Maryum Ali to Keynote CHAIRity Luncheon Dallas Furniture Bank, a non-profit organization that provides gently used furniture to families transitioning from homelessness, will celebrate 15 years of service at its annual CHAIRity Friendraiser and Luncheon at the Belo Mansion, 2121 Ross Ave. at noon, Feb. 14. Maryum Ali, affectionately known as May May, will serve as the keynote speaker. Born and raised in Chicago, Ali is the eldest of boxing legend Muhammad Ali’s nine children. As a little girl, her father asked her what she thought her purpose in life was and she replied, “I want to help people.” May May’s desire to help people has manifested itself in a myriad of ways throughout her life. She has 15 years’ experience in delinquency prevention and family development and has worked in a number of capacities in this field; from having direct practice experience with over 300 families, to working as a Regional Manager for the City of Los Angeles Mayor’s Office of Gang Reduction & Youth Development. She graduated Magna Cum Laude with a B.A. Degree in Social Work from the University of Nevada, Las Vegas. “We are delighted to have Maryum Ali as a keynote,” said Aliah Henry, Dallas Furniture Bank chief executive officer. “She has a wealth of experience with people in crisis who struggle to provide a home for their families. JUDGE KEMP GOES ON THE RECORD My name is Judge Tammy Kemp and I am the presiding Judge of the 204th Judicial District Court. I am running for re-election and asking for your support at the polls in the upcoming 2018 Democratic Primary. I would like to take this opportunity before early voting begins on February 20th to ensure you are well-informed about the transformation and successes of the 204th since I took the bench and to set the record straight with the facts on a key issue that has been raised during this campaign.

EFFICIENCY TRANSFORMATION When I began my first term on the bench four years ago, one of the first things I did was hire and recruit some of the best and brightest court personnel at the Frank Crowley Courts Building to ensure we had a strong team to serve you — the citizens of Dallas County. Putting a talented, experienced and knowledgeable team in place was and continues to be key to the court’s day-to-day operations and overall efficiency. Once our staff was in place, we did an assessment of the pending cases in the 204th as well as the manner in which the court operated under my predecessor and identified multiple deficiencies and opportunities for improvement. One of the primary ways that a criminal court’s success is measured, is based on the rate in which pending cases on the court’s docket are disposed. This rate of efficiency has a direct correlation between a particular court and the number of men and women who are sitting in the county jail at the Lew Sterrett Justice Center, awaiting court action (bond reduction

hearings, pre-trial hearings, trials, sentencing, etc.). We successfully streamlined the court’s docket process, and thereby reduced the number of individuals in jail pending court action in the 204th from an average of 300 defendants per month down to approximately 100 defendants per month. At a daily cost of $70 per day to house an individual in the county jail, this translates into cost savings to taxpayers. As a result of the enhancements we made under my administration, in my first year on the bench, we moved the 204th Judicial District Court from the worst ranked felony court (#17 out of 17 courts) to the number one felony court in Dallas County — a distinction that we proudly maintain today.

PROJECT PHOENIX: A CAMPAIGN PROMISE KEPT

When I ran for judge in 2014, one of the things I campaigned on was my vision to create a specialized program to impact low-level offenders by providing them with an opportunity to turn their lives around and be successful. After I won, I moved forward with turning that dream into a reality by partnering with the Dallas AFL-CIO to create a second chance initiative known as Project Phoenix. Designed to assist first-time offenders become productive citizens, Project Phoenix targets adults, ages 17 to 30, and partners with the various trades of the AFL-CIO to teach eligible participants a marketable skill while earning a living wage through an apprenticeship. To date, we have had 20 individuals successfully complete the program since its inception in 2016.

