City Council considers vacation rental regulations

Palm Coast adopts parks plan Palm Coast has adopted its new countywide Parks and Recreation Master Plan. The Parks and Recreation Master Plan serves as a blueprint for the future development and enhancement of parks, open spaces and greenways according to a press release from the city. The City Council voted 4-0, with council member Nick Klufas absent, to adopt the plan at its Dec. 5 meeting. The master plan is the culmination of a yearlong collaboration with Flagler County and BerryDunn, a firm hired to conduct surveys, analyze data and help city and county staff identify local priorities for a master plan. The result is a countywide approach to mapping the future of parks and recreation in Flagler County, according to the press release. The city has begun implementing several aspects of the plan already, including updating the QR codes along trails and collaborating with the county government, the Tourism Development Office, the Northeast Florida Regional Council and the National Park Service to make the signage system along trailheads more cohesive.

Palm Coast Mayor David Alfin said the city needs to look into ways to protect current residents from the potential dangers and nuisances of short-term rentals. “The idea here is not to deny anybody’s property rights,” he said. “It’s just to comply with, you know, what our residents in our neighborhoods expect and to maintain that level throughout the city of Palm Coast.” Palm Coast has a total of 8,837 rentals but only charges $5 to register new rentals — the same rate it has used since 2004. Palm Coast first began registering rentals in 2004, when there were only 800 rentals in the city, Code Enforcement Director Barbara Grossman said. Palm Coast requires all rental properties — regardless of whether they are short-term, longterm or vacation rentals — to register as rentals in the city. “A rental is a rental is a rental,” Grossman said. The 2004 ordinance required the applicant to pay a $5 registration fee and a $50 noncompliance fee. Almost 20 years later, with almost 11 times as many rentals as when the ordinance was first passed, Palm Coast is still charging the same amount. Rentals in unincorporated Flagler

Law firm bid process to begin on Dec. 27

The search for Palm Coast’s new legal representative will begin on Dec. 27. City Attorney Neysa Borkert ended her sevenyear tenure with the city on Dec. 12. Her exit opens the door for Palm Coast to begin searching for a new law firm for the first time in 15 years. The bid process will likely take until Feb. 13, according to City Council meeting documents. Assistant City Manager Lauren Johnston said the city will begin advertising the bid on Dec. 20, and it will open for applications on Dec. 27. Applicants are required to submit their intents to bid by Jan. 24 and to submit their proposals by Jan. 25. The bids themselves will be evaluated on different criteria: the experience of the potential city attorney, the experience of the firm, the fee proposal and the reference materials. Johnston said the period from Jan. 26 to Feb. 8 was left open for council members to evaluate the different applicants. Borkert has accepted another position in-house at Garganese, Weiss, D’Agresta & Salzman, P.A., Palm Coast’s contracted law firm since 2008. Managing shareholder Anthony Garganese assured the City Council at the Nov. 28 meeting that the firm will continue to supply attorneys for the city meetings and its other services until the city can choose new representation. Garganese said the firm was unable to continue supplying a single dedicated attorney to serve as Palm Coast’s legal representative in meetings, in part because of Palm Coast’s meeting schedule. Borkert said it has been a pleasure working with Palm Coast.

County are required to pay the county $400 for an initial application, $200 for renewals, $50 to transfer a rental and $50 to modify an application, Grossman said. City Council member Theresa Carli Pontieri asked Grossman if the city receives any portion of those fees. Grossman said she wasn’t sure. Pontieri asked city staff to investigate whether any of the county fees come back to Palm Coast or, if not, where the money goes. “If they’re not charging that to the city of Palm Coast, I think we need to really consider increasing our registration fee and our renewal fee, if we even have one,” Pontieri said. A search of Air BnB’s website showed more than 800 rental properties, some of which fell outside of Palm Coast city limits. The 2004 city ordinance also requires rental properties to be maintained “in a high-quality manner,” and requires properties to have a property manager within the city if the property owner lives elsewhere. The debate about short-term vacation rentals like AirBnB and how they should be regulated has been a recurring debate in Florida. But,

Grossman said, people often can’t tell the difference between homes that are short-term rentals and those owned by residents. The most common nuisance reports the city receives about rentals, she said, are the same ones it receives about other properties: noise, trash and parking. Grossman said Code Enforcement staff members are working to inform rental owners and renters about the city’s top violations. Grossman said they are working on either a pamphlet with the top 10 code violations that can be handed out to new renters or installed as a sign in the home. Members of the Florida Legislature have proposed multiple bills over the last few years that would restrict how local governments can regulate short-term rentals like Air BnB. The most recent was Senate Bill 714. Pontieri said there is already a new proposed bill for the next legislative session — Senate Bill 280 — that also proposes similar restrictions on local governments’ ability to restrict short-term rentals.

The Palm Coast Holiday Boat Parade celebrated its 40th anniversary on Dec. 9 with its largest-ever number of decorated vessels. At a captain’s meeting held earlier in the day on Dec. 9 for the registered boaters, Parade Chair Sarah Ulis said the parade was up to 108 registrants, making it the largest lighted holiday boat parade in Florida. In 2022, the holiday boat parade included 91 registered participants. Between the registered boaters and the number of other Palm Coast residents who did not register but still decorated their own boats for the parade, there were at least 150 decorated vessels, Ulis wrote in an email to the Observer. She called the event a “sea of lights.” “The number of officially registered boats was met and even surpassed by other Palm Coast boaters who decorated their boats to the plimsoll line and on up into the sky,” Ulis wrote. For next year’s parade, Ulis wrote, there will be official counters, and the parade will submit the numbers

to Guinness World Records. The parade, organized by the Palm Coast Yacht Club, ran from 6 p.m. to 8 p.m., and the city of Palm Coast livestreamed the parade on its YouTube channel. The parade was dedicated to Al Krier, a longtime community activist who died in December 2022. For the first time, Flagler County provided free shuttle services to and from European Village, allowing people to park at the Community Center and Daytona State College Campus to go view the parade. “Thanks to everyone for participating and making this such an amazing event for Palm Coast,” Ulis wrote.

