Wiggin inducted into Maestro’s Circle

The Oklahoma City Philharmonic announced that long-time supporter Renate Wiggin is the newest inductee into the Maestro’s Circle.

The award was bestowed at the December meeting of the OKCPHIL Board of Directors, held in the home of Board President Jane Jayroe-Gamble.

“Renate’s passion for music and the OKC Philharmonic Orchestra is decades deep and miles wide,” Jayroe-Gamble said. “Her leadership and generosity, together with her husband Chuck, has enhanced our orchestra forever. She is so deserving of this honor.”

Renate and Chuck became supporters of the Oklahoma Symphony Orchestra in 1978, and then the Oklahoma City Philharmonic in 1988.

As electric vehicles become more commonplace, Nichols Hills councilmembers have unanimously approved updated city ordinances regarding electric vehicle charging stations and parking space requirements. The amendments to Chapter 50 and Chapter 44 of the Nichols Hills city code are effective immediately.

During the December Nichols Hills city council meeting, City Manager Shane Pate told the council, “We only know the numbers by zip code, but we have 172 residential Electric Vehicle (EV) charging stations in the zip codes that include Nichols Hills.”

WOW: Winter on Western needs assistance to keep the lights on

The holiday season in Nichols Hills is truly enchanting!

The lights on Western are a big part of why Nichols Hills has a sparkle all its own at this festive time of year.

“Throngs flock to our part of the city to see the elaborate and vibrant light displays and are especially awestruck by the tightly-wrapped branches and trunks along the treelined corridor from Grand to NW 63,” organizer Edie Roodman said. “Aubrey McClendon’s big heart and lofty vision for our city was reflected in his commitment to his beloved OKC and nowhere was it more obvi-

Henry Ison earns Eagle Scout rank

Now, before installing an EV charging station, Nichols Hills residents, churches, commercial and retail businesses are required to file a written application for a permit with the City Clerk prior to installation. Applications must be certified by the property owner.

For installation of all EV charging stations applicants must pay a fee, provide a site plan including construction documents showing size of the proposed EV charging station with the electrical plan detailing location of existing meter.

The updated ordinance requires a screening plan demonstrating how the EV charging station is to be screened from view if placed outside. Pate told the council that most EV charging stations are installed inside the garage of a residence.

The council has also approved the purchase of an electric Tesla Model Y sedan for the Police Department and a Freightliner CNG sanitation refuse truck.

Pate has said the city is making a concentrated effort to use CNG and electric vehicles.

Merry Christmas! This weekend, I am celebrating with all twelve members of the McDaniel family. We are blessed beyond measure to be healthy and close enough to gather together.

Our most consistent family tradition is sitting in a circle and listening to every person talk about their year and the things that have inspired them the most. The 70-year age range ensures different topics and points of view. It always takes a little longer than expected. But, when the holidays are over, it is the time that I remember and cherish the most.

This year, I am most grateful for my brother, Randy McDaniel. Randy is a financial advisor, Army Captain, award-winning painter, and prolific writer and speaker who has written two books on financial literacy, Pensions and Prosperity and The Power of Financial Education. In January, Randy will wrap up 16 years of public service, serving twelve years as the State Representative for District 83 and four years as the State Treasurer of Oklahoma.

Randy was first elected in 2006 to the Oklahoma House of

Representatives, where he served as chair of the House Banking, Financial Services, and Pensions Committee. During his six terms, he wrote legislation and spearheaded pension reform to strengthen the state’s retirement systems, ensuring retirement security for teachers, public safety personnel, and public employees. Because of his tireless dedication to Oklahoma’s pension problems, he was selected as the nation’s Legislator of the Year in 2015 by the American Legislative Exchange Council, the nation’s largest nonpartisan, individual membership association of state legislators.

In 2018, Randy was elected as the 19th State Treasurer of Oklahoma, receiving 72 percent of the vote and carrying all 77 counties. As the state’s top elected financial officer, he managed the billions of taxpayer dollars deposited each year, safeguarded the financial health of the state, promoted responsible fiscal poli-

During his term, he also chaired the Oklahoma College Savings Plan Board of Trustees and the Board of Investors for the Tobacco Settlement Endowment Trust.

