THE battle for the ‘three tiger stripes’ adorned on the national jersey looks bound for a legal contest as the fight for ownership of the design heightens. Mesuma Sports Sdn Bhd has refused an invitation to meet with National Sports Council (NSC) organisational development director Suhardi Alias today.

The ministry wants to know why the council does not have records of a contractor responsible for wiring work on the playground in Taman Batu Tiga. Muhammad Naquiddin Mohd Marzuki, 11, died after he accidentally touched a lamp post while playing there with friends on March 19. The minister, Datuk Chor Chee Heung (pic), told The Malay Mail the council had been asked to prepare a report on the incident as well as its internal investigation into the "missing" contractor. “I am keen to know why the contractor’s record could go missing or wasn’t there in the first place." CR Sports had applied in 2009 for the design of the tiger stripe jersey and had it registered on Feb 4 last year. IPCM records show Mesuma Sports has been the registered proprietor of the trademark for 10 years from July 9, 2009. The certificates of registration were issued by IPCM on Feb 19. IPCM senior director of trademark division Abdul Aziz Ismail had, on Monday, confirmed the disputed design was trademarked by Mesuma Sports and that the jersey name 'Panthera' was in contention. A similar name, 'Panther', was trademarked by Secaicho Corporation Japan on Aug 30, 1977.

NSC went into an agreement with Telekom Malaysia Berhad (TM) to launch the Team Malaysia 'Panthera' jersey on April 28. TM filed eight applications to register designs consisting of the telco's logo and incorporating the tiger stripes and the words "Team Malaysia" on April 6. CR Sports filed six applications on May 3 – five days after the Team Malaysia 'Panthera' jersey was launched – to trademark the 'three tiger stripes' motif. Somali pirate pleads guilty A SEVENTH Somali man has pleaded guilty to piracy for his role in the hijacking of a yacht that left four Americans dead. Abdi Jama Aqid pleaded guilty in federal court in Norfolk, Virginia, yesterday. Another man pleaded guilty earlier in the day. They are among 14 people from Somalia and one from Yemen charged in connection with the February hijacking of the yacht Quest, whose owners, Jean and Scott Adam, along with friends Bob Riggle and Phyllis Macay, were shot to death after being taken hostage several hundred miles south of Oman. They each face life in prison, although that could be reduced. — AP

Sudan's civil war worsens SEVENTY northern Sudanese soldiers were killed and more than 120 are missing from an attack last week by southern Sudanese forces near the disputed region of Abyei, a Sudanese diplomat said yesterday, describing a toll that if verified marks one of the bloodiest clashes since the end of Sudan's civil war. A United Nations spokesman said he believed the casualty numbers were much smaller. The south voted to secede from Sudan, Africa's largest country, this year but the future of the Abyei region, which lies near the north-south border, was left in doubt. — AP

The photo was taken by t he man us i ng h is handphone when the acid splasher made his move on the latest victim at a traffic light junction near the Central Market last Friday. In the incident, the victim, a 26-year-old marketing executive, said a man on a motorcycle had splashed pink liquid on her car as she was driving to work about 7.30am. The victim, who requested anonymity, said she believed the man resembled the recently-released police photofit of the acid splasher. She also said the

suspect was dark-skinned, wore a helmet with the visor down and a white T-shirt. The suspect had repeatedly knocked on her car window and w hen she ref us e d to wind down the window, he opened a mineral water bottle and splashed pink liquid on her windscreen and fled. The victim drove to the nearest petrol station to wash off the liquid. She claimed a man who witnessed the incident approached her saying he had taken a photo of the incident with his handphone.

The man said the image he captured was unclear but promised to transfer the image to his computer once he reached his office and email it to her. However, the victim is still waiting for his email. In Selangor, B ernama reported the rumour of new acid splashing incidents in the State was not true. S elangor police chief Tun Hisan Tun Hamzah said: "I also received a report claiming that there were acid splashing incidents in 1 Utama and Kota Damansara today, but they were not true."

Police bust lorry theft syndicate This resulted in a 12km chase and it ended in front of a factory when police fired several shots at the lorry's tyres. "We arrested the two suspects in the Proton Saga near the factory. About 15 minutes later, a third suspect was arrested at the Rawang toll plaza. The fourth suspect was arrested after we recovered the other lorry at a factory in Taman Desa Jaya in Gombak." The suspects, all men aged between 24 and 26 years, have been remanded at Gombak district police headquarters for motor theft. “We believe the gang started stealing lorries this year," said Abdul Rahim.

F OU R me mb e rs of a lorry theft syndicate were arrested about 12 hours after they stole two threetonne lorries in Gombak on Sunday. Gombak district police chief ACP Abdul Rahim Abdullah said a factory supervisor at Taman Desa Jaya lodged a police report at 8am after he found two of his factory’s lorries, worth a total of RM185,000, missing. “We received a tip-off from a member of the public on the whereabouts of the lorries and at 7.30pm, we raided a house in Paya Jaras," he said. "One of the gang members fled in one of the stolen lorries while another two fled in a Proton Saga."

Daylight armed robbery in Kuchai Lama

A GANG of armed robbers including a firearm, made off with about RM10,000 after slashing one of their victims on the head and neck near a bank in Jalan Kuchai Lama yesterday. The five-minute incident occurred at 9.15am when the victims, who worked at a cybercafe nearby, were about to reach the bank to deposit

the cafe’s takings. A source said the robbers came in two cars, a Proton Gen 2 and Waja, and blocked the victims' car, a Perodua Myvi. Four of the robbers, armed with pistol, hammer and machete, charged at the victims, injuring one of them on the head and neck. After grabbing the money from the

victims, the robbers fled in the Gen 2, leaving the Waja behind. Checks on the Waja showed it was stolen in Damansara last Monday. A police forensics team also lifted fingerprints from the car. The victim was taken to a nearby clinic and received seven stitches on the head.

