In 2017, the Haub Environmental Law Program at Pace University continued to grow with the expansion of existing programs, and the development of new partnerships. In the past year, we created and launched a new Food and Beverage Law Clinic, began our tenure as joint Secretariat of the International Union for Conservation of Nature Academy of Environmental Law, developed a partnership with the K.G. Jebsen Centre for the Law of the Sea at The Arctic University of Norway through which we co-hosted a workshop on marine resource management in a changing climate, welcomed new faculty and scholars to campus, including our inaugural Haub Visiting Scholar, and cheered our student-centered Environmental Litigation Clinic, Energy and Climate Center, Land Use Law Center, Global Center for Environmental Legal Studies, and Brazil American Institute for Law and Environment as they advanced environmental law and policy in many arenas. In the coming year, we are excited to continue this momentum by welcoming the Haub Distinguished Professor of Environmental Law, Katrina Fischer Kuh, launching a new student board for Pace’s work with the International Union for Conservation of Nature, and more. We are proud of our Program’s national and international reputation for excellence in the field of environmental law, and of the skilled environmental lawyers we train. The innovative work of our dedicated faculty, alumni, students, and friends has strengthened environmental law and policy on the local, national, and international levels. We look forward to building on our decades of history and traditions with new, exciting endeavors that utilize the strengths of our program, and expand our expertise.

New Endeavors
Collaborations and Partnerships Sustainability, Impact Valuation, and the Food System The true costs of the production and consumption of food in terms of its global impact on society’s shared social and natural capital is an emerging concern for companies, civil society, regulators and consumers. Pace University’s Environmental Law Program has partnered with the University of Oxford’s Environmental Change Institute, along with industry and nongovernmental organizations, to advance the understanding of the environmental, public health and social costs of the food system and to develop life-cycle costing methodologies in promoting a sustainable food system. The Arctic University of Norway Partnership Over the course of the year, we developed a successful partnership with The K.G. Jebsen Centre for the Law of the Sea (JCLOS) at the Arctic University of Norway. We welcomed Dr. Elise Johansen, Associate Professor at JCLOS, to campus in October to discuss marine resource management and the connections to the Law of the Sea with Pace Law students. In June, we co-hosted a workshop entitled “Natural Marine Resource Management in a Changing Climate.” The workshop brought together leading academics from around the globe to reexamine management approaches of ocean and marine resources in light of global climate change. Environmental Graduate Research Fellows Program The Haub Environmental Law Program is pleased to welcome three graduate research fellows to its staff and LLM program in the 2017-18 academic year: Kat Fiedler (Environmental Law Fellow), Robert Habermann (EASE Fellow), and James Ward (Land Use and Sustainable Development Law Fellow). Each fellow works part-time in one of our programs or centers while earning an LLM in Environmental Law. The fellows bring varied interests and life experience to their work with our faculty and staff on innovative projects throughout the year. Past fellows have gone on to work at Riverkeeper, NRDC, AIG, and Pace Law to name a few. Applications for 2018-19 will open in January 2018. Please keep an eye on our website for information.

Awards Nicholas A. Robinson Award for Distinguished Environmental Achievement The Pace Environmental Law Alumni Association awarded the 2017 Nicholas A. Robinson Award for Distinguished Environmental Achievement to two welldeserving recipients, Marc Yaggi, Executive Director, Waterkeeper Alliance, and Dan Estrin, General Counsel & Advocacy Director, Waterkeeper Alliance. Marc and Dan exemplify Professor Robinson’s legacy—they are legal pioneers in the area of water law, focused on local as well as national issues, and supportive of Pace students and fellow alumni every step of the way. The Nicholas A. Robinson Award is awarded each year to an alumnus of Elisabeth Haub School of Law who has made significant contributions to our natural environment. The award is given in honor of Nicholas A. Robinson, the Gilbert and Sarah Kerlin Distinguished Professor of Environmental Law and founder of the environmental legal studies program at Pace Law, whose commitment to and achievements in the field of environmental law are a source of inspiration for those dedicated to the betterment of our environment. Elisabeth Haub Award for Environmental Diplomacy In 2017, an independent jury for the Elisabeth Haub Award for Environmental Diplomacy selected Christiana Figueres as the 2016 Laureate in recognition of her extraordinary service through her environmental diplomacy in fostering international cooperation for climate change and the success of the UNFCCC negotiations in Paris in 2015. This prestigious Award was established in 1997 by the Elisabeth Haub School of Law at Pace University, in cooperation with the Haub Family, to honor the legacy of Elisabeth Haub (1899-1977), a noted philanthropist and advocate for strong laws for the conservation of nature. The Award was established to commemorate the 25th anniversary of the United Nations Stockholm Conference and the 5th anniversary of the United Nations Rio de Janeiro Earth Summit

