This year there are both national and local elections of importance.

Please be aware that Texas has passed a new voter ID law which could be in effect for the November elections.

This law requires a voter to show a photo ID and this is limited to a valid driver’s license, passport, military ID or other acceptable ID. If you or a loved one needs to renew your driver’s license or passport between September and November this year, you should be looking into doing so in plenty of time to avoid not having the valid photo ID options required to vote.

If you have moved from some other area within Texas, to register to vote in your current precinct you can go to the Secretary of State's web site at http://www.sos.state.tx.us and change your address online Changes for a voter registration application process can take one month. If you miss the 30 day period, you may be allowed to vote in your previous precinct.

The Pemberton Journal AIA Home Tour to Feature Four Local Homes.

Betty Trent, AIA LEED AP The local Austin residential construction market is a bright star in the national economy.

The Austin chapter of the American Institute of Architects will hold its 26th Annual Home Tour the weekend of Oct 6-7.

The Austin tour has gained a national and regional reputation for excellence in residential design. 13 homes will be featured, including four in Pemberton.

The home tour will run from 10:00 until 6 Saturday and Sunday. The tour is self guided and over 5,000 attendees are expected to be wowed by the variety of talent on display at homes from small and affordable to luxurious.

A map showing each home’s location and information on each home, along with resource material, will be available in a brochure with each ticket purchased. Children are welcome and those under 10 do not require a ticket.

Tickets are available at each of the homes on the tour but can be purchased in advance at AIA Austin’s Center for Architecture at 801 W 12th St. or Zinger Hardware at Central Market.

The Pemberton Journal Revisions to Historic Landmark Zoning & Local Historic Districts Candace Volz, ASID

On July 24th, the City of Austin Historic Preservation Office held a stakeholder hearing to receive input on revisions to applications related to zoning of Historic Landmarks and Local Historic Districts that I attended at the request of the board of PHNA. A summary of the proposed revisions follows: 1) - Historic Zoning Application Packet (for “H” zoning)- revisions to instructions to reflect updated code language and revised submittal requirements 2) - Local Historic District Nomination Application & Instructions (for “H” zoning)New application packet to reflect revised submittal requirements 3) - Application for Tax Abatement for Rehabilitation of Property in a Local Historic District- New application packet based on code language establishing a Local Historic District tax abatement program Pemberton Heights is part of the largest National Register Historic District in the state of Texas, the Old West Austin National Register Historic District, established in 2003. In addition to this federal designation, 45 of our approximately 650 homes are zoned “H” because they are City of Austin Historic Landmarks. Austin currently has 567 “H” zoned properties; there is a link to a listing of these properties on the City’s Historic Preservation page: http://www.austintexas. gov/department/historic-preservation.

Austin’s several decades old Historic Landmark program is administered by the City Preservation Office, whose staff can be contacted at 974- 6454 (Steve Sadowsky, Historic Preservation Officer); 974-7801 (Alyson McGee, Deputy Historic Preservation Officer); and 974-2727 (Victoria Haase, Administrative Specialist).

Historic zoning (“H” zoning) is an overlay added to the base zoning of a specific tract of land. To qualify for City Historic Landmark status, a property must meet one or more (but typically 5 or more) of the local historic criteria (descriptions are truncated for space reasons; for complete information contact

the City Historic Preservation Office): 1) - The property is at least 50 years old & represents a period of significance of at least 50 years ago.

2) - The property retains a high degree of integrity, as defined by the National Register of Historic Places 3) - The property is individually listed in the National Register of Historic Places, or is a designated Recorded Texas Historic Landmark., or demonstrates significance in at least 2 of the following categories: Architecture; Historical Associations; Archaeology; Community Value; or Landscape Features Once designated, all proposed exterior site and building changes (other than routine maintenance) to a historicallyzoned tract require advance review and approval by the City Historic Landmark Commission (HLC). A copy of the HLC’s review standards is available from the City Preservation Office. City Historic Landmark properties that are in good repair and in full compliance with the City historic review requirements are eligible annually for a historic property tax exemption.

Also presented at the stakeholder meeting on July 24th was the draft of the new City of Austin Local Historic District Nomination Application & Instructions. In addition to it’s status as part of a National Register District, all or a part of Pemberton Heights could elect to become a Local Historic District (LHD), which is a geographically or thematically-defined area possessing a significant concentration of buildings united by their history and/or architecture.

Much of the research and evaluation already undertaken for our National Register District would be applicable to an LHD application.

In Austin, LHD’s are zoning overlays called “historic area combining districts” that set forth special regulations for the area in a “district preservation plan”. To qualify as a City of Austin LHD, 1) at least 51% of the principal buildings within the proposed district boundaries must be “contributing”

properties, and 2) the owners of at least 51% of the land area inside the boundaries, or at least 51% of the total number of property owners within the boundaries must consent to the nomination for LHD zoning.

As is true in our National Register District, the definition of a “contributing” building is that it is at least 50 years old; was built during the period of significance of the district as defined in the application; and retains sufficient integrity of materials and design to convey its historic appearance. Evaluation of which buildings are contributing to the LHD must be made by a historic preservation professional and approved by the City Historic Preservation Office, a process similar to that undertaken when our National Register District was developed.

A required element of the LHD application and a component that is not part of a National Register District is a “district preservation plan.” It contains “design standards” specific to the district. To ensure that these design standards are followed, the HLC reviews Certificate of Appropriateness applications for demolition, relocation and building permits, exterior changes on properties determined to be contributing to the LHD as well as applications for building permits for new construction. All proposals must comply with the district design standards.

District design standards can be developed by a preservation professional hired by the proposed LHD; by a committee of the proposed LHD, or a template has been developed by Preservation Austin (formerly the Heritage Society of Austin) for use by interested neighborhoods. Design standards prescribe the manner in which historic buildings may be modified to accommodate the changing needs of users. Based on the physical elements of the historic buildings that define the character of the LHD, the goal of design standards is to: 1) - Promote new construction sympathetic to the historic character of the district 2) - Preserve and enhance the historic character of the district (Continued on Page 7)

3) - Protect investment in historic buildings 4) - Improve the quality of design and site planning 5) - Promote well-designed new construction on non-contributing lots Properties in an LHD that undergo rehabilitation are eligible for tax abatement. The draft application for this abatement was also reviewed at the July 24th meeting. This tax abatement is offered to owners of contributing and potentially contributing properties to encourage preservation and maintenance of the architectural character of an LHD. The program abates 100% of the city property taxes assessed on the added value of the property for a designated number of years (7 years for residentially-zoned properties).

Completed improvements must comply with the LHD’s preservation plan. Owner-occupied residential properties must expend at least 25% of the pre-rehabilitation value of the structure to qualify, and at least 5% of the total qualifying expenditure must be spent on exterior improvements. Properties can qualify for this abatement once every 15 years.

The Pemberton Journal Local dog rescue collecting unwanted pet items September 6-9

Wags, Hope and Healing (WHH), a rescue and rehabilitation center for neglected dogs, is collecting new or slightly used pet items from Thursday, September 6, through Sunday, September 9.

The organization recently moved to a remarkable six-acre plot in southwest Austin to better enable them to assist dogs in need. WHH is reaching out to the community to help them prepare for their growing number of rehabilitating dogs and increasing financial costs.
