Flagler County’s number of new COVID-19 cases has dropped slightly, but it’s still higher than it was several weeks ago.

The Florida Department of Health in Flagler County recorded 789 COVID-19 cases last week — down from 936 the week before, but still above than the 731 recorded in the week before that. Ten COVID-19 patients died last week.

Meanwhile, vaccinations have been increasing by about 1% a week, and the county is currently at a 67% vaccination rate, Florida Department of Health-Flagler Communications Manager Gretchen Smith said on Flagler Broadcasting’s “Free For All Friday” radio program Sept. 3.

The department is shifting its testing and vaccination schedule to accommodate the trends its staff members are noticing. The testing location for Thursday, Sept. 9, and Friday, Sept. 10, had not been determined as of this publication’s print time; check www.palmcoastobserver.com for updates.

“We’re trying to modify our testing and vaccination plans based on demand,” Smith said.

It will take time for case investigators and contact tracers to reach you when/ if you or your child tests positive for COVID-19.

You or your child will need to isolate for 10 days from the onset of symptoms. Take initiative to protect your loved ones by speaking with family members and other close contacts so they can get tested and watch for symptoms.

If you are identified as a close contact to someone who tests positive, you may not hear from the health department if resources are not available.

If you have been vaccinated (two weeks after your final dose) you will not need to quarantine if you do not have symptoms.

If you have symptoms, get tested as soon as possible.

Students will need to quarantine at least four days after the date of exposure.

Much of the surge has been driven by the reopening of schools: As of Sept. 3, a total of 787 Flagler Schools student had tested positive for COVID-19 since the current school year began on Aug. 10; a total of 86 Flagler Schools staff members also tested positive.

Last year, only 376 students had tested positive over the entire course of the school year.

School Board member Colleen Conklin said that a few days ago, when Flagler had recorded 705 student cases among its 13,300 students, Broward County — which requires students to wear masks, while Flagler does not — had recorded only 418 cases out of its over 260,000 students.

Conklin had pressed the Flagler County School Board to adopt a mask requirement in Flagler County, but the proposal was voted down 3-2, with Conklin and board member Cheryl Massaro dissenting.

Conklin hosted a live-streamed forum Aug. 31 that gathered a number of local health experts to discuss best practices for COVID-prevention in schools. Her former electoral opponent, local doctor Paul Mucciolo, had participated, and joined her in support for a temporary mask mandate.

“Paul and I were able to set aside our differences and come to together, and we were hoping to make a statement with that,” Conklin said on the radio program. “ It shouldn’t be political.”

Smith said the forum was valuable.

“It was definitely needed, and there’s a lot of people ... that, sadly, believe what they read on social media, which is not necessarily true,” she said. “I think it’s important that we are able to dispel some myths.”

‘Living Reminder’ City will dedicate ‘Survivor Tree’ seedling at Sept. 11 Remembrance Ceremony

Rattled, resilient, changed Palm Coast resident was in the basement of the World Trade Center on Sept. 11, 2001.

Less than a month after the Sept.

11 attacks on the World Trade Center, a badly damaged Callery pear tree was discovered buried in the ruins.

The New York City Department of Parks and Recreation nursed what became known as the “Survivor Tree” back to health, and, in 2010, it was replanted at the 9/11 Memorial & Museum site.

The Palm Coast Fire Department recently received a 10-foot seedling from the tree, which the city has planted at Heroes Memorial Park, across the courtyard from the granite monument honoring the 2,973 people who lost their lives in the 9/11 terror attacks 20 years ago.

The seedling will be dedicated during a 9/11 Remembrance Ceremony at 6:30 p.m. Saturday, Sept. 11, at Heroes Memorial Park, 2860 Palm Coast Parkway NW. “It will make the 20th anniversary much more memorable now that we have something from New York City here,” said Fire Department Lt. Patrick Juliano, who is coordinating the ceremony.

Juliano said the city of St. Augustine received a grant for a Survivor Tree seedling with the stipulation that it find sister cities that also agree to plant and nurture a seedling in a public setting.

“Our Heroes Memorial Park is the optimum place,” Juliano said. “We already have a Sept. 11 memorial there.”

The Survivor Tree in New York has smooth limbs growing out of gnarled branches, telling the story of its past and present.

“The tree is a remarkable thing.

It’s a reminder of resilience and survival,” Juliano said. “We’re now 20 years removed from this, and we’ll never forget. This is a living reminder that through tragedy there is rebirth. There is renewal.”

Callery pear is a species of tree native to China and Vietnam. The Survivor Tree was 8 feet tall when it was discovered in the rubble of the towers and now is over 30 feet tall with a conical shape and rounded crown.

Callery pear trees produce fivepetaled white flowers three-quarters to one-inch in diameter. The fruit are inedible and very small at less than a centimeter wide. In summer the foliage is dark green and very smooth.

The seedling program was launched in 2013, with seedlings distributed to cities throughout the world. The Palm Coast tree was tagged “No. 725.” Juliano said.

“It’s amazing they’ve been able to do so many,” he said.

Juliano was 16 and living in Westchester County, north of New York City, at the time of the attacks.

“I knew people that were killed in the World Trade Center,” he said. “One of the people killed that day was one of our town councilmen. I saw him that Sunday talking at a street festival in our town, and he died that Tuesday. If you grew up in that area you knew not just one family but multiple families that were affected by the tragedy.”

