THE PUBLISHER Dear Reader, Never in our 47 years in Marbella have we witnessed so much activity, and so many people, in Marbella as in the winter months of 2016-2017. It often felt comparable to the number of visitors in the summer season twenty-five or thirty years ago! In this magazine, you will find our Marbella Property Market Report, which we publish annually, an article about Panorama’s first years in Marbella, titled Marbella of the 1970’s (page 20), and feature articles on special homes. In the second half of the magazine, you will find an amazing sample of properties on our books at the time of printing this magazine, followed by our classic articles for buyers and sellers and great aerial maps showing the locations of popular Marbella complexes and neighbourhoods. Due to year-round sales activity we have once again expanded our sales team and also opened a Client Services Department. In reflecting on Panorama’s many years in Marbella, I am proud to head an agency which is not only long-lived, but that has become stronger year after year, and is exceptionally qualified compared to most of our competitors: a Royal Institution of Chartered Surveyors (RICS) qualified agency; an associate of the powerful international agency Savills, with over 700 offices and associated agencies around the world; a highly trained sales and support team speaking 11 languages; probably the best portfolio of properties in the area, all fully documented on our database; and of course a total

adherence to the very highest standards of professionalism. Additionally, I was personally invited to become a RICS Fellow (FRICS) by the Eminent Route in 2015, lending further credentials and strength to our agency. However, at the end of the day, it is the quality of our highly educated sales and support staff and our ability to work together as a team which sets Panorama apart from our competitors and to whom we owe our success: teammates who share on the highest level my family’s values of service and dedication to our profession. Marbella Property MARKET REPORT 2017 By Christopher Clover, FRICS

Christopher Clover has been writing about Marbella property for 47 years. It is fascinating to see yet another property market cycle commencing in Marbella and the Costa del Sol in general, known for decades as the California of Europe. Marbella is unquestionably the most sophisticated city on the Coast and one of the highest quality environments of the entire Mediterranean Basin.

During the following years, most waited year after year for the market to touch the bottom. As a result, a strong bottled-up demand from international buyers developed.

The Market touches bottom in 2011

Residential tourism, that is, tourism based on the purchase and occupancy of second or retirement homes, is one of the many important factors behind the evolution of southern Spain’s most famous stretch of coastline over the last 70 years.

In 2012 and 2013 increasing market activity made it clear that the market had indeed reached its lowest point in 2011, and there was an influx of bargain-seekers rushing to secure properties before prices started to rise. This resulted in a dramatic increase in sales in the subsequent years as reflected in the chart below, with the peak of a 28% increase occurring in 2014 over 2013 sales.

When the bubble burst towards the end of 2007, most buyers were already wary of prices that had become unrealistically high.

This year-on-year increase started to taper off in 2015, reaching only 9.83% in Marbella that year. In 2016, this trend continued and

there was even a decrease in sales volume of 8.97% over the 2015 sales. Taking the three municipalities of Marbella, Estepona and Benahavís together, there was a drop of 5.97% on the official index of number of sales in 2016 compared to 2015. Careful analysis shows that an adjustment in the sales volume after such a deluge of purchases is perfectly normal. Since 2012 most of the distressed properties have been sold even though there remain some excellent bargains in all price categories and most areas. The majority of buyers who had waited so long were finally able to buy confidently at exceptional prices. Now that the dust has settled, the volume of sales has

naturally readjusted to the figures we saw in the pre-crisis years of 2007 as the enclosed graphs illustrate.

Brexit Perhaps the most important factor affecting the property market in the Marbella area and Spain itself in 2016 was Brexit. Many UK nationals took an understandably cautious “wait and see” view, after the unexpected majority vote for Brexit on June 23, 2016. Comparing the fourth quarter figures of 2015 with those of the fourth quarter of 2016 (the full 2016 figures include the half year before Brexit and are therefore not representative), 23.95% of the sales made to foreign citizens in Spain in the last quarter of 2015 were made to citizens of the UK compared to 16.40% in the last quarter of 2016, a decrease of 31.52% which one can fairly attribute to Brexit1. However, interestingly, of the 436,537 properties sold in Spain in 2016, sales to foreigners in 2016 represented 13.25% of the 1

whole, slightly higher than the 13.18% of 2015: the increase of other international buyers in Spain more than compensated for the drop in UK buyers (see the comparative chart opposite). This is just another example of the special strength of a multi-source market that has always been prevalent in Marbella and other resort areas of the world with buyers from many different countries and economies: when the market of one country cools off, others step up to take its place, just as in 2015 when we witnessed a sharp decrease in the Russian market and a simultaneous sharp increase in the British market before Brexit.

