Groundbreaking set for Tuesday for Animal Shelter

WINFIELD – A groundbreaking ceremony to start construction of a new Putnam County Animal Shelter has been set for Tuesday, Aug. 28, at 1 p.m. The public is invited to attend. Earlier this month, the Putnam County Commission passed an ordinance to finance construction of the new animal shelter. The financing closed on Friday, Aug. 17, and BBL Carlton, the contractor on the project, began work to clear brush on Monday. The new animal shelter will be located on the Eleanor side of the Ross Booth Memorial Bridge at Winfield. It will replace an existing facility in Winfield that has been in use for 27 years. As envisioned by the architectural firm Silling Associates, the new animal shelter will feature 46 kennels for dogs, nearly double the capacity of the current shelter, and will also feature a system that will keep the kennels easier to clean. The new facility will also feature inside and outdoor “bonding areas” where those looking to adopt a dog or cat will have time to play with the animal. The facility will also have two entrances, one for the public looking to adopt an animal, and a separate entrance where animals are brought into the building. Once construction begins, depending on the weather, it is hoped that the new animal shelter can open to the public by late spring or early summer 2013.

CONFIDENCE – As students around Putnam County returned to school on Thursday, students returning to Confidence Elementary School were greeted by a brand new, stateof-the-art school building. The brand new facility is located on W.Va. 34 about threeand-a-half miles past the former school building that it replaces. The former Confidence Elementary School building was built in the 1940s and featured a number of portable classrooms. Just a few days prior to the official start of school in Putnam County, a ceremony was held to cut the ribbon to open the new building that will house Confidence Elementary students now and into the future. Dozens of staff, students and community leaders turned out on Monday, Aug. 20, to officially open the new Confidence Elementary School. “We had more kids in portables than in the main building,” said Confidence

WINFIELD – Putnam County's unemployment rate continued to be well below the state average in July according to figures released this week by WorkForce West Virginia. Putnam County's unemploy-

ment rate for July stood at 5.4 percent, while the overall state unemployment rate was 7.4 percent. Putnam County's unemployment rate declined from 5.8 percent in June and was lower than all of its surrounding counties. Unemployment rates de-

clined in 32 other counties as well. Twenty counties reported rising unemployment rates. Counties with unemployment rates less than six percent included Preston (5.9), Lewis (5.7), Monroe (5.6), Putnam (5.4), Jefferson (4.8), and Monongalia (4.7).

Shifty Fifties Car Show A classic car show is coming to Valley Park in Hurricane, WV on September 16, 2012. Tomblin announces plan to fight substance abuse ‘epidemic’ BECKLEY, W.Va. -Gov. Earl Ray Tomblin has unveiled a statewide plan to fight the substance abuse epidemic in West Virginia by dedicating $7.5 million for the establishment and expansion of regionally based substance abuse support services. The governor made the announcement Thursday at Turning Pointe for Families, a drug treatment center for mothers in Beckley. He was joined by legislators, members of the Governor's Advisory Council on Substance Abuse, and members from the regional task forces. "We need more prevention, early intervention, treatment and recovery programs in all

four corners of the state in order to fight the substance abuse epidemic," Tomblin said. "By continuing to invest in services to combat and treat substance abuse, we are making it easier to access help-especially for our young people and women. I am appreciative of the legislature's support, as well as that of more than seventeen-hundred West Virginians who have worked with my task forces and advisory council to develop this plan." Earlier this year, the Governor's Advisory Council on Substance Abuse and six regional task forces advised funding local, regional and statewide service programs as part of a comprehensive plan to address drug

abuse in West Virginia. The funding recommendations include establishing and expanding the following services in the following areas: • Region 1: Crisis Stabilization Unit/Detoxification Unit; a Women's Regional Recovery Facility. Region One serves Hancock, Brooke, Ohio, Marshall, and Wetzel Counties. • Region 2: SBIRT (Screening, Brief Intervention, and Referral to Treatment) services; a Women's Treatment and Recovery Facility in the Potomac Highlands area. Region Two serves Morgan, Berkeley, Jefferson, Mineral, Hampshire, Grant, Hardy, and Pendleton Counties. • Region 3: A Child and Ado-

lescent Treatment Facility. Region Three serves Wood, Pleasants, Tyler, Ritchie, Wirt, Calhoun, Roane, and Jackson Counties. • Region 4: SBIRT services in the Randolph, Braxton and Harrison Region; Intensive OutpaTreatment in tient Randolph/Tucker; 2 recovery coaches in each of the counties (26 total). Region Four serves Monongalia, Marion, Preston, Taylor, Doddridge, Harrison, Lewis, Gilmer, Braxton, Barbour, Tucker, Upshur, and Randolph Counties. • Region 5: SBIRT in Logan/Mingo with regional coverage; Women's Treatment Facility with outpatient services for