Randy and I have been best friends since birth. He is a year and half older, a spectacular athlete, great singer, natural leader, and the most supportive older brother imaginable. Randy was always team captain and he always picked me first, even though there were better players available. And, that’s how it was through life. No matter how cool, or talented, or celebrated he became as an All-State athlete or elected official, he always reached out a hand to make sure that I was right there with him.

I am so grateful to Randy for dedicating 16 years of his life to make Oklahoma better and more financially sound. I’m grateful to his wife Julie McDaniel and their kids, Grace McDaniel and John McDaniel, for sharing him with all of us.

And, I am excited to see what’s next for my favorite public servant. Have a very Merry Christmas!

Bears compete in FCCLA, do hip hop

Family, Career and Community Leaders of America (FCCLA) is a national organization for students in family and consumer sciences classes.

FCCLA participants help students focus on youth concerns, career preparation, and leadership development. John Marshall students and FCCLA members Jackie Lazo Leon and Tanner Sumrall recently competed in the Students Taking Action with Recognition (STAR) competition.

In this competition students were required to showcase a topic that brings value to their community.

“After the presentation students would be asked questions from the judges. At first I was really nervous to present, but it felt good to talk about a topic that needed awareness,” said Leon.

Although it was their first time competing, the students made an impression with their topic about high school dropout. Jackie and Tanner spoke about causes related to dropout and

ways to prevent it. For their effort they were awarded first prize. That’s pretty good for a first try! Congratulations Jackie and Tanner.

In only its second year in existence, John Marshall’s Esports team is working hard to be the best. ecently they competed in a competition held at the Riversport Adventure Complex. Thirteen students went to compete in the games Super Smash Brothers and Rocket League.

Sponsor Em Kemper stated, “The tournament was a fun experience for all of the players, even the one that did not compete.”

John Marshall players made it through several rounds playing Super Smash Brothers, before getting beat. In Rocket League they were defeated quickly as they played the champions in the first

round. Despite the outcome, we are proud of our gaming bears.

• John Marshall students participated in the RACE (Radical Application of Creative Energy) 10th annual “Hip-Hop Nutcracker” at the Oklahoma City Community College (OCCC). Our dancers played the part of robots in the production this year.

Senior Erick Mora Moncado has performed in the RACE production of the “Hip-Hop Nutcracker” four times.

“It was really bittersweet to know that this was my last time to perform in this event. It is a life changing event and really gives dancers like me, a chance to know what it would be like to perform at the professional level.”

The same week as the “Nutcracker” the Visionary Dance Team per-

formed in the high school dance festival. In this event over 400 middle and high school students throughout Oklahoma City Public Schools take a variety of classes from dance teachers around the area, learn combos and then each school performs in a show that evening for the community.

Needless to say the JM dancers were worn out from all their performances.

In reflection of the week, dance teacher Carrie Conwell said, “The dancers were able to dance and take class with professional dancers. Everything they were learning about in the classroom. I am so thrilled and proud of the way each dancer presented themselves as a young professional. Watching them dance and perform makes me so proud.”

The following words, terms and phrases, when used in this Chapter, shall have the meanings ascribed to them in this Division, except where the context clearly indicates a different meaning:

Charging means that an Electric Vehicle is parked at an Electric Vehicle Charging Station and is connected to the battery charging station equipment and is actively charging.

Electric Vehicle means any motor vehicle registered to operate on public roadways that operates either partially or exclusively on electric energy. Electric Vehicles include battery-powered electric vehicles, plug-in hybrid electric vehicles, electric motorcycles, and electric fuel cell vehicles.

Electric Vehicle Charging Level means the electrical force, or voltage, at which an Electric Vehicle’s battery is recharged. Levels 1, 2, 3 Electric Vehicle charging levels include the following specifications: (1) Level 1 is slow charging, providing voltage ranging from 0 to 120 volts; (2) Level 2 is medium charging, providing voltage greater than 120 volts and up to 240 volts; and (3) Level 3 is fast or rapid charging, providing voltage greater than 240 volts, also referred to as Direct Current Fast Charging (DCFC).

Electric Vehicle Charging Station means a public or private parking space that is served by battery charging equipment that has as its primary purpose the transfer of electric energy (by conductive or inductive means) to a battery or other energy storage device in an Electric Vehicle. Electric Vehicle Charging Stations are Accessory Structures.

Electric Vehicle Parking Space means any marked parking space in the MultipleFamily and Commercial Zoning Districts that identifies the use to be exclusively for an Electric Vehicle and that provides an Electric Vehicle Charging Station. Electric Vehicle Charging Stations are Accessory Uses.