FORMER KISS guitarist Vinnie Vincent (pic) has been arrested on suspicion of assault after his wife accused him of hitting her in the face, throwing her to the ground and dragging her through broken glass, the Daily Mail reported. Diane Cusano, 44, was bleeding and smelled of alcohol when she drove herself to a sheriff's office following a row with her 58-year-old husband at their Tennessee home, a police report claims. After interviewing Cusano, sheriffs arrested Vincent on domestic aggravated assault charges. He was taken into custody, where he posed for a mugshot before being released on bail. Vincent, who was known as Ankh Warrior during his time in KISS, is due to appear in court on June 23.

THERE is no bias when it comes to assisting the homeless. So said the Women, Family and Community Ministry in dismissing claims it was selective in the choice of recipients. Responding to a series of reports on the Jalan Pudu homeless that The Malay Mail featured the past few weeks, its minister, Datuk Seri Shahrizat Abdul Jalil, said: “I read the news reports. I thought it was blown out of proportion. “Our ministry never closed its doors on the homeless. We want to help all of them, regardless of their condition. "Whether they are suffering from mental illness or find it difficult to land a job or need medical attention, we don’t turn them away. We don’t categorise.” In our May 12 front page report headlined “KL Open Asylum”, a Welfare Department head claimed his department was not able to help the homeless in Jalan

Pudu where about 40 vagrants slept on pavements at nights because they were ‘mental sufferers’. Shahrizat also dismissed claims that bureaucratic red tape between the ministry and the Welfare Department was hindering efforts to stop the city’s vagrancy problems. “There’s no such thing,” replied the minister, when pressed on the matter. “What we do have are formal procedures we have to go through like registering the vagrants and getting their details, but that’s for safety purposes. It’s important. “Our aim is to ensure there are no more homeless people on the streets, but this thing takes time and effort. These people are homeless for many reasons, but we want them to know we are here to help them." Speaking at a media briefing at Anjung Singgah, a shelter for the city’s homeless, Shahrizat said: “We want the homeless to know there is a place they can stay

and eat temporarily, while we help them by referring them to different agencies to solve their problems.” She said Anjung Sing-

gah is one of her ministry’s initiatives under the National Key Results Area (NKRA) to improve living standards of the lowincome group. She also urged non-governmental bodies helping destitute people to refer them to Anjung Singgah.

NATIONAL Welfare Foundation trustee Toh Puan Wan Hidayah Ismail says the response from the homeless has been positive since the Anjung Singgah shelter opened its doors on April 9. So far, the centre received 1,699 ‘customers.’ Out of that, 48 successfully got employment through the help of the centre. “Most of them came to the centre by themselves. They knew of this place from their peers, through word of mouth,” said Wan Hidayah. She said the centre was close to the Jalan Pudu ‘homeless asylum’ and the community there should come to their centre for temporary lodgings and obtain help. “We cannot pick them from the streets and force them to come here, so we hope NGOs who help them can refer these people to us.” The shelter has beds for 76 people and the homeless are allowed to stay for up to two weeks. Within that period, the staff at the shelter would assist them find employment and accommodation, said Wan Hidayah.

BEFORE you judge the homeless living on the streets in Pudu, try taking a closer look. One of them, who wished to be known as Ali, is a 59-yearold retiree who lived there for the past week. He came to Kuala Lumpur from Penang by train. "Sometimes we get food donated by volunteers from the Lions Club," he told The Paper That Cares. "They provide it late in the evenings. Sometimes, they do it three times a day, everyday." Last night more than 30 homeless people, some fast asleep, were seen at the same area along Jalan Pudu. Christian associations in Petaling Street and near the Klang bus stand also offer them free food, but he says most of the homeless are Malays. "The local mosques should put more effort into helping them." Ali claimed to have family problems which is why he left. "My children are married and working, while my second son is still schooling." He plans to return to his

family someday. During the recent wet weather, he said the homeless camped outside a nearby fast food outlet. "There's a lot of people sleeping here at nights," he said. "Many are from Myanmar but I don't know them that well. Some have no families to return to and have no means of earning a living." He said while public perception of them is usually negative, they are peaceful people and never ask for financial help. "None are here by choice. By daytime, all are usually gone and don't return until late. Some are capable of supporting themselves. Some do work and often send their clothes to the laundry." Others have endured greater misfortune such as having their belongings and identification cards stolen. "They are able people but have their own reasons for being here," Ali said. Basri, 21, from Kluang has been living on the streets for the past month. When it rains, he and his peers seek shelter

beside nearby restaurants. "I just stopped working," he said. Now he is looking for a new job. "I came to Kuala Lumpur to work and tried looking in many places." He said his last job involved doing electrical wiring, adding that he dropped out of school after Form Two. "In daytime, I stay in this area. Nobody has asked us to leave so far." During Hari Raya festivities, he goes back to his sister, who works in a bank. "She knows I'm in this area but is not aware I've ended up like this," he admitted. "I'm planning to find work before seeing her again." Muhammad Zulkarnain, 24, from Kelantan, worked as a security guard and also a delivery boy. "I was initially promised RM20 a day for the delivery job but they only gave me RM15," he said. "Sometimes I get less, so I quit. It was hard for me, as I had much walking to do." Zulkarnain admitted he has

family here. He is still looking for work but has not yet found a suitable job. "Sometimes during the day I sleep at different places, as everyone else will be gone. "Fortunately, the rats don't disturb us when we sleep. But we remain wary, as they may be carrying deadly viruses." As for food, he said, he receives help twice a day from a church. In previous Malay Mail reports, the homeless at Jalan Pudu were astoundingly described by the Welfare Department as being "mental sufferers". Despite claims of wanting to resolve the issue, they said bureaucratic red tape remained an obstacle and that the main challenge was that the homeless have to first approach the department for help. However, human rights body Suara Rakyat Malaysia (Suaram) had said claims that it was out of the department’s jurisdiction to aid them as they had "mental conditions" were "inhumane".