Further market observations relative to Brexit: • The drop in the value of the pound sterling, a direct result of Brexit, makes buying property more expensive for those counting their assets in that currency. We are seeing buyers today who can perfectly afford to pay the full price in cash without bank financing who are now reverting to mortgages to hedge the exchange rate issue, as well as to take advantage of historically low interest rates in Spain. • On the other hand, UK vendors are more ready to negotiate their sales price since euros buy more pounds today.

• Health care reciprocity is a concern for some UK citizens thinking of buying Spanish property as well as some who already own properties here who depend upon the public health services. • Clearly the evolution of the UK economy will be a major factor affecting demand for properties in Spain, in particular, with prices under €500,000. • Some UK buyers of larger homes intending to settle here permanently and perhaps run their businesses from their home may delay their purchase, even though many others will proceed with confidence with their plans.

• It is important to note that UK citizens will have exactly the same rights to buy properties in Spain after Brexit as before, and procedure for obtaining residency permits for stays longer than three months will be the same as that which applies to over 1,400,410 other nonEU country citizens with residence permits in Spain2. • In summary, the evidence would suggest that even though citizens from the UK will continue to be the largest single nationality purchasing Spanish and Marbella real estate for the foreseeable future, Brexit will obviously continue to influence the market and numbers of UK buyers will diminish in the short and medium term, compared to prior years.

According to data published on March 8, 2017 by the Spanish Instituto Nacional de Estadisticas, the price of private (unsubsidised) housing rose in Spain by 4.7% on average in 2016, which represents the third consecutive annual increase following six years of decreases and the highest rise since 2007.

Different regions of Spain are attracting different foreign markets. It is interesting to see the summary of nationalities last published in 20153. In Andalucía as a whole, the Swedish market is second to the British, with the Belgian market running third, whereas in the Balearic Islands, for example, the German market is first, the UK market second and the Swedish market is third.

can move in right away, and many are more reluctant to undertake refurbishment of older properties, leaving that job for the many investors who are specializing in that field. Over-optimistic pricing by some vendors of resale properties Now that there is once again a healthy market, even if it is, as in most resort areas, slow compared to big city property markets, an over-optimistic attitude has developed with some vendors of resale properties who have priced their properties at such a level that they are not enticing potential buyers even to view them. Consequently, their properties may not be reaching the market place. Sellers who really want to sell within a realistic time frame are seeking out

qualified agents who will provide real market comparables, either for sale or already sold and work together to establish a realistic asking price of their property along with a sensible marketing strategy. See our article with tips for vendors on page 182 of this magazine. New property developments After the virtual absence of new developments since the middle of the last decade, savvy developers started snapping up prime development land in 2012 and 2013 and quickly applied for their building licenses, resulting in hundreds of new properties, in many different projects, being sold off plan or under construction and already “sold out” in 2015, 2016, and the first part of 2017. To put an approximate number to the above, and help gauge sales activity of new builds, Panorama surveyed 20 new developments in Marbella and adjacent municipalities comprising apartments, townhouses, or groups of villas, that were under construction and have either sold out or have phases which have been sold out, in the years 2015, 2016 and early 2017. 705 units were reported as sold at prices ranging from €156,000 to €2,500,000. This figure does not include the sale of dozens of newly built or renovated individual villas under construction or remodeled during these years. In addition to those properties, we have compiled a list (intended only to be indicative of trends and not all-inclusive) of 53 new developments in Marbella, Estepona, Benahavís and Ojén which are for sale as of April 2017 and either being sold off-plan, under construction or completed. These new projects offer properties in the price range of €199,000 to €3,800,000 and represent a total of 1,944 properties, many of which are already under contract for sale.

If one adds new projects in Mijas, Fuengirola and Benalmádena, the figure jumps to 77 new developments and 2,626 properties with prices starting from €167,000. Scrapping of the 2010 General Plan The annulment of the 2010 General Plan and reversion to the old 1986 General Plan (PGOU) has certainly influenced the Marbella property market. Among the many repercussions has been a reduction of development land and single family plots qualified for building, even though there is still land available for the development of approximately 17,000 living units, according to the Town Hall (Diario Sur, March 13, 2016). So it’s unlikely that Marbella will run out of development land in the next three or four years.