The ceremony will include 9/11 survivors and first responders who will dedicate the Palm Coast seedling.

“I’m sure in a couple of years it will grow up into something nice,” Juliano said. “It will be a living reminder.”

SEPTEMBER 11 CEREMONIES KNIGHTS OF COLUMBUS REMEMBRANCE The Knights of Columbus Notre Dame Council 10514 will host the annual 9/11 Remembrance Ceremony at 8 a.m. at the Flagler Beach pier.

The ceremony will include recognition of Flagler vBeach and Flagler County representatives and first responders, a featured speaker and tossing roses into the ocean.

A procession to Santa Maria del Mar Catholic Church will follow the ceremony. The church will hold a “Blue Mass.”

ELKS MEMORIAL DEDICATION At 8 a.m., Palm Coast Elks Lodge 2709, 50 Old Kings Road, will unveil and re-dedicate a monument and memorial near the lodge’s front entrance.

Two beams from the World Trade Center were used in the monument. The memorial honors the victims, first responders and servicemen that perished in the Sept. 11 attacks. Flowers will be available to place at the base of the memorial.

The ceremony will last about two hours and food and refreshments will be available afterward. Seating is limited, so please bring a chair and be seated by 7:30 a.m.

REMEMBRANCE CEREMONY AT HEROES MEMORIAL PARK The 9/11 Remembrance Ceremony at Heroes Memorial Park, 2860 Palm Coast Parkway, will begin at 6:30 p.m.

The sunset ceremony will include an opening prayer, presentation of colors by an honor guard; the national anthem played by the Matanzas High School band; the Survivor Tree seedling dedication; a musical tribute from the Flagler Youth Orchestra; a memorial wreath presentation; the traditional striking of the four fives – ringing four sets of five bells in memoriam; taps; a closing prayer; and a bagpipe tribute.

Deputy Fire Chief Bradd will be the master of ceremonies.

Speakers include Mayor David Alfin and Fire Chief Jerry Forte.

Survivors and first responders who will dedicate the Survivor Tree seedling will include Michael LaGreca, an EMT who treated people on the New Jersey side of the Hudson River during the Sept. 11 boat evacuation of 500,000 stranded civilians; Ron Young, a retired New York State court officer; Ophelia Beyer, a survivor of the Sept. 11 Pentagon attack; and Yvonne Robinson, who was on the 74th floor of the North Tower when the first plane struck.

In 2001, I had been working in New York City for about 20 years. My office was located in lower Manhattan and on 9/11, I was situated on the 15th floor of a 20-story building on Broadway about three blocks south of the World Trade Center. My office had a large window overlooking Broadway, and looking north from that window was a majestic view of the towers of the World Trade Center.

I commuted daily to Manhattan from New Jersey and took a train to Newark, where I switched to another train that went under the Hudson River into the World Trade Center. After departing the train, I would take a long ride up one of the three escalators from the basement of the World Trade Center to its mezzanine level.

On 9/11, as I did each morning, I stepped onto the escalator at about 8:45 a.m.

Midway up the escalator, it began rattling.

Suddenly a number of NYC Transit Police began scrambling up the escalators, pushing aside the riders. New Yorkers are used to this kind of activity and usually are fairly unfazed by it all, and I was no exception. But when I hit the mezzanine floor at the top of the escalator, I realized quickly that there was something happening that was not at all routine.

A band of New York City cops and Transit Police were loudly telling the crowd to get out of the building, and they were not suggesting that we be calm and orderly about it. The scene was chaotic, with a panicked herd of people running for an exit.

Having spent so much time in the World Trade Center, I knew a variety of exits and entrances.

So, to avoid being trampled by the rushing crowds, I opted for an alternate route out of the building.

I veered away from the panic and went out a door onto the plaza on the Broadway side. I discovered quickly that I had made a mistake.

Large chunks of fiery debris, some the size of Volkswagens, were falling all around me. The sky was a blizzard of white paper; police and fire engine sirens had begun blasting; and I was confused as to which way to run.

To avoid the objects raining down from above, I decided to zig-zag and serpentine across the plaza, which, in retrospect was, of course, ridiculous — as if the falling debris somehow knew where I was going.

Stunned and breathless, I made it across Broadway out of the reach of large falling debris, but still surrounded by clouds of floating paper. I stood there with an assembled crowd all staring in shock at a massive fiery gash high up in the North Tower. I still had no clue what had happened; possibly a gas explosion I thought.

A plot of vacant land along Old Kings Road South of Palm Coast Parkway may be transformed into a plant nursery and a showroom for residential construction tradesmen.

The Palm Coast City Council at a Sept. 7 meeting approved a rezoning for portions of the 52-acre property, allowing owner Coastal Collections LLC to change its designation from office to high-intensity commercial in one section and from preservation to public/ semi-public in another section.

The owner of the location also owns land immediately to the south.

The property would showcase home good products such as chandeliers and have both a nursery and a section for hardscape yard features such as fountains, said project manager Charlie Faulkner.

The council approved the rezoning unanimously.

The council also voted to approve a rezoning for portions of a proposed 72-acre

residential and commercial development called Seminole Pointe, at the intersection of U.S. 1 and Seminole Woods Boulevard.

The development had initially been proposed years ago as master planned development and general commercial; the developer wanted it rezoned to multifamily residential and highintensity commercial.

