Based on the first neighborhood meeting held in late August, the developer is seeking the PBD rezoning to reduce required parking by 34

Concerns raised by residents at the last meeting included trucks and trailers using Fernery Trail as an access point to turn around and exit back onto Nova.

The meeting is scheduled for 6 p.m. on Wednesday, Nov. 20, at the Anderson-Price Memorial Building located at 42 N. Beach St.

ECHO grants in the works Aside from the MacDonald House restoration project, the city also applying for an ECHO grant for an LED lighting project for tennis courts at the Nova Community Park.

The lighting project is estimated to cost $275,000. If the ECHO grant is approved, the city would match the grant halfway, for a total of $137,500 coming from general fund reserves.

Cassen Park boat ramp closed Due to the beginning of the floating dock construction at Cassen Park, the southern boat ramp will be closed for the rest of the year, the city announced in a tweet on Tuesday, Nov. 12.

‘Somber reflection’ Keynote speaker retired U.S. Army Col. Hal Kushner retold his experience as a prisoner of war in Vietnam.

In the Vietnam War, Retired U.S. Army Col. Hal Kushner bore witness to the death or serious injury to 13 of the 17 medics in his unit.

Kushner himself had been deployed in August 1967 to replace one of the doctors killed in action.

The soldiers lived in tents in a landing zone and ate C-rations on the field. They burned their waste with the same heaters used to heat the outdoor showers.

The soldiers put Kool-Aid in their water to disguise the taste of iodine from the halogen water tablets. They communicated with family via letters or audio tapes.

Sometimes they were mortared.

Other times, they got to play Scrabble and Parcheesi with the Donut Dollies, combat nurses with the American Red Cross.

“I thought it was primitive and hard, but at the same time, it was exciting and fulfilling,” said Kushner to over 200 people at the Ormond Memorial Art Museum’s Veterans Day Tribute on Monday, Nov. 11.

But, Kushner added, it was only when he got captured on Dec. 1, 1967, that he learned was hardship really was.

A PLATFORM FOR ADVOCACY

Kushner, a local ophthalmologist who resides in Daytona Beach Shores, retold his account at the annual museum event, serving as the day’s keynote speaker. For a long time, he didn’t speak publicly on Veterans Day about his experience as a prisoner of war.

He preferred to stay home and think of his memories.

“It was a day that was like Memorial Day to me — of somber reflection and retreat,” Kushner said.

However, he now feels it’s important to tell his story, as he said the younger generations

don’t feel the patriotism like his did — a sense of patriotism that overwhelmed him when he saw the American flag for the first time on the tail of a C-141 airplane after five and a half years of capture.

His wasn’t the only story told at the tribute event. Local Poet A.S. Minor performed a spoken word piece and recounted his struggles after leaving the Army, where he was a mortuary affairs specialist.

He helped to process the personal effects of diseased soldiers, performed funeral ceremonies and assisted with autopsies.

He brought his dog Maxwell up on the stage with him. Maxwell struggles with standing upright due to hip issues, and is getting up there in age.

“Just like our nation’s veterans, [Maxwell] still remains vigilant, on-duty, with me despite his illnesses,” Minor said. “That’s why I wanted to bring him up today — because I don’t think that we as a society show enough appreciation for our service dogs.”

Kushner’s story is “inspiring, reassuring and amazing” to hear, said Nancy Lohman, president of the OMAM Board of Directors.

“His story is one of resilience and endurance — qualities that have allowed Hal to lead a full life and we’re lucky it has been in our corner of the world,” Lohman said.

‘THAT WAS THE HARDEST PART FOR ME’

The date was Nov. 30, 1967, and Kushner and his crew were flying a routine mission in terrible weather late at night. The next thing he knew, Kushner was hanging upside down in a burning helicopter. He was badly wounded and burned, and three days later, he was shot and captured 10 miles from the crash site.

The helicopter wreck was discovered the day after, and he was identified as being missing in action because he had splinted his co-pilot’s leg before his copilot died. Four months later, he was confirmed as a prisoner of war. His son was also born, but Kushner wouldn’t know that for another five years.

At the POW camp, they had nothing, Kushner recalled. They had poor shelter and were given little food. The soldiers were sick with jungle fever, malaria and dysentery, and they never saw the sun.

Out of the 25 soldiers, 13 died in that camp. Ten died in Kushner’s arms.

