Principal’s Message Thank you to all who join in partnership with us at JVH, Jewett and Kaslo Homelinks to support the learning of our children and youth – and welcome to all of our new families and staff! Over the summer, Ms McAllister, Ms Leathwood, and I were able to interview and hire for eight teaching positions across our two schools. All of our successful candidates have expressed a strong understanding of, and interest in, working in our context as dynamic rural schools with strong community connections and relationships. Our staff had the opportunity to get together for two days of professional development at the end of summer and as I looked around the tables at our team, I felt truly fortunate to be doing this work with this group.

One of the best aspects of my work is listening to the collective wisdom and experience from many, diverse voices and trying to help build this into a positive and welcoming learning environment for all. “MATRIMONIAL HOME” OCCUPATIONAL RENT When a couple splits up, one spouse may choose or be forced to move out of their house and live somewhere else. Typically that house is a family asset. Its value will be divided between the spouses as part of the division of property and debts between them, and it may ultimately be sold. Is the spouse who moved out (and has to pay for living accommodation elsewhere) entitled to get “occupational rent” from the spouse who stays behind in their home? A decision of the BC Supreme Court illustrates how the court treats such a situation. Mike and Debbie (names changed) were married in 1985, separated in 2011 and got divorced in 2013. Both were 56 years old at the time of trial. Debbie moved out of the matrimonial home when the couple separated, while Mike continued to live there until it was sold some 16 months later. Debbie said the rental value of the house was $2,250 per month. She claimed $18,325 occupational rent from Mike for those months, pointing out she had to pay $800 per month in rent for her apartment once she moved out. The court said it could award occupational rent for the matrimonial home in certain circumstances. But it decided not to do so in this particular case. Mike made no claim for contribution from Debbie toward the house expenses he paid while living there alone (one common reason to award the spouse who left occupational rent, as an offset). And the court found little evidence that Debbie had been forced to leave their home. In B.C. , though not in many other provinces, you

usually have to be ousted from your home to win an occupational rent claim, if the stay-behind spouse doesn’t ask for help with the home expenses. But even apart from this somewhat dated fault-based rule, the court decided awarding occupational rent wasn’t appropriate here to achieve a just and equitable result overall, considering the two spouses’ incomes, assets and total financial picture. Many things may play into different occupational rent claim situations, including child and spousal support arrangements and any arrears; who the couple’s children stay with post-split; whether the stay-behind spouse alone pays the matrimonial home expenses like mortgage, insurance, taxes and home maintenance costs; and whether the staybehind spouse does things to improve or decrease the value of the home. Here, the matrimonial home (sold for $425,000) – bought in 1986 entirely with money Mike inherited from his mother, which the spouses lived in mortgagefree while together – was a family asset. Debbie got one half of the house’s value from the property division. She also had an inheritance of more than $400,000 coming from her mother after she and Mike split, which Mike wouldn’t share in. (Mike, on the other hand, could look forward to a greater income potential and increased pension entitlement.). In short, the court decided the overall financial arrangements after the couple’s separation, as agreed between the spouses and ordered by the court, took care of Debbie’s occupational rent claim.

Kootenay Lake Local Conservation Fund Request for Proposals The Kootenay Conservation Program (KCP) and Regional District of Central Kootenay (RDCK) are seeking proposals for projects that will benefit conservation in the rural areas around Kootenay Lake, specifically electoral areas A, D, and E within the RDCK.

Kaslo adopted an Animal Attractant Bylaw in 2008 which is intended to help us all reduce Kasloâ&#x20AC;&#x2122;s problems with animals, bears included, in our streets. Bylaw enforcement is now in effect. British Columbia Conservation Foundation Basics for everyone to remember are: â&#x20AC;˘ Do not put garbage cans out for collection before 5 am on garbage days â&#x20AC;˘ All garbage must be in cans, not put out on the street in bags â&#x20AC;˘ Be sure garbage cans, sheds and outdoor fridges and freezers are secure against any animal interference â&#x20AC;˘ No bird feeders are permitted between April 15 and December 1 â&#x20AC;˘ Do not leave pet food outside â&#x20AC;˘ Keep barbecue grills clean â&#x20AC;˘ Compost properly, without food or smells to attract wildlife â&#x20AC;˘ Pick fruit when ripe, and clean up windfall within 3 days (do not allow fallen fruit to stay on the ground) Kaslo must stop providing easy sources of food to wildlife, deer included,to protect both animals and people. The purpose of the Fund is to provide local financial support for important projects that will contribute to the conservation of our valuable natural areas. Kootenay Lake Local Conservation Fund (KLLCF) funding is available for conservation projects that result in the reduction to a known threat to biodiversity. The themes for the Fund are water conservation, wildlife and habitat conservation, and open space conservation. Projects that are technically sound and effective, and provide value for money through partnerships with other funders will be given priority. Proponents must be a registered not-for-profit organization, First Nations band or local government. Unqualified groups or organizations may partner with a qualified organization. A Technical Review Committee will review project proposals and make recommendations to the RDCK for final funding approval. The telehealth project began in January in the rural communities of Creston and Golden. The specially designed software links rural patients experiencing an MHSU crisis with a psychiatrist in a larger centre, via telecommunication. “Let’s say a patient goes to a health centre or an emergency department where there are limited mental health or substance use services,” explains MHSU Health Service Administrator Chris Huston. “Rather than asking the person to go to a larger centre, which takes time, we can now connect people almost immediately via secure video conferencing software.” Over the past three months, the project has had more than 10 telehealth enabled consultations from rural emergency department locations. Clients, physicians and staff members are all praising the new service. “This is an amazing tool for us not only to connect with our rural patients but to break down the barriers and stigma that people face in trying to get the support they need,” says Cranbrook Psychiatrist Dr. Reza Khosroshahy. “I’ve used the tool with great success and I’m excited to see the tool implemented across more of our rural communities.” The telehealth project is currently expanding to Boundary, Fernie, Kaslo, Nakusp and New Denver with services expected to begin in some of those communities by late September.
