Christopher Clover has been writing about Marbella property for 49 years. odern day Marbella began in the mid-1940s with the arrival of the charismatic Ricardo Soriano Sholtz von Hermensdorff, Marquis of Ivanrey followed Ricardo Soriano
by his nephew Prince Alfonso von Hohenlohe and his father, Prince Maximilian Egon von Hohenlohe-Langenburg, and their role in the building and opening of the Marbella Club Hotel in the mid-50s. They were influential in creating one of the very first models of “residential tourism”, which is defined as tourism based on the purchase of a second or retirement home. Due to the affluence and vastly increased mobility of modern society, residential tourism, as pioneered by Marbella and other Spanish coastal areas in the 1950s, has now become a worldwide phenomenon.
Thanks in large part to the vision of Don Ricardo and Prince Alfonso, along with the leadership of many influential people they invited to Marbella during those years, and of many other personalities that followed, right up until today, Marbella has been incredibly fortunate to remain a low density, low rise, high quality jewel on the Mediterranean, unlike the overbuilding prevalent to the east of Marbella and in many other coastal destinations.1 Due to its incredible climate in the southernmost point of Europe, added to the care taken in its development over the years, Marbella, with its 12-month season, is unique on the entire Mediterranean coast, in contrast to other resort cities which close down at the beginning of autumn and gradually come back to life in the spring. Even in the middle of the winter, Marbella still buzzes with activity and events of all types due to its winter population of at least 300,000 inhabitants, between the official and the “floating” unregistered residents.
Consistent pace of development and a focus on high-quality properties Over the last years, since the market began to recover in 2012, the greater Marbella area (including Estepona-East and Benahavís) is now seeing hundreds of new properties being built with an emphasis on modern design, most with state-of-the-art installations, including intelligent home systems that allow absolute

control of the entire home by just pressing a button, even remotely. In the most consolidated residential areas, there are hundreds of properties that were built at least 20 years ago, and are now being completely refurbished to the highest standards to satisfy the requirements of the current market. The key word now is quality, and never before has Marbella seen such a wide variety and choice of high quality properties available for sale. The greater Marbella area is in the process of fulfilling every expectation of measured, quality, sustainable real estate development along with substantial modernisation and improvement of infrastructure and services. The result is the increasing popularity of this unique area as a true oasis for year-round residential tourism that caters to the more sophisticated and discerning lifestyle needs of today’s buyer, as well as to the classic tourist that stays in hotels

and rented accommodation. Over the following pages we will analyse in depth the state of the real estate market in this area today.
In 2018 overall residential sales in Spain matched only 2008 levels, while the number of foreign buyers broke records On a national level, according to the Ministry of Public Works and based on the figures of the National Institute of Statistics, 2018 ended with the best results of the last ten years, with 557,919 residential properties sold (not including public housing sales) of which 50,875 were newly built properties and 507,044 sales of resale properties.2 These figures represent an increase of 9.4% over the previous year with a sharp upturn in sales noted in January 2019 (see the graphs on the following page). Spain approved projects for the construction of 100,723 new units, the highest figure since 2009 but still far from the 865,000 in the pre-crisis year of 2006.3
is undergoing a moderate and sustained increase…which leads us to believe that this tendency will last, at least, for the first half of 2019”.5
The Land Registry reports that 12.64% of the buyers in 2018 came from outside of Spain, led once again by the UK, representing 15.54% of the total number of foreign buyers who bought twice as many properties purchased by either Germans or French, second and third respectively. 4
Other professionals were less reserved in their assessment: the most important real estate investment trusts (SOCIMIs), including Merlin y Colonial (quoted on the Madrid Stock Exchange) and the national property developers Neinor, Aedas, Metrovacesa and Vía Célere, are all in agreement that “the foundations of the market are solid and there is excellent potential for growth in the next two or three years, even though more moderately now than in the past five years”.6
(Note: there is a slight variation between Land Registry statistics and that of the National Institute of Statistics due to the time difference between signing the deeds and the registration of them.) Real estate expert José María Basañez, CEO of TecniTasa, (one of the largest valuation companies in Spain) is confident in a stable growth of the Spanish property market. He recently stated that “the real estate market

nationals are the top ranking foreign buyers in Andalucía by a large margin of 21.4%, followed by the Swedes with 11.6%, and the Belgians in third place with 8.11%. In the Balearics, for example, the leading nationality was the Germans at 37%, followed by the British at 15% and the Italians at 7%.7

The greater Marbella area’s real estate market is about two years ahead of the national market and consequently slightly more mature. For example, on a national level, residential sales volume in 2018 has only now reached the crisis level of 2008, whereas the sales volume in the greater Marbella area is now higher than the peak boom years of 2006 and 2007 as indicated in the charts on the next page.

