General Information & Sale Notes LOCATION: This sale will be held in the Borderway Mart, Carlisle Cumbria. Motorists should leave the M6 at Junction 43 and follow CARLISLE signs. The market is on the left hand side of the road within 1/4 mile of M6. ARRIVAL OF STOCK:

INSPECTION: The veterinary inspection will take place to examine all sheep forward for teeth, testicles, ear marks and general health at 10.30am on the morning of the sale. HOTELS: There are many hotels within the area, ranging from four star to excellent Bed and Breakfast accommodation, a list of which may be found on page 5 of the catalogue. CONDITIONS OF SALE: Sold under the conditions of sale as displayed in the market, recommended by the Livestock Auctioneer’s Committee for England and Wales. The Pedigree and descriptions of the lots are believed to be correct, but are not intended as warranty, and therefore shall be taken with all faults and errors of description. All sheep are sold as correct in mouth unless otherwise stated. METHOD OF SALE: All sheep will be sold in guineas (105 pence) and strictly in catalogue order, unless any alteration is announced by the Auctioneers. A commission of 5% will be charged by the Auctioneers on all sales, together with sale levy of 2%. SUBSTITUTE ENTRIES: Up to two substitutes will be allowed per vendor and these must be notified to the Auctioneers not less than 3 days before the event. Only substitutes notified will be eligible. COMMISSIONS: The auctioneers will dutifully execute commissions to purchase for buyers unable to attend the sale personally, upon receipt of written instructions. INSURANCE: A representative of Auctioneers H&H Insurance Brokers will be present at the sale and will be pleased to quote purchasers for transit and other risks. SETTLEMENT AND CLEARANCE OF STOCK: Settlement in full is due immediately at the close of sale. No animal may leave the sale premises without an offical ‘pass slip’ obtainable only from the Auctioneers upon settlement. MAEDI VISNA: All sheep are MV accredited.

Excessive dirty vehicles will not be allowed entry, therefore ensure vehicle is clean before arrival.

All vehicles transporting livestock will be subject to a documentation check before entry to market site.

All visitors and traders must ensure they wear clean clothing and footwear before entering market site.

All visitors and traders using car park areas please use main entrance.

Hauliers and farmers delivering livestock must disinfect their boots before and after loading or unloading.

Livestock purchased or unsold will not be allowed to move unless an authorised “pass slip” has been issued by the main office.

No livestock will be allowed to remain on the premises after a sale.

Only staff, livestock hauliers, owners or their agents are permitted to load or unload livestock.

Wash hands thoroughly when leaving pennage areas.

CONDITONS OF SALE 1. This Sale is held under the Bye-law’s of the Suffolk Sheep Society. The Bye-law is hereby incorporated as a Condition of Sale. 2. Vendors and purchasers are deemed to agree to these Conditions of Sale, and these Conditions of Sale are terms of any contract of sale and purchase at the sale. 3. These conditions shall be governed, construed and enforced in accordance with the law of England and the law of England shall apply to all contracts made at the Sale. AUCTIONEER’S CONDITIONS 1. The Sheep will be exposed in lots according to the numbers in the following catalogue. The Auctioneers reserve the right to refuse any bid without assigning any reason. The highest offer on each lot will be preferred to the purchase (subject to Article 3) 2. No liability whatever is undertaken by the Auctioneers for the statements appearing in the Catalogue or made at the Sale. The exposer who supplies such statements is alone responsible for any error or mis-statement. Animals affected with any disease of an infectious nature or animals our of an infected flock are strictly prohibited from being brought to the premises occupied or used by the Auctioneers at the time and should any such be brought, The Owner or Consigner will be held responsible for all damage or loss occasioned thereby. 3. The Exposers reserve the right to fix a reserve price and to announce same before the bidding begins or during the time of the bidding or at the conclusion thereof. The right to bid by or on behalf of the seller in terms of the Sale of Goods Act 1893, is expressly reserved. 4. Immediately after each purchase is declared, the risk of the animal shall be exclusively with the Buyer, and it is declared that until a settlement shall be made in terms of these Conditions the delivery of the animal shall be suspended. The right of the property shall not pass until the price is paid. 5. Immediately after the Sale all lots must be paid for in cash to the Auctioneers. The price being paid, each lot shall be taken away at the Buyer’s expense within one day after the sale thereof. Lots shall only be removable from the Auctioneers’ possession on a written order from their clerk, and any lot removed in contravention of this condition may be recovered brevi manu by the Auctioneers. 6. If any buyer fails to pay for and remove his purchase in compliance with the above conditions, the Auctioneers in their opinion may either (a) sue the Buyer for the price and interest thereon at the current Bank Rate and for the keep of, and any other expense incurred by them in connection with such purchase, or (b) re-sell the Lot either publicly or privately and recover from the defaulting Buyer the deficiency (if any) attending such re-sale and interest thereon as aforesaid together with the keep and other expenses. In either case the Auctioneers shall have the rights to sue at their own instance without the consent of the Owner or Consignor, and no defence whatever in such action shall be competent to the Buyer who shall have recourse against the owner or Consignor alone. 7.

