Just a month after he was sentenced to 15 years in prison for a 2016 child sex abuse case, a 61-year-old Ormond Beach man is now out on bail.

Mark Fugler, a former professor at Embry-Riddle Aeronautical University, was released from jail on Tuesday, Sept. 17, on a $200,000 bond as he awaits the completion of his appeals. The City Commission approved replacing the holly trees on all medians west from the I-95 overpass to Orchard Street with Medjool palms and Crape Myrtles, a project which will cost $839,700.

The City Commission approved a $50,000 building improvement grant for the old gas station site at 100 W. Granada Blvd. The property was originally slated to house the Pumphouse Barbecue restaurant, but Bill Jones purchased the Sunshine Dry Cleaners building nextdoor, and decided to locate the

restaurant there instead, a city memo states. Planning Director Steven Spraker said the two businesses at 126 and 128 W. Granada Blvd. (Chef Rx and the Neighborhood Shop) will not be affected.

by HEJAHA LLC, and the company has indicated wanting an ice cream or other dessert shop to occupy the building, which was built in

1963. The grant is meant to aid in the redevelopment and facade improvement of properties within the city’s Community Redevelopment Area.

There will be nine parking spaces, to be shared with the Pumphouse. The property owner will be given one year to complete the improvements, though the estimated timeline for the project is five to six months.

As Flagler County doesn’t have the ability to provide water and sewer to any future development in the U.S. 1 corridor north of the Volusia line, Flagler is asking for Ormond Beach to provide utilities to a 23.41-acre warehouse for Discovery World Furniture, an assembler and distributer of furniture.

Can the city handle the north peninsula’s sewage?

The city says yes, but Ormond-by-the-Sea residents want more information.

Though Ormond Beach is still in the bidding stage for the design and permitting of the first phase of the septic-to-sewer conversion in the north peninsula, some residents of that area wonder if the city’s wastewater treatment plant can handle their sewage.

Today, the city’s plant treats about 4.6 million gallons of sewage per day. Adding the north peninsula all at once would bring in an estimated 3.5 million gallons, give or take, said City Manager Joyce Shanahan. With the current facility having a capacity of 8 million gallons per day, barring any future improvements that could expand that, the city is confident it can handle the north peninsula.

The Florida Department of Environmental Protection has defined guidelines about capacity, Shanahan said. Based on analysis reports, the DEP could require municipalities to initiate

planning, design and construction of new facilities. “[DEP is] never going to let you bump up against your totals without giving you notifications that you have to expand the capacity of your plant,” Shanahan said.

Some residents affected by the proposed septic-to-sewer conversion in the north peninsula have toured the city’s wastewater treatment plant. One of those is Rashida Hakeem, who is also part of the Ormond by the Sea Association. She said the plant appeared to be run competently, and she doesn’t doubt it can handle its current sewage loads for Ormond Beach residents.

But when it comes to Ormondby-the-Sea, Hakeem said she still has doubts.

“Many of us are concerned,” Hakeem said, adding that residents don’t know how old the pipes are that run from the mainland to the north peninsula for the city’s current sewer customers in Ormond-by-the-Sea. She said the conversion is meant to help the environment, and at this time, Ormond-bythe-Sea residents aren’t seeing “strong reasons” to believe converting to city sewer won’t cause more environmental issues later down the road.

ORMOND TO AMEND COMPREHENSIVE PLAN FOLLOWING ANNEXATION FEARS OVER SEPTIC-TO-SEWER Due to Ormond-by-the-Sea residents’ fears that they could be annexed in the process of having their septic tanks converted to sewer service, the city of Ormond Beach will be amending its Comprehensive Plan to clarify that the north peninsula is exempt from the city’s annexation agreement requirement for connecting to utilities.

The City Commission came to a consensus on the matter at its meeting on Wednesday, Sept. 18, and plans to pass a resolution at its next meeting on Oct. 1, stating it will begin the comp plan amendment process. The amendment will need to go through two readings at the Planning Board level before reaching the commission.

“I don’t think you have to be covering this very closely to know that we’re getting killed on this lack of clarity on annexation,” City Commissioner Dwight Selby said.

Selby, who has spearheaded the septic-to-sewer effort, maintained that the conversion is for water quality. Annexation is currently the biggest objection from the residents, he said, though he predicted it won’t be the only one. However, this is the one that calls into question the city’s motives, Selby said, and must be addressed first.