Hannah Anderson was a student at Indian Trails Middle School six years ago. Now, she is the school’s Rookie Teacher of the Year. Anderson is actually in her second year as a full-time English Language Arts teacher at Indian Trails. She teaches sixth- and eighth-grade classes. Anderson, 20, became a full-time teacher at age 19. She dual-enrolled as a freshman at Matanzas High School and graduated a year early with her high school diploma and an associate degree. Two years later, she received her bachelor’s degree from the University of Central Florida. Anderson majored in English, but she wasn’t sure what she wanted to do when she graduated. “I just knew I loved the subject,” she said. “My dad told me to try out the education field, so I subbed for a bit, and I immediately fell in love with the profession.” Her father, Cody Anderson, is an assistant principal at Wadsworth Elementary School. She began subbing in Seminole County, then made her way back to Flagler County. She was a substitute teacher at Indian Trails before getting a full-time job there in August 2022. “I love everything about

the school,” she said. “I love teaching that specific age group. It’s a wonderful community to work at.” Being a young teacher has its advantages and disadvantages, Anderson said. “I definitely feel like I can relate to the students,” she said. “They feel like they can confide in me a little more as someone who’s experienced what they’re going through more recently.” But she said it’s hard at the beginning of the school year when her students walk into class and see a teacher who is only a few years older than they are. “I tell them, ‘I am young,

but I am your teacher and I am here to help you learn.’ It’s sort of difficult to set that boundary and expectation,” she said. The key, Anderson said, is to be structured. “I make it a very organized routine. They can see that we can have fun, but we’re here to learn. It’s a big learning process through the first few days of school.” Anderson said her fellow teachers are always willing to help her and provide advice. “They’ve totally taken me under their wing,” she said. “I feel like I got so lucky with my team. I’m constantly learning from them.”

Dr. Paul Mucciolo has filed to run for the District 3 seat on the Flagler County School Board. Mucciolo is the Emergency Department medical director for the AdventHealth Palm Coast and Palm Coast Parkway hospitals. He is also Daytona Beach International Speedway’s Emergency Care Center medical director. He also ran for the District 3 seat in 2020, receiving about 35% of the vote. Colleen Conklin won with 52%. In announcing his candidacy, Mucciolo said in a press release, “With deep roots in our community and as a proud parent of two children currently attending Flagler Schools, I have direct insight into the challenges faced by students, parents and educators alike.” Mucciolo is currently the only candidate for the seat. Conklin, who has been a School Board member since 2000, has said she does not plan to run again in 2024. Nicole Durenberger, who filed for the seat in September, told the Observer on Saturday, Dec. 9, that she has withdrawn her candidacy. “My father is 92, and he has dementia. So, we don’t expect for him to last through next year, and I want to make sure that I’m there whenever I need to be there for him,” she said. In an interview with the Observer, Mucciolo said there are too many conflicting agendas on the School Board. “There should only be one agenda,” he said. “And that’s the agenda of the students. It’s unfortunate that the students have become the bystander rather than making them the focus. And I’d like to make that change.” Mucciolo said he would like to help Flagler Schools achieve an A rating again. As a parent of a disabled student with an individualized education program, Mucciolo said he’d like to see the process made easier for parents. “Taking care of a child with an IEP is daunting,” he said. “I would like to think that, this will be my 28th year of medical practice and I would know how to follow directions. And despite being compliant with the documentation, the requests, the meetings, it’s difficult for my wife and me. And that shouldn’t be. This process should be transparent. It should be easy. And it is anything but, and that is not the fault of the district; I want to make that very clear. It’s the system. So what we have to do is work with the kids within the constraints of the system. “But I think that if the organization’s already in place to help parents of children who are disabled, we can really improve that level of service in the district and remove some of the anxiety and angst of the parents and the caregivers.” Mucciolo said his board member experience with AdventHealth, Emergency Medical Professionals and as president of the board of his homeowners association has helped prepare him to be a School Board member. Since he last ran for School Board, he has helped the district navigate COVID along with the Florida Department of Health-Flagler. “That has really opened my eyes a lot,” he said.

City task force reviewing residential drainage problems takes on 83 cases City Manager Denise Bevan said staff members on the task force are working to visit homes to assess them. SIERRA WILLIAMS STAFF WRITER

There are already 83 cases on the docket of Palm Coast’s newly implemented task force to investigate residential drainage concerns. City staff members are also proposing a regulation that would limit the height of the floor elevation in new builds, Stormwater Director Carl Cote said during a Dec. 12 City Council meeting. The city currently requires that the floor elevation of new builds is at least 12 inches above the crown of the road, but the city’s technical manual doesn’t list a maximum height. The proposed regulation would allow the floor elevation to be up to 22 inches above the crown of the road, so that there would be no more than a 10-inch height difference between the floor elevation of neighboring homes. City Manager Denise Bevan had announced at a City Council meeting on Nov. 14 that the city would be forming a task force to address stormwater drainage and flooding concerns from Palm Coast residents on a case-by-case basis. The Observer first covered the topic on Nov. 7, when Birchwood Drive residents said they had reached out to the city multiple times to stop a neighboring home from being built at a much higher elevation than their own. Efforts to bring attention to the problem have gained traction, with dozens of residents showing up to City Council meetings saying the same thing: A new home was built next door, and now their yards are retaining water. The city’s task force has so far visited 21 homes on its list, Cote said. Residents can add their home to the list by submitting a ticket on Palm Coast Connect at palmcoast.gov/ connect or calling customer service

