BUSTED FOR POT POSSESSION? You’ve heard that in Colorado and Washington State just south of the border, voters approved legalization of marijuana even for recreational (not just medical) use in 2012.

into many countries, particularly the U.S., because of travel restrictions. In short, a small baggie of the stuff, maybe just a friendly gift, can end up causing you a long-lasting hangover.

We in Canada lag behind these USneighbours when it comes to “soft drugs” like marijuana. Sure, there’s been talk about letting police just issue a ticket to someone found in possession of a bit of pot, say 28 or 30 grams. But that would be a far cry from “legalizing” possession. And even that small step, which would make simple possession a minor infraction, hasn’t been taken.

So what’s possession, anyway? Basically, based on what police find (and what you say), the police must prove that you had the stuff on you, like in your pockets or purse, or that it was under your control (like in your car’s glove box) – and that you knew what it was. So you can be in possession of marijuana even if you don’t own the stuff. Police also have to prove in court what the substance was, usually by a test report.

In fact, simple possession of even a tiny amount of pot is still not just illegal – it’s a crime in Canada (some medical exceptions apart). A first offence can lead to a maximum fine of $1,000 and a maximum jail term of six months. Penalties increase for repeat offenders. And there are stiffer sentences if you’re charged with possession for the purposes of trafficking, or with trafficking (basically, selling the stuff). Of all the provinces in Canada, British Columbia – famous for its “BC Bud” – has one of the highest rates of charging people with possession. Now, you’re not likely to be hit with the maximum penalties if convicted of simple possession for the first time. But there are still nasty consequences. For one thing, a conviction results in a criminal record. This may have to be disclosed on employment applications, so can hurt your ability to get a job. Also, you may afterwards not be able to get

But even if you’re caught with some pot, you have some fundamental rights to due process in Canada that may help you avoid conviction. You have the right to remain silent – so don’t blab your way into a confession. And you have the right to be protected against unreasonable search and seizure. So if police come to your house with a search warrant (basically, a judgeapproved authorization to search your house) for something else, and they come across your small stash, the court may not allow that into evidence – it all depends. The court may also look closely at the information used by police to get a judge to approve the search warrant in the first place. Probably the best thing you can do for yourself if busted for pot possession (or worse) is to exercise your right to call a lawyer at the first possible opportunity – and follow her advice!

Help Is Just A Phone Call Away With New Surveillance Nurses Six months into the new Surveillance Nurse program within Interior Health, remote telephone checks are having a positive influence and helping independent seniors stay at home longer.

The focus is on stable long-term Home Health clients. Surveillance Nurses phone them to see how they are doing at least once every three months and more if required. Clients may also call the nurse when they have questions or need assistance. The program’s goal is to identify any issues as soon as possible, to help ensure these independent clients continue to do well living at home. “The regular calls ensure we are being proactive and supporting clients so they continue to be lower needs for as long as possible,” said Whitby. “For example they may need encouragement to increase their activity level, to socialize more, or to quit smoking. Or they may benefit from other support services.” Surveillance Nurses are currently located in Williams Lake; Kamloops; Vernon; Kelowna; Penticton; Cranbrook and Castlegar. They support approximately 280 clients. As the program grows, they will continue to expand their reach across the health authority.

