YOU AND THE LAW WHEN IS IT UNFAIR TO SPLIT FAMILY PROPERTY EQUALLY?

After your marriage ends, do you and your spouse each get half of what you own? Are you also each responsible for paying half of your debts? Not necessarily. The Family Law Act came into play in BC on March 18, 2013. It empowers the court to order an unequal division of family property (and debts) if splitting them 50-50 would be “significantly unfair.” A recent case illustrates this. Jack and Jenny (names changed) married in 1997 and had four children. They separated in 2009. In early 2013, Jenny got an order for sole custody of the kids, and Jack was ordered to pay child support of $754 a month. Jenny applied to the court in July, 2013 to deal with the division of the money from the sale of their house. (Jenny was also granted a divorce.) The court looks at several things to decide if an equal split of family property would be significantly unfair, including, but not limited to the following: • the length of your relationship • any agreements you’ve made with each other • contributions made by you to the other’s career As well, the court can look at “any other factor … that may lead to significant unfairness.” That’s what the court did here. Early in 2010, Jack and Jenny agreed between themselves that Jack would keep about $100,000 worth of business equipment and vehicles, and Jenny would get the house instead of child support. Jenny afterwards paid the mortgage on the house with help from her family, but despite the “agreement” (and a later one where Jack “gifted” the house to her if she paid off

their family loans to buy the house), the house was never transferred to her. So in August, 2013, Jenny got a court order to sell the house. The sale resulted in net proceeds of about $70,000. Explaining why splitting the house sale proceeds in half would be significantly unfair here, the court said: “… there are elements to this case that clearly militate against dividing up the proceeds of sale equally between the parties. …[Jack] intended [Jenny] to have the equity from the matrimonial home in lieu of child support. While that might have made sense to the parties at the time, it reflects a view that all of the [other] matrimonial property, including the equipment and vehicles worth approximately $100,000, belonged to [Jack] to dispose of as he saw fit without regard to [Jenny’s] interests... If the proceeds from the sale of the matrimonial home were divided equally …, [Jack] would be receiving a double benefit – giving [Jenny] the home in lieu of child support and then effectively clawing half of it back, while still retaining … the equipment and vehicles.” The court decided Jenny should get all the house sale money. This would take care of Jack’s outstanding child support obligations from the time of their separation to March 1, 2014 (over $35,000). He could keep the roughly $100,000 worth of business equipment and vehicles that he got in 2010. In addition to an unequal split in some cases, certain property may be excluded altogether from the division of family property. Memorial Dedication to Bernice Gilbert On a sunny afternoon in June, a memorial bench was unveiled to honour the life of Bernice Gilbert, an active member of the Victorian Hospital of Kaslo Auxiliary Society. The bench was built by Bernice’s husband, Graham Gilbert. It is made of beautiful clear cedar. Placed in an area of the VHK courtyard grounds, the bench will provide a shady place for visitors and residents of the Long Term Care Facility to sit, to visit or simply enjoy time in the garden. 7KH EHQFK ZDV RI¿ FLDOO\ XQYHLOHG E\ Honora Cooper, VHKAS past-president, at a short dedication ceremony. Various members of the community Bernice Gilbert spoke at the unveiling. Bernice was a cherished member of the community of Kaslo and dedicated many hours of service to the VHKAS. She died suddenly on August 16, 2013 when stuck by a tree in Wells Grey Provincial Park while on a camping trip.

Anna Grace McLean Passed away August 29, 2014 Born on July 14, 1936. As a child, Anna lived in the Pend D’Oreille Valley; she moved to Fruitvale in her teens. She passed away peacefully with her family by her side after suffering a stroke and a battle with cancer. Anna was a very strong and hardworking woman who cared for her family very much. She was always loading up the grandkids into the motorhome and taking the kids to Fort Steele or Rock Creek Fair or somewhere else. Anna enjoyed curling, horseback riding, slo-pitch and mostly her children and grandchildren. She looked after the family business, NDB Trucking, until her health declined. Anna is survived by her husband Neil; sons Ron of Fruitvale, Len (Donna) of Fruitvale; daughter Shelley (Sid) of Salmo; sisters Irene (Don) Hill of Robson, Kathy (Jack) Seville of Robson; brothers Gary (Diane) Buckley of Camrose AB, Hugh (Shirley) Buckley of Pend D’Oreille Valley; Fred (Janice) Buckley of Pend D’Oreille Valley; 8 grandchildren, 7 great-grandchildren and many nieces and nephews. There will be no service at her request. A family gathering will be set at a later date. She will be missed by all who knew her. In lieu of flowers, donations can be made to the Canadian Cancer Society.

