HOW TO AVOID A CRIMINAL RECORD Say you’ve been nabbed by police and criminally charged – whether for possession of pot, shoplifting, or perhaps a driving offence (we’re not talking murder or robbery). You’re over 18 years old and it’s your first time. Is a criminal record a sure thing? Maybe not. A criminal defence lawyer may be able to negotiate with the Crown prosecutor and secure a guilty plea to a lesser, non-criminal offence (such as a motor vehicle infraction in the case of a driving offence). Or a criminal defence lawyer could win a “not guilty” verdict for you at trial. In either case, you’d avoid a criminal record. But what if your lawyer tells you neither of these options is likely? Let’s be clear – you want to avoid a criminal record if you can. Partly that’s because of the stigma attached. Nobody likes being branded a criminal. But a criminal record has other negative consequences. It may jeopardize your current job and disqualify you from holding certain jobs altogether (think teacher, nurse or bank teller). And you may have to disclose it when looking for a job – clearly it won’t help you land one in future. Also, it may result in travel restrictions. With a criminal record, you may not be able to get into certain countries, like the United States. So what can you do to avoid a criminal record? Several options may be available, and your lawyer will discuss these with you. One option is “alternative measures” sometimes known as “diversion.” Maybe the Crown prosecutor can be persuaded that in your particular circumstances
avoiding the criminal justice process is appropriate. You’d have to admit your guilt, take responsibility for what you did and try to make amends to the community. Typically this involves apologizing to those hurt by your actions, returning or paying for things that were taken, counselling and/or doing community service. But if the Crown agrees to diversion and alternative measures, it sure beats a criminal trial – and avoids a criminal record. Another option is: If you plead (or are found) guilty, the court might be persuaded that an absolute discharge is justified in your case. Maybe you are young and show remorse, and it’s clear to the court the offence was totally out of character. The court may lean against branding you a criminal. So if you’re lucky, you will, just this once, get an absolute discharge – and no criminal record. Yet another option is: If you plead (or are found) guilty, the court might be persuaded that a conditional discharge is appropriate. You would have to abide by a set of “good behaviour” conditions similar to probation for a specified time period. If you live up to those conditions, you will not have a criminal record. But make no mistake – if you trip up and break the conditions, pronto, goodbye conditional discharge, hello sentence and criminal record. In the case of either an absolute or conditional discharge, you can honestly say that you’ve never been convicted of a crime and you don’t have a criminal record. If you’re facing a criminal charge, even one that seems minor, see a good criminal defence lawyer – the consequences of a conviction and criminal record can be long-lasting and nasty.

Starting at 10 am and continuing to 3 pm, local sculptors David Ducharme and Peter Vogelaar will be hosting a pumpkin carving event to remember. Bring your own pumpkin or squash and learn tips and tricks to help you achieve great results. Explore the possibilities of creating beautiful works of art ranging from realistic faces to good old fashioned Jack-o-lanterns. Some sculpting tools will be available, but please bring your own if you have them. Later on in the day, from 6 to 9 pm, a campfire will be blaz-
ing, and local storytellers Mary Mortimer and Jake Conkin will be kicking off a round of tall tales, scary stories and music. Everyone is welcome to share their favourite tales. Lifelong Healthcare Series at the Co-op The Kootenay Co-op is hosting a new educational series with local naturopath, Dr. Christi Hartman of Full Circle Family Practise. The series will focus on diabetes, heart disease and osteoporosis in the fall/winter 2014 season. “We wanted to address some of the most preventable, yet widespread, diseases affecting our community,” says marketing & outreach manager Jocelyn Carver. Dr. Hartman will share factors that increase risk, basic information about how these diseases develop in the body, what is available for early detection as well as steps that individuals can take to reduce the risk of developing these conditions. “Our classes show participants how they can positively influence their own long term health,” says
Carver. “Having a naturopath as the instructor adds a level of expertise and experience to the classes that we are very excited about.” Classes are $20 for Co-op members ($25 for non-members) and include instruction, discussion, sampling and light refreshments. UPDATE - FALL 2014 THIS $900 MILLION, FOUR AND A HALF YEAR PROJECT IS BRINGING BENEFITS TO OUR LOCAL COMMUNITIES AND WORKERS
The Waneta Expansion Project near Trail is one of the largest hydroelectric projects currently under construction in British Columbia. When complete in 2015, it will generate 335 MW of clean, hydroelectric energy by sharing the water from the existing dam. It will provide enough energy to power about 60,000 homes per year and will reduce greenhouse gas emissions by 400,000 tonnes, the equivalent of taking 78,000 cars off the road. Recent project milestones include completion of work on the runner, stator and rotor for one unit, installation and commissioning of the gates, stoplogs and sturgeon exclusion screens in the powerhouse, watering up and blasting in the tailrace area (where the water will re-enter the Pend d’Oreille), and completion of structural concrete work in the intake area. Construction activities are currently focused on completion of the electrical and mechanical work in the powerhouse, rotor and stator assembly and completion for the remaining unit, preparation for watering up and blasting in the intake area, and commencement of de-mobilization and reclamation work.

