Apparently, even in hard times, mortgage fraud remains an easy con. The number of Suspicious Activity Reports (SARs) for mortgage fraud tracked by the Federal Bureau of Investigation could skyrocket by nearly 300 percent this year. Compared to 2007, mortgage fraud SARs in 2008 had already increased by more than 36 percent to 63,000. But just two months into 2009, the FBI has already documented nearly 29,000 mortgage fraud SARs. At that rate, some 174,000 SARs, • a 276 percent increase • could be filed by the end of the year. And that's only what the FBI can see. "Many mortgage finance-related entities are either loosely or completely unregulated at the state or federal level," said FBI Director Robert Mueller in recent testimony before the U.S. Senate Appropriations panel. The good news? "The current financial crisis has pro-
duced an unexpected consequence. They have helped reveal numerous mortgage fraud schemes, Ponzi schemes, and investment frauds, such as the Bernard Madoff scam," Mueller testified. But while the Feds are catching up with Wall Street crooks, struggling homeowners on Main Street remain common prey. Despite tougher lending standards putting the kibosh on some types of home loan scams, organized wise guys continue to traffic in mortgage fraud. That's prompted the U.S. Department of the Treasury, the U.S. Department of Justice (DOJ), the Department of Housing and Urban Development (HUD), the Federal Trade Commission (FTC), and the Attorney General of Illinois to launch new initiatives to pump up fraud investigations and step up enforcement actions, especially to protect homeowners seeking relief from President Obama's Making Home Affordable initiative. The effort particularly targets loan modification and mortgage fraud. Mortgage fraud, a
relatively new form of organized crime, first cashed in on the greed that came with the boom market, when some buyers would do anything to own a home including lie on the application. Cons, often insiders, also falsified documents, inflated appraisals and used other underhanded techniques to get home loans approved and properties flipped for a hefty profit when appreciation was skyrocketing. With the housing market bust, however, came stricter underwriting scrutiny which helped stem the tide of loans approved with fabricated information. Now, mortgage fraud is taking advantage of vulnerable, gullible homeowners facing foreclosure. Like those who once fibbed to cash in on the booming market, many struggling homeowners are likewise willing to do anything to remain homeowners. Mueller said today's host of sophisticated scams are associated with new loan modification services, foreclosure bailouts, equity grabs, bankruptcy, identity theft and

Bruce Hahn, president of the American Homeowners Foundation, a non-profit advocacy group in Washington, D.C. says it's tough to tell the good guys from the bad without a scorecard. "Some loan modification services are competent, but some are incompetent and there is another group of people who post ads to help with mortgage problems, but are basically fraudsters and fronts," Hahn said. The FTC recently surveyed online and print advertising for mortgage foreclosure
rescue operations nationwide and identified approximately 71 distinct companies running suspicious ads. It's clear homeowners, who want to avoid being taken by the new scammers must likewise become more sophisticated. The experts advise: • Don't be a rube. If it sounds too good to be true • it probably is. Debts, bad credit and other financial holes didn't appear over night. They won't magically disappear over night. "A fair number of homeowners have actually paid someone money before they
see us. They see us because they paid and the company didn't do anything for them," said Martin Eichner, director of housing counseling services for Project Sentinel in Northern California. • Be wary of strangers and unsolicited contacts, as well as high-pressure sales techniques. Avoid spam come-ons and web-based advertisements promoting the elimination of mortgage loans for an up-front fee to prepare documents to satisfy the debt. Beware of offers to "save" you from defaulting on loan payments or from (con’t. on page 4)

foreclosure. "The most outrageous of these schemes are offers to take your mortgage payment and hold them for you in a trust account. That is a total rip off. Never give your mortgage payment to any third party," Eichner said. • Attempts to cajole you into making false statements in the name of mortgage relief is a red flag. Likewise don't sign
blank documents or those you don't understand. • Seek out family, friends, co-workers and others you trust who recently successfully solved a mortgage problem. Ask them for referrals. That applies to loan modifications, work outs, restructuring and refinance efforts. "I would say contact a U.S. Department of Housing and Urban Development, but you can't just say that. We can't help everybody who needs help (because of over-
whelming demand). If you hire a for-profit service you should be paying money only if (and after) they are successful. If they are an attorney, contact the state bar. For mortgage brokers (and real estate agents) check with the California Department of Real Estate," Eichner added. Hahn also says to contact city and county housing offices for assistance and referrals and the latest information on legal, government-sponsored assistance.