THE driver of a Proton Saga died instantly after his car was rammed from behind by a lorry. The car was squashed and dragged 150 metres along Persiaran Kewajipan near SS14 in Subang Jaya yesterday morning. The victim was Sabaruddin Junus, a 34-year-old clerk from Sabah, and the lorry subsequently ploughed into three more vehicles - a taxi, a Proton Perdana and a Toyota Rush. Subang Jaya district police chief ACP Zainal Rashid Abu Bakar said in the 10am incident, Sabaruddin and the lorry

driver were both heading towards Subang. "The lorry driver lost control and rammed into the Proton Saga in front. Sabaruddin was trapped in his car and died instantly," he said, adding the case is being investigated under Section 41 of the Road Transport Act 1987 for causing death by reckless or dangerous driving. "The lorry driver, 23, from Terengganu and drivers of the other three cars sustained light injuries." Sabaruddin’s body was moved to Hospital Serdang for a post-mortem.

THE government must ultimately "return" the Bangsar open space in Jalan Maarof to residents even if money has to be spent to get back such land, say residents associations (RAs) when commenting on the recent announcement by Federal Territory and Urban Well-being Minister Senator Datuk Raja Nong Chik to reacquire the land by the end of the year. The open space in question had been legally acquired by Melor Travels Sdn Bhd. Kampung Malaysia Residents' Welfare president Kamaruddin Sakuri said the ministry should exhaust all legal avenues first rather than simply use taxpayers' money to buy back the land. "Even if it costs 'only' RM2 million, it needs to be justified because it was the government's land in the first place," he said. "After getting it back, the land should be "returned" to the residents." Melawati and Klang Gate Zone 1 RA president Abdul Yazid Alias said the government also has to take responsibility for alienating such land to others in the first place. "The authorities must ensure such mistakes do not recur elsewhere in the city." Bandar Mahkota Cheras (Jalan Puteri) RA president Datuk Ir Mahmud Arif Kasim said the government should use the people's money carefully. "Whether reacquiring the land or compensating the current lease holder, the price must be reasonable," he said. "The land should then be used by the people."

Forcible removal of canines untrue

Razif himself had gone along with the council officials, who kept knocking on the front gate. “Because the notice had been ignored and according to the Act's provisions, we had the absolute right to take the dogs away, as long as it went against the issued order.” On the allegation of unauthorised entry, he said: “Prior to going in, we had contacted our legal department to get the green light.

I have proof through a videotaped recording of the confiscation and letters of complaint from all five residents.” Razif also denied the local council had abused the dogs, as claimed by the family. He instead told The Paper That Cares the dogs had not been looked after well by the owners. “They were skinny, malnourished and had tick infections.” Razif added, “While at the pound, these dogs had been kept separate from other dogs. So, there is no way they had been bitten by

other strays there. All three dogs had been biting each other at the owner’s home.” The dogs' owner had alleged the two dogs were forcibly taken out of their home by the council’s officers and beaten at the dog pound despite having valid dog’s licences. The owner also claimed that after the dogs were brought back, they looked badly injured and had to be sent to the veterinarian for treatment. All the owner now wants is an apology from the council and some form of compensation.

It was aimed at raising funds for the Hidayah Madrasah Al-Taqwa orphanage that was struck by landslide and its survivors as well as to pay tribute to the 16 who were killed. Hosted by Awal Ashaari, the acoustic showcase featured performances by rocker Faizal Tahir, who initiated the idea, Aizat, Azlan and The Typewriter, Hujan, Black and Jaclyn Victor. "I first heard from my wife of the landslide, which initially didn't faze me too much. Then later, I heard it involved an orphanage. And yet, the magnitude of the incident didn't strike me until I heard the number of those missing," Faizal said after the show.

"I updated my status on Facebook and went about on my routine, not realising the full extent of the tragedy. "On Sunday morning, I found out how many were killed. I just broke down then," he said. "I immediately contacted several people, including folks from TV3, and asked what we, the artistes, could do." The response caught even the rockstar off-guard. "On Monday afternoon, TV3 called me and said we had a slot to perform and I called up some friends who agreed to help out. "I have to thank all my friends who took time off their busy schedules to join in this effort. Azlan even cancelled a show because he wanted to be a part of this." Fitness freak plans to take matter to consumer tribunal over gym dismissal THE National Consumer Complaints Centre (NCCC) has offered to help gym enthusiast CAROL LOKE (pic) who was booted out of her fitness centre for allegedly wearing obscene exercise gear. The 47-year-old mother-of-two is all for it and intends to clear her name which she claims has been smeared following her dismissal. "She has a good case against Fitness First because she is a paying member of the gym," says NCCC chief executive officer, Muhamad Sha'ani Abdullah. "LOKE can lodge a complaint with the consumer tribunal that she had been paying her monthly fee

just like other consumers." Muhamad Sha'ani says a complaint can be lodged if LOKE feels the termination was not done lawfully. She also has the option to initiate a civil suit against the gym. Yesterday, Hotline highlighted LOKE's plight after her membership at the Fitness First Cheras Leisure Mall outlet was terminated. LOKE had claimed she was informed about the decision at a roadside food stall as she was heading for the gym on May 16. She claims the termination was unlawful as she was expelled due to complaints received from other gym members.

Fitness First had in a response to Hotline said they terminated LOKE's membership primarily because of her 'obscene' gym attire which exposes certain private parts of the body. They also said the decision was made because over the last one year, LOKE had misbehaved during group exercise classes by screaming, shouting and moaning. The behaviour was deemed disturbing to both the instructor and the members. When contacted yesterday, LOKE says she plans to bring the matter to the Consumer Claims Tribunal. Baffled over broadband plan

WHEN JEREMY LEE from Kuala Lumpur signed up for a Yes mobile Internet plan on March 10, he thought it was a service he could rely on. He says the package was priced at RM1,199 and it came with the Zoom! wifi unit for the home. LEE says he paid the amount in advance and was informed he would have credit to use for his broadband which will be deducted on a monthly basis. "However, I got disconnected on May 10 due to insufficient credit. Upon checking my account, I noticed that I had used up RM788.05 by the first month (March 8 to April 9) and RM379.64 in the second month (April 10 to May 9)." LEE says he immediately contacted Yes via email thinking that there could be billing mistakes only to receive two auto-generated emails and another two responses from Yes personnel asking LEE to log on to his account to view the details of the statement. "At that point, I lost my confidence in them in terms of customer service. They then sent me a mail stating someone will call me for clarification but I

never received any calls." LEE says he even got a friend to call Yes Care to clarify, but was again given the response that the billing was correct. LEE was again asked to log on to the Internet to check his account statement. "Yes claimed my broadband usage was very high, therefore, the credit has been deducted to reflect the amount used," he says. "However, to use this amount, I should be downloading stuff over the Internet 24 hours a day or downloading movies and ripping it off the Net. But I don't. In fact, my usage just doesn’t justify the exorbitant amount." LEE finds the charges incurred ridiculous.