EV-Ready Parking Space means a designated parking space for future dedicated Electric Vehicle Charging Station(s).

Sec.50-601. Permits required to install Electric Vehicle Charging Stations.

Electric Vehicle Charging Stations may not be installed in any Zoning District until a permit therefor has been issued by the City Manager or his designee in accordance with this Division.

Sec. 50-602. Application for permit to install Electric Vehicle Charging Station. Persons wishing to install an Electric Vehicle Charging Station shall file a written application for a permit to do so on an application form supplied by the City Clerk. Applications must be certified by the owner(s) of the property. The following attachments (the details of which are stated in the application form) and all other information required by the application form, must accompany the application:

For installation of all Electric Vehicle Charging Stations:

A site plan showing the project address, scope of work, property lines, location of the proposed Electric Vehicle Charging Station, and location of electrical meter panel.

Construction documents showing the size (height, width, and depth) of the proposed Electric Vehicle Charging Station with an electrical plan showing the location of new and existing meter or sub meter, charge controller, wire sizing, and routing.

Information stating the existing panel rating (if any) and the proposed charging load.

For installation of Electric Vehicle Charging Stations in the Single-Family and Two-Family Residential Zoning Districts:

All of the information required by subsection (a) of this Section.

A site plan as required by subsection (a) of this Section that also indicates the footprint of the subject residence with the location of garage and proposed parking spot for use with the Electric Vehicle Charging Station identified.

A screening plan showing how the Electric Vehicle Charging Station will be screened from view if proposed for placement outside.

For installation of Electric Vehicle Charging Stations in the Multiple-Family Residential Zoning Districts and Commercial Zoning Districts:

All of the information required by subsection (a) of this Section.

The application will be considered officially submitted and filed only after it is examined by the Code Official or his designee and found to be complete. Installation of the Electric Vehicle Charging Station may not be commenced until an Electric Vehicle Charging Station Permit has been issued by the City.

Sec. 50-603. Application fee for Electric Vehicle Charging Station Permit.

A nonrefundable fee in the amount established in the City Fee Schedule must be paid to the City by the applicant with submission of the application for an Electric Vehicle Charging Station Permit.

Sec. 850-604. Code Official review; issuance of Electric Vehicle Charging Station Permit.

The Code Official or his designee shall assess the application. An Electric

Vehicle Charging Station Permit shall be issued by the Code Official or his designee if he finds that the applicant has complied with all of the applicable provisions of this Division. The permit will be valid for six months from the date of issuance.

Sec. 50-605. Revocation of Electric Vehicle Charging Station Permit.

The Code Official shall have the power to revoke any Electric Vehicle Charging Station Permit upon determination by the City of any material departure from compliance the plans and specifications submitted to the City with the Application or of any false statements or representations as to material fact relating to the installation of the Electric Vehicle Charging Station.

Sec. 50-606. Construction standards for Electric Vehicle Charging Stations in all Zoning Districts.

Electric Vehicle Charging Stations installed on any property within the City must comply with the installation standards and requirements in this Section regardless of Zoning District classification, as follows.

Installation must comply with applicable laws and standards. All Electric Vehicle Charging Stations must comply with and be installed in accordance with applicable law, including the National Electric Code, the International Codes as adopted by the City, and the then-current Standard for Installing and Maintaining Electric Vehicle Supply Equipment as published by the National Electrical Contractors Association. Further, each Electric Vehicle Charging Station and all of its component parts must meet applicable health and safety standards imposed by the State and the City. The City recognizes that new technologies may be developed in the future related to Electric Vehicles. It is the City’s intent that installation of all Electric Vehicle Charging Stations in the City and the manufacture of such stations installed in the City comply with the highest and best installation standards then in effect as stated in applicable law and published standards.

Signage. All Electric Vehicle Charging Stations must be readily identifiable with appropriate safety warning signage as required by applicable law and as approved by the Code Official, including a statement of the voltage and amperage levels;

Waterproofing of electric lines. All electric lines associated with an Electric Charging Stations must be waterproofed as required by the Code Official.

Depth of electric lines. All electric lines associated with an Electric Charging Stations must be buried to a sufficient depth to protect them from interference with surface digging or landscape maintenance, with a minimum depth of 24 inches.