“It is a very sobering experience to watch the light go out of a man’s eyes when you’re holding his head,” Kushner said. “That was the hardest part for me.”

He was moved to a prison in Hanoi, Vietnam, in February 1971, three and a half years after being in the jungle camp. It took 57 days on foot for Kushner to reach the jail, where he would spend the remainder of his capture in a cell with six men.

It was better than the jungle, Kushner said. They were fed pumpkin soup, two cups of water and bread twice a day. They had morale and a leader they called Moses. Later, Kushner would learn his name was Lt. Col. Ted Guy of the U.S. Air Force.

HOME AT LAST

Kushner was released in March 16, 1973. In what he calls a “fundamental moment” in his life, Guy lined up the soldiers outside of the bus before entering the air field and told them to unzip their windbreaker one-third of the way, hold their bag in their left hand and march into the plane with dignity.

Soon after, that’s when Kushner saw the American flag, which he said is a symbol of freedom and liberty, and a “beacon for the world.”

“It was the first time I’d seen our flag in five and a half years,” Kushner said. “And I realized how much I loved it, and how much it meant to me.”

Thanks for listening to our concerns about septic conversion Dear Editor, On Nov. 5, those of us who attended the Ormond Beach City Commission were treated to something pretty special.

Some residents of Ormondby-the-Sea spoke, including Michael McBride, who presented over 1,000 signed petitions to insist on scientific testing before we are forced onto Ormond Beach’s city sewer system; Samantha Oehlsen, who related a tale of Ormond-by-the-Sea daily kindness and brought attention to County Chair Ed Kelley’s reluctance to get involved; and Donna Craig, who spoke of her concerns as a new area homeowner.

Many Ormond-by-the-Sea residents looked on from the audience, clad in blue to show support. We have been attending and raising our concerns for months, so didn’t expect much. This time though, the Ormond Beach mayor and commissioners responded to our concerns and proved they have been listening.

Mayor Bill Partington called for a halt to the design process until the scientific testing is complete, and Commissioner Dwight Selby graciously seconded the motion and asserted that Ormond Beach would do more to control other potential sources of nutrient pollution — education and enforcement of Volusia County’s fertilizer ordinance, increasing storage of effluent at the wastewater treatment facility, and a moratorium on new septic systems in Ormond Beach.

It can’t have been easy for Commissioner Selby to accept that it is time to step back from this project after the efforts he has made to push it through.

Commissioner Susan Persis thanked all who took the time to speak on the topic and expressed agreement.

Commissioner Troy Kent shared some wisdom he has learned over the years: “The most important business, when you’re in the business is to mind your own business,” and he asked the question, “Why were we doing this, Ormond Beach? Some facts — this is not our city, you’re not our residents … The most important question was never asked: Do you want this?”

Great point, Commissioner Kent!

No one asked us whether we wanted any of this and if our

septic systems are not polluting, most of us certainly do not.

I must thank Mayor Partington and all of the commissioners for their consideration of the concerns of the residents of Ormond-by-the-Sea and for taking the time to address us at the meeting. We are not their constituents, but we deserved to be heard and last night we were, so thank you, leaders of Ormond Beach.

Now the challenge is to ensure that any testing performed is conducted properly — it isn’t an easy task to track down the specific sources of nutrient pollution in a body of water.

It will be necessary to determine not only that any water pollution is from human waste, but that it is coming from the septic systems of Ormond-by-the-Sea and not the wastewater treatment plants themselves or the septic systems that are near the waterway in other locations, like the new ones being installed on the other side of the basin in Toscana or any other systems that are close to the water. The river is many miles long and the presence of nutrient pollution from human waste will not point to a particular location.

Soil sampling will be in order, and samples will need to be collected over a long enough period of time to take into consideration any seasonal differences in the water table to get to the answers we need to determine whether the systems of Ormond-by-the-Sea are significantly contributing to the nutrient levels of the waterway.

Clean water is something we would all like to see, but we need to make decisions about how to reach this goal after conducting the relevant research to choose the best and most effective course of action.

Church property has history, too Dear Editor, This week’s Ormond Beach Observer had a good article in it regarding the MacDonald House and the ECHO grant it has requested.

Though it is an old house with history behind it, I cannot help but wonder why the Historical Society or the city

has not asked for funding for the oldest Christian Church on the west side of the river, Ormond Beach Union Church.