“Judge Kemp approached us about collaborating on an innovative program to mutually benefit both first-time, non-violent offenders and the trade industry prior to winning her elected position four years ago,” said Mark York, Dallas AFL-CIO. “She is genuinely passionate about rehabilitating those individuals who end up in the criminal justice system because of life circumstances, lack of guidance or poor choices. It was a campaign promise that Judge Kemp kept; and we are grateful for the opportunity to serve as the nucleus of Project Phoenix as we strive to restore dignity and equip people with the necessary job skills to help take care of their families.” Project Phoenix is available to all Dallas County courts. BAIL REFORM Another issue impacting the criminal justice system that I am passionate about is the continual need to overhaul the county’s bail policies and procedures. Historically, the bond payment system has been vulnerable to socio-economic bias towards indigent defendants, emphasizing the divide between the have and have nots. In other words, as it pertains to non-violent, low-level offenders, we are working to ensure individuals are not held in jail simply due to the financial inability to post bond. As an active member of the Bail Reform Committee, we have implemented all of the bail reforms that the law currently allows, and are constantly exploring new and innovative strategies to streamline the identification process in an ef-

fort to uniformly determine who is actually indigent. Once these individuals are identified, they can be enrolled in pre-trial release programs in lieu of making a bond payment. Bail reform is a work in progress, but I would be remiss if I did not recognize Dallas County for stepping up to the plate and providing the resources that have allowed the committee to make the changes we have made to date. We look forward to a continued collaboration with the county to mode r n ize the b o n d p a y m e n t system and make it fair for everyone.

LEGAL DISPUTE

While I am proud of the reputation of fairness and efficiency the 204th court has earned since 2015, there will always be detractors and individuals who have political agendas to undermine your team’s success. One such situation that you may have read about is a legal dispute between me and the Dallas County Public Defender’s Office. If you are not familiar with the subject, allow me to educate you on the background and arm you with the facts, the law and the legal outcome on the issue. In 2017, I initially appointed an attorney to represent an indi-


I Messenger gent defendant who had been indicted on three counts of capital murder. However, when I learned the attorney was only qualified to sit as second chair or co-counsel in death penalty cases in Dallas County, I then appointed a second attorney to represent the defendant and sit first chair as lead counsel in his trial. Prior to my appointment of lead counsel on the case, the Dallas County Public Defender’s Office filed a motion to be appointed counsel to represent this defendant and alternatively moved for a hearing for me to demonstrate good cause for denying the appointment of a public defender. I denied the motion for appointment by written order without stating a reason and denied their request for a hearing to demonstrate good cause. The public defender’s office contended that article 26.04(f) of the Code of Criminal Procedure required the 204th to give their office priority in appointments and to appoint a member of the office to represent the defendant unless the trial court had good cause to appoint other counsel. The public defender’s office filed a writ of mandamus (an order to perform a statutory duty) against the 204th Judicial District Court with Dallas’ Fifth Court of Appeals specifically asking the Appeals Court to vacate the trial court’s order denying their appointment, mandate that the public defender’s office be appointed to the defendant’s case,

and issue a writ of prohibition that would prohibit the 204th from denying future appointments sought by the public defender’s office. The Dallas Fifth Court of Appeals initially denied the public defender’s office’s writ of mandamus, but requested that I provide a reason for denying appointment of a public defender to represent the defendant in a written order. I then filed a motion for a rehearing asking the Court of Appeals to reconsider their opinion requiring me to provide a reason as to why I denied the appointment of a public defender in this case. “Forcing courts to enter these written orders in each criminal case where the public defender is not appointed would tax judicial resources at the trial level, cause potential backlogs in the appellate courts, potentially subject judges to recusal, raise concerns related to judicial ethics, could result in public defender’s offices attempting to manage overwhelming caseloads, and may result in more ineffective assistance findings in criminal cases,” I stated in my motion. It is important to note that in most capital murder cases, defendants are either facing life without the possibility of parole or the death penalty. In this defendant’s case, he initially was only charged with one count of capital murder. It was not until months later when he was indicted on two additional counts of capital murder and drew publicity by local media, that the public defender’s office showed interest in the case and asked to be appointed to represent him. The office had not requested to represent him in his original single capital murder case.