you may not realize that he was a real person. John Chapman spent 50 years planting apple trees around the country in the easly 1800s, afd I think that qualifies him as a true energy pioneer. Trees, you see, do a terrific job of cutting down on heat and also improving the air quality, primarily in the heat islands that are a special problem in large urban areas. The problem is that heat from the sun gets trapped by buildings, pavement, asphalt and other dark areas that absorb rather than reflect it. Regardless of what the weatherman says the temperature is in hot weather, areas around buildings can be 6 to 8 degrees hotter. You not only end up using more air conditioning to cool off your home, but the higher temperatures can make people uncomfortable and can also lead to health problems like heat exhaustion or breathing ailments like asthma and other concerns caused by smog and pollution.
A study in New Jersey a few years ago found that temperatures in Newark, for example, were as much as 11 degrees higher than they found in the city’s suburbs. While the problem of heat islands is usually worse in big cities, it is still a factor in most urban settings. This is where we get back to Mr. Appleseed. Planting trees is a great way to provide shade on the roof and walls of your home, helping keep temperatures lower. In your case, if you start planting trees in your yard now, you’ll notice increasing benefit from the shade as the trees get bigger every year. Remember what you learned about evapotranspiration back in school — trees give off water droplets that draw heat as they evaporate, and this helps keep the area around them cooler. In fact, research has found that a properly watered tree reaching a crown of 30 feet can actually give off as much as 40 gallons of water every day, an amount equal to getting rid of all the heat that would come from using a small electric space heater for four hours. Trees are also great at absorbing carbon diox-
ide and filtering pollutants from the air, absorbing sound, helping prevent erosion, and giving birds and small animals places to live. I also recommend trees as a first step in any home landscaping project because they can block strong winter winds and help channel summer breezes into the home. Once you get trees planted, there are a variety of bushes, shrubs and ground covers that can help improve the appearance of your home while providing shade and protection from the winds. I think it’s important to use native plants and grasses (a strategy called xeriscaping) when possible to minimize maintenance and watering. There’s a good Web site on heat islands (www.eetd.lbl.gov/heati sland) that will tell you more about the benefits of trees in improving the comfort level in your home. name only few are familiar with. The plant’s popularity is being driven by the Athens Select program, courtesy of the University of Georgia. Iochroma has been around, but mostly through specialty catalogs or at homes of tropical plant nuts and those who obsessively search out hummingbird plants. Though you might not know the name, you will recognize the Solanaceae family. That’s right — this striking plant is in the family with tomatoes, peppers and brugmansia, or angel trumpet. The Royal Purple Queen is similar to the angel trumpet, and a lot of information refers to it as a mini angel trumpet. Royal Purple Queen is a large plant that develops a shrub-like appearance. It can reach 3 feet with a single bound, and I have seen some closer to 5 feet. In mild climates, it may hit 8 feet tall. It is also fairly wide, reaching 24 to 48 inches. It comes to us from western South America. The leaves are large and velvety, giving a slight gray appearance, but it is the flowers that dazzle. Royal Purple Queen produces clusters of 3to 4-inch-long, dark purple flowers all summer. There may be 20 to 30
flowers in a cluster. Royal Purple Queen was sold at our Mississippi Garden and Patio Shows this year and quickly disappeared off the shelves. When you find yours, select a site with fertile, well-drained soil in full sun. Athens Select is touting them as being perennial in zones 7 and higher. This means that in our area, they will die to the ground in the winter and return like angel’s trumpet. The Royal Purple Queen also makes a nice tub or container planting, but keep it in full sun so it will look its best. In the landscape, it will look incredible planted in a tropical partnership with bananas, cannas like the Bengal Tiger and the old-fashioned candlestick plant with its yellow, candelabra-like blossoms. In the perennial garden, use it much like you would the blue anise sage or Salvia guaranitica, another outstanding hummingbird plant. The purple flowers scream to be grown close to yellow. The Mayan Gold tecoma or esperanza are great choices, as are some of the new yellow zinnias like Zahara Yellow or Profusion Yellow, which is coming out in 2010. (con’t. on page 13)

