An abandoned, unsafe, unsanitary, dilapidated motel has already been given a new breath of life as its new owner — 2251 S Old Dixie Hwy LLC (also the property’s address) — has paid the fines and back taxes accrued by the previous owner, and has removed dumpsters of trash. The swimming pool has been drained.

“We are encouraged by how much has been accomplished in very short order,” said County Administrator Jerry Cameron.

“The closing agent sent checks totaling about $70,000 to cover all of the fines and back taxes owed Flagler County and the Florida Department of Health (Flagler). This bodes well for the working relationship for the new owner.”

The relationship with the previous owners — brothers Ajmal M. and Zubair M. Zulali — was frustrating at best for the many Flagler County departments, as well as the Florida Department

of Health-Flagler. Eventually the county filed a lawsuit to compel the brothers into action “to abate the nuisance,” or the buildings would be demolished. They opted to sell.

“It was a masterful collaboration by the team,” Cameron said.

“We had done everything we could to work with the previous owners — cajoled them, advised them, fined them — but eventually we had to enter into litigation against them to effect change.”

Flagler County earlier this month entered into an agreement with the purchaser, signed by managing member David Shebiro, to ensure the conditions that pose a danger to human life and a hazard to the safety and health of the community don’t persist.

The three-page document outlines the past problems and details corrective actions that must be made by the purchaser within a tight timeline ending August 20, 2021, or a cash bond of $250,000 will be required payable to the Flagler County Clerk of Courts that the county may use to

demolish the building structures.

“Given the new owners performance so far, we have no reason to believe it will come to this,” Cameron said.

The agreement stipulates the following will happen by June 3:  Remove all litter and debris from the property  Drain or repair and secure the pool  Erect a fence on the property to prevent the access of trespassers to the dilapidated motel site It also stipulates that the purchaser will satisfactorily pass an “all rough” inspection to include the following by August 20:  Electrical rough  Mechanical rough  Second rough plumbing  Framing The county has not dismissed the lawsuit, neither has it asked that a hearing date be set. Should the court schedule a hearing before the Aug.20 deadline, the county will seek a continuance to allow the new owner to timely complete its obligations.

EDUCATION

he 2021 legislative session ended Friday, April 30, with a traditional hankydropping ceremony in the fourth-floor rotunda of the Florida Capitol.

Lawmakers took up a wide range of issues during the 60-day session, along with passing a budget for the fiscal year that will start July 1. Here are 10 big issues from the session:

injury protection, or PIP, coverage. They would have to carry bodily-injury coverage. Also, lawmakers approved changes in the property-insurance system, including allowing larger annual rate increases for customers of the state-backed Citizens Property Insurance Corp.

As part of a more than two-decade effort by Republicans to expand school choice, lawmakers passed an overhaul of school-voucher programs. In part, the plan would increase an income threshold so that a family of four making nearly $100,000 a year could qualify for vouchers. In higher education, the Senate considered controversial changes in the Bright Futures scholarship program before largely backing away amid an outcry from students and other opponents.

BUDGET Buoyed by billions of dollars in federal stimulus money and rebounding state tax revenues, lawmakers passed a record $101.5 billion budget for the upcoming year. The budget includes such things as bonuses for first responders, providing services to more people with developmental and intellectual disabilities and addressing effects of rising sea levels. Also, lawmakers scrapped proposed cuts in Medicaid funding for hospitals and nursing homes.

PROTESTS DeSantis quickly signed a controversial law-andorder measure that was sparked by nationwide protests last year after the death of George Floyd in Minneapolis. The law creates a new crime of “mob intimidation,” enhances riot-related penalties and makes it harder for local officials to reduce spending on law enforcement. But opponents said the measure is rooted in racism and would give police too much leeway to arrest peaceful protesters.

ELECTIONS Despite fierce opposition from Democrats, the Republican-controlled Legislature passed a wide-ranging elections bill that includes placing new restrictions on voting by mail.

Supporters said the bill, which addresses issues such as the use of drop boxes for mail-in ballots, is needed to ensure election security and integrity. But Democrats contended that it is designed to place barriers to voting and likened it to measures aimed at Black voters in the Jim Crow era.