I’m sure the history of it is known, as when the old wooden bridge was across the river, John D. Rockefeller used to walk across it for the services at OBUC. Story has it that Mr. Rockefeller would give out nickels — no, not dimes as we all were taught in childhood days — to all the children in church. He told them to hang on to that nickel, as they may need it someday.

Lessons learned from the man who climbed the ladder in life, became a millionaire, and lived in our town of Ormond.

Thinking that history should be taught more, what better use for the Ormond Beach Union Church?

It has been vacant since the day the city took it over, but has yet to be used for anything! Hence, it is decaying away and the history with it.

It was discussed by city leaders to use it for all to see the many good deeds done in that church through its lifetime by displaying the stories and pictures given to the city office, as well as obtaining more from the Beach Street museum, which had history of OBUC to offer too.

As we all know, there is plenty of parking space, thanks to a gracious donor of Ormond Beach. The Yacht Club used to be owned by OBUC, with its interesting history, as well as the Fish House across Lincoln on the north side. (Duly named by OBUC, as it was used by many ministers and for the young adult religious classes in recent years.)

So folks, there is a lot of history behind OBUC’s lifetime and I think it should be opened up to the public to teach more of Ormond’s history. Let’s remember too that the chapel at Bailey Riverbridge Gardens was moved there from West Granada Boulevard at the Pilgrim’s Rest Cemetery. Also historical.

Please help spread the history of OBUC and its surroundings before it’s too late!

Now, Ms. Elston is a good city employee. She was very helpful after Hurricane Dorian by calming the residents after said hurricane advising of pick-up of yard debris.

But, I believe that quoting statistics from the dreaded OB Life fiasco was not pertinent to the topic presented by Mr. Young. We have a city population in excess of 40,000 people. Assuming that 25,000 are adults that would have been capable of attending that OB Life thing, in reality only about 660 attended (and that is stretching it) the six functions.

Now that is a cumulative total of all six meetings. I attend all six meetings, therefore I was counted six times in the estimated total. I do not know why anyone quotes data from OB Life. Those figures are not a true representation of the wants and needs of Ormond Beach.

Also, this was supposed to be a meeting for Ormond Beach residents. No problem if folks from other local towns showed up. But, using their headcount in the statistics only skews the OB statistics.

Quoting stats like 48.5% and 3.4% from the OB Life results is not indicative of a qualified sample of our population.

And, to make matters worse, our city commission used this weak sample of data to prepare a fiscal strategic plan to guide the city into the future.

But this manipulation of data is indicative of how we are guided into the future by our fearless leaders. Perhaps this OB Life thing can best be understood by presenting a simple analogy in the form of a question. Can you imagine NASA planning and calculating the safety of our astronauts with percentages of 3.4% and 48.5%?

There is nothing strategic about that. It just goes to show you that liars can figure and figures can lie.

On Volusia’s environmental resilience We must adapt now, county official tells Daytona chamber.

By 2100, Volusia County’s coastal cities — including Ormond Beach, Daytona Beach and New Smyrna Beach — could be underwater due to rising sea levels.

That’s based on 2017 projections by the National Oceanic and Atmospheric Administration that estimate sea level could rise up to eight feet in about 80 years.

“It’s a little bit sobering, and hopefully, this never comes to pass,” said Ginger Adair, county director of environmental management.

To prevent this scenario, we we must adapt now, Adair continued at the Tallahassee Speaker Series event titled, “Resilience: Balancing Environment and Economy” held at Bethune-Cookman University on Tuesday, Nov. 12. In addition to Adair, the estimated 30 people in attendance also heard from Jenifer Rupert, of the East Central Florida Regional Planning Council; and Julia Nesheiwat, the state’s new chief of resilience officer. As the state’s first person to occupy the new position, Nesheiwat is tasked with preparing Florida for the environmental, physical and economic impacts of sea level rise, according to a press release by the office of Gov. Ron DeSantis.

WHAT IS RESILIENCE?

Rupert defined it as the ability to “bounce forward,” absorb,

recover and get better in the face of short-term shocks, like hurricanes and infrastructure failures, and long-term stressors, like affordable housing.

“It is the common ground that all of our local jurisdictions across all of our eight counties really have to understand and adapt to,” Rupert said.

RESPONSE TO FLOODING

Nesheiwat, a Stetson graduate who is also a former U.S. Army officer, said being a witness to the 2011 Fukushima tsunami in Japan inspired her research into resilience, especially as it relates to natural disasters. As Floridians, she said we are seeing impacts of rising sea levels with stronger storms “front and center.”