Major international funds are for the first time investing hundreds of millions of euros into purchasing land Delays in issuing building licenses Although the Town Hall is doing a good job in many areas such as security, rubbish collection, cleaning, roads, beaches etc. and despite the fact that there is enough qualified development land under the 1986 General Plan, the department of Urban Planning that grants building permits (Urbanismo) which in turn has to recommend them to the Town Council for approval is suffering serious delays – some are even calling it a paralysis4. Property developers, and those wanting simply to build their own home on their own plot, agree that these delays are punitive in nature. This has encouraged buyers to purchase land in the neighbouring municipalities of Benahavís and Estepona where the process is quicker: in these municipalities building licenses can be issued in around three to four months from the submission of the project, whereas right now in Marbella we are told the procedure can often take more than a year. The serious delay in the concession of 4

building permits in Marbella is causing incalculable damage to investors who bought development and building land in good faith, and indeed, to the very image of Marbella itself and is a separate issue to the annulment of the 2010 General Plan and the urbanistic chaos in Marbella suffered over the last fifteen years. Whatever the cause of the blockage and delays in the concession of building permits, and irrespective of internal problems in the Town Hall, those who apply for building licenses have every right to expect a rapid and efficient procedure leading to the issuance of building licenses on qualified building sites within a time frame similar to adjoining municipalities and others throughout Spain. The Town Hall has the obligation to provide strong and effective leadership to achieve that end. into the purchase of development land on the Costa del Sol, with emphasis on the quality end of the market between Marbella and Sotogrande. With historically low interest rates, investment in land and development promises investment yields far greater than that obtainable elsewhere. These investments are a major indicator of confidence in the future of the market for second and retirement homes in this unique area renowned for its incredible year-round weather, healthy lifestyle and high quality environment. As a result, virtually all of the prime development sites in Marbella have been sold, with new projects currently in the planning stage. Quoting from an original article published in Diario Expansión on March 10, 2017: “The recovery of the residential market is starting to take shape in certain autonomous regions and international investment funds are positioning themselves to benefit as the boom takes hold (…) and as they await the reactivation of the sector, several of the funds have made in-roads. Värde, Lone Star, Castlelake, Texas Pacific Group, Apollo, Cerberus and Kennedy Wilson are just some of the stars of the new residential market. These funds maintain their presence in the residential market in several ways: as holders of debt, as servicers and as owners of the new generation of property developers, which are much more professional than their predecessors.” Tourism is again breaking records The number of tourists coming to Spain rose in 2016 by 10.3% from 2015’s record high, to reach yet another high of 75.6 million visitors, of which 23.6% were from the UK. Press reports have shown that arrivals in Málaga airport increased by an impressive 15.7% over 2015, to 16,672,776 passengers,

Clearly, Spain is benefiting from security concerns in other parts of the world such as the Middle Eastern countries, where many or most are not prepared to travel, in addition to the classic reasons of safety and quality of environment which Spain, and Marbella in particular, represent. In Marbella, the fact that a major hotel group owning two important beachside hotels in Marbella, is said to have had a record year for occupancy and income in 2016 speaks for itself. Marbella is receiving record numbers of foreign tourists, with the Spanish tourism level still well behind the level of 2006. Marbella has never looked better than it does today and the optimism in the air is contagious. Historically, we have witnessed for more than a half a century how real estate investment is a direct beneficiary of quality tourism.

Demand for villas over €4,000,000 A brief survey of the owners of the major estate agencies in the Marbella area came to the unanimous conclusion that the market for properties over €4,000,000, instead of increasing in 2016 as everyone (including ourselves) had predicted, actually decreased in 2016 even though it is showing very good signs of strength in 2017. Estimates by main agents in Marbella of the number of these properties sold in 2016 are in the area of only 20 to 25 properties, even when leaving a margin for units that changed hands privately.

There are some amazing properties built for the top end of the market today, built by outstanding architects showing more stylistic influences from beyond Spain than ever before, with a strong contemporary trend having firmly taken root. We have always believed that an important element of the future of the Marbella area market is the top end of the market and that eventually prices will climb toward the levels of the Côte d’Azure. This will come in time, and also as the exceptionally high quality, luxurious properties currently reaching the market attract new top-end clients who were unable to find this type of property in the past.

Has the market fully recovered? No, not fully, despite healthy market activity and having left the market crisis behind years ago. New developments, carefully planned and designed for their target market are selling very well. Resale activity in the most consolidated, prime residential areas has been as good as at any time in Marbella’s history, with new or refurbished properties sometimes achieving prices above the 2006-2007 highs. In most other areas of Marbella and adjoining municipalities, the market has progressed well, there is solid market activity, but there are still many exceptionally well-priced resale

properties waiting for the right buyer. One of the many big differences in the market today, compared with that of 2011 and the years preceding, is that there is a good market demand in all price categories and property types. Selling any property today is therefore only a question of price. Before, when vendors dropped their prices, often no offers were forthcoming. Now, when vendors fix their asking price to the right level where their properties are perceived as very good value for money, there is an almost instant response in the marketplace.

