A passion for theatre Rev Rodney Dunlop is a man with a passion for people and the performing arts, so it’s understandable that he spends some of his spare time at the local theatre His talent for creativity has been put to good use by the Otamatea Repertory Theatre for the last three years — painting and creating sets. This year he worked on M*A*S*H and then the major musical, Annie. “I have enjoyed applying my artistic eye to building and painting sets for the ORT productions, helping to create the illusion of time and space that is all part of a theatre production,” he says. “Most of all, I’ve enjoyed interacting with a wide group of very talented people who enjoy music and drama, creating for others’ entertainment, and productions which often carry a challenging message for life.” Rev Dunlop has been involved with theatre for many years. “I’ve been on stage since I was about 11. This led to church and further school productions and, after I immigrated to NZ in 1959, I joined the Putaruru Drama Club. “Later at Massey University, I appeared in reviews and interuniversity drama tournaments. Since my ordination as a minister in the church I have written and produced many different plays to illustrate biblical stories and Christian truths. “Being part of the productions at Otamatea Theatre has been a wonderful return to the stage.”

Circus Kumarani has been gifted 50 tickets to sell for the Cirque du Soleil Auckland show, Saltimbanco, as a fundraising initiative, and it is looking for buyers. It is part of the Cirque du Monde programme started in 1995 and operating in more than 80 communities throughout the world, which recognises the benefits of community circus on marginalised youth. “Unfortunately ticket sales have been slow and the tickets will soon need to be returned,” said Kumarani manager, Jenny Huriwai, “The show is in Auckland on a Thursday night, which makes it really hard. Ideally, we’d like to put on a bus too but that’s an extra cost. “The tickets are $125 but we’re also running a raffle for some of the tickets too.” Saltimbanco will be at Auckland’s Vector Arena from August 25 to September 4, for a two-week season. Tickets are available until the end of the week from Kumarani Creative Centre, 14 Parenga Street, Dargaville or phone 09 439 5152.

A taste of Malaysia A nine-day journey into a new and exciting culture was a huge adventure for 23 Dargaville High School leadership students who used their own resources to raise their fares and spending money. Accompanied by school deputy principal, Takari Pumipi, and a group of adult supervisors, the students travelled to Malaysia. “In the past we have had trips to the Pacific, said Ms Pumipi. “This time, at the suggestion of our Malaysian staff member, Jin Hayhurst, we selected Malaysia and the visit was a great experience for all of us.” Over the nine days, the party was entertained at cultural shows, visited three museums and an art gallery, as well as enjoying a wide variety of Asian food and cooking styles. There was also an opportunity to visit a shopping mall and amusement park — all contained in a 22-storey high-rise building. “The project is all about students, who have shown service to the school and the community, raising their own funds and being independent and responsible for themselves,” Ms Pumipi added. Dargaville High plans to have a similar group of students visit Malaysia on another trip in the future.

New General Manager Operations for council John Burt comes to the Kaipara District Council as General Manager, Operations. “My role with KDC is about leading all operational activity and planning for future operational needs of the district,” he said. “One of my objectives is to build a constructive culture within KDC that results in achievement orientated people working as a team.” Mr Burt was born in Christchurch and grew up in the central North Island in smaller communities. Married with two adult children he lives in Mangawhai. He holds a Diploma in Business and a Masters in Management from Auckland University, and previously served as general manager and national operations manager for Adshel NZ. Outside of work, his interests centre on triathlon, hobby farming and sailing.

Where the wind blows

While the Crest Energy plan to place undersea turbines in the entrance to the Kaipara Harbour has approval, the actual technical side of the project seems still to be months if not years away from it actually happening. Some scientists postulate that while permission exists, the scale of expertise to actually place massive turbines in a channel where the tide flows at nine knots and the seabed shifts and changes, has yet to be developed. The seabed project has aroused the organised opposition of Te Uri o Hau. But not so the prospect of a wind power generation farm in the forest on the Pouto peninsula, about 70km south of Dargaville.

