The Chairman

With a new year comes a new legislative session and new opportunities to create an even more business-friendly environment in Oklahoma. We enter this year’s legislative session with a new governor and many new legislators. This will undoubtedly present opportunities and challenges, Carl Edwards but I’m certain that if we 2011 Chamber Chairman remain focused on our priorities and work together toward their success, we will see significant progress made. While the Chamber is the voice for the business community at the capitol, the individual voices of our members are invaluable when it comes to pursuing our efforts. There are a number of ways you can help us ensure that our voice is heard. Through the Chamber’s Legislative Action Center, www.LegislativeActionCenter.net, you have access to the current issues and legislation being discussed at the capitol. Communicating with our elected officials is key to making our

voice heard, and the Legislative Action Center makes it easy to call, mail, e-mail or visit your elected officials. Last year, the Chamber took its involvement at the capitol a step further with the creation of the Greater Oklahoma City Chamber Political Action Committee (Greater OKC Chamber PAC). Through the PAC, we are able to support candidates for elected office who share the Chamber’s vision for creating a business-friendly city. In 2010, the PAC supported 22 candidates – with 21 of those candidates elected to office. I hope you’ll take a closer look at each of the avenues of involvement, and see how you can play a part in our efforts. Workers’ Compensation Reform Incremental change to the workers’ compensation system in Oklahoma in the past has not provided the changes needed to adequately protect Oklahoma businesses and maintain our state’s competitive position for economic development.

AGENDA

economic development incentives are revenue positive, meaning that they provide net new revenue to the state. The Chamber supports a number of incentive programs that have positioned the state to compete well for capital investment and job creation of primary job or traded sector firms. The Chamber supports the state’s premier incentives, which help to differentiate Oklahoma from competing locations. We feel they cannot be eliminated/diminished without calling into question our reputation as a probusiness and economic development state.

The Chamber supports an overall restructuring of the state’s workers’ compensation system to: • Produce lower cost to Oklahoma employers. • Be more responsive to injured workers in a spirit of fairness. • Streamline the process to eliminate delay and waste.

Lawsuit Reform The Chamber supports major lawsuit reform, including: • Elimination of joint and several liability • Hard cap on non-economic damages • Class action lawsuit reform • Product liability reform • Legislation appropriating money to the Indemnity Fund to purchase insurance to pay non-economical damage awards in excess of $400,000 in professional negligence cases.

Economic Development Business Incentives The economic growth Oklahoma has experienced over the last decade, as well as the state’s economic resilience during the recent recession, is due in no small part to the effectiveness of Oklahoma’s business climate and incentives. Most of Oklahoma’s

• Retain the Quality Jobs Act (and the Small Employer Quality Jobs Act) • Retain the 21st Century Quality Jobs Act • Reinstate the Aerospace (engineer) Employer & Employee Tax Credit programs • Retain the Prime Contractor Quality Jobs Program • Retain the Film & Music Profit Reinvestment Tax Credit and Oklahoma Film Enhancement Rebate programs The Chamber also supports the state’s foundational incentives – which are basic incentives offered by virtually every other state and competing location. Without these programs Oklahoma will not be considered a viable location by most manufacturing, warehouse and distribution firms. Some of these programs, however, could be modified in such a way that local, regional and state governments could recover their “cost of services” while still offering significant value to a new or expanding firm.

• The 5-year ad valorem tax abatement and sales tax exemptions on facilities, equipment, inputs and energy used in manufacturing and warehouse & distribution operations • The Freeport (inventory) Exemption • The Investment/New Jobs Income Tax Credit Programs The Chamber also recommends the continuation of several industry specific incentives to support the growth and development of industries important to Oklahoma’s economic future. • The Oklahoma Quality Events Act • Tax credit for gas used in manufacturing • Tax credit for electricity generated by zero-emission facilities • Tax credit for qualified rehabilitation expenditure for historic buildings • Tax credit for energy efficient residential construction • Sales tax exemption & refund for aircraft repairs and modifications • Sales tax exemption & refund for aircraft maintenance or manufacturing facility • Excise tax on aircraft services Research and Development The Chamber supports funding for programs currently managed by OCAST. The Chamber will oppose all efforts to unreasonably restrict the continued development of the state’s bioscience and research programs and will support efforts to foster an environment that is conducive to further research. Liquor Laws The Chamber will work with all significant stakeholders to examine the consequences and benefits of changing the state’s liquor laws to allow the sale of wine in grocery stores (and other changes). EDGE Fund The Chamber advocates protecting the EDGE endowment fund from being eliminated or borrowed from, and supports identifying a 4

permanent funding source that will ultimately allow the EDGE Fund to reach $1 billion.

