YOU MUST TRY TO BE FINANCIALLY SELF-SUFFICIENT AFTER DIVORCE Anne and Steve (names changed) were married for 34 years before separating. Steve was the main family bread-winner during the marriage. Anne had worked in a bank for 20 years during the marriage. But, for the last 12 years of the marriage she had not worked at the bank, instead she did child care out of the family home. Anne was now 58 years old and did not have a high school diploma. Steve had never been supportive of Anne’s child care work and at the time they were breaking up she stopped running the childcare program. After their marriage ended, Anne did not try to get work outside the home, since she’d only qualify for minimum wage-type work that she wouldn’t like. Steve was at one time making $125,000 a year. But his income had recently dropped to $90,000, and his job was now less secure too. What were Steve’s post-divorce obligations for supporting Anne financially? And what were Anne's responsibilities to earn money of her own? The BC Court of Appeal considered this case recently. It highlighted that an important goal of our divorce laws is to encourage each former spouse to become economically selfsufficient after their marriage breaks up. You have to take reasonable steps to contribute to your own financial support. But, the court also acknowledged that becoming fully financially self-sufficient may not always be possible due to age, health, limited education or other reasons. Nevertheless, the court emphasized you have to

make an effort – it’s not fair to put the whole financial burden for your future financial support on your ex (and this wouldn’t promote the law’s important goal of striving for self-sufficiency after a marriage ends). The court went on to say that, yes, in our free society, you can choose not to take a job which you wouldn’t like and feel doesn’t pay enough (like minimum wage). But even if your earning ability may not be great, if you don’t try to contribute to your own selfsufficiency, you have to bear the financial consequences of your own personal choice. The court observed here that Anne received the family home when the marital property was divided up, in part because she said she wanted to run a daycare in it. But she hadn’t started on that. In these circumstances, the appeal court said that the spousal support Steve had to pay, based on his income and the guidelines commonly applied, should be adjusted downward. The court made an assessment of what Anne could be expected to earn, either as a part-time employee earning minimum wage or by running a daycare. These earnings were estimated at $1,000 per month ($12,000 per year). The spousal support order was therefore adjusted to arrive at a new, lower amount of spousal support he had to pay her under the guidelines. The Bears – And Garbage – Are Still Out For the past month, the WildSafeBC Community Coordinator and volunteers have been tagging garbage containers left out on the curb overnight in Nelson. How many did we find? We tagged 49 garbage containers – potentially 49 buckets of bear food – in two rounds of city garbage collection. There are still bears out – not to mention skunks, raccoons, coyotes, dogs, and rats – looking for food despite the colder weather. The North Shore, Blewett, Balfour, and communities within Nelson have all reported bears still getting into garbage. Garbage is one of the main attractants for bears, not just in Nelson but in the surrounding rural communities as well. The following are reminders to help keep wildlife wild and our communities safe: • Keep your garbage in a location inaccessible to bears. • If you do not have secure garbage storage, you can freeze the smelly food items until collection day or take the garbage directly to the transfer station. • A bear-resistant bin will reduce your chances of conflict. Please report any sightings or conflicts with widlife to the Conservation Officer Service hotline at: 1-877-952-7277. Off The Edge Of The Map With John Pollack On Thursday November 27 at 7 pm, Café Langham – Inspired Ideas Speaker Series at the Langham Cultural Centre in Kaslo will present its final talk of the year by South Slocan resident, John Pollack, of the Institute of Nautical Archaeology, the National Speleological Society, and the Royal Geographical Society. Mr. Pollack has participated in scientific expeditions for over forty years. He will take the audience on a visual, cultural and technological tour of recent projects in the Yukon, Laos, Borneo and Vietnam. John Pollack’s candid and humorous presentation will describe how “extreme surveying” has allowed him to participate in three National Geographic expeditions to document some of the largest caves in the world, map a Klondike Gold Rush era shipwreck in Lake Laberge, Yukon, and search for the lost Mongol invasion fleet along the coast of Vietnam. Expect an evening of great photography, innovative science, mapping underwater at 0˚C, and kayaking an underground branch of the Mekong River. Meet famous archaeologists and caver explorers, discover foreign cultures, and experience some South East Asian delicacies that are best avoided, like ‘wasp whiskey’. And of course, there will be a small but significant dose of science. Everyone is invited to the Langham’s last talk of the season! Watch for the 2015 Speaker Series beginning again next May. Giving Tuesday Is A National Giving Day You may have heard of Black Friday that marks the un official beginning of the Christmas shopping season, or Cyber Monday that promotes online shopping the Monday after US Thanksgiving.
