FAA proposes rules for drone flights
R
aerial systems operations. Commercial flight is prohibited in the U.S. without a waiver from the FAA. The new policy allows operators with waivers to automatically Lance Evans receive a certificate of waiver or authorization for flights at or below 200 feet. Operators must comply with existing FAA requirements for UAS use, but this updated policy eliminates the need for operators to apply for a waiver for each block of airspace they wish to use. The policy will apply to the current class of waiver-holders and to all successful petitioners between now and the time the rules for commercial UAS use are finalized. It is expected that this new policy will open up new areas of airspace
to operators and their businesses. While drones are exciting new technology, until the rules are finalized the Jefferson-Lewis and St. Lawrence County Boards of Realtors remind sellers that real estate professionals cannot use drones to aid in the selling and marketing of properties. “Currently, using drones to market and sell either residential or commercial property can result in heavy fines for agents,” said Korleen Spilman, president of the St. Lawrence County Board of Realtors. “But when the rules are finalized, drones will hopefully become an exciting, new tool to help sellers make their property even more attractive to buyers.” Visitrealtor.org/drones for more information and updates as they become available. n LANCE M. eal estate agents across the country have been waiting for the Federal Aviation Administration to release guidelines permitting the use of drones for commercial purposes, such as marketing real estate. This spring, the FAA released its proposed rules, which would allow realty professionals to use drones to aid their clients in marketing and selling properties. Unmanned aerial vehicles, more commonly known as drones, are aircrafts without a human pilot aboard. The applications for this new technology are varied and numerous. Property managers are interested in drones’ property inspection applications while real estate agents hope to use drones to capture videos and pictures that help visualize and market clients’ residential and commercial properties. “New drone technologies can help real estate agents market homes and properties in ways that were cost-prohibitive in the past,” said Elizabeth Miller, president of the Jefferson-Lewis Board of Realtors. “Aerial photography and video could someday be an added value that Realtors provide for all of their clients, creating eye-catching listings that stand out to potential buyers.” The new rules provide guidance on the various permits and registrations operators will need to obtain, when and where the drones can be used, and the requirements for reporting accidents or injuries. It will likely take two years for the rules to be finalized and go into effect. Some requirements included in the proposed rule are: Commercial drones’ flights would be restricted to 500 feet in altitude, 100 mph of speed, and daylight hours. All flights would need to be within visual line of sight of the person operating the drone. Operators of commercial drones would be required to pass an aeronautical knowledge test to be issued a permit to fly, which must be renewed every two years. This would be different from receiving a pilot’s license. On March 24, the FAA updated its waiver policy for commercial unmanned

Take care of repairs during a sale

any questions arise during the home-buying process. Buyers looking at homes that require a good deal of TLC may wonder who is responsible for the home’s repairs, particularly if such repairs are needed to secure a certificate of occupancy. Depending on the situation, there is no clear-cut answer. There is no perfect home, and things that are acceptable to the current owner may not be acceptable to the buyer who is looking to become the next owner. The home-buying process is typically a careful cooperation between buyer and seller to find a middle ground. The buyer may have to make some concessions, as will the seller. Ultimately, it is this cooperation that often determines if the sale goes through or is terminated. Before any negotiations can begin regarding repairs, it is adviseable for a buyer to have an independent inspector come out and look over the home and property. Most real estate agents will suggest this be done as a first priority -- even before a contract is entered on the home. An inspection will unveil any potential problems in a home and indicate things that the buyer may not be aware of, including items that do not meet with code or could be unsafe. An inspector also may point out problems that could cause a mortgage lender to give pause. This may mean the lender will deem problems unsafe and refuse to fund the mortgage until repairs are made.
A copy of this inspection report should be sent to the home seller to review with his or her attorney and real estate agent. The buyer working with his own real estate attorney and agent can petition for certain repairs to be made. Many sellers will make such repairs to ensure the purchase goes through, or they will accept

Buyers might want to hire a good real estate attorney to write clauses into the contract to protect their interests. This allows the buyer to forfeit the sale and walk away from the contract should an issue arise. The rules often change when buying a home that is a short sale or in foreclosure. A home that is in distress is typically in this situation because the current owners cannot afford to pay their mortgage, and thusly, are not able to afford repairs. According to Think Glink, a moneymanagement Web site, buyers may try to negotiate repairs with the seller, but they shouldn’t assume that sellers (or lenders in the event of a bank-owned home) are
responsible for the repairs. Generally speaking, most short sales and foreclosures are sold “as is” and may even specify that repairs and requirements for the certificate of occupancy are the buyer’s responsibility. A buyer also can ask to have the home price reduced to cover the repairs. But foreclosures are often already deeply discounted. Buyers should know that, homes not in foreclosure, there are some repairs that should ultimately be the responsibility of the seller. If these repairs are not made, a buyer should think strongly about walking away from the deal, according to Why6Percent.com, a real estate marketing site. Such repairs include: n Lender-required repairs that could impact home safety n Leaky pipes n Water penetration issues, including a bad roof n Unsafe decking or handrails n Wet basements or crawl spaces n Insecure foundations or obvious structural damage n Poorly functioning sewer lines or septic system It is always adviseable for buyers to speak with a reliable real estate attorney and a trusted real estate agent to guide them through the process of buying a home. These people can help buyers navigate the important decisions that can affect the home they’ll be living in for the next several years. — (MS)