Identification of circuit breakers. The circuit breakers or circuit breaker spaces for all Electric Vehicle Parking Spaces must be clearly identified in the panelboard director and the termination point for the space.

Service source capacity. The source for service to the Electric Vehicle Charging Stations must provide an adequate capacity for the load served. For Electric Vehicle Charging Level 3 and greater, the applicant must provide proof satisfactory to the Code Official that the capacity is adequate for the proposed service, which may include a letter from the electric company that the proposed Electric Vehicle Charging Station will not negatively impact the electric supply to neighboring properties.

Conditions on issuance of permits. The Code Official is authorized to impose conditions on issuance of Electric Vehicle Charging Station Permits to address health and safety concerns.

Inspection. All construction or work for an Electric Vehicle Charging Station for which a permit is required shall be subject to inspection by the Code Official. Such work must remain accessible and exposed for inspection purposes until approved by the Code Official.

Sec. 50-607. Additional construction standards and requirements for Electric Vehicle Charging Stations in the Single-Family and Two-Family Residential Zoning Districts.

In addition to meeting the applicable construction standards and requirements set out in Section 50-606, all Electric Vehicle Charging Stations installed in the E-1 Estate District, the E-2 Urban Estate District, the R-1-75 Single-Family Residential District, the R-1-60 Single-Family Residential District, and the R-2 Two-Family Residential District, must meet the following standards and requirements:

Private use; permitted Charging Levels. Electric Vehicle Charging Stations must be designed so as to serve only the occupants of the dwelling and only at the Level 1 or Level 2 Charging Levels. Electric Vehicle Charging Stations at the Level 3 Charging Level or greater are prohibited.

Screening requirements. All equipment associated with Electric Vehicle Charging Stations located outside a garage must be screened from view from the public street and from the view of abutting property owners. Such screening may consist of a combination of stone or masonry walls, evergreen landscaping, landscape rocks or other methods approved by the Code Official.

Recommended location. While not required, it is recommended that Electric Vehicle Charging Stations located inside a garage be appropriately insulated. Location of the Electric Vehicle Charging Station in air-conditioned space is preferrable for the life of the equipment.

Sec. 50-608. Additional construction standards and requirements for Electric Vehicle Charging Stations and Electric Vehicle Parking Spaces in the MultipleFamily Residential Zoning District and the Commercial Zoning Districts.

In addition to meeting the applicable construction standards and requirements set out in Section 50-606, all Electric Vehicle Charging Stations and the associated Electric Vehicle Parking Spaces installed in the R-3 Multiple-Family Residential District, the U-4 Church District, the C-1 Office District, and the C-2 Retail Business District must meet the following standards and requirements:

Charging Level. Electric Vehicle Parking Spaces must, at a minimum, be equipped with an Electric Vehicle Charging Station rated at Electric Vehicle Charging Level 2. No impediments or safety hazards. Electric Vehicle Parking Spaces must be designed and located so as not to impede pedestrian and bicycle movement and so as not to create safety hazards on sidewalks. Equipment mounted on pedestals, lighting posts, bollards or other devices must be designed and located as to not impede pedestrian travel or create trip hazards on sidewalks.

Signage. Signage must be installed for each Electric Vehicle Charging Station stating: (1) any time of use restrictions and fees for use payable to the property owner; and (2) that the parking space is reserved for parking and charging of Electric Vehicles.

Accessibility – ADA compliance. Electric Vehicle Parking Spaces must be designed and located so as not to interfere with accessibility. A minimum of one Electric Vehicle Parking Space must be located adjacent to a required accessible parking space such that the Electric Vehicle Charging Station can be shared between an accessible parking space and the Electric Vehicle Parking Space. A minimum of a five-foot wide accessway must be provided by the accessible Electric Vehicle Parking Space if the accessway is not already provided as part of the planned accessible parking space.

Equipment standards and protection. Battery charging station outlets and connector devices may be no less than 36 inches and no higher than 48 inches from the surface where mounted. Adequate battery charging station protection, such as concretefilled steel bollards, shall be used. Curbing may be used in lieu of bollards, if the charging station is setback a minimum of 24 inches from the face of the curb.

Size. Electric Vehicle Parking Spaces must be standard size parking stalls.

Sec. 50-609. Required maintenance of Electric Vehicle Charging Stations.