The hapu’s treaty settlement trust, has said the 3,200ha site would be able to generate up to 300MW — vastly increasing power generation by existing wind farms, which produce about 170MW. “Embarking on this project proves the point that we are not opposed to renewable energy as a matter of principle,” the hapu says. “It is that the Crest Kaipara Harbour experiment is at the mouth of a harbour that is already under ecological stress and is a taonga for Te Uri o Hau and Ngati Whatua. Unlike the Crest project there are many examples and locations of wind turbines in the North Island that we can compare with.” Matters under consideration in relation to the wind turbines being placed on the land include wahi tapu areas, shifting sand, existing pine trees, ecological factors including bird flight pathways, noise, employment opportunities, and social factors including housing capacity. While undersea turbines are nothing if not experimental harnessing the wind has proven to be one of the cleanest, most sustainable ways to generate electricity. It has its detractors — but those seem to be from urban areas in sight of the windfarms, affected by ‘visual pollution’ and perhaps the incessant rumble of turbines.

Poutu then would seem an ideal spot, and an ideal alternative to delving beneath the sea. For the writer, the choice seems fairly obvious, but then again, I spent many years on Great Barrier Island — where wind-power — a rattling three-bladed propeller spinning a small generator, topped up batteries to provide all the light, TV and radio we needed. And hey, a wet-back stove did the cooking and water heating. There is something to be said for simpler times.

Giving wholehearted care to the older person Happenings at Kauri Coast Rest Home and Hospital. The big thing at the moment is the development of the garden area inside the new fence at the front. We have had several meetings with residents to develop the plan and this is looking good. Plants have been purchased and we are now deciding what paving we want the path constructed of. That decision is to be made next week so we can proceed with getting a price on its’ laying. I have offered my services but staff and residents have suggested I stick to what I do best. This is promising to be a great area for residents to relax, contemplate, stroll and enjoy. Two features will be an old style two person ‘love seat’ and a farm style gate along the path. We are looking for someone with the knowledge, skills and tool who would volunteer to make these for us. They will be long lasting and will be a very special contribution to the residents environment. If you would like to get involved in this project please speak to the manager, assistant manager or activities officer at the care home 09 439 6367. We are also in the process of planting some fruit trees along the back of the property for the enjoyment of residents and staff when they come to fruition. Speaking about volunteers I will take this opportunity to thank all those who do contribute to the residents quality of life. The Dalmatian group who came and entertained with music and dance recently and the ballroom dancers who came the same night. The church groups who come and sing, pray, take services. The Kapa Haka groups that have and do come and perform. The schools that have come and sing and play instruments. The highland dancers that come and perform. The pianist who regularly comes and entertains. The artist who holds a group each week. The RSA man, yes, you know who you are Dick, who supports the residents. Those that just come and talk to residents. I believe I have covered most, if not all. If I have missed anyone my apologies. We really do appreciate all that partner with us. There is still room for others. If you can read a newspaper out loud and discuss some of the contents with a small group there is a place for you. Maybe you would like to support taking people on a van ride once a week and could assist the driver. Perhaps you have a talent or skill you would be prepared to share. We recently had someone with a sewing machine that does embroidery come and demonstrate. It is our ongoing aim to build links with the community that will enrich your lives and those of the residents. If you would like to discuss what you can do, big or small, we would be happy to have a no obligation talk with you. With minimal effort you can make a huge difference and be surprised at how much you will get in return.

Whatever, wind energy is the fastest growing source of electricity in the world. The United States has installed in excess of 8,500MW capable of powering more than two million homes. The technology is both old and new. From the grain mills of the pre-industrial world, to the latest high-tech wind turbines, we have used the power of the wind for millennia. The modern wind era began in California in the 1980s. Small companies and entrepreneurs installed 15,000 medium-sized turbines, providing enough power for every resident of San Francisco. Pushed by the high cost of fossil fuels, a moratorium on nuclear power, and concern about the environment, the wind industry took off.

