Log booms lingering
Canada stations in British Columbia. The closest station for Peachland drivers to fill up is in West Kelowna which is 10 kilometres up the highway, though gas has been a little cheaper in Summerland lately, which is about 20 kilometres south.
The Log Booms in Peachland are among the last flood protection measures still in place by the regional district. Peachland’s State of Emergency ended earlier this month, and last week so did Kelowna’s and the Regional District of Central Okanagan’s. Those were the last two State of Local Emergency’s in place in the Central Okanagan. All evacuation orders and alerts have also been removed. As of this morning, Okanagan Lake is at 342.57 metres. The Emergency Operations Centre has demobilized most of its flood protection measures, though some measures will remain in place until the lake drops closer to the full pool level of 342.48 m. These measures include log booms installed offshore near Swim Bay in Peachland and Maude-Roxby Bird Sanctuary in Kelowna.

50+ ACTIVITIES CENTRE It seems like May just flew by with summer like temperatures and a lot of activities happening at the 50+ Activity Center here in Peachland. The first Pancake Breakfast of the season, May 20th, was legendary. We had lineups of all ages, and everyone enjoyed pancakes, sausages, and Val’s delicious fruit compote. We served 237 breakfasts and had to put up a sold out sign! A huge thank you to everyone who volunteered their time to make this such a successful event. Don’t miss out on the pancake breakfasts held on the long weekends throughout the summer: Canada Day – Sunday July 1st BC Day – Sunday, August 5th Labour Day – Sunday, September 2nd Everyone is welcome, so please join us from 8 am – 11 am. Cost is $5 ($3 Ages 6-11, free for 5 and under) for pancakes, sausages, fruit compote, juice and coffee/tea.
We had 59 members attend the annual 80’s Members Appreciation Luncheon, Friday, June 8th. It was such a nice way to celebrate the founding Members. Lunch was prepared and served by the Board of Directors. Our oldest member in attendance was Albert Galpin (95) who had the cake cutting honours, and he even sang a love song to his wife Bernice. Special thanks to pianist, Margaret Martin who played for the members during lunch and to Bruce and Linda Lea Klippenstein for the Town Cryer addition to our day. Thank you to everyone who made this such a special time for our special members. The spring bus trip Friday, June 15th, was sold out!! Thank you to everyone who purchased their tickets early. This was a fun filled day exploring the Fintry Manor, Fintry Provincial Park, followed by a trip to Armstrong to enjoy lunch at Tuckers and a tour of the Village Cheese Factory. The bus left at 8:45 am sharp and on the way we saw a herd of 18 Mountain Sheep and two deer. A number of members had never been to Fintry and we found the tour to be very interesting, especially the Scotch cellar in the reading/den room. The trophy room was another surprise. The Village Cheese Factory had some wonderful cheeses we were encouraged to try and buy. After a full day we were back by 5:45pm. We hope you will join us for the last Potluck for the summer, Friday, June 22nd. We will be barbecuing hamburgers and hot dogs and we ask that attendees bring a salad or dessert, as

Investment in bicycling VIEW STAFF
Acquitted of mischief but ban stands
The province gave $20,000 to Summerland for their “Cycling Hub.” The hub is located at Memorial Park and has maps and a repair station. Bike racks and GPS trail beacons are on the wish list. Summerland was one of 18 communities in the province to get some cash from Bike BC. “B.C. is a leader in North America when it comes to cycling infrastructure, and I’m pleased to see 18 more communities building a culture of cycling and encouraging healthy living,” said Claire Trevena, Minister of Transportation and Infrastructure. “I’m excited this year’s grant recipients represent diversity in the kinds of projects being built and the size of participating communities both urban and rural.” Bike BC dolled out a total of $6.11 million in grants this year.
Denis Oltmanns Ruby (Dympna)
Ruby Denis Oltmanns of Peachland passed away at Pine Acres Home, Westbank, BC, on June 15, 2018 at the age of 97 years. Ruby, also known as Dympna Flanagan, is survived by son Gerald (Maureen); daughters Kim (Chris) and Corinne (Marcel); grandson Finn; and sister, Ethna Flanagan. Ruby will also be fondly remembered by nieces, nephews, extended family and friends. A special thank you to Dr. John Brinkerhoff, the nurses and staff of Pine Acres for the loving care provided to Ruby. A Prayer Service was held at 7:00 pm on Tuesday, June 19, 2018 at Our Lady of Lourdes Catholic Church, 2547 Hebert Rd, Westbank. A Funeral Mass was celebrated at the church at 11:00 am on Wednesday, June 20, 2018. Interment followed at Peachland Cemetery.

