Police believe the camera was either lost of stolen before they recovered it. “Investigators have since exhausted all efforts to identify the rightful owner, of what police believe to likely be a stolen Go Pro camera,” said Cpl. Friends of Beach Avenue forms to legally challenge District’s PeachTree decision VIEW STAFF Opponents of PeachTree Village are hoping to take the District to court by challenging the legality of a five-storey building along Beach Avenue.

A group called Friends of Beach Avenue Peachland BC have hired a lawyer to defend the Official Community Plan, which calls for buildings to be no taller than three-storeys tall on the waterfront properties.

Friends of Beach Avenue member Randy Brophy said the legal challenge was filed on Wednesday morning in Kamloops.

Beyond the issue of building height exceeding the limit prescribed in the OCP, the Friends of Beach believe due process was not followed during the public hearing process. In the lead-up to approving the project, the District was dealing with a state of emergency due to flooding; third reading to rezone was passed late at night

during a marathon council meeting; and Brophy says a petition with 985 names (at least 520 confirmed Peachlaners, he says) wasn’t given proper consideration.

“I feel betrayed,” Brophy said.

“It’s really unfortunate that this small group of people are against what is going to be a beneficial development in the downtown core,” Mayor Cindy Fortin said.

“If this suit goes through – win or lose – it’s going to

end up costing the taxpayers of Peachland.”

Fortin worries the legal challenge could deter other potential developers from investing in Peachland.

“I take a moderate stance – I don’t want to build the whole core up but we need some new development to brighten up the town.”

As of press deadline, Fortin said the District had not yet been served with legal notice. But whether or not the municipality finds itself

in court, she doesn’t believe council stepped over any legal boundaries.

“The OCP is just a guideline, it’s not written in stone.

It’s just a vision.”

Gaetan Royer, the man at the helm of PeachTree, said he hadn’t been serviced with legal notice as of Wednesday afternoon.

“I’m not aware if this is true or not but if it’s going to a legal process then I can’t comment on it,” he said.

Peachlanders don’t take kindly to the thieves who have been targeting local properties.

Strangers who claim to be canvassing contractors or confused wanderers have been arousing suspicion of locals, especially in light of numerous robberies in recent months. It’s believed that many of the victimized properties were scouted out by professional criminals.

Members of the Peachland Community Policing have responded by extending their patrols of the District into later hours of the night.

“It’s important that people under-

stand the severity and it is ongoing,” said Community Policing member Janis Brown. “We’ve begun showing a stronger presence, and we still do day patrols too.”

Brown says anybody who witnesses suspicious behaviour around town should phone the police, get a licence plate number if application, and report the circumstances.

The RCMP constantly remind the public to always keep their car doors locked, as the majority of theft reports come from unsecured vehicles.

“People should be keeping valuables in their homes overnight, not in their cars. And make sure garage doors are

Drunk driving grandson was actually a scammer VIEW STAFF An elderly couple who went to bail their grandson out of jail almost became victims of the “Grandparent Scam.”

But when they showed up to the cop shop with $1,000 cash, “It did not take long for the Kelowna Mountie, assigned to assist the elderly couple, to determine that their grandson was not in police custody and the couple were likely being targeted by a scammer,” said Cpl. Jesse O’Donaghey.

“Following our officer’s recommendations, the couple called and spoke to their real grandson, who thankfully confirmed he had not been involved in any crash. Fortunately the man and woman did not

lose any of their money.”

The older couple got a phone call from a scammer pretending to be their grandson who claimed to have been involved in a serious car accident. The faux grandson said he had a broken nose and was arrested for drunk driving. His plan was to get the grandparents to wire the money electronically, which of course they did not do.

“Victims of the Grandparent Scam or Emergency Scam typically fail to verify the story until after they have transferred the cash to the caller. Often times the fraudster, who seems frightened, will ask the victim not to tell other relatives.”

Brown has become very staunch about protecting Peachland after becoming the victim of a burglary herself.

“So now we have to have cameras and security sensors – we feel like we’re living in Fort Knox and this is Peachland.”