Clinics, Centers, and Experiential Learning The Pace-NRDC Food Law Initiative is a collaboration between Pace’s Environmental Law Program and the Natural Resources Defense Council. It seeks to grow the legal capacity for our regional food system by training lawyers and law students, and by providing direct pro bono legal services. @pacefoodlaw 2016-2017 highlights • Under the direction of Professor Jon Brown, Pace launched the Food and Beverage Law Clinic, which represents farmers, food businesses, and food justice and sustainability organizations in transactional legal matters. • Professor Margot Pollans interviewed former Deputy Secretary of Agriculture Kathleen Merrigan at the Food Law Initiative’s annual event, cohosted by the Natural Resources Defense Council and GrowNYC. • The Food Law Initiative offered a day of farmer food law trainings at Stone Barns Center for Sustainable Agriculture’s annual Young Farmers Conference. Our award-winning, pioneering Environmental Litigation Clinic incorporates students into a thriving environmental law practice representing public interest groups. @PaceEnvClinic
The Land Use Law Center fosters the development of sustainable communities by promoting innovative land use strategies and dispute resolution techniques. @LandUseLC Projects and news • The Land Use Law Center held its 15th Annual Land Use and Sustainable Development Conference on December 8, 2016. The sold-out event was packed with eight sessions on various land use topics of national significance. The conference theme was The Economics and Equity of Sustainable Development. Vicki Been, former Director of NYU’s Furman Center for Real Estate and Urban Policy and Commissioner for NYC’s Department of Housing Preservation & Development, was the morning keynote speaker. Doug Farr, FAIA, LEED AP, national leader in designing sustainable neighborhoods and buildings, was the luncheon keynote speaker. • The Center is also supporting New York State with expansion of its Climate Smart Communities Certification Program. The Certification Program encourages local governments to lay a foundation for local climate action and recognizes communities for their accomplishments through a rating system. The expanded Program will include an online portal and additional sustainable development actions.
Notable cases • Riverkeeper, Inc. v. Global Companies, LLC: The Clinic represents Riverkeeper in fighting the approval of permit modifications for Global’s massive oil facility near Albany. Thus far, largely due to the Clinic’s efforts, DEC has not approved the installation of boilers at the facility, which would allow Global to handle heavy crude products. The Appellate Division will hear an appeal in the case in September 2017. • New York Water Quality: The Clinic, representing Riverkeeper, Waterkeeper Alliance, NRDC and several other NGOs, recently drafted and served a Notice of Intent to Sue the EPA under the Clean Water Act for EPA’s ongoing failure to require New York to adopt scientifically defensible water quality criteria for the waters around New York City. • Hudson River Anchorages: On behalf of Riverkeeper, the Clinic drafted and submitted lengthy opposition comments to the Coast Guard’s attempt to create multiple new anchorage points along the Hudson River for oil barges. The issue drew a tremendous amount of community opposition, including over 6,000 comments.

The Energy and Climate Center’s mission is to protect the earth’s environment by transforming the ways society supplies and consumes energy. @Paceenergy
Projects and news • Filed over 600 pages of comments and testimony in 11 Reforming the Energy Vision proceedings, and worked with 26 organizations in New York’s REV landscape. • The Center successfully completed our twelfth year as the home of the US Department of Energy’s Northeast Combined Heat and Power Technical Assistance Partnership. In cooperation with our partner at UMass School of Mechanical Engineering, our Center ranked first among all Centers nationally in Technical Analysis services provided to end users during fiscal year 2016. • The Center served as advisors to the NYC Mayor’s Office of Sustainability as they developed a roadmap to reducing greenhouse gas emissions. We assisted in developing a suite of carbon reduction strategies and initiatives, a community energy map that helps identify areas of the city ripe for resilient distributed energy resource deployment, and models to forecast the impact of various policies on the City’s greenhouse gas emissions.