Electric Vehicle Charging Stations must be maintained in good condition in all respects, including the functioning of the equipment, by the property owner. Removal of any required Electric Vehicle Charging Stations is prohibited. A phone number or other contact information must be provided on the equipment for reporting when the equipment is not functioning, or other problems are encountered.

Sec. 50-610. Requirements for Electric Vehicle-readiness for new development in the Multiple-Family Residential Zoning District and the Commercial Zoning Districts.

New construction in the R-3 Multiple-Family Residential District, the U-4 Church District, the C-1 Office District, and the C-2 Retail Business District that includes new parking associated with the construction may be required to provide EV-Ready Parking Spaces if so determined by the Code Official, in which case the Code Official will determine the number of required spaces. If required, such spaces will be counted toward meeting the overall parking requirement for the project.

Secs. 50-611—50-625. Reserved.

Section 2. Chapter 44, Traffic and Motor Vehicles, Article IV, Stopping, Standing and Parking, of the Nichols Hills City Code is hereby amended by the addition of Division 3, with new language underlined, to wit:

DIVISION 3. ELECTRIC VEHICLE PARKING SPACES Sec. 44-195. Definitions.

The terms Charging, Electric Vehicle and Electric Vehicle Parking Spaces used in this Division are defined in Section 50-141.

Sec. 44-196. Use of Electric Vehicle Parking Spaces in the Multiple-Family Residential Zoning District and the Commercial Zoning Districts.

When a sign provides notice that a parking space is a designated Electric Vehicle Parking Space for an Electric Vehicle Charging Station in the R-3 Multiple-Family Residential District, the U-4 Church District, the C-1 Office District or the C-2 Retail Business District, it is a public nuisance for any person to: (1) park a nonelectric vehicle in such space; or (2) park an Electric Vehicle in such space when that vehicle is not plugged in and properly receiving a charge or is not subject to payment to the provider of the space. In each case, such nuisance is subject to abatement by the City, including removal and impoundment of the vehicle and fines.

Section 3.All ordinances or parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed.

Section 4. The provisions of this ordinance are severable and if any part or provision hereof shall be adjudged invalid by any court of competent jurisdiction, such adjudication shall not affect or impair any of the remaining parts or provisions hereof.

Section 5.EMERGENCY SECTION. WHEREAS, in the judgment of the Council it is necessary for the preservation of the peace, health, welfare and safety of the City of Nichols Hills, Oklahoma, and of the inhabitants thereof that the provisions of this ordinance be put into full force and effect immediately, and therefore an emergency is hereby declared to exist by reason whereof this ordinance shall take effect and be in full force from and after its passage as provided by law.

Antler girls take 3rd at Enid Classic

With a slim 51-48 win over host Enid, the Deer Creek girls basketball team finished third last weekend at the Enid Holiday Classic tournament.

The Antlers (5-4) suffered a 51-46 loss to Class 5A No. 7 TulsaWill Rogers in Friday’s semifinals to reach the

third-place game. They also opened with a dominating 61-20 victory against Northwest Classen on Thursday.

Earlier in the week, Deer Creek escaped with a 56-54 triumph over Westmoore but the Antler boys (3-3) endured a 63-39 setback to the Jaguars.

After the Christmas holiday break, both squads resume the season Jan. 3 at Norman and the boys compete at the McGuinness Classic on Jan. 5-7.

NEWCASTLE TOO MUCH FOR IRISH

Falling behind early, the McGuinness boys never recovered in a 58-41 loss to Newcastle last Saturday in the Sickle Cell Festival at PC West.

Price Bradley and Andrew Harris scored a team-best 11 points each for the Irish (2-4) and Vincent Shivers poured in eight points.

The Irish girls (2-4), meanwhile, suffered a 61-50 defeat to Millwood at PC West.

Both squads open the second half of the season Jan. 2 against Fridayland rival Casady and Jan. 3 at Del City.

CHARGERS FALL AT HOLLAND HALL

In a weekend trip to Tulsa, Heritage Hall left town with just one

win in four contests against Holland Hall and Victory Christian.

On Saturday, the 4A No. 14 Charger boys (33) fell 100-61 to the fourth-ranked Dutch and the girls (2-4) endured a 54-34 setback.

Things turned out better for the girls on Friday with a 55-50 victory at Victory Christian, while the boys took a 70-50 loss to the No. 7 Bulldogs.