hether the kids have all grown up and moved out or if the kids are on the way and it’s time to expand a living area, building a new home is an exciting, yet often agonizing, experience. The reasons for building a new home are many, but regardless of the reason, the process of choosing a builder should remain the same. Andrew Nadalin, president of Pace 2000 Inc. and a fourth generation builder and craftsmen, offers the following advice to prospective homeowners with their eyes set on building a dream home to call their own. n Look for a builder with a solid reputation. A builder’s reputation speaks volumes, but it doesn’t have to speak for istself. That’s because a builder who has spent years providing personal service, innovative design and quality workmanship will no doubt have a host of happy former customers ready and willing to offer their input. If during the interview process a builder appears reticent to share his work or experiences with previous customers, this should be a red flag. Reputable builders will be proud of their work and more than willing to show it off. n Find a builder who is flexible. You will be paying to build your home, not the builder’s home. A builder should be flexible and ready and willing to meet your needs, no matter how unique they might be. n Look for a builder who does more than build. A good builder should do more than just build. A builder should provide a network of qualified professionals to make the process go more smoothly. This network should include real estate and building consultants, interior designers, architects and engineers. Such connections can provide peace of mind and will also illustrate that a builder is both respected in the community and is intent on ensuring your home becomes the dream home you envision it to be. n Don’t build on the cheap. Buyers who plan to build their own home are in the unique position to ensure their home is as safe and high-quality as possible. This isn’t always the case when buying a resale, so make the most of your opportunity and use only top-of-theline construction materials and features and choose a builder with experience in working with such materials and features. Building on the cheap could prove disastrous in the not too distant future, so don’t sacrifice on quality when building a new home. — (MS)

uying or selling real estate is rarely free of complications. Unforeseen issues often arise during real estate transactions, and in such instances a real estate attorney can prove invaluable. While buyers, sellers or veteran real estate investors might be able to handle minor or routine issues on their own or with the help of their realtor, more complex matters are best left in the hands of a real estate attorney. One of the benefits to hiring a real estate attorney when negotiating a complex or potentially complex real estate transaction is the expertise that lawyers can bring to the table. Realtors may have vast experience buying and selling homes, and many are adept at negotiating as well. But realtors are not licensed to practice law, and even the savviest realtor would admit that offering legal advice is not his or her forte. Men and women involved in complex or potentially complex real estate transactions would be wise to hire a real estate attorney, and the following are a few things to consider before hiring someone to represent you.

Experience One of the reasons to hire a real estate attorney is to make use of their experience. Hurdles have a tendency to spring up during complicated real estate transactions. Men and women involving themselves in development deals or buying rental properties likely won’t see potential red flags as clearly as a veteran real
estate attorney will. When interviewing a real estate attorney, ask how long he has been working as a real estate lawyer and how long he has been practicing in your particular state and city. Zoning laws and other restrictions vary from state to state and city to city, so look for a lawyer who has considerable experience in your state and city or the state and city where the transaction is taking place. plan of action When interviewing prospective attorneys, don’t assume each one knows the best way to approach your particular case. Provide the details of your transaction and then ask each attorney to explain how they would approach the case. A veteran real estate attorney should be able to provide a detailed account of how he plans to represent you, including what needs to be done to get the transaction off the ground, any potential hurdles that might need to be cleared and how to clear those should they arise. Avoid attorneys who give general or ambiguous answers, as such answers may be poor attempts by the lawyer to mask his or her inexperience with transactions such as yours. Some attorneys may request time to develop a plan of action, and you should not immediately remove them from consideration, especially if they ultimately answer the question in thoughtful detail. Real estate transactions are rarely inexpensive, so you don’t want to be blindsided down the road when your legal bills come due. representation When interviewing an attorney, many people assume the attorney they initially interviewed will be the person who represents them throughout the transaction. However, the day-to-day work on your case may be assigned to a junior associate or even someone who isn’t licensed to practice law, such as a paralegal or a current law school student who is interning with the firm. These people might be perfectly capable of handling your transaction, but you should meet them before hiring the firm to represent you. long, gravel driveway leads motorists peacefully toward Lake Ontario through the woods where a modest-looking, contemporary home, aptly named the Orenda, spreads out majestically in front of the water at 4,300 square feet. Towering greens and leafy bushes comfortably shade the driveway where deer and other wildlife watch from afar, as dusty cars amble toward the house. The deer are safe on this 18-acre spread. They are home. It is the same feeling property owner Dana Keefer felt when she and her husband first
set foot on the property in 1998. “When I walked onto the lot it was a swampy mess with scrubby-looking cedars and bumpy ground,” Mrs. Keefer recalled. “It was not very attractive. But when I came out to the shore to look over the water I felt my shoulders go down about eight inches. I felt unbelievably calm. I imagine this land was once some kind of healing site for the Iroquois. Guests seem to sleep better and tell me they feel very calm here. So I named the house Orenda to reflect those feelings.” Orenda is an Iroquois word that means the Great Spirit is found in all things. Knowing the condition of the property had to change, the Keefers brought in
truckloads of dirt to level the land and give the limestone-plated lot some new earth so builders and architects could construct without incident. Foliage and trees were also planted, and gardens with colorful bushes and flowers were laid out. Today those gardens are landmarks on the property, and have been a stop for several tours through the years to benefit Hospice of Jefferson County. The Henderson Garden Club also frequents the grounds. Not far from the main garden that centers the circular drive is the cedar-shingled home, which immediately boasts an Adirondack Great Camp style porch. This porch is the primary entryway. It is quaint, welcoming and rustic.