No undertaking of the Auctioneers or their servants to take charge of any animal after the sale or to forward it to its destination shall be held to impose upon the Auctioneers any legal obligation or vitiate any of the foregoing conditions.

8. The Auctioneers is appointed Judge of the Sale, to whom are hereby submitted all disputes and differences of any kind which may arise at and in relation to the Auction, either between Exposers and Offerers or among Offerers themselves; his decision shall be final and binding on all parties.

RAM FERTILITY GUARANTEE (BYE LAW 17) 17.1

All rams and ram lambs sold at a Society sale are warranted by the seller to be capable of natural and effective service by 70 days from date of sale (“the Male Guarantee Period”) provided always that:

17.1.1

any animal which is not so capable and where the incapacity is caused or contributed to by injury or illness howsoever caused, suffered or contracted after the sale is not covered by the warranty; and

17.1.2 any animal which has not been conclusively determined as incapable of natural and effective service in accordance with the procedure set out hereinafter and which dies of natural causes during the Male Guarantee Period is not covered by the warranty. 17.2

An animal shall be deemed incapable of natural and effective service if:

17.2.1 it fails to make at least one ewe pregnant during the Male Guarantee Period under natural breeding conditions; and 17.2.2 it is certified as being so incapable by a veterinary surgeon in accordance with clauses 17.4 and 17.5 below. “Natural breeding conditions” means when a ram is run with ewes in normal breeding condition, cycling without artificial interference. Ewes which have been sponged and/or treated with hormones to induce or synchronise ovulation are deemed not to be in normal breeding condition. 17.3

The buyer shall throughout the Male Guarantee Period give the animal full and sufficient opportunity to prove that he is capable of natural and effective service and maintain him in a fit condition.

17.4

If the buyer highlights that the ram or ram lamb has failed to prove capable of natural and effective service by 56 days from sale date of the year of sale, the buyer shall then:

17.4.1 Notify the seller in writing that the animal is to be tested; and 17.4.2 Have the animal subjected to a semen test by the artificial vagina method by a veterinary surgeon attached to a breeding company authorised by the society; and 17.4.3 Obtain from the veterinary surgeon a duly completed Soundness for Breeding report; and 17.4.4 (If the veterinary surgeon certifies that the animal is incapable of natural and effective service) lodge a copy of the Report with the seller. 17.5

The seller shall be entitled to have a second test carried out by the same or a different veterinary surgeon attached to a breeding company authorised by the Society who shall issue a Soundness for Breeding report by 14 days after notification by the purchaser and such Report shall conclusively determine whether or not the animal is capable of natural and effective service. The seller shall deliver to the buyer a copy of this second Report. The buyer shall at the expense of the seller do all acts, deeds and things necessary to enable the second test to be carried out. If the animal shall be deemed fertile the buyer shall on demand repay the seller the veterinary surgeon fees of the second test and Report.