Like disparate characters in a Humphrey Bogart film, elected representatives, lobbyists, and private citizens continue to articulate and advance a broad range of opinions and recommendations regarding the implementation of one of Canada’s most controversial pieces of legislation in modern history, the legalization of cannabis.

We’re less than eight months away from the implementation date, July 1, 2018, and there are still literally hundreds of advocacy groups and politicians from all three levels of government who feel compelled to add something to the legalized weed conversation.

It’s no secret that most provinces are behind the eight ball when it comes to having a regulatory framework in place for cannabis licensing, distribution and sales. As I’ve stated in my earlier columns, the provinces and federal government have failed to adequately prepare for 2018. (Example: the BC government’s allowable timeline for public feedback and stakeholder engagement was only five weeks, hardly enough time for individual citizens and community groups to prepare their submissions.)

Throughout the national debate there exists a great deal of misinformation, uncertainty, confusion—and yes, even smidgeons of disingenuousness by politicians claiming that the focus is not on tax revenue generation. But as citizens, let’s show our astuteness by acknowledging that the sale of legalized marijuana is indeed about generating and maximizing tax revenues.

Enter Bill Blair, the Liberal MP, a former police chief of Toronto, who is spearheading the cannabis legalization process for the Trudeau government.

Blair and his colleagues are proposing

a federal excise tax of $1 per gram of marijuana or 10 per cent of the final retail price, whichever amounts to more.

Revenues will be split 50-50 with the provinces.

Accusing the federal government of “smoking something,” Alberta’s finance minister, Joe Cici, rejects the split, suggesting that all the revenues should go to the provinces since they will bear all the costs of implementing and overseeing legislation, enforcement, distribution and retail sales.

“The taxation is one small part of it,” explains BC minister of public safety and solicitor general, Mike Farnworth, adding that a lot of regulatory work still needs to be done, including amendments to various provincial statutes.

Even municipalities want a piece of the action. Kelowna mayor, Colin Basran, advocates a financial model that is similar to revenue sharing of gaming funds.

While the BC government hasn’t yet determined who will be licensed to sell cannabis, the government of Manitoba already has given the green light for the Manitoba Liquor and Lotteries Corporation to oversee the distribution of cannabis in the province while private retail outlets will handle sales, says Premier Brian Pallister. It appears that Manitoba is better prepared than the other provinces—save, perhaps, for Ontario, where Premier Kathleen Wynne has adroitly sewn up the process by designating the Liquor Control Board of Ontario as overseer of marijuana distribution and sales. It’s an astute move, guaranteeing the province exclusive access to cannabis retail sales revenue.

The Cannabis Act allows adults to purchase and possess a maximum of 30 grams of cannabis, although the provinces will have the choice to lower this amount.

Let’s see if any province does.

MEMBER OF PARLIAMENT Last week the Liberal Government announced it would publicly post an online “mandate tracker” where Canadians can see the Governments progress on key initiatives. In theory this a good idea, however in execution the Liberals have come up short on this one and I will explain why.

The first challenge with the Liberal mandate tracker is that it is not based on the promises that the Liberals made in order to get elected.

Rather the mandate tracker is based on the mandate letters to the Ministers of the Liberal Government. For example, the Liberals promised to restore Canada Post door to door delivery. However in the mandate letter to the Minister who oversees Canada Post, only a review of door to door mail delivery was requested but not a restoral of service.

The other challenge I have with the mandate tracker is that the Liberal Government themselves decide how much they have actually accomplished.

In other words, it is not the Parliamentary Budget Officer or any other independent and objective department providing this information.

Also this week we learned the long awaited details of the Liberal Government’s new peacekeeping measures. As some may recall during the election, Mr. Trudeau had suggested that Canada was out

of peacekeeping business and promised an increase in Canadian peacekeeping forces.

This promise led to a commitment from the Prime Minister before the 2016 UN Peacekeeping Defence Ministerial Conference in the UK, to provide up to 600 troops and 150 police for a specific deployment that was promised to be announced at a future date.