The statistics only show the numbers of properties sold, as per the title deeds issued at the notaries, and don’t reflect the hundreds of sales of properties under construction or offplan. It is interesting to note that the greater Marbella area sales volume has remained on about the same level for the last five years, showing a stable market which is in the process of consolidating with none of the signs of overheating as before.

Brexit Impact As shown by the statistics given at the beginning of this article, the British market is by far the most important single foreign market, and even more so in the province of MĂĄlaga. Since the Brexit vote in June 2016, there has been a decrease in the percentage of British buyers compared to other nationalities from 21.34% in 2015 to 15.54% in 2018, whilst the actual number of British citizens buying property since the year before the Brexit vote has increased (9,116 sales in 2015 compared to 10,166 sales in 2018).9 Whereas the overall market increased by 39.76% from 2015 to 2018, the British market only increased 12%.

There is little doubt that the British market will remain the most important single foreign market for purchasing property in Spain and in the Marbella area in the foreseeable future
• The strength of the UK market will, in great part, be related to the strength of the UK economy and of course, to the pound sterling. In this sense if there is a “hard Brexit” scenario without agreement, the British economy is going to be more severely affected and consequently the British market. • The British market share that is more likely to be affected is the market priced under €800,000. Surprisingly, rather than relinquishing their dream of joining the incredible lifestyle on offer due to the drop in value of the pound, it would appear that more budget-conscious UK citizens are simply tightening their belts and buying less expensive properties, or buying cheaper properties to
refurbish or obtaining mortgages at what still are historically low interest rates. • As in any other sector, those with higher budgets will be less affected. Indeed, a good number of the most expensive property sales in 2018 were made to British nationals, many of whom were already residents outside the UK. At the same time, we believe that other issues that are causing uncertainty (i.e. pensions, health care, residency) will all be acceptably resolved, albeit a lot easier if there is a Brexit deal, and with more difficulty without one. Spain has already announced that if there is no Brexit deal, British residents will be allowed to maintain their Spanish residency until at least December 2020.10

• Finally, just as uncertainty of any type affects markets anywhere, so uncertainty generated by Brexit is postponing some people’s plans to purchase second homes.
Property Prices Nationally, in 2018 residential property prices rose an average of 6.7%, the largest increase since 2007 and the fifth consecutive year of increases. Notwithstanding, prices have only now reached 2011 levels and have a long way to go before reaching the pre-crisis highs.11 Clearly there are exceptions to the above, in specific high-demand, prime and ultra-prime residential areas throughout the country. As
mentioned previously, sales volume in the greater Marbella area now exceeds pre-crisis levels, but in the locations with highest demand, prices now also exceed pre-crisis levels simply because demand is now greater than supply. In Marbella, for example, beachside properties on the Golden Mile, especially around Puente Romano, and other specific, highly desirable locations, both east and west of the city, have reached record prices. Hard evidence shows that the average prices in the greater Marbella area have not yet reached pre-crisis highs, as illustrated in the above graph, based on price statistics from the Spanish Ministry of Housing.

Resale asking prices sometimes overly-optimistic Due in part to the historical lack of reliable statistics in Spain with respect to real sales prices, many owners place their properties on the market at prices which are overly optimistic. Some have gone too far, pricing their properties at a level that doesn’t even entice viewings. Consequently, their properties are not even reaching the market place. This is not unusual in this market and eventually with time, those asking too much will have to accept the reality that the market is good, but not that good!
New developments being sold offplan or under construction Fausto Martinez, CEO of FM Consulting, specialises in the promotion of new residential developments and has distinguished himself as a top professional for the quality of his work over almost three decades. In recognition, he was awarded, in November 2018, the prize for
“Clients looking for a new property find so many they are not able to view them all” Outstanding Businessperson by the prestigious Centro de Iniciativos Turísticas (CIT) of Marbella, a local association of business people and professionals with approximately 500 members. Fausto notes a slight decrease in visits to the new developments: “In recent months we’ve noticed a lessening in the number of visits to the new developments we are promoting which is clearly due to the increased number of new projects currently available on the market on the Costa. Clients looking for a new property today find an immense range and variety of new developments on offer; so many that they are not able to view all of them.”

