CTA and the Driver Inc. Movement Every industry has at least one lobby group that represents them. It’s actually a fairly decent system where industry professionals assist elected officials in making policies and laws that govern respective livelihoods. Those who win elections often only have one major talent… getting elected. Too often cabinet positions are assigned based on qualifications that have little or nothing to do with actually knowing the portfolio to be governed. I know one elected official who had to be informed of the difference between a half ton truck and a highway tractor. A lobby group is needed to professionally assist elected officials without having to educate them with decades of details. It is designed to avoid taking an industry down dark and bumpy paths of ignorance or a lack of understanding. The CTA (Canadian Trucking Alliance) is the Federal extension of the many Provincial Trucking Associations. It is designed to address Federal trucking issues. There are definitely transportation issues that the Federal Government needs to address that the individual, Provincial Associations cannot. The CTA’s assistance with inter provincial freight movement is fundamental to effective and efficient oversight on many issues such as bio-diesel mandates to universal hours of service, just to name two. Their input is often times the greatest voice of reason in a multi-polar political climate. However, in my opinion, the latest push by CTA to squelch incorporated drivers is truly beyond their mandate. It’s not that I disagree with their position, but I think their approach is doomed to fail on many levels. The CTA’s position that they are defending the country against potential tax cheaters is an abominably weak argument. It is not the responsibility of CTA to do CRA’s (Canada Revenue Agency) job. The assumption that CRA should 20 • OVER THE ROAD
“police” the trucking industry at the direction of the CTA is preposterous. I have successfully worked with CRA for over three decades. The vast majority of auditors and workers there are exceptionally fine individuals who are doing the best job they can within their system. Their mandate is to ensure that everyone is paying the correct amount of income tax, CPP and EI (if applicable). They simply do not care if the person is T4’d, self-employed or Incorporated. It is true that auditing a T4’d driver is much easier than the others. But ease of work load is irrelevant. It is also true that there are rules associated with classifying someone as “self-employed” or “employee”. The Source Deduction Department of CRA could be emphatically against a selfemployed driver but the GST/HST department couldn’t care less and neither does the Income Tax Department. I’ve seen auditors sit down and train a “self-employed” driver to calculate GST/HST and organize their paperwork. As long as they pay the correct amount of taxes (including the employer’s portion of CPP) they generally don’t care and, why should they? Their mandate is to ensure people are paying the correct amount of taxes. Not very long ago I had a conversation with a source deduction auditor about a perceived 15 hour per week “deduction exemption”; the one that implies that if a person works less than 15 hours per week the “employer” doesn’t have to put them on payroll for deductions (a situation I DO NOT endorse but have had to occasionally deal with for clients). He concurred with me that there is NO SUCH EXEMPTION; however, he stated, many auditors do not enforce these levels of T4 classifications due to its inconsequential impact on the “employer” remittances. As long as the recipient (self-employed worker) declares the income, the issue is not relevant enough to enforce. This enforcement logic filters its way

through CRA at many (or even most) levels. If everyone is paying their taxes, CRA doesn’t much care.
The level of fraud that the CTA implies is just not possible long term. Canada’s tax reporting system eventually finds them… usually broke and running from creditors.
CTA’s position that CRA should care about “potential” tax fraud is misdirection in several ways. It assumes CRA doesn’t care about tax fraud (which it obviously does). CTA isn’t motivated by potential tax fraud; they are trying to “level the playing field” by imposing employer costs on carriers who have found other options. They are trying to retain as many drivers as possible in a manageable pool. They are trying to get CRA to assist them in an area that they have failed to do on their own; care for and educate drivers to financially succeed in their chosen career.
Carriers who impose Driver Inc. on their “employees” do it for a reason; to save costs and potential liability. Drivers should think through the cost benefit of changing their tax reporting methods. It requires a level of cost and commitment that MUST be compensated for. If it doesn’t pay, find another carrier. Our firm does have Driver Inc. clients. However, we find that 50% end up owning their own truck within two years and the other 45-49% end up closing their company within the same time frame (often owing taxes). The remaining 1-5% are all family related issues or unique situations. For my company, Driver Inc. companies are considered an entry level client and the introduction to becoming an Owner Operator.
A Blue Ribbon Task Force produced a report that addressed driver retention and turnover. Though it said carriers should look inward at how they treat their drivers, it presented its position with the strength of a “wet paper bag”. I agree with the findings, but many carriers are just not getting it. They still treat their drivers like herds of cattle, prodded them with zappers and directing them with barbed wire. Using CRA as their latest zapper just shows the mentality of too many carriers (at least those with influence at the CTA) is still “a boot on the neck”.
Drivers, take your time; do the math; calculate the true cost/benefit. You should always retain your right to walk away from anyone requiring something like this be done and, don’t let a special interest lobby group scare you into or away from a choice you’ve calculated to be prudent.