This architecture, which incorporates natural materials such as wood, clay and stone, sparked a revolutionary shift in the American interior. It was that revolution Mrs. Keefer grasped onto when she shared her vision with designers and architects as the house began to take shape at the turn of the millennium. The result is a magnificent home that boasts unique features not likely to be found anywhere else in the north country. The Wright style of design doesn’t fly solo in the $1.4 million-dollar home that was built in 2004. The Arts and Crafts panache also shows up. Arts and Crafts is a style well known for its straight, linear
lines and clean edges. It first emerged in Europe and North America in the in the 19th century, surfacing later in Japan in the 1920s. The entrance doorway at the back of the house boasts this technique loud and clear with a series of 16 square windows that can illuminate the entryway with remarkable, linear rays of light that add its own unique elegance to the home. This humble collection of Craftsman windows is just the beginning; 115 windows in total don the great walls of Orenda, bringing the spirit of the Frank Lloyd Wright style full circle. Even with the inspired aforementioned styles of architecture, Mrs. Keefer wanted to make sure the inside of the home em-

Inside, the look and feel of the home is inspired mostly by the work of Frank Lloyd Wright, an architect of the early 20th century responsible for designing structures that were in harmony with humanity and its environment, a philosophy he called organic architecture. This is immediately recognizable with the rock walls made of New Hampshire granite and Pennsylvania bluestone that start as a partial wall in the foyer or dining room and then creatively push out into the exterior of the home where it picks itself up again as a garden wall. Wright shaped a new way of living through his design. He shepherded a style of architecture characterized by open in-

have to be tucked away here, however. Below the loft and just off the master bedroom is the guest suite. Two bedrooms, a full bath and an open sitting area offer visitors comfortable places to rest. A small deck completes the wing, giving guests an option take a cup of coffee or the morning paper outdoors. Outside on the beach, Mrs. Keefer stands at the edge of water and looks down into it. She points to the greenish-grey rock clearly seen just inches below the tiny waves that play-
fully meet our feet from the lake. “See that limestone there?” She references the slippery stone that stretches several feet across under water. “See how it’s jagged and smooth and all different levels? When we built our deck we wanted to emulate this. That’s what Wright would have done. So we used different levels and angles on the deck so it would mirror the limestone ledges in the water.” The beach is brought back inside where smooth shore stones are used as

braced more of the Great Camp style. And with its natural woodwork and cathedral ceilings, it certainly does. It begins in the great room, where a fireplace made of river rock and large wooden beams meets the cathedral ceilings with grace and ferocity. The style shows up again above the master bedroom. Acting as a third story, a campy library loft rests quietly atop the bedchamber where three great beams stretch across the master space. The loft above is a place of solace; a place where writers and readers and dreamers can curl up in a chair and gaze up at the Scandinavian designed bookshelves as they contemplate their next read. This space is where the door to the attic is found. It is also where a large, hidden room resides, ready to be transformed into a private office, a guest room or an exercise room. Guests don’t

And in the round tower dining room highlighted with a sturdy copper ceiling, the delicate, yet prominent lighting comes front and center once again. The lights here are called Tivoli lights, and hug the entirety of the copper ceiling. With a quiet radio and simple meal, the dining room becomes the epitome of elegance and peace as one takes in contemplative conversation with the splash of Lake Ontario just a few feet away. The round dining area is a special place of retreat. North country winters can be harsh, which is why the installed windows are thermal.