Five Ormond-by-the-Sea residents spoke against the project at the meeting, citing disbelief in the 2013 Health Department report stating that 1) septic tanks weren’t suitable for the north peninsula, and 2) that they were to blame for the pollution in the Halifax River. The residents requested scientific studies and asked about the city enforcing the county fertilizer ordinance.

“I would like to remind [the

commission] that Ormond-bythe-Sea is our living environment,” Ormond-by-the-Sea resident Janet Nutt said. “We actually like it in Ormond-bythe-Sea just the way it is.”

Committee to follow?

City Attorney Randy Hayes suggested that if the city moves forward with septicto-sewer in the north peninsula, the commission should consider putting together a committee to oversee the project. It would be made up of both Ormond-by-the-Sea and Ormond Beach residents.

Though Selby said he hadn’t given much thought to a committee, the rest of the commissioned voiced support.

“I think that would give the committee’s work some clarity and some representation,” Mayor Bill Partington said.

City Commissioner Rob Littleton said he’d support creating a committee, but that the city has to clarify the comp plan first.

“If we don’t crush the narrative that we have ill motivations, any blue ribbon advisory committee, or something, is not going to work,” Littleton said.

Partington also said the city will hold town hall meetings on septic-to-sewer in the near future.

HOW ORMONDBY-THE-SEA FIRST GOT CITY WATER City Attorney Randy Hayes said it's common for cities that provide water or sewer to properties outside its municipal limits to establish an annexation agreement as a condition, and it is Ormond Beach's general policy. However, that police has never been enforced in the north peninsula. What follows is the history of OBTS utilities.

SPILLS IN RECENT YEARS

Some north peninsula residents have voiced concerns over sewage spillages, and while Ormond Beach has seen seven such incidents in the last two years, Shanahan said they were small and resolved quickly.

The most recent one occurred on Aug. 15 at the Breakaway Trails Pumping Station. There was a power outage that disabled the pumps, and 50 gallons of sewage was absorbed into the ground; the ground was then disinfected.

A few months earlier, 200-300 gallons of sewage spilled into a dry retention area at the Fisherman’s Landings apartment complex on April 18 due to a grease clog. In that incident, 50 gallons were recovered and the rest seeped into the ground, which was disinfected. City crews also fixed the blockage.

In 2017, a leak from a cast iron pipe force main near Granada Plaza at 205 E. Granada Blvd., serving a private lift station, leaked about 50,000 gallons over a number of months. The pipe was repaired and storm drain disinfected.

In the past 10 years, the city has experienced 26 spills due to force main breaks, lift station malfunctions and power outages.

The spills total 149,000 gallons of sewage.

“I don’t think that’s massive, by any stretch of the imagination when you’re treating 4 million gallons a day of sewage,” Shanahan said.

THE ROAD AHEAD

By the end of this year, the city hopes to accept bids and negotiate a contract for the design and permitting of the first of 10 phas-

es for septic-to-sewer conversion in Ormond-by-the-Sea. At around 60% of completion for the design and permitting, the city will start getting a clearer idea of how much the conversion will cost for residents, Shanahan said. But that is likely to take 12-14 months.

“It’s an incremental road,” Shanahan said. “We specifically wanted to get the design work started because of the governor’s platform of clean water. We felt we would have a better chance of getting state funding for that.”

She said the city understands cost is a concern for the north peninsula, and that is why Ormond Beach is working to secure funding from the state, DEP, the federal government and the county. Once they have answers for residents, town hall meetings will follow.

Now that the city has gone on the record that it has no intention of annexing the north peninsula by beginning to amend its Comprehensive Plan — though Hakeem said some residents aren’t convinced the comp plan amendment takes annexation totally off the table — cost is still a major concern for residents.

Hakeem said some in their Facebook group have taken the position to wait and see what it will cost before doing anything else.

Others are leery of the “wait and see” mentality.

“We’re concerned that if we wait until we know what it’s supposed to cost us and all, that it’s too late to do anything about it at that point,” Hakeem said. “Once they give you the bill, you can’t be like, ‘Hey, wait a minute, that’s too much.’”

For over four decades, the Beacon Center in Volusia County has been lighting the way for victims of domestic violence.

Formerly known as the Domestic Abuse Council until its 2017 rebranding, the organization has served 465 women, men and children, both in-shelter and through its outreach, in six months from July 2018 to February 2019 — more than it served in the previous 12 months, from July 2017 to June 2018.