men and women in Logan, Mingo, and Wayne Counties; Detoxification unit in Logan, Mingo and Boone Counties. Region Five serves Cabell, Kanawha, Mason, Putnam, Clay, Wayne, Lincoln, Boone, Logan, and Mingo Counties. • Region 6: Detoxification and Stabilization Unit; SBIRT services. Region Six serves Fayette, Monroe, Raleigh, Summers, Webster, Nicholas, Greenbrier, Pocahontas, McDowell, Mercer, and Wyoming Counties. In the coming months, the West Virginia Department of Health and Human Resources will solicit bids to establish and expand such services in certain regions of the state.

HURRICANE – The Putnam Farmers Market is currently in second place in the country in an online contest sponsored by the American Farmland Trust to identify America's Favorite Farmers Markets. As of Friday morning, Aug. 24, the Putnam Farmers Market was the second leading vote getter in the country in the small market category. The Botanical Gardens of the Ozarks Farmers Market in

Fayetteville, Arkansas, was first in the small market category. The small market category is for markets with 15 or fewer vendors. Voting in the 2012 America's Favorite Farmers Markets contest began June 22 and will continue until midnight eastern time on Sept. 3. The goal of American Farmland Trust’s fourth annual America’s Favorite Farmers Markets contest is to highlight the role that farmers markets play in keeping family farmers on the land.

The summer long contest is a nationwide challenge to see which markets can rally the most votes from their customers. At the end of the contest, four winning markets—one small, one medium, one mid-size, and one large—will receive the title of America’s Favorite Farmers Market for 2012. The winning markets will be featured in the media and will be honored at local celebrations organized by American Farmland Trust. For more information about

Putnam Rotary Club hears story of living with Lupus TEAYS VALLEY -- The cause is unknown, and there is no cure for lupus, a disorder in which the body's immune system attacks healthy cells. More people in the United States suffer with lupus than those with cystic fibrosis, AIDS and cerebral palsy combined. Nine out of 10 of the victims are women. Ramona Runyon is a victim, and she shared her personal story of faith and inner strength in the face of hopeless debilitation this week with the Putnam Rotary Club. "It all started out the summer that I turned 30 years of age," she said. "Instead of getting a tan I had a rash on my face and extremities. Then fatigue, nausea and a headache set in." The young mother of two children was referred to a hematologist who diagnosed an auto immune disease called lupus. The disorder varies from mild to life-threatening, Runyon told her audience. "There are five types," she said. I have the most common type, which is called systemic lupus erythematosus. It can affect any part of the body." No two people have the same

tired, and feel refreshed when you rest, but exhaustion. I've been so fatigued that it was an effort to breathe," she said. "My husband had to turn me over in bed and carry me to the bathroom and help me with personal hygiene care."

Another common symptom of lupus is arthritis -- swelling, inflammation and pain of the joints. "My doctors tell me that I am a better forecaster than the meteorologists because my lupus flares whenever rain or snow is coming. "When I get a virus, my immune system goes into super drive. Most people let the virus run its course. I have to go to the hospital. "Lupus has no cure, because they do not know what causes it," she said. "There is no 'lupus gene.' "My social life is not the active calendar that I used to have when I was always on the go doing something. It mostly consists of phone visits, prayer lunches with friends on my better days, and visits from my immediate family "I go to church when I can. But being susceptible to germs and infections. I avoid sick individuals and crowds. "Having support and help from family and friends is beneficial. Prayer support from others, and my faith and reliance in Jesus Christ have a direct impact on my dealing with my disease. "For all people who have lupus, I want a cure. Until then I want better and more affordable treatments with fewer side ef-

fects. And I want more research." Surprisingly, there is no state organization dedicated to research and support of lupus victims. However, the Lupus Foundation of America reports that research is nearing significant breakthroughs in the underlying science of the immune system. Public awareness and understanding continue to grow. Improvements in diagnosis, a greater understanding of how medications can work together to control symptoms, and increased knowledge of the effects of the disease have allowed better management of lupus over time. Today, people with lupus are leading healthier lives and living longer than at any time in history. And while Runyon waits and labors in her quiet way to raise lupus awareness in the community, she witnesses to the strength and will of the human spirit. Chinese miners to train in West Virginia STAFF REPORT CHARLESTON — Mining managers from China’s top coalproducing province will attend safety and rescue training in West Virginia. Officials from Shanxi Province traveled to the capital to sign the agreement with Southern West Virginia Community and Technical College and West Virginia University (WVU) on Thursday. First Lady Joanne Jaeger Tomblin hosted the event at the governor’s mansion and signed the agreement on behalf of Southern West Virginia Commu-