at 386-986-2360. The City Council urged staff to speed up the process of visiting all of the homes on the list and to gather as much data as possible. Vice Mayor Ed Danko said fixing the problem for future residents isn’t enough. He suggested the council look into ways to help Palm Coast residents who are dealing with flooding issues now. “Whether the builder caused it, nature caused it, we caused it doesn’t matter. It’s been done, and they need help,” he said. City Attorney Neysa Borkert said the council must be cautious about using taxpayer money to fix problems on private properties. The city can legally only expend public funds to help the “general public,” she said. “That has to be a threshold question when considering what type of assistance you’re going to provide to property owners,” Borkert said. Borkert said there wouldn’t be anything wrong with other communities that may have dealt with similar issues or investigating potential grants available to help residents. The other council members did not oppose the idea of helping residents who are struggling, but wanted to exercise caution in using taxpayer dollars. “I’m not averse to looking at funding mechanisms to help certain homeowners who, by design, are having these issues,” Pontieri said. “But I want to tread very lightly as to what we open ourselves up to as a city.” THE PROCESS

Bevan told the Observer that the task force will comprise people from multiple city departments, not just stormwater. “This is one of our top priorities,” Bevan said. “So, discussions are happening daily.” The task force is in the data-gathering stage, Bevan said, which is dependent on information from residents. Staff will go out to each home to review the problem and return to present the information to the task force to find a solution.

Chief of Staff Jason DeLorenzo said staff is looking at any condition that has changed or could have changed since a home was built that impacts water flow in a yard. Those conditions could include erosion, unmaintained drainage ditches, installed fixtures like pools and even raised garden beds, and a new house built next door. In some cases, DeLorenzo said, the city may find that the solution is a simple fix. At a home on Royal Oaks that butted up against city property, city staff solved the resident’s drainage problems by cleaning out a city drainage ditch. But, DeLorenzo said, the solution may not always be something the city can help with. Stormwater Deputy Director Lynn Stevens said staff has found that older homes were designed to drain onto empty lots. Stevens said each case will require a different solution. “The onus may be on the resident to do the repair,” Stevens said. “It just depends. Each situation is going to be unique and different.” DeLorenzo said the residents’ assistance will be important for the task force’s investigations. “Without the resident helping us understand what conditions we’re dealing with, we would have a really hard time understanding the problem,” he said. UPDATING THE MANUAL

Bevan said that while the task force will review the homes with flooding problems, the technical manual revision will address residents’ greater concerns about new home construction. The city has been working on updating the stormwater section of its technical manual for the last three months, Stevens said. “We’re looking at a larger scope, a larger review process, when we look at that initial plan that comes in for drainage,” Stevens said. She said the city is communicating with the Flagler Home Builders Association throughout the process. “It doesn’t necessarily mean we’ll utilize their input, but we want to

hear ... from their perspective,” Stevens said. “They’re the ones that have to abide by the technical manual.” The manual currently requires both that a home’s finished floor elevation be 12 inches above the crown of the road, and that, if there is no canal or ditch in the rear, the property drains to the front swale. The 22-inch height maximum city staff is proposing, Cote said, would ensure that there is no more than a 10-inch differential with the adjacent home “unless there are extenuating circumstances and [then it’s] approved by a licensed engineer.” Until staff implements a height requirement, Stevens said, the city will ask builders to explain their reasoning when staff notices that a house is being constructed to a greater height than neighboring homes. COMMUNITY RESPONSE

Palm Coast resident Candace Stevens is one of many residents who have contacted the city about water collecting in her yard. She said that neighboring homes, built years after her home, caused the drainage problem. She said she is happy to hear that

at least some steps are being taken to address the height of new builds while the city works on the manual. “I think that that is a great start to solving this issue, actually,” she said. “I don’t know why it wasn’t there before.” She said she feels that whoever approved the grading on some of the builds in Palm Coast did not take neighboring homes into account. “There’s other places in town where homes have been built and that they’re not having this problem,” she said. “They should have looked at how the houses around it were set to drain.” Dipan Math, who bought his home in the R Section a year ago, said two new builds are going up on two sides of his home. He said he has submitted multiple claims on Palm Coast Connect about flooding in his yard and, separately, in his swales. He said he’s never received a response from the city until he emailed City Council members. Based on his experience, Math said, he is not very hopeful anything will come of the task force. “At least it’s getting traction. ... But will something actually happen? I’m not actually sure,” he said.

RUSH JOB 2:24 p.m. — 1500 block of West Granada Boulevard, Ormond Beach Petit theft. A 43-year-old woman and 46-year-old man, both from Ormond Beach, were arrested after they tried to steal about $180 worth of merchandise from a big box store. When asked by police why they did it, the man said he “thought he could get away with it.” The store’s loss prevention employees told police that the pair attempted to walk out of the store without properly scanning all of their items, according to a police report. The reporting officer asked the pair if they had enough money to pay for the unscanned items, and the man said they did. Why didn’t they pay for them? The man claimed he had been rushing because he was late for work, the report states. The store wished to press charges. The man was arrested and taken to jail, and the woman was released with a notice to appear in court.

NOT SO SNEAKY 1:30 p.m. — 2400 block of East Moody Boulevard, Flagler County Fraudulent practices, violation of parole. A man on parole tried to fool his urine test by filling a hand lotion bottle with synthetic urine. The man — who is on parole for a drug offense — was required to submit to an observed urinalysis as part of his parole. As the parole officer watched the man give a sample, he noticed a device of some kind hidden within the “center ‘pocket’ underwear,” according to the man’s arrest report.

The man handed over the item when the officer demanded it — it turned out to be a small lotion bottle filled with synthetic urine, the report said. The man was arrested for violating his parole and attempting to scam his urine test.

