CAUGHT SHOPLIFTING? NOW WHAT? How embarrassing – stopped by a security employee as you leave the store and accused of shoplifting! You’re taken to a back room to wait while the police are called. And now you’re looking at going to the station to be photographed and finger printed and appearing in court to face the music. If this has happened to you, you’re far from alone. Shoplifting is perhaps the most common criminal offence in Canada. And despite popular belief, it’s not only the young or desperately poor who do it – people from all walks of life get caught shoplifting. Young people may sometimes do it on a dare. For adults, it may be just a sudden impulse or even sheer forgetfulness. But no matter, taking store property with intent to deprive the owner amounts to stealing. Even if it’s only a chocolate bar, it constitutes “theft under $5,000” under the Criminal Code. If convicted, the potential penalties for “theft under” are a fine of up to $2,000 and a jail term of up to 6 months. And you’d end up with a criminal record. Some of the consequences are restrictions on travel – you may not be able to enter the US, for example – and employment difficulties, both with your current boss and potential future employers. And since theft is seen as a crime of dishonesty, there’s a certain stigma attached to it – and a conviction may disqualify you from certain jobs altogether. But depending on the circumstances, there may well be things that a good criminal defence lawyer can do to minimize the nasty consequences of a shoplifting charge.
Particularly if it’s a first offence, she may be able to persuade the Crown prosecutor that “diversion” (sometimes called “alternative measures”) would be appropriate. The prosecutor is in a position to “divert” the case out of the criminal justice court process altogether and substitute alternative measures. This may happen if you acknowledge you’re sorry for what you did and agree to make amends. The alternative measures could mean returning or paying for the stolen property, counselling, making a gift to charity and/or spending time doing community service. If the prosecutor agrees to divert the case, there’s no court hearing, no conviction and no criminal record. But beware – even if obtained, it’s a one-time-only pass. Or your lawyer may be able to improve the outcome of a shoplifting charge, even if it goes to court. Maybe, for example, you can get an absolute discharge or a conditional discharge and probation. In this case, so long as you fulfil the conditions of probation, there’s no conviction and no criminal record. Separate rules apply to young offenders, so if your child or teenager is caught up in such a situation, seek good legal help right away too. If you find yourself accused of shoplifting, don’t try to go it alone. Remember you have the right to remain silent – you don’t have to say anything to the store personnel or police that could incriminate you. And remember you also have the right to ask to talk to a lawyer. Make use of that right, and follow the advice you’re given.

Myrtle Mildred (Jensen) McKilligan 1921~2014 In 1949 the couple moved to Vallican and from there to Lardeau, then on to Kaslo where Myrtle has since resided.
Myrtle McKilligan of Kaslo passed away peacefully on November 30, 2014 at the Victorian Community Heath Centre where she resided for the past 3 years. During her stay there, Myrtle won the hearts of many of the nurses and staff with her unique sense of humour and her loving and gentle ways.
Together they had four children: Dale Wayne McKilligan (deceased), Patricia Ann McKilligan (Boyle) of Harrison Hot Springs, BC, Ronald Roy McKilligan of Kaslo and Roger Dean McKilligan of Pattaya, Thailand.
Myrtle was born in Eastend, Saskatchewan on May 4, 1921 to Nick and Bertha Jensen, the sixth of eight children. After finishing her education there she left home to work at various jobs in the area. At the age of 20, she and her younger sister of 15 moved to Vancouver BC to work. She later met and married Wayne McKilligan there in 1944.

Myrtle is also survived by two grandchildren, Stacey McKilligan (Chataway) of Calgary, AB and Jason McKilligan of Nelson, BC, as well as two great-grandchildren Peyton and Quinn Chataway of Calgary, AB. Myrtle will be greatly missed by family and friends. There will be no service at this time.

Cowan’s Gets Wrapped Up With The Nelson Food Cupboard Cowan’s is launching a great new holiday idea especially for the arts town of Nelson. This concept not only promotes the awesome stimulation of mindful gifts but is also an opportunity to help out others this holiday. As the staff were preparing for this year’s holiday gift buying season they realized something wonderful – that people were starting to discover the amazing benefits of gifts that activate the mind and inspire imagination. They also realized that this time of year is very stressful for many people, so they decided to do something about it and introduced the Complimentary Crafty Christmas Wrapping Station and Creative Kids Fun Zone, a place in the Cowan’s store where children and adults have access to a wide variety of crafting tools to wrap their gifts, create artwork and cards, and make personalized holiday paper. To pay forward the efforts, all they ask for is a donation to the Nelson Food Cupboard, as this time of year is when some families need all the help they can get. The intention behind this project is to get people using their hands this holiday to be creative while also getting the opportunity to help out those who will need a little extra this year. “Nelson is wonderful community with many talented and compassionate people. When we started to notice the trend toward people buying art and creative supplies for Christmas we wanted to do more for them by offering an imaginative way to wrap their gifts and an opportunity to pay forward good fortune during these Holidays,” says Paul Cowan of Cowan Office Supplies. Kootenay Lake Fishing The Current State As expected, fishing has its ups and downs on every body of water. And whether it be a natural cycle or intervention of humans, or a management issue, there has to be peaks and valleys. Every ecosystem works that way. It’s common knowledge that our kokanee numbers have declined drastically – that’s true. With over 150 days on the lake each year and over 20 years experience, we have seen these patterns before. But, I can tell you that the rainbow trout are still around. We are catching them. They just might not be as big as usual due to the lack of food. Our fishing as of late has been fairly consistent. We are still getting out on a regular basis, and contrary to some stories out there, we are still catching fish. Lots of smaller rainbows have been feeding lately, as well as a few big fish. You just have to put your time in. We have been putting in our time, and we are out there regularly, and that’s why we have been catching fish. Just remember, you can’t catch them from the couch. There certainly haven’t been a lot of boats out there lately. But, that’s one of the great things about this lake. It’s not overcrowded. Our clients from the bigger cities can’t believe how pristine our area is and they can’t believe how little traffic is out on the water. It’s like we have the lake to ourselves. What a great resource. These same clients are also having a blast catching fish. While we may not have the 20-pound class fish hanging around lately, most tourists have been very happy with catching fish between 2 – 13 lbs. Where else can you experience the chance of catching rainbow trout over 10 lbs and enjoy the spec-
tacular scenery. We may have been spoiled by regular big fish in the past, but the out of town folks are still excited to share this exciting fishery. As we are experiencing this so-called downward cycle, keep in mind that there are still fish out there and it is still called ‘fishing’. A day of fishing is all about the experience. Spending any time out on the lake is very gratifying to us, and being able to spend a day on the water with a bunch of buddies is what its all about. The fish are an added bonus! So, don’t be discouraged by some of the stories. And know, we are still catching fish! Seeking Participants For Focus Groups The Kootenay Boundary Community Services Co-operative (the Koop) is inviting residents from Nakusp, Creston and Castlegar to participate in their focus group sessions addressing the delivery of community social services programs. The sessions are set for January 2015 and an honorarium of $40 and refreshments will be provided. Says Koop executive coordinator, Prudence Elise Breton, “We are aiming for a diverse group of 6-8 residents in each municipality. We are looking forward to learning more about how the public perceives community services organizations through this project. We are encouraging individuals to apply who are 21 or older, have resided in the region for five years or more and who are not currently employed (or do not have immediate family employed) by a social services organization or related ministry.” The project requires a time commitment of 1.5 to two hours of one evening.