FAVORABLE FINDING

Upon review of the legal arguments presented in my motion for a rehearing to reconsider their initial opinion, the Fifth Court of Appeals agreed that the 204th did not have to provide an explanation of its reason for denying appointment of a public defender; reversed their original decision; denied the public defender’s office’s writ of mandamus and dismissed their writ of prohibition where the office was attempting to prohibit the 204th from ever denying the public defender’s office future appointments. My opponent, Stephen Duplantis, a private attorney, previously worked for the Dallas County Public Defender’s Office until shortly before he filed to run for office in 2017.

I am a native of Wewoka, Oklahoma, and I earned a Bachelor of Business Administration in Finance and a Juris Doctorate degree from the University of Oklahoma. After graduating law school, I worked as an Assistant Attorney General and an Assistant Secretary of State for the State of Oklahoma, before relocating to the Dallas area. I have been practicing law since 1988 and my areas of expertise include criminal, corporate and retirement law. In my previous role of Administrative Chief of the Family Violence and Child Abuse Divisions at the Dallas County District Attorney’s (DA) Office, I supervised 28 attorneys, 21 investigators, and 18 support staff. My duties included the investigation and prosecution of criminal offenses, including death penalty capital murders. I am a member of the State Bar of Texas and the State Bar of Oklahoma. Justice for Dorie Miller

Fittingly, the theme of Black History month this year acknowledges the potent historic contributions made by African-Americans in our nation’s military. They have been heroic, and legendary. Yet, if our nation is serious about honoring role of blacks that have risked their lives to defend liberty, free speech and our way of life, its leaders should begin by finally awarding the Medal of Honor to Seaman Doris Miller, a Texan who, with no thought for his own safety, saved the lives of others during the Japanese attack on Pearl Harbor. Robbed of his life at the age of twenty-four while serving on an aircraft carrier, it is unconscionable that Seaman Miller has been denied the medal that his actions demand. Those that witnessed his actions aboard the USS West Virginia on December 7th,

1941 believed that Miller was deserving of the military’s highest honor. Yet, it was the secretary of the Navy, a civilian appointee during the Roosevelt administration, whose explicit racial biases resulted in Miller being denied the Medal of Honor. Earlier in his term, the naval Secretary fervently argued that all Japanese Americans in the western part of the country be placed in internment camps. In fact, the naval Secretary did not want Miller to receive the Navy Cross. Even after reading the battle report written by those who witnessed Miller’s heroics, he only thought that Miller should receive a Letter of Commendation, the lowest of three awards given by the Navy, with no medal included. When fair-minded officials in the Navy heard of the naval Secretary’s position they protested directly to President Roosevelt, demanding that Miller receive fair and adequate treatment. Their case was so compelling that Miller was awarded the Navy Cross, essentially a compromise that did not subject the naval Secretary to scrutiny from the press, demanding to know why he had recommended a letter. Miller, himself, knew that

he should have received the nation’s highest military award, but was precluded from speaking publically about his actions aboard his ship because the battle report was classified, and any mention of it would have resulted in a military hearing and dismissal from the service. Miller was effectively silenced. A number of naval historians that have studied the awarding of the Medal of Honor to members of the Navy have concluded that Dorie Miller’s name should be among those who have re-

ceived the honor. They point out that one of the factors that the Navy, itself, gives as a reason for a medal upgrade is racial bias. They have concluded that the actions of the naval Secretary amounted to racial biases, and are ready to testify before

any panel that calls them to appear. Medal upgrades are not uncommon in our nation. In 2014, More than twenty veterans of the Army were awarded the Medal of Honor because they had been denied the award due to ethnic reasons. Most of the honorees were Jewish and Hispanics-Americans. Like Miller, most of them were deceased at the time of the upgrade. The decisions brought great joy to their family members, and to prudent members of the Congress and military. Since I made my first appearance in Congress, I have advocated for a medal upgrade for Dorie Miller. I shall not stop now. HALL: The Law of Rules? QUIT PLAYIN’ By Vincent L. Hall