LEE confirms he has suspended the account and is mulling the next course of action.

Zero Astro for three weeks

EXTREMELY frustrated with poor and slow response from Astro B.yond, YULLYA YALADHARI says her family has not been able to watch TV for the past three weeks. YULYYA claims despite contacting Astro several times, she is still not happy with the results. Since the first week of April, YULLYA has been asked to change the decoder twice, change the smart card three times, and reactivate her new account once. She said Astro also sent three technicians on three separate occasions but the problems were still not resolved. She has spoken to two Astro managers but there has been no solution. "For a company like Astro, I’m completely amazed at how poor their customer service is. "It’s been one week after the 'promise' that they would give me a loaned decoder set, but several

enquiries later I've been informed the delivery of the loaned set is still in progress. "When I called Astro's personnel customer service, nobody could provide me with a status update and when I asked to speak to their manager, I was refused." YULLYA says she was later informed that her problem had been sent to another department's jurisdiction and no one in Astro could give her an update on whether the problem would be fixed or when the loaned set would be delivered to her. "According to Astro's system, my account appears to be running fine and active but the irony is, I have not been able to watch TV for the past three weeks!"

YULLYA says she is happy her family can now enjoy their favourite TV shows and hopes the incident will not reoccur.

Misled by customer service WHAT is the purpose of having customer service if they are unable to provide information to customers? This is the question asked by an irked CIMB bank customer JEYA SUSHMA VERIAH who made a needless trip to the bank thinking the information provided by the bank's customer service personnel would be accurate. "I wanted to open a current account for my company which also has two other directors. I am also the authorised signatory of the company, and since this was my first time opening a current account, I decided to ask what the requirements were." She called the customer

service line at 1300880900 and was informed about the documents needed to open an account. She was also told the other two directors were not required to be present when opening the account. Before heading to the bank, she called the customer service again and checked on the same matter and the answers were the same. JEYA SUSHMA says she took a day off from work and headed to the CIMB branch in USJ 9. To her disappointment, she was informed that the bank would not be able to process the application as the other directors were required to be present. "I think this is just ridiculous. I told them about my calls to the cus-

tomer service centre and their reply was I should not call the customer service but to call the bank directly as the customer service does not know the procedures." JEYA SUSHMA says the bank staff was not even apologetic and kept telling her that it has been the procedure all this while. Now, she has to make another trip to the bank to open the account and this would depend on her work schedule and when the other directors would be free.

Loan sharks targetting lunch crowd with festive financial pamphlets AH LONG have taken to the streets in Petaling Jaya to promote their services and are focusing on the Hari Raya festivities three months away. ROGAYAH WAN, a sales executive, was approached by runners distributing pamphlets in Jalan 13/2 when she was having her lunch yesterday. She says, in the last few days, she noticed that a number of teenage boys have been

"We are trying to stop people from getting into bad debt, and these people are advertising their services freely. "It's bad enough that we have to put up with road signs being vandalised by Ah Long advertisements, now they are luring people to take loans by directly approaching customers who are having their meals at shops and stalls." Where have all the smiles gone?

SADLY, courtesy is very much lacking in large sections of our society. How did we arrive at such a woeful situation? Could it be the case of bad leadership by example with shameless politicians leading the way? Have loud-mouthed champions done more harm than good to the very people they claim to represent? Are children of rude parents equally so? How do we account for our religious and often-touted Asian values when much of our behaviour leaves much to be desired? How can we be proud to be Malaysians amidst such degradation of society and desecration of environment? Those who claim superiority on religion, race, language, PETALING JAYA

education or culture but display contempt for others lose credibility as it is our level of courtesy that truly reflects who we really are, not our heroics. Perhaps we are aware of the importance of courtesy but are nonchalant about it. After all, we pay scant regard to even life and death issues, such as the need for a healthy diet and regular exercise. It is no surprise that the ongoing campaign to promote courtesy is hardly noticed, let alone effective. Compiling a long list of dos and don’ts would be a good start but knowledge alone would not necessarily translate into action. For centuries, people have had access to religious books but there has been no change

in human nature whereas science and technology have improved by leaps and bounds. Indoctrination may change people only at the superficial level. For real change to occur, people must first undergo proper training. As such, I propose full-day workshops on courtesy to be conducted nationwide to raise awareness and explore best practices with participants making individual pledges in front of the group on how they can lead and influence others to be more courteous in the workplace and society. The objective of such training is to condition participants to think and walk the talk on courtesy.

The aim is for such core groups of courteous Malaysians to produce a rippling effect across our society and embrace courtesy as our way of life. The various trade associations should seek the support of their respective ministries or government agencies to organise such workshops, as courtesy would lead to higher productivity and profitability. Meanwhile, we can be courteous by greeting people we meet, offering strangers a smile and show our smiling eyes to our loved ones as courtesy begins at home. It should generate from within us. In order to love and respect others, we must first learn to do the same to ourselves. In this way, we would always

be courteous whether others are deserving or not, as the onus is on the giver, not the recipient. Great courtesy is to continue listening especially when we do not agree to what is being said. It is genuinely courteous to provide honest feedback, using both emotional and analytical intelligence to communicate effectively. It is also courteous to complete a job on schedule and getting work done as paid to do so. Our values are manifested by our outward display of courtesy. The reverse also applies as practising courtesy strengthens our character. Activists go out of their way to fight for what they believe

to be noble causes. What we sorely need are courtesy activists who are genuine patriots and their exemplary behaviours would be welcomed by all quarters. Perhaps the greatest transformation we can achieve is to become a nation of courteous citizens. For this, we can try emulating the Japanese as they have recently shown that their courtesy is beyond superficial display. All of us should identify the various roles we can contribute in promoting courtesy and playing our part to improve the quality of life. We owe it to future generations and ourselves. YS Chan