Chief Executive Officer Angie Pye said it’s proof of the center’s outreach efforts. Aside from basic core services, like running an emergency shelter, providing counseling, case management and support groups, the Beacon Center has also increased its advocates (including Spanish speakers), attorneys and amount of financial literacy aid, such as helping victims search for jobs, learn how to write resumes and find housing.

With October being National Domestic Violence Awareness month, Pye said it’s important to remember domestic abuse is a crime that touches all in some way. She herself is a survivor, having grown up in an abusive household, and she hopes the community will come together to take a stand against abuse.

“We see domestic violence as an oppressive crime,” Pye said. “It’s a hate crime, essentially. It’s a crime that’s rooted in sexism.”

This means it generally impacts the female population, Pye said.

In 2018, there were 4,328 reported cases of domestic violence in Volusia County, according to the Florida Department of Law Enforcement. Ormond Beach ranked fourth in the county with 248 cases reported to Ormond Beach

People have a hard time understanding domestic violence, Pye said. In her 23 years of working with survivors, she’s always asked: “Why do women stay?”

That’s the wrong question, she said; people should be asking instead, “Why are the perpetrators reoffending, and why do they think they can harm their partner and children?”

Pye said a system needs to be built that focus around the choices a perpetrator makes to commit the abuse. It’s true that victims sometimes don’t want to press charges or prosecute, she added. They may be worried about what happens if the perpetrator doesn’t go to jail.

“The survivors tend to think about their safest choice, and sometimes their safest choice is not participating in prosecution,” Pye said.

At the Beacon Center, the main goals are safety and justice, she said. The National Coalition Against Domestic Violence reports that, in Florida, 1 in 3 women and 1 in 4 men have expe-

With numbers like that, Pye said everybody knows someone who is in an abusive relationship, even if they’re not aware of it.

“If the Wawa was getting robbed at the rate women are being beaten in this county, there would be outrage,” Pye said. “We should have that kind of outrage when we hear about women and children being beaten in their own homes, and being abused in their own homes.”

Ormond Beach’s first mural was approved last week, and soon the blank wall adjacent to Ormond Garage Brewing’s back entrance will portray a scene from the city’s beach racing history.

The City Commission unanimously approved the mural at its meeting on Sept. 18, following recommendation from city staff and the Ormond Beach Arts District Mural Committee. Dorian Burt, authorized representative on behalf of Wivigeco LLC, one of developer Bill Jones’ companies, said there were many great photos of the city and its early history to choose from. The chosen photograph that artist Thays França will recreate is one taken at the Granada Boulevard beach

“This is going to be incredible for Ormond Beach,” Burt said. “...

França said it’s going to be a large project, but she’s excited.

“I hope that with this mural, we create a sense of pride in our city, and that’s what I’m really, really hoping for — that this mural will bring us back in time, and forward, all at the same time,” França said.

City Commissioner Susan Persis praised França and said the mural’s vision is “perfect for the city.” People will take photos in front of it once completed.

“We hope it’s the first of many, and we think it’s just going to be a great addition to the city,” said Judith Stein, Ormond Beach arts district president.

Family Renew celebrates 30 years — with ice cream Family homelessness continues to be a problem, and fundraisers like this help the nonprofit continue to service families.

On Sept. 18, Family Renew Community celebrated its 30th anniversary of helping families lift themselves out of homelessness, and, with a current 96% success rate, the nonprofit hopes to continue its mission for another 30 years.

As families indulged in ice cream for Family Renew’s 30th ice cream social event at St. James Episcopal Church, Executive Director Tony Deobil reflected on what the milestone represented.

Three decades ago, Family Renew was formed after several churches got together and decided to take action regarding the local homeless problem.

“And here we are, 30 years later, and it’s even worse than it was 30 years ago,” Deobil said.

Family Renew is doing what it can to help.

Deobil said the nonprofit isn’t a housing program but a restoration program. While families can stay in the program for up to 18 months — during which they’re given a stable place to live while the parents are assisted in becoming self-supporting — most stay six or seven months. Family Renew helps teach them basic life skills, and tries to help them find and become qualified for jobs that pay above the minimum wage.

Deobil remembers an 8-yearold girl who once told him she wanted to have babies when she grew up because her grandmother told her she could then get a check from the government. That same little girl later told him she wanted to be a nurse, and Family Renew got her a play nursing kit and had real nurses talk to her. At the end, before her family graduated, the little girl told Deobil that her brother had gotten sick. She took care of him, and she loved it.

“Break the cycle, you know?”

Deobil said. “And that’s what we try to do at Family Renew.”

