The Dublin Marathon - 40 Years of running Terms and conditions Terms and conditions for submitting text and/or photographs (‘Content’) to The O’Brien Press Ltd. (the ‘Publisher’) via dublinmarathonbook@obrien.ie for use in their book (the ‘Book’), currently titled 40 Years of the Dublin Marathon (working title only) and/or all associated publicity, including sharing on social media: 1. By submitting any text or photographs to dublinmarathonbook@obrien.ie you agree to grant the Publisher a perpetual, royalty-free, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, distribute, make available to the public, and exercise all copyright and publicity rights with respect to your Content worldwide and to incorporate your Content in the Book and any other versions of the Book, produced by technologies now known or later developed, and/or in any associated publicity, including sharing on social media, for the full term of any rights that may exist in your text and/or photographs. By submitting your Content via dublinmarathonbook@obrien.ie you warrant that you have the right to grant this license. 1.2. To the extent permitted by law, you waive your moral rights (e.g. the right to be identified as the author) in your Content. This clause 1 means, for example (without limitation), that we can: Continue to publish all or part of your Content, including your full text and photographs or any edited or amended versions of them (e.g. text may be edited to fit a particular space in the Book, photographs may be captioned or cropped), any comments, profile, name, town and country. Remove your Content, even if you have not breached these terms of our content guidelines. Use all or part of your Content in promoting the Book, the Publisher, our publication list or catalogue (e.g. we may use your Content in our advertising and other publications). Edit your Content, which may result in a part of it being modified and displayed. 2. Your Content - what you are not allowed to do: 2.1 You must not submit any material to the Publisher that is: Defamatory, malicious, threatening, false, misleading, offensive, abusive, discriminatory, harassing, blasphemous or racist A breach of confidentiality or somebody's privacy Indecent, obscene or of a sexual nature Or is likely to: Cause someone alarm, anxiety or distress Encourage violence or racial or religious hatred
Infringe any intellectual property rights, such as copyright and trademarks. This means generally that you must own the rights in everything you submit (e.g. any text and photographs) or must obtain permission from the rights owner to submit the material. Advertise any products or services Impersonate anyone else or otherwise misrepresent your identity, affiliation or status Prejudice any active legal proceedings of which you are aware Be technically harmful (including, without limitation, computer viruses, logic bombs, Trojan horses, worms, corrupted data or other malicious or harmful software, data, components or conduct) Encourage or teach conduct that is a criminal offence, gives rise to civil liability, or is otherwise unlawful Be in breach of these terms
2.3 You must not re-submit content that you are aware has been removed. 3. Your personal information: 3.1 We will use your personal information in connection with the use of your text and/or photographs in the Book only, and retain it only for as long as we may require to consult with you about the continued inclusion of your Content in the Book, and any future editions or reprints, or any edit or amendment required to your Content. 4. Your warranty: 4.1 You warrant that you have the right to make the text and/or photographs available to The O’Brien Press Ltd. for all the purposes specified above; 4.2 You warrant that your text and/or photographs do not infringe any law; 4.3 You agree to indemnify the Publisher against all legal fees, damages and other expenses that may be incurred by Publisher as a result of your breach of the above warranties; 4.4 You agree to waive any moral rights in your text and/or photographs for the purposes of its submission to and publication in 40 Years of Dublin Marathon (working title only) and for the purposes specified above. 5. These terms and conditions will be governed by the laws of Ireland and the parties agree to submit to the exclusive jurisdiction of the Irish Courts.