A trusted co-worker and White Brother who grew up in this community gave me an anecdote and answer for the true meaning of the “Rule of Law” in America. RM (his initials) summed up a definition of “justice” from his close proximity to the local courts over several decades. “The law is whatever a welldressed, well-financed man interprets it to be.” That reality/revelation or both, was bequeathed to him by a seasoned barrister at the Dallas County Courthouse. The “Breaking News” chyron rolled the message; “Trump releases GOP memo”, so I had to admit that RM and the government lawyer, who gave him insightful counsel, were right. America in 2018 is not a nation governed by the “Rule of Law”; we have become a flawed democracy by our political acquiescence to the “Law of Rules.” Laws require judicial concurrence; rules can be established by the majority at various and sundry times. Or, to channel Barack Obama, “elections have consequences.” This warning ain’t “Truthful hyperbole;” this is a pending crisis. Just imagine if the same preponderance of evidence for possible collusion, obstruction of justice and money-laundering were hanging over

the heads of Leroy, Juan and Osama rather than the current names; Manafort, Flynn and Papadopolous. The former group sounds

Conversely, Trump remains adamant that America’s public safety requires the targeting of certain suspects. So Trump believes in profiling potential criminals in Manhattan but

that no case can be settled solely on the strength of the prosecutor’s argument. The accused must be given ample opportunity to refute the charges brought against it. The Law of Rules deems it appropriate to release a one-sided detail of events. Trump and the GOP violated the most sacrosanct rule of civil and criminal law. The real danger is that as partisanship increases, so does the propensity for weaponized government against political foes or a particular people. Black activists had a motto back in the day; “Every time we learn how to play

the game, they change all the rules.” The game has been changed; again!! Donald Trump and his limited morality were burdensome enough for this nation. It’s obviously not a crime to be a government-sponsored billionaire, with five children, three babies’ mamas and a penchant for porn stars. However, the least Trump could do is comport himself to the appearance what America purports as “Presidential.” We knew Trump was suspect when he wouldn’t release his tax returns, reintroduced the lost locker-room legacies of “pussy grabbing” and used the hubris of hate and racial division as a means of electoral engagement. Trump has transliterated the ideals of “American Exceptionalism” by his promotion of “Exceptional Americanism.” The Law of Rules is great for Nationalism, patriarchy and political gamesmanship. But the rule of law is the only means by which Americans can achieve the equitable pursuit of liberty and justice for all! RM was right…mostly. In this case Trump is interpreting the law to his advantage. Here’s to Johnnie Lindsey and the lessons we learned from the Dallas County Exonerees. Dallas County leads the nation in exonerations. Over 30 innocent men were tried, convicted and sentenced to long terms in prison. One man in particular, Johnnie Lindsey, served over 26 years for a rape DNA evidence later proved he did not commit. I got to meet him a few times and was always struck by his humility and grace. But the fates have conspired against him again. Although he beat cancer once before, it came back with a vengeance, as cancer tends to. He passed away yesterday. I’m going to pray for him and his family, and I hope you will, too. We all strive to leave a legacy, an imprint on the world. Some imprints are bigger than ever, and Mr. Lindsey’s is bigger than most. He is part of a unique group of men, bound together by the criminal justice system’s most heinous crime - an innocent man going to prison. These men, their stories, their courage, their cases have taught us so many valuable lessons. How? Before I became a Judge, I was the Chief of the

