Pattaya tourist court off to slow BEGINNING T

here has been a good deal of optimism in some sections of the media about the impact of the recently-established Pattaya tourist court. In fact, the term “court� is something of a misnomer. The new office, housing a foreigners’ legal advisory service, opened in the Jomtien courthouse premises on September 5. The general idea is to help scrutinize the role of tourism operators in providing fair service for tourists, especially those who will be returning soon to their home countries. The Pattaya structure is a pilot at this stage with plans to extend it to other tourist cities later, notably Bangkok,

Krabi, Koh Samui, Chiang Mai and Phuket. It was the brainchild of the sports and tourism ministry which was concerned about the rising number of scams and crimes committed against international visitors. Although there is a perception that the socalled tourist court is sitting nightly to sort out tourist complaints and hand down sentences to villains, that is simply untrue. What is available at the moment is a legal advisory service, for civil and criminal matters, on courthouse premises which is open during normal office hours, 8:30 am to 4:30 pm. Continued on page 6

News The very mysterious switched-off iPhone

A Chinese national reported to police that he had left his iPhone in a baht bus which had taken him to the Asia Hotel. However, when the tourist tried to ring the number from a house phone nobody answered, and the phone was later switched off. Police located the baht bus in South Pattaya and the driver handed over the missing phone to tourist Li Yonggui. The driver, Sontaya Buajoob, said he had accidentally turned off the phone because he did not know how to use it. Li said he was satisfied to retrieve his phone and would not be pressing charges.

Drunken American assault woman Several women sought refuge in a convenience store opposite the VC Hotel in South Pattaya after an ex-US serviceman who was the worse for seemingly being drunk grabbed a Thai woman by the neck. Siriluck Hongrujiko, 38, said she was walking home when the farang pounced on her, bruising her face and breaking a tooth. She fled into an adjacent 7-Eleven store along with two other frightened ladies. The 41-year old man refused to discuss his behavior with police; he identified himself as Sherman Ware. Investigators said they needed the results of a medical examination on the assaulted woman before deciding on further action.

Delayed warrant issued for suspects Two European tourists reported a theft from their hotel rooms but claimed there was no police follow-up until one of the victims identified himself as a journalist. Brit Mancuso Salvatore, 46, and Italian Dolce Gesvaldo, 63, were shopping on Beach Road when two young Thai women offered play for pay. The four consenting adults returned to a hotel in Soi Bukao and enjoyed some food and drink bought in a nearby store. However, the men began to feel drowsy and fell asleep before sex. They awoke to find they had been robbed of nearly 400,000 baht, including cameras and jewelry. The men suggested the police check the CCTV video in the hotel, but said no further action was taken–until one of them showed his press card. That spurred police to issue an arrest warrant for the suspects.

Brit guy caught stealing clothes British tourist Michael John, 50, was arrested after security personnel at Big C Extra noticed he had walked past the checkout counters with a pile of clothing--including pants, shoes, shirt and socks—stuffed under his shirt along with some grocery items. The man appeared dazed when questioned by police and said nothing except, “Hello”. John was sent to Pattaya police station for further questioning; officers suspected that he had a medical problem.

Thai woman escapes from the police station

A Thai woman arrested for stealing gold from shops in Sri Racha and Bangkok managed to squeeze through a window and escape from the Pattaya police station. Malisa Rodeim, 34, was apprehended near the Chaimongkol temple market on South Pattaya Road. Following her interrogation, she complained of a stomachache and was allowed to use the ladies room at police headquarters, from which she made her daring getaway.

Thai drunk hooligan wounds Brit in city

British tourist Mark Anthony Strickleton, 53, was attacked by a drunk on Walking Street when the two men accidently bumped into one another. The Brit suffered a serious neck wound. Police later arrested 27-year-old Montri Kanghan, who admitted that in his drunken state he overreacted to the bumping incident. He also splashed the remains of a drink in Strickleton’s face. Police said that the assailant had previously been arrested for public violence, calling him a hooligan when under the influence of alcohol.

Immigration police host seminar

Tattooing quandary The latest in the foreign gangs syndrome is that groups of Malaysians have apparently been secretly coming into Thailand to have their tattoos removed. They hope that by eradicating these tell-tale pictures and symbols that they will be harder to spot as mafiosi. However, police say that the removal will actually make it easier to identify them as the smudges and marks left by the de-tattooing process makes it easier for them to be picked out in a crowd. All passes cancelled The head of police in Thailand, General Adul, ordered all journalists’ cards which permit them to attend national police press conferences called in and replaced only after vetting by a committee. Apparently, criminals posing as journalists have been using the passes to create confusion and even commit crimes. Altogether almost 1,000 press cards have been cancelled. The renewals, when they are ready, will need the personal signature of the boss. No-car day coming up In an attempt to encourage use of public transport, Bangkok will initiate a “no car” day on Sept. 22. It’s not compulsory, but the move is a nod in favour of environmentalism in one of the world’s most polluted cities. Police say that more than a million new vehicles are registered in the metropolis every year and that the average speed for travelling on the congested roads is still dropping annually. Pattaya may hold a similar day later, but will urge the use of pedal bikes. Maybe Pattaya’s public transport couldn’t stand the strain. The naked Russian It’s not been a good week for 7-Eleven staff. A Russian dressed only in shorts entered a branch in South Pattaya and showed his penis to the alarmed workers. He then calmly walked out of the store without having bought anything. The CCTV footage suggests he was confused, or worse, at the time or may even have had mental problems. Nonetheless, he has been charged with sexual harassment. Good job he did not display himself in a club or he might have been accused of working without a permit.

Chonburi Immigration organized a conference at the Tropicana Hotel to publicize the negative effects of human trafficking and gang-organized crimes which reflect on the image of Pattaya. Motorbike taxi drivers, bus operators and restaurant owners at the meeting were urged to cooperate with police to help reduce tourist-related crimes.

Na Jomtien has smelly problem The National Environmental Board has been collecting specimens from the sea in the Na Jomtien area after the sea turned black and green in a few areas, accompanied by the stench of rotting animal flesh. One suggestion was that the cause was plankton boom phenomenon; samples have been sent to Burapha University for analysis.

Ladyboy sets the tone

A woman sleeping alone in her room in a laundry was awakened by the sound of someone stealing her two Nokia phones. She followed the thief to Soi 12, Pattaya, where her shouts for help attracted the police. Twenty-nine-year-old Pradit Prasomsit, dressed in women’s clothing, admitted to the robbery, claiming he was unable to pay his rent.

A Thai man screamed for assistance after he was handcuffed and muffled with a t-shirt over his head before being bundled into a car where he was robbed of jewelry worth 5,000 baht. Worapol Mayer, 32, said he was drinking with friends when several strangers approached and kidnapped him; his drinking companions had not lifted a finger to help him. The victim had to make his own way home after being dumped on Sukhumvit Road. He added that he had worked as a photographer for many years and had no enemies.

Motorbike taxi driver killed

Sawangboriboon volunteers were called to a vacant building in Banglamung when a decorator was accidentally electrocuted. Pairat Suwankod, 32, was said to be in serious condition at Banglamung Hospital after his paintbrush accidentally touched a live wire.

In another accident on Sukhumvit Road near South Pattaya Road, 37-year-old Manut Chuermuangoan was killed when his motorbike taxi struck a car. Witnesses said that the victim was on the wrong side of the road when he made a turn at the intersection.