Therapeutic Riding Camps 2014 Equine Empowerment Camps are being offered for West Kootenay area youth from ages five to 19 at the Pass Creek Regional Exhibition grounds near Castlegar. These camps are free of charge and sponsored by Columba Basin Trust, Arrow Lakes Therapeutic Riding Association and Pass Creek Regional Exhibition Society. Camp participants will receive two 1.5 hour lessons per camp, which will be tailored to each individual and include working with horses, whether that means riding, grooming or simply learning about the horse. We aim to create a safe and comfortable environment for each individual participant. Camp dates are Thursday, August 21 to Saturday, August 23 and Friday, September 26 to Sunday, September 28. Pinto is a pretty brown and white female rat around 1 year old. She was found abandoned in an apartment and brought to the Trail Regional BCSPCA on May 24, 2014. Pinto is very neat and smart. She uses the litter box and loves to be handled, especially when she gets to sit on your shoulder. She is a great choice for guardians who want to have a pet, but live in a small apartment. Pinto lives in a cage with her sister Sterling, and while she would be happy to be adopted with Sterling, she would be fine on her own as well. Nutrition Tips For The Healthiest Summer Ever Summer’s finally here! And after a long, harsh winter, everyone is enjoying backyard BBQs, day trips to the beach, and weekend getaways to the cottage. The foods that often accompany these activities – hamburgers, cotton candy, potato chips and hot dogs – are hard to ignore, but do little to fuel your body with the nutrients it needs. Take advantage of fresh produce. With produce at its peak during the summer months, now is the perfect time to indulge in nature’s finest by eating the freshest vegetables. Instead of whipping up a batch of potato salad for your next BBQ, put together a mixed green salad. If you’re up to the task, create your own salad dressing. Do an internet search, or check out recipe books to get ideas for different salads and dressings. Eat your berries. Like vegetables, the most flavourful berries are readily available in summer. Instead of reaching for apple pie à la mode, make yourself a delicious fruit smoothie for dessert. When choosing fruits, always make sure you’re getting the freshest, and best quality fruit. If you’re unsure of how to pick produce, ask an employee in the produce department to help. Have fun during this summer by going to different farmers’ markets or going berry picking. ground turkey, or skinless chicken breasts. For added taste, soak in a marinade overnight and grill them to get that delicious BBQ taste. This way, you’re getting healthy, nutritious food without sacrificing taste. We all scream for ice cream! As the hot, hazy days of summer go by, often the urge strikes to reach for cool, sweet snacks like ice cream, popsicles and iced coffee drinks. While it’s okay to treat yourself to a sundae once in a while, these high calorie treats can quickly become an everyday item. To satisfy your sweet tooth without feeling guilty, look for healthier alternatives. Buy low-fat versions of ice cream or sorbet. Experiment with different brands and remember to control your portions! Running empty on water? With scorching hot temperatures and increased outdoor activities, more and more people are suffering from dehydration and other heat-related illnesses. It’s easy to get caught up in a softball game, but it’s extremely important to stay hydrated while engaging in physical activities during summer. If you’re mildly to moderately dehydrated, you may begin to feel symptoms such as dry, sticky mouth, thirst, dry skin, dizziness or light-headedness, and headache. If not treated, these symptoms can lead to a more serious or severe form of dehydration, marked by symptoms such as extreme thirst, lack of sweating, lower blood pressure, rapid breathing, rapid heart rate and loss of consciousness. To stay hydrated during the summer, keep a bottle of water handy at all times. Place it somewhere you can easily reach for it. With their tactile, textural and architectural qualities, the potentials of textiles are obvious and omnipresent; from the loincloth to Louis Vuitton. The question therefore is not why an artist would gravitate to textiles as an art form, but why-ever not. Angelika Werth notes that [t]he renewed interest in textile work, the acceptance of contemporary textile as an art form, the creative interpretations and combinations of traditional and contemporary techniques are what keep artists such as herself inspired and excited to be working in a medium that has evolved in concert with its makers. Angelika Werth has had numerous accolades for her contributions to the field of textile art. She has exhibited in over 30 juried exhibitions world wide, including Fibreworks in Cambridge, Ontario and the Contemporary Craft in BC: Excellence with Diversity at the Vancouver Museum in 2008. She was a recipient of the 2008 BC Creative Achievement Award and named ‘Cultural Ambassador’ by the city of Nelson in 2010. Jumbo Update Summer 2014 From a recent interview with my government contact person, the Senior Manager of Major Projects in the Mountain Resort Branch of the Ministry of Forests, Lands and Natural Resource Operations, I learned: We discussed the moving of the environmental assessments of newly proposed major ski resorts from the Environmental Assessment Office (EAO) into the All Seasons Resort Policy (ASRP) which includes the Can-

adian Alpine Ski Policy (CASP). The move is thought by all to be good as the EAO primarily assesses mineral and energy applications. The proper analyzers are now making sure ASRP and CASP are equally, or better, able to make the appropriate assessments. It is entirely likely that government will create proper legislation and use the original Order in Council date of January 2015 to make the change. All established Ski Resort applications will stay with the EAO. The office of the Mountain Resort branch recently received four applications to begin work in the Jumbo Valley by Glacier Resorts Ltd. (the parent corporation of the proposed Jumbo Glacier Resort development): 1. New road construction 2. Cutting trees (MOF) 3. Crossing Jumbo Creek with the road (MOE) 4. Building a day lodge in Jumbo Valley at the proposed village site. These applications took my contact person and the Joint Resources Forum (JRF) team to meetings with the Ktunaxa (Kootenay) First Nation as the Jumbo Glacier Resort development proposal is within their land claim. The JRF was there to guide the Ktunaxa to allow the four applications to move forward. RE: Judicial Reviews: The Ktunaxa’s Judicial Review challenged the granting of the Master development Agreement to GRL which allowed development to begin. The judge decided that development would not “impinge” on the sacredness of Qat’Muk. The Ktunaxa plan to appeal. Kathryn Teneese, Ktunaxa Nation Council Chair, said in a press release, “Our beliefs are what make us Ktunaxa and being told that our sacred relationship regarding Qat’Muk, and its need for protection from development, are not important enough to stop this development of our sacred place, should concern any British Columbian who cherishes the freedom to practice their religion without interference, and who respects constitutionally protected rights.” The West Kootenay Eco-Society’s Judicial Review challenges the legality of creating a municipality with no residences, the Jumbo Glacier Mountain Resort Municipality. “We are building the strongest possible case in order to move forward to win,” said David Reid, Executive Director of the West Kootenay Eco-Society. Since the original Jumbo Alpine Glacier Resort first came to public attention in 1990, we have been through eight governments including the present one. Residential Real Estate Market Update For First Half Of 2014 To understand how a real estate market is performing we must consider the absorption rate – how long it would take to sell off all existing inventory at the present velocity of sales. With 495 listings now active in the GTA*, it would take 18 months. A well balanced market is said to take between 5 and 7 months, so we are in a real bear of a buyers’ market.

Buyers rejoice. Not only do you have a great selection to choose from, but prices are down 9% from the same time frame last year. The number of homes sold is up 24% in the first half of this year over 2013. Buyers are finally taking advantage of reduced prices, low interest rates, and the situation of the sellers, who have realized that if they are going to sell, they must be competitive.

The average sale price for the first six months of 2014 was $189,959, compared to $208,839 in 2013. Buyers are opting for larger, more substantial homes over last year and paying less for them. The month of July 2014 saw more of the same. Prices were down 8% from July of 2013, and the number of sales up 5%.