nity and Technical College. She accepted the duties as president of Southern West Virginia Technical College in 1999 and became the 36th First Lady of the State of West Virginia in 2010. President James Clements signed on behalf of WVU. Southern West Virginia Community and Technical College is in the application process to accept international students. The managers will enroll through WVU, which will contract with the technical college to provide the training. Seven executives from Shanxi mines are scheduled to attend the two-day training in September 2012. “One of the goals of this program is to raise awareness of mine rescue safety during disaster operations,” said Tomblin. “We hope that China and other countries will continue to send mining officials for such training.”

The Shanxi officials toured the training facilities on the Logan campus and the college’s Academy for Mine Training and Energy Technologies. The course focuses on emergency management for mining disasters and command post training for mid-level managers and rescue personnel. Because most of China’s coal mines are underground, the rescue training will focus on practices applicable to underground mining. The training agreement is part of ongoing efforts to build and maintain trade relations between West Virginia and China. West Virginia Development Office International Division has participated in mining trade shows in China in 2008, 2009 and 2011. Southern West Virginia Community and Technical College participated in the state booth at the China Coal and Mining Expo in 2011.

Survey says lawsuit abuse affects nation’s economy By Chris Dickerson www.wvrecord.com

CHARLESTON - A new survey shows that Americans believe lawsuit abuse is a problem that hurts the nation's economy. Results of the poll, released Wednesday by the American Tort Reform Association and a group called Sick of Lawsuits, show that 89 percent of those surveyed say lawsuit abuse is a problem, and 69 percent says it is a "major" or "big" problem. The results also showed that 83 percent believe the current liability system needs to be improved. Locally, legal groups had mixed opinions of the findings. Richie Heath, executive director of West Virginia Citizens Against Lawsuit Abuse, said the survey figures are overwhelming. The results of the survey are clear," he said. "Americans believe that lawsuit abuse is a serious problem, and they want to see lawmakers do something

about it. "With the election right around the corner, voters on both sides of the aisle want to support local candidates that back meaningful legal reforms.� The president of the West Virginia Association for Justice, meanwhile, condemned the results. "This so-called study isn't news," Scott Blass said Wednesday. "It's business as usual from the American Tort Reform Association. Its previous studies, including its annual judicial hellhole report, have been widely discredited by both academics and independent groups. This study is just more of the same." Blass called the study "nothing more than propaganda" designed to scare West Virginia voters into giving up their constitutional right to trial by jury and provide immunity for corporations that break the law. "Here's the truth," Blass said. "ATRA was created for one pur-

pose -- lobbying for immunity when corporations break the law and risk the lives and bank accounts of West Virginia consumers, workers and business owners. "Independent analyses show that, despite what ATRA claims, lawsuits are not an issue for business owners, West Virginia ranks just 39th in the number of lawsuits filed per capita and more than $13 billion in new business investments have been made since 2005." Heath countered. "These numbers should hit home especially hard in West Virginia, which has suffered greatly from its reputation as a judicial hellhole," he said. "It's also no coincidence that West Virginia consistently ranks as one of the worst states in the nation for job creation. "Hopefully, our state lawmakers will take notice of this important data and finally work toward passing the meaningful reforms that a large majority of voters support."

The ATRA study, released Wednesday, surveyed 1,013 registered voters. It also found that 60 percent think lawsuits against businesses have damaged the economy and slowed the economic recovery and that 88 percent support measures that would help protect companies from lawsuits that could put them out of business. And 78 percent think there are too many lawsuits filed in the United States. Blass said the courts "play a critical role in protecting the interests of West Virginia businesses." He cited National Center for State Courts numbers that show business-againstbusiness contract cases comprise more than 50 percent of all civil cases filed nationally and that just 5 percent of civil cases are tort cases, but onethird of those are tort cases filed by one business against another. Blass also quoted Tea Party

Nation founder Judson Phillips, who has said our courts "are essential to protecting our free market economy by holding businesses that break the law accountable." "The free market is wonderful. It encourages good behavand punishes bad ior behavior," Phillips wrote. "The civil court system is part of the free market. It is the part that punishes bad behavior." The results of the ATRA study are based on a national survey among 1,013 U.S. voters conducted by Luce Research by telephone from July 11-19. The interviews include both landline and mobile telephone numbers. The data were weighted by age, ethnicity and region to ensure a representative sampling of voters by all demographics, including gender, education and party identification. The sampling error for this study is plus or minus 3.1 percentage points at the 95 percent confidence interval.

