TACO has been very active this year so far and we see nothing in the future to change that. We have attended RV shows, directly or indirectly, and handed out thousands of camping guides along with member literature. We have attended tourism-related events and can confirm that RVing and camping is alive and well in Texas. There is some trepidation in the marketplace regarding $4 a gallon gasoline and $5 a gallon diesel fuel, or higher outside the state of Texas. Technically, this brings back the old staycation concept – folks are going to continue getting in their downtime but just closer to home. Newsflash – tailor your marketing efforts accordingly because these fuel prices aren’t dropping precipitously any time soon. Speaking of marketing, we have distributed more TACO guides quicker this year than any year previously, and website visits are up 25%. We had to take a second semitruck load of guides from the printer just recently to accommodate the demand. All this proves that print is not dead, it’s rockin’, and to that end the TACO guide and digital marketing representatives are in the field right now
helping parks fill their campsites. Don’t miss out on these unique opportunities. Michael Moore represented TACO at the latest meeting of a task force convened by RVIA. They discussed several issues relevant to Texas Campgrounds including campground standards and marketing. Meanwhile, our legislative team continues to work on significant issues like zoning restrictions, utility billing, lawsuit liability, property taxes, etc., that affect campgrounds across the state. See Ron Hinkle’s legislative report for more details regarding efforts, Sunset Commission hearings and the upcoming legislative session agenda. As many of the TACO members know, the Texas Legislature meets in January 2023 for the 88th Legislative Session. In the meantime, the Texas legislature is in the interim period, but there are a number of issues already taking place where the RV Park industry can make a strong impression on our concerns. But first, here are the legislative priorities we are working on now for the session in 2023:

Relief and reform from antiquated TCEQ policies on the cost of and use of the public water system that defines water availability to RV Parks. This will be in the form of re-filing SB 1676 from the 87th Legislature.
Meaningful property tax relief for residential and commercial entities as promised by the legislature.
Liability protection for RV Parks and campgrounds. This will be a re-filing of HB 1478 relating to liability protection for RV Park and campground entities for injuries arising from certain activities.
One of the issues coming up quickly is the Texas Commission on Environmental Quality (TCEQ) Sunset review. TACO has put together some information that can be sent to the Texas Sunset Commission on their website where public input is sought. After instructions are emailed from TACO about how to participate in the Sunset review, we highly recommend that TACO members provide input. Follow the instructions (will be sent soon!) to comment online. Use the information provided to recommend certain actions by TCEQ relating to water issues and RV Parks. This information will go directly to Texas Sunset Commission members for their review. Other important and timely issues are covered in legislative interim reports that have been provided to the TACO membership. Various topics are selected among leadership for legislative committees to hold meetings in Austin and around the state, for public input. Some of the topics that will be addressed and important to TACO members are appraisal and property tax relief (commercial and residential); strengthening the travel/tourism industry; ensuring a reliable electric grid; policies on workforce and job creation; and water infrastructure. The Senate Committee on Finance will meet the State Capitol on May 17th, as part of their interim charge to examine and recommend ways to reduce Texans’ property tax burden. In particular, the committee will review and report on proposals to use dedicated state revenue (in excess of the state spending limit) to eliminate school district maintenance and operations property tax. Lastly, TACO is lining up legislative sponsors for our priority legislation, by reaching out to specific House and Senate members requesting they agree to sponsor our legislation. H

KOA MONTHLY RESEARCH REPORT KOA continues to track camping incidence and behavior of all campers throughout the U.S. and Canada monthly. This special report evaluates the camping market from both a look-back at previous months as well as a look-forward to show the trends for how the market continues to evolve. Previous camping reports can be found at KOApressroom.com. IT’S CAMPING SEASON! Spring has arrived with 1-in-5 campers planning to take a warm weather break. With optimism increasing, and more than half of campers already booking some of their trips for this year, the look ahead for 2022 is strong. As the influence of COVID-19 continues to decline, it can be expected that campers (and other leisure travelers) will seek to expand their experiences, looking for new ways to camp and spend time outdoors (e.g., glamping, unique accommodations/experiences, different locations.) With many campers still making adjustments due to the high volume of campers, and occasional challenges in finding a preferred campsite, the industry can expect alternative camping options to flourish.