COVID-19 Lawmakers passed a measure aimed at shielding businesses and health-care providers from lawsuits related to people getting sick or dying from COVID-19.

Also, they approved making permanent a ban on COVID-19 vaccine “passports.” Gov. Ron DeSantis in early April issued an executive order to prohibit businesses from requiring people to show they had been vaccinated to gain entry.

SOCIAL MEDIA After former President Donald Trump was blocked from Twitter and Facebook early this year, Republican lawmakers passed a plan to crack down on social-media companies. The plan, a priority of DeSantis, includes barring social-media companies from removing political candidates from the companies’ platforms and threatens hefty fines. Critics questioned the bill’s constitutionality and described it as a “big government” move.

INSURANCE After years of debating the issue, lawmakers approved ending Florida’s no-fault auto insurance system. Under the bill, motorists would no longer be required to carry personal-

In a major win for business groups, lawmakers passed a plan that will require out-ofstate online retailers to collect sales taxes on purchases made

by Floridians. The roughly $1 billion a year generated by the change will be used to replenish a depleted unemployment trust fund. Later, it will be used to offset a cut in a commercial rent tax. Florida businesses have long argued online retailers enjoyed an advantage because they didn’t collect sales taxes.

WHAT DIED IN SESSION? From abortion restrictions to vacation rentals, many highprofile bills died Friday when the Florida legislative session ended. Here are 10 issues that did not make it through the Legislature.

ABORTION The House overwhelmingly passed a bill that would have prevented doctors from providing abortions that women seek because of tests showing fetuses will have disabilities. The bill about so-called “disability abortions” threatened criminal penalties against doctors, but the Senate did not take it up.

UNION DUES Public-employee unions staved off attempts by Republican lawmakers to place new restrictions on union dues. The proposals included adding a step in which government employers would have had to confirm with workers that they want dues taken out of their pay before the deductions could start.

VACATION RENTALS Bills aimed at further restricting local governments from regulating vacation rental properties did not make it through the House and Senate.

The issue has long been controversial, as cities and counties have fought the additional restrictions on their authority.

Who pays for growth?

If Flagler County raises its impact fees, new singlefamily homes could cost an extra $5,000.

Flagler County could be adding more impact fees soon, in an effort to offset new construction’s projected impacts on the area.

The county currently only has two impact fees — to pay for roads and parks — and the roads impact fee is suspended. To pay for future growth, the county should add several more fees to pay for things such as fire rescue, law enforcement and public buildings, according to a presentation

by Tindale-Oliver, a design firm that reported to the County Commission at the May 17 workshop.

WHAT’S AN IMPACT FEE?

If the roads fee is reinstated and all other recommendations

by Tindale-Oliver are implemented, a 2,000-square-foot home in unincorporated Flagler County would be assessed a total of $6,587 for its impacts on the community — up from $1,706. In other words, a new home would cost about $5,000 more than it used to.

By comparison, the city of Palm Coast updated its impact fees in 2018, and the fees are adjusted yearly. For an infill lot in existing ITT neighborhoods, a new home pays $3,284 in park, road and fire impact fees. (That cost goes up to $4,705 for a home in a new neighborhood.)

All new homes in the county, whether in a city or not, also pay $3,600 to account for school capacity.

Moreover, some of the county’s proposed impact fees, such as for fire and law enforcement, could impact Palm Coast’s fees, if agreements are reached between Flagler County and the city.

DRIVE-THRU COSTS JUMP

Impact fees are one-time fees paid when a new home or other building is built.

The revenue has to be used by local governments to expand capacity of services, not to maintain previous levels of service. In other words, the road fees could be used to pave a new road, but not repave an old one.

Fees paid by retail, office, bank and light industrial space would also increase, but the biggest change would be in drive-thru restaurants, based on TindaleOliver’s recommendations. For every 1,000 square feet of space for something like a new McDonald’s, the impact fees would go up from $14,931 to $41,054.

Commissioner Joe Mullins favored increasing impact fees, although the numbers are still in the planning stage and need two public hearings before they could be voted on.