Stuart Smith got away with causing a disturbance but he’s still not allowed in the District office. The 72-year-old Peachlander was arrested and charged outside the municipal headquarters in June of 2017. He went there to pay his taxes. Judge Robin Smith acquitted Stuart Smith of causing a disturbance, but in his decision, the judge made it clear that the District has the authority to ban him from municipal buildings. Smith was originally banned from the District office because of contention between him and the local building inspector that started back in 2008. He claims his neighbour built a deck that entered over his property, though the issue was resolved long ago. But while it was ongoing, Smith was upset about the process so he asked a District staffer to give an Ace of Spades to the building inspector, which the District interpreted as a veiled threat, as it can used to symbolize “the death card.” Smith admits the Ace of Spades was meant to insult the building inspector, but not threaten him. That was the eleventh incident between 2008 and 2012, CAO Elsie Lemke testified. Smith received an email in January 2013 notifying him that he’s “no longer permitted to attend at District Hall.” Smith was notified by email that he was banned. But after the ban was made official at the next council meeting during an in-camera session, Smith requested disclosure through the Freedom of Information Act. The District declined the request which prevented Smith from knowing the full extent of his ban. That helped Smith get off the hook. “The Crown cannot rely on the city council ratification of the banning as authority, because for some odd reason the District chose not to give notice of that ratification to the accused,” the judge said in his reasoning for acquittal. Since Smith doesn’t respect the District’s
authority to ban him, he complained to the Ombudsman. The Ombudsman investigated but nothing happened. So Smith kept showing up to the District Hall, staffers kept telling him he wasn’t allowed there and they would call the cops to make him go away. The third time the police got involved was when he was charged with mischief. Smith was behaving stubbornly because he wanted to get arrested. “I was hoping that this would kick start them into this other suit,” he said about the legal fued between him and Peachland’s building inspector. His goal was to bring the circumstances of his banning before the courts so that a judge would find that his civil liberties have been violated. The judge didn’t care though. “The court may agree or disagree with the decision (to ban Smith from municipal buildings),” the judge said. “But that is not the test. Even if the court does not think the circumstance warranted a banning order, if the CAO had the authority to do so, the court will not go behind that decision.” The Crown wasn’t able to prove that Smith violated section 430(4) of the criminal code. When asked how it felt to get acquitted, Smith said he wasn’t acquitted because he’s still not allowed to enter municipal buildings. Regardless of how Smith interprets the ruling, he was acquitted of mischief. The judge did say that Smith was trespassing during the incident in June 2017. But that’s not what he was charged with. “The accused needs to clearly understand that the CAO did have the authority to ban him from attending District Hall.” Smith was also warned that future veiled threats could be interpreted as making a criminal threat. When asked if he just goes out looking for trouble, Smith said no, trouble “just happens to come after” him. He added that he has problems with neighbour’s on both sides of his property. Lemke and Mayor Cindy Fortin were not available for comment.

Dog owners, watch out for wheatgrass Dog Ambassadors are bark! VIEW STAFF

Dangers are lurking in the bush for dogs who go about their doggie business. When wheatgrass grows tall and then grass dries out, it poses a problem to curious dogs. Once it’s been dried out, it can stubbornly get into the paws and ears of a dog in the bush. “When it gets inside the ears it can be extremely painful because it can poke the eardrum,” said Dr. Oz of Rose Valley Veterinary Hospital. “It can cause huge chronic problems.” Dr. Oz has a special endoscope at the clinic to safely remove the wheatgrass. He said dog owners should try and avoid letting their pets roam in areas where wheat grass grows, and to check their paws and ears after playing in the bush. A dog that does get wheatgrass in its ear will likely be scratching it in pain. Pet owners who need to treat wheatgrass can do so at Rose Valley Veterinary in West Kelowna.
Armed sinners loot the Garden of Eden VIEW STAFF
A brothel in downtown Kelowna was robbed at gunpoint during daylight hours on Monday. Two armed robbers went into the Garden of Eden during the afternoon of June 18, and took off with an undisclosed amount of cash, according to the RCMP. Police were notified of a robbery in progress at 4:26 p.m. A perimeter was set up after police learned that two men brandishing two firearms entered the business with their faces covered. A man inside was assaulted and suffered minor injuries. One witness said a shot was fired inside, though nobody was injured by it.
The robbers fled and were last seen in the area of Eastbound on Lawrence Avenue. “Kelowna RCMP are reviewing video surveillance from other downtown businesses and are requesting any motorists who were equipped with dashboard cameras to please review their footage in hopes to assist with this investigation,” said Cst. Lesley Smith. “Police are also requesting any witnesses who have yet to come forward, to please contact the Kelowna RCMP.” According to downtownkelowna.com, the Garden of Eden has “some of the most beautiful women Canada has to offer” who “impress the pants off Kelowna” by creating “an irresistible world of sensual pleasure, guaranteed to meet your every desire.”