MARTIELE VATELLA BALLINGALL Martiele Vatella Ballingall, 88, of Scott Depot, formerly of Chelyan, died August 8, 2012, at home, surrounded by her family. Born July 28, 1924, she was the daughter of the late Joseph and Rose "Dimple" Estep Vatella. In addition to her parents, she was preceded in death by her husband of 60 years, John "Jack" Ballingall; an infant son, John Jr.; sisters, Elizabeth Rumburg, Hazel "Tootie" Billo and Patty Anderson; and brothers, Billy, Leon and Charles Vatella. Mrs. Ballingall was retired from Diamond Department Store and was a playground director at Cabin Creek Mission School for many summers. She was a member of Chelyan First Baptist Church where she was Sunday school superintendent and active in the women missions for many years. Surviving are her daughter and son-in-law, Patty Jo and William Gillespie of Scott Depot, with whom she made her home; grandchildren, Heather (Dan) Kinder of Cross Lanes, Johna (Tony) Huffman of Scott Depot, Andrew (Kayleigh) Gillespie of Culloden and Adam Gillespie of Belle; and great-grandchildren, Katie and Ashley Kinder, Olivia Martiele and Luke Huffman. She also loved, and considered as her grandchildren, Kristy Fellure, Chad Harless, Morgan Tuell and Lauren Gillespie. She loved and was loved by many nieces and nephews. Funeral services were held Saturday, August 11, at Chelyan First Baptist Church, James River Road, Chelyan, with the Rev. Chuck Kinder officiating. Burial followed in Montgomery Memorial Park, London. The family would like to thank Dr. Michael Robie, Dr. Leonard Fichter and the wonderful nursing staff at CAMC Teays Valley for the excellent and loving care.