What does the future hold? • Big money speaks, and money attracts money: the vote of confidence represented by the investments of important international funds and developers in the Marbella area serves not only to ensure future, well-planned, higher quality property developments but also to attract further investors and individual buyers, generating market confidence all around. • Market analysis would lead us to conclude An International Associate of Savills

Marbella now has a 12-month season unlike any other resort city in the Mediterranean Basin (all other factors being equal) that the next few years will probably be characterized by a gradual development and growth of the area rather than a market heading for overheating as before, all depending of course on the economic evolution of the world and the different countries whose citizens comprise the markets for Marbella area real estate. • The last three to four years have witnessed an expansion of the Marbella area’s touristic “shoulder seasons” where the autumn activity is lasting longer, and spring activity is starting earlier. With a core population of around 300,000 in the low season months, Marbella’s restaurants, most hotels, sporting facilities (including more than 40 golf courses in Marbella and nearby) and nightlife remain open and active, creating a 12-month season unlike any other resort city in the Mediterranean Basin. The tendency towards the lengthening of the shoulder seasons will no doubt continue as it has very gradually for the last fifty years, and will serve to fuel the

growth of property sales in the coming years. • The old model of property development of the boom days, where developers would build almost anything and it would sell quickly, moving on rapidly to the next promotion is, thankfully, buried. A more sophisticated, experienced and caring developer has taken its place, truly keen to give excellent value for money to its purchasers, investing far more time and effort into producing properties of higher quality construction than in the past, tailored to a more refined, varied market requirements and demand. The rewards are already becoming apparent: rewards for the developers with projects already underway who are enjoying substantial success in sales, and rewards to purchasers who are finally receiving an increasingly broad choice of new quality properties with different characteristics, prices and locations. • The growth of sales in neighbouring municipalities of Marbella will continue unabated and Marbella’s growth will

continue, perhaps at slightly more leisurely rate than its neighbours until the delays in the issuance of building licenses in Marbella are resolved, which might take another two or three years if appropriate steps are taken. • The Spanish national market share, easily 35% before 2007, now probably around 20%, historically, comprised the foundations of Marbella’s property market. As the Spanish economy continues its recovery, so this sector of the market will increase. • The “top end” of the market will show increased activity as new, beautifully designed and very well-equipped properties are completed and put on the market. • Those resale properties that are sensibly priced and well-marketed in all residential areas of Marbella and its outskirts, will sell more quickly than in past years, as the demand for properties increases.

restaurants, all combine to make Marbella the only resort area on the Mediterranean with an active 12-month season. This is why Marbella attracts quality people from all over Europe and the rest of the world.

A new era of Marbella property growth There is an important conclusion with respect to the greater Marbella area of today, including the adjoining municipalities Estepona and Benahavís: those who have watched and measured the evolution of this area for many years believe, almost universally, that this part of the Costa del Sol is at this very moment at the dawn of a new Golden Age. By Christopher Clover As a preface to the story of Panorama’s first years in Marbella, I would like first to provide some insight into why Marbella became so attractive to us in the first place back in 1970 that we decided to open an office here.

The beginnings It was 1946, The Spanish Civil War had ended some seven years before. Marbella was a village with less than 10,000 inhabitants and with a very interesting history. In the middle of the village there was (and remains) an old Moorish castle dating back to the 9th Century and Roman ruins throughout the municipality. of people made it inevitable that in 1953, Alfonso decided to build a small hotel with 18 rooms adjacent to the converted farmhouse, surrounding a courtyard, much like the motels he had recently seen in the United States. He decided to call it the Marbella Club Hotel. The hotel opened its doors to the public in 1954 and immediately became a magnet for quality tourism. Count Rudi von Schönburg, a relative of Alfonso, who had recently graduated from Alfonso and his father built a beautiful, new the Swiss Hotel Management University in home on their land, and encouraged their Lausanne, joined Alfonso in 1955 as the Hotel’s friends to come and visit them. Upon their arrival in Marbella, while waiting for Uncle Ricardo’s return from a fishing trip, they had a picnic lunch under the umbrella pine trees of the beautiful Finca Santa Margarita adjacent to the sea just west of the village. They fell so in love with Marbella, and with this finca especially, that they returned the following year and bought the property.

