Flag city council agrees on constitutional grounds

eeting in special session on Sept. 24, the Flagstaff City Council voted unanimously to settle the ACLU

lawsuit. The suit was brought on behalf of Marlene Baldwin, 77. Baldwin was arrested for loitering on Feb. 22 after she had asked an undercover Flagstaff Police Department (FPD) officer for $1.25. The law governing the arrest is not a Flagstaff ordinance, but rather an Arizona statute. Prior to Baldwin’s arrest, Matthew Evans, a NAU Extended Campus part-time faculty member, was in the process of giving money to a Hispanic family that was holding a sign requesting help at the Safeway on U.S. 89. Evans was approached by FPD who informed him that his actions were illegal and constituted aiding and abetting. Evans firmly asserted his right of free association and successfully tendered his aid to the family. Concerned over the outcome of the situation, he went a week later to FPD headquarters to see if the family he helped had been arrested. They were not, but his discovery of the arrest of Baldwin caused him to take further action. “While police may claim that arresting this old Hopi woman for asking for a buck may contribute to the public safety . . . [it] seems quite the opposite. If the city portrays downtown and the rest of Flagstaff simply as a site of commerce — and nothing else — then the city becomes a place inhospitable for good deeds, virtue, connecting to people, building community and connecting to reality,” Evans said. He brought the Baldwin case to the attention to local attorney Mik Jordahl, who, after taking the issue to the ACLU, became co-lead counsel in the suit brought in the U.S. District Court of Arizona. The state has agreed the statute is unconstitutional and will review. The Flagstaff City Council called the special session to either formally accept or reject a settlement that would enjoin the city, most see CITY COUNCIL page 8

fter 11 months without a touchdown or a 100-yard rushing game, senior running back Zach Bauman finally broke through for both against the University of South Dakota (USD) Coyotes, leading No. 20 NAU to a 22-16 victory in its 2013 home opener. “It’s been six games since I scored a touchdown,” Bauman said. “It was great to get back in