Ownership Bylaw.” Smith adds, “We’re a hot spot for visitors during the summer months and many bring their dogs. My name is Bruce York and I live in a small hamlet of roughly 100 homes just outside the city of Peachland, British Columbia. Our community is part of the Regional District of Central Okanagan (RDCO). We live in a narrow valley that we refer to as Paradise Valley that butts up to the city of Peachland but is not part of Peachland. I am writing to you today in hopes that you will look into recent events that will dramatically effect the future of our community. Recently The Province of British Columbia and the Regional District of Central Okanagan held private meetings with the Westbank First Nations to give them land at the upper end of our valley. These meetings were all conducted in secret, behind closed doors, all without the knowledge of our community. We were never notified by mail or by email. We we never given even an unofficial heads up. There was no official notification in any of the newspapers. There was no consultation process. We were completely blind-sided of what was about to happen. We really only got word of this when the residents here received a letter in the mail from Westbank First Nations of their intention to commence logging our watershed. So I ask you, does “the duty to consult” only work one way? For decades now there has been gravel extraction out of three gravel pits in our valley. This has been to the great benefit of Peachland, West Kelowna, Westbank First Nations and the city of Kelowna. Millions of dollars of gravel has been driven past our homes down the valley and continues to this day. Our community has not receive so much as a thin red cent of this revenue. Our community does not have a water system. The District of Peachland draws water above our community and their water flows past our homes every day. Billions of gallons of water have been
drawn out of our valley. Peachland refuses to even consider installing a couple of fire hydrants along the water line that runs right through our community. This brings me to my next point, we have no fire protection. We have discovered that as part of the secret deal with Westbank First Nations that the city of West Kelowna’s fire department will respond to fires on this newly acquired land. West Kelowna is perfectly fine with having their fire trucks drive right past our community to put out a fire further up the valley but our homes can simply burn to the ground. With this land acquisition our community has been bookended with the City of Peachland on our East side and now Westbank First Nations on our West. Our community has no way to grow. We will never be able to raise the capital to pay for our own infrastructure. Our community has been simply set up to fail. We are beginning to lose hope as these local governments continue their infighting, all of them bickering over funding and resources amongst themselves. All of them narrowly focused of what is in their own selfish interests. Small communities like ours get lost in the shuffle as they barrel right over top of us. Now we can look forward to even more resource extraction out of our valley with logging trucks added to the many gravel trucks barreling past us. Of course no benefit to us. I guess my daughter and grand daughter that live with me will have to run the gauntlet of trucks as we get her off to kindergarten. Does any of what I am telling here seem in any way equitable to you? My hope is that you kill this land deal and make these governments conduct a proper process with ALL affected stakeholders even it means that they have to start the process all over again, right from the beginning. Dear editor: Democracy has been denied to date by this Mayor and the majority of Council, which consistently refuses to listen to the taxpayers of their town at well advertised Public Hearings, resorting instead to not answering taxpayers questions, delaying meetings until 11pm, interrupting citizens attempting to speak, insulting them by name in the press, banning dissenting councilors from meetings, calling the RCMP when the meeting room they have booked is too smalleven though the local press had forewarned of a large turnout- and making ridiculous, melodramatic claims in the local paper that do not stand up to even basic scrutiny, timed to coincide with and distract from their latest rulings in defiance of the community’s expressed wishes . This is behaviour more suited to an episode of Jerry Springer than Public Office. Bullies attempting to portray themselves as victims, like the person who gives you a cheap shot below the belt in a match and then either dives or goes crying to the ref when you retaliate. Whether on a soccer field, a hockey rink, a boxing ring, or in the public arena, the behaviour is the same, only the venue has been changed. Why have public hearings if you are not going to listen to the public? Why try to pass off, through a Planning department with multiple 6 figure
salaried management that this Community is paying for, a new OCP which has no height restrictions on Beach Avenue when it is abundantly clear, in Public Hearing after Public Hearing, that that is clearly not what the community wants? Community plans should reflect what the Community wants, not some watered down, nebulous BS contracted out and cobbled together in spite of the Community wishes. I believe and hope the Peachland Community will retaliate in spades this October at the ballot box. Simply ask all potential candidates what their position is on a referendum on height restrictions on Beach Avenue. Depending on their answer, or lengthy non answer, you will have a clear indication of how to vote on the future look of Peachland. Peachland is the most beautiful town in the Okanagan Valley. Let’s have the collective courage to keep it that way. Don’t let the outgoing Mayor and Council ruin it forever because they simply, continually refuse to listen. On a personal note, we live here, our children are moving here and our grandchildren will be raised here. We believe we owe it, to all those who have come before us and to all those who will come after us, to do our best to make sure this town remains the most beautiful town in the Okanagan Valley. The efforts of long time Peachlander, Keith Nixon, with the assistance of the Regional District and a partnership with the Peachland Watershed Protection Alliance have organized a volunteer clean up for the large dump site left behind this winter after 2 squatters were arrested for mail theft. Trepanier’s ”Bonnie and Clyde” abandoned a 35’ stolen RV, chemicals including hydrochloric acid and methyl hydrate, a rudimentary drug lab, a gold smelter, household garbage, scores of propane tanks, structures and filth after they called the banks of Trepanier Creek, one kilometer from the water intake, home for 7 months. During last week’s council meeting, the decision to cut down three cottonwood trees came up. Staff made the assessment to take out the trees based upon a fair bit of research, but evidently no substantial reason or problem solving effort. Staff claim to have conducted a “risk assessment” under international standards, and they gave reasons that they thought the trees should go. There was no indication that they considered hiring someone like Asplundh Tree Services - who only have 90 years history in this kind of thing! The money wasted on a contract with BCHydro could have paid for Asplundh to trim and manage our trees on Beach Avenue. I’ll be talking with Asplundh to confirm their expertise in this area. Try fighting face-to-face Dear editor: Regarding the ongoing battle between PWAC and Ron Barkwill – what a delight it was to see that there were no comments in last week’s paper from those two. It’s time they stopped the back bitting, back stabbing, name calling. These two have good points but really is this the place for childish behaviour? We are undertaking an immediate wetland health assessment in the upper watershed area near Wilson Lakes’ former recreation area. Volunteers will be using the newly released Forest and Range Evaluation Program wetland protocol. This protocol was developed to allow persons with basic working knowledge of marshes to evaluate the health of wetland sites close to industrial activities. The information collected will assess potential threats to the wetlands from the surrounding watershed area (primarily changes in hydrology and sedimentation) from forestry, cattle and recreation. Indicators for moose and aquatic habitat will be used. The findings will be used to develop prescriptions to mitigate any adverse impacts on our precious wetlands. If you are interested in learning more about wetlands and their conservation or just want to volunteer some time in your watershed, please join us. The community’s most vibrant lifeforms were all on display last weekend during the Peachland Art and Garden Tour, when floral lovers toured nine homes belonging to the finest local gardeners. Those taking the tour could be eligible for a draw by visiting all nine gardens and proving it with a stamp from each one.
The winners are: Kathy MacKenzie, Mavis Richardson, Sue van Noortwyk, Trudy Boos, Jenny Bessel, Barbara Mandau, Jan Langton, and Sue Drexel. Prizes were donated by Lee Valley Tools, Poolside Retreat in Peachland, The Greenery, Little J’z Gardening, and The Wellness Centre.