Through Alfonso, his father, his mother, and his Uncle Ricardo’s contacts, so many people started visiting the area (and the Marbella Club), that many were unable to find accommodation. Such an influx

Marbella a magnet for those looking for a new, special location for their holidays. Alfonso was certainly not demure in inviting everyone belonging to the jet-set of the time to the Costa del Sol’s first luxury hotel and, in no time, Marbella was The “In” Place of Europe. By the ‘60’s, there were many regular “famous” visitors to Marbella and the Marbella Club and a large number bought land to build their homes, sometimes from Alfonso himself. Some of these “big names” included: José Banús, who came to Marbella in 1962 and acquired the land of what is today Puerto Banús, and Nueva Andalucía (many called his vision “crazy” at the time!), Jaime de Mora, Manolo Lapique, Ignacio Coca, the founder of Los Monteros and the Río Real Golf courses, and other big names such as the von Thyssens, Princess von Bismark, the Füstenberg family, Mel Ferrer and Audrey Hepburn, the Duke and Duchess of Windsor, Prince Rainer of Monaco with Grace Kelly,

Ava Gardner, Cary Grant, Laurence Olivier, Guy de Rothschild, Terry von Pantz, Deborah Kerr, Jimmy Stewart, Teddy Kennedy, Jean Negelesco, and many others. Alfonso had successfully taken the seat of his Uncle Ricardo as the prime promoter of Marbella. Marbella had become a “special place for special people”, which was Panorama’s slogan in our early years.

Bridging the gap between Special Seaside Village and International Hot-Spot As a result of Alfonso’s promotion, together with that of his many friends who built new homes and developments in the area, the official population of the municipality surged from 12,156 in 1960 to 29,253 in 1970, but when Panorama arrived here in the early ‘70’s, there was still a “village feeling” about

By the late 1960’s Marbella had become a “special place for special people”, which was Panorama’s slogan in our early years. Marbella, a small town full of interesting and friendly people. The key locations at the time – apart from the Old Town – were the Marbella Club, Puerto Banús, Nueva Andalucía, Los Monteros and Guadalmina; the last three with their respective golf clubs, all of which were built with their owners betting on the future of residential tourism (tourists who own Wedding of Princess Marie Lousie and Count Rudi in 1971 properties and live in them part of the year). By the late 1960’s, Marbella had most of the ingredients to eventually become a major, quality holiday and residential tourist destination with a 12-month season, rather than simply a summer holiday resort. However, for a town to be open year-round, with enough business for luxury shops, boutiques, restaurants, nightspots, leisure and amusement facilities, a minimum nucleus population in the winter “off-season” was required of around 150,000 inhabitants, between registered residents and the “floating population” of residential tourism. This figure was not achieved until around 1996, when the “off-season” took on a life of its own, transforming Marbella into the only resort city on the Mediterranean Basin with a year-round season. Today there are between 275,000 and 300,000 residents in the low season in Marbella.

Bland Hoke, who had worked before in sales in our Washington D.C. office and today a highly successful real estate broker in Jackson Hole, Wyoming. Bland’s principal job, with his sales team of five, was to receive the regular inspection

The popularity of Marbella had already spread overseas. My father, Bill Clover, a successful real estate broker in Charlottesville, Virginia since 1952 (like his father, B.B. Clover, had been in Chicago since 1904), decided to add to his business by purchasing an international real estate agency in 1968 called Panorama International Ltd, with headquarters in Washington D.C., about a two hours’ drive north of his home in Charlottesville. A French associate of his at the time, René Frank, suggested that Marbella had become the most important new jet set destination in Europe and that we should seriously consider opening an office there. And so we did, in early 1970, along with offices in Mallorca and Mexico City shortly thereafter (the latter, headed by my brother Bill). Panorama was the first international real estate agency in Marbella, B.B. Clover in 1904 and the first real estate agency to bring

flights of clients sent by Panorama’s D.C. office and start laying the groundwork for listing and selling resale and investment properties. In February 1973, Bland returned home and my first wife Kirsten and I set off to Marbella for what was only meant to be a year overseas to re-organise the office, but resulted in our staying permanently. When we arrived, Marbella was still a small town. To make an international call in those days, one had to book a “slot” through the Málaga operator, and sometimes wait for hours to get a connection. Our trusty secondhand telex machine, with technology Iberian Daily Sun, March 16, 1973 dating back to the 1930’s, was our only reliable link to the outside world. Donkeys were still present in the streets as a means of transporting goods, along with a lot of Seat 600s and the box-like Seat 124 sedan.