RM300 fine too fast and furious, say bikers (May 24)

No excuse to lower fines for motorcyclists THE RM300 fine for motorcyclicts is fair. Car drivers are already being fined this amount. There is no excuse for asking for lower fines, just because many motorcyclists are assumed to be from the lower income group. If the government does indeed decide that bikers can be fined at a lower amount than car drivers, then this is akin to the government saying motorcyclists are encouraged to commit more traffic offences. All car drivers have seen multitudes of mad bikers committing all sorts of traffic offences, which not only endanger the riders but other motorists as well. Going the wrong direction on a one-way street, ignoring red lights, driving on highways instead of driving on

their own dedicated motorbike lanes, swerving at high speed between cars during heavy traffic, lack of use of signals, parking wherever they feel like parking are all some of the offences. When they do get into an accident, the other party is blamed. In some areas, you can see bike riders without helmets, youngsters without licence, beating traffic lights or carrying more than one passenger. In the Kerinchi area, you can see these law-breakers ignoring the safety of others on the road on a daily basis. Besides the motorcyclists breaking the law, it is noted that a lot of car drivers, too, beat the traffic lights. Red light means stop, but many vehicles just drive through. Concerned Citizen

Obey traffic rules I, TOO, ride a motorcycle everyday and I have seen many motorcyclists riding against the traffic flow. It is high time to implement fines without having to listen to excuses. Obey traffic rules, and there will be no fine. There is no excuse for not obeying the law.

WHAT about those motorcyclists who ride against traffic? This is done so frequently that it is a norm in Malaysia to see motorcyclist riding against traffic. Is it then wrong if we knock into them when they ride

Undressing prickly issues

THE MALAY MAIL ran an story yesinteresting terday. In case you didn’t come across it, it was basically about a 47-year-old woman whose gym membership was terminated because of, according to her, her sexy gym clothes. A longtime member (she had been visiting the fitness centre thrice a week for the last seven years), she was asked to return her membership card because other patrons had complained about her two-piece attire. In reply, the gym said it was more than that – it alleged the customer’s membership was terminated because she was "behaving inappropriately" toward other clients, in addition to her outfit being too revealing. It allegedly used words like "screaming", "obscene" and "moaning" when describing her. Who was right? Was she sexy? Were her clothes appropriate? Was her behaviour acceptable? I don’t know. I don’t have the full facts and it’s a grey area when it comes to what’s right or wrong here. Naturally, there are an equal number of those

ON WEDNESDAY who support the woman’s right to dress as she liked and those who felt it was within the gym management's right to take action. Each side of the fence had a case. She’s an independent woman who paid to work out at the premises and wore attire she considered appropriate while the gym has the right to govern the dressing and behaviour of those who use their facilities. Considering they have to take care of all customers, balancing the rights of the individual and other clients, it’s understandable they had to act. What this little conflict highlighted, however, was something more important: where does your right to dress as you wish end and the right of the premises owner to govern your dressing begin? When does your freedom of expression infringe

the right of the business owner to police their premises? Consider some government offices, for example. Some offices explicitly ban people wearing certain attire from conducting business. If you decide to jump out of bed, put on your flipflops, shorts and singlet and go as you are, expecting the people behind the counter to treat you well, you may just get disappointed. Look around and you may find posters dictating how you should be dressed if you want to get served by these civil servants. No jeans, flip-flops, round neck tees and caps. You can argue all you want, saying it’s within your right to wear whatever you want and that wearing a collared shirt, a tie and a pair of shoes that cover your toes doesn’t make you any more worthy of being helped by

government servants than if you were wearing bermudas, tight fitting tees and your favourite pair of selipar Jepun. I mean, you pay taxes too, yes? Dressing does not make the man. What about swimming pools and beaches? Surely sunsoakers and swimmers have the right to don the latest bikini trends and Speedos? It’s a free country, yes? And what of the other places? Surely you can wear anything you fancy, instead of being told like a juvenile what to wear and how to carry yourself? But what about the rights of the premises owners? As owner, don’t they have the right to determine how those who patronise the place dress and behave? It’s hard to say. In cases like these, it’s often subjective and depends of the perception of the one calling the shots. Some may find it counterproductive to humans rights, the women’s movement and so on. But perhaps, with no reference to the earlier case, uncomfortable situations could be averted with clearer policies, better human

relations and mutual respect. Places that welcome patrons, paying clients at that, must always endeavour to provide clear, specific and reasonable guidelines to their customers if they expect them to behave or dress a certain way. You can’t punish them arbitrarily based on casual observation or even abstract complaints by other patrons. That’s akin to the police telling motorists a vague “no speeding”, without giving an actual speed limit. "No short skirts" – how short? "No sexy attire" – how sexy? When guidelines are clearly defined and expressed, establishments that want to enforce such policies must also practise restraint, professionalism and compassion when dealing with those that run counter to those policies. It’s not enough to tell them, "Sorry, we’ll need to kick you out now because of so-and-so", but there must be a respectful way to get them to comply. There must be proper procedures to communicate the situation, explain the options and if need be, take corrective

action. It protects you from legal action and you leave your customer with their dignity intact. And when we talk about respect, the patron, on the other hand, must realise that, yes, while he or she may have paid for the service or facilities, it is a place shared with other patrons. Just like any other public place, you must practise restraint and good manners, respecting the rights of others while enjoying your rights. It’s like keeping quiet in a movie theatre – yes, you paid to watch the flick, but so did 200 other people, so making noise is not an option. Elections and democracy