It’s a vital part of Nelson’s identity as a community that values its past, but Streetcar #23 may have never seen its rebirth if not for the vision of a former Selkirk College administrator who helped pluck the storied people-mover from a pathway towards total disappearance. In 1981, Bruce Meldrum was the principal at Selkirk College’s Silver King Campus and in his spare time took on the role of president of the Nelson & District Chamber of Commerce. from pg 21 industry and primary resources. Unemployment was high and the future was uncertain in a community that had witnessed the recent closure of its waterfront mill. Meldrum and those behind the Streetcar #23 project saw an opportunity to not only restore the vehicle, but put people to work. In November, 1982 the streetcar was moved to the Silver King Campus where it could be safely housed while the restoration took place. Using job creation programs from senior levels of government, the group managed to secure funds to hire unemployed workers to undertake the task. In 1988, a grant was secured to construct a building that would house the now refurbished streetcar on the corner
of Hall and Front streets. The building was pre-fabricated on the Silver King Campus and then constructed on the site. In February, 1988 Streetcar #23 was moved to the new location where it was put on display for the public to see. In the first six weeks, more than 1,700 people came through to check out the impressive restoration. It took a few more years for community leaders to prepare and raise funds for the waterfront route which Streetcar #23 currently runs. On July 1, 1992 the community finally realized the rebirth of a cherished piece of history. On that opening day more than 800 people rode the streetcar along Nelson’s majestic shoreline. VOTING BY MAIL: Mail ballots are available to qualified electors in the following instances:

New Staff At The Whole School This September The Whole School welcomes three new staff members: two teachers, Nashira Birch, a teacher with specialized training in outdoor and multi-age classroom education, Rose Hodwitz, also a certified teacher and Educational Assistant; and JosĂŠe Corrigan, the new administrative coordinator will join Anniah Lang, our principal/teacher. Nashira is a Kootenay local originally from Argenta. She has been an educator since 2004 through a variety of community-based programs â&#x20AC;&#x201C; from teaching preschool to adventure therapy to developing and implementing childrenâ&#x20AC;&#x2122;s programs focused on environmental and global citizenship. Rose Hodwitz grew up in a communal living environment and feels perfectly suited to the home-like, mixedage classrooms at the Whole School. She has worked as a teacher, teacherâ&#x20AC;&#x2122;s assistant and support worker since 2003. She is also a local potter. These new teachers are joined by JosĂŠe Corrigan, the schoolâ&#x20AC;&#x2122;s new administrative coordinator. JosĂŠe, also a trained mediator with an Masterâ&#x20AC;&#x2122;s degree in alternative dispute resolution, has lived in the valley for over 14 years. Anniah Lang continues to bring her expertise to the Whole School using the Circle of Courage model â&#x20AC;&#x201C; a positive youth development model based on the universal principle that to be emotionally healthy all youth need a sense of generosity, independence, belonging and mastery. â&#x20AC;&#x153;The Whole School combines attachment theory and the Circle of Courage with multi-age, small classroom sizes to support each student to excel at their own pace, and we have never turned a family away for lack of funds,â&#x20AC;? said Anniah Lang. The Whole School has a vision of sharing the Circle of Courage philosophy with other related child and youth groups in our community. Games Day Kicks off Curling In Kaslo The Kaslo Curling Club hosted a free, fun Games Day and Open House on Saturday, October 4 to kick off the 2014-15 curling season. Guests worked up an appetite and won cash prizes at the darts, Wii dance and egg race contests before enjoying a BBQ and yummy desserts. Our goal was to bring new faces into the club, so we are very pleased that 25 non-members came out and we were able to get 21 of them on the ice. Twelve courageous souls delivered their very first curling rock after receiving some instruction. The draw to the button contest brought even more people out and the non-members outscored the club members, showing “How hard can it be?” Mona Zilkie won the $100 draw to the pin, while Gerry McMahon won $50 for second closest. cont’d on pg 52