Health Care Mandates The Chamber opposes new health insurance mandates and liability that will undermine an employer’s ability to provide quality health insurance at a reasonable cost to employees. Uninsured The Chamber supports programs and initiatives that work to reduce the number of the state’s uninsured. Medicaid The Chamber supports a long-term solution, such as a provider fee, to address full reimbursement funding for Medicaid services provided by hospitals to the federal upper payment limit and no less than 100% of Medicare rates for physicians. The Chamber opposes fees that are unreasonably burdensome on Oklahoma businesses, such as the 1% access tax on health claims that was enacted in 2010, and later declared unconstitutional. Wellness The Chamber supports state wellness and prevention programs that serve to improve the health of Oklahoma citizens. The Chamber supports the repeal of state pre-emption laws in an effort to increase the wellness of Oklahomans, therefore decreasing the cost of health care. Workforce The Chamber supports incentives and appropriate funding of state medical schools to enhance the number of Primary Care Physicians and Allied Health professionals in rural and underserved urban areas. We also supports closing the tax loophole on smokeless tobacco to fully fund the state’s physician student loan repayment program.

Transportation The Chamber will work with the Congressional Delegation, ODOT, and the City of Oklahoma City to secure the funding necessary to complete the Downtown Boulevard by 2014. The Chamber will advocate for funding and completion of the Lincoln/Byers project to connect Bricktown to the Oklahoma River and Boathouse Row by 2011. We will advocate for funding and completion of the I-40 Crosstown realignment mainline by 2012. Federal Issues The Chamber supports improving health care quality, coverage, and affordability without imposing new mandates and/or taxes on business. Therefore, the Chamber opposes a single-payer government-run/public option or health care system with government mandates. The Chamber believes that employers drive innovation in health benefits and that market-driven health reforms are the best approach to reducing costs while promoting efficiency, wellness, and quality of care.

Immigration Reform The Chamber opposes illegal immigration. We support an improved immigration process that promotes the ability of students and workers/employees to enter the United States lawfully and allows employers to accurately verify the status of employees through a federal database. The Chamber believes that immigration policy should be set by the federal government and supports comprehensive reform at that level. Accordingly, the Chamber opposes additional immigration reform at the state level.

American Indian Cultural Center and Museum (AICCM) We support legislation to allow issuance of state revenue bonds to match privately-raised funds to ensure the timely completion of the AICCM.

The Chamber will advocate for funding and completion of the teardown of the elevated portion of the existing I-40 Crosstown to make way for the Downtown Boulevard by 2013. The Chamber will advocate for completion of the I-235/Harrison /10th street ramp access improvements by 2011. Federal Highway Trust Fund The Chamber will work with ODOT, the City of Oklahoma City and our Congressional Delegation to secure a permanent funding solution for the Federal Highway Trust Fund, and ensure Oklahoma does not revert back to its former status as a donor state. The Chamber also supports the reauthorization of the multi-year Surface Transportation Act. Major Interchanges The Chamber will advocate for funding and completing work on major interchanges located at I-44 and Broadway Extension, I-240 and I-35 (Crossroads) as well as the necessary improvements to S.H. 74 (north of Lake Hefner Parkway). Transit The Chamber will support continued dialogue on transit programs that will best serve the long-term interests of the central Oklahoma region, including: • COTPA’s 2005 Fixed Guideway Transit Study (including alternative analysis process) • ACOG’s Regional Transit Dialogue Committee to identify regional transit alternatives/solutions for central Oklahoma • Amending state law to facilitate the development of improved transit in central OK

Quiet Zones We will work with the City of Oklahoma City to establish a Railroad Quiet Zone on the BNSF mainline running through downtown Oklahoma City, and to establish split grade crossings in other parts of the metro area to facilitate safety and expedite transportation. Legislative Funding We support recent efforts made to secure transportation funding and will seek to preserve and protect ODOT’s 8-year plan. Alternative Transportation The Chamber encourages the construction of sidewalks and bike lanes where appropriate to facilitate safer travel by bicyclists and motorists.

Regional Issues The Chamber will continue to foster the development of the Central Oklahoma Regional Advocacy Alliance (CORAA). The Alliance, made up of local chamber and business leadership in the central Oklahoma area, will develop and implement a public policy agenda that addresses regional issues critical to central Oklahoma, including air quality, transportation and transit, long-term water supply, education and support of Tinker Air Force Base.

Education & Workforce Development Teacher Performance (Due Process Reform) The Chamber supports removing restrictions on a school district’s ability to terminate bad or low performing employees, as well as those who engage in inappropriate behavior and actions, by removing the right to a trial de novo, and allow for accountable at will employment in Oklahoma schools.