KNIGHTS HOLD OFF GUTHRIE

ORDINANCE NO. 1221 AN ORDINANCE AMENDING SECTION 8-28 OF THE NICHOLS HILLS CITY CODE REGARDING THE CITY’S ADOPTION OF THE INTERNATIONAL RESIDENTIAL CODE; REPEALING ALL CONFLICTING ORDINANCES OR PARTS OF ORDINANCES; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. EMERGENCY ORDINANCE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NICHOLS HILLS, OKLAHOMA: Section 1. Section 8-28 is hereby amended, with deleted language stricken through and new language underlined, to wit: Sec. 8-28. Adoption of International Residential Code. That certain document, three copies of which are on file in the office of the City Clerk, being marked and designated as the International Residential Code, 2015 2018 Edition, as published by the International Code Council, as modified and adopted by the State of Oklahoma in Chapter 20, Adopted Codes, of Title 748, Oklahoma Uniform Building Code Commission, of the Oklahoma Administrative Code, is hereby adopted as the residential code of the City for regulating and governing the construction, alteration, movement, enlargement, replacement, repair, equipment, location, removal, and demolition of detached one- and twofamily dwellings and multiple single-family dwellings (townhouses) not more than three stories in height with separate means of egress as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions, and terms of said residential code on file in the office of the State of Oklahoma are hereby adopted and by reference made a part hereof, as if fully set out in this Article, with the additions, insertions, deletions, and changes, prescribed in subsection (b) of this Section. The City Clerk shall keep copies of such Code for distribution or sale to the public at approximate cost. The following sections of the 2015 2018 edition of the International Residential Code adopted in this Article are hereby revised as follows: Section R-101.1 Title Insert “City of Nichols Hills, Oklahoma” in place of “(Name of Jurisdiction).” Add the following at the end of this Section: “All references to “this Code” mean this Code as modified and adopted by the State of Oklahoma and as further modified and adopted by the City.” Section R102.2 Other laws Add the following at the end of this Section: “In the event of a conflict between this Code and another provision(s) of the Nichols Hills City Code, the Nichols Hills City Code will govern.” Section R105.2 Work exempt from permit Under word “Building:” delete items 1, 2, 3, 4, and 5. Section R105.5 Expiration [of permits] is deleted. Section R112 Board of Appeals is deleted. Section R114.1 Notice to owner or the owner’s authorized agent [Stop Work Order] Add the following at the end of this Section: “Where an emergency exists, the Code Official shall not be required to give a written notice prior to stopping the work.” Section R202 Definitions The definition of “Building Official” is changed to read: “Code Official. The building superintendent, the building inspector and other City inspectors, together with their authorized assistants, as set out in Section 8-2 of the Nichols Hills City Code. All references to ‘Building Official’ throughout this Code are changed to read ‘Code Official.’” Section R301.2(1) Climactic and geographic design criteria Add Insert the following into Table R301.2(1), Climatic and Geographic Design Criteria: Table R301.2(1). Insert “Roof Ground Snow Load 10; Wind Speed 90 mph (except for garage doors as provided for in Section 8-29); Seismic Design Category 2; Weathering Medium; Frost line depth 18 ; Termite yes, Decay Moderate; Winter Design Temp 0; Flood Hazards No.” Section R401.4 Soil tests Add the following at the end of this Section: “Notwithstanding the foregoing, geotechnical evaluations of soils signed and sealed by a licensed engineer are required for all new construction of structures of 3000 square feet or more of air conditioned space (including additions of 3000 square feet or more of air conditioned space to existing structures). The recommendations set out in such soils test must be adhered to unless the Code Official approves otherwise.” Section R506.2.3 Vapor retarder Revised as follows: “A 10-mil (0.01 inch; 254 µm) polyethylene or approved vapor retarder with joints lapped not less than 6 inches (152 mm) shall be placed between the concrete floor slab and the base course or the prepared subgrade where a base course does not exist. Exception: The vapor retarder is not required for the following: Utility buildings and other unheated accessory structures. For unheated storage rooms having an area of less than 70 square feet (6.5m²) and carports. Driveways, walks, patios and other flatwork not likely to be enclosed and heated at a later date. Where approved by the building official, based on local site conditions. Section N1101.14 (R401.3) Certificate (Mandatory). Adopted as follows: A permanent certificate shall be completed by the builder or registered design professional and posted on a wall in the space where the furnace is located, a utility room or an approved location inside the building. Where located on an electrical panel, the certificate shall not cover or obstruct the visibility of the circuit directory label, service disconnect label, or other required labels. The certificate shall list the predominate R-values of insulation installed in or on the ceiling/roof, walls, foundation (slab, basement wall, crawl space wall/or floor) and ducts outside conditioned spaces; U-factors for fenestration and the solar heat gain coefficient (SHGC) of fenestration, and the result from any required duct system and building envelope air leakage testing done on the building. Where there is more than one value for each component, the certificate shall list the value covering the largest area. The certificate shall list the types and efficiencies of heating, cooling and service water heating equipment. Where a gas-fired unvented room heater, electric furnace, or baseboard electric heater is installed in the residence, the certificate shall list “gas-fired unvented room heater,” “electric furnace” or “baseboard electric heater,” as appropriate. An efficiency shall not be listed for gasfired unvented room heaters, electric furnaces or electric baseboard heaters. As to Additions, this Section applies to extensions or increase in 30 percent or more of the existing air conditioned floor area of the existing residence. Section P2603.5.1 Sewer depth [Freezing] Insert “12 (305mm)18² (457.2mm)” in the first place of [NUMBER] and “12 (305mm)18 (457.2mm)” in the second place of [NUMBER]. Section P3008.1 Sewage backflow Change to read: “Sewage backflow. All new and replacement sanitary sewers shall be protected from sewage backflow by the installation of backwater valves.” Section 2. AN ORDINANCE AMENDING ARTICLE V OF CHAPTER 50 OF THE NICHOLS HILLS CITY
THE BUILDING COMMISSION REVIEW PROCESS; REPEALING ALL CONFLICTING ORDINANCES OR PARTS OF
SEVERABILITY; AND DECLARING AN EMERGENCY. EMERGENCY ORDINANCE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NICHOLS HILLS, OKLAHOMA: Section 1. Section 50-341 is hereby amended, with deleted language stricken through and new language underlined, to wit: Sec. 50-341. When Certificates of Approval are required; advance consultation with the City encouraged. Certificates of Approval issued by the Building Commission are required before application may be made to move or demolish a Building or to construct a Main Building, a Secondary Building or an Addition to a Main or Secondary Building (except Minor Additions as defined in subsection(b)). Further, the Code Official may refer applications for certain alterations to Main or Secondary Buildings to the Building Commission for a Certificate of Approval prior to granting a Building Permit. Minor Additions. Building Commission review is not required for Minor Additions to the first floors of a Main or Secondary Buildings when such Additions are less than or equal to 15% of the total square footage of the existing Building, provided that such Minor Additions shall be allowed only once every ten

