J

ohn Evans is not a lawyer. He approaches every cause, however, as if he were one—researching, documenting and strategizing how he will win the battle. For Evans, winning is everything. Winning means change. As head of the DeKalb NAACP and president of Operation LEAD, a civil rights organization he founded, Evans has been at the forefront of defending the civil rights of the poor, the unemployed and underemployed, the elderly, and school children. With the help of members in the NAACP, he has tackled discrimination, environmental racism, economic injustice, soaring gasoline prices, the death penalty and other causes. Last July, in the sweltering heat, Evans and NAACP members marched in support of President Obama as he called on a stubborn Congress to raise the debt ceiling to cover federal deficits. In January, Evans joined leaders and lawmakers at Georgia’s Capitol to demand the abolishment of the death penalty in the wake of Troy Davis, who was executed Sept. 21, 2011 for the

murder of police officer Mark MacPhail in Savannah, GA. Davis maintained his innocence until his execution. Recently, Evans was in the news for speaking out against the Gwinnett County School System’s scandal involving teachers who incorporated references to slavery into math lessons given to third graders. “That was extremely insensitive. They should have never done that. I don’t care what they were trying to teach,” Evans said. As the Presidential primaries and local elections crank up, Evans is mobilizing the NAACP for voter registration drives. The organization also is in full swing in

recruiting its goal of 2,000 members. In fact, during his birthday party in January, Evans called on everyone to support the organization by buying NAACP T-shirts. The celebration, held at the International Bar & Grill in Lithonia, drew family, friends and even sparring elected officials together for a night of dancing, eating and fun. The bash was held on the Saturday night before Evans’ actual birthday on Jan. 29. He turned 79. Larry Johnson, one of several politicians who attended the celebration, called Evans “a champion for the people.” Johnson, who serves as presiding officer for the DeKalb County Board of Commissioners, said even though he

and Evans have had their differences, he respects him and looks forward to working with him. “John has a heart for the people. He is the people’s voice,” said Johnson. “He’s a rare breed. At his age, he is one of the last of our Civil Rights leaders from the Old Guard.”

s early as his high school years during the Civil Rights movement, Thomas Cuffie knew what he wanted to do with his life: protect people’s rights. Once he opened a law firm, he decided that he could fulfill his goal best by protecting the rights of victims of catastrophic injury and those who lost a loved one because of the carelessness and recklessness of others. Cuffie understands the law from the vantage point of how law enforcement officers and legislators think – because he has been both. Before graduating from Morehouse College in 1972 with a degree in political science, Cuffie joined the Atlanta City Police 8 OCGNEWS TOP ATTORNEYS 2012

Department and served as an officer and a detective. After law school, Cuffie took the position of Associate City Attorney in Atlanta. In 1981, Cuffie was elected to the Atlanta City Council, where he served three consecutive terms. Cuffie opened his law firm focusing on serious personal injury and wrongful death cases some 30 years ago. He and his team fight tirelessly to get justice for those whose lives have been painfully disrupted by injuries and death. Undergirding his legacy of achievement is Cuffie’s commitment to justice for all people. Cuffie explains his philosophy and how it drives his successful law practice:

Q: What influenced you to enter the law and specifically to help people in crisis? A: I entered college during the Civil Rights Movement when my role models, including Dr. Martin Luther King Jr., who was a Morehouse graduate, preached a message of social consciousness. It seemed to me that I could make the best contribution by entering the law. I wanted to help the underrepresented so that everyone – regardless of race or station in life – would have a fair shot at justice. Q: Do you think you have achieved that goal? A: Reaching the goal will be a lifetime effort; but I do take pride in a number


of accomplishments. My work on behalf of a client set the standard Georgia attorneys use for evaluating “the value of life” for low to modest income earners who’ve been killed. (Consolidated Freightways Corporation v. Futrell et al 410 S.E.2d 751;1991) This case continues to be relied upon and taught here in Georgia, and went a long way toward changing the way the law regards not-sorich individuals. When individuals are so seriously injured that they cannot continue to work, the financial implications can be traumatizing to their families. We fight for the fair treatment of those whose lives have been irreversibly changed and continue to help families recover from their losses. Q: Does this quest for justice affect your private life? A: Yes. I feel fulfilled because my firm helps people at the most devastating times – when they face serious injury or loss of a loved one. But my effort to do good works doesn’t stop when I leave the office. For decades, I’ve been deeply engaged in civic affairs. I am a founder of 100 Black Men of Atlanta, and for the past 25 years I’ve worked to help African Americans enter college and pursue careers. I’m a strong believer in giving youths the tools they need so that they can open doors of opportunity and walk through them well-prepared. In this global economy, it’s more important than ever for our young people to be well-educated and involved. Of course I think the law is a good field for advancement. As a member of the Board of Visitors at my alma mater, North Carolina Central University School of Law, I help with recruitment and fundraising. Helping people continues to be my highest calling both professionally and personally.