Fish and Kumara Pie Ingredients

5 large kumara, peeled and diced into 2.5cm squares Salt and pepper 2 eggs 2 large handfuls of fresh spinach 1 carrot, halved and finely chopped 1 onion, finely chopped Extra virgin olive oil 285ml cream (or double cream) 2 good handfuls of grated cheddar or parmesan Juice of one lemon 1 heaped teaspoon English mustard

Method Oven to 230° C / Gas 8. Put potatoes into salted boiling water for 2 minutes. Add eggs and boil till hard boiled and potatoes cooked. At the same time steam spinach in a colander above the pan. Steam 1 minute then remove and gently squeeze excess moisture. Drain potatoes, remove eggs, cool, then peel and quarter. In a separate pan slowly fry onions and carrots in a little olive oil for about 5 minutes, then add cream and bring to boil. Remove from heat and add cheese, lemon juice, mustard and parsley.

Parsley to taste

Put spinach, fish and eggs into an appropriate sized oven dish and mix together, pouring over the creamy vegetable sauce.

Mash kumara with a smig of olive oil, salt and pepper and spread over top of pie. Bake 25-30 minutes until top is golden brown.

Te Hana’s welcome to the North

Te Hana Te Ao Marama — the new dawning of Te Hana — is an exciting Ngati Whatua ki Kaipara Maori Cultural Tourism Centre with a difference. “After ten years of hard work, thousands of volunteer hours and tireless amounts of fundraising, this beautiful complex is living proof that dreams do come true,” says CEO Linda Clapham. “In fact, it’s been a battle against the odds because Te Hana has rebuilt and reinvented itself.” The centre covers a total of ten acres, with a huge carparking area, just off State Highway One. “We have an array of different cultural activities for visitors to experience including our recreated 17th century Maori village and model pa, which allows people to take a glimpse at pre-European Maori life with a guided tour. “As well there is entertainment with Te Hana’s professional cultural kapahaka group and

Although the conditions were wintery Mitchell reports it did not prevent the ship sailing in and around the Hauraki Gulf. During the voyage Mitchell experienced shipboard life to the full including climbing the sails and other activities such as raft paddling, hiking, beach clean ups, Burma trails and team building exercises. He also established some strong friendships with other students whom he plans to keep in touch with. A highlight for Mitchell was when the trainees took over sailing the ship on the last day. Mitchell was elected Second Mate and was in charge of running all the sails at the front of the boat. It was very rewarding knowing they had learned enough and were capable to run the ship, even in adverse conditions! Mitchell reports the experience of living and working together

There is safety in servicing by Our Motoring Correspondent A recent television programme made much of the vehicle repair industry, and whether or not various garages were up to the job of fixing cars with problems. Allegations were made of over charging and lack of professional workmanship on the part of the odd mechanic. In this day and age, vehicles usually come with very competitive warranties, many with several years for the drive train. So it is perhaps no surprise that the old days of DIY maintenance, oil changes and suchlike, have pretty much gone by the board. ‘Who needs servicing’, you can hear them cry. But it appears that 50 per cent of the drivers on New Zealand roads are just looking for trouble, and at the same time compromising road safety. A new Motor Trade Association survey shows that more than half of those car owners seen are failing to have their vehicles regularly serviced. That’s pretty much half of us driving around on a wing and a prayer. Servicing schedules are developed for each make and model of vehicle, by the manufacturer, to ensure top performance and reliability. By neglecting to have basic servicing work carried out on a regular basis, those drivers may be missing out on the opportunity to reduce

both running costs as well as emissions, and heading for major problems down the track. The survey of 500 vehicles was carried out in April this year at 25 service stations across the country. The findings were worrying, according to MTA manager, Ian Stronach. “New Zealand already has an old fleet by world standards, and it’s getting older. The level of non-service, whether through lack of knowledge or just overstating the condition of their vehicle, means owners may not just be using more fuel than is necessary, but adding to overall emission levels as well as potentially putting the safety of their vehicle at risk too.” The survey found that the distance by which vehicles were beyond their scheduled service point, ranged from just a few hundred to nearly 80,000 kilometres; the most common were between 2,500 and 5,000 kilometres. On a time basis, that ranged from just a few days through to a worst case of 1,043 days; the average time being 175 days overdue. Many of the vehicles were well outside the ‘oversight’ stage. Clearly there are a significant number of owners prepared to forgo regular servicing of their vehicle. On a sustained basis, failure to service invariably leads to a vehicle failure.