OFFENSIVE ACTIONS 7:03 p.m. — First block of Advent Health Way, Palm Coast Battery. A 56-year-old woman yanked the ponytail of another woman who commented on the reckless driving of a red pickup truck in a hospital drop-off area. The victim was walking into the hospital with her son when the pickup sped through the parking lot in front of them to the pickup area where the suspect was waiting, according to an arrest report. Before the victim and her son went inside the hospital, she turned around to tell the driver he was being reckless. That is when the suspect, who was walking toward the pickup, reached up and grabbed the other woman’s ponytail, pulling her to the ground. Hospital security separated the two, and the victim called the police. The red pickup truck did not belong to the suspect, but a man who lived at her home. Sheriff’s Office deputies later picked up the suspect from her home on Brian Lane. They have charged her with battery.

THAT’S FOWL 9:03 a.m. — Intersection of Division Avenue and South Orchard Street, Ormond Beach Suspicious incident. Police were notified that a bowl containing a “decapitated chicken carcass” was left at the above-mentioned intersection. According to an incident report, a tea can-

dle had been placed on top of the carcass, which officers found at the northeast corner of the intersection. Officers reported that it appeared to be a Santería shrine. Santería originates in Cuba and is a mix of Catholic practices and African folk beliefs. Officers took photos of the shrine before disposing of the chicken carcass and the bowl. PLAYGROUND VANDALIZED 5:37 p.m. — 300 block of Sanchez Avenue, Ormond Beach Vandalism. An Ormond Beach woman took her children to a local park and soon discovered “derogatory and demonic” writing on the playground equipment. The woman took photos of the writing before trying to wipe it off with baby wipes, according to a police incident report. About 45 minutes later, she saw four teen boys arrive at the playground, one of whom approached one of her sons and asked him to go down the slide with him. The woman said no. The other teen boys, she told police, were standing by the bathrooms telling their friends, “Let’s go before she takes our picture,” according to the report. The boys then left and the woman called police to report the vandalism on the playground. Officers noted in their report that the vandalism on the equipment appeared to have been written with a marker. The boys’ bathroom was vandalized with spraypainted graffiti.

Ormond vet surprises kids in parade Chris Washington is not just home for the holidays. The U.S. Navy vet is home for good. JARLEENE ALMENAS MANAGING EDITOR

Chris Washington knew exactly how his three children would react upon seeing him show up at the Ormond Beach Home for the Holidays Parade on Saturday, Dec. 9. He predicted his 9-year-old daughter Bailey would cry. His 12-year-old son Scott would give him a big hug. If he got any reaction out of his oldest, 14-year-old Logan, he would consider it a win. And that’s exactly how it went when he surprised them at the end of the parade. “I’m home, and I’m not home for two weeks,” Washington said prior to the surprise. “This is it. I’m home and I’m home forever. ... I’m hoping they’ll be super excited — hoping I can control my own tears.” Washington is retiring from the U.S. Navy after 20 years,

having enlisted in 2003. He has been stationed in Cleveland, Ohio, for the past three years, visiting only every six months. The family moved to Ormond in 2020, but Washington had never seen the local parade, as he usually came down the week of Christmas. This year, all three of his children were in the parade: Bailey was with the Pop Warner cheer team, Scott was with the Pop Warner Sandcrabs football team and Logan was playing with the Seabreeze High School marching band. About two weeks ago,

Washington said, he and his wife were talking about their kids being in the parade and thinking of ideas to surprise their kids with his homecoming when he put those two thoughts together. So he reached out to the city and was able to make the surprise happen. His wife, Leah Washington, said her children’s reaction to seeing their father at the parade was “priceless.” “We’re not oblivious to that there’s definitely going to be some challenges ahead, but it’s worth it,” she said.

December 25, 1930 - November 30, 2023 Charles Zulauf, loving husband and father, passed away peacefully at home in Palm Coast FL on November 30th at the age of 92. Charles is survived by his wife of 70 years Barbara, his daughters Penny, Paula, and Patty(Eric), son Edward(Lesa) and grandsons Colin, Justin and Ryan, several in-laws and many nieces and nephews, and his cat Munchkin. He was predeceased by his daughter Pamela and his sister Elizabeth. Charles was born in Bellefontaine, OH on December 25, 1930 to Warner and Georgia Zulauf. After graduating from high school he enlisted in the Air Force and served as a radio operator on the island of Okinawa during the Korean War. On leaving the military and working as a truck driver for a number of years, Charles moved from Ohio to

Skaneateles, NY where he and Barbara raised their five children while he served as Director of Transportation at Red Star Express Lines in Auburn NY. After retiring Charles and Barbara moved to Haines City, FL for 10 years before moving to Palm Coast, FL to be closer to family. He was a lifelong member of the Elks Club in Willard, OH and an avid coin collector, but his favorite hobby was helping others. Charles was a man of few words but spoke through his actions. He was kind and generous and a man of great moral character. He was always willing to help both strangers and friends. Charles will be greatly missed by all that knew him but will remain in their hearts forever. There will be no public services per his request.

Our mom, Sally “Diane” (Straus) Roberts of Palm Coast, sadly passed away on October 17, 2023 at the age of 87. She was born in Port Chester, NY, August 28, 1936 to Arnum & Mildred (Johnson) Straus. She grew up in Greenwich, CT, and graduated from Greenwich High School. She was known as a gifted equestrian, and for her archery & rifle skills. She worked as a contracted bookkeeper for various companies. She became a long term Girl Scout Leader in Norwalk, CT (15+ years) and put a lot of mileage on her car taking us to sports practices, meets, and scouting activities. She was a lifetime member of the Beta Sigma Phi sorority. She made the best

baked beans and chocolate chip cookies. She and our dad retired to Palm Coast Florida in 1992 where she became an active member of St. Thomas Episcopal Church and the VFW Auxiliary. She liked spending time tag saling with family and reading. She was predeceased by her husband of 60 years, John E. Roberts. She is survived by three children: Terry (Dennis Canaday) Roberts, Kris Roberts, Debra (Matthew) Murawski, and 4 grand children: John Abelkis, Ariel Murawski, Jessica Murawski, and CJ Murawski. The placement of her ashes with our dad’s will be a small private event.

