D ear G entlemen: Old Dominion University (the "University") appe als the decision o f a hearing officer that revers ed its issuan ce of a Group III noti ce o f disciplinary actio n terminating Mr. Birkrne yer's em ployment as a University police o fficer and awa rded him substantial attorn ey's fees. The admi nis tra tiv e proceeding was pr otracted and co ntentio us.
Motion to Dismiss The University filed its N oti ce o f Appeal on Mar ch 20 th . Before it co uld file a brief Mr. Birkmeyer flied a m oti on to dismiss. He asks me to dismi ss the appeal because: (1) the University did not provide a co py o f th e N oti ce of Appeal to the Director (the "D irector" ) of the Department of E mploym ent Di spute Res oluti on (th e "Department"), (2) the N otice o f Appe al is broader than the permission to appeal the Director granted the University, and (3) the N otice of Appeal did not specify how the final decision was contrary to law. I deny the Moti on, Section 7.3( a) of the G rieva nce Procedure Manu al doe s provid e that a copy of the N otice o f Appeal "must be provided to the .. . EDR Director." The Court' s jurisdiction, however, is granted by statute and an executive agenc y may not circumscribe the exercise o f that jurisdictio n by the adoption of rules . Code of Virginia ยง2.2-3006(B) do es not impose any requirements o n th e content o f the Notice of Appeal; nor does Rul e 1:4(d).
