With the Maryland General Assembly in full swing, the Maryland Association of Realtors is supporting the following measures: Addressing Housing Supply —Maryland Realtors has consistently advocated for measures that increase the supply and affordability of housing. However, we have faced opposition to state involvement in zoning from local government representatives. With housing legislation expected from the Administration in 2024, Maryland Realtors will support meaningful proposals to address our housing shortage, particularly those that quantify housing needs at the local level and require accountability for producing those units. Buyer Brokerage Compensation — Maryland Realtors supports greater transparency for consumers on real estate commissions and fee structures. This bill will clarify existing requirements to clearly state the amount of compensation owed to the buyer’s broker, who is responsible for paying it, and what actions entitle the broker to that compensation. Condo and HOA Act Reforms — Maryland Realtors continue to report excessive fees charged by associations to obtain resale information, while the differing timelines and disclosure requirements between the acts cause confusion in sales transactions. Recently adopted in Virginia, Maryland Realtors will seek similar legislation to conform resale disclosures and timelines across Common Ownership Community types, and to prohibit any fees which are not outlined in statute. Continuing Education Reporting — Policies instituted by the Maryland Real Estate Commission this summer require expedited reporting of CE credits by real estate schools. This has placed a hardship on those providers, which could result in fewer class offerings or increased costs passed on to licensees. Realtors will submit legislation to require licensees to complete CE credits 30 days before license expiration and restore longer timeframes for continuing education providers to report completed credits to MREC. Anonymous Complaints for Advertising Violations — Maryland law requires that all complaints against real estate licensees be made under oath, preventing the Maryland Real Estate Commission (MREC) from considering anonymous complaints. Several states currently in-
vestigate complaints submitted without the name of the person bringing the complaint. This bill would allow submission of anonymous complaints for advertising violations. Because advertising violations are readily apparent, Realtors believe this change will not raise due process concerns. Oversight of Branch Offices —Realtors support legislation to resolve an inconsistency within the brokerage act. Currently, real estate brokers may oversee one office, but office managers do not face similar limits. Having to hire an office manager to expand to a second location can be a financial deterrent to a broker growing his or her business. This bill will allow brokers the same oversight of branch offices provided to office managers. Financial Literacy —Maryland currently requires all local school districts to teach the state’s financial literacy curriculum but grants flexibility to local districts in how that curriculum is presented. At least eight districts teach a full course on financial literacy, while the rest incorporate it into other classes, like civics or mathematics. In several previous sessions, legislation to require financial literacy as a standalone graduation requirement statewide has failed. Realtors will continue to support efforts to require increased financial literacy education requirements in public schools and revisions to enhance the state’s required curriculum. First-Time Homebuyer Savings Accounts —When Maryland Realtors passed this initiative in 2021, several compromises were made to the program’s structure to win approval. Unfortunately, those changes made the accounts less attractive to first-time buyers. Realtors will seek to restore as much flexibility in the program as possible while working within the state’s budgetary restraints. Assignment of Contracts and Marketing Equitable Title (“Wholesaling”) — “Wholesaling” refers to a real estate practice in which an investor signs a contract with a seller and then proceeds to “sell” the contract to another purchaser for another price. While legal, the practice can be abused leaving sellers unaware that the “buyer” is assigning the contract to another party, and the buyer unaware that the “seller” is only a beneficial owner and not the title holder to the property. At least 10 states have passed legislation to require either licensing of “wholesalers” or enhanced consumer disclosures for assignable transactions. Maryland Realtors supports instituting similar requirements.

NAR economist sees market growth ahead National association’s Yun forecasts home sales rising by 13.5% over 2023’s total WASHINGTON – NAR Chief Economist Lawrence Yun forecasts that 4.71 million existing homes will be sold, the housing market is expected to grow, and Austin, Texas will be the top real estate market to watch in 2024 and beyond. Yun unveiled the association’s forecast in December during NAR’s fifth annual yearend “Real Estate Forecast Summit:
The Year Ahead.” Yun predicts home sales will begin to rise next year – by 13.5% compared to 2023, and the median home price will reach $389,500 – an increase of 0.9% from this year. “Metro markets in southern states will likely outperform others due to faster job increases, while markets in the Midwest will ex-
perience gains from being in the most affordable region.” Yun expects rent prices to calm down further in 2024, which will hold down the consumer price index. He predicts foreclosure rates will stay at historically low levels in 2024, comprising less than 1% of all mortgages. Yun forecasts that U.S. GDP will grow by
1.5%, avoiding a recession, with net new job additions slowing to 1.7 million in 2024, compared to 2.7 million in 2023 and 4.8 million in 2022. After eclipsing 8% in late 2023, he expects the 30-year fixed mortgage rate to average 6.3% and that the Fed will cut rates four times – calming inflationary conditions – in response to slower economic activity. Yun also foresees 1.48 million housing starts in 2024, including 1.04 million single-family and 440,000 multifamily. Continued on Page 13