(cd)Certificates of Approval are not required to apply for Building Permits for fences, swimming pools, or Accessory Buildings or Structures when such proposed construction is the only work for which the Building Permit is sought. (de) It is a violation of this Chapter for any person to move or demolish a Building or to construct a Main Building, Secondary Building, or an Addition to a Main or Secondary Building for which a Certificate of Approval is required until a Certificate of Approval has been obtained from the Building Commission as set out in this Article. (ef) While this Article does not require submittal of any documentation prior to formal application for a Certificate of Approval, property owners are encouraged to consult with the City prior to making formal application to become familiar with the policies and requirements set forth in this Article. Section 2. Section 50-372 is hereby amended with new language underlined, to wit: Sec. 50-372. Application for Certificate of Approval. ****** For construction of a new Main Building or Secondary Building, or construction of an Addition to an existing Main Building or Secondary Building for which a Certificate of Approval is required: ***** (3)Except as set out in subsection (f), floor plans, renderings, elevation drawings, and other pertinent drawings, with the Centroid determined as set out in Section 50-3 and that determination signed and sealed by a licensed engineer or architect ***** (f) Renderings for Additions. Renderings are not required for rear yard Additions that are not visible from the Street or any public way. For construction of an Addition to an existing Main Building or Secondary Building, renderings may be required for front and side yard Additions and for rear yard Additions that are visible from a Street or any public way. Notwithstanding subsection (b) regarding Minor Additions, a Certificate of Approval is required if the appearance of the façade of a Building on its street-facing side(s) will be altered, and such façade alterations span over 50 lineal feet of the Building or 30% of the façade, whichever is less. A Certificate of Approval pursuant to this subsection is not required for: (1) the removal and replacement of like materials to the façade; nor (2)