Today we know this 2016 commitment will be yet another promise that is not fully honoured by this Prime Minister. Instead only 200 personnel and 50 police will be provided in primarily training and transport roles. There will be no specific deployment zone despite many promises and overseas trips to explore potential peacekeeping opportunities over the past two years.

I am not suggesting that Canada will not continue to serve a useful role in UN peacekeeping operations with this significantly reduced commitment. My observation is that once again we see a pattern where Mr. Trudeau is pleased to make a significant announcement with a photo opportunity, as was done in the 2016, only to move the goal posts at a later date.

My question this weekshould the Prime Minister have fully honoured his 2016 commitment to the UN Peacekeeping Defence Ministerial Conference?

Won’t forget about PeachTree Dear editor: I agree and applaud Bud Day’s endorsement of Randy Brophey for council in in last week’s View letter to the editor.

November 2018 will undoubtedly bring some necessary housekeeping to this current council chambers.

However, I disagree that all a Councillor needs to keep their chair in this town is to be “conscientious and well meaning.”

My Labrador retriever is well meaning.

As a taxpayer, the least we expect of our elected officials is that they be informed, educated and active in the issues, in attendance at all meetings and functions. transparent, and paramount, our mayor and council need to listen to

the people.

If that is not happening, taxpayers will feel compelled to continue until they are satisfied they are being heard.

The OCP states three stories is high enough along Beach Avenue, council have disregarded that mandate, setting a development precedent along our lake shore that will negatively impact the essence of our village.

So, to Mr. Day and the rest of Peachland who think it “is time to move on” with the opposition to PeachTree, think again, in the now infamous words of Mayor Fortin, the situation “will stick out at first, but people will get used to it.”

Crack down on creepy politicians Has sexual harassment among Canadian politicians become so prevelent that we need new legislation to cut it out?

Bill C-65, which was tabled earlier this month, seems to be addressing exactly that.

I never considered the people who work on Parliament Hill to be a vulnerable bunch since they’re well paid and educated. Also, existing laws were already protecting them from sexual misconduct. So why do parliamentarians get more protection than the general public? Is there really such a thing as

legislation that can make creepy co-workers go away?

There’s probably an ulterior motive at play. Maybe the Liberal Party is trying to score some publicity by dealing with a sensational issue that Hollywood celebrities dragged into the headlines.

Prime Minister Justin Trudeau likes to position himself as a feminist gentleman, and Bill C-65 does a good job painting that picture.

Dear editor: Surely the Mayor & Council are not seriously thinking that “voluntary compliance” will work?

Many Peachlanders currently ‘tolerate’ the rule breakers, as saying something to them may be hazardous to our health.

Apparently our bylaw officer confirmed this by quitting. The dog walkers who are tourists/out-of-towners don’t come to Peachland to squeal on others and many others come because there is no enforcement of rules.

“What We Tolerate, We perpetuate” and it happens all too often in Peachland with many things.

The Mayor also indicated that we need to change some of the regulations. She says “ease the rules to give the dog walkers more freedoms. I can only assume she owns a dog?

Peachland’s Beach Avenue walkway is a place where everyone can come to enjoy a beautiful walk and are also allowed bring their dog. It’s a place that the residents paid taxes for and we continue to pay taxes for the doggy poop bags, garbage pickup and poop pickup which seems pretty nice of us, especially if we don’t own a dog.

The Beach Avenue walk was not intended as, and is not a proper area for dogs to ‘play’. As is with goose poo, kids, shoes and dog pee and poo do not mix! There are dog parks that allow dogs to be off-leash and run free nearby.

The Mayor and council should consider all residents & tourists wanting to enjoy the Beach walkway who don’t own dogs. We, already have to move over to allow dog and owner to pass or get mowed down because the dog wants to walk on the wrong side of the sidewalk, or someone is walking multiple dogs, or watch for leashes wrapping around our legs, or dogs not on their leash that charge up and makes one wonder if they

are friendly or not.

There’s also the problem of the dog poop laying on the Beach walkway that owners ‘don’t see’ their dog do-do.