While the state has great standards when it comes to hardening against strong winds, Nesheiwat said, standards to get ahead of flooding are not up to par.

Nesheiwat wants to build a repository of best practices for the state, as well as one for “lessons learned.” She also hopes to use her new position to accelerate environmental projects throughout the state. From a federal standpoint, she aims to find ways to make Florida stand out to harness federal grants.

“It’s all about the funding,” Neisheiwat said. “That’s the big kahuna at the end of the day.”

At the local level, Adair said the county has put into place a Sustainability Action Plan as well as a 2017 plan called Resilient Volusia, to assess ways to build resiliency against flooding and sea level rise.

Volusia sheriff, FBI dismantle meth distribution ring More than 20 pounds of meth and pills recovered over the past year.

A methamphetamine and pill distribution ring led from a Georgia prison cell has been dismantled by the Volusia County Sheriff’s Office, Volusia Bureau of Investigation, the Federal Bureau of Investigation and the Florida Attorney General’s Office.

The organization is believed to be responsible for distributing more than 200 pounds of crystal meth in Volusia over the past year, according to a Nov. 11 press release.

The dismantling is a result of a VBI and FBI investigation called “Operation Extended Stay,” which began in December 2018.

The ringleader of the organization was identified as 42-year-old Jeffery White, who is currently incarcerated in Georgia.

White is serving a 20-year sentence for aggravated assault.

He ran the organization by using a contraband cell phone, VCSO reported.

Other upper and mid-level organization members where operating out of cities including DeLand, Edgewater and Crescent City.

“Our job here isn’t done, but thanks to months of hard work by everyone involved in this operation, today there’s a little less crystal meth and fentanyl out on the street and a few more drug dealers behind bars,” Sheriff Mike Chitwood said.

BRIEFS Worker killed in fall from Ormond-bythe-Sea condo A contractor working at an Ormond-by-the-Sea condominium died Thursday morning, Nov. 7, after he fell from the building’s eight floor.

The man, whose identity has not been released, was working on storm shutters in the Aquarius Oceanfront Condo, located at 1575 Ocean Shore Blvd, the Volusia County Sheriff’s Office reported. Deputies responded to a 911 call about the incident just after 10 a.m. on Nov. 7.

The man had been harnessed to an object at the top of the building, VCSO reports, but the harnessing equipment also fell to the ground.

No criminal charges are pending at this time and VCSO is continuing to investigate the fall, which the agency says looks to have been a “tragic accident.”

This marks the 15th fall-related death in the state of Florida in 2019, according to current fatality inspection data by the Occupational Safety and Health Administration.

Falls are one of the top four leading causes of private sector worker deaths in the construction industry and accounted for 381 out of the 971 deaths in construction in the U.S. in 2017, according to OSHA.

COVER-UP 12:32 p.m. — 1500 block of West Granada Boulevard Petit theft. A Deerfield woman covered clothing tags with packets of Kool-Aid while self-checking out at a local supermarket, attempting to leave with $145 dollars’ worth of clothing but instead ending up with a notice to appear in court for the crime.

The store’s loss prevention officer confronted her outside of the store and asked her to come back inside to the store’s office to wait for law enforcement, according to a police report.

The woman complied, and later told police that she had intentionally placed the Kool-Aid packets over the tags to avoid paying the full price of the clothing items.

The woman admitted that she knew it was wrong and showed remorse for her actions.

CHURCH ON SUNDAYS 3:02 p.m. — Intersection of Allwood Green Boulevard and Clyde Morris Boulevard DUI. Police arrested a 60-year-old woman who was driving drunk on her way to church, according to her statements to officers. The woman also didn’t have a valid driver’s license.

The woman was pulled over by police after she was seen driving recklessly, almost hitting a white SUV when she pulled out of Allwood Green Boulevard.

Police began a DUI investigation because they could smell alcohol on her breath, and she had “red and glassy” eyes. She failed the field sobriety tests.

The woman admitted she‘d had one or two glasses of white wine and that she had not slept since her husband had surgery a few days before.

Her husband told police that she had a “very bad drinking problem.”

She was taken to jail.

BITING THE HAND THAT FEEDS YOU 5:40 p.m. — 300 block of West Granada Boulevard Grand theft. Over a period of about one month, a 51-year-old local grocery store employee stole from the store approximately 46 times, according to police reports.