Demise of Chapter 313 Should Prompt Thorough Examination of Commercial Property Taxes By Tom Wolfe, Texas Conservative Coalition Research Institute, Policy Analyst
property tax relief to all business owners. Indeed, its benefits flow primarily to large companies with the pre-existing ability to hire a large number of workers or make significant capital investments. The average small business owner, in contrast, simply sees his or her property tax bill climb year after year. Given the contributions that small and mid-sized businesses make to the state economy, Chapter 313 almost exclusively favoring larger companies raises fundamental questions of fairness in both the existence and application of such programs. Indeed, some industries are automatically excluded from Chapter 313; for example, restaurants and retail stores generally cannot qualify. SECOND, the idea that companies receiving Chapter 313 tax breaks would not have expanded in Texas unless they were provided tax breaks has come into serious question. Although the Comptroller is tasked with verifying that a company applying for Chapter 313 tax breaks would not move to Texas without the breaks, there is no practical way for the Comptroller to determine this beyond taking the company at its word, and most companies give that word eagerly. In recent years, there have been news reports of companies breaking ground on projects in Texas and then subsequently claiming in their Chapter 313 tax application that they would not be relocating to Texas if it were not for the tax break. Nate Jensen, a professor at the University of Texas at Austin, estimates that 85 percent of the companies receiving Chapter 313 tax breaks would have expanded in Texas even without the tax break. This suggests that the program is both unnecessary and, for the most part, wasteful. THIRD, the idea that Chapter 313 is not necessary to entice many of its beneficiaries to move to Texas is bolstered by the practice of companies making side payments to school districts as part of the negotiated agreements. As the Comptroller notes, companies effectively give back an average of 13-20 percent of their received tax breaks to school districts. This kickback-like arrangement makes clear that Chapter 313 subsidies are more generous than necessary to attract businesses. FOURTH, throughout its history, Chapter 313 has had a poor track record of job creation. Notably, creating high-paying jobs was one of the original goals of the applicable statute. Eventually, even modest job creation demands on the part of the state (10-25 jobs being created per Chapter 313 project) were apparently too much. Many Chapter 313 projects, especially those in the renewable energy industry, routinely request and are granted waivers of the job creation requirement. Proponents of Chapter 313 will argue that these tax breaks generate all kinds of economic activity indirectly, but even if those claims could
Commercial property taxes in Texas are burdensome due to a combination of high tax rates and a broad tax base. In 2021, the Legislature declined to extend the Texas Economic Development Act, found in Chapter 313 of the Tax Code (Chapter 313). Chapter 313 offers significant property tax breaks to companies re-locating to, or expanding in, Texas. To secure these tax breaks, companies are required to demonstrate that they create jobs and/or make large capital investments. Chapter 313 had many failings that emerged over the years. These failings, along with a strong sentiment against these types of economic development policies, led to a disagreement over its reform and extension that ultimately led to its expiration. Some brief background on the program is in order. Chapter 313 permits school districts in the state to enter into agreements with companies under which the companies’ new property in the school district is limited to a fraction of its actual value for the purpose of calculating Maintenance & Operations (M&O) school district property taxes. This value limitation agreement stays in place for a 10-year period, after which the property is taxed at its then-fair value. The company is required to make a minimum capital investment in the area and create a minimum number of jobs (although as discussed below waivers of the job creation requirement are frequently granted). In addition, the Comptroller must determine that the tax break was a “determining factor” in the company’s decision to invest in Texas. A particular point of interest about the program is that a company often agrees to make side payments, known as “payments in lieu of taxes,” or “PILTs,” to the school district during the agreement term. Once Chapter 313 became law in 2001, businesses and school districts quickly took advantage of its offerings. As of June 2020, there were 509 active agreements in the state. Notably, the Legislature’s decision to not extend the program beyond the end of 2022 does not prevent companies and school districts from entering into agreements before December 31, 2022. Any such agreement will last for 10 years. Thus, it can be anticipated that companies will eagerly seek these “grandfathering” provisions by entering into Chapter 313 agreements before December 31, 2022. Even if the analysis is restricted only to the agreements in place as of June 2020, approximately $10.8 billion in tax breaks have been, or will be, granted to companies over the life of the agreements. An aggregate tax break of this size—granted to a relatively small number of Texas companies—must be carefully examined. That examination highlights a number of flaws in Chapter 313. FIRST, a key flaw in Chapter 313 is its failure to provide broad

