CHILD SUPPORT RE-EXAMINED Child support obligations aren’t always clear, especially if there are unusual circumstances. The BC Court of Appeal recently dealt with such a case.

Mark, 68 and retired, owned a mostly US real estate portfolio worth $11 million (in addition to a substantial inheritance)and earned some $168,000 a year.

The court considered the child support obligations for Peter (all names changed here), a pleasant 24-year-old man with a mental disability. Peter couldn’t make basic decisions for himself and likely would never be able to live independently. His life expectancy was normal, and he would need support for the rest of his life.

Their son Peter had some significant assets himself, partly from an inheritance from his grandmother and partly from a trust fund, though that fund could only be accessed if the Public Trustee agreed. Peter also got some monthly government assistance.

Peter’s parents, Mark and Linda, had divorced in 1995. They initially shared joint custody and guardianship of Peter, five years old at the time, but in late 1996, they agreed that Mark would have sole custody. Since Mark’s business took him to the United States a great deal, he also agreed to pay Linda (who earned only a modest income at the time) $300 a month in child support. This was essentially to enable her to travel to the US for visits with Peter, which she did frequently over the years. By the time of the court hearing over child support, however, both Linda and Mark were very well-off financially. Linda had married a venture capitalist in 1998 and enjoyed an affluent lifestyle. She didn’t work, and details of her current income were sketchy (she got some money from a company her husband was involved with). Before her first marriage to Mark, she had earned roughly $20,000 a year as a charter airline employee, and in the initial court documents in this case, she said she earned $20,000 annually, though later said it was less.

Due to the substantial change in Linda’s financial circumstances and her no longer having any financial difficulties in exercising access, the lower court decided Mark didn’t have to pay Linda any arrears dating from 2008 or make any further child support payments to her. But Mark also wanted his ex-wife to help pay for the ongoing support of their son. The Court of Appeal emphasized that, even though Mark could well afford to support Peter alone, Linda was also responsible for Peter’s support – it’s fundamental that both parents have an obligation to support a child like Peter, who was likely to outlive his parents. It was Linda’s voluntary choice not to work, observed the appeal court. So it said Linda should be treated as earning $20,000 annually. Using this income figure and the child support guidelines, the appeal court ordered Linda to pay Mark $174 a month toward Peter’s child support. The Ancient Art Of Marbling!

Oxygen Art Centre is pleased to present a workshop in the ancient art of marbling by Vancouver based artist Natalie Purschwitz. Dating back to 12th Century Japan, the ancient craft of marbling has amazed artists all around the world with its magical process of swirling inks, dyes and paints on a liquid surface to produce beautiful, organic patterns. For hundreds of years throughout Asia, the Mediterranean and across Europe, marbling has been used to create original artworks, endpages for books and colourful patterns for textiles. According to Purschwitz, there is a perfect balance between control and unpredictability in the process that is undeniably addictive. Every new piece is both a surprise and an accomplishment. The workshop will take place on July 25 & 26 from 10 am – 5pm. Oxygen Art Centre is located at 320 Vernon Street (back alley entrance) in Nelson. Adriana Bogaard, an alumna of the Capitol’s Summer Theatre Program herself, is thrilled to design the set for this group of talented youngsters. Currently a design student at the National Theatre School of Canada, Adriana is really excited to be involved with Capitol’s Summer Theatre Program this year to create some of the magical moments of Mary Poppins. Capitol Theatre director Stephanie Fischer says, “Mary Poppins the musical is a wonderful fusion of elements from the classic Disney film and the beloved stories of P.L. Travers. The RDCK is pleased to announce the Kaslo transfer station will reopen with full services on Friday, July 31. Upgrades to the RDCK’s Balfour and Kaslo waste transfer stations were an important part of the RDCK’s 2010 Resource Recovery Plan. Construction at the Kaslo Transfer Station began June 15 and is anticipated to be completed July 28. Construction will begin at Balfour once the Kaslo construction is complete which will cause Balfour to be closed from August 1 to October 2. The Balfour Transfer Station is scheduled to reopen Saturday, October 3. “We are pleased with the progress at the Kaslo Transfer Station and are excited to continue these valuable upgrades at the Balfour Transfer Station,” says Tom Newell, Chair of the Central Subregion Resource Recovery Committee. “Since the RDCK worked closely with engineers and contractors to ensure minimal disruption of service, the construction at Kaslo closures has gone smoothly and we expect that the Balfour closure will be just as painless for residents.” To minimize disruption to the public during the construction period at the Balfour site the RDCK will install temporary facilities adjacent to the transfer station gate so that residents have access to basic disposal and recycling services: • Small loads of residential bagged mixed waste ONLY will be accepted at Balfour on Wednesdays and Saturdays from 10 am to 4 pm during the construction period. Bagged mixed waste will be charged at $2.50 per bag. • Larger loads of mixed waste, scrap metal and wood waste will NOT be accepted at the Balfour site during the construction period. These loads should be brought to the Grohman Narrows Transfer station 4 kms west of Nelson, with the hours of operation for this site being Monday through Saturday 8:30 am – 5:30 pm. • Recycling bins will be made available during the construction period. Steel girders 118´ long were swung into place by Gwill Crane Services, while spectators watched from the safety of Railroad Ave. Rapid Span had manufactured the steel in two sections, after which it was trucked to Kaslo to be unloaded by Glen Settle and then bolted together to form a single span. Enthusiastic cheers, shouts and whistles greeted the hard working Kaslo Trailblazers Society team as the huge crane slowly settled the steel girders upon the concrete abutments designed by Pennco Engineering, all within ¼˝ of the target placement lines. After over 800 hours of volunteer work since early April, finally SUCCESS! Now work continues to complete the wood superstructure, including a roof, in a similar design to the 2007 bridge constructed further upstream as part of the Kaslo River loop trail. “Teens 101” Program

