Agents in Thailand May Soon Need the Century 21 Brokerage License to Stay Competitive in Foreign Market Thailand is a very popular destination for expats and international investors who are looking to purchase properties in a developing market. Pattaya especially is popular for foreigners looking to buy real estate, however buying real estate in Thailand is often quite a different experience than buying in a Western market. One of the most striking differences is that the Kingdom lacks the mandatory requirements for brokerage licenses that most Western countries have. A lack of a mandatory license means that anyone with access to a listing can act as an agent. This can be dangerous for foreigners who don’t speak the language or have a thorough understanding of the market, laws and regulations surrounding real estate transactions. A solution may be on the horizon for this however, as the global real estate franchise Century 21 Thailand is in the process of creating a broker licensing course for all existing and new agents in their network. While the course will only be mandatory for Century 21 agents, it will be open and available to all agents in Thailand seeking an edge with the foreign market. The program, which will be held at the new Century 21 Thailand Sales Academy will train and test all real estate students on a full spectrum of the industry; from how to become an established and service-minded agent to mastering appraisals and taxes. A major component of the coursework will focus on national laws and regulations, which will provide all license holders with the knowledge necessary to give sound advice to their clients. Courses at the Thailand Sales Academy will be run in trimesters. At the end of each one, students and aspiring real estate professionals will take examinations in which a passing grade will allow them to advance into different levels of their license, and thus career. The three levels will include the Agent license, the Associate Broker license, and the Broker’s License. Each level will allow the professional to advance from agent, to manager, to franchise or agency owner. With an internationally recognized brand and over 50 offices in Thailand, the Century 21 broker licensing course will achieve a significant reach as soon as it launches. It will be a strong start to what will expectantly become the standard measurement of professionalism in the real estate industry. Eventually foreigners will learn to enquire whether agents possess the Century 21 license, as it proves that the agent is competent and educated in their field.

Onyx Residences Achieve EIA Approval in Time for Construction Onyx Development Co. Ltd. took a huge step in March 2015 by securing the EIA approval for their new project, the Onyx Residences for the building. This was the final hurdle for the development team as construction is slated to begin before May 2015. Everything is now in place for this stunning building to commence with completion expected in little over two years. When a building like the Onyx comes along it tends to set a new standard for quality and service, and it’s likely that others will try to follow. In order to remain competitive against buildings of this quality, developers in town will have to reassess what they offer to the market regards design and build. Although Pattaya is currently experiencing a tough market, Onyx Residences is already 70% sold out. Thailand-Property.com Takes the Hassle out of Search with the Kingdom’s First Property Alert Tool Thailand’s leading English language property portal, ThailandProperty.com (a Dot Property Co. Ltd site) just released a new email alert function that will help home seekers identify and review properties of interest with virtually no effort. While property alerts are quite commonly used by home seekers in Western countries, the property email alert function by Thailand-Property.com is the first in Thailand. Right at the top of Thailand-Property.com’s homepage, visitors can simply enter in their search criteria to request custom email alerts for all properties that match their interest. Emails are then delivered as soon as a relevant property is added to the site, making the users who sign up the first to know about new listings. China and the Middle East Tourists Replace Russian Tourists Due to various reasons and events Thailand saw foreign tourist number not surprisingly fall in 2014 by 6.7 % to a total of 24.7 million, which is well below the 28 million originally forecast. However, January 2015 has shown an upwards trend with major comebacks by almost all the important tourist markets with Malaysia, South Korea, USA,Germany, United Kingdom and India, plus the Middle East too. It was announced on the 18th March by the Thai Ministry of Tourism and Sports that visitor arrivals to the country had reached a record monthly total of 2,654,634 in January 2015, this is up by 16.3% when compared to January 2014. The figures show that the numbers of arrivals from all regions grew well with the exception of Europe, Russia and Oceania. The greatest increase was in visitors from East Asia reaching 43.25% which equates to over 1.54 million people. This number includes the largest single tourism source of China with a total of 560,399 arrivals an increase of 57%. The figures for visitors from the Middle East shows a growth of 31% reaching 55,521. Arrivals from Kuwait and the UAE show the largest increase at plus 92% and plus 115% respectively. There was even an increase odf over 10% to more than a1000 visitors from Saudia Arabia. Arrivals from Russia and Europe showed a drastic decrease in numbers. This was particularly influenced by the current European economic crisis which resulted in 14% fewer visitors from Europe. The most dramatic fall was seen in the number of Russian visitors with figures falling 46% to 269,479 which followed a drop of 8% throughout 2014. The undeniable reason for this was the crash of the rouble with it now worth about 50% of its value last year so doubling the cost for Russian visitors. The effect of this has most keenly been felt in the real estate market with large numbers of Russians defaulting on off plan property payments. However,despite these concerns and the increase in vistors from other areas the TAT have reiterated their target of 28 million visitors for the coming year with a generated revenue of $41.5bn in tourism receipts.