Teacher charged in Walmart thefts Antisemitic vandalism suspect ID’d Matanzas teacher Anthony Zaksewicz stole $3,178.61 in merchandise over five months, according to the Sheriff’s Office.

There were three 30-day periods in which Zaksewicz stole $750 within the 30 days, according to the report. The Flagler County Sheriff’s Office first became aware of the thefts in October when a Walmart loss protection investigator handed over receipts and video evidence of Zaksewicz swapping out the price tags of expensive items with less expensive items and “skip-scanning” other merchandise, the report said. Flagler Schools Communication Coordinator Jason Wheeler told the Observer that Zaksewicz is on paid administrative leave as Flagler Schools conducts its own investigation into the allegations. In October 2022, Zaksewicz was honored by Flagler Schools for receiving the Florida Council Social Studies Harry T. Moore Teaching for Civil Rights and Civil Liberties Award, according to an October 2022 Flagler Schools press release. The press release said Zaksewicz received the award in part “for the passion he brings to the classroom and for all the opportunities he takes to bring Civil Rights education to all his students.”

A 17-year Matanzas High School teacher was arrested on Dec. 5 after he allegedly stole over $3,000 worth of merchandise from the Walmart on Cypress Point Parkway in Palm Coast. Anthony Zaksewicz, 45, has been a history teacher at MHS since 2006. He is facing 14 theft-related charges, according to his court records: 10 counts of misdemeanor petit theft, one felony charge of using an antitheft countermeasure device, two counts of felony retail theft and one count of grand theft. The thefts span a five-month period from May to October of this year, according to Zaksewicz’s arrest report.

The Flagler Beach Police Department has identified a citizen of Ireland as the man who spray-painted antisemitic messages on local businesses in November. Six businesses in Flagler Beach — owned by either Israeli nationals or those of Jewish heritage — were vandalized late Nov. 19 with graffiti messages that read “Jew Murder,” “290,000 child killers,” “500,000 Jew child killer,” “501,110 Jew child murderer,” according to a press release from the FBPD. The FBPD has identified Liam Mackin, 70 — a citizen of Ireland with a local address in Flagler Beach — as the suspect. A warrant was issued for Mackin’s arrest on Dec. 6, but, according to the Central Florida Intelligence Exchange, he left for Ireland on Dec. 5, with no known return date. Mackin is charged with felony

criminal mischief, evidencing prejudice while committing offense. The warrant for his arrest has nationwide pickup, the press release said. “Should this criminal attempt to re-enter this country at any border crossing, airport, etc., he will be arrested on the outstanding arrest warrant so he can answer to his crimes,” FBPD Chief Matt Doughney said. FBPD Detective Rosanna Vinci worked with FBPD staff and the Flagler County Sheriff’s Office’s Real Time Crime Center team to identify Mackin. Local Flagler Beach businesses also handed over surveillance footage to help identify Mackin and track his movements that night. “These types of crimes don’t occur very often in Flagler Beach, but when they do, we will utilize every resource available,” Doughney said. “Our community should rest easy knowing that this coward is no longer a threat to our community. ... This message is specifically directed to Mr. Mackin, should he happen to see this news release on social media: Happy Hanukkah!”

CRIME REPORT Man stole cash register drawer from Walmart, FCSO says A man stole an entire cash register drawer from Walmart in Palm Coast on Dec. 10, according to the Flagler County Sheriff’s Office. The theft occurred at around 8:25 p.m., according to the FCSO. The FCSO posted a photo from security camera footage on its Facebook page on Dec. 11, asking for the public’s help identifying the man. FCSO is looking for a tall, white man with short brown hair in a red shirt carrying a black rectangular box, according to the incident report. The drawer was estimated to hold $3,500. Former inmate gives time, money to paint deputies’ homes BIZ BUZZ ‘I felt led by Christ to do this,’ said James Salazar, owner of Salazar Painting in Palm Coast. SIERRA WILLIAMS STAFF WRITER

For James Salazar, owner of Salazar’s Painting in Palm Coast, honoring and supporting law enforcement has a different meaning than it does for most people. But most people don’t spend 11.5 years in a state prison. Twenty years after his conviction, Salazar has been quietly donating his services to the Flagler County Sheriff’s Office, since 2021, to paint a deputy’s home for free each year. He calls the initiative “Paint the County Blue.” “The largest portion of this is I felt led by Christ to do this,” he said. “To be in a position where I am a business owner, but I can give back and show the love, mercy and grace of God to the peacemakers.” Salazar was convicted of an aggravated assault charge in 2003 in Vermont. He served 11.5 years in a state prison in Kentucky. During his time there, he said, he was one of those inmates who would disrespect and

fight with the guards. It wasn’t until three years before he was released that he said he found Christ and was able to turn his life around. Now, as a business owner, Salazar said, he just wants to be able to give back to law enforcement for their service in any way he can. Salazar married his wife, Maria, in 2017 and has operated his home improvement business since 2019. So far, he has painted five deputies’ homes for free: one each in 2021, 2022 and 2023 during Law Enforcement Appreciation Week, plus two others in 2023 as well. Maria Salazar said that when her husband came to her with the idea, she was a little nervous about losing out on a potential paid job while the family was still recovering from the pandemic. “I was like, ‘We don’t have the money. I love the idea, I want to help, but I don’t know how we’re going to swing it,’” she said. But swing it they did. The FCSO held a drawing during Law Enforcement Appreciation Week, and Paint the County Blue has since become an annual donation at the FCSO. The initiative has two regulations: The recipient must work at the FCSO in some capacity — not just as deputies — and they must own their home.

