Ti any Dowell Lashmet is a professor and Extension specialist for Agricultural Law at the Texas A&M AgriLife Research and Extension Center in Amarillo. She recently posted the following Corporate Transparency Act update:
“On Dec. 3, a federal judge in Texas issued a nationwide preliminary injunction in Texas Top Cop Shop, Inc. v. Garland halting the enforcement of the Corporate Transparency Act and staying the beneficial ownership reporting deadline. The court found that plainti s were likely to succeed on their claims that the Corporate Transparency Act violates the 10th Amendment. For now, the reporting requirement deadline is on hold.”
AFBF President Zippy Duvall also commented on the nationwide injunction ordered by the federal court in the Eastern District of Texas halting enforcement of the Beneficial Ownership Information filing requirements under the CTA. The requirement requires the filing of private business ownership information with the federal government.
“Farmers and ranchers across the country have faced great uncertainty since the passage of the Corporate Transparency Act in early 2021 and as the Beneficial Ownership Information regulations have been written,” Duvall said. “Questions are swirling about who is required to file and who will have access to the confidential data being collected.
“Farm Bureau has long fought against the mandated disclosure of farmers’ private business information to the federal government in a number of di erent scenarios. For a second time this year a federal court has ruled the CTA oversteps the Constitution on that front. We appreciate the temporary reprieve provided by the injunction and hope Congress can take a cue from the courts in the coming weeks to provide a more permanent resolution to this problematic policy.”

■ Equipment types traveling on gin yard. (module trucks, wheel loaders, semi-trailers, pickup trucks, other).
■ Major routes for equipment on the gin yard. Instructions to NOT STOP in major pathways of equipment on the gin yard.