Budget Condos in Oversupply, But Luxury Condos Still Holding Their Value The latest research and findings from the Pattaya property market do not make the best of reading for investors and speculators with more than 19,300 unsold units available on the market. When compiling their Pattaya City Condominium Market 2H 2014 report, Colliers International Thailand saw that around 10,000 units are sold a year in Pattaya and if all the units belonging to investors and speculators are included the real figure could be nearer 22,000 units. They also reported that is a slowdown in construction and this is directlyaffected by the city’s property developers financial performance. It was also seen that some developers had either postponed or delayed projects. The prices of new condominium units may not show a significant increase during 2015. This was put down to the large number of unsold and second hand units available in the market place affecting the prices of new condominium launches. A notable exception to this could be found in the luxury sector. It is conceivable that demand in the Pattaya market may not recover during this year. Also Colliers said that decrease in the Russian rouble that came about in 2014 may not see any significant recovery and this will also affect the market in the area.

To demonstrate the over supply of units Colliers reported that during the period from 2011 to 2013 a figure of 16,916 units were launched and a further 12,460 last year. During this time only between 10,000 and 14,000 units per year were being purchased. With the political issues and concerns at the end of 2013 and the beginning of 2014 being at the forefront of the developers minds only 3,800 or so units were launched in the first 6 months of last year. However, with the formation of the new government later in the year confidence was restored with developers launching more projects making a further 8,670 units available despite the fact that Pattaya’s condo market was beginning to show signs of oversupply. In addition Colliers also noted that further projects were scheduled mainly in the Jomtien and Na Jomtien areas from Chinese developers as well as Thai developers from Bangkok. The Pattaya market has suffered various set backs in the past and it has also gone onto recover. This time the recovery may well be slower than previously experienced however, with the development of new attractions such as the water parks in the area both Thai and foreign tourists will always be attracted to the area.

Although sales of entry level condos targeted at foriegners has declined, the mid level and high end condo market targeting predominantly on middle and upper class Thai home buyers as was evident in both attendees and booth marketing materials.

If it Sounds too Good to be True… Check to see if it’s a New Nordic project The editor of this magazine asks me to write about things that excite me. Apparently I’m really excited about New Nordic property developments because I’m still talking about them this month. What I wanted to say this month is how attractive New Nordic properties are from an investment point of view. Many people invest in resort or residential properties in Thailand with a general and vague plan about renting them out for income. In international real estate jargon this is referred as “Buy-to-let”. Thailand is a pretty good choice for this kind of endeavor even if you don’t have a solid plan or any experience. According to Global Property Guide, buy-to-let investments in Thailand average between 6 to 8% annual return. But it’s not guaranteed. Once you buy a desirable unit and furnish it, you are still responsible for finding a tenant. A real estate firm like mine can find help, but you’ll pay a fee that cuts into your profit. You can do all the public relations and legwork yourself, but it isn’t as easy as it sounds, especially with a considerable amount of competition out there. It’s even more difficult if you live in another country. And, the hustle never ends as you have to play landlord, fix broken air conditioners and constantly find new tenants. A few years ago we started seeing advertisements in Pattaya for “guaranteed returns”. I’d seen these types of promotions before and always considered them as the same stuff my grandmother puts on her tulips to make them grow. I even looked into the contracts and mechanisms that these developers were actually offering.