9 17.6

If the ram is deemed incapable of natural and effective service during the Male Guarantee Period, the buyer may by 31st October of the year of the Sale return the animal to the seller and thereupon the seller shall repay to the buyer the whole of the purchase price and the cost of transport of the animal from the buyer’s premises to the seller’s premises and the veterinary surgeon testing fees incurred by the buyer.

17.7

The seller shall not be liable for any indirect or consequential loss howsoever sustained by a buyer.

17.8

As to clauses 17.4 and 17.5 and 17.6 time is of the essence.

17.9

The seller and the buyer may vary the provisions of clauses 17.4, 17.5, 17.6, 17.7 and/or 17.8 if but only if and insofar as the variation is set out in writing and signed by each of the parties.

17.10

The terms of any statutory enactment or custom or trade which are inconsistent with the provisions of this Bye-law 17 are hereby excluded.

17.11

Failure to comply with any of Bye Law 17 will allow the Society, at its discretion, to cancel Society membership.

17.12

Society Bye Laws do not exempt a breeder from the Sale and Supply of Goods Act.

GENERAL DISPUTES 18.1

In the event of a dispute arising between two or more Members of the Society any one of such Members may refer the dispute to the Society with a request that the matter be referred to an arbitrator to be appointed, failing agreement between or amongst the parties, by the Society. The decision of the arbitrator so appointed shall be final and binding on all parties to the dispute and Council has the power to ensure that the arbitrator’s decision is implemented.

18.2

Any arbitration under this Bye-law 18 clause shall be subject to the Arbitration Acts for the time being in force.

Identifying Rams with Superior Breeding using Estimated Breeding Values (EBV) and Indexes The way in which an animal grows and develops is determined by both its breeding and a host of non-genetic factors such as management and feeding. The aim of Suffolk Recording is to work out how much of each animal’s performance is due to its breeding and this information is expressed using Estimated Breeding Values (EBVs) for specific traits.

Estimated Breeding Value

Explanation

8-Week weight EBV (kg)

Selection on high EBVs for 8-week weight will result in faster growing lambs to weaning.

Mature size EBV (kg)

This trait gives breeders the opportunity to influence the mature size of their flock.

Litter size EBV (lambs/ ewe)

Selection on high positive figures will increase the number of lambs born in the flock.

Maternal ability EBV (kg)

This is the maternal component of the 8-week weight measurement. High figures indicate breeding lines where females perform well as mothers – maternal care and milking ability.

Scan weight EBV (kg)

Selection on this trait will increase growth rate to scanning (21 weeks of age).

Muscle depth EBV (mm)

Choosing animals with high muscle depth EBVs will increase lamb muscularity and hence the lean meat content of the carcase.

Fat depth EBV (mm)

Selection for negative fat depth EBVs will reduce fat levels in the carcase or enable lambs to be taken to greater carcase weights without becoming over fat.

Gigot EBV (mm)

Selection for high figures will enhance gigot muscularity.

FEC EBV

Animals with negative figures are more resistant to worms and excrete less worm eggs onto pasture.

An overall Breeding Index incorporates the commercially economic important EBVs for Terminal Sires (growth, muscle and fat) whilst including gigot muscularity and an additional penalty for animals with very low fat depth EBVs. The Suffolk Breeding Index is presented as an economic value. This value, in pounds and pence, ranks animals according to the relative financial merit of their progeny.

When buying a ram, buyers should use the Breed Benchmark to identify where an animal’s EBVs rank within the Breed.