Clearly, with more projects being built, and with approximately the same number of potential buyers to spread amongst them, some will sell better than others. Therefore it’s more important than ever for buyers to use very knowledgeable and experienced agents to guide them from development to development and help them discern among the many products on offer. So many new projects are beginning to create a very competitive marketplace which is always an advantage for buyers. As always, it is those projects which are in the best locations, with the best design, quality of finishes and most competitive in prices which will be most successful in selling. The above chart, compiled by Panorama, is illustrative of the numbers of new projects, of units being built, sold or reserved and those which remain to sell. These numbers include only major property developments and do not include hundreds of individual properties which have been or are being refurbished, new individual villas under construction, or dozens of small developments of less than 10 units for sale. The numbers are significant in that they reflect the boom of new projects in Estepona, a healthy increase in Benahavís, and a slower development in Marbella, the latter due in part to the continued delays in the granting of
building licenses by the Town Hall (even though the time required has improved significantly), and also due to the shortage of prime fullyzoned development sites under Marbella’s current General or Master Plan. In 2018 the Málaga Architects’ Association (Colegio de Arquitectos) approved projects representing 1,107 residential units to be built in Estepona, compared with 800 the year before, according to the statistics published on January 19th by the association. In Marbella, there were projects approved for the building of 587 properties compared with 252 the year before.12 It is likely that we will see new large scale building projects starting to materialise at a slower rate now that the best building sites have already been sold, and prices for the few good building sites left are increasing. Building costs are also increasing substantially partially due to the shortages, once again, of skilled labour and certain building materials.
Marbella market indicators13 To give an idea of recent sales activity in Marbella itself, ultra-prime areas continue to lead the market and prices are reaching alltime highs. Recently a small, refurbished villa near the Marbella Club sold for €6,350,000 or €18,000/m². A well-located second line

Marina Puente Romano is a top location for property investors
apartment in Marina Puente Romano in its original, well-kept condition, sold in the summer of 2018 for €1,750,000 or about €11,000/m² and has been recently totally refurbished to the highest possible standards and placed back on the market at the end of March 2019 at €3,000,000 or about €19,000/ m². This somewhat daring “rebranding” may appear excessive to some but it serves to show the extremely high level of confidence that the most professional investors have in the very best locations where there is a low supply of properties available for sale. During the last year there have been at least 65 properties sold with prices greater than four million euros in accordance with a survey we have conducted. The vast majority of these transactions took place within Marbella and Benahavís and at least six of them took place within La Zagaleta, perhaps one of the most exclusive residential country clubs in Europe, where sales are increasing. Resale apartments: In the most consolidated areas on the Golden Mile, refurbished apartments and townhouses located mountain side of the main highway, some of which are walking distance to the beach and Puente 14

In Nueva Andalucía, similar prices in the area of €3,800/m² were achieved for fully furnished apartments. Prices will of course vary in accordance with location, views, age and services provided in the building/complex. Brand-new and fully refurbished apartments and townhouses: in Nueva Andalucía prices ranged from €2,700 to €5,600/m². On the beachside of the Golden Mile and Puerto Banús, prices achieved were sometimes double or even triple the above values with selling prices ranging from €7,000 to €15,000/ m². Obviously, beachfront properties attain a much higher premium for the location and the uninterrupted views.