The Proposed Kaipara District Plan A group of Kaipara ratepayers are so concerned about the impact of the new Proposed District Plan on existing and future generations of Kaipara residents, that they have, at their own expense, commissioned an opinion on the plan from eminent QC, Paul Cavanagh. Below you will find reported comments on the new District Plan by Mayor Tiller, followed by extracts from the Cavanagh Opinion.

What has the Kaipara Mayor had to say about the plan? In an open letter to all Kaipara residents run in the local press some time ago, Mayor Tiller stated the proposed plan was an enabling plan which lets you do any activity anywhere provided you mitigate the effects. The plan describes the effects to be mitigated. The council believes it is an enabling plan which encourages growth and allows farmers in particular, to get on with the business of farming. He also went on to state that the council has an obligation to submitters and others involved in earlier consultation to complete the process and issue its decisions, and allow the rest of the Resource Management Act process to take its course. This is what is intended by the legislation. To now not follow this course of action is likely to put council at risk of substantial costs by others taking action to ensure the process is completed. Mayor Tiller concluded his open letter with the statement, ‘While council accepts and respects the view of the Kaipara community, it must take the wider view, and act in the way it believes is in the best interests of the Kaipara District’.

Excerpts from an opinion by P. T. Cavanagh QC Reasons which may be taken into account in determining whether withdrawal of the District Plan is appropriate . . . I have seen the Kaipara District Plan and consider that it reads as an extensive, sophisticated and complicated document that establishes significant constraints on rural development in contrast to the positive development opportunities that were available under the provisions of the Operative District Plan. In my opinion it should be accepted that the proposed plan has to be considered against the background of a diverse and relatively poor rural, and rural town community. This does not indicate any justification for the imposition of a District Plan of the complexity and encompassing the restrictions implicit in the Council’s proposed plan. 1. The proposed plan in that context appears to be in conflict with s5 RMA because it fails to meet the need to enhance the social and cultural wellbeing of the wider community. 2. The proposed plan has introduced rural subdivision provisions that impose controls that are so restrictive as to remove all reasonable subdivision opportunity in the rural parts of the district. The opportunity that has been lost is therefore the chance to improve the environment and ecological standards of the rural area as part of rural subdivision development activities. 3. The proposed subdivision rules also appear to prevent people who wish to live, invest and modify the use of land or undertake conservation and ecological activities from doing so as part of a rural subdivision opportunity. The standards for subdivision appear to be set so high (with an average of 12ha being required) that it is unlikely that the rules will promote any form of ecological or conservation enhancement in the rural environment. 4. If this is accepted, then the subdivision rules fail to reflect or implement the intentions of the objectives and policies for the rural zone which seek ecological and environmental improvement as part of the rural development dynamic.