IN The Rakyat Guides 1: What is the Federal Constitution? We learnt that the Federal Constitution sets up a system for the governance of Malaysia. It is a “democratic” system which means that the people of Malaysia decide who runs the country. We do this by voting at elections. Under the Constitution, elections are held to select the 222 members of the Dewan Rakyat (known as Members of Parliament or MPs) and the 576 members of the 13 State Legislative Assemblies. In this Rakyat Guide, we will focus on elections for the Dewan Rakyat. When do elections take place? Elections for the Dewan Rakyat take place when Parliament is “dissolved”. When Parliament is “dissolved” this means that it is stopped from functioning. This can happen in two ways: • Parliament is automatically dissolved five years after the Dewan Rakyat’s first meeting; or • The Prime Minister can

request that the Yang diPertuan Agong (YDPA) dissolve Parliament, and the YDPA may then decide to do so. While in most cases, the YDPA must act on the advice of the Prime Minister, the Constitution says that the YDPA may refuse to consent to a request to dissolve Parliament before its five-year term ends. Once Parliament is dissolved, a general election must take place within 60 days to select 222 new MPs. How are elections conducted? The Constitution does not give details on how elections are conducted. It does, however, set up the Election Commission (EC) and makes the EC responsible for conducting elections for the Dewan Rakyat. Parliament has also made laws on how elections are to take place and it has given the EC the powers it needs to conduct elections. Under the law, once Parliament is dissolved, the EC will fix a nomination day and

a polling day for the general elections. There are 222 voting area (known as constituencies) throughout Malaysia, one for every seat in the Dewan Rakyat. On nomination day, anyone who wants to be elected as an MP in a particular constituency must file the proper documents with the EC official for that constituency (the returning officer). The person who files the papers then becomes a candidate. If there is more than one candidate for a constituency, an election takes places there. If there is only one candidate, that candidate will be declared the winner. After the nomination process, the campaign period begins and continues until the eve of polling day. This is when the candidates will try to persuade voters to vote for them. On polling day, voters go to polling centres in their own constituencies and vote for the candidate they prefer. Once the voting period is over, the votes are counted and the winners are announced.

The winning candidate is the candidate who gets the most votes in that constituency. Whichever political party or coalition of parties is able to secure the support of a majority of the MPs (at least 112 out of 222) will be invited by the YDPA to form the next Executive Government. Who is eligible to be MP? Any Malaysian living in Malaysia who is at least 21 years old can take part in an election to become an MP. A person cannot become an MP if the person: • is of unsound mind • is a bankrupt • holds an office of profit (an office of profit means those holding a position in the judiciary, the Election Commission, the Auditor General and any other position that Parliament may declare) • spends more money than is allowed under the law on his or her election campaign • is found guilty of a crime where the punishment is a jail term of one year or more, or a fine of RM2,000 or more; or • becomes a citizen of anoth-

Who is eligible to vote? Under Article 119 of the Constitution, you can vote if: • you are a Malaysian citizen; • you are at least 21 years old; • you are living in the constituency where you wish to vote; or • you have registered to vote. A person is disqualified from being a voter if the person: • of unsound mind or serving a prison sentence; or • has been convicted in any part of the Commonwealth and sentenced to death or to a term of imprisonment of more than 12 months and has yet to complete his/her sentence. Are there an equal number of MPs/constituencies for each State and Territory? No. The allocation of seats depends on the size of the population and territory, and the constitutionally permissible weightage for rural areas.

US tribute to fallen Aussie hero THE US is mourning the death in Afghanistan of an Australian hero who ignored his wounds to dash to the aid of an American unit pinned down by insurgents during a 2006 battle. Internet freedom at issue Google tells e-G8 policymakers to avoid 'stupid rules'

FRANCE wants better regulation of the Internet. Google's executive chairman says policymakers should tread lightly and avoid "stupid" rules. Bridging such differences about how the Internet could or should be more regulated took center stage yesterday at an "e-G8" meeting aimed to parlay the digital world's growing economic clout into a cohesive message for world leaders at the Group of Eight summit later this week in Normandy. The two-day Paris gathering has brought together Internet and media world gurus such as Google Inc executive chairman Eric Schmidt, News Corp. Chairman and CEO Rupert Murdoch and Facebook founder and CEO Mark Zuckerberg. And the discussion includes issues such as protecting children from "evil stuff " on line, preventing illegal download-

ing of copyrighted materials and shielding Facebook users from unsolicited invitations. The e-G8 comes amid concerns in the industry that some countries, including several in Europe such as France, have taken measures or enacted laws that could curb Internet freedoms. French President Nicolas Sarkozy, kicking off the conference, said governments need to lay down and enforce rules in the digital world, even as they need to foster creativity and economic growth with the Internet. Drane Burdick told jurors that all the evidence points to the 25-year-old defendant as the murderer of Caylee Marie Anthony, who was gone for a month before her grandmother alerted police that she was missing. The prosecutor also offered for the first time a theory that Caylee died from three pieces of duct tape being placed over her mouth and nose. An autopsy was never able to conclude a cause of death. Anger of tribes unleashed in Yemen FIGHTERS from Yemen's most powerful tribes fired on government buildings and soldiers retaliated with intense shelling yesterday as the uprising against President Ali Abdullah Saleh threatened to become a militia-led revolt after street protests and Arab mediation failed. Tribal leaders say at least seven militiamen were killed, but the full death toll was not immediately known as the heart of Yemen's capital, Sanaa, was turned into a no man's land with heavy gunfire, mortar rounds and apparent artillery fire from government forces. Both sides traded blame for triggering the latest violence, further deepening the rifts and suggesting Yemen could be stumbling toward a potentially bloody showdown between well-armed tribal militias and pro-Saleh troops. of "dragging the country to chaos." The Interior Ministry, in turn, blamed the "bloodshed" on Sheik Sadeq al-Ahmar, the head of Yemen's largest tribe, called the Hashid. for his albums. No stranger to working with Malaysian and international artistes, including Apache Indian, the reggae music advocate takes time to match songs to artistes. “There is a story behind the collaboration with every artiste I work with, not just about working with anyone for the sake of it,” said Sasi, whose full name is Sasidharan Chandran. In his upcoming album Don’t Panic, It’s Just Music, he is working with a few new and old friends. Among the local artistes featured in his album this time around are Malaysian songstress Jaclyn Victor and