Resale villas: villas that were built more than 10 years ago and kept in their original condition achieved selling prices ranging from €2,800 to €4,000/m² in Nueva Andalucía. For beachside villas in San Pedro de Alcántara, an area which has recently become very popular since the completion of the boulevard, achieved prices in the range of €3,000 to €4,000/m². In consolidated areas on the mountain side of the Golden Mile, such as Las Lomas de Marbella Club, villas reached a selling price of €5,000/ m², whereas on the beachside, prices achieved ranged from €7,000 up to €18,000/m² for those villas close to ultra-prime locations such as the Marbella Club and Puente Romano.
Brand-new and fully refurbished villas: on the Golden Mile mountain side new villas achieved selling prices up to €6,500/m² compared to up to €25,000/m² on the beach side. In Nueva Andalucía prices for new-build villas ranged upwards from €5,400/m² mountain side, to €12,500/m² beach front near Puerto Banús. In Estepona, new-build villa prices ranged from at least €3,000/m² mountain side, to €8,000/m² beach front. Building licences issued in half the time compared to a year ago
The number of new building permits that have been issued in Marbella has doubled between September 2017 and August 2018 Agents are unanimously reporting 2018 to have been “a good year”, with some typical slowdown in the autumn as the statistics themselves reflect. But 2019 has started with a strong spurt in activity in the first quarter, lending optimism that this year has every potential of surpassing the last year in sales volume.
A major recent problem in Marbella was the exasperating long delays in the issuance of building licences by the local Planning Department. This situation caused frustration for those applying for building licences in Marbella which drove many investors or developers to buy land in Estepona or Benahavís where the local planning departments are more agile. However, the good news is that this critical problem in Marbella is being solved, and the backlog of building permits pending approval has already been reduced substantially. According to the Mayoress of Marbella, Mª Ángeles Muñoz Uriol, and her team, the number of new building permits issued has doubled between September 2017 and August 2018, and minor works licences have increased by 30% over the same period.14 In 2015, when Spain’s Supreme Court invalidated the General Plan of Marbella of 2010, the previous city plan of 1986 came back into effect by default. The plan of 1986 had not been adapted to the later Regional Plan (known as the LOUA, Ley de Ordenación Urbanística de Andalucía), and prevented the Town Hall from approving any planning modifications. Consequently, the adaptation of the 1986 plan to the LOUA was a top priority for the Town Hall. Since the approval of the adaptation in July 2018, the Town Hall has initiated multiple modifications to the city plan of 1986 that will finally enable the granting of building licences for many new public facilities and private development projects.15

Drones are now helping with planning inspections
Even though the time of issuance of building licences has been reduced from a year and a half to approximately ten months, the goal of the Planning Department is to reduce this period again by more than half, to four months. Three specific steps were announced by the Mayoress on 14 March 2019.16 1) Consolidated urban areas prioritized. New protocols were adapted to expedite the issuance of building permits in fully consolidated areas. The old system of dealing with licence requests “first come, first serve”, has been changed so that the building licences that are requested for building in consolidated urban areas with no zoning issues and fully compliant with the General Plan will be separated from the others and dealt with in an accelerated manner by a separate team in the Planning Department. 2) Architects’ Association to pre-study technical elements of a project. An agreement has been reached between the Town Hall and the Architects’ Association of Málaga, where the Association will issue a technical planning compliance report upon request, which will thereby reduce the time needed for the review of the project by the local Planning Department. 3) Larger planning team. In 2018 the Planning Department added several new members to their team to accelerate the backlog of work and the time in which building licences are granted.17 The size of this team will be increased once again by five more architects, a similar number of lawyers, and three engineers.
Other news from the Planning Department: • Drones to help with inspections. In February 2019 the Marbella police force purchased drones to help expedite inspections of the area, which was also requested by other municipal departments, including the Planning Department.18 • Director of Planning in Marbella moved to same post in the Junta de Andalucía (the Regional Government). In February 2019, José María Morente, Director of the Marbella Planning Department, was appointed Director of the Planning Department for the Junta. He was instrumental, together with local councilor Ms. Caracuel, for the above-described improvements in the Planning Department of Marbella. This is excellent news, as few people know Marbella planning matters better than he does, and this will no doubt greatly facilitate the contact between the Town Hall and the Regional Government with respect to those planning issues which are ultimately dependent on the Junta.19