Canamedia, an independent production company, is producing the first-of-its-kind interactive, multimedia, multi-platform program aimed at informing and supporting youth and their families facing life’s varied challenges. Comprising of a television series, in-class lesson plans and mobile and web support systems, the program’s topics focus on youth mental health and well being issues, including: Peer Pressure, Bullying, Family Dynamics, Addictions, Body Image, Depression and Anxiety. The 13-episode television series entitled Teens 101 is currently in production helmed by veteran Producer & Director Daniel D’Or. “I want to produce this show that conveys to teens, that no matter what stressful challenges they may be facing, they’re not alone,” says D’Or. We want to empower youth with knowledge, tools and direction that they and their families may require. Permaculture Design Course

The Kootenay Permaculture Institute in partnership with Selkirk College is offering the 14th annual Permaculture Design Course in Winlaw, August 16 – 29. Permaculture is a holistic approach to land-use planning. The permaculture concept originated in Australia in the late 70s and now many people, organizations and companies around the world are using permaculture design principles to plan and create more ecological and resilient projects. Permaculture is the conscious use of ecological principles in designing self-sustaining food, fibre and energy producing ecosystems. The idea is to set up regenerative systems that work with nature – using a diverse number of species and activities, interdependence, recycling and conservation – with perennial plants including trees to produce a stable and self-reliant dynamic system. Permaculture design evolved from the observation of natural ecosystems that are usually abundant, resilient and often very diverse in species and in the relationship between species. You can create an abundance and diversity of food in your own backyard by using permaculture design principles and techniques while using only a small amount of energy, resources and time to implement and maintain the design. Permaculture systems can be developed in any climate and on any scale. The Permaculture Design Course will cover the principles of permaculture design and the different techniques that can be used on your land or in your small urban backyard. It will include many hands-on activities at the farm

in the Slocan Valley. The farm where the course is being held was started in 1993 using permaculture principles. It now produces a diversity of perennial vegetables, berries, fruits and nuts as well as many medicinal herbs and other useful plants. The participants will also work on a permaculture design exercise. Some of the topics covered during the course will include: Permaculture principles and techniques, site analysis, soil fertility, organic gardening, edible landscaping, fruit and nut trees, agroforestry, microclimate, water uses, forest ecosystems, land restoration, ecological building and urban permaculture. The instructor Gregoire Lamoureux has been living in the West Kootenay for over 25 years and is one of the most experienced Permaculture teachers in Canada. Guest speakers will include Barb Hazenveld who grew up in Alberta and traveled to Australia where she learned permaculture with Bill Mollison as well as Shanon Bennett who is an environmental educator and founder of Huckleberry Adventures, a program dedicated to instilling appreciation for the wonders found in the wilds of our backyards.