COPS CORNER SEPT. 10

GONE FISHING 1 p.m. — 1200 block of N. U.S. 1 Grand theft. When committing a crime, just go fish. That was one 51-year-old Daytona Beach man’s cover story when police approached him while investigating a call over a couple of men stealing copper wires from a local business.

Police report that the employee spotted the men just beyond the fence taking the wires, and that he ran up to them. The employee was able to catch the Daytona man, but his copper-stealing friend got away. He was later located and arrested.

The Daytona man told police he was in the woods looking for a fishing pond, and that his friend had picked up the copper from the ground when the employee yelled at them. Police searched the area where the Daytona man said his fishing equipment was, and found a tackle box and fishing pole. There was also several spools of copper, police reported.

This led to a check of the trail which revealed more spools, valued at $750. The man was arrested and taken to jail.

ing a call about a drunk person.

The man told officers he was waiting for a cab to pick him up and take him to a hotel, and provided one of the officers with a credit card to prove he could pay, according to his arrest report.

The officers waited for the cab with him, and as they were doing so, the man pulled out a cigarette and lighter.

Because they were in a gas station, the officers told him not to light the cigarette. He was also sitting next to a cage full of propane tanks. The man refused to listen, police report, and started to ignite the lighter. The officers reached for the lighter, and the man pulled it away from their reach before throwing it at one of the officers.

The man was taken to jail.

SEPT. 12

BAD DAY TIMES THREE 5:50 p.m. — Intersection of North Beach Street and Lincoln Avenue DUI. A 41-year-old Ormond Beach man caused a three-car crash while drunk driving, and one of the other drivers told police that after the man exited his car, the man began throwing alcohol bottles out of his vehicle and said he had a bad day. He also apologized and said he was drunk.

Police spoke to the man, noticing that he had difficulties while standing, as he was swaying back and forth. The man denied drinking to the officer, and asked for a lawyer when the officer asked him if he had been driving his car at the time of the crash. Questioning stopped at that point, according to his arrest report.

The man failed his field sobriety tests and was arrested before taken to jail.

had exposed his penis to her daughter. The victim’s mother discovered this after finding entries in her daughter’s diary.

On Aug. 15, Fugler was convicted of three counts of lewd and lascivious exhibition, three counts of displaying obscene material to a minor, and three counts of lewd and lascivious acts with a minor for events that happened between Aug. 19, 2014 to June 20, 2016. He has no other criminal record.

“He stole a child’s innocence,” said Volusia County Sheriff Mike Chitwood. “He groomed our victim to do this, and yet the judicial system gives him every break.”

Chitwood is asking for residents to respectfully reach out to Chief Judge Raul Zambrano and State Attorney R.J. Larizza and implore them to overturn the bail decision granted by Senior Judge R. Michael Hutcheson.

It’s not the first time this judge has granted bail to a sex offender, Chitwood said. In 2009, he granted bail to a man involved in a case with six young victims.

“Where does it say one person is bigger than the criminal justice system?” Chitwood said. “Where does it say that he gets all the breaks and the victim gets nothing. It’s not fair. It’s not right.”

Will Raulerson, the foreman on the jury who convicted Fugler, said it’s upsetting to have done his job and then have a judge “annihilate” the jury’s verdict.

CHIEF JUDGE RESPONDS After Senior Judge R. Michael Hutcheson released Mark Fugler from jail on Tuesday, Sept. 17, on a $200,000 bond, Volusia County Sheriff Mike Chitwood asked Chief Judge Raul Zambrano to overturn the decision.

Zambrano responded to Chitwood with a letter that says: ”Contrary to what many believe, a chief judge does not have the authority to overturn rulings made by other judges.

Rather, if a litigant believes that a judge has ruled improperly, he/she may file an appropriate motion and request a hearing before the assigned judge. If that does not achieve the desired result, he/she may seek a remedy before an appellate court. Your request of me would be akin to me asking you to overturn a decision made by a local Chief of Police.

“Furthermore, as a judge, I am ethically prohibited from commenting on a pending

petrator years after the initial trauma.

“As a jury, as a citizen of the county of Volusia, all my life born and raised here, it’s hard to sit back and watch stuff like this take place,” Raulerson said.

Chitwood said Fugler’s defense team will likely drag out a long appeals process for years to come.

Seabreeze head coach Pat Brown encouraged his team from the sideline.

“We told them to fly off the ball,” he said. “We knew we were going to get a stop. You could see it in the guys’ eyes. We came too far for this.”