“I’ve never seen an area that didn’t have impact fees,” Mullins said. Developers are sure to “exploit” Flagler County if they’re not required to pay. He likened the county to a real estate firm that doesn’t charge for its services. “We are part of a business that’s saying, ‘We’re giving you this for free,’ and I think it’s far time to get this implemented.”

“We need to do this,” Commissioner Greg Hansen added.

County Administrator Jerry Cameron said Flagler should compare itself mostly to St. Johns County, which is where he used to work as an assistant administrator.

“Flagler County is exactly where St. Johns used to be about 15 years ago,” Cameron said, “... St. Johns is probably one of the highest in our area (for impact fees), but they have the highest quality of life to go along with that. And they stand in stark contrast to the arguments that say, ‘Impact fees discourage growth.’”

Mark Langello, who has been in the development business in Flagler County for 40 years, cautioned the County Commission about oversimplifying the matter.

New home construction doesn’t only come from out-of-town residents. Rather, many people who are building new homes are already living in the county.

For example, he said, “I’m here, and I want more room for my family, so I’m going to be buying a new house — and I’m going to be paying an impact fee,” he said.

“I think people who are coming in new should help — I’m not opposed. But the implementation has to be looked at correctly.”

The cost of drive-thru restaurants could also price out local entrepreneurs. “The people who can afford these fees are always going to be the conglomerates,” he said. “Please look at these numbers.”

Hansen agreed with regard to the drive-thru restaurant fees.

“Those are big numbers,” he said.

Commissioner Dave Sullivan pointed out that even though the fees haven’t been decided on yet, developers are listening now.

“Once the word is out that we’re implementing new impact fees, it might change the way developers look at things for the next 12 months,” he said. “It’s one of those things that we need to push on.”

Boston Whaler breaks ground, will hire 300

The company is seeing ‘historic demand’ for boats, officer says.

Boston Whaler will hire 300 people in the next year, officials announced at the ribbon cutting ceremony and tour on Friday, May 21, at 1958 Unsinkable St., Flagler Beach.

John Silva, operations manager, said on WNZF’s “Free For All Friday” that parent company Bruns-

wick is seeing a historic demand for boats.

“Everybody’s been trying to get outside more in the past year, and boating is a great way to do that,” Silva said.

He added that the Flagler Beach plant, which formerly housed a Sea Ray Boats plant, is being modernized, particularly in its lamination building.

Boston Whaler will sell a range of sizes, from 17 to 42 feet long, in conjunction with its Edgewater plant.

The opening of the plant comes with an opportunity for ancillary businesses to thrive as well, with

a program called vertical integration.

For example, Silva said that Boston Whaler has six contractors to create cushions for the boats, but the new plant is equipped to create its own cushions. Considering the difficulties with supply lines, caused by the pandemic, being able to create cushions in-house could help cut down dramatically on construction time.

REALTORS GROUP CHALLENGES EVICTION MORATORIUM A major Florida real-estate group is challenging a federal moratorium on evicting renters during the COVID-19 pandemic.

The group Florida Realtors filed a lawsuit recently in federal court in Tampa that described the moratorium imposed by the federal Centers for Disease Control and Prevention as “an unprecedented and unlawful federal administrative order.”

The lawsuit contends that the CDC overstepped its legal authority in imposing the moratorium, which is scheduled to expire June 30.

“The CDC predicates this unprecedented action on its statutory authority to prevent the interstate spread of disease, but that authority does not make the CDC the nation’s landlord-in-chief any more than it places the CDC in charge of citizens’ social media or the national minimum wage,” the lawsuit said.

Federal and state officials, through a series of actions, moved to halt evictions last year as COVID-19 caused massive job losses, illnesses and deaths. While Congress and Florida Gov. Ron DeSantis had taken earlier steps to halt evictions, the CDC issued an order in September that was extended through subsequent orders.

In the latest extension, dated

March 28, CDC Director Rochelle Walensky pointed to health dangers of renters being evicted during the pandemic.

The CDC order requires tenants who seek protection under the moratorium to provide a declaration that they meet certain criteria related to issues such as income, job losses and inability to make full rental payments. The lawsuit cited examples of property R.W. Caldwell manages, such as a tenant who has not paid rent in five months and is delinquent by about $4,375.
