President’s Corner As we enter March, it is a good time to provide an update to all homeowners on the collection process. As of February 16, 2012, the HOA mailed collection letters to 211 Chandler Creek Homeowners who had not yet paid their 2012 assessments. This represents $58,025.00 in unpaid assessments and $4,036.43 in collection costs that have been added to those accounts. When reviewing the list of homeowners, we see quite a few of “repeat” late payers. Those who received the 1st collection letter will have 30 days to pay their balance in full or request a payment plan. On March 17, 2012, any homeowner that has not yet paid their assessment balance or requested a payment plan will have a lien filed against their property and the cost of preparing and filing the lien will be added to their account balance. This fee must be paid and will not be waived! Once the lien is recorded at the County Courthouse, a 2nd letter will be sent giving them 10 days to pay their balance. If their balance goes unpaid after 10 days, their account will be turned over to the HOA’s attorney for collection. Once the account is turned over to the attorney, the homeowner will have to deal directly with the HOA’s attorney regarding the account. It costs $25.00 to enter into a payment plan with the HOA and Alliance; however, once at the attorney, a payment plan will cost, at a minimum, $100. Please avoid these extra collection costs by preventing your account from going to the attorney. While the HOA recognizes that some homeowners do not like the collection policy and the actions that are taken, the HOA also realizes that it is not fair to those homeowners who do pay on time for the HOA to not take any action regarding delinquent accounts. At the date of this writing, there are still signs posted in the neighborhood reminding homeowners that assessments were due in January. The annual statements were also mailed in early December 2011 in order to give all homeowners plenty of notice and to plan accordingly. If you are one of the 211 homeowners who have not yet paid your assessments, please do not ignore the collection notices (which are mailed via certified and regular mail). Please get in touch with Alliance as soon as possible to discuss your account if you are not able to pay in full.

According to the latest community park survey conducted at the Fall Festival, one of the most requested items was additional trails and lighting • New Benches will be added to the sand volleyball court area. • Bleachers will be added to the basketball court area including a canopy for shade • Several new trees have recently been installed to help shade the playscape area. Several other projects are underway stay tuned for updates. WHAT YOU NEED TO KNOW ABOUT MUNICIPAL UTILITY DISTRICTS

What is a MUD? A Municipal Utility District (MUD) is a political subdivision of the State of Texas authorized by the Texas Water Code to provide water, sewage, drainage, and other services within the MUD boundaries. Why do we have MUDs? During the 1970’s, Austin voters defeated several bond issues to finance the extension of city services to new subdivisions. MUDs became the most practical and least expensive way to provide services to new subdivisions. Without MUDs, people wanting new homes would have to live in nearby towns, or in rural areas dependent on wells and septic systems for water and wastewater. How is a MUD created? A majority of property owners in the proposed district petitions the Texas Commission of Environmental Quality (TCEQ) to create a MUD. The TCEQ evaluates the petition, holds a public hearing, and grants or denies the petition. After approval, the TNRCC appoints five temporary members to the MUD’s Board of Directors, until an election is called to elect permanent Board members, to confirm the MUD’s creation, and to authorize bonds and taxing authority for bond repayment. How does a MUD work? The publicly elected Board of Directors manages and controls all of the affairs of the MUD subject to the continuing supervision of the TCEQ. The Board establishes policies in the interest of its residents and utility customers. A MUD may adopt and enforce all necessary charges, fees, and taxes in order to provide district facilities and services. Will my taxes be higher in a MUD? Some older established MUDs around Austin have tax rates more than 22 percent lower than those of the City. MUD tax rates, like all property tax rates, vary according to property values and debt requirements. MUD rates generally decline over time as the MUD is built out and the operating and debt service costs are shared by more homeowners. (Continued on Page 6) Copyright © 2012 Peel, Inc.

How do MUDs provide for parks, pools, and recreation facilities? In addition to their common functions of water and wastewater service, MUDs are legally empowered to engage in conservation, irrigation, electrical generation, firefighting, solid waste collection and disposal, and recreational activities (such as parks, swimming pools, and sports courts). A MUD can provide for itself the recreational amenities that are approved by the Board of Directors and funded by the District. What is a developer’s responsibility to MUDs? Developers must petition the TCEQ to create a MUD. Developers are prohibited from serving or placing employees, business associates, or family members on the MUD Board of Directors. Developers must pay for or put up a letter of credit equal to 30 percent of the cost of subdivision utilities. This requirement insures against “fly-by-night operators” who are not committed to the success of the MUD. The “30 percent rule” also offers protection to MUD residents in the event that a subdivision is not built according to schedule. Unless they are voting residents within a MUD, developers have no authority or control over the MUD’s Board of Directors. If they are voting members of a District, they have the same power to vote and attend Board meetings as any other resident.