What is needed, in my opinion is “enforced rules” on Beach Ave so I suggest we get someone that has experience in enforcing them.

There are *many, many regulations being broken on Beach other than the ‘dog’ regulations, so advertise and pay for someone that knows how to handle those smartmouth people and verbal abuse.

Thousands of cities/ towns in many civilized countries have bylaw officers, so Peachland should first find out why ours don’t stay.

Council needs to stand behind this bylaw person, letting them do their job and get things under control.

Dog signage on the Beach Avenue walkway is so poor. Small signs, wrong locations and confusing to figure out, even if you’re from Peachland.

The signs are not visible to the people who have their dog down at the water’s edge or swimming in the lake (so they tell us). It’s also easier to break the rules and be forgiven then it is to walk up to the sidewalk to figure out if the dog can be on that area of beach.

Wondering if a dog running up to me was supposed to be onleash or not, I found it

confusing to decipher the signage, even taking the time to study them.

While walking in the evenings, we have seen people allowing their dogs off leash in areas marked “Dogs to be on Leash”. We see a number of people allowing their dogs to swim in the water where there are clearly signs indicating “no dogs on beach”. One X-councilor is a habitual rule-breaker allowing his dog to swim many evenings.

There are many people who seem to be ‘tourists’ that let their dogs onto the beach areas. I would read the sign out loud (so they heard) that indicated the dog should be on leash and not on the beach but I would get a “look” but they stayed.

Considerations: 1) The access to the water is now limited due to the big rocks placed on Peachland’s beach so is it necessary to allow any dogs to go onto the beach or into the water?

These limited access areas should be used for people wanting to get to the water.

2) Can we have peo-

ple using the Beach walk with their dogs, keep their dogs onleash at all times?

It is not a park but a “walkway” for “people” to enjoy. I don’t think the dogs mind.

3) Voluntary compliance won’t work. I for one would never approach someone breaking the rules.

It’s a matter of time that you’ll get a drinking tourist punching out a ‘good citizen’ who tells him to put his dog on a leash.

Is there a liability to the District of Peachland because the Mayor & council are encouraging residents to call out a person breaking the rules? Hmmmmm.

4) Get a real Bylaw Officer who is experienced and enduring and for heavens sake stand behind him.

There are so many other important offences that need to be addressed too along Beach Ave that he/ she will have to handle. Make sure they are capable.

5) Please don’t ease the regulations. Dogs already rule the walkway!!!!!

sible for replenishing the entire valley’s fish stock. So far, their resistance is successful.

Some residents in Lake Country formed Save Gable Beach, and are voicing their surprise and anger with council, while the government in Lake Country, during closed door meetings, considers selling a portion of public beachfront to private homeowners for $1.34 million.

Kelowna residents too are still opposing council’s January approval to build a tourist information centre on donated waterfront land specifically designated for parks. This large resident’s group has vowed to continue their challenge to overturn this decision, Communities and residents groups up and down the valley are rising up to speak out and defend their parks, green spaces, public access, vistas and water features— Peachland included.

Residents understand the Official Community Plan states 3 stories along Beach Ave is the recommended height and should be followed; also, the pertinent zoning bylaws for parking and setbacks should apply.

One neighbour along Beach Avenue stated. ”If PeachTree was any closer to the lake, it would be designated as a houseboat!

Yet, our council chose to approve the PeachTree development of 5 stories, limited parking and no setbacks.

The process of the OCP required intense public consultation: because our mayor and council have not adhered to this plan, some taxpayers feel they are not being heard, believing their council is in breach of duty.

The residents have spoken, the precedent of five and ultimately seven-storey high-rises along the village waterfront is not desirable nor acceptable in OCP deliberations, nor for the future character of Peachland. It appears this issue, like many others along Lake Okanagan, will continue to be challenged.

PIER PROJECT GROUNDBREAKING – Anglers have been anticipating this weekend for years. Members of the Peachland Pier Project are inviting the public to their groundbreaking ceremony this weekend. The

ceremony takes place at 1:30 p.m. at Heritage Park on Saturday, and the 50+ Activity Centre will be hosting a reception afterwards.