Clinics, Centers, and Experiential Learning A member of the International Union for the Conservation of Nature, the Global Center for Environmental Legal Studies engages in innovative projects addressing global environmental challenges. @GlobalCELS Projects and news • A delegation of faculty, staff, students and alumni represented the Center at International Union for the Conservation of Nature’s 2016 World Conservation Congress in Honolulu Hawaii in September. The delegation debated and voted on motions concerning controversial conservation and sustainable development issues in the Member’s Assembly, IUCN’s highest decision-making body. • This June, Ann Powers and four students attended the Inaugural IUCN US National Committee Meeting in Virginia. The event brought together representatives from forty IUCN member organizations to discuss the goals and priorities of the Committee, and help guide the direction of the US National Committee.

The Jeffrey G. Miller National Environmental Law Moot Court Competition, hosted by the Elisabeth Haub School of Law and run by its students, draws hundreds of competitors and judges to this premier environmental moot court each year. @PaceLawNELMCC
2017 Highlights • In February, over 300 students, advisors, attorneys and judges participated in the 2017 Competition, which addressed the Endangered Species Act and the US Constitution’s takings clause as they apply to an intrastate population. • Judge Bernice B. Donald, United States Court of Appeals for the Sixth Circuit, Judge James E. Graves, Jr., United States Court of Appeals for the Fifth Circuit, Judge Stephen A. Higginson, United States Court of Appeals for the Fifth Circuit, Judge Thomas I. Vanaskie, United States Court of Appeals for the Third Circuit, and Judge Mary Kay Lynch, EPA Environmental Appeals Board served as the final round judges. • Of 63 participating teams, Columbia Law School took first place, edging out finalists from The University of Connecticut School of Law and Stetson University college of Law in an intense final round.
Housed jointly at Pace and the Getulio Vargas Foundation School of Law in Rio de Janeiro, the BrazilAmerican Institute for Law and Environment (BAILE) advances environmental protection and sustainable development in the US and Brazil. @PaceBAILE Projects and news • 2017 saw another very successful Brazilian Comparative Law Class. Following classes in White Plains, the class traveled to Rio and Buzios, Brazil where we had lectures by Julio Melo Borges, a lawyer with IBAMA (Brazil’s EPA), Professor Antonio Porto, who directs the Law, Economics & Environment Center at the Getulio Vargas School of Law (FGV Direito Rio) and many others. • The Elisabeth Haub School of Law and UCS recently signed an agreement that will allow for student and faculty exchanges, among other collaborations with the University of Caxias do Sul (UCS). Building on the partnership, Prof. Cassuto delivered the inaugural lecture in August for the new doctoral program in law at UCS. The United Nations Environmental Diplomacy Practicum—a program unique to Pace Law—places students in internships with Permanent Missions to the United Nations for small island developing states. Recent highlights • The Practicum placed student interns at the UN Missions of Costa Rica, Sri Lanka, Papua New Guinea, Dominican Republic, and the Marshall Islands as well as with the Permanent Observer Mission of IUCN, among others. • It hosted guest lecturers Ambassador Ahmed Sareer, Permanent Representative of Maldives to the UN and Chair of AOSIS (Association of Small Island States) and Dr. Massimo Tommasoli, Permanent Observer of International IDEA (Institute for Democracy and Electoral Assistance). The Washington, DC and New York Environmental Externship Programs give students the chance to gain crucial skills and knowledge while studying with experienced, dedicated practicing professors. Held every fall, the Future Environmental Law Professors Workshop brings visiting assistant professors, fellows, researchers, law clerks, practitioners and others together to learn about the environmental law teaching market. The Workshop covers a wide array of subtopics within the field (from animal law to energy law), as well as the history and development of the field of environmental law. It is designed to give advice, inside perspectives, and feedback on the environmental law hiring process, as well as provide opportunities for mock interviews and job talk presentations. Participants have gone on to secure tenure track teaching positions around the country. Heading into its fourth year, the Workshop has been fortunate to host three excellent keynote speakers in the recent past. Our inaugural keynote speaker, Professor Richard Lazarus (Harvard), discussed “Environmental Law Scholarship: Challenges and Opportunities.” Our second keynote speaker, Professor Douglas Kysar (Yale), discussed “Making a Contribution in Environmental Law.” Our third keynote speaker, Professor Pat Parenteau (Vermont), discussed “Nature Deficit Disorder: A Reply to the Eco-Pragmatists.” We look forward to another insightful Workshop this coming year.