Is the RV Industry Ready for the Electric Vehicle Revolution? Part 2 of 3 By: Tom Davidock

that power outages are pretty common on hot summer days when dozens of RVs are running their air conditioners. Now, complicate this electric demand with EV charging, and many campgrounds simply won’t be able to keep up with it. This issue may not be a problem in the short term, but campgrounds will need to prepare and upgrade their sites for widespread EV tow vehicle use in the future. This change will take time, but more importantly, money. I venture to guess that this isn’t even on the radar of most RV park managers.
Batteries are just one component of the RV industry’s challenges for the EV revolution. Another is charging on the road. While the last decade has resulted in significant growth of EV charging stations, they are designed for the passenger vehicle market. Trucks towing RVs simply can’t utilize the current charging options. Also, since towing RVs with current technology will require more frequent stops, RVers will need a lot of these larger stations. RVs will take up a lot of space when parked to charge, perhaps the room of 4-5 passenger vehicles. They may also take longer to charge with their larger battery banks. The current reality is that there just aren’t any mainstream options available to accommodate this right now. However, EV technology will eventually make its way into the hauling and transportation sector. When this happens, the need for charging for electric semi-trucks transporting goods and materials across the country may lead to solutions for the RV community.
WHERE DO WE GO FROM HERE? At the beginning of the article, I suggested that we could be on the cusp of one of the most significant innovation points to the RV industry. However, when reading through the challenges the industry is facing, is that accurate? The answer is yes. The reality is that there is no stopping the transition from ICEs to EVs. It’s going to happen, and the industries that rely on it must change too. For the RV and camping industries to get ready for this change, they must work in unison with other sectors of the economy to solve the outstanding challenges. However, just as the EV truck market can’t solve everything alone, neither can the RV industry. Below are some of the critical changes we need to see in the coming years or decades to make EV RVing a reality.
RV DESIGN AND SIZE Until EV technology significantly improves, most of the RV fleet on the road today won’t be able to take advantage of it. This reality is simply due to the fact that many RVs are big and heavy. Trucks like the Ford Lightning or Rivian R1T cannot tow the larger trailers and 5th wheels on the road today. Even the ones within their tow capacities won’t be viable options because of the truck’s limited range when towing. RV design is simply not ready for the EV market. Getting there will require innovation and the adoption of new, lighter materials and more aerodynamic designs. The only viable RVs ready for the EV truck market today are the small teardrop-shaped RVs or slightly larger ones used by weekend warriors camping close to home. RVers accustomed to larger RV living quarters, fifth wheels, and long-distance travel will not have viable options for several years.
TOW VEHICLE MANUFACTURERS AND CHARGING The recent introduction of EV trucks to the market is a good start. The big players in the market (Ford, GM, Chevy) have a strong history of building heavy-duty trucks to meet their customer’s needs. Even though current EV technology is not ready for this segment of their business, I can assure you that their engineers are hard at work readying themselves for this. In addition, while the RV community makes up a significant percentage of their customer base, they’re also concerned about the construction industry and fleet vehicles. Truck manufacturers will need to invest heavily in technology that will significantly increase range and decrease weight. They will also need to lead the way in n developing charging options for their vehicles when on the road. Elon Musk made this a priority early on when developing Tesla. As a result, while they were building cars, they were simultaneously constructing charging stations throughout the country. Other manufacturers will need to do the same and help build the
CAMPGROUNDS Another challenge for electric RVing is the traveler’s end destination: the campground. Can campgrounds handle the electric demand of an electric RV fleet? Currently, the answer to this is no. Many campgrounds are maxed-out with their electrical capacity. Many campgrounds operate using a private electric network installed in the 1970s and 1980s. If you’ve camped at any older park, you will know