Community Health Report On August 26th the Kaslo and Area D Healthcare Select Committee and Kaslo Village Council met with Interior Health Authority (IHA) CEO, Dr Halpenny and two senior managers, with regard to the Victorian Community Health Centre in Kaslo. Council advised that Drs Allen, Fontaine and nurse Robert Nellis would be made ex-officio members of the Health Committee at their meeting that night and IHA concurred that that was a good step towards improving communication between themselves, local government and the community. It was also recommended that IHA appoint a Medical Director for Kaslo’s health centre, and IHA agreed to discuss the leadership role that the doctors could play after both full time contracts begin on September 15th. As part of the ongoing improvement to community health care it was recommended that an annual report be produced. The Committee and Council will continue to provide information as needed.

Lardeau Wharf Park Approved The provincial government has approved a 30 year lease of land adjacent to Davis Creek Provincial Park in Lardeau so that the RDCK can create a regional park with a public wharf. RDCK staff will now work with local residents on the siting and building of the wharf, funds for which were put aside through a Community Development grant several years ago.

Kootenay Lake Local Conservation Fund The Kootenay Conservation Program, in co-operation with Friends of the Lardeau, Friends of Kootenay Lake and others, will be sponsoring a clean up of the Lardeau/ Duncan River on World Rivers Day on Sunday, September 28th. The Area D Community Development Fund will pay any tipping fees at the Marblehead Transfer Station. For more information please contact Claire de La Salle at: friendsofkootenaylake@gmail.com Voters of Electoral Areas A, D and E will be going to referendum on November 15th to determine if they want to support a $15 per year parcel tax for local conservation initiatives. Over the last fifteen years some $150 million has been raised towards private land conservation in the Kootenays and a $20 parcel tax was introduced into the Columbia Valley a few years ago. Because of smaller parcels in the West Kootenay, the three Directors decided to ask for $15 per parcel. Such an assessment will collect $106,500 per year in Electoral Areas A, D and E and will allow us for the first time to work with and financially assist projects to enhance and maintain riparian and


low elevation ecosystems. Already the Kootenay Conservation Program and Fish and Wildlife Compensation Program have been considering bringing in someone from the BC Cattleman’s Association to look at ways to halt the river bank erosion along the Duncan/Lardeau at the mouth of Hamill Creek. The Friends of Kootenay Lake’s second AGM will be in Kaslo on Saturday October 18th, and there is already some discussion on how and where to pilot a new and more ecological dock that would enhance fish habitat. Please watch your mailbox and the Pennywise and Valley Voice for more information on the Kootenay Lake Local Conservation fund referendum. 15. Johnson’s Landing The evacuation order for Johnson’s Landing was finally lifted on July 31st, after a meeting with residents and the then RDCK CAO Brian Carruthers, Development Services Manager Sangita Sudan, Regional Fire Chief Terry Swan, Alternate Director Watson and myself. The RDCK has agreed with the community that the temporary earthen works constructed right after the slide along Gar Creek should remain in place, and the Ministry of Forests, Lands and Natural Resource Operations has agreed to maintain a monitoring program above Johnson’s Landing. Chair Kettle and myself made no progress in persuading the provincial government to offer financial compensation to five of the seven property owners who were deemed ineligible under the current Disaster Financial Assistance Regulations. The RDCK will be proposing adoption of new regulations at the Union of BC Municipalities AGM in September. 16. Service 469 Discussions Earlier this spring the Nature Trust of BC (TNT of BC) announced that it no longer wanted to participate in the RDCK’s mosquito abatement program on the Lardeau/Duncan Flats unless there was a known threat of West Nile Virus. Along with a representative from the RDCK’s contractor, Morrow Bio-Science, I participated in a

teleconference with the Interior Health Authority, after which a Medical Health Officer directed a letter of support be sent to the RDCK advising that this program improved the working and living conditions in the Valley. In early August a meeting was held with some local businesses and community representatives who are now sending letters to TNT of BC explaining the importance of the abatement program to the local economy, and to the occupational health and safety of those working in the local mills and in agriculture during the mosquito larval hatch. The current program, in accordance with RDCK policy, uses Bacillus Thurigiensis Israelensis (BTI) which targets mosquito larvae through hand and aerial broadcast in a cornmeal. I will be meeting with representatives of TNT of BC in Vancouver on September 19th to discuss the 2015 season. 17. AKBLG, UBCM and RDCK The Association of Kootenay Boundary Local Governments (AKBLG) Executive will hopefully be meeting with the Minister of Environment to discuss lack of coverage by the new recycling program funded by taxpayers and residents of BC through Multi-Materials BC (MMBC). Currently the RDCK and Regional District East Kootenay (RDEK) are spending $1.6 million per year maintaining the old recycling program. In the RDCK only Nelson, Castlegar (parts of I and J), Kaslo and Nakusp have contracts with MMBC. Currently none of the mandated plastic packaging is being recycled in either RDCK or RDEK. On August 6th two representatives of the RDCK met in Cranbrook to discuss issues surrounding proposed new Agricultural Land Reserve regulations and two representatives of the Union of BC Municipalities are sitting on a provincial committee. Earlier, at the AKBLG AGM, members passed a resolution asking the government to halt making changes to the ALR, until appropriate consultation had taken place.