NANCY THOMAS BARNETT Nancy Thomas Barnett, 58, of Poca, passed away at home on Thursday, August 9, 2012, after a long illness. Nancy was a lifelong resident of Poca; attended West Virginia State College; and was a former assistant manager of the GoMart in St. Albans. She was a loving mother, grandmother and great-grandmother. She was preceded in death by her parents, Walter and Margaret Thomas. Left behind to cherish her memory are her lifelong companion, Charles "Chuck" Cartwright; children, Charles Barnett Jr. and wife, Linda, of St. Albans, Sean Barnett and wife, Chasidy, of Eleanor and Michelle Gibson of Winfield; her sisters, Karen Hackett of Poca and Linda Childress of Nitro; her brothers, Steve Thomas and David Thomas, both of Poca; her grandchildren, Rebecca, Cameron, Blake, Ian and Abbigail; and great-granddaughter, Anna Claire. Nancy is also survived by other relatives and a host of friends. A celebration of Nancy's life was held Saturday, August 11, at Cooke Funeral Home, Nitro, with the Rev. Ray Humphrey officiating. Burial followed in Cartwright Cemetery, Poca. JERRY W. BRISCOE SR. Jerry W. Briscoe Sr., 60, of Winfield, passed away Wednesday, August 8, 2012, at his home. Born December 19, 1951, in Winfield, he was a son of the late Armon Allen and Arbutus Meadows Briscoe. His brothers, William Earl, Harry Allen, Richard Harold and Roger Okey; and his sister, Shirley Moore, also preceded him in death. Jerry was a self-employed masonry worker. Surviving are his wife, Bonnie Sue Briscoe; his sons, Jerry Wayne Jr. ( Jessice Baird) and Scottie Dewayne (Carisa), all of Winfield, and William Allen (Nick) of Nitro; his sister, Mae McCallister of Hurricane; seven grandchildren; and four greatgrandchildren. MICHAEL WAYNE FOSTER Michael Wayne Foster, 35, of San Diego, Calif., formerly of Winfield, suddenly passed away on August 9, 2012, in Winfield. Mike was the only son of Jerry and Rebecca Graley Foster, born on March 17, 1977, in Charleston. Mike was a former 10-year member of the Teays Valley Fire Department, where he also served as a Fire Marshal. He was a former director of the Putnam County Fire Investigation Team. He was also co-owner of Federated Investigations Service Corporation for 6 years and a nationally certified fire investigator by three organizations and served on the board of directors of the IAAI West Virginia Chapter, a fire investigator for many other cities with the qualifications of CFI and CEFI. Mike was also a member of Scary Creek Church of God. He was preceded in death by his maternal grandparents, Emory and Margaret Graley; paternal grandfather, Merwin H. Foster; grandparents, Mazie and Londis Reveal; and infant sister, Jerri Michelle Foster. In addition to his parents, Mike is survived by his wife, Juliane Ranson Foster of San Diego, Calif.; sister, Jessica Foster and her daughter, Mikenzie Foster, both of St. Albans; his paternal grandmother, Dorothy Foster of Cedar Grove; his mother and father inlaw, Jimmy and Joyce Ranson of Scott Depot. Funeral services for Mike were held Monday, August 13, 2012 at Chapman Funeral Home, Hurricane, with the Rev. Gary Hale officiating. GARY R. HOLBERT Gary R. Holbert, 76, of Milton passed away Tuesday, August 7, 2012, at his home. Funeral services were conducted Friday, August 10, 2012, at Heck Funeral Home, Milton with Rev. Allen Stewart officiating. Burial followed in Forest Memorial Park, Milton. He was born June 18, 1936, In Wetzel County to the late Harry Rexford and Ada Josephine Gump Holbert. He was also preceded in death by his brother-in-law Harry Koon. Gary had a zest for life and enjoyed spending it with his family, especially his grandchildren and great-grandchildren. He spent a lot of time in his younger years coaching Milton Little League football and baseball and helping to develop the ball fields. He served as President of the league for a few years. After 34 years of service, he retired from Union Carbide, Institute Plant. He was a member of Milton Baptist Church. He served 5 years in the National Guard and was honorably discharged. RUTH C. LAKE Ruth C. Lake, 84, of Hurricane, WV died Friday August 10, 2012 at CAMC Teays Valley Hospital. Her husband of 62 years, Donald L. Lake, 83, died one day later at the same hospital. They were both born in Parkersburg, W.Va.; he was a son of the late Elmer E. and Ruby (Bays) Lake, and she was a daughter of the late Pete and Mollie Argabrite Miihlbach. Donald was a West Virginia state trooper and also worked for the West Virginia Parkways Authority. Ruth worked for West Virginia Division of Highways and Workers Compensation. He was a United States Marine veteran, having served in the Korean War. He was also a member of the American Legion, the VFW, the West Virginia State Police Retired Members and Troopers Associations, and the Masonic Lodge. She was a member of the Order of Eastern Star. They are survived by three children. Pete Lake of St. Albans, Michelle Lake of Richmond, Va., and David Lake of Hurricane; and a grandson, Kyle Lake of Hurricane. He is also survived by a brother, Dean Lake of Newport Beach, Calif.; and a sister, Bonnie Barnes of York, Pa. In addition to their parents they were preceded in death by a daughter, Mollie Lea Lake. RUTH LEE MILLER Ruth Lee Miller Oliver, 92, of Hurricane, widow of Walter M. "Mack" Oliver, passed away Thursday, August 9, 2012, at home. Ruth was born January 6, 1920, the daughter of the late Judge and Mrs. Lewis H. Miller of Ripley. She was a graduate of West Virginia Wesleyan College and began her teaching career at Ripley High School. She was a Gunnery Specialist Second Class in the WAVES in the U.S. Navy during World War II, where she met and married Mack. Ruth taught in high schools in Birmingham, Ala., during the early years of her marriage, and when they moved back to West Virginia she began teaching at Hurricane High School in 1954, continuing there until her retirement in 1980. While at HHS she was head of the English Department and Putnam County Teacher of the Year in 1976. Upon her retirement she became an avid quilter and was a founding member of the Quilt Lover's Guild of Putnam County. At the time of Mack's retirement they made an art of their retire-

ment years, enjoying them to the fullest. Ruth was an Episcopalian but fellowshipped with First Baptist Church of Hurricane with Hurricane family members. In addition to her husband and parents, Ruth was preceded in death by her sister, Mrs. James J. (Jo Clare) Robinson. Survivors include a sister, Mrs. Doris "Dotty" Nichols of Jupiter, Fla.; three children and their spouses, Susan Hayslett and husband, Tim, of Hurricane, Michael H. The bond was the first to be passed by county voters since 1976. “We are so thankful to the people of this county for believing in us and making this possible,” Huston said. “We will not let you down.” The new 38,000-square-foot Confidence Elementary School features a computer lab, library/media center, large cafeteria and a separate gymnasium. The school also features new expanded bathroom facilities. “The kids are going to love the new bathrooms,” Huston said. Approximately 186 students attend Confidence Elementary School in Kindergarten through fifth grades. Huston said that she and her staff had been working hard to get the new school ready for the school year that began Thursday. Much of the furniture for the new building had only arrived on Monday, hours before the ribbon cutting ceremony to open the building to the public. Following the ribbon cutting ceremony and a tour of the new Confidence Elementary,