One of the toughest challenges we can have when our dog is off leash is getting them to come back to us using a cue. In the dog training world this is known as a ‘recall’’.

There are various reasons for a dog not recalling on cue and none of it includes the dog being stubborn, insubordinate, spiteful or dominant.

Non-compliance is often one or more of the following: • The dog didn’t hear the cue • The dog is not able to complete the task due to an impediment, perceived impediment or injury • The dog doesn’t have a grasp of what the cue means (training not completed) • The dog has not been trained to perform the behaviour in more challenging environments • The recall cue has been ‘poisoned’ All these can contribute to a weak or non-existent recall but what I see most often is failure to complete the training and unrealistic expectations of compliance in environments that are more distracting and challenging for the dog.

Firstly, there are two things to note: 1. Recall is the behavior of the dog moving towards you, returning to you upon the cue ‘come’ (or another chosen cue which is NOT their name) 2. Dogs are NOT born knowing the cue ‘Come’. You need to teach it!

3. The world outside your home is your biggest competition. The environment has many more interesting smells, sites, natural distractions (squirrels, humans and dogs) and the natural instincts that apply to dogs are to seek; to go forward and explore.

In most cases, lack of compliance to the recall cue simply means that the recall hasn’t been taught or something else is more important than you. In the dogs mind, the choice to come when called comes down to this: What is more important? Eat poo? Roll in fish? Greet someone other than my guardian? Or, return to my guard-

ian? Which one benefits me the most? Which one will make me feel good? You need to teach him/ her that choosing you each and every time will reap greater rewards.

This takes work and time and includes building a good relationship in all aspects of your dog’s life because at the core of a great recall is the trust between you and your dog.

A killer of good training happens when dog behavior is taken personally. Labels and excuses don’t serve the dog in any way except that they never learn to recall in tougher environments. When guardians fail to get results due to lack of follow through in recall training, they may resort to punishment based training to gain wanted results.

Anytime you take your dog off leash, you may be throwing your dog into the deep end before he’s ready to swim. Dog parks are an example where dogs are set up to fail. Dogs are called over and over and guardians have no control.

This is where training up to that point is undone because the dog has be put in an environment that is more interesting than his guardian. Yet, people continue to take their dog to the dog park or off leash areas only to see the dog fail the recall over and over. You’ve probably gone down a notch or two, in your dog’s world, as far as importance is concerned too.

Another aspect of dogs to remember is that dogs don’t generalize so just because your dog knows his name and the cue inside the home doesn’t mean it transfers outside.

You must train your dog that ‘come’ inside also means the same thing outside, on the trail, in the dog park or wherever you take him or her and allow them to be off leash.

Building a great recall takes time, consistency, patience, and should be built slowly in easy environments first before it’s taken outside and off the property. When a dog is off leash, he or she has freedom. They are free to make choices and if you’re going to let your dog off leash, it’s important to know this and accept the consequence of it. If anything happens, that responsibility lies with you.

Devastating flood brings United Church back to the drawing board

floor that suffered major damage after this year’s extreme flooding. This calls for a big reno – so McLean is asking the community what they’d like to see.

VIEW STAFF One of the great lessons from the Book of Genesis is that a historical flood is the perfect opportunity for a fresh start.

And after an unprecedented amount of local flooding experienced earlier this year, the Bargain Bin was forced to evacuate from its location in the basement of the Peachland United Church.

“United Churches all over the country are facing challenges, so this is a good time to step back and re-evaluate,” said Pastor Ian McLean.

During this period of reflection, it’s time to ask, “What does Ministry look like here for Peachland United Church – now and in the future – and how does that link with the facilities we already have?

The basement of the church was a sturdy foundation built of stone. After holding up for over a century, the building’s bottom floor finally succumbed to the elements amid the flood of 2017 (the main floor was unaffected and regular Sunday services have not been disrupted).