The store’s regional manager contacted police and reported that the Daytona Beach man had been leaving the store with merchandise in shopping bags. The manager told police that the man admitted to the crimes, signed a written statement, and informed her that he’d started taking food and beer around July because money was tight. He then started stealing every day.

The man admitted to taking $894 dollars’ worth of merchandise. He was arrested and taken to jail.

There is a common bond between veterans and those who are currently serving in the U.S. Armed Forces — a sense of duty, acceptance of risks, and dedication to freedom and democracy, Vietnam veteran Jim Bowers said at Ormond Beach’s Veterans Day Celebration and luncheon Nov. 7.

In front of the sold-out room of city leaders, veterans and their family members at the Ormond Beach senior center (veterans entered free, while others paid for entry), Bowers spoke about the importance of remembering those who served and what their commitment means.

“Freedom and liberty are the birthright of every American, but we have had to fight for it,” Bowers said. “Maintaining the strength of the American ideal requires courage and constant vigilance among those who envy what we often take for granted.”

Veterans Day means more to veterans than just a holiday, said Bowers, who is also part of the American Legion Post 267. It’s a day to remember the generations of men and women “who have shouldered the burden to serve” and for Americans to consider the freedoms they enjoy.

“It is a day to think about the awesome responsibility that is ours, and what it takes to maintain this land of the free,” Bowers said. “This home of the brave.”

Mayor Bill Partington issued a proclamation at the event and highlighted the liberties veterans fought to protect.

Ormond Strong provided medallions for the veterans in attendance and vowed to continue to support the veteran community. Members of the local nonprofit walk the Granada Bridge regularly to raise awareness of veterans issues.

At the end of his speech, Bowers told the stories of three veterans, and urged those in the room to ask someone else for their stories. Those stories are “one of the most powerful weapons” to secure a future for men and women who will serve in years to come, he said.

“We must remain committed to a stronger nation and to our veterans, for it is our veterans who have sacrificed and paid the highest price for all of us,” Bowers said.

IMAGINATION LIBRARY SEEKS FUNDING Dolly Parton’s Imagination Library of Volusia/Flagler Counties is seeking the community’s help to fund the upcoming year to keep the program going.

DPIL will hold a social media campaign via its Facebook pages from Nov. 15 to Dec. 20 with the goal of gaining 100 new donors in 30 days.

DPIL was started in 1995 by Dolly Parton, whose vision to foster a love of reading among her county‘s preschool children and families led her to create the organization.

y all accounts, Seabreeze girls soccer’s 2018-19 season was a success.

The Sandcrabs won 14 games, lost 7, tied one. They beat Eustis 2-1 on Jan. 31 to capture the district championship. And they beat Lecanto 2-1 on Feb. 5 to advance to the second round of the Class 3A Girls Soccer State Championship Tournament, where they lost 4-1 to eventual Final Four-bound Eastside.

“We want to win more,” senior forward Kara Haas said. “At least a district title — hopefully further.”

To do that, the team will have to bond more, Seabreeze head coach Kim Merkel said.

“We need to build up our chemistry so we can play more unified,” she said. “The wins will come easier.”

Despite last year’s success, Seabreeze — who opened the 2019-20 season with a 3-0 loss to Flagler Palm Coast the night of Tuesday, Nov. 12, at FPC High School — struggled finishing.

And it appears that may be a problem again this year, as the Sandcrabs failed to put a shot on-goal against the Bulldogs.

“You just have to keep working on shots, making the runs, pushing the ball,” Merkel said.

The biggest area of need, however, might be the Sandcrabs’ defense. The Sandcrabs graduated a plethora of talent, including senior defensive ace Ashtyn Pascoe, who now plays college soccer for Daytona State.

“She was a big loss,” Merkel said.

Mainland advanced to the second round of the Class 6A FHSAA State Playoffs after the Buccaneers (6-4) defeated Booker T. Washington 38-20 the night of Friday, Nov. 8, at Daytona Stadium.

The Buccaneers’ offense got things going with a rushing touchdown by senior quarterback Taron Keith. Running back Nathaniel Braswell tacked on a rushing touchdown of his own, which gave Mainland a 14-0 lead in the first quarter. The lead would have been larger after Keith scrambled for a 99-yard touchdown run — but it was called back do to a penalty on the Buccaneers.

The Wildcats scored one touchdown and kicked two field goals to go down 21-13 at halftime, and the Buccaneers led by just 1 point late in the third quarter.