5. I am also of the opinion that the imposition of the Kaipara Engineering Standards 2009, under relevant provisions of the proposed District Plan raise unacceptable difficulties for applicants. These Standards impose costs, design outcomes and restrictions on development which may be impractical and appear to lack any relationship with the proposed purpose of small scale rural subdivision even if the plan achieves consent. The Standards are onerous to the extent where they may be seen as a deterrent to rural development. 6. From the review of the collection of rules, methods and assessment criteria for rural development set out in Chapter 12, they appear to challenge the use of rural land for productive purposes as well as preventing reasonable sub-division and development that would otherwise generate an enhanced ecological and conservation environment within the productive rural environment. 7. I am told that the Northland Regional Council filed a submission in opposition to the provisions of the District Plan upon the basis that they were premature and failed to anticipate the need to take into account directions that would arise from the preparation of a new Regional Policy Statement. The Council has proceeded with its proposed plan contrary to this advice. 8. I am also told that many submitters requested that the Council take its lead from the now Operative Far North District Plan which I believe is regarded by the Environment Court as providing a good model for the balancing of rural and coastal development opportunities, taking into account the need to protect productive land for rural productive purposes. This approach appears to have been ignored by the Council and its consultants in the preparation of the proposed District Plan. I wish to stress that it is for the council itself when considering a proposal to withdraw the District Plan to establish whether such reasons are sufficient to justify withdrawal of the current proposed District Plan. In making that decision, regard may also be had to the cost the council has already incurred in pursuing the plan to this stage.

It is necessary for the council to take advice from the district solicitors to seek an estimate of the likely further costs involved in achieving an operative status for the proposed plan given the extensive appeals that will arise from submitters unlikely to be satisfied with anything less than a considerable revision of the proposed plan’s direction. The questions that you have asked me to respond to are as follows: Under Clause 80 of Schedule 1 RMA the local authority is permitted to withdraw a proposed plan. Are the present circumstances such that Kaipara District Council is able to exercise the provision of Clause 80 for both the proposed plan and Variation 1. 1. As I have stated, it is necessary that the Council satisfies itself whether it is justified in taking such a step. If I have correctly set out matters which may be taken into account, the Council may feel confident that withdrawal of the proposed plan is the correct decision to make. It will also be necessary to consider whether re-casting the plan provisions to address concerns exposed at submission stage could avoid incurring unnecessary litigation costs that would be involved in defending the plan in its present form. 2. If the proposed plan is withdrawn in its entirety will the operative plan revert to being the dominant statutory instrument for RMA purposes? The operative plan will revert to being the dominant statutory instrument for RMA purposes. Q. Is it possible for submitters/further submitters to take the council to the Environment Court if the proposed plan is withdrawn before decisions on submissions are adopted and/or seek costs in relation to the preparation of submissions and hearings? A. I do not believe so, particularly if the relevant resolution makes it clear that the Council intends proceeding immediately with an amended plan and completing the review process with that plan. Q. Does the Environment Court decision on Chapter 18 (Variation 1) mentioned above add any complication? A. It is envisaged that Chapter 18 would be withdrawn along with the entire proposed plan. I have envisaged that the decision would involve the withdrawal of the whole Plan including Chapter 18. (Variation 1). A decision to withdraw only part of a plan can create particular problems that I have not addressed in this opinion. I have adopted the view that the problems faced by this plan and its present form means that the only way to resolve existing concerns is to withdraw the plan in its entirety and start again. It is assumed that if the existing plan were to be withdrawn, then steps would be taken to promulgate a new plan based on the data assembled for the existing plan and that this would ensure that the new plan could reach an equivalent stage in a much shorter timescale and at a much reduced cost.