Attorney Michael Chiumento, representing the developer, told the council that the multifamily residential units would be what he referred to as “attached single-family,” such as duplexes, rather than apartments.

Residents would be able

to walk or bike to nearby commercial properties, he said.

“I think the single-familyattached housing style is something that we need to add to our inventory,” Councilman Nick Klufas said.

Councilman Victor Barbosa, earlier in the same council meeting, had been part of the minority voting against a rezoning for another development that would have converted commercial land to residential, saying the city needs more commercial development. But he supported the Seminole Pointe proposal.

“This is an example of a perfect project,” he said.

“We have homes, we have businesses, we have jobs.”

Council may reconsider Whiteview Parkway plans Since 2018, the Palm Coast city government has proposed reducing Whiteview Parkview from four traffic lanes to two traffic lanes, plus turn lanes, to reduce rear-end crashes there.

The segment of the road that stretches from Wood Aspen Lane to Rolling Sands Drive had been ranked in the top 10 for crash severity according to the Transportation Planning Organization’s analysis in 2017.

But city staff at a Sept. 7 council meeting proposed paying for a study to look at another option: Adding turn lanes to the existing road, without reducing the number of travel lanes, and adding a multiuse path.

The fee for that study, plus design, could have been up to $382,702. City Council members asked city staff to give the council more information before the council votes on whether to spend the money.

With over 2,000 students missing school in the first month alone due to COVID-19 cases and close contacts, a health official recommended the Flagler County School Board de-emphasize contact tracing. No vote was made.

Dr. Stephen Bickel, medical director for the Florida Department of Health-Flagler, also said universal masks in Flagler Schools are a low-cost strategy with a moderate to high benefit.

“There is no question that masks are not 100% effective, but there is lots of evidence that they are somewhat effective,” Bickel

told board members at an agenda workshop meeting Sept. 7.

He said contact tracing works well with a lower number of positive tests, but with the high case load due to the delta variant, “it doesn’t accomplish a whole lot.”

Bickel also recommended outside learning when possible, good ventilation and social distancing of at least 3 feet.

David Bossardet, the district’s risk manager and safety specialist, said that according to CDC guidelines students in a classroom setting with universal masks should not have to quarantine if they are identified as a close contact but are asymptomatic.

Board member Jill Woolbright said she would be against any kind of mask mandate while there are still legal questions.

“To me, until it is legal to do so, universal masks are out of the question,” she said.

ruling that the governor and the Department of Education have no authority to punish school districts for mask mandates has been appealed with a stay.

“In essence, the executive order stands in place,” Gavin said.

Board Vice Chair Colleen Conklin said Broward and Alachua county school districts, which have mandated masks, have had significantly lower COVID cases.

But board member Janet McDonald said fabric and surgical masks allow “smoke to get around and through, so that tells us that the virus will get around and through, so I think it’s a false promise.”

McDonald said asymptomatic people don’t spread the virus, which Bickel refuted.

“With contact tracing we’re bargaining with people who think they should be free to breathe and learn,” McDonald said. “Healthy people have never been forced to wear a mask before in all of his-

McDonald went on to question COVID vaccines’ efficacy.

“I would not suggest to anyone to get an experimental injection,” she said.

Bickel told McDonald, “You are such an outlier with your point of

view it’s hard to respond.”

“Do I think masks solve the problem? No.” Bickel said. “Do I think they help? Yes.” Bossardet said the district has made one change with its COVID policy. The Department of Health will no longer contact teachers directly. When a positive case is identified in a classroom, an administrator will tell the teacher.

“We’re trying to take (the DOH) out of the middle-man role,” he said.

BOARD APPROVES TAX RATE

The School Board approved a final millage tax rate, budget and a flexible spending resolution for the 2021-22 fiscal year.

The millage rate was set at 5.865 to raise $43,420,156. The rate is the lowest in 25 years, Patty Wormeck, the district’s chief financial officer, said. The tentative budget for the school year is $211,987,394.

‘I figured that was the end’ a break to catch my breath at the rear entrance of my building and then heard another loud explosion. I couldn’t see the Trade Center from where I was then, so I guessed that it was a secondary gas explosion. When I got up to the office, my staff was huddled around a conference room TV waiting for details. Others were looking incredulously out the picture windows on our floor that provided a bird’s-eye view of the fire and smoke streaming from the buildings.

We learned that two planes had crashed into the Trade Center, the first one into the North Tower and then the South.

I then realized that the escalator rattle I’d felt was actually the plane exploding into the North Tower, and I was amazed that the impact shook the building all the way to the basement, about 90 stories down.

At first, everybody including the news media presumed that it had been a pilot error or some bizarre air traffic controller glitch.

Even when the second plane hit, the thought of a deliberate attack hadn’t sunk in.

The story rolled out over the next few hours — multiple planes, multiple destinations, terrorists — and it became clear that we were under attack.

But the information remained vague. Nothing much more than what we could see ourselves and what CNN provided was learned.

Suddenly I heard a scream from a secretary down the hall, followed by a frantic cry that the building was coming down. In disbelief, I began to rise to go look down the hall where the best vantage point was, but ended up huddled under my desk when our building began to shake violently. My picture window overlooking Broadway turned pitch black and began to vibrate. The noise and vibration were so great that I feared the terrorists had followed up with a nuclear device, and I figured that was the end of Manhattan.