In February 2019, three tenders were submitted by major architectural firms for the drafting of a new General City Plan for Marbella. The winning candidate is expected to be selected before the month of June, and a draft of the plan should be ready for preview before the end of the year. The document’s final approval, however, is not expected to be done until the end of 2021 at the earliest, when the current problems in different areas of the municipality will be resolved in the context of the new plan, putting the chaotic past history of planning permission problems squarely behind us.
2019 Municipal budget increased The Marbella municipal budget was increased by 15%, that is to say to a total of €283 million, with investments in improvements and infrastructure increasing by 50% to €30 million.20 Within this budget, and among many other specific actions taken throughout the municipality, a program to begin the renewal of urban infrastructure, especially of the older urbanizations, was recently announced in March, 2019. 21
Benahavís approves General Plan for its municipality Other interesting news which will affect the future of the area is that Benahavís approved its new General Plan in 2018, with zoning in specific areas allowing for the construction of an additional 2,000 homes.
Rentals market is booming According to a recent report of the national property valuation company TecniTasa, Marbella occupies the third position of the “Top 5” of the Spanish cities with the highest residential rental prices, with a price of €22/m². 22 In our own experience the average longterm rental price is €10-15/m² in non-prime residential areas, €20-25m² in prime residential areas and up to €35/m² in ultra-prime areas. As always, the price depends on multiple factors including especially the location, community services, quality of the finishes and the quality of the furnishings. Marbella has become so sought-after for rentals, that it’s increasingly hard to find reasonably priced properties, particularly for those who come to Marbella to work and cannot afford the higher prices that have taken hold in recent years. location on the coast for employment which has given rise to an increase in commuters from other coastal and inland towns where rentals are more affordable. The more affluent market continues to drive the demand for medium to high quality and luxury category properties against less supply than in previous years, which has sparked a sharp increase in the cost of renting a high calibre apartment or villa. Added to this mix, the holiday rental market sees properties in the best areas booked months in advance for the coming summer season. Such is the popularity of Marbella, that the rentals market can count on repeat clients year after year which undoubtedly has caused the lack of supply of long-term rentals due to the tempting returns of the summer months.
More control of rentals by government and tax office Since the law was passed by the Junta de Andalucía in 2016, short-term rental properties (up to two months) in Andalucía must now be registered for that purpose. The compliance procedure is not complicated and it can be easily handled by a solicitor.
Further rental protections to tenants were passed into legislation by the government in March 2019, including providing an extension to the maximum length of time a compliant tenant can stay in a rental property on a long term lease (now extended to 5 years), as well as several other measures. The tax office has also imposed controls to tighten the noose around those property owners renting their properties and not declaring the rent to the tax office. Compliance, as always, is highly recommended, and a qualified tax advisor will be able to help a property owner through these steps.
Tourism reaches record numbers in Spain for sixth consecutive year In any area where residential tourism has developed over the years, real estate sales are intimately related to the number of classic tourists staying in hotels or in touristic accommodation. This is especially true in Marbella, given the high quality of tourists attracted to the area and its world-famous lifestyle, many of whom fall in love with this area and decide to buy a part-time or even full-time residence here, just as tens of thousands of people have done since the 1950s.

Spain has set a new record of 82.6 million international visitors in 2018, a little less than one percent increase over 2017, representing an impressive increase of 43.7% since 2012. There was an accompanying increase in tourist expenditure of 3.1%, a figure approximating €90 billion.23 For the second year running Spain has surpassed the United States in international visitors, and is the second most visited country in the world behind France. hristopher’s grandfather, Burtt Byron Clover, was one of the first golf course developers in the United States, and a developer of single family homes in Chicago. In 1904, after having worked for four years with W.A. Marigold and Company as manager of their real estate agency, he founded B.B. Clover and Company, a real estate and property development company headquartered on Evanston Avenue in Chicago. B.B. Clover began building and selling single family homes in and around the village of Itasca in the Chicago suburbs, and opened a branch office there to help promote his developments. He transformed Itasca into a highly desirable place to live and enjoy a comfortable suburban lifestyle, catalysing a small population explosion which the town enjoyed during the 1920’s and 30’s. One of B.B. Clover’s first and major contributions to Itasca was a golf course and a clubhouse built on the land originally owned by the first Burtt Byron Clover in 1925