aniel C. Jason is a stickler for details. He left active duty service in 1997 as a Captain with several honors and commendations. Jason was later promoted to the rank of Major in the Army Reserves before being honorably discharged in 2002. tlanta’s temperatures rose into the 80s that day, but grew much hotter inside the car where a 3-year-old toddler waited. With the child strapped in, her mother cracked the windows and reported to work, her first day on the job. When she returned about 90 minutes later to check on the child, she found her unconscious. The little girl died after arriving at a hospital, where doctors said her temperature was 108 degrees. The mother was charged with murder. Magistrate judges set bail amounts for release and decide the sufficiency of evidence. Magistrate judges hear eviction cases, bad check citations, small civil claims and garnishments as well. A Detroit native, Aten has lived in Rockdale for 10 years and raised three children who are graduates of Heritage High School. She earned her law degree and a certificate of sports degree from Tulane University in New Orleans. She has been honored for her contributions to the community on several occasions, most recently as the recipient of the 2011 Outstanding Community Service Award by the Conyers Arts Conservatory and the Luminary Leadership Business Award by the Rockdale-Newton Chapter of the Georgia Federation of Democratic Women.

elvin Johnson is a survivor who beat the odds in the face of homelessness. At 17, he found himself homeless after he lost contact with his mother when a civil war erupted during her trip to visit family in Liberia, West Africa. Johnson, who was a senior at DeKalb County’s Sequoya High School at the time, had to fend for himself. With nowhere to go, he was forced to sleep in his car at time, and shower at friends’ homes. He worked odd jobs in order to eat. Despite his hardship, Johnson graduated with honors and went on to receive degrees

in accounting and law. Today, Melvin “Action” Johnson is in private practice at The Action Johnson Firm in DeKalb County, where he serves as Chief Judge of the City of Lithonia. The position is one that he took on at age 35, becoming the youngest judge in the city’s history. He also serves as a judge in Atlanta. Johnson’s law firm handles car accidents (personal injury), immigration, criminal and selected domestic cases. Johnson earned his degree in accounting from Georgia State University before pursuing a law degree. As an accountant, he worked in the private and public sectors for about

three years. At Thurgood Marshall, Johnson earned the nickname “Action Jackson” for his steadfast advocacy for the disadvantaged. He transferred to his alma


mater, Georgia State University, where he earned his juris doctorate at age 27 in 2000. Johnson has earned a reputation as a wellrespected lawyer across the nation. After a yearand-a-half-long battle that he took on pro bono in August 2009, he won a controversial child welfare case involving a Fairview, Oklahoma family who sexually assaulted and abused five Liberian-born girls they had adopted. Family members tied one of the girls with rope to a bed in the basement of the family home and at times, forced her to sleep outside in the cold. The family members were convicted for their crimes. The case thrust Johnson into the national spotlight. “I had to make numerous trips to Washington D.C. to meet with dignitaries, U.S. senators and U.S. Congressional leaders on that case,” said Johnson. “I made trips to Oklahoma to meet with NAACP leaders, state leaders, community leaders, witnesses and others for the court hearings and trial proceedings. By the grace of God, those girls are free.” The case set Oklahoma jurisprudential precedent as it reached the Oklahoma Supreme Court. It is Johnson’s winning attitude—and love for God—he lives by. “I have had to do very menial jobs to survive. I thank God for everything that I am,” said Johnson. “I went through a lot to get to where I am today. It was an experience that I would never wish even on my worst enemy, if I had one.” Johnson continues to be a quiet community servant in metro Atlanta. Through his foundation, The Action Foundation, he runs a mentorship program that gives underprivileged youths a look at the judicial system and provides them with educational field trips. He donates computers, and other school aids to assist youths and young adults. “I have no choice but to have passion for such youngsters because I can relate to them,” Johnson said. Johnson is a member of the International Christian Fellowship Church in Atlanta, where William B.G.K. Harris is pastor. Johnson has four children.

they know and do not know. It is in their best interest to be honest and upfront with their clients because they most often rely on referrals for new business. First, ask friends, family and colleagues for recommendations. Most people have had contact with attorneys at some point and if they haven’t, they will know

This could make a huge difference in your final decision. Third, get a notepad and be prepared to interview potential lawyers. Arrange a brief meeting with the attorneys that have been recommended or that you have selected as potential prospects. The interview will allow you to gauge the attorney’s accessibility as well as the opportunity to assess the lawyer’s performance and personality. Pay attention to things like how the attorney presents him or herself. Consider other things like how open they are to questions and how thorough their responses are. Professionalism can also be evaluated by their promptness in communication. Do they respond to emails and telephone calls within 24 to 48 hours? Do they cancel and reschedule appointments frequently at the last minute? Most attorneys will agree to a one-time free consultation. Come prepared with good questions and request a list of previous clients as referrals and have the attorney cite some specific cases she has worked on that are similar to yours and the outcome of these cases. Note: Good attorneys should also be interviewing you, and getting as many details about your case as possible. Do you require an up-front retainer? What is your experience in this area of law? Have you ever handled a matter similar to mine? How many cases have you won in matters similar to mine? What are the possible outcomes of my case? What are the alternatives in resolving this matter? How long will the matter take to resolve? Do you recommend mediation or arbitration? What are your rates and how frequently will you bill me? What is your estimated ballpark figure for the total bill, including fees and expenses? Can junior attorneys or paralegals in the office handle some of the legal work at a lower rate? Fourth, examine the attorney’s background and workspace. Is their office neat and well-organized? What is their education and work experience, and how long has the individual been in practice? If an individual can manage their business properly it is a sure sign that they will be able to help you with yours. Fifth, research the state bar’s website to find the average attorney’s hourly rate in your area or ask friends who have recently hired an attorney. After gathering all of this information, compare credentials, accessibility, flexibility and personality to determine if what you are being charged is reasonable. Attorneys have set rates and fees. Be cautious if an attorney wants to know what your budget is. Make sure the attorney puts her fees in writing and provides detailed billing.
