Despite the momentum, true progress for hemp production was still being held back by some of the research provisions in the 2014 bill. Industry groups like the U.S. Hemp Roundtable started working with lawmakers to strengthen and enhance the hemp laws in the next farm bill. It took much negotiation and work by activists, industry groups, and lawmakers, but when the 2018 Farm Bill was passed and signed, it ended the era of hemp prohibition and included these provisions:

• Officially removes hemp from the Controlled Substances Act and designates hemp as an agricultural commodity regulated by the USDA like any other vital crop

• Redefines hemp to include all of its extracts and derivatives, explicitly legalizing products containing CBD derived from agricultural hemp

• Makes crop insurance available to farmers

• Opens up research grants on hemp to academic institutions

• Allows transportation of hemp products through all states and tribal lands

• Allows for hemp growing by tribal nations

• Leaves the oversight of hemp nutritional supplements and topicals in the hands of the Food and Drug Administration and their strict standards on safety

As these laws have gone into effect, they’ve invigorated the hemp and CBD industry. With legality assured, investments and American ingenuity can be applied to this adaptive old plant.

How to Choose a Hemp CBD Product

Not all hemp CBD is created equally, so here are some tips on how to choose a quality hemp product.

Testing

The most important thing you can look for in any hemp-derived CBD product is test results. For all of a company’s feel-good vibes, promises, and handsome branding, only third-party lab testing can assure you that you’re getting a high-quality product. Unfortunately, according to a number of independent testing labs and secret buyer studies, the majority of products labeled for CBD sold in the United States contain less than the advertised amount of cannabinoids, or even none at all.

A test for cannabinoid content is only the beginning. Such a test just assures you that you’re getting what you paid for, but the best companies test for many other factors including:

Pesticides This plant grows like a weed, and you hope that most farmers aren’t using pesticides on hemp plants (though the pesticide crisis in California is revealing how widespread the practice is for recreational marijuana). That being said, pesticide drift can always occur from nearby farms, and with the toxicity of some of these compounds at even the lowest levels, testing must be done to assure they’re not in your product.

Heavy Metals It’s well-known that hemp can clean up the soil by leaching out heavy metals, but that also means those heavy metals end up inside the plant. If the soil your hemp is grown in isn’t clean, heavy metals like lead, arsenic, mercury, and cadmium can end up in your product. Make sure these substances are below the detectable limits.