The raw materials were shipped in by boat for the building to be completed in 1911 – even before the launch of the SS Sicamous in 1914.

It was constructed by volunteers at a time

when the words “building codes” meant nothing.

Not only does McLean want the building to conform to modern engineering standards, he wants it to grow into a more comfortable place.

“We want to look at our options” he said.

“Should we move the Bargain Bin back here?”

He wants the public to share their ideas. Currently, the Bargain Bin is still able to operate on site, it’s new location is in the hall next to the church. McLean is asking Peachlanders if they prefer it up there, or if they would rather see it return to the basement. But if the thrift store takes up permanent residence in the hall, the basement can be freed up to serve the community in other ways.

“Maybe this is a blessing in disguise. Let’s take a look at what it means to be a church in the years ahead.”

McLean is asking for the entire community to weigh in, not just members of the fellowship.

BC Liberals trying to take too much credit for infrastructure projects DERMOD TRAVIS

INTEGRITY BC www.integritybc.ca There were likely more people on the floor of the legislature listening to it than watching it live on television, but there was an interesting exchange at the legislature last week.

Energy Minister Michelle Mungall was being grilled by her opposition critic, B.C. Liberal MLA Tracy Redies.

First off, it was civil, which in and of itself is noteworthy. Redies posed questions and Mungall – by and large – provided answers.

But a few of those answers lacked – how would you put it – substance, detail.

You can’t necessarily fault Mungall for her answers – some could have just as easily come out of the mouth of her predecessor in the portfolio, former Energy minister Bill Bennett.

And that’s where the fault lies. Not with Bennett per se, but with B.C. Hydro officials trying to be too clever by half.

Mungall agreed with Redies that most capital projects at the utility come in “under budget.”

Huh? What projects? Which budgets, the original or the one made available at the ribbon cutting ceremony?

Here’s what Hydro’s former president and CEO, Jessica McDonald, had to say on the subject in November 2015: “BC Hydro has completed more than 550 infrastructure projects between fiscal 2011 and fiscal 2015, and collectively, these projects were delivered more than $71 million under budget.”

Wow. That’s more than two infrastructure projects a week for five years.

Can you imagine the number of environmental assessments, applications to the B.C. Utilities Commission, calls for proposals, tenders that would have been required?

Suspect the word smiths at the utility may have been playing around a bit with the definition of infra-

structure and project.

So off in search of the Holy Grail.

Flipping through the pages of past provincial budgets, it turns out 43 projects at the utility – valued at more than $50 million in capital expenditures – were approved by the Liberals while in power.

They run the gamut from a generator stator replacement at the Mica Dam first estimated at $52 million to Site C, estimated at $7.9 billion less than three years ago.

The new stator ended up costing $89 million, according to the government’s three-year fiscal plans, and Site C is currently at $9.4 billion, a jump of 19 per cent since 2014 or nearly five times the rate of inflation.

Don’t get me wrong, the utility is good at bringing certain projects in on budget.

Projects that might be defined as a utility’s equivalent to changing a light bulb: switchgear replacements, spillway gate reliability upgrades and the like.

But when the first estimate for a project exceeds $100 million, not so much, and particularly when there may be far more reliance on outside contractors than there might be with a control system upgrade.

When McDonald was bragging about those 550 infrastructure projects, she was also announcing the completion of

the Interior to Lower Mainland Transmission Line.

In keeping with the bragging rights theme, McDonald announced that “the final cost of the line is expected to be $743 million – about $18 million higher than BC Hydro’s original budget of $725 million.”

One problem: the original budget was first announced at $602 million and the $743 million price tag may not be final, pending an arbitration with the contractor.

Something else of note from the exchange between Mungall and Redies

was the minister’s agreement that if everything stays on course Hydro’s deferral accounts will peak at $5.9 billion in 2019.

One could be forgiven for thinking the Liberals felt the minister should send celebratory cake to the utility.

The former government was routinely chastised for the accounting practice and this September auditor general Carol Bellringer issued a qualified opinion over the government’s financial statements for 2016 and 2017 as a result.