Salazar said offering to paint the home of a deputy doesn’t just honor the deputy’s service and sacrifices, but that of the deputy’s family, too, which is just as important. “Without them being willing to sacrifice their husband or their wives for the work that they do, I mean, we wouldn’t be where we’re at,” he said. Cmdr. Mike Lutz said Salazar came to the FCSO unsolicited. Even in a supportive community like Flagler County, it is always nice when members of the community reach out like Salazar has to show their appreciation, Lutz said. “We and they [the deputies] especially are very appreciative,” he said. “[Painting a house], that’s a major expense and, you know, law enforcement, we’re not in it for the money.” The initiative has gotten enough

attention that fellow members of the Home Builders Association — Hulbert Homes and Thomas Consulting and Construction — worked with Salazar to offer the 2023 Law Enforcement Appreciation Week recipient a master bedroom renovation as well. Sherwin Williams paint stores in the area have also donated 15 gallons of paint toward each recipient’s home since 2022. Salazar said he wants to expand the initiative with “Paint the County Red,” for the local fire departments. He’s also working with several others to start a 501c3 nonprofit to help disabled veterans receive home repairs. Lutz said Salazar is a good example of how people do not have to stay on the same track for their entire life. “This actually shows that people can turn their life around, can be a success,” Lutz said. “You can be that person, and then you don’t have to be that person for the rest of your life.” Salazar said he would not call himself a good example. He just wants to be able to give back, even if it’s “a little pebble in a small pond.” “I’m just somebody who, while I was in prison ... gave my life to Jesus,” he said. “Back then, I was [violent and dangerous]. Oceanshore Blvd., Sip & Surf offers breakfast, bakery items, a variety of fresh-brewed coffee and tea flavors, ice-cold beer and wine. Costa said he was surfing on the beach after the hurricanes in November when the landlord of 701 N. Oceanshore Blvd. approached him with the idea of opening a coffee shop there. Costa said that’s when he realized there wasn’t a coffee shop across from the beach on State Road A1A. “When you’re waking up in the morning, the first thing in the morning, you want to see the sunrise and get a coffee,” he said. “So I just thought to add it to the beach experience.” Sip & Surf officially opened in April, and since then, Costa said, business has been good. He said the restaurant has been working on transitioning from commercial syrups to using syrups made in-house. Costa said that right now, Sip & Surf has several holiday season flavors, and he hopes to add lunch items to the menu soon.

The Florida Agricultural Museum was in danger of closing five or six years ago, but is now financially stable, Executive Director Kara Hoblick said. The Agricultural Museum is a private nonprofit that is loosely tied to the Florida Department of Agriculture but does not receive funding from it, Hoblick said. black, Hoblick said, it’s ready to hit the restart program with a new marketing strategy, starting with changing its name. “‘Museum’ does not really give the image of who we are,” Hoblick said. “We have historic buildings brought in from around the state of Florida, a lot of hands-on activities, a lot of animals. So it’s more of an experience and an educational facility.” The board is considering new names, Hoblick said. A name change will have to be approved by the Florida Legislature. A new name probably won’t be official until next summer, she said. The facility is requesting $2.7 million from the Legislature for a new horse barn and new buildings in the school touring complex. The funding bill has support from Speaker of the House Paul Renner and Sen. Travis Hutson, Hoblick said. Rep. Keith Truenow is sponsoring the bill. The Florida Agricultural Museum’s SCORE mentor is Tony Flores, who has helped the facility come up with new marketing strategies, Hoblick said. “He is one of our biggest advocates,” Hoblick said. “Every week we still hear people saying, ‘I didn’t know you existed,’ and these are our neighbors. Our job this next year is going to try to change that.” Part of that effort will be putting up signs on I-95 and U.S. 1. “This year will be the year people notice us,” Hoblick said.

Flagler Beach has a new oceanside smoothie and juice bar to enjoy: Beachfront Nutrition. Raymond Hall opened the smoothie spot alongside his wife, Amelie, on Sept. 1. Located at 705 N. Oceanshore Blvd., Unit A, the shop sells protein shakes, smoothie bowls, doughnuts and more. Hall said he is a Palm Coast resident who has lived here for two years. He and his wife began to teach workout sessions in February on the beach and, one day, noticed that the unit directly across the beach was empty, he said. “We were like, ‘That could be a good opportunity to open a smoothie shop right across to serve people after their workout,’” he said. “It was a no brainer.” The protein shakes Beachfront serves can actually be a meal replacement, he said: They are low in sugar and high in protein, but “taste like ice cream.” Business has been really good, he said, and he’s excited for the peak season next summer. “We were able to build a nice community,” Hall said. “And now we’re really looking forward for next summer.” Beachfront is open from 7 a.m. to 4 p.m. Monday through Friday, from 8 a.m. to 4 p.m. on Saturday and closed on Sundays.

The Flagler Department of Health has joined the international nonprofit Little Free Library with its own little library, the “Big Blue Box.” The DOH-Flagler opened its little library as part of the DOH’s initiative to further childhood literacy. Mary Kauffman, a DOH-Flagler senior health educator with Women, Infants and Children and Nutrition Services, came up with the idea after seeing Little Free Library boxes when she worked at the DOH-Volusia office. Kauffman said the DOH-Flagler’s little library has only been running since October, but has already garnered interest from visitors and patients. “Our Health Department serves a lot of lower income families that don’t necessarily have the transportation to get to the library,” she said. The DOH-Flagler office is located at 301 Dr. Carter Boulevard, Bunnell, and the Big Blue Box is to the right of the main entrance, by the sidewalk leading to the WIC center. Kauffman said it was placed close to the parking lot and sidewalk to make it as accessible as possible. The Little Free Library’s goal is