The ball was snapped over Bears quarterback Luke Morgan’s head, and Sandcrabs defensive end Harold McKay recovered it.

The Sandcrabs were able to run about 2 minutes off the clock before punting the ball away in the final minute. After getting backed up to third-and-25 following an intentional grounding penalty, the Bears spiked the ball on fourth-and-10 with 6 seconds left.

The Sandcrabs (3-2) defeated Winter Springs 24-20 the night of Thursday, Sept. 19, at Daytona Stadium. It was the Sandcrabs’ third win in their last four games and their second victory in a row – a feat they hadn’t achieved since Oct. 13, 2017.

Seabreeze struggled mightily in the first half, surrendering three rushing touchdowns to the Bears, who lead 20-10 at halftime. The Sandcrabs’ lone scores came off an 11-yard touchdown pass from quarterback Thomas Davidson to receiver Trevon Phillips and a chip shot field goal in the half’s final seconds.

for us,” Brown said. “We didn’t do a good job adjusting on the fly as a coaching staff, but we knew once we got into the half, that if we made adjustments, the guys would trust us.”

The Sandcrabs opened the second half by forcing consecutive turnovers. The first, an interception by Evan Williams, which led to a 53-yard touchdown reception from Davidson to receiver Matthew Bossett. The second, a fumble recovery that set up a 6-yard rushing score from Otis Walker.

“It was a team thing,” Brown sa i d . “ We stopped ourselves in so many instances. We knew we could come out with it. We just had to stick to the plan.”

The Sandcrabs have a bye week for Week 5 and won’t play until they face Halifax Academy at 7 p.m. Friday, Oct. 4, at Daytona Stadium.

“This win means a lot,” said Davidson, who hadn’t played since suffering a concussion in the season opener against Spruce Creek. “It makes us a lot more confident. We feel like we can beat anybody right now.”

Down 24-21 with 9:45 to play in the fourth quarter, Fagan picked off the Cardinals’ quarterback inside the red zone. The Seminoles won the game 35-24.

‘We have to move forward’ Mainland stalls in final minute in loss to Seminole

fter an 18-yard touchdown run by Buccaneers quarterback Taron Keith, Mainland held its first lead of the game with 5 minutes left on the game clock.

Holding onto a 4-point lead over Sanford Seminole, the Buccaneers’ defense needed a stop — and they thought they had one.

The Seminoles’ running back appeared to fumble the ball, and Mainland’s William Marshall scooped the ball up and ran it back for a touchdown.

But the runner was ruled down.

The Seminoles then scored on a 1-yard run with 1:23 remaining.

The Buccaneers’ comeback drive was stopped at midfield, as Seminole defeated Mainland 22-20 the night of Friday, Sept.

20, at Daytona Stadium.

The Buccaneers (1-2) were down 16-3 at halftime, but were able to make the necessary adjustments in the second half.

Ethan Gettman nailed a 28-yard field goal for Mainland’s first score of the second half. A safety cut the Seminoles’ lead to 16-8.

And a 2-yard touchdown run from running back Nate Braswell made the score 16-14 with 1:38 in the third quarter.

Mainland’s defense kept the Seminoles out of the end zone until that final game-winning drive.

“Boy, I though we had that fumble,” Mainland coach Scott Wilson said. “But credit to Seminole. We weren’t able to finish at the end. I’m proud of our kids. We fought to the end.”

The rain the morning of Sept. 19 did not dampen the enthusiasm of the crowd waiting for Aldi food market to open at 8:25 a.m. at 1260 W. Granada Blvd. in Shoppes on Granada.

Pam Amato arrived at 6:30 a.m. and was near the front of the line of people who arrived early to get a free gift card, an opening day promotion for the first 100 guests. She didn’t mind the wait.

“It was an adventure. We even got a shower,” she said with a laugh about a brief rain.

The line of people, chatting amiably, stretched the length of the business. After the store opened, the parking lot filled quickly with shoppers.

Amato said she likes Aldi because they have a lot of European selections. She believes the Europeans have higher standards when it comes to additives, artificial color, etc.

Myrcia Munet said her father always shopped at the Aldi in Daytona Beach because he liked the produce and the prices.

Amato’s husband, Jim, said he likes the fact that Aldi does not overwhelm the customer with many varieties of the same item.

One person in line hailed from Germany, where Aldi started. Pat Botts said she likes the holiday items they have at Christmas and Easter.

“I wish they had more,” she said.