When it finally began to clear a bit, out my window I could see through the haze a bleak winterlooking scene with white parked cars, white deserted streets, and sidewalks with a few dazed slowmoving and sometimes stagger-

ing people all also blanketed in a layer of white dust. The air was too dense with smoke, dust and debris to see the rubble of what was left of the collapsed tower.

I began thinking about an escape from the city when reports surfaced that the Brooklyn Bridge, only about a quarter-mile north of my office, was being used as an evacuation route. Then suddenly, the same loud rumble began again and there were yells from the floor that the other Tower was coming down. It was deja vu: the same intense rattle of our building and its windows and again the total darkness. Any thoughts of evacuating then were on hold. After almost the same amount of time it took for smoke, dust and debris to clear somewhat from the first Tower collapse, three of us who lived in New Jersey decided it was time to go.

The plan was to hike out, head for the Brooklyn Bridge, walk across the bridge and hopefully hook up with a friend of mine in Brooklyn with a car to drive us home to Jersey.

The hike out of Manhattan was surreal, with the dense haze in the air, white dust on everything, in some places more than an inch deep. I had removed my T-shirt, which I had soaked with water, and had it wrapped around my face. My briefcase was full of whatever survival items I could put together: a couple of bottles of water, an old granola bar, and even a pint of brandy leftover from last year’s holiday party.

Along the way, I remember coming upon an abandoned fruit stand with an assortment of dustcovered fresh fruit. Not knowing what the future would hold, I filled up any available space in my

We were told by a passing dust-covered lady that they had closed the Brooklyn Bridge to all but emergency personnel and that we had to instead head for the Manhattan Bridge about a half-mile north to get out of the city into Brooklyn.

The view of the lower Manhattan skyline as we walked across the bridge was unnerving. Giant plumes of smoke had replaced the gleaming twin towers that used to be the centerpiece of NYC. We were part of a stream of New Yorkers hiking in silence, all in shock, but relieved to be out of the city.

On the Brooklyn side of the bridge, we jumped on a bus and eventually hooked up with my friend with the car. Dazed and tired, we finally headed home to New Jersey. It was a very long harrowing day, but it wasn’t until I finally went to bed that night that the immense magnitude of what all had happened and the carnage really set in.

Manhattan was to some extent grimmer than 9/11 Itself. By then we had a very sobering death count. Thankfully, I didn’t know anyone who perished in the disaster, but I knew lots who knew someone who did.

Rudy Giuliani, the NYC mayor, following the lead of President George Bush, wanted to get everybody quickly back to work in the city to show the terrorists how resilient we were. Most major businesses were back functioning the week after 9/11. Most smaller businesses, however, were not operating and wouldn’t open for months.

Lower Manhattan had the feel of a war zone, with heavily armed police and military patrolling on every street corner. Cleanup workers with their heavy equipment had converged on the site, and the gruesome task of unearthing and identifying remains had begun.

All around the area, there were posters taped to street signs, and on walls were pictures of people still considered missing. Relatives and friends of those unaccounted for roamed the streets passing out flyers with pictures of the missing, hoping someone would recognize them and declare them to be alive. Numerous little memorials to honor the dead, in the form of candles, ribbons and pictures were seen along the streets near the disaster site.

The air quality in lower Manhattan was stifling. The remains of the World Trade Center were still smoldering in a giant ugly heap when I returned to work, and the smell was pervasive for months. People were wearing dust masks, and giant air cleaners were placed on every floor of major office buildings even though the city and the federal government declared the air quality to be safe — a claim that was later refuted. Most felt that returning to the area so soon was a mistake.

New York’s reputation as a cold uncaring city had always been wrong, and 9/11 drove the real truth home with the many stories of the heroism of World Trade Center survivors and the fire and police responders’ courage and sacrifice. The disaster definitely made New Yorkers starkly aware of how fragile and vulnerable the huge metropolis and its people really were and will sadly continue to be since their city and the world had moved on to a very different place.

After Newsholme’s attempted suicide, he’s accused of fraud There are 12 cases being investigated at Flagler Tax Service. Newsholme’s criminal history dates to 1970s.

On Aug. 25, the day after Bob Newsholme shot himself in an attempted suicide, his clients at Flagler Tax Service contacted the Flagler County Sheriff’s Office to report that he had defrauded them.

The FCSO General Assignment Unit, Internal Revenue Service Criminal Investigations, and the Volusia County Sheriff’s Office executed a search warrant Sept. 3 on Flagler Tax Service of Bunnell, located at 608 E. Moody Blvd. Detectives seized multiple computers, files and other evidence potentially linked to numerous incidents of a massive organized scheme to defraud clients.

Newsholme has a criminal history dating back to the late 1970s in New York for fraud, larceny and forgery. He is not a certified public accountant as most of his clients believed he was, and the current cases being investigated by the FCSO total $189,871 of missing funds.

“At this time, we have no indication that any other Flagler Tax Service employees took part in or had knowledge of any illegal activity,” Sheriff Rick Staly

said. “Thousands of documents and forensic material are being analyzed as the investigation continues. It’s unfortunate that someone who was trusted in the community would take advantage of so many people that trusted him. Our investigators will not rest until the victims are identified and the suspect is held accountable for his actions.”

FCSO is asking the community — any person or business whose taxes have been prepared by Flagler Tax Service and has received a notice from the IRS of late filings — or anyone who believes they may be a victim to please contact the FCSO to make a formal report at 386-313-4911.