Transformational Education Reform Oklahoma should create an in-state competitive grant program to fund innovative programs that will improve performance. Higher Education The Chamber supports higher education funding as growth revenue is available and support leaving the tuition-setting authority with the Oklahoma State Regents for Higher Education. We support finding a solution to help the state meet the financial commitment to the Endowed Chairs program which provides state funding to match private contributions for teaching and research professorships. Expansion of School Choice and Charter Schools We support legislative and administrative reforms that create innovative solutions to charter school infrastructure funding obstacles. Enable Partnerships with Early Childhood Programs The Chamber encourages all districts in the region to implement all-day pre-kindergarten and kindergarten for every child. In order to create classroom space, schools must create partnerships with local businesses and non-profit groups, bringing about liability issues. We support legislation that will protect partners from unnecessary risk. Curriculum Standards and Graduation Requirements The Chamber supports aggressive and full implementation of the K-12 Common Core Standards adopted in 2010 and particularly encourages the adoption of higher math standards. The Chamber opposes weakening graduation requirements or curriculum standards, and opposes actions that reduce the rigor of the testing system. Teacher Salaries - Pay for Performance The Chamber will continue to support creating competitive salary and benefits for teachers based on improved student performance. We support aggressive implementation of the Teacher and Leader Evaluation (TLE) system which ties evaluation to student performance, changes the definition of tenure and creates an incentive pay system.

Student Records Systems The Chamber supports aggressive implementation of a uniform, statewide student records system. Increased Instruction Time The Chamber believes it is important to increase the amount of time spent on classroom instruction and supports increasing the number of instructional days beyond the currently required 175 days. We also support implementation of strategies to help schools utilize time more efficiently and increase the time spent “on-task.” Improved Teacher Preparation The Chamber supports implementation of programs that will improve the education of teachers and provide additional “real world experience” to teachers before they enter the workforce. Incentives for Excellence in Teaching We support reinstatement of state scholarships for teachers who pursue National Board Certification, as well as the $5,000 annual stipend to newly-certified teachers. Both were placed under a twoyear moratorium in 2011. Higher Education – Campus Safety The Chamber continues to oppose efforts to permit the carrying of concealed weapons on college campuses. Higher Education – Oklahoma’s Promise We oppose legislation that would change the focus of OK Promise and reduce the number of students eligible to participate. Online Education The Chamber supports changes to curriculum and academic requirements that will allow more students to earn academic credit via online courses, but only if online education providers

meet academic content and rigor requirements similar to those of public schools in the state. Support for Career Tech System The Chamber supports enhancement and development of Career Tech programming, including high school dropout recovery, school credit recovery, career academies, and specialized education and technical training for targeted industry. Support for the Oklahoma School of Science and Mathematics The Chamber supports adequate funding levels so OSSM can remain a center of excellence in Oklahoma. Also, the Chamber will oppose efforts that would require OSSM students to pay for portions of their tuition or room and board, as this would create a barrier for some students to attend.

Eminent Domain The Chamber will actively monitor all eminent domain legislation and work to prevent any changes that would negatively impact central Oklahoma’s economic development.

Environment Clean Air The Chamber will work with the Association of Central Oklahoma Governments (ACOG) and other regional and state environmental stakeholders to address the EPA’s ozone requirements. Although Central Oklahoma is currently still in attainment of the strict ozone standards, a non-attainment designation could result in significant restrictions that would impede regional economic development. Clean Water The Chamber will work with the City of Oklahoma City to support the availability of a long-term water supply for central Oklahoma. The Chamber will continue to monitor the development and completion of the state comprehensive water plan.

Tax Increment Financing and Business Improvement Districts We will work to protect the current laws on tax increment financing to ensure its continuing viability as an economic development tool. The Chamber will also monitor any efforts to change the laws relating to business improvement districts.

The Greater Oklahoma City Chamber recognizes the benefits of partnerships when working to represent the business community and create a pro-business climate statewide. In 2011, the Chamber will work together with the Tulsa Metro Chamber in lobbying the State Legislature on the following issues.

AMERICAN INDIAN CULTURAL CENTER & MUSEUM / OKLAHOMA MUSEUM OF MUSIC & POP CULTURE

Liquor Laws The Chambers will work with all significant stakeholders to examine the consequences and benefits of updating the state’s liquor laws, including allowing the sale of wine in grocery stores. OCAST The Chambers support funding for programs currently managed by OCAST (Oklahoma Center for the Advancement of Science and Technology).

