Trail Market on the Esplanade discontinued
The City of Trail is announcing it will not proceed with the Trail Market on the Esplanade (TMO) in 2019 and future years due to the decline in attendance in recent years. The event started in 2012 as an initiative brought forward by the Trail & District Chamber of Commerce and a sub-committee of the Downtown Opportunities & Action Committee to bring vibrancy to the downtown core. Since the TMOE’s inception, several markets in the area have developed and more community events have been established, providing vendors and patrons more shopping and entertainment options. We encourage past TMOE participants to inquire about the other markets in the area, such as the incrEDIBLE Trail’s Farmers’ Market that occurs every second Saturday downtown Trail from April to October with some special event markets happening throughout the season. For questions about the Trail Market on the Esplanade, please contact the City’s Communications & Events Coordinator at communications@trail.ca or 250-364-0834. www.trail.ca//en/News

Student Ryan Hommy is a veteran indie rock musician who has returned to school for a formal education.
Students present year-end concert series
Ryan Hommy is a Selkirk College Contemporary Music & Technology Program student, but he’s also a veteran performer and fan. As he joins classmates in preparing for the annual Year-End Showcase Concert Series that runs over the next three weeks, Hommy is looking forward to an entertaining eight nights of music. “It’s always really cool to see the creation that all these students come up with,” says the 34 year old. “From when students start in first year to now, it’s just night and day. If people are into live music generally, they want to see a show that has good sound in the Shambhala Hall and they like to experience something that they might experience once, it’s a good idea to check it out.” The year end shows run March 15 through April 5 and will feature 17 student performances in a variety of different genres over eight nights. An important part of the final stages of their formal education, students are required to put together a band of peers, choose songs for their 30 minute set and execute the performance. Students can choose to perform original music, covers featuring their own interpretation or a mix of both. Alexanne Kasandra arrived to Selkirk College one year after graduating from high school in her hometown of Winnipeg. The 20 year old grew up singing in choirs, picked up a guitar in middle school and by high school was performing with a friend in coffee shop gigs. As she gets set to graduate this April, Kasandra is confident the last two years of study in the classrooms and studios at the Tenth Street Campus have prepared her well for what’s to
come. “We are in a program that moves fast and the course load is heavy,” she says. “It’s awesome because it makes you a hard worker and able to thrive under pressure, two really important traits to have that will serve me well in the future.” Like Hommy, Kasandra is looking forward to her own performance and those of her classmates. “There are so many talented people we have as classmates, it motivates and inspires me,” Kasandra says. “Everybody is working so hard, anybody who comes out to any of these showcases will be blown away.” Kasandra’s showcase is on March 29 where she will be performing three originals and three covers in a genre she describes as alternative pop with a little bit of an electronic element. Hommy will be on stage with his band on April 5 with a show featuring all originals in a genre spanning style that draws mostly on his punk rock background. Other performers and dates are as follows. March 21: James Alexander (rock/metal, jazz, funk), Liam Van Haretzmuller (metal). March 22: Stephen Beck (progressive rock, heavy metal), Calvin Reid (hard rock, metal, jazz). March 28: Brendan Watts (rock, instrumental), Shannon Sargent (blues, rock). March 29: Jonah Miller (hip hop, R&B), Alexanne Kasandra (pop, singer/songwriter). April 3: Santo Joseph (rock, fusion, funk), Waseem Hakhroo (jazz fusion, funk). April 4: Tiago de Renor (electronic ensemble), Amon Carpenter (contemporary alt pop), Cole Senger (rock, R&B, country). April 5: Isaac Klaassen-Wright (loud, rock, prog rock, metal), Ryan Hommy punk, rock, progressive). All performances take place at the Shambhala Music & Performance Hall on the Selkirk College Tenth Street starting at 7:30 pm. Admission is by donation and seating is limited so arrive early. Doors open at 7 pm. Learn more about the Contemporary Music & Technology Program at: www.selkirk.ca/music Submitted by Bob Hall