Panorama was the first international real estate agency in Marbella, and the first real estate agency to bring inspection flights to the area. The main two-lane highway to the airport passed through the centres of Fuengirola and Benalmádena Costa, and was known then as the “Highway of Death”. In general terms, the infrastructure was deficient and unreliable, with power cuts sometimes several times a month, with this being somewhat understandable when you look at the population multiplying by two and a half times over the prior decade. We lived under the dictatorship of the Generalísimo Francisco Franco. On Franco’s last trip to Marbella in the spring of 1973, to inaugurate the new Clínica Incosol, as the story goes, he noticed the towers of the Hilton Hotel and the studio-apartment hotel next door (now known as the Hotel Don Carlos), and also the Torre Real, in front of Incosol, and was absolutely horrified, and gave the order that never again should such tall buildings scar the skyline of Marbella, in the manner that had already literally ruined Torremolinos and Benalmádena Costa. Franco’s perspective coincided with the low-rise, low-density vision of quality development and growth, already begun by Marbella’s “founders”, starting with Ricardo Soriano himself, who discouraged his friends from building more than one floor homes, and encouraged them to maintain

the traditional Andalusian style. This style was followed by Prince Alfonso, José Banús, Norberto Goizueta and others. Franco’s opinion only helped strengthen the local authorities’ will to maintain this tradition, and not one tower building has been built in Marbella since 1973. It is only due to the strong, lasting influence of these people that Marbella has been able to remain a city with a high level of luxury and quality development, compared to the concrete jungle to the east of the municipality and most other resort cities along the Mediterranean Coast.

new clients for a start-up business such as ours. The Marbella Club was then, and has remained, my favourite bar and restaurant: warm and romantic, classy, great service and food, great people. The salary I allocated to myself when I arrived in Marbella was 25,000 pesetas per month, which was the equivalent at the time of about $420, and with which we were able to live very decently. The most luxurious sports car made in Spain was the Seat 124 Sport, in fact it was a Fiat model assembled in Spain until 1975, but with a Spanish engine and transmission, which cost around 350,000 Pesetas or about $5,800 at the prevalent exchange rate, a fortune in those days. I bought one secondhand in 1978 and still have it! Of the Spanish made cars of the day, the best that one would see on the road was the Dodge 3700 GT (made by Chrysler España) – a real sign that you had money if you drove one! The purchase of imported cars from Germany, America or England was virtually prohibitive due to exorbitant import taxes which literally doubled the cost of an already expensive luxury car. In fact, until the mid-80’s there was a certain

“social stigma” attached to making an extravagant exhibition of wealth, which was associated not only to driving a “Spanish” Dodge, but also any type of Mercedes or other imported luxury automobiles. Spain was incredibly cheap in the ‘70’s and ‘80’s, and even well into the ‘90’s due, in part, to the peseta being devalued six times between 1977 and 1993, enabling the economy to remain competitive with respect to its exports, and tourism to keep growing every year. However, with the Euro becoming legal tender in Spain in January 1999, and the peseta eliminated at the end of 2001, this economic tool is no longer available and is now having to be substituted by severe belt-tightening by the municipal, regional and national governments along with labour reforms, which will eventually result in a more competitive economy.

and other businesses. In 1974, he was the owner of a beautiful, palatial villa located just opposite El Ancón on the Golden Mile which he had bought from Mara Lane, sister of Prince Alfonso’s wife Jackie Lane, and sold it a few years later to the late King Fahd (then Crown Prince Fahd). In the mid-90’s, David bought the Marbella Club and the Puente Romano Hotels, along with several other hotels in other countries, now in the capable hands of his children Daniel and Jennica. David treated me as a special friend and not only became our most important buyer client at the time, through his purchase of several significant properties, but he also introduced me to some key people who introduced me to Jaime de Mora y Aragón & his wife Margit Ohlson others. in Málaga at the time, Bashir commissioned me to negotiate the purchase of a parcel of land in Málaga on which the new Islamic Cultural Centre was to be built. When he was nominated in the mid-‘90’s as the future Saudi Ambassador in Japan, he asked me to be his buyer’s agent and to find for his government a new, representative building for the Saudi Embassy in Tokyo. One and a half years later, we successfully closed a deal for the purchase of an 11-storey, brand-new building in Roppongi, central Tokyo, incorporating a duplex penthouse for the Ambassador. Today, it remains the most beautiful Saudi embassy building in the world. The purchase of properties by Crown Prince Fahad, and his family encouraged many others from the Middle East to also buy homes in Marbella in the late ‘70’s and early ‘80’s. Many other Princes, along with important – even legendary – businessmen

