BOARD REPORT There was no Board meeting on September 4. We instead held a community meeting with Cedar Park officials to answer questions about the proposed limited purpose annexation and get support petitions signed, but turnout was low. ANNEXATION An official FAQ was posted on the community Facebook group (www.facebook.com/ groups/60243129318/) and is included in this newsletter as well. The net benefit is that, with no new taxes, we’ll get significant new city services, including Police & Fire protection, code enforcement, animal control, library services, and access to parks & recreation programming. What's not to like? By now the house-to-house petition drive by Board members is complete and the petitions have been turned in to City officials for validation. We hopefully exceeded our 50% target so the proposal can go forward toward a January 1, 2014 target, and we thank all who met with us. SELF-STORAGE FACILITY A core team representing

Bella Vista and Twin Creeks stays in constant contact with Cedar Park, Travis County and other stakeholder groups to monitor project status and adherence to development requirements. They’ve identified significant barriers that any developer, not just the current one, will have to hurdle in order to build on the property. Follow their actions on the Cedar Park Neighborhood Action Network Facebook page (www.facebook.com/groups/cpaction). WATER RESTRICTIONS Don’t forget to reprogram your sprinklers to only water on your designated day, Wednesday or Thursday, or the City will fine you. The Board still waits on a draft Xeriscaping policy. It will include rainwater collection with relaxed rules for rain barrels, but you must still submit plans to the ACC for approval. Monthly Board meetings begin at 6pm at the RealManage office (10800 Pecan Park Blvd, Suite 100) on the first Wednesday of each month, and a notice will be posted on the Bella Vista website at least 3 days before the meeting.

ANNEXATION FAQS: 1. What is this all about? This is a voluntary limited purpose annexation of the Twin Creeks Water Control and Improvement Districts 1F & 1G and Bella Vista Municipal Utility District (“Districts”) by the City of Cedar Park (“City”). These districts comprise the neighborhoods of Twin Creeks and Bella Vista. 2. What does “limited purpose” mean? This proposed annexation is limited purpose, meaning that residents of Twin Creeks and Bella Vista will be provided essential City services; however, due to the level of the District’s debt payments related to the neighborhood’s infrastructure (i.e. roads, water and wastewater utilities, drainage, streetlights, etc.) residents will not pay the City’s property tax rate. Instead, residents will pay the tax rate set by their District (very similar to current levels). 3. What essential City services will I receive? Residents will receive essential City services including: fire protection, police protection, code enforcement, animal control, parks & recreation programming, and library services. 4. How does this impact my local property taxes? Currently residents of the Districts pay property taxes to several entities including Leander ISD, Travis County, and others. One of these entities is your District, where your tax dollars pay primarily for your District’s infrastructure debt (see #2 for additional detail). Residents also pay Emergency Services District #14 (ESD #14) a tax of $.10 per $100 of property valuation which provides for fire and first responder services from the Volente Fire Department. The limited purpose annexation will remove the Districts from ESD #14, and the Districts will begin collecting that same $.10 in order to pay the City for municipal services, including fire and first responder. This rate will initially be $0.10/$100 but could increase in any given year if the City’s tax rate is increased. This adjustability ensures that cost of service increases are shared by the entire Cedar Park community, including Twin Creeks and Bella Vista. 5. Under a limited-purpose annexation, can I vote in City elections and serve on City Council? Residents under a limited-purpose annexation may vote in general elections, but may not serve on the City Council or vote in bond elections. Upon full-purpose annexation, residents may vote in all elections and run for office. 6. How does the petition process work? Because this is a voluntary annexation, a petition signed by more than 50% of property owners is required. The petition number is based on the number of property owners living in the district. Your Homeowner’s Association members will be leading the petition drive 4

and can answer additional questions about the process. Once the requisite number of signatures have been collected, the petition will be given to the City of Cedar Park (by September 30). Once the petition is received, the City will validate the signatures in order for the process to continue.
7. Can both my husband and I sign the petition? Each property owner listed on the deed – whether husband & wife, parent & child, etc. – may sign the petition. Each individual listed on the deed is a “property owner” and may sign in support of the annexation, and each property owner signature would count towards the “>50%” goal. 8. Must both spouses sign the petition? No. Each property owner may decide whether to sign for themself. If both spouses are listed on the deed, then both may sign as property owners, and both signatures would count towards the “>50%” goal. 9. What if I sign the petition and my spouse does not? If one property owner signs the petition, that signature would count towards the “>50%” goal, even if the other property owner does not sign. A non-signing spouse or co-owner would NOT invalidate the other owner’s signature. 10. What if my home is owned by a trust or other entity? A legal representative of the trust or entity may sign the petition, and that signature would count towards the “50%” goal. 11. What if I’m a tenant, can I sign the petition? No, only a property owner may sign the petition. Any tenant or other non-owner signatures would be invalid. Such invalid signatures would not invalidate the entire petition, but they would NOT count toward the “50%” goal. 12. When will the annexation go into effect? The City is supportive of the residents’ interest in completing the limited purpose annexation process by December 31, 2013. This would require completion of the petition process, negotiation and approval of three Strategic Partnership Agreements, a series of public hearings involving District Boards and City Council, and numerous other statutory requirements. While the City and your HOA representatives are attempting to affect completion of this process by December 31, 2013, it is possible that delays may occur. 13. What happens next? In addition to the petition process, City officials, District representatives and HOA representatives are drafting the necessary agreements outlining the specifics of the annexation.