The naked American Police rushed to another Pattaya convenience store after reports that a naked American had taken a woman hostage and held her against her will for a short period. The abducted woman said she was on her way home and stopped to ask the guy if he needed assistance. Well now he needs legal and financial help as he has been charged with assault and attempted kidnapping. He is alleged to have told witnesses that he wasn’t feeling himself at the time. The naked Finn Police were called to the resort’s Beach Road area when a man from Finland was observed dashing around nude and annoying the general public. In the company of police later, the Finn then became calm and said he could now remember the name of his hotel. He was escorted there, but staff were advised to take note of how many layers of clothing he was wearing the next time he wanted to venture outside. English teacher scam Although Thailand faces a chronic lack of teachers of English in the run up to the ASEAN Economic Community at the end of 2015, there is little sign yet of a serious attempt to recruit the numbers required. One problem, say police, is that some foreign teacher applicants have fake documents and fraudulent degree certificates. But critics say they have had 20 years to sort out a problem which isn’t exactly unknown in other areas of Thai working life.

Victim handcuffed before nasty attack

Ladyboy crackdown It’s not a good time to be a transvestite in Pattaya. Up to 20 cross-dressers a night are being apprehended, mostly on Walking Street, and hauled off to the main police station to have their ID checked against the list of known criminals. They then walk back to Walking Street to resume...well... walking, one assumes. Other groups being targeted are homeless foreigners, street clowns, flower sellers and other such dangerous persons. Fake visa stickers Following thefts from Thai embassies abroad, a few fake visa stickers have been turning up in Pattaya. But police say that most of the fakes will probably remain unused after the substantial publicity given to the matter in recent days. The solution, of course, is to follow the example of India which insists that an embossed photo of the applicant is included on the visa sticker in your passport. But critics say that this would be using a hammer to crack a nut.

News World Health Conference endorses cigarette package warnings Meeting in Pattaya last week, more than 1,000 health officials from around the world endorsed Thailand’s stepped up efforts to discourage smoking—particularly among youth. At the 21st World Conference on Health Promotion, Dr. Michael Sparks, chairman, said, “Half a century of research has shown that tobacco is the single most lethal product available legally in the world. It kills six million each year. It is the responsibility of a nation’s government to regulate tobacco product and protect the health of its population.” Sparks, president of the

International Union of Health Promotion and Education (IUHPE), sponsoring the conference, reported that the conference committee and more than 1,000 delegates from 81 countries strongly support the Ministry of Public Health of Thailand to have strong measures to protect Thai children and youth from tobacco addiction. Increasing pictorial warnings from 55 to 85 percent is a fundamental measure to educate the public on the danger of tobacco use which multiplies the effectiveness of other tobacco control policies such as taxation and smoke-free environments.

“Strong tobacco control measures are very much in line with the conference theme, Best Investments for Health, which emphasizes the need to increase the economy, productivity, health and wellbeing of the people, said Sparks. As Thailand is a model country with strong tobacco control measures and is a party to WHO FCTC, I believe that the reason why tobacco industry threatens Thailand at the court is because they don’t want Thailand to lead the way in having 85 percent pictorial warnings. They are afraid that other countries will follow which will lead to the decline of their sale.”

Tourism needs clear direction from above The government’s plan to achieve 2.2 trillion baht in tourism revenue in 2015 depends on clear action and policies, according to tourism-related experts. Dr. Naligatibhak Sangsanit, head of DASTA (Designated Areas for Sustainable Tourism Administration), said that simply relying on bigger numbers doesn’t necessarily lead to bigger revenue on the scale anticipated. He explained that whilst tourist numbers had increased more than 123 percent in the period 2003-2012, tourist revenue had risen only by a much more modest 16.37 percent. Clearly, he added, tourism in Thailand is concentrated on 10 major destinations, including Pattaya, Phuket and Hua Hin. What is needed, he argued, is diversification to secondary provinces in order to drive spending. The prime minister had

recently suggested that some islands could be developed to specialize in high-spending eco-tourists. It’s also the case that Krabi and Chiang Rai earn high revenue because of the fewer but better quality visitors they attract. Thailand was urged to understand foreign markets. France was an example of a country which had integrated balanced tourist numbers and revenues. Paradej Payakwichien, former governor of the Tourism Authority of Thailand, said that the Kingdom needs to know how to attract rich tourists from India and China; that, in turn, means tackling problems such as street crime and infrastructure. He also said Thailand’s logistics were not good,

pointing to the out-of-date railway system as an example. One way forward for Thailand is to concentrate on high-spending niche markets such as golfers, medical tourists, weddings and honeymooners. Corporate conferences and exhibitions were another undeveloped area.

If foreigners wish to raise a concern officially, they still need first to obtain a report from a police station and also take to the Jomtien courthouse any other documentary evidence, relevant photographs or witnesses in support. The tourist court will then offer mediation, particularly in consumer affairs disputes, and the speed of any settlement depends on both parties cooperating. For example, in a Jet Ski civil dispute about the cost of repairs, the court would want to hear from both sides. Where the matter is not resolved by the time the foreigner leaves Thailand, the court will let them know the result later. If there is no agreement, the matter may be passed to the regular court for definitive judgment. The new court is not able to hear serious criminal cases, but will pass on any foreigners’ statements to the regular court.

Thus the recent case in which two Chinese citizens died after a speedboat accident, the driver in question will be tried in the regular court as before. Therefore, the new tourist court concept is not an overarching judicial body but will liaise on occasion with the traditional courts. Pattaya Today reporters, who have spoken at length to officials, agreed that the Pattaya tourist court structure is in its infancy. But at the moment it is essentially an advisory service which will attempt to mediate an agreement between the tourist complainant and the alleged perpetrator. However, it is untrue that a way of bypassing the traditional courts has been introduced. We are reprinting the full text of the official Tourist Protection Section regulations on page 7 of this issue of Pattaya Today.

TAT awards prizes for photo contests After viewing a thousand photos submitted to TAT Photo Contests, the Tourism Authority of Thailand selected winners, and Prakit Piriyakiet, TAT deputy governor for Marketing Communications, presented awards at a special ceremony at the TAT head office. Both contests generated interest from foreigners as well as Thais. The first contest, “Thailand Events and Festivals,” was won by Kosin Sukhum. His 30,000-baht cash prize was for the photo entitled “Good Fortune Flowing in.” Second place, 20,000 baht, went to Narin Soengpaisarn for “Tenderly Craved,” and third place, 10,000 baht, was awarded to Vejchayan Tharavisit for “Nearly Reached.” The second TAT Photo Contest, themed, “The Magic and Mystery of Amazing Thailand,” was won by Phumiphat Jiarajetchai, whose photo was entitled, “The Beauty of Culture.”