Cold Case Division at the Dallas County District Attorney’s Office. I worked with seasoned detectives, investigators and prosecutors on cases like Mr. Lindsey’s. DNA lead to most of these exonerations, providing undeniable scientific proof that a person like Mr. Lindsey did not commit the rape he was accused of. Police, prosecutors, criminal defense attorneys, advocacy groups, and law professors among others reviewed the processes and evidence in these cases that lead to false convictions, and made significant changes. Systemic changes. Legislative changes. Police protocol changes. Prosecutorial policy changes. Police don’t do lineups the same way the police did in 1981 in Mr. Lindsey’s case, nor do they place the same weight in a positive eyewitness identification they once did. Laws were passed recently requiring biologi-

cal testing before trial. Pre-trial discovery laws have dramatically changed, requiring complete transparency well before the trial. More money is being used for investigators and expert witnesses for the defense. The list goes on. Things are different today. Dramatically different. Not perfect, but markedly improved, and we are working on it. These exonerations shook the Criminal Justice System to it’s very core, and the sys-

HOW YOU CAN CELEBRATE BLACK HISTORY

Every year, the Association for the Study of African American Life and History selects a theme for Black History Month. This year, the theme, African Americans in Times of War, is meant to commemorate the end of World War I, the war that supposedly made the world “safe for democracy”. It is a war that African Americans fought for the right to fight in, a war that saw African Americans go abroad to fight for democracy, only to come home and be oppressed by segregation. Undoubtedly, there will be many programs designed to lift up this theme, which ASALH sees as an opportunity to reflect on the African American role in all wars, including the contemporary “war on terrorism”. What will you do to celebrate Black History Month? Many will participate in programs at their schools or churches. Some will gather for lunches and dinners and reflect on African American history. However, I wonder how many will simply let the month of February slide without doing anything to commemorate this month. Carter G. Woodson, the founder of ASALH and Black History Month (originally Negro History Week), would be spinning in his grave, if he knew how few of us celebrate this month. (Of course, Black history is also American history, and we ought to celebrate Black history every month of the year!) Dr. Eugene Williams, Sr. (a retired educator in the DC area) reached out to professional basketball teams to ask them to feature Lift Every Voice and Sing, the Negro National Anthem that was penned

by James Weldon Johnson sung at games in the month of February. He has commitments from the Washington Wizards, the Cleveland Cavaliers, the Golden State Warriors and George Washington University. Other teams, including the LA Lakers and the Atlanta Hawks, are considering the effort as well. Dr. Williams isn’t representing an organization – he just had a great idea, and started calling NBA team offices with his request. What will you do to celebrate Black History Month? Will you mount an effort

like Dr. Williams? His independent effort will have an impact and ensure that NBA games commemorate Black history. What can you do? Here are a few ideas: JOIN ASALH (www.asalh.org). Memberships range from $45 for students to $100 (or more for life memberships). What better way to celebrate Black History Month than by supporting the organization founded by the man who made our celebration possible? REGISTER TO VOTE! The struggle for the right to vote is an integral part of our Black history. Rev. Jesse Jackson once said, “The hands that picked peaches can now pick Presidents”. There are lots of important races in 2018, and you honor Fannie Lou Hamer, Medgar Evers, Dr. Martin Luther King, Rosa Parks, and so many others with your vote.