Panorama International was the first company to offer international properties and developments to investors in the United States. The company distinguished itself by selling second and retirement homes in Mexico, the Caribbean, France, Morocco, and most notably Spain. It established the first international real estate office in Marbella in 1970 and shortly thereafter, offices in Mexico City and Mallorca. At that time Marbella was in the early stages of establishing itself as a quality resort destination. After graduation he taught French at the Landon School in Bethesda, Maryland for two years, before joining his father and brother (Williston H. Clover) at Panorama International in Washington DC in 1971. Armed with a strong linguistic background and after gaining extensive experience in marketing and sales with Panorama’s Washington office, Chris arrived in Spain in February 1973 on his 26th birthday, taking charge of Panorama International’s Marbella office, which at that time mostly served to receive the clients sent to it from the United States. In that same year, and with the wholehearted support of his father, Chris expanded the Spanish office to concentrate on the listing and sale of prestige properties in the Marbella area to an international market. Finding & Buying A PROPERTY By Christopher Clover PANORAMA ALWAYS RECOMMENDS that purchasers of property in Spain retain a qualified solicitor to represent and and also advise them on all tax issues. he Internet has become by far the most useful tool for those looking to buy properties and a net-based property search is usually the first step taken by any potential buyer. But, is it the right second step, once one sees a few desirable properties on several sites, to contact and make appointments with all the agents offering those properties, agents you don’t know or may not have even heard anything about, some of whom do not even identify themselves correctly on their sites? Perhaps another option to consider, even while looking at everything on the net, might be to seek out as a first priority a really qualified, experienced agency to work with that has a large direct inventory of the kind of property you are looking for. There are several great agents in Marbella to choose from, many who have outstanding credentials, long experience, excellent product and area knowledge, and adhere strictly to the agents’ code of ethics. Additionally, choosing such an agent will assure that they pull out all the stops to spend plenty of time with you to get to know you and your special requirements as well as possible, sharing with you their market knowledge and recent comparable sales actually made, and who will eventually find just the right property for you. If it’s not in their own inventory they will go

out and find that special property through their colleagues in other agencies on a commissionsharing basis.
Choosing a lawyer Panorama always recommends that purchasers of property in Spain retain a qualified solicitor to represent them and and also advise them on all tax issues. Once you have made a decision to purchase property here, even though you may not have found that special property yet, establishing a relationship while you are in Marbella can be immensely useful if you start negotiating a purchase after returning to your country of residence, as it is clearly more difficult to choose a lawyer long distance. Essential today to buying property in Spain is the compliance with AML (anti-money laundering) protocol, required for opening a bank account, engaging a lawyer, and agents as well, in order to identify you and prove the legal origin of the funds intended for the purchase. For European Union citizens this procedure is straightforward in most cases, but for Eastern European citizens or those from the Middle East the procedure can take, in some cases, many weeks. So, if you know you are going to be eventually buying a property it is good to get these matters out of the way sooner than later.

Getting the basics into place Having a lawyer, NIE number (a number issued to foreigners in Spain) in place, AML compliance in order, and bank account opened strengthens a buyer’s position when negotiating as he or she can put down an immediate deposit if an offer is accepted, since all the other details will have been taken care of already.
Negotiating a purchase A good agent will also be immensely helpful to you in negotiating the purchase of a property you are interested in buying. It is important to remember that if your offer is too low it will not engage the interest of the seller, and might actually prove counter-productive. An articulate offer will generally capture the attention of a vendor. We recommend getting all your points together, rather than negotiating “piecemeal.” Make your offer in writing if possible (of course, subject to contract). Points to include are not only the price, but also the deposit amount and when you are prepared to pay it, when you are prepared to complete the transaction, what you understand to be included 42
in the price (for example furniture and fittings if applicable), and an often neglected point – that all technical equipment and installations should be in good working order. Also, if you have a second choice property you should certainly advise the vendor of this fact. Your lawyer can also be consulted during the negotiation to ensure that the terms of the offer meets his or her legal criteria, and on occasion will also become actively involved in more complex negotiations.
The purchasing process Actually purchasing a property in Spain is a relatively straightforward procedure. The “last word” in property ownership is the property registry, which will show immediately if the seller owns the property free of liens and encumbrances. Most frequently, unless an immediate payment of the full purchase price is made, a private contract of purchase is drawn up wherein the details of the purchase are reflected – the legal description of the property, purchase price, form of payment, date of completion, date of possession, etc. Upon signing the private