Official Translation of Pattaya Tourist Court Regulations Tourist Protection Section

The amount of Thai and foreign tourists traveling to different areas across the country has increased which results in the distribution of income in all economic sectors but causes more disputes. Such disputes has arisen in consumer protection cases due to the consumption of goods or services and criminal cases which the tourist might be an injured person or a defendant. These cases are unique as most tourists stay in each place, which can be a scene of action, in short period of time. Therefore it is necessary to provide a special section, the Tourist Protection Section, in each court of justice located in major tourist attraction areas to implement such cases quickly and fairly. This will create a good image for the country’s justice system and will benefit the economy and the society of Thailand as a whole. Responsibilities of the Tourist Protection Section The Office of the Judiciary has defined responsibilities for travel case sections/units to be consistent with the justice-implement mission for the tourists. 1. Provide assistance in preparing the plaint or charge. 2. Administer the appointment to bring the cases

into mediation system within the next working day or as soon as possible and unremittingly continue such cases until consideredcompleted, also arrange the appointment for taking the evidence before suing. 3. Coordinate with the Ministry of Tourism and Sports to inform the sued entrepreneurs to come to the court to negotiate and seek a solution to settle the dispute quickly. 4. Take responsibility for sending summons and copies of the plaints to the entrepreneurs including informing the appointed date or the court order by means of telephone, fax, email or other information technology. 5. Coordinate with translators or mediators who remain on duty overtime. 6. Provide tourists assistance in authorizing government officers to continue the trial in case of the necessity of returning to their home countries. 7. Report the case to the authorized government officers to inform the tourists including advising them when there is execution. 8. Coordinate an inquiry official or a public prosecutor to admit the tourists’ complaint and arrange taking the evidence before suing including

advising them to authorize government officers to follow and inform the case result. 9. Coordinate with the Ministry of Tourism and Sports when a tourist is accused in a criminal case to provide him/her information and inform the embassy of his/her home country when required. 10. Cooperate or support other concerned or assigned organizations.

Notification of Pattaya Provincial Court

Re: Rule of practice governing proceedings in relation to tourist Whereas the office of the Court of Justice issues notification establishing Tourist Protection Section in Pattaya Provincial Court in order to facilitate tourist, Pattaya Provincial Court adopt the Rule of Practice governing civil and criminal proceedings as follows: 1. Civil Proceedings 1.1 When the tourist intend to submit the plaint to the Court, an officer shall suggest and assist in drafting the plaint, including prepare relevant documents, and in the case that the tourist gives a power of attorney to a person to represent him in a case, an officer shall inquire contact address and contact method of his attorney and clearly write down in the powers of attorney. 1.2 Every case under 1.1 shall commence with mediation on the next working day or as soon as possible and the officer shall notify the appointed date and time to the tourist or his attorney (if any), including coordinate with a representative of Ministry of Tourism and Sports in order to notify the mediation schedule to the defendant. 1.3 An officer shall submit the plaint to the judge to consider instantly. In the case where the tourist submit the plaint at any time out of the usual hour of office and no judge exercise his function at such time or acceptation of the plaint for trial in lieu

of other court in the same province, an officer shall submit the plaint to the judge on the next working day or send the plaint to the Court of the territorial jurisdiction (as the case may be) as soon as possible. 1.4 An officer shall prepare mediation room and notify the appointed date and time to the mediator. If the parties have not appointed any person as mediator, an officer shall appoint the conciliator of the Court as mediator. In the case where the translator is needed in mediation process, an officer shall notify a representative of Ministry of Tourism and Sports to provide translator on the appointed date. 1.5 In the case where the defendant does not appear on the appointed mediation date, an officer shall serve the summons and plaint to the defendant and continue the proceedings. If the defendant appears on the appointed mediation date, the officer shall serve the summons and plaint to the defendant and mediate the parties. If the parties cannot bring about an agreement, an officer shall fix the date for a hearing or the date of settle the issues or the date of taking evidence, as the case may be, and notify the parties. In this case, the court may examine the witness who is a tourist in advance. 1.6 In the case where the tourist request for any other assistant, apart from proceedings, the officer shall notify representative of Ministry of Tourism and Sports in order to render assistance. 2. Criminal Proceedings 2.1 In the case where any action under 1.1 is connected to an offence and the tourist intend to lodge a complaint, an officer shall notify representative of Ministry of Tourism and Sports in order to assist lodging complaint with the inquiry official, including coordinate with The Public Prosecutor to file motion to the court for taking evidence of the tourist in advance in accordance with the Criminal Procedure Code. 2.2 In the case where the tourist become an accused, if he wish to notify his Embassy or Consulate, an officer shall notify representative of Ministry of Tourism and Sports to proceed further action.

Check your passport Thailand’s 200,000 or so retirement visa holders need to get a new passport if the expiry date is less than 18 months before the next one-year visa is requested. This is because, under new regulations, a visa extension can be granted only until the expiry date and is not transferable. Previously, you simply brought your new passport with the old one for updating to complete the full term. Now you would need to start afresh and provide new documentation and pay the fees on top. Judge bans media In an unusual move, a Phuket judge has ordered the media not to report an ongoing murder case until it has been completed. This is because at least one press report is believed to have influenced witnesses before they give evidence in court. Although the judge did not mention it, another cause for concern in many criminal cases (in Pattaya, too) is that the delays between hearings are often so long that witnesses are at risk of being tampered during the interval. Beach Road oddities Nobody seems to be sure why workmen are busy demolishing all the trees along the Jomtien sea front. What over-riding concern defeats the environmental considerations is something of a mystery. Also, along Pattaya beach front, the road widening has proceeded at a great pace and nears completion. Let’s hope the whole exercise wasn’t just an opportunity for two lanes of extra parked vehicles to block the flee-flow of traffic. Inevitable delay announced Following the news that a new tourist assistance centre is to be opened on Beach Road, together with a new multi-purpose police station staffed by the various sections, the inevitable anti-climax was quick to follow. It now appears that the 3.5 million baht project is on hold, maybe until the next fiscal year... or the one after. Amazing Thailand once again. Visa -free travel? Although Thailand has not yet decided on its policy as regards fellow ASEAN nationals, other members are forging ahead. Myanmar has announced that it has signed a 14-day reciprocal visa exemption for ordinary passport holders. The country has also signed an agreement with Cambodia, Indonesia and the Philippines to develop a single smartvisa system for tourism development in the area. Thailand needs to move soon. Hotel shortage in Yangon Given the chronic shortage of hotel rooms in Myanmar’s capital, Yangon, it’s good to hear that 1,000 rooms now under construction will increase capacity by 65 percent. As visitor numbers have dramatically risen – 560,000 visitors to Myanmar last year – hotel room rates have gone up from around US$50 a night to well over US$200 in some cases. Amongst the coming developments are the Novotel Yangon Max due to open next year with 366 rooms, and Hilton Yangon Hotel with around 300 rooms. Andrew Drummond moving According to his blogsite, Thailand’s best known investigative journalist, Andrew Drummond, will relocate to UK sometime next year. He says the main reason is to give his kids a decent education. Over the past two years the site has increased massively in popularity and now reaches in excess of 130,000 hits monthly, thanks largely to the controversies surrounding his claims and the resulting court cases. It is not yet clear whether the site will continue in some form or other. Phuket versus Pattaya Odd how the tourist scams are mostly being addressed in Phuket rather than in Pattaya. Down there they are said to have a new policy to prevent visitors being ripped off by taxi drivers (raising the basic fares) and a soundproof set of regulations to prevent Jet Ski nonsense (guarantees by the craft operators). But are they working? Well, no. Doubtless that’s the reason why we haven’t heard much about the improvements in the Pattaya situation. Counting and counting A reader with nothing better to do says he has counted no fewer than 563 24-hour convenience stores in the Pattaya and Jomtien area, not to mention 38 Indian restaurants and a slightly bigger number of dentists. He adds that in the same area there are 3,100 venues where you can get something to eat. That total includes all restaurants, cafes and street kitchens. Now you know it all. Perhaps his next task will be to count the number of uncollected bin bags lying by the roadside.

