LANDLORDS – It's Here – New immigration checks for agents and landlords! ......

The Immigration Act 2014 places new restrictions on illegal immigrants accessing private rented accommodation. By law, landlords will be required to carry out document checks to identify if a potential tenant has the right to reside in the UK, before they grant a tenancy. Landlords will also be required to keep appropriate records during the tenancy and for at least twelve months after the tenancy has ended. Agents can carry out checks on behalf of a landlord, but are advised to confirm their responsibilities in writing. Where an agent has accepted responsibility for compliance with the new rules, the agent will be the liable party in place of the landlord. The new rules will initially be launched in the West Midlands from 1st December 2014, before being rolled out around the UK in 2015. What does this mean for landlords? The requirement to carry out document checks only applies to: * landlords letting property located in Birmingham, Walsall, Sandwell, Dudley and Wolverhampton * all adults aged 18 and over living at the property * new tenancy agreements starting on or after 1st December 2014 In most cases, landlords will simply need to check the tenant's passport or biometric residents permit prior to granting a tenancy. Landlords will need to check original documents and keep a copy and appropriate records during the tenancy and for up to twelve months after the tenancy has ended. In a limited number of cases, where tenants do not have their documents due to an ongoing Home Office application, landlords can request a check using an online form. The checking service will then provide a yes or no answer within 2 working days. The new law will mean private landlords letting property in these areas will have to check the right of prospective tenants to be in the country if they want to avoid potentially being fined up to £3,000. This includes landlords who take in lodgers or landlords and tenants who sub-let property. If a Landlord wishes to subrogate this responsibility to their Letting agent it must be done in writing and the Letting agents terms and conditions must show they are clearly taking on this legislative responsibility as the agent will be liable for a penalty if a breach of the rules is found. If an agent establishes that a person does not have the right to reside in the UK and reports the matter to the landlord in writing, the landlord will be liable to a penalty if they grant a residential tenancy agreement to that person. The Home Office has said it will evaluate the launch in the West Midlands, before rolling out the measures around the rest of the UK in 2015. As Christmas approaches, we look at some gift ideas to help you find the correct gift for the golfing family and friends on your Christmas list.  GOLF ACCESSORIES/ ATTIRE– The list can be endless here but good quality golf balls eg Srixon or Titleist are both popular brands and for the golfing attire a smart jumper is always a good idea, as well as a good quality waterproof top for those golfers who like to carry on playing through the winter.  GOLF CLUBS-When buying a golf club nowadays a lot of clubs are tailor made to suit the individual golfer (custom fitted). Whether its a driver, set of irons or a putter make sure relevant information about the individual you are buying for is given eg height, handicap and age of the golfer.  GOLF LESSONS – whether you’re a total beginner or an established golfer. A golf lesson can prove to be invaluable. A beginner learns the basic fundamentals of a correct golf swing which sets you on the right path to learning to play golf, or as an established player you can tweak your golf swing or work on other areas of your game that you wish to improve upon  GOLF RANGE FINDER-for the more serious golfer these always prove very popular as they give you the exact yardage from the tee or where your ball is lying on the fairway. This enables you to choose the correct club for the yardage given. I personally use the Bushnell range finder but the Garmin GPS wristwatch is also another suitable alternative. I hope the above gives you some help in choosing a gift suitable to your budget for the golfer in your family. A Word From Your MP......................... It’s that time of year again as we approach the winter festivities and it is a pleasure to wish all readers a very Happy Christmas. Harold Wilson said a week is a long time in politics, yet I have been your Member of Parliament for almost 4 years now and feel that the time has flown quickly. The Holidays always offer me an opportunity, like it will for many others, to look back and reflect on the year just gone and to look forward to the year ahead. Over the past year it is clear to see that Wolverhampton is still changing for the better; The Queen recently opened the i54 Jaguar Land Rover site, the new Sainsbury’s store on Raglan Street was finally completed and the Wolves got promoted back to the Championship with a record number of points. Next year there will be a general election and I know that I must keep working hard for all my constituents and the city of Wolverhampton if I am to deserve your vote. Before my office breaks up for Christmas I will be holding a few more surgeries. My last surgery of the year will be in Chapel Ash on Friday 12th December and can be booked by appointment through my constituency office. However, I will also be holding two surgeries without appointment on Friday 5 th and Friday 12th December from half past ten to midday in the café at the Sainsbury’s on Raglan Street. If you are one of my constituent’s and feel that I may be able to help you with your concerns, please feel free to pop by. My office will then be closed over the Christmas period from Friday 19 th December until Monday 5th January; surgeries by appointment will then start again where the year ended in Chapel Ash on Friday 9 th January. Once again, my family and I would like to wish you a Merry Christmas and a Happy New Year.