Anita Sarawak. “I have always wanted to work with a legendary artiste like Anita Sarawak and finally I have that chance with the song One Love,” added Sasi. One Love is a simple, original composition that spreads the message of unity regardless of culture and creed, through the power of music. Don’t Panic, It’s Just Music is the Sasi’s fourth album so far and one that describes his journey as an artiste from the beginning until now, scheduled to be launched next month. The album also features well known artistes and Sasi’s idols Maxi Priest, Dr Alban as well as one of India’s well-known vocalist Harish Raghavendra. Having a chance to work with reggae stars means a lot to Sasi, whose encounters with his idols begin through social networking sites. “When I knew I was going to London to play there, I

asked Maxi Priest to go for the show. Although initially he said he wouldn’t be able to make it but he came for the show and liked it,” said Sasi. Island Queen is the result of their meeting together and Sasi’s dream of working with another idol completed. The importance of educating the patient By dr haizal haron kamar lifestyle@mmail.com.my I had just finished giving a talk in Palembang, touching on the subject of hypertension and the heart when a doctor from the audience stood up and ask me how best to deal with patients who do not follow advice. I acknowledged his concerns by telling him that it was a very common and widespread problem affecting every society in the world. Poor patient compliance is one major reason why blood pressure control is disappointing — only about a quarter of hypertensive individuals have their blood pressure under control. So why do some people refuse to do as they are told? The answer can be found by understanding the condition itself and in this case — hypertension. Hypertension is a rather peculiar condition. It is the commonest global risk factor accounting for 7 million deaths every year, yet it causes no symptoms in the vast majority of cases…until heart attack or stroke suddenly occurs. This is why there are many out there walking around with high blood pressure, some even through the roof, not realising their time bomb is ticking away. For the ‘fortunate’ few who have symptoms, a consultation with the doctor for headache or dizziness will unveil the ‘hidden’ abnormal blood

pressure. However, this is relatively uncommon. Most with hypertension have no symptoms but when you start them on medications, they may get symptoms… ironically, from the side effects of medication! Amlodipine and other calcium-channel blocking drugs are known to cause mild leg swelling, perindopril and other ACE-inhibitors may cause irritating cough and atenolol and other beta-blocking drugs can lead to erectile dysfunction. These are just some examples. Side effects of drugs is one of the reasons why compliance is poor. To a patient, the doctor is probably making his life miserable as he was ‘fine’ before the doctor’s intervention. He may not just stop his medications, but he will also not want to see you again. This will be a tragedy as the hypertension will then go untreated. So what then can be done to improve patients’ treatment compliance? One answer to that is good patient education. However, it is not easily implemented for various reasons — one of which is due to the lack of time spent during consultation. I am certainly guilty of this many a times. What I would love to do with my patients all of the time when I begin

to manage their hypertension to ensure good compliance would be the following:

• Explain what a normal blood pressure is (less than 140/90mmHg) and what the optimal level should be (less than 120/80mmHg). • Define hypertension and explain that most individuals with it do not have any symptoms, ie. a silent condition. • State the dangers of hypertension and explain the need to keep it under control. • Explain that if strict lifestyle changes such as stopping smoking, regular exercise, losing weight, reducing stress and lowering salt intake after a period of time fail to get the blood pressure down, then medication will be needed. • Once medication is started, take it as prescribed (dose, timing and frequency) and assume that it is for life. • Medicines for hypertension are not to cure, but rather, merely to control. In the majority of cases, more than one drug is needed to control the blood pressure. I know a few patients on five! • In some cases, side effects of the medication may occur and that they should inform the doctor immediately. There is a whole cupboard full of drugs that can be used to treat hypertension so if one drug does not agree with a

person, then a drug from a different class/type can replace it. What he/she should not do is to stop the drug without informing the doctor. • The dose of drug may increase with time as the arteries get stiffer and your body becomes tolerant to the drug. Additional drugs may also be needed. As you can see, patient education is vital. Only if they understand their problem fully and the need to control it well will they follow the doctor’s advice to the letter. What I would ask my readers to do is if anyone has been diagnosed as having any disease or condition, especially if it requires him or her to be on medications, then to seek a clear explanation from the doctor. I am sure the doctor will be more than happy to attend to the concerns. That doctor’s question served as a quick and timely reminder for me — to spend more time with my patients and help them understand their condition more. Dear Marilyn, You are right, it is either a chronic lung disease such as emphysema or bronchitis, or heart failure, which in this case is just as likely if not more. In most instances, it is possible to tell the difference between the two even before a stethoscope is placed on the chest. Heart failure has other symptoms such as difficulty in lying flat in bed because of breathlessness, known in medical terminology as orthopnea. Patients may also have swelling of the feet. Chronic lung disease, on the other hand has frequent cough and wheezing as the predominant symptoms.

Chronic smoking is the common denominator in both chronic lung disease and heart failure. In the latter, smoking accelerates the hardening of the coronary arteries - a process called atherosclerosis – which can lead to heart attack. Heart failure occurs because the damaged heart muscle does not allow the heart to work efficiently as a pump. When blood does not get squeezed out of the heart well, then there is a back pressure into the lungs. Fluid seeps out of the capillaries and cause pulmonary oedema, or water in the lungs, causing breathlessness. In chonic lung disease,

smoking causes permanent damage to the airways leading to chronic bronchitis as well as destruction of lung tissues giving rise to chronic emphysema. A careful examination by a doctor, including auscultating the chest with a stethoscope, can usually clinch the diagnosis. Two tests that will help are chest x-ray and echocardiogram. The latter is an ultrasound scan of the heart to see how strong the heart is. Having said all that, the best advice that I can give you is to say that your father has a problem which is likely to be serious and that he needs to see a doctor…fast.