Gambling farang fined 500 baht Seventeen people, Australians and British, were arrested by Pattaya police and Department of Special Investigation officers in a new crackdown on illegal gambling in Pattaya. The farang, many in their 70s and based long term in

Thailand with their wives and families, were accused of betting on Australian horse racing events in a Pattaya bar which, when raided, was found to have betting slips and other paraphernalia. The judge in Pattaya court took a lenient view

and they were each fined 500 baht but not required to leave the country or to be formally deported. Two organizers of the alleged betting ring were given a term of imprisonment but remain on bail pending the appeal.

Southeast Asian governments pledge to end dog meat trade

Officials to work with animal welfare coalition Asia Canine Protection Alliance

Government officials from Thailand, Cambodia, Laos and Vietnam have pledged to end the inhumane, commercial trade in dogs for meat. The trade is responsible for slaughtering an estimated 5 million dogs for human consumption per year. Thailand, Cambodia and Laos supply dogs for the trade into Vietnam, where they are slaughtered and consumed. Dog meat production has evolved from small-scale household businesses to a multi-million dollar industry of illicit dog traders causing pain and suffering to the dogs involved and posing health risks to humans. The trade in dogs for meat involves movement of dogs of unknown disease and vaccination status, impeding rabies elimination efforts in the region. Countries are failing to comply with their own national animal disease prevention measures, and are not following recommendations for rabies control and elimination by organizations such as the World Health Organization and the World Organization for Animal Health and the trade has been linked to

outbreaks of trichinellosis, cholera and rabies. The World Health Organization recently cited the trade as a contributing factor in recent outbreaks of rabies in Indonesia and cholera in Vietnam. Government officials agreed to work to end the trade at a recent meeting in Hanoi with animal welfare coalition Asia Canine Protection Alliance. Concerned about the spread of rabies, officials said they would enact a moratorium on the commercial transport of dogs from one country to another for the next five years. In that time, authorities will measure the impact of a moratorium on rabies transmission in the region. (In Thailand, where the trade is illegal, authorities agreed to better enforcement of existing regulations.) Pornpitak Panlar, with the Department of Disease Control, Ministry of Public Health in Thailand said, “We cannot change culture or habit, but we should stop the smuggling of dogs. This meeting was important to urge government agencies to see the problems caused by the dog meat trade and discuss a platform to stop the spread of rabies.” Nguyen Thu Thuy, deputy director, Department of Animal Health in Vietnam added, “The rabies situation has become more severe – especially this year. One of the main reasons is the illegal crossborder trade of dogs.” Boonseub Chemchoig, chief

inspector general, Ministry of Interior, Thailand noted, “We never allow the transfer of dogs from Thailand to Vietnam for the purpose of consumption. We are still seeking solutions as the border between Thailand and other countries is long and difficult to manage considering the illegal trade. We are trying.” Animal protection organisations, under ACPA, will work with officials, helping to provide financial assistance, expertise and other resources as needed. ACPA is made up of Change for Animals Foundation, Humane Society International, Animals Asia and Soi Dog Foundation. “Canine rabies remains endemic in Vietnam, Thailand, Laos and Cambodia,” it was pointed out by Lola Webber, programmes leader, Change for Animals Foundation. “Ending the illegal trade in dogs destined for human consumption is a crucial component of national and regional rabies control elimination programmes.” Kelly O’Meara, director of companion animals and engagement, Humane Society International, said, “The trade is not about a desire to maintain culture or custom. The trade is profit-driven and poses a risk to human health. In addition, throughout Asia and globally, there is mounting concern for animal welfare and overwhelming evidence documenting the inherent cruelty in all stages of the trade---from sourcing, transport, sale to slaughter.”

Overland to Angkor Wat, Kingdom of Cambodia for the Hyundai Veloster World Wonders 2013 Historic & Unique Press Caravan to Angkor: Thailand – Cambodia. I AM LATE and it's chock-a-block, bumper-2-bumper Friday morning über heavy traffic. The 10-vehicle Hyundai Veloster caravan plus police escort is waiting for Khun John. In the nick of time my taxi pulls up at Hyundai's shining white, big, new HQ on Viphavadee Rangsit Road. I step out of the pink, beat-up Toyota metered taxi and headed straight into the driver’s seat of the redspanking new Hyundai Veloster, one of the five Hyundai Veloster media test-drive vehicles. The caravan is off with police escort headed by veteran caravan leader Somsak, sirens and flashing lights and walkie-talkies galore plus three Hyundai H1 MPV (multipurpose vehicles) for support and a Japanese Mazda pickup truck carrying iceboxes crammed with soft drinks, iced coffee, Red Bull energy drinks, cold towels and tons of snack. The caravan moves swiftly, changing lanes. Headlights on. Keeping it

We're moving, 380 kilometers to destination – Siem Reap, Kingdom Cambodia and the ruins of Angkor, the monumental 12th century Khmer Empire that can be seen from space. Just like the Great Wall of China. The first leg. Bangkok to Aranyaprathet, the bustling, frontier towns Aran and Poipet on the Cambodian border. Distance 230 kilometers from Bangkok. Cars, trucks everywhere. We are driving on a smooth six-lane motorway and Somsak, the caravan leader, steps on it. Follow the leader vehicle. Soon we are all cruising along in the center lane at 120-30 km/h. Before the Chonburi province PTT service station, the caravan exits; National road 304. Single carriageway. Handson driving. Now I can feel this new sporty Veloster hatchback fits me

like a glove. The more I drive it the more I like it. The weather changes from cloudy to light showers as our bright red, white, yellow and grey convoy of Velosters swish past Chachoengsao province. Overtaking all the time and keeping the distance nice and tight. A 15-minute pit stop at a large Kabin Buri PTT petrol station and 7-Eleven with clean restrooms. Change of drivers. Off we go! The Border: Aran - Thailand / Poipet - Cambodia The international border/ immigration point, the gateway to the Kingdom of Cambodia, is also known Rongklua Market, the Chatuchak of Aranya province. Nearby is the dusty, heavily plastic bag littered, hot border crossing. With a constant flow of the overloaded pushcarts and human beasts of burden, begging children and long lines of middle-class Thai daytrippers waiting in line at immigration. Here 99 percent of the Thais are gamblers on their way to the black jack tables and slot machines of Star Vegas, Holiday Palace and Crown Casino only a stone’s throw from the Cambodian immigration. After a hearty buffet lunch at Grand Diamond City we embark our vehicles again. Route Nationale 5 – National higway 5 We leave the dusty Poipet