There are currently 12 active cases being investigated for fraud against Newsholme that FCSO is investigating. If you feel you may be a victim, please contact the FCSO by calling 386-3134911 to file a report. Upon filing a report with FCSO, victims need to contact the IRS with their case number at 800-829-1040 (Individuals) or 800-829-4933 (Businesses).

The FCSO also urges residents who may have had their tax information seized during the investigation of Flagler Tax Services to contact the IRS.

BRIEFS 11-year-old arrested for falsely reporting school shooting

‘Marsh’ finds a home after months on the run

An 11-year-old girl was arrested Sept. 2, after she called 911 to report an active shooter at Palm Coast’s Rymfire Elementary School. She later said she was encouraged by another student to make the call as a prank.

“This student learned the hard way that we do not tolerate false reports, especially of an active shoot on a school campus,” Flagler Sheriff Rick Staly said.

“Here is a great example to the youth that threats are not a joke, and pranking law enforcement is a crime. We take all threats very seriously, and they will not be tolerated. This fake call required multiple deputies to respond to the school, taking deputies away from responding to other calls. Parents, please talk to your children about making threats and be the sheriff in your home.

Threats are not a joke and making one will get you arrested.”

The 911 caller said that multiple shots were heard, but when the dispatcher asked to speak with the teacher, the caller hung up.

Deputies visited the teacher, who said there was no such incident. Deputies then called the phone number 25 times.

A school administrator was able to help deputies link the phone number to the student, who was then arrested.

A dog who had been on the run for six months was finally trapped and will be adopted, according to the Flagler Humane Society.

Dog traps are only helpful when the animal that needs to be caught is hungry. Unfortunately, some neighbors were unaware of the trap and were providing her food. Flagler Animal Services Officer Dawn Morton spent months trying to trap her but was unsuccessful.

Then the call came that the dog was contained in the beachside resident’s backyard. Morton and a helper responded, and “Marsh” was successfully caught and transported to the Flagler Humane Society.

Marsh already has a home waiting for her: the beachside resident who helped trap her.

COPS CORNER AUG. 22

DRUNK THREATENS DEPUTY, THEN ASKS WHERE HE LIVES 11:11 p.m. Cypress Point Parkway and Belle Terre Parkway DUI, threatening a public servant. A man rear-ended the car in front of him. Deputies who arrived at the scene could smell alcohol on him even from a good distance away.

The man admitted he’d had a couple of beers at work before leaving. Then, when deputies pointed out an empty beer can in the car, he admitted that he’d had that, too.

When deputies went to arrest him, the man threatened one of the deputies, and said, “I’ll see you out, bro.” When the deputy asked him what he meant, the drunk man repeated the phrase, then asked where the deputy lived. The Sheriff’s Office added a charge for threatening a public servant.

He found a car idling on the side of A1A with the driver’s side door open and the driver, a woman, slouched over the front console.

The driver wore no pants. She smelled of alcohol, and there was a box of wine on the pavement.

The deputy asked the woman where her pants were. She said she didn’t know and may have left her hotel without them. She was arrested for a DUI.

The federal eviction moratorium that kept many renters in their homes even as they were unable to pay rent ended Aug. 26, potentially leaving Flagler County residents at risk of eviction.

As of Sept. 8, local property owners’ attorneys have started pushing to move eviction cases forward, Flagler County Clerk of Court Tom Bexley said.

“Since the moratorium on evictions was lifted, we have seen significant activity on the cases that were filed earlier this year and late last year,” Bexley said.

There have been 140 eviction cases so far this year, Bexley said.

There had been 175 filed in 2020, and 275 in 2019, before the pandemic.

But people having trouble paying rent are often eligible for government assistance programs that can help keep them housed until they’re able to get their finances worked out or find other living arrangements.

Sometimes, those programs are under-used because people don’t know about them — for instance, the OURFlorida.com program run by the state provides up to 15 months of rental assistance for people who are behind on their rent and at risk of eviction.

It prioritizes people whose income is at or below 80% of the median area income and who

Much of that money is still available, according to the Flagler County government.

Bexley says he feels for both renters and property owners in the eviction issue.

“It was a tough situation, I think, for everyone,” he said.

“The good news is the process is there, and it’s put in place to remedy situations like this. And it doesn’t always turn out the way you think, with an eviction and your mother-in-law’s belongings sitting out on the curb.”

Ideally, he said, case managers would be able to work out a resolution before that point.

With every judge facing case backlogs, evictions will likely take about six months to work their way through the system, Bexley said.

“Once you begin the eviction process, it’s going to take a while,” he said.

While Gov. Ron DeSantis said people shouldn’t “read too much into” the U.S. Supreme Court’s refusal to block a Texas law that bans almost all abortions, Republican legislative leaders indicated Thursday, Sep. 2, they will determine if Florida can enact similar restrictions.

Senate President Wilton Simpson, R-Trilby, called the Texas law “a new approach,” with the Supreme Court’s 5-4 ruling “encouraging.”

“As an adoptive child myself, it’s important to me that we do everything we can to promote adoption and prevent abortion; therefore, I think it’s worthwhile to take a look at the Texas law and see if there is more we can do here in Florida,” Simpson said in a statement.

House Speaker Chris Sprowls, R-Palm Harbor, issued a separate statement indicating he expects the issue to be pursued during the 2022 legislative session, which begins in January.