But your outdoor party can be spoiled quickly if unwelcome insects show up. More than half of backyard revelers have moved a party indoors due to mosquitoes, and 46 percent have left a party to escape the pests, according to a new survey from the makers of OFF! Perfect for roofs, awnings and patio covers, they are ideal for keeping large birds like pigeons and seagulls off of surfaces. With a plan in place, there are fewer opportunities for blunders and mishaps. Consider these basic preparation skills before your next painting project to help ensure everything comes together without a hitch.

Homeowners, apartment dwellers and condo renters get the itch to renovate and repaint while the weather is still pleasant. Especially popular are those rooms where people tend to spend the most time: the kitchen, bedroom and bathroom. Often times, however, that itch causes renovators and weekend warriors to hastily begin projects and thus make a colossal painting mistake: not planning out the
Timeline Yes, painting is relatively quick and painless, but it is not instantaneous. If you start painting at 4 p.m., you’ll be up all night. Before beginning your project, make sure you determine how long each step will take. Allow for appropriate drying time for both primer and actual paint application. into the basement and the first-floor subflooring under the bathroom. We had the leak fixed and have not had any issues since, but the mildew odor in the bathroom has persisted. We removed the insulation from the basement ceiling under the bathroom and noticed a small amount of mold/mildew on the subflooring. Is there a nonintrusive way to fix this, or do we need to have the bathroom hardwood floor and the subflooring removed and replaced? Also, would you recommend replacing the insulation? My husband is in favor of leaving it alone since the leak has been fixed, but I’m concerned about the odor and the mildew. A: I can see your husband’s point, since if you don’t leave well enough alone, it can lead to a lot more work and greater expense.
I don’t think you should leave it alone, however. Something got wet in that floor, and the moisture that normally accumulates in bathrooms and the dampness of basements — the lowest part of your house, finished or not — will often feed mold, especially that caused by a leak. I think you should consider removing the insulation. Perhaps, if the moisture is localized, you can treat it from the underside — opening it up from the basement ceiling, running fans, using bleach and water. If that doesn’t work, you might have to go the more expensive route. I hate to annoy your husband even more than I probably have already, but my suggestion is to hire a professional to do the work. preparation. If you paint a new color on top of walls that are already cracked and full of nail holes, the new paint is not going to adhere correctly. Instead, plan on washing the walls thoroughly and spackling any holes in the drywall before you apply the first coat of primer. A clean surface allows for a more even application and better quality finish. And don’t forget to use primer. Primer allows the paint to better grip the wall surface and thus helps to avoid cracking and peeling. End with a clean canvas If you start clean, you’ll end clean. That means you have to prepare for the final cleanup. Always be sure to secure drop cloths and painter’s tape to any area you don’t want covered with tiny little paint flecks. If you make sure to cover any exposed furniture, electronics, appliances and keep small children out
of the room, you’ll spend far less time cleaning up after you’ve finished painting. Up a creek without a brush Consumers sometimes forget that the tools they use to paint are just as important as choosing the right paint. A good rule of thumb is to have a multi-use painter’s tool, a sturdy roller frame with

If you choose the cheapest paint available, and then it starts to fall off the wall, it won’t matter what color it is. Some of the best quality paints are those manufactured specifically for durability. Color conscious There are a multitude of tools available to help you choose the right color for your space — everything from handheld color chips to poster sized adhesive sheets to actual sample size containers of paint. More importantly, don’t forget to choose colors that will flow from room to room. Color flow refers to how the colors in each room of your home mesh and blend with each other. Having a deep red dining room buttressed directly against a soft green kitchen with white trim may eventually feel like you’re living in a Christmas tree. Make sure to stay in the same color family. If you really love browns and reds, then stay in the warm and neutral color family. Don’t paint one room blue (a cool color) and have the very next room a shade or orange (a warm color).