en route for Siem Reap 150 km on the recently rebuilt and upgraded NH 5 direction Siem Reap. Right hand traffic (steering wheel on the left; opposite of Thailand). Onwards to Sisophon. Speed limit 80-90 km/h as the caravan drives through endless verdant green rice paddies, quiet sleepy Khmer villages, schools and temples. There was a railway station here before the Khmer Rouge destroyed the rail service, blew up the banks all in the new agrarian Khmer People’s Democratic Republic. Here we encounter the blue and white Thai bus transportation company coaches plying the new Bangkok-Phnom Penh route via Siem Reap. Siem Reap – Tonle Sap– The Gigantic Lake The road to Siem Reap cuts like an arrow thorough the fertile verdant rice fields. Traffic is sparse and the tarmac is smooth. Now the red and petrol grey turbocharged 186 horsepower Velosters are speeding along following the white highway Hyundai Elantra police cruiser. Our normally aspirated Hyundai is in hot pursuit. Tonlé Sap lake next. Before we reach Siem Reap a right turn. Late afternoon. The sun is still strong and bright as we hit a bumpy, dusty, potholed dirt road. Nok and Giant ask where we are? The road comes to an end. We have arrived at an estuary. Moored to the banks of the river is a fleet of riverboats that will take us to the mouth of the the lake. Blue skies with white fluffy cumulus clouds. Everything so clear, like a painting. Ten minutes downstream we hit small floating villages. Kids jumping and swimming in the clean water. I don't see any plastic bags. We arrive at a bunch of blue tall houseboats floating amidst islands of thick water hyacinths. One more starboard turn and I see an ocean! “Where is Tonlé Sap, Ou le Le Lac?” I ask our French-speaking guide Rakvit, whose parents were killed by the Red Khmers. “Regarde le horizon”, he says. That's Ton Le Tonlé Sap. It looks like an ocean. Where the sky and sea meet - that never ending line. The size. Tonlé Sap is the largest

freshwater lake in Southeast Asia and is an ecological hot spot that was designated as a UNESCO biosphere in 1997. Angkor Wat The Khmer Empire The caravan departs early for temple complex of Angkor Wat, 20 kilometers outside Siem Reap. Angkor Wat, in Thai, Nakorn Wat, world famous for its intricate lotusblossom towers, its enigmatic smiling Buddha images and lovely dancing girls (apsaras), and its geometrically perfect moats and huge fresh water reservoirs. An architectural jewel, Angkor Wat (in English, the Holy City) is the largest religious structure in the world. It is the crowning achievement of the classical Khmer Empire, which once ruled most of Southeast Asia. The Khmer culture and the empire alike were built around a single critical resource: water. The world's greatest single religious monument in the world. Our admiration and wonder go to the architects, mathematicians and astronomers, and 50,000 workers who toiled here 900 years ago to create this awesome edifice which, of course, has featured as a backdrop for Hollywood action films such as Indiana Jones and the Temple of Doom and Lara Croft: Tomb Raider. The star of Tomb Raider was Angelina Jolie and vehicle, the SUV--the Land Rover Defender 90 Tomb Raider edition. Our star is the new South Korean Hyundai Veloster hatch-back. The Veloster with its avant-garde design contrasting the millennium old ruins of the once powerful Khmer Empire built by King Suryavarman II. In the sunset our Hyundai caravan heads back across the causeway and thorough the sandstone gates of the Angkor Wat UNESCO World Heritage site onwards to our hotel in Siem Reap. Next day awaits with early departure to Poipet – Aranyaprathetand back to Bangkok. It's been a historical test-drive; Veloster, a cutting-edge South Korean, three-door hatchback, and an epic overland journey from the Thai capital to the awesome temples of Angkor Wat and Angkor Thom.

Koh Chang Chang means “elephant” in Thai, and Koh Chang refers to the size and shape of the island, which looks from above like a large elephant lazing in the sea. Koh Chang is a part of Trat province and is the second largest island in Thailand after Phuket, but in terms of five-star resorts, Koh Chang lags far behind Samui and Phuket. However, in terms of rich jungle and pristine greenery, it blows both of them out of the water. And now that Koh Chang has recently been awarded national park status, it seems little will change in this respect. Koh Chang is a haven of natural wonders, from the clear waters laced with corals, to the jungles with a large variety of flora and fauna, and spectacular waterfalls. Do Koh Chang’s beaches are unique, especially in terms of tranquility and serenity. The two-kilometer long White Sand Beach is the busiest beach in Koh Chang and is dotted with numerous shops, bars, convenience stores and restaurants. This white stretch of sand is perfect for tanning and swimming. A little further along is Klong Prao Beach. Though beautiful, much of the beach is dominated by luxury resorts, and so finding a private spot can be tricky. However, it has a great view overlooking several nearby small islands. The sunset at Laem Chaiyachet is truly spectacular. A 10-minute drive along the coast will bring you to Lonely Beach, which is ideal for those looking to escape the crowds. Bailan Beach is a great place to watch the sunset. Outside of the rainy season (June-October), Koh Chang and surrounding islands are also excellent places for snorkeling. The underwater life here includes stag’s horn coral, moray eels, triggerfish, groupers, stingrays, and, if you are really lucky, whale sharks. The best dive shots can be found in Man Nok and Him Sam Sao. Alternatively, Koh Rang is about 20 kilometers from Koh Chang. Fringed with coral reefs, this is also a well-known spot for snorkeling and diving. Moving inland, there are some impressive waterfalls on Koh Chang. Klong Phlu Waterfall is the biggest waterfall in Koh Chang, with three levels. The first level is only 500 meters away from the car park and is an especially spectacular and romantic setting. Than Mayom Waterfall is a slightly smaller

waterfall with four levels. Water here runs over black granite rock and helps to create a cool haven from the heat of the sun. Island hopping is a popular activity in Koh Chang. Visitors should take a trip to nearby Koh Mak, a low-lying island with coconut and rubber plantations. It’s a great place for scuba diving under the clear blue sky, with white sandy beaches in the northwestern and southwestern parts of the island. There are three smaller islands off Koh Mak: Koh Kham, Koh Rayang Nok and Koh Kradad. There is also a daily ferry service to Koh Mak and Koh Kham at Laem Ngop, but faster services can be arranged at Bang Bao as well. Eat Since Koh Chang has not yet been overrun by tourists and travel companies, there are still plenty of local seafood restaurants that serve reasonably-priced fare. It’s worth going to Bang Bao village either for lunch or dinner to try freshly caught seafood from the Gulf of Siam. There

is also a growing number of upmarket restaurants starting to make their presence felt on the island. Amari Emerald Cove Resort’s Just Thai Restaurant (+66 (0) 3955 2000) serves authentic Thai cuisine in a contemporary Thai atmosphere. Pad Thai with king prawns has never let anyone down and doesn’t here. For those interested in traditional Thai seafood dishes, look no further then Jae Eiw seafood restaurant (+66 (0) 1982 3954), which serves an eclectic variety of cuisine. The restaurant serves perhaps the best tom yam (spicy soup with shrimps and shellfish) on Koh Chang, as well as delicious river prawn and crab dishes. Play Though Koh Chang is better known for its tranquility than as a nightlife venue, some lively nightspots are nevertheless starting to emerge. Strewn on both sides of the main road and along the beach in the White Sand Beach area is a multitude of bustling night entertainment hangouts. From laid-back cafes serving drinks and light snacks, chilled-out pubs with live music and big screen TV, to fun beach bars or whatever else tickles your fancy and defines your idea of a great night out. Just take a walk along the beach and you’re bound to find it! Among the most popular venues are 15 Palms, where you can watch live fire shows, and the busy and lively Sabay Bar and Oodie’s Place, where French and Thai cuisine can be sampled with your drinks. Shop The shopping scene in Koh Chang is far quieter than in other parts of Thailand. A range of souvenir shops can be found at White Sand Beach.