The only tax benefits would be writing off minimal expenses and that nearly always produces less tax savings than the new added employer CPP cost and much higher tax return costs. It’s simple math. Zapping those accepting a math error rather than selling the truth is a failure in optics.

The situations you are in with your family, friends and the carrier you drive for are because you choose to be in those situations; either good or bad. There are no chains that keep you where we are at, regardless if it’s either a good or bad situation. You are in charge of you. This is a simple concept… right? Well, if that is true then why do we seem to be so hell bent on sticking with the ordinary in our lives when the extraordinary is within our grasp? We all have the power to change if we are motivated to do so.
So what can you control as an Owner Operator? You control many significant operating expenses such as your MPG. Is it as high as you can possibly get it? You control your maintenance cost. Are you doing everything necessary to minimize this expense? Do you have a good relationship with the shop that does your work? Do you handle as many minimal roadside breakdowns as you can yourself by carrying your own tools, grease etc.? Do you have a good Accountant and financial support staff who know trucking and can offer advice when needed? Are your financing costs in line with what they should be? Your relationship with your dispatcher - is it cooperative or aggressive? Are your living expenses outside your truck reasonable?
So you are not happy with your current carrier and you are contemplating making a change (as many of you are or you might not have even picked up this magazine). What do you do now? Many Drivers will simply look through recruiting ads and make a short list of carriers to call and see what they have to say. They might listen to what their buddies have to say about where they’re working or listen to the CB rumor mill etc. Each of these little bits of reconnaissance will have some limited value. If you’re considering leaving your current carrier, my question to you is…” what have you done to make the place you are at now a success and why is it bad?” Ask yourself. “What can I control in

Now look at what you can’t control. You cannot control the number of miles you are offered and if there aren’t enough for you to make a living you will need to move on ASAP. You also can’t control certain costs your carrier is probably going to pass on to you that might include your base plates, insurance cost etc. Let’s try doing it this way… grab a piece of paper and draw a vertical line down the middle of the page. List all your fixed expenses on one side. This may include your truck payment, base

plate and insurance if it is a set amount. On the other side of the line list all of your variable expenses such as fuel, maintenance, on-road meals, calling cards and tolls etc. When you have finished collecting all the things that it cost you to run your business, fill in the dollar amounts that each one of these cost you each month. Try not to go into shock as you see the numbers all in one spot. It can be shocking but please be honest with each entry.
you became a small business person. Are you sure you are acting like one? One of the miracles of trucking is the maze of different pay packages that exist in this business. No two are alike and they all have their own little nuances that can make or break an Owner Operator or Company Driver. One of the biggest fallacies is that bigger is always better. It may very well be that the carrier that advertises the highest gross rate will not be the carrier that will put the most in your pocket. Shop wisely and investigate what processes and offerings each carrier provides that might help you reduce your variable cost. Some carriers offer reduced shop rates, some might offer discount group offerings on cell phones, fuel or health benefits. Whatever it might be, investigate it all and see what might be available that you can leverage to reduce your variable savings and help you to succeed.
After you have done this look at each item. On the fixed side, try and see if everything listed is in line to what you know about the industry. Although these items might have a fixed payment schedule attached to them you should still feel comfortable that they are reasonable. If you’re not sure, your financial advisor should be able to help you here. The variable side is often where the savings can be found. These items are within your control and every opportunity should be explored to ensure that these items are minimized. Obviously, you don’t want to go cheap on your maintenance cost and bring on a big expense later. So, when I say minimize I don’t mean to be penny cheap and dollar stupid. What I mean is that you have to be comfortable that all the expenses wrapped around what it cost to run your truck (business) are in line and you are doing your best at all times to keep these under control and always with an eye to reducing them further.
This advice is applicable for Company Drivers also. While you don’t have truck payments and base plates to worry about, you still face many variable costs which dictate how profitable you’re driving career is and how much money you take home at the end of the day. Take a hard look at your meal and phone costs. Can you save money (and remove an inch from your waistline) by choosing your meals carefully? Absolutely! Do your homework and compare cell phone packages. Saved pennies quickly turn into saved dollars. Safe Trucking!
I am not trying to talk anyone into leaving the carrier that they’re currently working with. I am simply trying to slow down the Owner Operators who have had 5 jobs in 5 years and cannot understand why everyone’s always picking on them. Look in the mirror… one of the reasons you became an Owner Operator is for the independence; when you made that decision,