As Florida schools opened their doors to students, the number of children hospitalized with COVID-19 has increased more than tenfold.

At a news conference Thursday, Sept. 2, with U.S. Rep. Kathy Castor, D-Fla., University of South Florida College of Public Health professor Jason Salemi said an average of six children were hospitalized each day with COVID-19 in early June. But during the last week of August, that increased to an average of 66 children.

“The likelihood of a child being hospitalized with COVID-19 is far lower than an adult being hospitalized with COVID-19,” Salemi said. “But we are continuing to see a rise in hospitalizations for pediatric populations.”

Christina Canody, a BayCare health system pediatrician who took part in the news conference, said 180 COVID-19 pediatric patients were hospitalized at BayCare’s 13 hospitals in August, the “highest by far” and triple the previous high count. In addition to increasing hospitalizations, Canody said the health system has seen an uptick in the number of emergency room visits among pediatric patients.

With the deadline to set a property tax rate looming, Palm Coast’s council members are still divided on what that rate should be: Councilman Ed Danko wants the city to set the rate at the amount that would bring in the same amount of tax money as last year — called the rollback rate — while other council members favor a less dramatic rate reduction.

But they were able to come together Sept. 7 on a decision to fund all 10 new Sheriff’s Office deputy positions requested by Sheriff Rick Staly, and asked the city’s financial services department to look at how much the millage rate could be reduced if the city uses some of its reserve money to pay for expenses.

Holding the property tax rate steady at the current $4.6989 per $1,000 of taxable value would bring in an estimated $2.8 million more in tax dollars for the city in the coming year.

“Let’s begin by picking the items that we have some agreement or consensus on,” Mayor David Alfin said after a contentious back-and-forth between Danko and Councilman Eddie Branquinho.

Danko had suggested that the city eliminate all planned hires for the coming year, plus merit raises for current staff. Councilman Victor Barbosa said staff members need those raises, and that it would be a mistake to cut the planned new positions, given how quickly the city’s growing.

Alfin asked if all councilmen

were in favor of funding all 10 deputy positions. They were.

He asked if there was consensus to reduce the millage rate. There was not. Danko wanted the rollback, Alfin favored a more “modest” reduction, and Branquinho and Councilman Nick Klufas wanted to keep the current rate.

Alfin proposed using some of the city’s reserve money to pay for expenses, so that the city could reduce the property tax rate: The reserves are currently 27.4% of the city’s general fund, while the city’s guidelines suggest 10%-20%.

Klufas said he’d be OK with that, but added that the difference between rollback and the current rate would only be about $15 for the year for some residents.

Branquinho thought the city should maintain its reserves in case the money is needed to deal with a disaster like a hurricane.

Danko suggested the city save money by reconsidering its decision to build a regional racquet center. Alfin was open to that possibility, asking City Attorney Bill Reischmann if the city would be breaking already-executed contracts with design or construction firms if it did so.

Reischmann didn’t know, but confirmed that the city could potentially absorb the expense of, for instance, reimbursing a contractor for completed work.

Volunteers joined forces Sept. 4 for the city of Palm Coast’s 14th-annual Intracoastal Waterway Cleanup. Commemorative T-shirts, as well as trash bags and gloves, were distributed at the Community Center “Since 2008, the City of Palm Coast has utilized this event to not only clean up the Intracoastal Waterway, but as a way to bring our residents together,” Interim City Manager Denise Bevan said in a press release. “This is a familyfriendly event that allows every participant to make an impact on our community by preserving and

protecting the environment.”

Since 2008, volunteers have collected more than 20,000 pounds of trash. The event is supported by a $5,000 Florida Inland Navigation District grant.

Paul was loved by everyone who met him.

His quick wit, love for life and contagious smile will forever remain in their hearts. He was voted, “Most Popular” by his senior class of 1955 at Eustice High School and remained friends with many of his classmates throughout their lives.

Paul met Loretta in 1957 and it was love at first sight. They married a year and a half later and had four children which they always referred to as the blessings of their lives.

Paul attended the University of Florida and remained a huge Gator fan throughout his life. He also attended the University of Virginia when he was in his mid 30’s and earned a degree in Banking Law. Paul was the Vice-President of Barnett Bank on Park Avenue in Winter Park, Florida and later was promoted to Executive Vice-President of Barnett Bank and oversaw all the loan departments on the SE coast of Florida.

Paul was a lifetime member of the Elks club and he and Loretta loved to have dinner and dance to the live music there. They were marvelous dancers and the people on the dance floor would often step aside and give them room to, “Light up the dance floor!”

Paul had a musical side as well and was a self-taught banjo, harmonica, and guitar player. He and Loretta loved singing with their family, children, and friends.

Paul was a devout catholic and would stop by every morning on his way to the bank and pray.

Paul is survived by his loving wife of 63 years, Loretta, their four children, Mike, Brad, Greg, and Dana. Eight grandchildren, 22 great-grandchildren, and two greatgreat grandchildren.

His family was blessed beyond measure to have Paul as their daddy, grandfather, and great-great grandfather. He will be forever in their hearts, and they will always have a huge grin and loving laugh when they think of him.