Hosts Vina Maipo Wine Dinner Mantra Restaurant & Bar hosted an exclusive 5-course wine dinner showcasing the wines from Vina Maipo. This is a prestigious Chilean wine producer with a rich history and excellent growth performance since1948. Today the Maipo winery exports to more than 70 countries, and its efforts are focused on developing and strengthening its premium product portfolio. Representing the winery was Anais Marmonier, regional marketing assistant manager, VCT group of wineries. She was on hand throughout the evening to discuss and explain the characteristics of each variety. Chef Leonard Faust had crafted an innovative menu to complement the carefully-selected wines. So as we all gathered in the chicness of Mantra’s bar to enjoy a pre-dinner aperitif and canapés, we were in high expectation as to the

gourmet evening that lay ahead. The wine chosen to accompany the one-bite hors d’oeuvres was a Sauvignon Blanc Chardonnay which, with traits of fresh crispness, proved the ideal companion. It was then time to take our table in the main dining room. Chef Leonard had prepared a unique starter imaginatively fusing the flavours of a classic Italian dessert and the spices of the subcontinent. A curried panna cotta with roasted marinated medallion of lamb, seared king scallop with lobster-vodka sabayon and black and red caviar. What an opening number, the flavours soared complementing beautifully the second pouring of the evening, a Reserva Vitral Sauvignon Blanc. With its pale yellow colour and citric notes, the fresh balance was a juicy treat to accompany chef’s richly diverse first course.

Next up was, for Mick and me, the star act of the evening. Described as black chicken essence with Asian herbs and dry sherry, foie gras and a shrimp wonton, it was a memorable dish. The scrumptious chicken consommé laced with dry sherry bore two culinary treats, a big juicy shrimp packed dim sum and a piece of scrumptious foie gras. Accompanying this soup was a Syrah and Cabernet Sauvignon, full-bodied, round and tasty, it successfully managed to add yet another face to the ensemble. Snow fish saltimbocca was the main course. This most succulent of snowy white fish benefits from strong flavourings and chef had certainly implanted them into the generous fillet. Wrapped in Serrano ham with a ricotta cheese, pine nuts and spinach filling, it arrived on a bed of scrumptious squid ink risotto with steamed kale and soya sauce. Another star dish superbly cooked and tastefully presented. The cheese course provided a taste of three classic French cheeses: Roquefort, a soft goat’s cheese, and Pont-l'Évêque, delicious all and accompanied by Vina Mipo’s Reserve Vitral

Syrah, it became another pageant of delicious taste sensations. Sweet dessert came in the guise of a spicy chocolate brownie served in a coupe glass. Thick, rich and decadent and served with a pouring of Reserva Vitral Cabernet Sauvignon, it was truly heavenly. Chef Leonard and Anais’s expertise had produced a superb wining and dining experience. Saturday night is BBQ buffet night We recently visited Cape Dara Resort. “Dara” means star and this 5-star resort displays not just one but a galaxy of star-studded assets. Set on the most northerly promontory of the Naklua peninsula, the edifice rises 26 stories into the sky and offers incomparable vistas of Pattaya Bay. All 264 guest rooms, suites and villa compounds have open-sky views allowing spectacular glimpses in all directions. The resort boasts a coterie of bars, lounges and restaurants including the newly-opened Ming Xing Chinese Restaurant, the air-conditioned dining section called Raio connecting to Radius Restaurant which is their all-day open-air venue. It benefits from spectacular panoramic views out over the sea and at night the glittering lights of downtown Pattaya. It was here that Mick and I were invited to enjoy the restaurant’s Saturday night BBQ buffet priced at B.899 net. Incidentally, Cape Dara Resort’s pricing policy is totally “net”. The décor is chic and elegant, decorated in soothing muted tones using natural organic materials

to reflect the hotel’s belief in environmental conservation. The restaurant was buzzing with happy eaters when we arrived, and the talented Phee was entertaining diners with his tuneful renditions of songs from the 70s and 80s, making for a cheery party ambiance. Once settled at a terrace table we ordered a glass of house wine (Sauvignon Blanc Loncornella Maule Valley, Chile) at B.200 a glass or B.999 by the bottle. The sushi and sashimi table is always a popular starting spot at any buffet and this was where we headed to kick off the proceedings. Premium quality raw fish and seaweed-wrapped delicacies sat glistening on ice awaiting our selection. Salmon, snapper, and tuna immediately found their way to our plates accompanied by a mighty dollop of top-notch seaweed and fish roe salad, pickled ginger and of course that nose exploding wasabi. For a hot soup option spicy pumpkin was the special for that evening, the big steel cauldron sat next to a huge basket of freshly-baked breads.

Some of the many prepared salads would also make for tasty starters. Chilled poached prawns, crabs, giant mussels and rock lobsters are generously piled on their icy setting, and it was from here that Mick and I

launched into our shellfish fest. The shells on the giant prawns fell away easily under our fingers (always a good indication of freshness) and dipped into one of the myriad of dressings and sauces, we were happy eaters. The adjacent cold meats table offered mountains of sausages, squid, chicken breasts, beef and pork kebab, while the line of heated terrines was brimming with hot, cooked dishes. These included golden fish fillets with caper butter, pork cordon bleu, spaghetti carbonara, spinach gratinee, lyonnaise potatoes, rice, BBQ duck, grilled pork with garlic sauce, and stir-fried beef in oyster sauce. However, the aromas from the noodle station pulled us in that direction. Oodles of noodles were on offer; pick your favourite and then select your vegetables, fish, crab or prawns and chef will prepare your bespoke noodle dish to order. We chose our version of the muchliked glass noodle salad (yum woon sen). Packed with shellfish, crunchy veggies, peanuts, onions and chillis and tossed in a fresh lime/fish sauce dressing, it was spicy and vibrant.

This perennially popular salad is prepared to order--be sure to say how many hot chillis you want; it was sparkling with freshness and flavours and quite the best we’ve tasted for a while. The omelet chef was cooking up a storm and the most popular seemed to be the oyster and mussel variety, but also lots of other choices for egg lovers. Moving on to the dessert table, Cape Dara’s in-house pâtissières had produced the most beautiful pastries and desserts. They looked gorgeous and tasted wickedly wonderful. Hot, fresh waffles looked tempting, but we had to pass as our volume of gleeful eating had defeated us. The a la carte menu at Radius covers the gamut of all-day dining from Thai favourites to western snacks and main courses. Remove from the heat and leave to infuse for 20 minutes. Strain through a fine sieve and place back into a stainless pot and bring to a boil. Mix the corn starch with a little water and add it slowly to the sauce while whisking until thick and sticky.

Tuna Nameroo with watermelon

Japan is one of my favorite countries to visit, and as a foodie you can’t come to Japan and not stop by the Tsukiji Market, one of the world’s biggest seafood Mecca! I had the opportunity to witness the Tuna Auction on my last visit and I’m still in awe weeks after I’ve been home. Another stop you can’t miss is a sushi bar! We visited all kinds of sushi bars including a Kaiten sushi restaurant where the sushi are place in a conveyor belt around the sushi bar and you just pick up the ones you like. Surprisingly, at this particular Kaiten sushi, they also include some seasonal fresh fruits in the rotation and the watermelon was particularly mouthwatering that hot summer day! Voila, this week’s recipe!