HELP SOMEONE MAKE BLACK HISTORY. In Georgia, state legislator Stacey Abrams, is running for Governor. She can win, too, if she can get the voter turnout and financial support that she needs. If you live in Georgia, you can help this woman become the first African American to be Governor of a southern state. An organization called Urban Intellectuals has developed two volumes of flashcards that explore aspects of Black History. You can check them out on Facebook, www.facebook. com/urban intellectuals, order their cards, and learn more of our history. GIVE A CHILD A GIFT OF A BLACK HISTORY BOOK. One of my favorites, Preaching to the Chickens: The Story of Young John Lewis, by Jabari Asim, celebrates a contemporary hero, Congressman John Lewis. Another, Minty: The Story of a Young Harriet Tubman by Alan Schroeder, tells the story of the Maryland icon who helped dozens of enslaved people escape through the Underground Railroad (legend says it is hundreds, but at Harriet Tubman Museum (operated by the National Park Service in Church Creek, Maryland) researchers say some of the estimates are too high. The Youngest Marcher: The Story of Audrey Faye Hendricks, a Young Civil Rights Activist by Cynthia Levinson will motivate young people to activism. Sit In: How Four Friends Stood Up By Sitting Down by Andrea Davis Pinkney and Brian Pinkney will also motivate young people to take on activist roles. I love my wife, but... Ask ALMA Dear Alma, Before I begin, let me say upfront that I love my wife. That said, in the years since we wed, she has gained considerable weight. When we eat out, she stuffs herself like a pig and never misses a chance to order desert. When I hint that she might forgo the sweets, she calls me a killjoy. On top of all of this, she refuses to do any exercise that requires her to break a sweat. Sure, I’ve gained weight, too, but no one would ever accuse me of being fat. How do I talk with my wife about this without making her feel self-conscious or unattractive? Despite the extra pounds, she’s still the apple of my eye. Friends say I’m asking for trouble. E.P.; South Carolina Ahhh, yea E.P., And they’re right…almost. It all depends on your delivery. Confronting a woman about her weight can be as psychologically risky as a woman

talking to her man about…well, you know. Here’s my confession: I, too, gained weight over the years while my husband diligently maintained his well-groomed looks and muscular physique. What turned me around, you asked? Picture this: Dayton, Ohio 2008. We were at Aunt Prevella’s 70th birthday party and cousin Lelar was taking pictures. Long story short, she took a picture of me, a side view. While looking through the photos on her camera, like the Isley Brothers I asked, “Who’s that lady?” Her answer: “That’s you.” In the parking lot later on, she stepped to me lovingly, sister to sister, and said, “What’s going on with you, girl? You’ve got to do something; your health is at risk.” She was right and hooked me up with nutritionist Roxanne Koteles-Smith, founder of the Food Wisdom program located just outside of Asheville. The weight came off so fast my coworkers thought I had undergone gastric bypass surgery. Trust me when I say I know how your wife is feeling. She knows she’s overweight, and this just may be the motivation she needs to do some-

thing about it. Even if you decide to broach the topic, it has to be her decision to make a lifestyle change. So let’s come up with a plan, Stan. I suggest you follow the example of cousin Lelar. Approach this subject as a health issue and not a weightgain problem. When the moments right, let her know you’re concerned about her health and the few extra pounds she carrying. She knows what that means. Talk about planning fun activities for the two of you, like daily walks hand in hand after dinner, making more time for whoopee (which burns calories) and maybe joining a gym. Whatever she likes that gets her moving. I personally enjoy hand-dancing. Ask her about joining a bowling team or taking tennis lessons. Be creative. You hold the power to make this an encouraging conversation. Be kind with your words. Remember, it’s about reaching new goals set for living a healthier lifestyle and getting your “Boo” back in shape. Assist her on a successful journey. It’s all lies in your delivery…. Alma

First, it's based on a thousand year old true story. It's the story of Bilal Ibn Rabah, an African slave who became an early follower of Muhammad. Another unique twist on the movie is that it comes from a Middle Eastern film studio and animators from all over the world worked on the film. That gives it a very unique style on screen. Finally it's a pretty graphic animated film which earns it a PG-13 rating. But overall, it's one of the best animated films I've seen in recent memory. In the movie Bilal is a

Beauty in the Bricks a 1981 documentary about four teenage girls growing up in the West Dallas housing development, will be shown February 17, 2018, 10 am at the Lakewest Women's Health Center, 3737 Goldman St, Dallas, TX.

Beauty in the Bricks gives a vivid portrayal of the contrast between the difficult lives of four teenage girls in the West Dallas projects the dreams and aspirations they had for a better life. It is an important part of West Dallas history and Dallas history in general. The showing will be accompanied by short presentations by people involved in the making of the movie, including some of the girls -- now women -- who appeared in it.