EDUCATION

The Chambers support maximizing private donations by supporting a state bond issue for capital investment in the American Indian Cultural Center and the Oklahoma Museum of Music and Popular Culture in addition to other cultural, historical and entertainment venues in the Oklahoma City and Tulsa regions.

The Chambers support removing restrictions on a school district’s ability to terminate bad or low performing employees, as well as those who engage in inappropriate behavior and actions, by removing the right to a trial de novo, and allow for accountable, at-will employment in Oklahoma schools.

DEVELOPMENT, ECONOMY & TAXES Bioscience & Research The Chambers will oppose all efforts to unreasonably restrict the continued development of the state’s bioscience and research programs and will support efforts to foster an environment that is conducive to further research. EDGE Endowment Fund The Chambers advocate protecting the EDGE (Economic Development Generating Excellence) endowment fund from being eliminated or borrowed from, and support indentifying a permanent funding source that will ultimately allow the EDGE Fund to reach $1 billion.

The Chambers believe Oklahoma should create an instate competitive program that allows local districts to apply for funding of new and innovative programs that will improve performance and accountability.

ENERGY The Chambers support policies that encourage energy development in a regulatory environment that creates more business certainty, promotes job creation and encourages economic growth for all domestic energy sources. The Chambers support increasing CNG infrastructure statewide.

HEALTHCARE The Chambers support a Hospital Provider Fee to allow the state to obtain the (approximately) 3:1 federal matching dollars necessary to fund the state’s Medicaid program, to achieve the Upper Payment Limit (UPL) for hospitals and to provide durable, consistent and predictable funding for Medicaid and indigent care providers. The Chambers oppose new health insurance mandates and liability that will undermine an employer’s ability to provide quality health insurance at a reasonable cost to employers. The Chambers support the repeal of state pre-emption laws in an effort to increase the wellness of Oklahomans and decrease the cost of health care. The Chambers support closing the tax loophole on smokeless tobacco to fully fund the state’s physician student loan repayment program. The Chambers advocate for the funding of the medical home model for primary healthcare as provided by the Federally Qualified Healthcare Centers (like Morton and Community Health Connection); support residency training at the FQHC’s (Teaching Health Centers Program) and National Health Service Corps Expansion to cover medical school loan payback through FQHC service.

IMMIGRATION The Chambers oppose illegal immigration. The Chambers support an improved immigration process that promotes the ability of students and workers/employees to enter the United States

TAX CREDITS AND INCENTIVES The Chambers support reinstatement of the aerospace and other effective tax incentives. The Chambers support the legislature’s protection of effective tax credits and elimination of ineffective tax credits through a process of annual review. The Chambers support incentives to attract new businesses to Oklahoma. The Chambers will guard against attempts to change, sunset or repeal existing business incentives such as the Quality Jobs Act, the 21st Century Quality Jobs Act, the Ad Valorem Reimbursement Fund and the Quality Investment Act. The Chambers support additional transparency on incentive and tax credit programs to generate increased confidence and bring accountability to those programs.

TRANSPORTATION

FEDERAL

The Chambers support recent efforts made by the state legislature to secure transportation funding and will seek to preserve and protect ODOT’s 8-year plan.

Tax Cut Extension The Chambers support extension of the federal tax reductions enacted in 2001 and 2003.

Gilcrease Expressway The Chambers support the building of the Gilcrease Expressway and bridge through any funding mechanism available in order to expedite this long overdue transportation system; a partnership with the Oklahoma Turnpike Authority and the Oklahoma Department of Transportation may be beneficial.

Card Check Opposition The Chambers support the right of workers to voluntarily join unions under fair and democratic rules. They oppose initiatives that would upset the balance of the National Labor Relations Act, including union-backed proposals to abolish secret ballot elections in favor of card check majorities for union recognition. (Employee Free Choice Act, EFCA or “card check”).

Existing Road Funding The Chambers will work to defend all existing road funding; prevent any diversion of monies; and support increased funding for transportation by developing an adequate, comprehensive funding strategy to broaden the sources of funds and increase the total amount going to transportation statewide.

Cap and Trade Opposition The Chambers oppose cap and trade legislation, a carbon tax, or similar “carbon” legislation that leads to higher energy costs for businesses and results in private sector job losses. EPA Emission Standards The Chambers support the adoption of a more reasonable time frame for the implementation of the new more stringent ozone emission standard.

WORKERS’ COMPENSATION REFORM Incremental change to the workers’ compensation system in Oklahoma in the past, while producing some benefit to Oklahoma employers, has not solved the problem of competitiveness in economic development. The Chambers support an overall restructuring of the state’s workers’ compensation system to: • Produce lower cost to Oklahoma employers. • Be more responsive to injured workers in a spirit of fairness. • Streamline the process to eliminate delay and waste.