necessary infrastructure to power their vehicles. The U.S. government will also need to step in and provide funding for the electric charging infrastructure required for the EV revolution. While RVs will benefit from it, the primary driver for action will likely be the transportation industry. Moving goods and materials across the country is vital to the U.S. economy, which should push the feds into action. Transitioning the traditional diesel trucking fleet to electric alternatives will positively impact the RV community. It will provide charging options to accommodate larger rigs and in more places throughout the country. There is some good news on the charging front. In Oregon, through a partnership by Portland General Electric and Daimler Trucks, inroads have been made in meeting the needs of big-rig charging. As it’s named, Electric Island is the first US charging station for electric semis, providing megawatt fast-charging, something that the RV industry may need. However, this technology will need to be replicated throughout the country before EV RVing can become a reality. The advancement of electric semi-trucks is also critical for the
RV industry. While towable RVs will rely on EV trucks, larger Class A motorhomes will require a whole different solution. Future EV motorhomes will likely use the same technology that powers semitrucks and busses. SIXTH, for those districts which do have a Chapter 313 agreement, an overlooked flaw of Chapter 313 is that, by the time a given valuation limitation agreement expires and a company’s property is placed on the tax rolls at its fair value, the property may have already depreciated considerably. To illustrate the problem, consider a case in which business equipment valued at $250 million at the time the agreement is signed is exempted from school district M&O taxes for 10 years, but at the end of that 10 years the property is worth only $30 million. Although the Comptroller is not supposed to approve Chapter 313 projects unless they will generate tax revenue over a 25-year period that offsets the forgone property tax revenue during the value limitation period, the Comptroller noted in 2016 that attempting to predict whether this will occur involves considerable speculation and uncertainty. To ensure that Chapter 313 projects generate tax revenue sufficient to offset the forgone revenue during the value limitation
be verified, the same is true of any economic subsidy. The real question is whether the state’s taxpayers as a whole are getting value for the Chapter 313 subsidy. FIFTH, while there is no question that some school districts get a good deal from Chapter 313, they may do so at the expense of the state. Under the state’s funding formula for public schools, school districts can receive state aid if their taxable property values are low compared to their number of students. As the Comptroller noted in 2016, “Most of the local tax revenue the school district forgoes under Chapter 313 is replaced with state funding. Thus, the act uses state revenue to promote local economic development.” Compounding the “localization” of benefits, the side payments school districts receive from companies—unlike property tax revenue—are excluded from the state funding formula and thus are never at risk of being distributed by the state to other school districts.

tax system. An improved property tax system would recognize that the state’s current system is not welcoming to capital-intensive businesses, just as Chapter 313’s implementing statute so recognized. But unlike Chapter 313, a reformed property tax system would make sure that property tax relief is extended to all businesses, not just a handful of favored ones. And if any tax breaks are targeted at certain companies, the state has the right to demand specific, non-waivable job creation and capital investment commitment from the companies. Finally, a guiding principle of commercial property tax reform should be ensuring that interested parties are not playing with house money; the state should never be on the hook for agreements that local taxing units negotiate with businesses. H
period, a “claw back” tax could be applied to companies whose capital investment depreciates beyond a certain percentage by the time the property is fully on the tax rolls. While the above flaws raise serious concerns about the wisdom of the Chapter 313 program, it is important to note that the program has arguably had some positive effects too. For example, the agreements in place as of June 2020 are estimated to have increased the I&S tax base throughout the state by more than $92 billion. And while some companies may exaggerate the importance of Chapter 313 in being a “determining factor” in their decision to set up shop in Texas, there is no question that Texas’s property tax system is unfriendly toward capital-intensive businesses. Given the fierce competition among states to attract business development—witness the nationwide bidding war for Amazon’s HQ2 project in 2018—Texas must re-think its property