Local MP Dan Albas introduced a private member’s bill to help protect the assets of parents with disabled children. To keep creditors from collecting the fortune of a disabled person’s late parent(s), Albas’ bill, if it passes, will amend the Bankruptcy and Insolvency Act to protect RESPs and RDSPs from seizure by creditors in the case of bankruptcy or insolvency. The bill would seek to provide clarity to creditors on how to treat Registered Education Savings Plans (RESP) and Registered Disability Savings Plans (RDSP). Specifically, it would legislate that they are not vulnerable to creditors similar to how RRSPs and RRIFs are currently protected. Currently, provinces decide how to treat these registered savings vehicles. Reasonably, a trustee in bankruptcy can permit creditors to seize the holdings of any RESP or RDSP in the event that the account owner files for bankruptcy; this can include accounts dedicated to child dependants whose parent or guardian is the bankrupt. C-410 will prevent this from happening. “RESPs and RDSPs are important tools for Canadians living with disabilities and Canadian families saving for their children’s education.” said MP Dan Albas. ”I’m proud that with this bill, Canadians across the country will have the peace of mind that these essential savings vehi-
cles are protected.” Albas added that, “Bill C-410 is a way to honour the groundwork that was laid by the late Hon. James Flaherty who created the RDSP savings account. He was a loud advocate for people to save; for families dealing with the high costs of caring for a family member with disabilities and for parents who want the best possible education for their children. Bill C-410 makes sure that those hard-earning savings remain off limits to creditors.

Some readers are wondering why PeachTree Village hasn’t broken ground yet. In August 2015, owner Gaetan Royer told the Peachland View he hoped to break ground by the spring of 2016. “When will you break ground?” was the most frequently asked question during
a public information session in March 2017. During the period of public consultation, the website said PeachTree hoped to break ground by the fall of 2017. It’s now the summer of 2018. The District’s planning director Cory Gain said a few permits still need to get approved, and although “we haven’t seen him advance
those applications,” she said it’s common for a developer to “go off and take care of his financing.” An email to Royer was not responded to by press deadline. Many residents protested a bylaw that was amended in February which allows the controversial project to exceed a maximum height of three storeys along Beach Avenue.