LONG distance runner K. Prabudass nurses an ambition to debut at the Jakarta Sea Games in November. For one thing, he has the pedigree. His father is G. Krishnan who represented Malaysia in the 80s. This Diploma in Physiotherapy student of Masterskill University of Health Sciences, however, intends to do better. He is a regular in events, such as the 5,000m, 10,000m and 2,000m steeplechase. However, he must meet the qualifying time of 9:27.0s in the 2,000m steeplechase. He is competing against two other aspirants — J. Karthig and Ahmad Luth — for the two spots in the Sea Games. His dad won bronze in the 5,000m and 10,000m at the Jakarta Sea Games in 1979, and silver in 10,000m and bronze in 5,000m at

the Bangkok Sea Games in 1985. "I want to qualify first as the battle for places is still open," said Prabudass, who is being coached by former national athlete S. Muthiah. "I'm third in the pecking order but confident of making it to the Sea Games. "My personal best in the steeplechase is 9:40.0s. I can still try to make the cut in the Selangor Open, NS Open and national championships." Prabu, 21, had podium finishes in Sukma at Terengganu and Malacca. Recently, he was third in his pet event — the steeplechase — at the Malacca Open, where he clocked a poor 10:04.0s. He will represent Malaysian Private Educational Institution (Masiswa) in the Sipma Games in Malacca on June 2-12.

A former Kelantan netball player, she said: "I started my diploma at Masterskill

in 2008. Netball was my first love and now I also like futsal, where I play as goalkeeper. "Our management wants us to succeed in our studies as well as in sports." The lass from Bachok, Kelantan, added she received offers from two top private colleges while at Masterskill but declined. " My t a l e nt i n s p o r t s attracted them. I preferred to remain in Masterskill where it is less hectic, and the environment is friendlier." She was invited for selection for the national women’s futsal team ealier this year but had to decline as she was preparing for examinations. But she has not given up hope of playing at a much higher level.

Chiow Chuan's programme leads the way for grassroots development

UNEARTHING passionate, qualified coaches and enthusiastic children eager to excel in hockey — that could well be the marketing 1Mas development director Lim Chiow Chuan has in mind. This reporter received an email earlier claiming the 1Mas programme is a "misappropriation of taxpayers' money". What caught the reporter's eye was the allegation that the programme was "non-functional" in certain States. Apparently, Pahang — from where Malaysian Hockey Federation (MHF) president Tengku Abdullah Shah hails — is one of them. When told about the contents of the email, Chiow Chuan laughed but to his credit, he wasn't defensive either.

Having played in the 1992 Barcelona and 1996 Atlanta Olympics, he admitted some States were sleeping on the job. "There's no point in hiding the facts. Yes, some State HAs had problems, including Pahang and Johor. Pahang had internal problems but the programme was revived in mid-April," said Chiow Chuan. "Tengku Abdullah knew about it and he wasn't impressed at all. He made sure things were in order and now they are. Johor too ran into some coaching problems but that's all sorted out now." Nothing less then two golds is the target that has been set by the Selangor Cycling Federation for the 2011 Sukma. Amrun Misnoh, the association secretary, said the target of two golds is achievable and the team's athletes are also confident of reaching that target. "This is the minimum target we have set, but of course it will be great if we get more golds," said Amrun during the dry run held at the Cheras Velodrome. A total of 20 cyclists will be part of the Selangor cycling team at Sukma. Amrun explained that most of the cyclists have been under their association since they were in Form One. "On weekends, the team would go through long distance training, while every Friday they have their swimming sessions," said Amrun. Among the categories that the Selangor team will be participating in are team sprint, team pursuit and scratch. With only eight days remaining til Sukma, Amrun said the team is now focusing on speed and endurance in their training. "The training sessions are coming to and end, we just hope the cyclists are focused on the competition for now. Hopefully, it will be a good year for the Selangor team," Amrun concluded.

Bolt hoping bigger muscles lead to faster times

THE world's fastest man Usain Bolt revealed this morning he has put on some muscle in an attempt to stay ahead of the chasing pack. The 24-year-old Jamaican is making his return to the track for the first time in almost nine months at the Golden Gala meeting here, the third leg of the Diamond League series. He has not competed since being beaten by American Tyson Gay in Stockholm at the beginning of August. Bolt appeared bigger and more muscular than in the past but said he doesn't yet know what effect his ripped physique will have on his times. "I put a little bit more muscle on this season, I've been doing a lot of work strength-wise and core-wise and maybe that's why I look fitter," he said. "I'll definitely see tomorrow (what difference it makes) because this is going to be the first race that I'm looking like this. "I can't really say (what time he'll run) as I haven't run all season. "Normally I would've done a couple of races already (at this stage of the season) and I could determine what kind of time I could do. "But I've been doing well in training so I'm hoping it will be a very good time." It's not just core strength that Bolt, the world and Olympic champion over 100m and 200m — and the 100m record holder at 9.58secs — has been working on during his long lay off. He also wants to improve his starts. "Last season I didn't take

Devil Giggs fears for his place against Barca MANCHESTER UNITED ace Ryan Giggs (pic) fears for his place in the Champions League team in the final against Barcelona at Wembley on Saturday after his super-injunction outing on Monday in British Parliament. The Belfast Telegraph reported sources within United say manager Alex Ferguson is “beside himself with anger” over the outing of Giggs. And the veteran player himself fears the scandal will cost him his place in the team. Ferguson has, of course, known for a long time that his most decorated player was the man behind the socalled super-injunction, — just like virtually everyone else in the United Kingdom. The Daily Mirror reported Giggs was said to be so careful that even his agent Harry Swales only found out about the alleged affair with 28-year-old reality TV star and model Imogen Thomas when he was contacted by journalists. “I’m shocked. his family.” Meanwhile, cars have been vandalised yesterday in a suspected attack targeting photographers outside Giggs’ home. A group of masked men damaged the body work, slashed tyres and egged the vehicles parked near his mansion in Worsley, Greater Manchester. Press attention on the 37year-old Giggs intensified after Hemming’s “revelation”. A number of paparazzi photographers have been camping outside Giggs’ home, which he shares with his wife and their two children. A police spokesman said inquiries are continuing. However, he believes his old teammates will have to keep their concentration like they did when they defeated the Catalans in the semifinals in 2008 if they are to win. “It is the same Barca team from 2008 and what I saw for 180 minutes then was the highest level of concentration I have ever witnessed from a United team in 15 years of being here,” said Neville. “It was unbelievable.