The city of Palm Coast is looking into building a new sports complex to draw a multi-million dollar industry to Palm Coast. The complex would not come at a cost to taxpayers, though, Assistant City Manager Lauren Johnston said in an interview with the Observer. City staff, at the direction of the City Council, will consider options for a public-private partnership and other funding opportunities. “We look at this being that economic catalyst for growth of Palm Coast,” Johnston said. In 2022, Palm Coast asked Sports Facilities Companies to conduct a feasibility survey so the council could see what, if any, kind of sports complex would fit in Palm Coast. Evan Eleff, a representative from Sports Facilities Companies, presented the results of that survey at a Dec. 12 City Council meeting. It could cost about $90 million to construct both indoor and outdoor facilities. But, Eleff said, a sports facility could have an economic impact of $30 million in direct spending in its first year alone, if there are 37 events held there in the first year. “Our projection, with confidence, on a conservative level, is that this facility can and will cover its own operating costs by year three,” Eleff said. Johnston said that the Indian Trails Sports Complex, built in 2005 on Belle Terre Boulevard, has already demonstrated, on a smaller scale, the kind of revenue a sports complex could generate. “Back in the recession, that’s what sort of kept the business community ... afloat,” Johnston said. “As the city continues to grow … this just kind of fits in naturally.” If the complex gets the green light,

To that end, books in the DOHFlagler Little Free Library are geared toward children 8 or younger, including babies, Kauffman said. “I loved reading to my kids when they were really, really small,” she said. “And I feel like it helps so much in developing their literacy skills.” According to the Florida Literacy Coalition’s analysis of 2020 census data, 16.6% of Flagler County’s population is at or below Level 1 Literacy. Someone at Level 1 literacy would struggle with reading and writing more than short materials or completing simple tasks, like filling out forms, according to the coalition’s website. “Kids need easier access to books,” Kauffman said. “Whatever we can do to help get books in the hands of children — I just want to start doing that more often.”

to provide access to books to every community. The initiative started in 2009 in Wisconsin. There are now more than 150,000 registered Little Free Libraries, in all 50 states and in countries around the world, according to the nonprofit’s website. Kauffman said that the little library has already seen enough activity that she needed to buy more books to keep the library stocked. Ideally, participants would swap the books they take with books of their own, she said. “In order for these to be sustainable, it really should be a community effort,” she said. Including DOH-Flagler’s Big Blue Box, Flagler County has nine libraries registered on the Little Free Library mobile app, including one built by the city of Palm Coast in the Community Center’s playground. Kauffman said the Little Free Library, as a nonprofit initiative, qualifies for grant funding. The Florida Healthy Babies grant funded the

Johnston said, the city would place it along the eventual westward expansion of Matanzas Woods Parkway. The concept idea proposed for Palm Coast would be a 180-acre facility with a 112,000-square-foot indoor facility and almost 43 acres of outdoor use. The indoor facility would house eight basketball courts, 16 volleyball courts, a kitchen and concession, a medical center and mixed-use meeting spaces. The outside fields would include four multi-purpose fields, 16 synthetic turf fields, a multi-use path, a play area and a space for a future championship field, plus ample parking. The revenue derived from a complex like this would help shift some of the city’s tax burden away from residents, Johnston said. Eleff said the facility would also generate business opportunities for hotels, restaurants and other businesses that would serve groups that stay for a tournament. The downside is that there is not much grant funding for such a project. Eleff public-private partnerships are common in this industry. “Today, these complexes that get built, about 85% of them that we work on, have a significant publicprivate partnership,” Eleff said. The concept idea does not include a pool because of their high maintenance costs and the low demand for travel tournaments in swimming, he said. The City Council agreed that the next step would be for city staff to scope out funding opportunities. “Let’s see if we can get those partners,” Vice Mayor Ed Danko said. “Obviously, we have to find money to do this.” Johnston said staff will reach out to local stakeholders to see if they are interested. “We can make this from concept to reality, but if we’re going to make it a reality, who’s going to come to the table to help us,” she said.

The Kids Workshops at The Home Depot bring out the best in my kids. They bring out the worst in me. You see, I’m not what they call “skilled” with following directions that depend on spatial orientation. Once I line up a nail, I can pound it with the best of them, but it often then needs “adjustments.” As in, it was put on upside down. My 9-year-old daughter, Kenne-

dy, knows this from sad experience. So, when I offered to help her when we arrived at the workshop earlier this month, she declined. “Dad, usually when I do what you say, I have to tear it apart,” she said. Therefore, she sat next to my wife, Hailey. Luke, who is 5 years old and less picky about his final product — in this case, a wooden gingerbread house — got stuck with me as his helper. The setup is genius. Both The Home Depot and Lowe’s do it: Free crafts for kids function as a tractor beam to pull in the parents. Parents develop some loyalty and goodwill to the brand, and probably buy something while they’re at the store. The workshop tables are arranged

in a long line down a lumber aisle at The Home Depot. Some non-workshop customers at the store might not like the deafening cacophony of 25 little kids pounding away with their hammers, but how can customers stay upset when they see the smiles on 25 little kids’ faces? It’s another example of an event creating a sense of community, a shared experience that reminds us all that we’re not alone. “How am I covered in paint?” Hailey said suddenly. She lifted her forearm to reveal a long smear of thick, blue paint from a bottle that apparently had been overturned by an earlier artisan. It was actually a great color on her, but now didn’t seem like the time to mention it, so I left our table in search of a paper towel. What I found was even better: The employees in charge of the event had

planned ahead with a ready supply of wet wipes. Experience matters. It was a good thing, because after Hailey’s encounter, Luke needed a wipe several more times due to his own spills while painting his gingerbread house. Would he notice if I accidentally “lost” his house in the garbage can on the way out of the store? Of course, that was out of the question. One look at Kennedy’s and Luke’s faces would show that they had just made another masterpiece out of a Saturday morning.

