“MATRIMONIAL HOME” OCCUPATIONAL RENT When a couple splits up, one spouse may choose or be forced to move out of their house and live somewhere else. Typically that house is a family asset. Its value will be divided between the spouses as part of the division of property and debts between them, and it may ultimately be sold. Is the spouse who moved out (and has to pay for living accommodation elsewhere) entitled to get “occupational rent” from the spouse who stays behind in their home? A decision of the BC Supreme Court illustrates how the court treats such a situation. Mike and Debbie (names changed) were married in 1985, separated in 2011 and got divorced in 2013. Both were 56 years old at the time of trial. Debbie moved out of the matrimonial home when the couple separated, while Mike continued to live there until it was sold some 16 months later. Debbie said the rental value of the house was $2,250 per month. She claimed $18,325 occupational rent from Mike for those months, pointing out she had to pay $800 per month in rent for her apartment once she moved out. The court said it could award occupational rent for the matrimonial home in certain circumstances. But it decided not to do so in this particular case. Mike made no claim for contribution from Debbie toward the house expenses he paid while living there alone (one common reason to award the spouse who left occupational rent, as an offset). And the court found little evidence that Debbie had been forced to leave their home. In B.C. , though not in many other provinces, you

usually have to be ousted from your home to win an occupational rent claim, if the stay-behind spouse doesn’t ask for help with the home expenses. But even apart from this somewhat dated fault-based rule, the court decided awarding occupational rent wasn’t appropriate here to achieve a just and equitable result overall, considering the two spouses’ incomes, assets and total financial picture. Many things may play into different occupational rent claim situations, including child and spousal support arrangements and any arrears; who the couple’s children stay with post-split; whether the stay-behind spouse alone pays the matrimonial home expenses like mortgage, insurance, taxes and home maintenance costs; and whether the staybehind spouse does things to improve or decrease the value of the home. Here, the matrimonial home (sold for $425,000) – bought in 1986 entirely with money Mike inherited from his mother, which the spouses lived in mortgagefree while together – was a family asset. Debbie got one half of the house’s value from the property division. She also had an inheritance of more than $400,000 coming from her mother after she and Mike split, which Mike wouldn’t share in. (Mike, on the other hand, could look forward to a greater income potential and increased pension entitlement.). In short, the court decided the overall financial arrangements after the couple’s separation, as agreed between the spouses and ordered by the court, took care of Debbie’s occupational rent claim.

Kootenay Lake Local Conservation Fund (KLLCF) funding is available for conservation projects that result in the reduction to a known threat to biodiversity. The themes for the Fund are water conservation, wildlife and habitat conservation, and open space conservation. Projects that are technically sound and effective, and provide value for money through partnerships with other funders will be given priority. Proponents must be a registered not-for-profit organization, First Nations band or local government. Unqualified groups or organizations may partner with a qualified organization. A Technical Review Committee will review project proposals and make recommendations to the RDCK for final funding approval. To apply for funding, go to www.kootenayconservation.ca and click on the Kootenay Lake Local Conservation Fund tab. Review the Terms of Reference, paying particular attention to Section 8 – Fund Design and then apply using the application form provided.