High Speed Rail The Chambers support ODOT’s feasibility study of high speed/ commuter rail service between Oklahoma City and Tulsa. Intermodal Transportation The Chambers support the development of an intermodal transportation system, including streets, transit, express buses, ports, airports, and rail.

Since the birth of the state, the Greater Oklahoma City Chamber has been the voice of business for Oklahoma City. In 2010, your Chamber took a step to make that voice stronger by creating the Greater Oklahoma City Chamber Political Action Committee (Greater OKC Chamber PAC).

Every business in Greater Oklahoma City, no matter the size, shares in the successes and failures of the state’s economic policy. There is only one group that exists solely to further the goals of Greater Oklahoma City’s business community – The Greater OKC Chamber PAC.

It is difficult for individuals to have a relationship with every state official. However, when members of the business community come together through the Greater OKC Chamber PAC, the collective voice grows louder and the business community’s impact on the outcome of elections can be increased. Elections have consequences and it is up to business leaders to ensure that the business community’s voice is heard by those leading our state.

The Greater OKC Chamber PAC is the only fund that aggressively pursues the election and re-election of candidates who take a stand for Oklahoma City’s key business issues such as: • Economic Development • Workers’ Compensation Reform • New Business Development • Lawsuit Reform • Transportation Funding for Oklahoma City area projects • Improving Oklahoma Education Systems • and many others

It is vital for the success of local businesses and the future of the community that the Greater Oklahoma City business community has an effective lobbying effort at the Oklahoma State Capitol. A strong political action committee will lead to a stronger influence from Oklahoma City’s business community through the election of candidates who support the business community’s priority issues. A strong business climate is imperative for the region’s continued growth, and by electing business-friendly candidates to Oklahoma’s government, there is an opportunity to further strengthen our region.

KEEPING VOTERS INFORMED The outcome of local, as well as national, races on Election Day impacts Oklahoma business. Every day, Oklahoma’s state legislators make decisions about our economy, health care, education, taxes and more. These decisions affect our companies’ abilities to grow and compete. Every vote counts when it comes to Election Day. That’s why the Prosperity Project, a non-partisan organization, provides Oklahoma employers with tools to help educate their employees about critical election issues and candidates that affect their future. The goal is to motivate citizens to take an active role in state and federal elections by partnering with Oklahoma employers, chambers of commerce, trade associations and other organizations to ensure accurate, non-partisan information is distributed. “The individuals elected to our state legislature will make important decisions regarding our economy and the ways in which we do business,” said Brad Krieger, Vice Chair, Government

The Research Institute for Economic Development (RIED) evaluates legislators in the Oklahoma House and Senate to determine their support for business, jobs and economic growth issues. Founded in 1997 by business, industry and financial leaders across the state, RIED is a non-partisan organization endorsed by the Greater Oklahoma City Chamber, the Tulsa Metro Chamber and The State Chamber. The results of the evaluation are published in an annual study highlighting the voting record of each legislator in areas such as business, industry, jobs and economic growth issues.

The 2010 study showed strong support for economic growth in both the House and Senate. More than 56% of the House and nearly 54% of the Senate earned passing scores. When RIED released its first evaluations in 1999, only 35% of Oklahoma’s legislators supported business and economic growth issues. Legislators’ RIED scores for 2003-2010 are listed alphabetically in the table below. Scores of 70 or more reflect a pro-business voting record. Scores below 70 represent votes contrary to probusiness measures. These scores are shown in RED.

Election carried out by Oklahoma County Election Board (405) 713-1515 The administrative body of Oklahoma County is the Board of County Commissioners, which was created by the Oklahoma Legislature. Oklahoma County, like all counties in Oklahoma, is divided into three districts. The districts are as equal in population as possible, numbered 1, 2, and 3, and subject to alteration by the Oklahoma Legislature not more than once every 10 years. One commissioner is elected from each district for a term of four years.

Oklahoma City is governed by a council/manager system established by an amendment to the city charter in 1927. The charter, adopted in 1916, originally called for a commission form of government. The mayor and eight city council members are elected to four-year terms. In order to keep continuity within city government, half of the council is elected every two years. The city is divided into eight wards. The voters of each ward elect a council member to represent them, and the mayor is elected at large. The

mayor and the council appoint a city manager to serve as the city’s chief administrative official. Primary elections are held the first Tuesday of March. The general election is held the first Tuesday of April. The filing period is neither more than 29 days nor less than 24 days before the primary election. Elections for the city wards are always held in odd-numbered years, while the mayoral election is held in an even-numbered year.