1 cup fine diced tuna (high quality for raw consumption) 1 cup fine diced watermelon (make sure no seeds) 1 oz Osetra caviar 1 tablespoon karashi (Japanese mustard paste) A few young Thai basil leaves Salt and pepper to taste

1 ½ tablespoon calamansi or lime juice ½ cup Japanese soy sauce 1 tablespoon sweet soy 1 tablespoon extra virgin olive oil Salt and pepper to taste

For the sauce, mix all ingredients together in a mixing bowl, adjusting each amount until desired flavor is achieved. Finish seasoning with salt and pepper and set aside. For the nameroo, season the diced watermelon with salt and pepper. Do the same with the diced tuna. In a ring mold, place the watermelon evenly on the bottom, then place the tuna over it. Place a quenelle of the caviar and a dollop of the karashi garnished with Thai basil leaves. Spoon the sauce on the outer edge of the ring and then remove the ring mold. Make sure to keep all surface and utensils for this dish really clean and sanitary since we are dealing with raw, ready-to-eat ingredients. I like eating this dish with some chips, like fried vegetable roots or Papadam chips! Happy Eating!

When it is time to transition from day to evening makeup, you don’t need to strip right back and start again. All you really need to do is reapply eye color in stronger shades, and go for a stronger shade of lipstick. 6. Get the Lashes Right

Blusher should shape and highlight your cheekbones, not make you look like a painted doll with two round pink splotches. Instead, go for a foundation similar to your own tone, and apply sparingly to your cheeks and T-zone (forehead, nose and chin) blending outward toward your hairline and jaw. 4. Save the Smoldering Eyes for Evenings Out You don’t need heavy, smoky eyes all day every day. If you’re naturally pale or work in a well-lit office or outdoors, a natural look will work much better for everyday wear. Opt for natural browns and beiges with a little pink for brown eyes. Choose blue or green to match your eye color otherwise, and go for brown or grey eyeliner. That way, when you do go all out for a special occasion, it will be even more effective.

Nothing looks worse on your eyes than clumpy heavy mascara. You want lashes that look full and lush but still natural. To get the best effect, use lengthening mascara with a fine bristled comb to coat the lashes from root to tip. Once you’ve let this dry, add a thickening mascara to build volume towards the tips, focusing on the outer corner of the eye for that flicked out effect. The top tip, though, is to use a lash comb to separate the lashes, and remove those unsightly clumps. 7. Lip Service We all want full pouty lips, and slathering on a heavy, plumping gloss is tempting. If you really want to make your lips kissable, though, make sure you keep them in great condition. Use a wet toothbrush to slough off dead skin when you brush your teeth (gently, you don’t want to make them chapped and sore) and use a protective balm in cold weather. What is Due Diligence? Due diligence is the research and analysis of a company, organization, or individual which is done in preparation for a business transaction or investment. A reasonable person takes extra precaution before entering into an agreement or a transaction with another party to prevent unnecessary harm; the procedure helps identify potential risks and liabilities. Due diligence serves to confirm all material facts and legal parameters in regard to a sale or acquisition by investigation and evaluation of a potential investment. What is the importance of Due Diligence on Thai property purchase? Investing in real estate certainly involves a huge amount of money. We cannot deny the fact that there are some fraudulent dealers and developers taking advantage of naïve investors who can easily be victimized in unscrupulous deals. Therefore, investors are advised to take extra precaution before finalizing any transactions. Due diligence is a useful tool for estimating the status of a prospective project and the developer. The failure to conduct the necessary safeguard in ensuring that the potential property to be purchased is what the seller claims or promised it to be usually results in severe consequences such as serious financial and legal distress on the part of the buyer. It must be remembered that almost always after the transfer has been completed, the seller will not be held responsible for any problems not discovered by the buyer.

It is essential to know how long the developer has been developing properties in Thailand and the amount of their registered share capital. • You must have a clear understanding of the rights and obligations of each party. This includes who pays which taxes and fees, when the deposit and balances gets paid, how long the project will take to completion, and what remedies there will be if the project is not completed on time. • It is recommended that you have a lawyer in Thailand to review the contract drafted by the seller to ensure it is prepared with proper terms and conditions that meet the standard terms as required by relevant laws and confirm that the contract does not contain terms of any hidden cost or drawbacks. Your lawyer will also negotiate and discuss with the seller on your behalf any proposed changes until both parties mutually agree with the content of the final contract then set to meet for signing.

What are the important factors to consider in carrying out Due Diligence? • You need to be guaranteed that the seller is holding the said property under a true title of ownership. Land descriptions contained in any title deed must match the records on file with the Land Department. It is necessary to establish whether or not the chanote or title deed has been correctly and legally issued. • You need to be aware of the burdens existing on the property. It is necessary to review the Register of Records stated at the back of the title document, which contains all encumbrances and liens currently levied upon the property. • You need to determine whether the seller is the one who holds title to the property and, therefore, has full legal rights to sell the property. When is Due Diligence conducted? The need for thorough, detailed due diligence begins prior to the signing of a binding contract. The necessary title and background investigations provide the initial basis to confirm a safe purchase and ensure that both parties deal with each other fairly.

Due diligence is all about research; that is why a reasonable schedule should be allotted to ensure that all essential aspects are scrutinized. Thailand Property Awards 2013 Battle of the Boutiques!

The complete shortlist of winners for the Thailand Property Awards 2013 was reported recently at a press conference at the Centara Grand Convention Center at Bangkok’s Central World.

All shortlisted finalists are winners and will receive Highly Commended award status, with one winner in each category. Paul Ashburn, senior partner at BDO Advisory, which oversees the entry and judging process for the Property Awards, said in an interview, “As is the case every year, the judges’ decisions were based on strict and extensive criteria.” He added that for the development categories, “local teams visited shortlisted developments to undertake site inspections before the central judging panel submitted their final decisions.” Yes, the development categories always draw the highest interest, and the most exciting award each year is clearly the coveted Best Developer Award. This year we definitely saw four of the very finest development companies nominated and judged--each competing for the title Thailand’s Best Developer. was while surveying the finest and most impressive luxury condos seen to date. We all know Raimon Land as having constructed some of the top condominium designs in Thailand for a number of years now, and I must say the 185 Rajadamri Condominium and its views of the Lumpini lake and park from one direction and looking out over the racing tracks at the Royal Turf Club of Thailand are remarkable. I can only tell you it is a ‘six-star’ accommodation that would be a top runner in any city in the world, but the nominated Ritz-Carlton Residences is absolutely in a class of its own. It features 200 residences with the legendary service of The Ritz-Carlton in Bangkok’s most exclusive address. The Ritz-Carlton Residences will be Thailand’s tallest building and it offers a stunning building design and interiors of Calvin Klein design. I cannot tell you how astounding the entire package is; it is sure to be a world-class landmark in the heart of Bangkok. Bravo! A certain portion of our judges scoring is based upon the state and quality of construction and, of course, new developments just starting their construction like the Ritz-Carlton Residences will have better and better scoring as the their building goes up, much like was experienced by Raimon Land’s The River as it was nominated and scored three years in a row before it finally won Best Luxury Condo Development (Bangkok). With that in mind I must also mention two more luxury condos we judged this year that are also in the early stages of construction: the Menam Residences, with the developer having designed this serviced condominium to provide 5-star hotel-style services to residents and the interior and exterior building designs are astounding, and Sansiri Group’s new XXXIX, most timeless and elegant condominium ever located on popular Sukhumvit Soi 39. It’s a measure of the spreading fame of Atlantis Condo Resort in Pattaya that it’s much higher in the Google rankings than the famous lost continent. Project manager Pornthep Chawla, known as Dev and acting for Blue Sky Development Company, says that the location on Jomtien Second Road is in the area which is currently experiencing the most new starts. Kingdom Property’s chief executive officer, Nigel Cornick, has a self-assurance which follows from his 23 years in Thailand and his planning here of 5 million square feet in real estate. Ann Winfield is the notable exception that proves the rule. Most voluntary organizations in Pattaya are dominated by men and male chauvinism remains common in expat clubs, sports clubs, the voluntary police and so on. The Pattaya International Ladies Club (PILC) has been on the go since 1987 with a current membership of over 200. Newly elected president Ann says the main merit of PILC is that it offers a welcoming and homely atmosphere with its coffee mornings, lunches and diverse fund-raising and community action. Ann predicts that PILC will become ever more important in the future as Pattaya continues its expansion and a new generation of ladies, from ASEAN countries and from China, enters the scene.