A personal note from his family: Rest in peace dear Paul. We will carry on your amazing legacy, and you will forever be known by all your future family, and they will too grin and loving laugh as they are told of the amazing person you were and the wonderful life you lived.

here were a lot of potential distractions heading into the Mainland-Flagler Palm Coast football game: Mainland coach Travis Roland returning to the school where he coached the past four years; FPC coach Robert Paxia taking over at his alma mater.

Bulldogs linebacker Jason Browning Jr. decided to fix his attention on one thing.

“There were so many things going on,” Browning said. “I just mainly tried to focus on one. I was playing for Nehemiah Gilyard. He was supposed to be right next to me this game.”

Gilyard died in a single-car crash on Feb. 14. His No. 17 jersey was brought out to the field and placed on the bench at Sal Campanella Stadium. The Bulldogs went on to score 17 points in the first quarter and held on to defeat Mainland 17-13 in the delayed season opener on Sept. 3.

“We made the decision that he was going to play with us in the off-color jersey,” Paxia said.

“Today you saw the gray jersey No. 17 come with us. It stayed on the bench with us.

“His younger brother (Elyjah Gilyard) wears 17. I felt like if somebody was going to get to wear that jersey I thought it should be his little brother. We’re going to carry (Nehemiah’s jersey) every week. It will be our off-color variant for each game.”

Nehemiah Gilyard was a middle linebacker. Dedicating the game to their fallen teammate, the Bulldogs’ defense rose to the occasion. They recorded nine sacks and two interceptions and stopped a potential game-winning drive by the Bucs in the final minutes. Browning had four of the sacks.

“He was a very close childhood friend of mine,” Browning said of Nehemiah. “I grew up playing football with him. (Focusing on him) helped clear my head of all the complex, stupid things. I never tried to antagonize (Roland) or do any showboating in front of him, because that’s not what I was there to do.”

FPC’s Ashton Bracewell had an interception, a couple of sacks and a key pass breakup on the Bucs’ final drive. He started the game at linebacker and moved to safety in the second half.

“We’ve had to use him in multiple positions,” FPC defensive coordinator Brian Cox said. “He’s played outside linebacker, safety.

He played (defensive) end a little bit last year. He just comes in, works hard every single day. He wants to be a great player.”

Roland appreciated Bracewell’s work ethic too. And, despite the loss, he was pleased to see his former player have an impactful game.

“Ashton’s one of the best kids, just personality-wise,” Roland said. “He’s a great person, works hard, lifts weights hard. He used to be really hard on himself, and I told him, ‘Ashton you’ve got a lot of time.’ He’s only a junior. He’s going to be a D-I player.”

The 6-foot-3, 190-pound Bracewell wanted to have a big game in front of his former head coach.

“That was my mentor,” he said.

“When I came in Coach Roland (put) me at DB. Being able to show him what I can do at safety too, that’s what he taught me, so I felt good about it.”

LIGHTS OUT, PART TWO

The stadium lights went out with 3:15 left in the game with Mainland in Bulldogs’ territory at thirdand-nine. Roland remembered the same situation last year when FPC was hosting Madison County.

In that game, the Bulldogs scored the winning touchdown after the lights came back on.

“We ended up winning the game on that last drive. I thought the same thing was going to happen again,” he said. “Unfortunately, it didn’t.”

Matanzas cross country runner Zach Spooner set a personal record for the second week in a row, this time on his home course.

Spooner finished second in the boys five-kilometer race with a time of 17:09.77 at the Run Matanzas Invitational on Sept. 4.

“I was running alone. There was no one around me,” said Spooner, who finished nine seconds ahead of Liam Griffiths of Orlando Bishop Moore and about 44 seconds behind winner Royce Eggert of Orange City University, who handily won the race with a time of 16:35.6.

“It’s a little less stressful, but you run slower so it’s a little less stressful,” Spooner said of running by himself for most of the race.

Matanzas senior Hunter Smith finished eighth with a time of 18:03.49, one spot ahead of teammate Andrew Hatten at 18:04.66.

Jaden Smith (19:22.66) finished 20th.

University won the boys’ title with 41 points, followed by Bishop Moore (42) and Matanzas (61).

We’ve just got to capitalize on them. That’s a really good football team we played. I knew what kind of team I left. I left a really good football team. They run the ball well. They’ve got a really good scheme. If they can run the ball, they’re going to make some noise.”

Mainland hosts Spruce Creek on Sept. 10 and then opens district play on Sept. 17 against last year’s Class 6A state runner-up, Lake Minneola.

Doug Berryhill was optimistic about the community. Occasionally, he would hear complaints about people in Palm Coast, but Doug and Kyle would say to each other, “Who are these ‘bad people’? We just meet the best families over and over again, people who love their kids, who are trying hard, kids who just bring joy to your day,” Kyle Berryhill recalled.

“You get attached to the kids,” Doug Berryhill said in a 2018 interview with the Palm Coast Observer. “It’s more than winning or losing. There’s always another game to play, always another game to win, always another game to lose, but we do this for the relationships.”

Indeed, one star player named Ben Apfelbach said of Berryhill after a season ended, “He’s taught me so much. Leaving him is like leaving a family member.”

According to his obituary published by Clymer Funeral Home & Cremations, he is survived by his sons, James Kyle Berryhill and his wife, Danielle; Trevor Scott Berryhill, and his wife, Kristi; Brooks Kendall Berryhill, and his wife, Jessica; his six grandchildren; three siblings; and the mother of his children, Deborah Berryhill.