However, on the next drive, Keith broke free for an 85-yard touchdown run to give Mainland a 28-20 lead at the end of the third quarter.

Keith scored his third rushing touchdown of the night from 5 yards out with 55 seconds left in the game.

Recent book shows how a young lawyer won against corruption and changed the way mentally ill are treated.

A

fter a 50-year career in the law, including serving in the state House of Representatives and as a judge in the 7th circuit, Richard S. “Dick” Graham, of Ormond Beach, says a case he handled as a young lawyer was his top accomplishment.

“I got a case to the Supreme Court and changed a law. I got an innocent guy out,” he said recently.

It was the case of Jesse Daniels, a young man who spent 14 years in a mental institution after being blamed for a crime he did not commit, as chronicled in a book released last year, “Beneath a Ruthless Sun,” by Gilbert King.

When taking the case in 1969, Graham set out to not only free Daniels, but also to strike down

the Florida law that allowed mentally ill people to be confined indefinitely, even if they are no danger to themselves or others.

The story would be mostly unknown, if not for King’s book that describes Graham’s yearslong efforts, that were ultimately successful.

To honor his achievements, the Volusia County Bar Association has made Graham the first recipient of an award named for him, the Richard S. Graham Power of the Law Award.

Graham, 77, now a mediator at Upchurch Watson White and Max, a mediation firm headquartered in Ormond Beach, said he just happened to be in the right place at the right time when he took the Daniels case.

“Any good lawyer who saw what I saw would have done something,” he said.

The bar is raising money to create a monument in honor of Graham, a bronze bust of him to be displayed on the grounds of the Volusia County Courthouse in DeLand. The bar’s Power of the Law Award Committee has a fund-raising goal of $20,000.

FIGHTING THE GOOD FIGHT

Daniels was found incompetent to stand trial for rape in Lake County in 1957, and sent to Chattahoochee Mental Hospital, where he could have spent the rest of his life. The book says that Lake County Sheriff Willis McCall accused the young man, because the husband did not want it known that his wife was raped by a black man. It was a time of segregation, Jim Crow laws and racial violence.

“It was obvious he was innocent,” Graham said.

Graham argued his case to the Florida Supreme Court and a hearing in Lake County, losing both, but won in an appeals court. However, his big victory came when the U.S. Supreme court ruled in his favor. The U.S. Supreme Court received the case automatically after he lost in the state Supreme Court, because it involved the U.S. Constitution.

A trial was ordered for Daniels, but the prosecutors in Lake County dropped the charges.

King’s book says that the officials in Lake County did not want a trial, because they feared the victim of the rape would tell the truth on the stand, clearing Daniels and revealing the truth.

Daniels was freed, and the state mental health statute was struck down. In 1972, Graham was contacted by Maxine Baker and she asked him to write the Mental Health Act of 1972, which became known as the Baker Act and was copied in other states.

McCall was aided by the state attorney for the district, Gordon Oldham. In 2017, the Florida Legislature made a public apology for the corrupt regime of McCall and Oldham.

Graham said he wanted “really bad” to see the corrupt officials in jail.

“There was segregation in the country, but it was brutal in Lake County,” he said.

He said Oldham and McCall wanted to see him disappear, too.

Graham spent two years in getting Daniels free, and another two years trying to get compensation for Daniels and his mother. He asked for $177,000, but it was reduced to $75,000 after the award was strenuously fought by Oldham.

THE CLOSER

Graham graduated from Stetson School of Law in 1967, and worked at his father’s firm in DeLand before going to work at Volusia County Legal Services, where he took the Daniels case. He later returned to his father’s firm, where he continued the Daniels case pro bono, because the family was so poor.

Graham handled Baker Act cases while serving as circuit judge.

He points out that it provides due process, with legal representation for those charged. If not a danger to themselves or others, the subjects of the Baker Act are freed.

Graham, who has lived in the same Ormond Beach house for about 40 years where he raised a family with wife, Bunnie, now stays busy as a mediator at UWWM. It’s standard today for civil cases to be mediated rather than going to trial.

The receptionist at the firm, Eileen Olsen, calls him “the closer” because he settles the cases expeditiously.

“He just knows the law so well,” said Media Manager Catherine Klasne.

“Any good lawyer who saw what I saw would have done something.”

The most highly competitive program for international educational exchange in the United States has awarded two faculty members from Embry-Riddle Aeronautical University — Dr. Massoud Bazargan and Dr. Vitaly Guzhva, each from the Daytona Beach Campus — 2019-2020 Fulbright Scholar Awards.