Sharp Transportation’s Five Elements of Trucking When Shawn Baird, founder and President was asked how he named his company twenty years ago; he related that while trying to decide on a name for his company, he was faxing ideas of different names to his lawyer on a fax machine with a brand name of Sharp. Shawn thought to himself, this has a good sound so why not check out this possible name too? Thus, Sharp Transportation Systems Inc. was born. Shawn’s business has evolved significantly over its 20 years in business which started with one truck, two trailers and a contract to move hotel furniture. This led into hospitality and transporting office furniture. By 2003, Sharp had opened an operation in Holland, Michigan where many of the big office furniture companies make their headquarters. 2005 presented a new opportunity as the company ventured into the pharmaceutical

sector. Shawn’s passion and insight in this sector was noticed by others and in 2008, Shawn assisted in the planning of Canada’s new guide for temperature-controlled freight for FDA and all medications. Specializing in the movement of pharmaceuticals now constitutes the majority of Sharp’s business. “The bottom line is that trucking is expensive so we strived to target highly-specialized industries for which we haul freight and we have made our niche market”. A clear sign of the company’s specialization is that they have recently developed ‘Sharp’s own Pharmaceutical Chassis’ which is spec’d with air ride. Today, twenty years later, Sharp Transportation now has two major customer base industries; office furniture and pharmaceuticals. As a result, the company only does spot loads to move a driver from point to point. As President,

They pick detail packages themselves and the interior of the truck is important as well, so they get to have a say”. Shawn openly admits, “In truth, I have a love/hate for trucks. They cost a lot to buy and to operate.”
Shawn is active in sales and overseeing the business operations. He has developed a strong team to manage the fundamental principles in running any business and Sharp Transportation follows a program that Shawn describes as: the Five Elements of Trucking. This involves taking the following five pieces and making them fit together: Sales, Driver, Mechanical, Governing Bodies and Weather.
Sharp’s approach to regulations is straightforward: “To be fair to everyone and to follow all laws in all lands”. This works into Sharp’s logistics strategies and most of their harbor work is done through the ports in Halifax, NS due to the ever-present risk of strikes in the USA sea ports.
Sharp’s approach to sales is to acquire the customer first. The process they follow is to determine the prospect’s needs and quality controls. Any certification that is required is determined and a full disclosure is given to the prospect regarding rates etc. Once the prospect becomes a customer, the transportation division of the company takes over by purchasing a truck while they find the right driver.
In dealing with weather issues, Sharp planners consult the NOAA site and base decisions on outlooks. If there is a severe weather forecast, planning is modified accordingly. “There is nothing that we deliver that cannot wait a day,” says Shawn. “The moment you force a driver to move [in bad weather], they are 80% more likely to be in an accident. Any of our drivers can rest assured that if they decide to park the truck due to weather, it is their call and there will be no punitive action.” Shawn continues, “There is no autocratic behaviour here. We have stripped authority from our dispatch; they cannot fire or force drivers into any situation. Dispatch has only one role; to communicate information and support the driver and the customer.” And speaking of dispatch, there have been great efforts made to move as close to paperless as possible and with as much electronic communication as possible. A dispatcher cannot do their job if they are constantly answering phones. Shawn reveals that it makes the office so much quieter, to the point where he occasionally calls into dispatch from his office just to make sure the phones are still working!
Shawn relates that every successful leader has a right hand person. In Shawn’s case, his right hand is Maribeth Filiatrault. Maribeth tells us, “I was originally hired to run Safety and Compliance. Since then, my role has expanded into HR and I have overseen the development of the Quality Control Department. Every Standard Operating Procedure (SOP) for every role and function that a driver must action has had to be papered. Today, this living document suggests that Sharp operates more as a pharmaceutical company than a trucking company. For example, the Guidelines for Temperature Control of Drug Products during Storage and Transportation (GUI-0069) are known by all drivers. Also, audits, both virtual and on-site are a regular occurrence in the pharmaceuticals transportation arena”. “After new business is acquired, or if it is time to upgrade equipment, Sharp’s first order of business is to survey our drivers about their preferences in trucks and features. Naturally, the company has its list of required specs that must also be included.” Shawn said. “The drivers work with the salespeople and they make changes they want up to $10,000.