INDEPENDENT TRIAL RESULTS THE SAC STIRLING COLLEGE STUDY

This was an independent trial designed and supervised by senior staff at the Scottish Agricultural College (SAC), Stirling. Objective The aim of the trial was to assess the impact of dosing with LIQUITHRIVE SHEEP® on a hill flock, with particular reference to fertility, lamb performance and economic outcome. Methodology 1. From a commercial flock of 600 ewes, the ewes were randomly split into two equal groups. The first group was given LIQUITHRIVE SHEEP® and second group, the control group, was not treated. 2. The ewes in the first group were given 20ml of

LIQUITHRIVE SHEEP 4 weeks pre-mating and 20ml prelambing. Both groups were given a copper injection 7 weeks pre-lambing. All other feeding and conditions were the same. ®

3. The lambs from treated ewes were split into two groups.

Group 1 was dosed with 5ml LIQUITHRIVE SHEEP® at an average age of 6 weeks. Group 2 was untreated. 4. The lambs from untreated ewes were also split into

two groups. Group 1 was dosed with 5ml LIQUITHRIVE SHEEP® at an average age of 6 weeks. Group 2 was untreated. Assessment The lambing dates of ewes and growth of lambs was checked at the end of the trial. Lambing percentage, lamb mortality, barrenness, lambing period and financial implications were all measured.

If the handler is temporarily absent, arrangements should be made with another vendor, steward or member of Harrison & Hetherington staff to oversee the bull until the handler returns. Handling of Livestock at shows and sales: Harrison & Hetherington Limited recommend that an adult person should accompany any junior person during the showing/sale of livestock in the ring and reserves the right to intervene at any point if, in the company’s opinion, the person showing the livestock is at risk in undertaking that activity. Passageways must be kept clear at all times during the auction sale. PLEASE DO NOT STAND IN THE SALE RING ENTRANCE AND EXIT PASSAGES. The auction ring man escapes and refuges must be kept clear at all times. All portable electrical equipment supplied and/or used by visitors and traders must be safe and fit for the purpose and should have a valid portable appliance test certificate.

AUCTIONEER’S TERMS & CONDITIONS OF SALE (Incorporating the Auctioneer’s Terms and Conditions as recommended by the National Beef Association) 1.

The biddings to be regulated by the Auctioneers and the highest bidder, subject to the Vendor’s reserve (if any), to be the purchaser. No bid shall be retracted and if any dispute should arise between two or more bidders, the Lot in dispute to be put up again and resold, or the Auctioneers may determine the dispute at their own discretion and their decision shall be final. The Auctioneers reserve the right to refuse the bid of any person without being called upon to give reason for such action.

2.

The Purchaser to give his full name and dwelling place and pay for all Lots purchased immediately at the close of sale. No Lot or Lots shall be removed from the sale premises until paid for and a pass-out slip obtained from the Auctioneer’s clerk but each and every Lot shall immediately at the fall of the hammer be considered as delivered and be and remain in every respect at the absolute risk and expense of the respective purchaser or purchasers thereof and shall be removed from the sale premises at the purchaser’s expense. The right of property shall not pass until the full purchase price is paid.

3.

Purchasers paying by cheque must be prepared, if required, to produce a banker’s reference. As a result of the Money Laundering Regulations (2003) the auctioneers are unable to accept cash payments in excess of nine thousand pounds sterling for any any single or linked purchase transaction.

All statements in the catalogue, or made by the Auctioneers at the time of sale, also the correct identification of the animals, are the entire responsibility of the Vendors. The Auctioneers take no personal responsibility for the correctness of such statements or identities.

All statements in the catalogue, or any made by the Auctioneers at the time of sale relating to any veterinary or other tests are to be taken as statements of fact only. No such statements shall guarantee the purchaser of any animal against loss arising from the subsequent reaction of such animal to any test administered after the sale and the Vendors shall not be liable in any way should this occur.

All stock is sold subject to the Conditions of Sale recommended for use at markets by the Livestock Auctioneers’ Markets Committee for England and Wales except in so far as these conflict with any Special Conditions applicable to the sale of pedigree stock, when the latter Conditions shall prevail.

Neither the Vendors nor the Auctioneers will be responsible for any accident or injury to persons or property, through fire or any other cause whatsoever, nor for any damage by animals prior to, during or after the sale.
