President’s Corner As we enter March, it is a good time to provide an update to all homeowners on the collection process. As of February 16, 2012, the HOA mailed collection letters to 211 Chandler Creek Homeowners who had not yet paid their 2012 assessments. This represents $58,025.00 in unpaid assessments and $4,036.43 in collection costs that have been added to those accounts. When reviewing the list of homeowners, we see quite a few of “repeat” late payers. Those who received the 1st collection letter will have 30 days to pay their balance in full or request a payment plan. On March 17, 2012, any homeowner that has not yet paid their assessment balance or requested a payment plan will have a lien filed against their property and the cost of preparing and filing the lien will be added to their account balance. This fee must be paid and will not be waived! Once the lien is recorded at the County Courthouse, a 2nd letter will be sent giving them 10 days to pay their balance. If their balance goes unpaid after 10 days, their account will be turned over to the HOA’s attorney for collection. Once the account is turned over to the attorney, the homeowner will have to deal directly with the HOA’s attorney regarding the account. It costs $25.00 to enter into a payment plan with the HOA and Alliance; however, once at the attorney, a payment plan will cost, at a minimum, $100. Please avoid these extra collection costs by preventing your account from going to the attorney. While the HOA recognizes that some homeowners do not like the collection policy and the actions that are taken, the HOA also realizes that it is not fair to those homeowners who do pay on time for the HOA to not take any action regarding delinquent accounts. At the date of this writing, there are still signs posted in the neighborhood reminding homeowners that assessments were due in January. The annual statements were also mailed in early December 2011 in order to give all homeowners plenty of notice and to plan accordingly. If you are one of the 211 homeowners who have not yet paid your assessments, please do not ignore the collection notices (which are mailed via certified and regular mail). Please get in touch with Alliance as soon as possible to discuss your account if you are not able to pay in full.