As Chapter 18 is a variation to the proposed plan, it would fall with the plan. Q. What are the likely consequences if any of breaching Clause 10(4) First Schedule RMA? It is noted that this clause was re-written under the Amendment Act 2009 and consequently there has been no Environment Court interpretation of it? A. Clause 10(4) First Schedule states: ‘The local authority must: (a) Give its decision no later than two years after notifying a proposed policy statement or plan under Clause 5; and (b) Publicly notify the decision within the same time’. This provision will not be complied with if the Council makes a decision to withdraw the whole plan, but that may be seen as an answer to many of the submissions that it has received. I do not believe this will create a problem for the Council if it immediately proceeds with its review, albeit with a new plan. Q. If the action to withdraw the proposed plan and Variation 1 is taken, are there grounds for the appointment of commissioners in terms of the Minister’s powers under ss. 24A, 25, 25A or 258 RMA? If yes, if the action is taken and includes a commitment to immediately prepare a revised proposed plan, are there grounds for the appointment of commissioners in terms of the Minister’s powers under ss.24A, 25, 25A or 258 RMA? A. Section 24A authorises the Minister for the Environment to investigate and make recommendations regarding the performance by the Council of its planning function. Section 25 refers to residual powers of the Minister for the Environment. Section 25A authorises the Minister to issue directions for the preparation of the plan, change or variation. Section 258 authorises the Minister to direct commencement of a review. These provisions are there to enable the Minister to intervene in circumstances where the Council has neglected or failed in its duty to properly carry out its functions under the Act. If the Council can demonstrate that it has appropriate reason to withdraw the plan and is acting to ensure that a new plan is promulgated promptly, then I see no reason why the Minister would seek to intervene. Farmers of New Zealand believe that if the Kaipara District Council adopts the new Proposed District Plan the Kaipara community will never recover and your children and their children’s children will be paying for many generations to come. In an open letter to the Kaipara community Mayor Tiller stated that: ‘While council accepts and respects the views of the Kaipara community it must take a wider view and act in the way it believes is in the best interest of the Kaipara District’, and yet in his first speech when elected mayor over four years ago he said: “It is essential that our people take an interest in their local and central government activities. School targets possums Dead possums could earn successful hunters a holiday weekend, a stereo system or numerous other prizes in the upcoming Paparoa School Possum Purge. “We have lots of great prizes, including first, second and third for the most fur and also some awesome spot prizes and numerous other vouchers and goodies,” said PTA spokesperson, Libby Jones. “We are crossing our fingers for a fine weekend over September 2–4 and hunters need to register by September 1 to be in for the big spot prizes. “We will have $3,000 worth of prizes — numerous spot prizes, special kids’ prizes, as well as family fun activities, a bouncy castle and slide, and kids’ competitions.” The possum purge schedule calls for hunting of possums on the Friday and Saturday with a sausage sizzle and prize giving on Sunday September 4 from 11am. “The holiday weekend will be the prize drawn for pre-registration and that’s $10 for adults, with children free,” said Ms Jones. A musical protest ‘Please John Key, stop it before it’s too late’. That’s the punchline of a protest song about to be released as a music video by Dargaville singer-songwriter, Dan Collett. “It is a protest song about the plan by Crest Energy to sink 200 huge turbines onto the sea bed off Pouto,” said Dan. “It reflects the huge opposition to the proposal.” Dan Collett being Crest has been granted permission in filmed at the Aratapu Tavern the Environment Court to site three of the proposed turbines and opposition to the decision has been led by Te Uri O Hau. “After I wrote the song, we had a day’s filming down at Pouto, and then we had an evening shoot at the Aratapu Tavern,” Dan added. The evening video was part of his work — he appears at the tavern regularly as ‘Missing Kiwi Dan’. The music video is entitled Turbine Protest Song and was recorded at the Whangaparoa Recording Studio. “It’s going through final processing in Wellington and we expect to have it available in about a week,” said Dan.

The Kaipara District Council in partnership with the NZ Transport Agency, is about to begin developing a structure plan for Kaiwaka. There are three main objectives for the evening. One is to inform the Kaiwaka community about the structure plan process and what Council knows about the Kaiwaka area. The second is to ensure that the information Council has is correct, while also gaining information from the Kaiwaka community on what Council doesn’t know. The third outcome is to gain some direction from the community. To help start the conversation Council has put together a discussion document. This is available to view on Council’s website on www.kaipara.govt.nz and also available at Council offices in Kaiwaka and Dargaville. At the meeting there will be an opportunity to talk to Council and NZ Transport Agency representatives both before and after a brief presentation which is being held at 4:15pm and again at 5:15pm. Some questions Council would like answers to in order to get some guidance from the Kaiwaka community include: How would you like to see your community look in 30-50 years time? What outcomes would you like the Kaiwaka Structure Plan to address? What do you think makes Kaiwaka unique?