corner of the business world. Time after time, I’ve wasted my time examining the inner workings of guaranteed returns. Oddly enough, this is why I’m still excited about New Nordic projects this month … guaranteed returns. Finally I found a guaranteed return program that I understand and that makes sense. In fact, I’d say the guaranteed return and cashback program offered by New Nordic is even better than their modest advertising proclaims. New Nordic offers property and guaranteed return programs for its hotels, condos and spectacular luxury project, The Castles. Here is how it works: 10% guaranteed return for 5 years in VIP condos, 10 years in VIP hotels and 20 years in The Castles. Maintenance/Service fee paid 50/50 between buyer and seller. Set rate is 37.50 THB per square meter. 3% cash back to the buyer based on payments during construction. If the buyer pays in full, 10% cashback will commence the following month. The buyer relinquishes full rights of usage to the seller for the agreed guarantee period. Termination of the agreement requires 6 months written notice. The seller maintains and insures the property. The seller is also responsible for upkeep and renovation. The seller offers to buy back the property after 5 years for 100% of the original price. In the case of The Castles Condo project, an escalating offer is made after the 5th year. For example, buy back in 5 years at 100% … 6 years at 105%. The buyer can sell the unit and transfer the remaining income guarantee. This is the kind of offer even I can understand. What I couldn’t understand is how New Nordic can make such an offer. Then I talked to CEO Kurt Svendheim and I got it. With 49 projects on Pratumnak Hill alone, New Nordic far exceeds the title of “experienced” developers. Their management procedures are tried and tested; their personnel trained and focused. Their core business is hotels, so site management and putting tenants in rooms is second nature to them. This is where I’ve seen many guaranteed return programs break down … in the execution. Another major component driving New Nordic’s success is the fact they have a travel and tour operation business in Norway and right here in Thailand. They don’t wait for visitors and future tenants … they bring them here! So, that’s why I continue to be excited about New Nordic. They have a simple plan, the ability to execute, and a proven track record. New Nordic’s program isn’t “too good to be true” … it’s “too good to compete with”

When I saw this advertising, I was under the impression that if I purchased a unit, I would be guaranteed a certain percentage of return. A 5 million baht condo with a guaranteed 8% return would yield 480,000 baht over one year. The math looked pretty simple to me. Unfortunately, reality and execution did not meet my expectations. “If it sounds too good to be true, it probably is”. The Royal Cliff Garden Condominium

Located on the South -Western slope of Navy Hill, on land once owned by the Royal Family stands the four towers that make up Royal Cliff Garden Condominium that was constructed during the period of 1988 to 1991. The list of facilities available is quite extensive and includes 3 swimming pools all located on separate terraces. Two of the pools are 25 meters in length and the upper pool is an infinity pool offering great ocean views. It has tennis, squash & basketball courts, gym, saunas and a children’s playground to name but a few. Units can still be purchased in foreign ownership, however, the chance to do so does not come round very often as owners tend to buy for the long term. You have seen these structures quite often in Pattaya, a shop-house with office space at the bottom and 3-4 storeys of rooms on top. By choosing this type property, investors ensure that they get office space for their business (or rent it out to another entrepreneur in need of an office), a place to call their home and about 10 extra rooms they can rent out for profits. Jomtien and the east side of Pattaya (what used to be called the ‘dark side’) are the most popular places at this particular moment in time, you will see these type of multi storey buildings in pretty much every Soi.

Which markets are getting involved in the commercial property trade You probably will be surprised to know it’s actually the Thais (from Bangkok and surrounding cities like Si-Racha) who are putting the most amount of cash into these type of properties. Locals have been noticing the land prices increase in Pattaya and are wasting no time buying up land just to see it’s value climb higher and higher every year. The other major market that is seeing a lot of growth is, and I doubt this will come as a surprise to you, the Chinese market. With plans for both a massive highway and a fast speed train connecting China and Thailand directly, everybody is quickly adapting and marketing to this huge (and poorly tapped) market. The internet is still at the helm of marketing towards these Chinese buyers, but little by little, they are personally coming here l;looking for good investment opportunities.

Along the same lines, because you are renting long term, the actual rental rates you can get from renting your house are small in comparison to the short term rates. To exemplify, you can get about the same amount of profits if you rent your home 10 days out of the month on a short term rental than you would by having long term tenant i.e if you can keep your house full under a short term rental, you will make a lot more money.