contract, a payment on account is always made which can vary substantially according to the terms of the sale and the date of completion.
Deposit and insurance A quite normal deposit for completion within 30 to 60 days would be 10% of the agreed purchase price. New properties which are unfinished obviously are paid for over the construction period, and all payments on account before finishing must be guaranteed, according to LAW 38/1999, by a bank or insurance company: if the property is not finished by a certain date, a purchaser has the right to reclaim the monies paid, plus legal interests. Additionally, another law obliges the property developer to arrange a ten year insurance policy with respect to any
basic building defects with the purchasers as beneficiaries.
The escritura When the entire purchase price is paid for the property, the seller will issue the public deed of conveyance (escritura) to the purchaser, free of liens and encumbrances. This deed is issued before a Spanish Notary, is passed from the notary to the tax office to be assessed for Transfer Tax if the property is a resale or second hand property, or assessed for Stamp Duty if the property is sold directly by the developer. It’s then presented to the Property Registry for inscription. A provisional inscription in the registry is made immediately upon issuance of the deeds. >>

his brief article is intended to share some essential points about selling properties, based on our own experience of almost 50 years.
to sell, though in our experience this is considerably shorter where both buyer and seller are serious in their intent.
Marbella is not a big city like London, Madrid or New York with a captive market within 50 kilometres of the centre. Instead, it’s a small city with a mostly secondary housing market and a buying public spread out all over Europe and the world – a subtle but important nuance.
The most important thing to establish is a ‘sales strategy’, at the heart of which is the asking price. In other words, if you ask too much for your property, people will not bother to view and it will linger unseen. Ask too little for your property, and you are potentially throwing away money.
Most buyers are not looking for a primary residence here, but a second or even a third home. This makes Marbella real estate less of a need and more of a luxury in which people are not drawn to property close to centres of work but to the quality of life a property can offer them. As a result, one characteristic of a secondary housing market is that especially luxurious properties can take a longer time 46
Establishing an asking price
The right asking price is perhaps the most essential ingredient in the art of selling real estate and is the result of thorough market research. Do not opt for the figure you would like to hear, find out the true market value, taking into consideration: what sales of comparable properties have been accomplished, and at what price? What are other owners with similar properties asking?

The more unique a property, the more an owner can ask for it and the stronger they can negotiate when trying to seal a deal. The less unique a property, the more the owners are going to have to resign themselves to the fact that there is a large supply of similar properties, and that they will have to price it competitively.
Avoid quoting a ‘net’ price One thing to avoid, if you intend to use agents to market your property, is listing on a net basis, where you want a fixed sum with the agent’s commission added on top. You can end up with a property marketed at several different prices, leading to confusion among potential buyers. Wise sellers will form a team with their agents and protect their agents’ commission, as they too expect to be protected and advised by their agents, and fix one sole asking price for the property, inclusive of commission.

Should you give an exclusive sales agreement to an agent? If you are an absentee owner, or if you don’t feel like playing a co-ordination role among various agents, granting exclusivity to a leading agent can make your life a lot easier. It also provides the agency in question with the confidence to fully dedicate its energy and resources to the marketing and promotion of the property.
Providing agents you trust with easy access to the home is important in order not to lose potential buyers, though a good agent will screen interested parties first. They will also offer advice on how best to present the property for viewings and approach the negotiation process.
A professional agency will propose a coordinated strategy based on its experience and adapted to the specifics of your property. This will include the creation of quality marketing material and targeted promotional campaigns. A responsible agent will try to avoid taking a sole agency unless he sincerely feels that the asking price is correct and that he or she is truly capable of selling the property within the time
Commission Rates The standard agency fee in a resort area such as Marbella is 5% plus VAT, which covers the marketing, promotion, and listing of properties and the arranging of viewings, follow-up with prospective buyers, property searches, providing background information and support throughout the buying process and beyond. Agents don’t give keys out to clients, they always show properties personally and will spend a great deal of time to find the right buyer.

FREQUENT COMMMENTS BY SELLERS “My property has been on the market for months and I’m hardly getting any viewings.” The only times this might be considered to be normal is if your property would only be of interest to a small crosssection of buyers – or if it is overpriced. If neither applies your property is not getting enough market exposure. Our advice: speak to your agent or seek the advice of another well-established agency with a good reputation. An accurately priced and marketed property should be getting a regular stream of clients viewing it.
“All the clients that agents bring to my property are time-wasters.” Are they really? If you are getting lots of viewings and no offers on your property, chances are your property is not as unique as you’d like to think it is. It likely needs to be reduced in price or perhaps you could consider making marketdriven renovations in order to increase its appeal. And always remember, selling a property in many ways is a numbers game. The more people who view it, the better chance there is of one of them falling in love with the property and buying it.
“How much negotiation room should I build into my asking price?” With the help of your agent we recommend pricing the property taking into consideration not only similar asking
prices, but also prices at which similar properties have actually sold. Many buyers are very knowledgeable today and will recognize a realisticallypriced property, but bear in mind that few will want to pay the full asking price, so leave some room for negotiation.
“I really need to sell my property NOW.” If you need to sell your property quickly, you need to be prepared to price it at a heavy discount when compared to similar properties on the market. This is when you need a very knowledgeable agent working for you who can suggest the price that will achieve the sale.
“Selling a property is a numbers game. The more people who view it, the better chance there is of one of them falling in love with the property and buying it.”