78 YOU AND THE LAW®
LAW OFFICE
CAN YOU BE FORCED TO TESTIFY AGAINST YOUR SPOUSE? There used to be a centuries-old spousal immunity rule – generally, you couldn’t be forced (and weren’t competent or able) to testify against your spouse in court in a criminal case. But that is no longer the case. A reform of the federal Evidence Act in 2015 did away with this outdated general rule. A spouse can be forced (by subpoena from the prosecution) – and is competent and able – to give evidence against the other spouse. (Even before 2015, there were exceptions to the old general rule, for example, in certain domestic violence situations and in cases involving abuse of children under 14. In these cases, clearly a spouse’s evidence would often be crucial to prove the offences had occurred.) But there’s another old-standing rule or “privilege” for spouses that still survives. It applies when you don’t want to testify against your spouse about communications you had with him or her while married – even though you still have to show up in court and testify. That rule allows you, as the unwilling spouse, to claim socalled “spousal privilege” and refuse to give evidence about those communications. Such communications aren’t automatically protected. If you want to give evidence against your spouse about conversations you had, you’re able to do so under the reformed general rule. And if unwilling, you must now actively claim spousal privilege for these communications. Some of the historical reasons for the original spousal immunity rule seem odd to modern ears. (Examples are the outdated former notions that legally, upon mar-
riage, a wife’s identity was submerged in that of her husband, and that a husband’s and wife’s interests were always one and the same.) They are out of step with today’s legally recognized values of individual autonomy and equality between the sexes, including marriage partners. Reform of that general rule was overdue. When it comes to your right to claim “spousal privilege” for intra-marital communications – which still exists – society’s interest in fostering marital harmony is the main still-valid reason for this privilege. But it comes at a price. Suppose there’s a lack of evidence in a criminal case due to a spouse’s claim of spousal privilege? Imagine, for example, that a spouse refuses to testify in court about their spouse confessing to them about committing a serious offence, and there’s not enough other evidence to prove that. The offence would go unpunished, in aid of preserving marital harmony between these spouses. So limitations have developed on when spousal privilege can be asserted, and by whom. It’s available for communications made between spouses who are legally married and still together, but not perhaps for communications between partners in a common-law relationship, even a long one. It’s not available for communications before marriage even if the couple later marries. It’s also not available after divorce, or if the couple has irreconcilably separated (even though still technically married) – there’s no marital harmony left to preserve. For help through the legal thicket, see your lawyer.

Would your acreage benefit from soil amendment? Mercer Celgar is looking for landowners with 2 or more acres within 55 km of Castlegar that would benefit from using their Celgrow soil amendment. Pastures and hay fields are good options. Mercer Celgar will cover the costs of a qualified professional performing soil sampling, obtaining government authorization and delivery costs of Celgrow soil amendment based on access with a large truck/pup combination. Acreage should be able to accommodate at least 6 truck/pup loads. The two major components of Celgrow are individual wood fibres lost from the pulping process and surplus bacteria from the wastewater biological treatment facility. Wood fibres enhance soil moisture retention and bacteria are a good source of soil nutrients. The landowner is responsible for spreading and incorporating Celgrow into their soil.

Wine Festival celebrates 20 years!
RCAC presents An Unconventional Life
The Rossland Council for Arts & Culture (RCAC) is thrilled to present An Unconventional Life on Friday, April 5, at 7:30 pm. This musical and theatrical performance piece was written by Lynn Van Deursen, and will be performed by Noemi Kiss and Lynn Van Deursen with pianist Judy Runions. Through the guise of a graduation speech, An Unconventional Life tells the tale of an unconventional young woman and her passionate pursuit of an education. This remount of the very popular musical drama based on the film ‘Yentl!’ An Unconventional Life is the result of three Kootenay artists collaborating during the winter months; daring to dream not only about spring returning, but also about sharing their creative efforts with an audience. When local soprano Noémi Kiss decided she wanted to sing all the songs from the movie Yentl starring Barbara Streisand, she asked Kaslo thespian Lynn van Deursen if she could ‘write something theatrical’ to link the songs together and create a performance piece. Noémi then asked Nelson pianist Judy Runions if she’d be willing
Twenty years ago the Castlegar Sunrise Rotary Club introduced wine festivals to the area. From that first festival our event has grown from 16 wineries to the 29 we are welcoming on April 6. We have been honoured to showcase 133 BC wineries over the years. This year the wineries are presenting a wide variety of intriguing samples to savour along with delectable appies (some gluten free) from Alligator Pie. Our renowned silent auction returns with an extensive selection of items from hotel stays to home furnishings, golf and ski passes and even a bicycle and dishwasher. Incredible raffles feature a private shopping spree at SWISH, Celtic pendants from Ted Allen’s and a Mountain Waters spa treatment. The door prize of a one night’s stay at the Lakeside Resort in Penticton accompanied by a wine tasting and tour at Dirty Laundry Vineyard will complete the evening. Don’t miss this very special event on Saturday, April 6 from 7 to 10 pm at the Castlegar Community Complex. Tickets are available at Oglow’s Paint and Bubblees in Castlegar as well as Trail Coffee Company. Dress is semiformal at this Safe Ride Home event (by donation to the Castlegar Interact Club). Hope to see you there! Submitted by Sandy Hartman