Short Term Rentals:

As foreigners living in a non-touristic city, we tend to think of long term rentals as the usual way of making business: You meet a tenant that wants to stay in your house for an extended period of time, you set a per month rent based on your expected ROI and leasing period, and once the contract is accepted and signed you sit back and get a standard amount of money every month.

Now we are considering renting your property on shorter terms, anything from 3 days up to a month are generally consider short term rentals. The best and main advantage of doing business this way is that the potential for profits are much larger, if you are skillful enough to fill the house on the regular basis, you will be making a lot more money than having long term tenants. Let’s give you an example: If you have a house that you could normally rent out for around 40,000 -50,000 THB per month on long term rates, under a short term agreement, it is fair to say you can get from 5,000-8,000 THB a day. Do some simple maths with these numbers and you can say that if you can rent your property with daily short term rates all month long (5,000 THB x 30 days = 150,000 THB) you stand to make a significant amount of extra cash.

At the same time, putting your property in the long term rental schedule also means you will have a bit of protection against the low/high seasons fluctuations. It’s a great feeling to know once the contract is signed your property will be taken for a long time regardless of low or high season, this mean money in the bank and a lot of people choose this sense of security. That said, because it’s a lot more difficult to find people willing to sign a long term contract in Pattaya, there is a big chance your house/property will sit empty (and not making you any

Land Ownership Requirements

W

e’ve written a lot about buying property as a residence, investment, office or business. As you might already be aware it is impossible for a foreigner to truly own land in the Kingdom. That said, there are a few common methods employed to effectively own land. NOTE: Before using any of these methods, step #1 is to go to the land office and make sure whatever land you’re looking at is free and clear of encumberances and truly owned by the person you’re negotiating with. Here are the four methods most recommended for coming to possess your own little piece of the Land of Smiles.

THE 30 YEAR LEASE It is possible for you to obtain a renewable, 30 year lease. You can renew a lease of this type up to two times, effectively owning your residence for 90 years. A lease of this type is transferrable via sale or inheritance. This is a popular method, but does not result in you truly owning the land. The big disadvantage here is that someone can purchase the land you’re leasing from the true owner and nullify your lease, should they so choose. Make sure to get a good lease agreement that will protect you from this, and other, potential pitfalls. Remember: Whatever you build on this land could

very easily become someone else’s property.

INVEST If you’re planning on investing in Thailand and, have ฿40,000,000 (£821,000 / $1.23M) to do so with, you can buy up to one rai (0.4 acres) of land on which you can build a house and own both free and clear. Your investment must be for a period of at least five years in an approved and recognized investment, and the land you purchase can only be used for a personal or familial residence. This is a good option for those of you who are already planning on investing more than 800,000 GBP. Otherwise, you’ll probably want to go another route. The obvious benefit to this method is that you truly own the land and property, and you can keep or sell it as you please.

START A COMPANY A company started by a foreigner has to be majority owned by Thais both in terms of money and directorship, but that company can own land. Starting a company for the express purpose of owning a residence is in a legal gray area but it is one of the most popular methods to home ownership in the Kingdom. To protect yourself, make sure the company is incorporated in such a way that you are the CFO, have majority voting and borrowing directorship, and therefore your partners cannot borrow against your property without your approval. To protect yourself from any bureaucratic snooping, actually do engage in business.