In response to the heartfelt desire expressed by our community to keep festivities at Central Park—the original and cherished location —

We’ve increased the number of course marshals to ensure safety along the parade route. YOUR TOWN ROAD TO SUCCESS PROGRAM REACHES 350 GRADUATES The Road to Success Youth Program reached its 350th graduate in November. RTS, which began in September 2012, helps 16- to 24-year-olds who left high school earn their general education diplomas. The classes at George Washington Carver Community Center in Bunnell are smaller than high school classes. The program has morning and afternoon sessions Monday through Friday. Students generally take three to six months to graduate. “The RTS staff is one-on-one with students and supports what you do,” program graduate Grant Bredstrup said. “They are excellent mentors, and the program helped me succeed. … The smaller classes were beneficial and allowed the staff to get to know you on a personal level.” RTS is an alternative for students who struggle in the traditional high school setting. The graduation of 350 students demonstrates the success of the federally funded program, which is supported by the Flagler County School District and the George Washington Carver Foundation. RTS also has a contract with Career-

Source Flagler Volusia to provide services to 50 young adults this year. The main component of the program assists students with their academics so they can earn their diplomas. he Jewish community of Palm Coast rang in the fifth night of Hanukkah with Chabad of Palm Coast’s annual Chanukah Jewish Festival and Concert. The celebration took place at European Village on Dec. 11 and featured music from the international singer Shuky Sadon and Israeli musician David Twito, plus a petting zoo, latkes and the Grand Menorah Lighting ceremony. Hanukkah this year began on Dec. 7 and runs through Dec. 15 Chabad of Palm Coast Rabbi Levi Ezagui congratulated the Jewish community for continuing to serve their faith openly, in spite of the latest war between Israel and Hamas, and, he said, the voices opposing Israel across the world on social media. “There is every reason in the world why the small nation of ... Israel should cower in fear, should crumble in fright, should run and hide,” he said. “But no, that is not what is happening here tonight.” Hanukkah is the eight-day Jewish Festival of Lights. Palm Coast Mayor David Alfin lit the center candle of the menorah while Val Krayter — owner of Palm Coast Pharmacy, which sponsored the festival — lit another five candles. Sheriff Rick Staly was invited to light the torch used to light the menorah. Staly referenced recent acts of antisemitic vandalism committed in Flagler Beach and said he is committed to making Flagler County

Flagler Palm Coast’s first-year coach, Michael Talley, wants to build a winning mentality. Two games in a row, the Bulldogs came up just short to undefeated teams. Some people may say FPC, which went 7-18 last year, is headed in the right direction. That’s not how Talley sees it. After the Bulldogs lost 60-58 on the road to Father Lopez on Dec.

5, Talley was silent for 10 minutes before asking his players, “Did you guys like how that felt?” When they said they didn’t like the feeling, he told them the mindset had to change. They had to come out with energy from the start and not let up. Unfortunately, he said, that didn’t happen two days later on Dec. 7 when New Smyrna Beach (5-0) held off FPC 55-50 at the Bulldogs gym. FPC battled back from an 11-point deficit in the fourth quarter. “I don’t think it was a really good effort,” Talley said. “I think it’s a mindset that you have to have to start a basketball game, and I don’t think we were ready to even play the game from the beginning.” The Bulldogs followed the loss with a 59-47 win over Pine Ridge on Dec. 11 to improve to 3-4. Talley has a history of winning

as a player and a coach. As a player, his Detroit Cooley High teams won three straight state championships. He was a player with the University of Michigan during its two NCAA championship game appearances in 1992 and ’93. The FPC sophomore suffered a quad contusion in a loss at Orange Park the night before and bruised her knee in the first quarter of a 52-47 loss to Forest on the first night of the Bulldog Classic. Connerton took a short rest after hurting her knee then returned and finished with a game-high 20 points and 10 rebounds. “I sat for a little bit, but no matter what, you got to play,” Connerton said. “I didn’t feel it during the game. My adrenaline was running high, my emotions were running high. I was focused on the game and everybody playing as a team. But I’ll feel it after the game.” The Bulldogs trailed by five at halftime, but the Wildcats outscored them 20-5 in the third quarter, going on a 20-1 run to take their largest lead at 52-33. Forest did not score in the fourth quarter as the Wildcats held the ball for long stretches, but FPC could get no closer than five points. Connerton scored 11 of FPC’s 20 second-half points. “She’s a baller,” FPC first-year coach George Butts said. “She has that fight in her. She’ll be one of those we’ll be watching on TV someday.” Connerton is not worried about

Freshman Ava Works added 11 points and two steals against Forest (5-3), while sophomore Carolyn O’Lear had seven points and eight rebounds. “We had a tough game (the day before in a 66-47 loss to Orange Park). Everybody was hurting,” Connerton said. “But we still have to play through it. We have a lot of freshmen, and they’re still getting used to varsity basketball, but they’re all contributing to the team. With our offense and defense we have to be in shape. We give it our all, and we keep rotating in players. I love this team, and I love the coaches.”

Mills was a state runner-up at 170 pounds as a sophomore but missed the postseason last year with a shoulder injury. Pirates junior T.J. McLean finished second at 120 pounds. Their 56-28 advantage midway through the third quarter was reduced to single digits midway through the fourth quarter. The Green Wave regained their composure, however, to escape the Pirates’ gym with a 78-68 victory on Monday, Dec. 11. Father Lopez (6-0) remained undefeated, while the Pirates (1-7) saw some encouraging signs in what has been a rough start to the season. “Our lead went from 28 to 15 just like that,” Father Lopez coach Brad Ridenour said. “It was real quick.” The Wave’s 41-28 halftime lead ballooned to 56-28 after they scored 15 straight points to begin the third quarter. Matanzas senior guard Tariq Shakir ended the run with a 3-pointer.