OTHER TIPS FOR SELLING YOUR HOME Present your property in its best light First impressions count. When agents take clients to view your property, ensure that curtains and shutters are open to let lots of light flood the property. Check your agent’s website to see how your property is presented, in terms of the photographs, the description and the accuracy of the information provided. While photography should be representative, it should also present your property as well as it can, enthusing potential buyers. To stand out from the crowd you may need professional images, especially indoors. If there are any small repairs or repainting that would enhance the overall appeal of the property, it’s well worth getting this work done 50
now to eliminate any small ‘objection factors’. Also, make sure your home is spotless for photography and viewings alike.
Get your main agent to put up their ‘For Sale’ sign This always results in enquiries. Many potential buyers drive around different residential areas before going to an agent. Without a sign, they wouldn’t know your property is for sale. Not allowing a sign to be placed is to block one of the many proven paths for reaching the market place. Our experience is that signs still help significantly in selling properties.

plays golf three times a week, you are losing a vital chance to show the property at the client’s convenience. Bear in mind that the first properties that agents tend to show are the ones for which they have the keys. Properties that need appointments to be set up in advance will generally be shown less.
Taxes Make sure that you are fully aware of your tax obligations when you put your property on the market. Meet with your lawyer and tax advisor, and find out your options to ensure there are no surprises when you enter into negotiations
Negotiating a sale Let your agent form a team with you in handling negotiations, checking points with your lawyer and tax advisor when necessary. This is your agent’s job and one of the reasons you pay the agency’s fee, and experienced real estate
professionals are generally far better at negotiating the commercial points of a deal than lawyers. Once this is accomplished, your lawyer should take the lead role (in coordination with your agent), draft the sales contract and supervise the completion of the sale. If you are frequently travelling, it can often make sense to leave a Power of Attorney enabling your lawyer to sign a private contract on your written instructions. You can negotiate the details of the sale with your agent by telephone and email, and your lawyer can then take the ‘first step’ towards the sale by signing a private contract without delay.
Points to consider when a negotiation is taking place Is the buyer expecting a counter offer from you or has he or she given you a one-and-only, take-it-or-leave-it offer? Do they have other properties in mind? Is their offer a fair one? Are all details included in the offer – price, target contract date, deposit, completion date, and precise understanding of what is included in the sale in the form of fixtures, fittings and furniture, etc.? All these items should be agreed upon at the outset before lawyers are instructed. Don’t allow yourself to be pressured by your agent or anyone else to accept an offer! A good agent will simply point out your options and offer advice based on his experience, but once you decide to proceed it is good not to waste time and risk losing the buyer. In summary, selling a property can be as easy or as complicated as any task involving one’s personal affairs. Competent, honest, professional help from agents, lawyers and tax advisors can go a long way to help you manage your sale objectively and easily.

he Four Seasons Hotels and Resorts, founded in 1960 with more than 120 hotels and resorts to its name in 47 countries, is one of the most prestigious luxury hotel chains in the world. Spain has been chosen as the location for two new resorts, one in Madrid and one in Marbella. The Four Seasons Resort Marbella is anticipated to open in the first half of 2022, after that of Madrid in late 2019. The whole project represents an investment of close to €650 million, and promises to be the most luxurious, and the largest, project of its type in Andalucía. The site is a fully-zoned tract of land measuring some 300,000 m2 located just east of the city centre, and to the west of the Torre Real neighbourhood. All roads and services are already installed, and the site is located on both sides of the road. The developers are a consortium formed by Miami-based developers Fort Partners, the Belgian property development company Immobel and the Villa Padierna Group, led by Ricardo Arranz de Miguel. The hotel itself will have about 80 rooms and 52