and dignitaries from every single country in the Middle East bought properties in Marbella, adding to our wonderful cosmopolitan and cultural mix. Notable among these were Sheikh Zayed bin Sultan Al Nahyan, the Ruler of Abu Dhabi and President of the UAE, whose family still owns a magnificent estate adjacent to Rocío de Naguëles; various members of the AlMarzook family from Kuwait; Adnan Khashoggi and his many friends; the electronics magnate Mouffac Al Midani; Rafic Harriri, who went on to become the Prime Minister of Lebanon; H.E. Sheikh Kamal Adham and countless others. There is a special comfort that many Middle Easterners felt and feel in Marbella and southern Spain in general. Many rivers, villages and other geographical areas bear Arabic names and there are thousands of

words in the Spanish dictionary stemming directly from the Arabic language, all a result of the Moors’ 781 years occupancy of Spain from 711 to 1492. The Rif Mountains of Morocco can be seen most days of the year, with the lights of Tangiers visible many nights, past the Rock of Gibraltar, giving one a very special sense of our geography.

A British enclave In the early ‘70’s, a small number of British citizens, not more than two or three thousand, had settled here either as part-time or fulltime residents, many of them important personalities. There was a specific reason for the number of people being so low: Great Britain had exchange controls in the form of the infamous “dollar premium”: tight

restrictions on spending money made it very difficult for people to take foreign holidays and to buy second homes overseas on a scale we now take for granted, or to buy shares in foreign companies. At one point, people could not take more than £50 cash abroad, even for an ordinary family holiday overseas. You even needed to have your passport stamped by the bank when you collected the cash! When the late Margaret Thatcher was elected Prime Minister in 1979 and relaxed (and shortly thereafter eliminated) the exchange controls in that same year, the demand literally exploded in a surge of buying second homes abroad, which in fact has never really abated very much since then, other than the peaks and troughs of the market in general over the last thirty-five years. Marbella of course was a prime beneficiary of this pent-up demand, as were other parts of Spain, France, Italy, the U.S. (especially Florida), and other countries. Flights from the UK surged in number, and the Costa del Sol became a preferred holiday and residential destination for UK tourism, with Marbella as its quality capital. Panorama marketed properties directly to UK purchasers, with advertising in The Times and The Financial Times. We sold many important properties to an affluent UK clientele, throughout the 1980’s and again in the mid1990’s, partially due to a strong partnership at the time with Chesterton’s, a leading London estate agency, and continuing until today, thanks in part to Panorama’s current association with Savills. Today, the British are the largest single nationality, after of course the Spanish themselves, with a permanent or part-time residence in the Marbella area.

New friends, business associates, and celebrities Amongst the many influential people we had the opportunity to meet in Panorama’s early years in Marbella was Rafael Zea. Rafael was a pioneer property developer who, among many other projects, built the Skol building in Marbella by the sea in the ‘60’s. Rafael was the Chairman of the developing company which owned Las Lomas del Marbella Club and came to Panorama in 1974 recommended by mutual friends. We got along well and he quickly agreed to give us an exclusive on the sale of their plots in Las Lomas which resulted in our selling, over the next years, most of this wonderful residential area located in the heart of Marbella’s Golden Mile. Rafael also gave me a wonderful deal on the purchase of my first villa in Marbella. I also did business with Mel Ferrer who, as a money-making pastime, built and sold inexpensive, rustic villas. Mel was a terrific person, and I remember him being both extremely polite and very down to earth.

I had the privilege to meet and become good friends with Ray Milland and his wife Mal (in 1946 Ray won an Oscar for Best Actor in Billy Wilder’s film The Lost Weekend), and Stewart Granger, one of Hollywood’s greatest stars, who was also a seller of an important estate between Marbella and Estepona. Ray Milland contacted us in 1975 from an advert in the International Herald Tribune and came down to look at beachfront homes. Since he had become a star a little before my time, I didn’t know who he was, and when I collected him at the airport, he rode in the back of my box-like Seat, and his wife in the front, and I asked him what he did for a living! After a brief silence and a long sigh, he said with some exasperation in his face… I was watching him through the mirror… “I’m in the cinema industry”. Unfortunately it got worse when I asked him what part of the industry! In the end we got along very well and we, as well as our wives, became close friends. The Millands ended up purchasing a jewel of a beachfront home in the El Ancón development, on Marbella’s Golden Mile which belonged to a Mr. Brown. Along the front line in El Ancón there were 4 other houses next to Mr. Brown’s: two on the right and two on the left. The first at the end, on the right, belonged to John Green, the original developer of the estate. The second belonged to the well-known industrialist, Gordon White. On the left was Mr. Black and, at the other end, Warren Gold. Incredible but true! We called it “Rainbow Row”! John Green, brother of the art gallery owner Richard Green, is a highly creative and successful property developer, not only for his projects in Marbella but also in London.