He himself was a proud and loving grandparent, according to Facebook posts from his children.

One of Berryhill’s sons, Kyle, who is now the interim fire chief for the Palm Coast Fire Department, said in a Sept. 2 phone call with the Palm Coast Observer that his experience was like others who had Doug Berryhill has a coach: “I learned how to work on the baseball field, how to compete, how to deal with disappointment, how to handle success.”

New coach, new foundation Flagler Palm Coast volleyball is ‘taking lumps’ early with young, inexperienced squad.

When Anthony Favors took over the Flagler Palm Coast High School volleyball team this year, the first thing he noticed was there are no volleyball banners in the gym.

He would like to change that, but first he has to build his program from the ground up.

The Bulldogs lost eight seniors to graduation last year and returned only a few players with varsity experience.

“The whole program is super young,” Favors said. “A lot of these players have not seen action at this level before. There’s no substitute for experience, and we’re taking our lumps right now.”

FPC was swept in its first two matches by Fleming Island and Seabreeze. They’re learning as they go.

“This is a totally different team from last year,” said sophomore Lily Purtis. “We’re not used to playing together.”

Purtis and senior setter Emma Laupepa are trying to help ease the transition. Purtis, particularly, has a heavy load as a sixrotation player, playing in both the front and back rows.

“She passes and hits,” Favors said. “But you become everyone’s

target. Most of the serves go to her. Teams are going to go after your best player.”

Purtis said she is accustomed to the role.

“It’s not new for me,” she said.

“Volleyball is my life. I’ve been playing it since I was 11.”

Favors hopes Purtis and other young players can help help form a foundation as he establishes a culture and tries to take FPC to new heights.

“Lily is carrying a big weight right now,” Favors said. “She could become the best player this program has ever seen.”

Council approves apartment complex in 3-2 vote

A vacant plot of land on Old Kings Road may become a 246-unit apartment complex.

The Palm Coast City Council approved a rezoning necessary for the proposed complex in a 3-2 vote on Sept. 7, with council members Eddie Branquinho and Victor Barbosa dissenting.

The council had been divided 2-2 on the proposed complex at a previous meeting while Councilman Ed Danko was absent, quarantining due to COVID-19 exposure. Danko was back on Sept. 7 and cast the tie-breaking vote in favor of the development.

The proposed complex would consist of “higher-end apartments” on a 22-acre parcel on the eastern side of Old Kings Road about a third of a mile north of State Road 100, and the council’s decision Sept. 7 allows one portion of the property to be rezoned from a current commercial designation to multifamily residential.

Of the 246 homes, 240 will

be apartment units in three- or four-story buildings, while the remaining six will be “carriage homes” similar to townhouses.

Project manager Charlie Faulkner, in a presentation to the City Council, said the location is perfect for a multifamily development. “The location, very simply, is the very best location in the entire county,” he said.

He said that there would be transportation opportunities in every direction for the development’s residents, and that neighboring properties are zoned commercial. The new residential development, he said, will provide potential customers for those commercial developments.

“This project will actually raise the value and the marketability of that commercial property surrounding it,” he said.

The development’s opponents on the council, Barbosa and Branquinho, hadn’t challenged the development’s quality or noted any reasons that it would be at odds with the city’s Comprehensive Plan or Future Land Use Map. Instead, they’d objected broadly to the rezoning of commercial property as residential property: Barbosa said the city’s tax base is already weighted too heavily toward residents and that the city needs more businesses to even it out, while Branquinho expressed concern that the city is becoming

overdeveloped.

“My problems is [the] density, that’s the only problem I have,” Branquinho said.

But City Attorney Bill Reischmann warned the council that, under the law, it could deny the proposed rezoning only narrow legalistic grounds: It would have to be able to show that the proposal was at odds with the city’s codes.

City Councilman Nick Klufas noted that the developer, at the Sept. 7 meeting, had brought a court stenographer who was busily recording the council’s discussion.

Klufas added that the developer already has a successful development in Palm Coast — the nearby Tuscan Reserve. When residents complain about development, he said, they’re generally saying they don’t want it in their backyard.

“This is not in anybody’s backyard,” Klufas said. “It’s just not going to impact too many people.”

Several residents, during the meeting’s public comment period, said they opposed the development, saying they thought that more residential development would overtax the city’s infrastructure or schools.

Developers pay impact fees to offset those impacts.

One resident, the real estate writer Toby Tobin, said the city needs more multifamily housing.

“We’re at full capacity in every different housing market. ...

Nothing is available,” he said.

He noted that ITT’s original vision for Palm Coast suggested a housing stock that would be almost half multifamily. The current housing stock is about 9% multifamily.

“We are way out of balance with the original ITT plan,” he said. “I support this project wholeheartedly.”

Branquinho agreed with Tobin that people are trying to move to Palm Coast.

“They’re coming, no doubt about it,” he said. “But we have the power to say how fast. ... I’m in absolutely no rush to let it grow that fast. I love the way Palm Coast was; I still love it.”

Mayor David Alfin reminded the council that, in accordance with a new state law, the city had just, at that very meeting, incorporated into its Land Development Code a statement supporting property rights.

After the 3-2 vote, Branquinho proposed a six-month moratorium on residential development, suggesting the council take that time to discuss what the city’s future should look like.

Other council members didn’t express support for a moratorium, but Mayor David Alfin said he’d be willing to review the city’s Future Land Use Map.
