Social Security Law, 2012 Legal Framework
In 2012, the Government of the Union of Myanmar adopted a new Social Security Law, 2012. The new law covers more branches of social security and provides higher benefit levels for the cash benefits existing under the Social Security Act, 1954, (sickness, maternity and work injury) have higher levels under the new law. Source of Funds Worker wages is cap at 300,000 MMK per month. Employer and worker each contribute 2% of the workers wage for medical care, sickness, maternity, paternity, funeral grant and family benefit into the Health and Social Care Fund if the worker is less than 60 years old at registration. If the worker is above 60 years old, employer and worker each contribute 2.5% into the fund. The family benefit is financed by a 10% contribution of the Health and social care fund. The employer contributes 1% of the workers wage into the Employment Injury Fund for the work injury scheme, which provides a temporary disability benefit, a permanent disability benefit and a survivor’s benefit. Employer and worker each contribute 3% of the workers wage for the Disability Benefit, Superannuation Benefit and Survivors Benefit Fund. As of June 2017, this fund is not yet in operation.