He went on after his project El Ancón to develop, from 1981 to 1985, another beautiful, gated community in the hills just opposite El Ancón, which was called El Ancón Sierra. I was involved in selling him the land, selling most of the homes there, and was a member of his company’s Board of Directors. John and his wife Jacqui remain close friends, and we both own homes in El Ancón Sierra today.

The ‘Hostess with the Mostess’ Another personality among the many people we were close to at the time and who remained so well into the ‘90’s, until her death, was the Baroness Teresa (Terry) von Pantz, heiress to the Avon perfume fortune. She inherited her fortune through one of her previous husbands, and she lovingly called her last husband, Baron Hubert von Pantz, “Hubert the Fifth” as she had out-lived her prior four husbands. Hubert himself had a well-publicised affair with the French designer Coco Chanel in his youth. They were both very generous people and loved giving lavish parties for their many friends and acquaintances: Terry was known for over three decades in Marbella as “the hostess with the mostess”. Her favourite hobby

Marbella Sierra Blanca In the late ‘70’s we met Elizabeth and David Brockman, who, with their partner Connie Muneman, and his family, owned the most beautiful development site in Marbella, which is now known as the Urbanización Sierra Blanca. A little known story is that a Kuwaiti client of ours contracted to buy the entire land, subject to the approval of a partial plan by the municipal government. However, due to the delays caused to the plan approval by ecologists at the time, our client got cold feet and backed out of the deal a year and a half later. The purchase price for the entire site (of course before infrastructure) was $3,000,000! The Brockmans later found another partner, the highly successful, high quality property developer Pedro Rodriguez, (Sierra Blanca Estates) who made his first investment in Marbella in the Brockmans’ company and proceeded with the installing of infrastructure and subsequent sale of plots.

Friends since the ‘70’s Other wonderful people who opened their doors to us in our first years in Marbella, were Miguel Gomez Verdun, the owner with his wife Antonia, of the Gomez and Molina jewelry boutiques. Miguel was at the time also Director of the Hotel El Rodeo; the late Archie and Cathy McNair – Archie was the Chairman of Quant which he co-founded with Mary Quant in the 1950’s; the late Bill Genske and his wife Silvia, the developers of Lomas del Marbella Club Pueblo; Nielson Sanchez Stewart with his wife Alicia, who was and remains an active lawyer and good friend.

The late Rafael Cruz-Conde became a close friend and our main lawyer in the late 1970’s, and his job with Panorama (and friendship with me) is continued through his son Mauro and daughter Alejandra today. Count Hans Larisch and his wife, María, the Marquesa de Salamanca, also became good friends. Perhaps my oldest close friend is Patrick Op de Beeck, the well-known insurance broker, whose office was next to ours when we arrived.

Marbella is not a big city like London, Madrid or New York with a captive market within 50 kilometres of the centre. Most buyers are not looking for a primary residence here, but a second or even a third home. This makes Marbella real estate less of a need and more of a luxury in which people are not drawn to property close to centres of work but to the quality of life a property can offer them. As a result, one characteristic of a secondary housing market is that especially luxurious properties can take a longer time to sell, though in our experience this is considerably shorter where both buyer and seller are serious in their intent.

New properties which are unfinished obviously are paid for over the construction period, and all payments on account before finishing must be guaranteed, according to LAW 38/1999, by a bank or insurance company: if the property is not finished by a certain date, a purchaser has the right to reclaim the monies paid, plus legal interests. Additionally, another law obliges the property developer to arrange a ten year insurance policy with respect to any basic building defects with the purchasers as beneficiaries. When the entire purchase price is paid for the property, the seller will issue the public deed of conveyance (escritura) to the purchaser, free of liens and encumbrances. This deed is issued before a Spanish notary, is passed from the notary to the tax office to be assessed for Transfer Tax if the property is a resale or second hand property, or assessed for Stamp Duty if the property is sold directly by the developer. It’s then presented to the Property Registry for inscription. A provisional inscription in the registry is made immediately upon issuance of the deeds.