A professor of production operations management, Bazargan will serve as a senior researcher at the Eskisehr Technical University, the largest aviation school in Turkey, during his Fulbright exchange period of January to June 2020.

“The experience will certainly expose me to ongoing international challenges in aviation faced by academia and industry,” Bazargan said.

A professor at Embry-Riddle since 1999, Bazargan is a native of Turkey; he now lives in Ormond Beach.

“It is truly an honor to have

received this award,” he said. “I hope it leads to more collaborative research between the two major aviation schools.”

A former military and corporate pilot, as well as a Daytona Beach Campus alumnus, Guzhva has taught aviation finance at Embry-Riddle since 2004. For his Fulbright Scholar period, he will spend five months in the world capital of aircraft leasing and financing: Dublin, Ireland. With about 50% of aircraft worldwide operating on a lease, more than half are managed from Dublin.

“I am extremely honored and proud to earn the Fulbright Scholar Award,” said Guzhva, who was born in Russia but now also calls Ormond Beach home. “It shows that the Fulbright Commission and my peers recognize my current and potential contribution in the field of Aviation Finance.”

Three Embry-Riddle faculty members — two from the Daytona Beach Campus and one from the Worldwide Campus — also won Fulbright Scholars Awards in 2018-2019.

Ohio man wins Margaritaville house ‘Wheel of Fortune’ fan couldn’t believe his luck.

Three phone calls brought Michael Corbett to Daytona Beach.

The first call on Nov. 19, 2018, appeared as “unavailable” in his phone. Corbett didn’t answer it.

He received another one a couple hours later, which he picked up.

However, he only gave the representative on the phone from Interactive Solutions enough time to say his name and the word “Wheel” before Corbett hung up.

On the third ring, Corbett finally heard the representative out, and he found out he was the potential winner of a new home in Latitude Margaritaville.

“I don’t think I believed it to begin with,” Corbett said.

A few weeks earlier, Corbett, an avid “Wheel of Fortune” watcher, had entered the show’s “Home Sweet Home” sweepstakes. The show had partnered with Minto Communities and Margaritaville to give away a new $350,000 home. The sweepstake took place around Corbett’s birthday.

“The idea of winning a home in Florida was just crazy, but OK, I’ll enter the sweepstake and see what happens,” Corbett recalled.

After all, his wife Vickie had been wanting to leave the Dayton, Ohio, winters for a year.

Kathy Pope was setting up the office for the day on Sept. 11, 2001, when the first plane hit her building in the World Trade Center.

“We didn’t see anything but we felt it,” she said Monday in a Remembrance Program at Ocean Art Gallery in Granada Plaza, 197 E. Granada Blvd. “It knocked everything off the shelf. The computers flew.”

Pope, of Daytona Beach, was one of several speakers at the annual event, organized by Frank Gromling, owner of the gallery.

The purpose of the ceremony is to mark Veterans Day, as well honor all first responders and remember the attack on the towers in New York.

Pope was an employee of IBM,

working in an AIG office in the first tower that was hit. At first, they were told a small plane had gotten into the wrong air space.

But after they had evacuated the building and saw the second plane hit, they knew it was attack, most likely terrorism.

She was in charge of the office, and lost 14 employees that day. It was a time before computers were backed up, and seven employees went back into the building to protect personal data of customers. Three were hit by people jumping from the upper floors.

Four people panicked and ran back into the building after the second plane hit.

The theme that ran through the evening at the art gallery was, “if you see something, say something.” Pope said there may have been warning signs at the flight schools where the terror-

ists trained, or when they were checking out New York, and perhaps someone could have alerted authorities.

Also Speaking was Ormond Beach Police Chief Jesse Godfrey, who said that after calling police, you should also follow-up.

“No call is too small,” he said.

“It’s never a burden. Call us.”

Pope said she and others ran 11 blocks to the seaport. After getting there, they turned to see the second tower that was hit fall. It fell before the first tower because the plane caused more damage.

“It melted like a candle,” she said.

When thanked for relating her story, she said, “It’s therapeutic.”

Also speaking was local photographer Ed Siarkowicz, who displayed one of his photos, “Phoenix Rising,” which shows two policemen standing in front of the new Freedom Tower in New York. He asked the audience to always thank a veteran when they see them. He said veterans