Sharp Transportation has implemented all the critical, trucking electronic tools and is ahead of the industry in many aspects with the utilization of advanced telemetry systems. Sharp has recently launched their revamped website in commemoration of the company’s 20 year anniversary in September, 2018.

Sharp is also present on all the key social network platforms. Similar to his feeling about trucks, Shawn explains that he personally doesn’t want to be part of social media but knows enough about it to know that the company needs it. So in addition to bringing in Kimberly Biback to handle corporate relations & marketing and as part of the marketing strategy, he decided to have Kimberly oversee and administer Sharp’s digital footprint. This has proved to be a positive step to meet the company’s growth needs as inquiries from drivers come in regularly through these platforms. Kimberly is also involved in seeking out new business and interactions. While launching the revised web site, the company also launched Driver’s Corner – a community for their drivers that provides tips and advice for their health and well-being. This has been a huge hit and a self-esteem boost for the drivers and Sharp Transportation is the only transportation company that currently has a space like this. During the hiring process, applicants are vetted with an extensive screening process that involves a ten year background check and a four hour interview. After the driver applicant has gone through the interview and the hiring process, the driver is put into a mentoring program. For a newer driver the mentoring may be for a longer period of time and for an experienced driver, a shorter period of time. Their aptitude and experience to learn the many processes is also a factor. If a driver later wants to switch careers or needs a change, they are accommodated. Shawn says, “If we hired them and they are still with us, it is because they are good drivers or employees and they are a good fit with Sharp” He states, “hire the good; the good will come. I believe that if you have history and rapport with us, then I also believe in promoting from within rather than bringing in someone new.” For someone thinking of choosing driving as a career, Shawn again states, “If you enjoy driving and your lifestyle allows you to do it, you can make good money driving for Sharp. We like second-career people because they want to be on the road, doing what they’re doing.”

The success of Sharp Transportation is felt outside of the company as well. Shawn and the company have been active for years with animal rescue efforts, both in Canada and the USA. In fact says Shawn, “We have a full-time guy based out of Alabama and all he does is animal rescues in the USA. We work with the Humane Society and other rescue organizations in the USA.” Shawn estimated that Sharp has done between 200-300 animal rescues for the Humane Society in Canada. As for the future of Sharp, Baird said he won’t be growing through acquisitions; rather he hopes to grow steadily using his ‘ABC formula’. “We have looked at acquisitions and I don’t see the value of buying another company. The reaction (from staff) can go either way and it can be a lot of work. So, we will grow through a simple philosophy: A is the customer, B is the truck and C is the driver. A lot of companies out there will try to do B first and purchase trucks and then they go to C, to find drivers. And then try to find A, the customer. We don’t do it that way. We work on A first and we negotiate with a customer for six to seven months. Once the customer is in place, then we do our combined program of hiring drivers and purchasing trucks. I believe that you should always make sure you have the customer first and then everything else will fall into place.” Shawn concludes that working with good people and having the will and agility to evolve, Sharp Transportation has a solid foundation and bright future.