USUFRUCT USUFRUCT is a type of limited lease that allows the bearer to use the leased property without altering it. A usufruct lease can be sold or sublet, but it cannot be inherited. Usufruct is much like renting an apartment or condo, except that you are entitled to make money off the property. For example, if you sign a usufructuary lease for a farm you can sell the fruit from the farm, hence the roots of the word, “usus et fructus,” or use and enjoyment. With all the methods available to the aspiring property owner there is sure to be one that fits your needs. My advice? Don’t jump in headfirst. Engage a lawyer and a property agent and take your time. Where to buy outside Thailand It’s easy to get caught up in the high tech hustle and bustle of Bangkok business or the lazy, sandy, glitz-and-glam of Pattaya. Too easy. So easy, in fact, that many expats forget there’s more to the kingdom than the Big Mango and Sin City. It’s normal for foreigners to invest in property where they are most comfortable. Why else would Pattaya be home to so many condo developments catering to Russian tourists and Bangkok have to many billboards in English? But what about all of the areas outside the well known tourist destinations? Don’t get me wrong, if you’re looking to invest in a beachside property for your own enjoyment, or to resell to another foreigner you can do much worse than to buy in Pattaya. If you want to have a storefront with guaranteed foot traffic you can be sure to find it in Bangkok. But you won’t find much fertile land, a reasonably priced B&B or peace and quiet in either place. To find any of those in abundance - and the low prices that attracted so many of us to the Kingdom - you have to go a bit afield. Here’s a little sampling of some other places where you might be interested in investing or residing.

Chiang Mai

You’ve almost definitely heard of, if not visited, Chiang Mai. Besides the size of the city, it’s large proportion of English speakers and variety of leisure offerings there is a lot to recommend Chiang Mai to someone who wants to own valuable property. Firstly, hip-and-chill Chiang Mai has long been a reliable tourism destination. Since the majority of tourists to Chiang Mai are Thai there is a steady stream of locals to form the revenue base for a successful hotel, restaurant or attraction. Plus the popularity of the city among Chinese, who pop down for a weekend or make Chiang Mai their first stop or must see, means that a well prepared business can count

on a very nice yearly bump during the high season. Since it is known as a sanctuary for tourists looking for a laid back, natural place to relax a western-themed business can also count on Australian dollars and British pounds to trickle into the coffers from the many backpackers and retirees. All in all, Chiang Mai is a great town to have your own little place, whether that place is your retirement palace or a little guesthouse-cum-cafe. Even with all the competition, Chiang Mai is big enough to allow everyone some breathing room and popular enough to support a growing tourism sector. Plus, the city is just plain beautiful. Really, the only drawback is the lack of a beach.

Nature does much of the work and your initial capital investment means that with a bit of nurturing you don’t have to keep reinvesting money. Plus there is a certain satisfaction to growing things that appeals to the peaceful side of many people. As an added bonus you’ll always have a country retreat to run off to and rest your head.

Rural Bangkok

If you’ve got a taste for the simple life, there is a lot to be said for farming. In the words of Mark Twain, “Buy land, they aren’t making it anymore.” Since the invention of landfill that isn’t strictly accurate anymore but good, fertile land is highly valuable, very much in demand and one thing that Thailand has in great abundance. While it isn’t easy to get a farmer to part with their land (typical purchase prices can include marriage contracts) it is nevertheless possible to find land for sale. Just make sure you do the due diligence before signing any contracts. The great thing about owning land in Thailand is that every sort of produce and livestock flourishes in this beautiful climate. If it likes water and sun and warmth, it loves Thailand. There

On the con side of things, finding good and trustworthy employees is not always the easiest thing in the world. And, in harvest season, if you’re growing something very valuable such as Durian it isn’t only four legged thieves you’ll have to worry about. While farming can be a largely absentee owner business you will need to be available to check in on your investment, be friends with your workers and generally be a good neighbor. That is why I recommend the areas outside Bangkok city. You can reside in town, spending the spoils of your concern on a posh condo and still be close enough to drive into the country whenever the need arises without having to spend money on a plane ticket.

Isaan

For anyone who wants to see “The Real Thailand” Isaan is the one and only destination of choice. As Thailand’s poorest and most ignored province, Isaan remains now as it has been for centuries (with the addition of electricity, modern plumbing and western style homes in some places) and many of the people live very much like they have since antiquity. Not only does this mean that you can experience traditional Thai culture first hand, it also means you can trek into the jungle or ride down the river quite easily. It also means that your baht will be worth just a whole ton more. The same money in Isaan will get you three times the house it would get you in Bangkok. If you want to have a nice, big house and be looked upon as a baller by all the ladies when you go out for drinks, Udon Thani or Khon Kaen - two of Isaan’s four major cities - might just be for you. If you want to get even more for your money then head outside of the cities, but be prepared to trade all western conveniences for natural splendor. Who knows, it might be just what you’re looking for.
