CONSERVATION EASEMENTS

THE MONTANA LAND RELIANCE The Montana Land Reliance (MLR) partners with private landowners to permanently protect agricultural lands, fish and wildlife habitat, and open space. Since its establishment in 1978, MLR has worked with over 850 landowners to protect over 1,030,000 acres of land in Montana. It is the largest land trust in Montana and the largest accredited, statewide land trust in the country.

WHAT IS A CONSERVATION EASEMENT? Conservation easements are the only conservation tool that permanently protects private land from inappropriate development. Conservation easements are the legal glue that binds a property owner’s conservation ethic to their land in perpetuity. Donors of conservation easements retain title to their property, and the easement runs with the title, regardless of changes in future ownership.

STEPS TO RECEIVE CHARITABLE INCOME TAX DEDUCTION FOR THE DONATION OF A CONSERVATION EASEMENT:

STEP 1

Landowner and MLR agree on specific terms of the easement and complete “due diligence” work (title commitments, county review, etc.).

STEP 2

A resource documentation report is prepared to document the condition of the property at the time of the easement donation.

STEP 3

A mineral remoteness report is prepared, if necessary, as required by the Internal Revenue Code.

STEP 4

Landowner secures a subordination from any mortgage or contract holders.

STEP 5

Landowner procures a conservation easement appraisal

STEP 6

Landowner consults with professional advisers to review final documents and determine tax consequences.

SOME GENERAL GUIDELINES OF THE DONATION ARE AS FOLLOWS: The amount of the charitable donation is determined by the difference between the value of the property before and after easement restrictions, as determined by a qualified appraiser. The donation amount is treated as a charitable contribution. Landowners donating conservation easements may deduct the value of the easement against 50% of their adjusted gross income in the year of the donation, and up to 15 years in the future for any unused contribution amounts. Qualifying farmers and ranchers may deduct against 100% of their adjusted gross income Farm and ranch corporations may also be eligible for the 100 percent deduction available to agricultural landowners.