He expects Centara to continue investing in Pattaya and believes that City Hall has done a great job in marketing the Eastern Seaboard resort to a wider international market. Chances for Political Reconciliation Most Pattaya Today readers have given the thumbsdown to the government’s attempt to forge harmony in the divided country. But a minority believes that the attempt is certainly worthwhile. Politics is a dirty business but the government is absolutely right to try and reach accommodation with its opponents. Hong Kong dilemma Q: I am very confused why I have to send my British passport application to Hong Kong whereas my friend recently obtained an emergency one in Bangkok. Why does the British government make it so difficult obtaining a simple service like renewing your passport or simply returning to your own country? A: The requirement to send the application to Hong Kong is a temporary measure pending the return of all passport services in the world to London next year. Your friend was not applying for a regular passport but had clearly lost or had stolen his passport. Under those circumstances, the embassy in Bangkok retains a role to issue short-term documentation in a real crisis situation. Presumably this facility will remain after the Hong Kong office (and all other passport offices worldwide) closes next year. Overstay issues Q: I have a two months’ overstay on my Dutch passport but my passport expires in about three weeks. My question is whether I can pay the overstay at the Cambodian border and then come back to Thailand with the normal two weeks on arrival. I am also unclear what the whole thing will cost. A: Normally one can indeed pay an overstay fine at the Cambodian border but not in your case. This is because you have less than six months availability left on your passport – and that minimum period is needed to get into Cambodia and other neighboring countries. The best advice I can give you is to obtain a new passport from the Dutch embassy in Bangkok and take both passports with you to the border. The alternative is to go to the airport with an international flight ticket. You could pay the overstay there and obtain a new passport in your new destination. Bail after overstay case Q: My friend has been charged with overstay and sent

all sides to compromise. The Democrat opposition could have made a major input into the process but have decided otherwise. (TB) What Thailand is facing is the establishment of an electoral dictatorship. Confident it will win the next election, the government is ramming through its policies to ensure that happens. Reconciliation is the furthest thing from their minds. (Wise Cracker) I think the government is beginning to unravel. According to a recent public opinion poll, the overwhelming majority of citizens believes that reconciliation is a smoke screen pure and simple. (Francis Wilson) If the government was sincere in the attempt to win over its opponents, it would have withdrawn the current bill in parliament to excuse criminals. You can’t have reconciliation whilst pushing the very matter which is at the heart of the problem. (Pattaya Pat) It would be no different if the opposition was in power. When they were (2006-2011) they sought to punish the opposition. So what has changed? (Harry Gregory) I just don’t understand Thai politics. The leader of the 2006 coup now sits in the Thai parliament and hobnobs with the very people he tried to replace just six years ago. (Able Mabel)

to prison for around two weeks. He did not have any money at the time but he now has enough to pay for bail, which I understand is 50,000 baht in these cases. Can you let me know how I go about helping him? A: Bail is not normally available after the sentence has been served, the only exceptions being people who are seriously ill. Your best course of action is to wait until his sentence has been served and then contact Immigration to explain that you have the funds to pay for the airfare back to his home country, which I know is Ireland. This may save some time because, ordinarily, prisoners under deportation are sent directly to the Immigration detention prison in Bangkok to await the air ticket. If you are unused to Thai procedures and expectations, you may want to use a Thai lawyer to make arrangements on your behalf. But nothing happens until the sentence in the local prison is served. Long overstay Q: I am curious: What happens if a foreigner has, say, a two-year overstay, which I hear happens from time to time. How long do they have to spend in prison in such circumstances? Are they banned from ever returning to Thailand? Does it matter why they have gone into a long overstay? They may have suffered a very serious stroke for example. A: The Thai Immigration rules are deliberately flexible. The fine for a shorter overstay is 500 baht a day up to a maximum of 20,000 baht. After that it’s discretionary. Your friend may be allowed to board his plane at the airport after paying the 20,000 baht, or he may be arrested and charged. Presumably there are reasons why he has such a long overstay, other than stupidity, and it may be a good idea to take relevant documentation with him, e.g. medical certificate, proof he has been forcibly detained in Thailand, or whatever. If the reason is he ran out of money and now has funds, perhaps a letter from the relative or friend who has sent him the cash. Police work permit? Q: I don’t understand why foreign police volunteers or assistants don’t seem to need a work permit. You have written before in this column that voluntary work is not exempt from the alien labour legislation. A: It’s a fair point. But where foreigners are helping the Thai state and have an ID to prove it – all foreign auxiliaries have such an ID signed by a police chief – this is deemed to be satisfactory. The same is true of foreign translators in the Thai courts or hospitals. As in much Thai legislation, the detail is not spelt out and there is a discretionary element.

Snap Judgment Changing Property Scene A recent property report on Pattaya and Hua Hin says they are both still expanding. However, the main condominium buyers at the moment are Thais seeking a holiday home or second residence by the sea and those who are working in these coastal regions. Colliers International Thailand’s report says that 800 condominium units were transacted in Pattaya during the first half of 2013, a higher figure than for the same period last year. The number of new-start projects, around 7,400 units, is similar to 2012, with the majority found in the Jomtien area, mostly along the new Second Road. Three listed developers – Sansiri, Supalai and SC Assets Corporation – launched their first projects in Pattaya in early 2013 and received positive feedback from buyers, especially domestic purchasers. The main problem has been shortage of labour in the construction industry, whilst the cost of building materials seems to have peaked for the time being. Owing to limited plots of available land in Pattaya itself, projects have been moving to Jomtien ever since Second Road formally opened in 2005. However, ongoing repairs and renovation on the highway continue, with traffic lights at busy intersections becoming operational only in 2013 for the first time. There is general agreement that growth on the Eastern Seaboard will be largely Jomtien orientated. Seaview condominiums located in the North Pattaya and Wong Amart areas still command optimum prices, averaging 135,240 baht per square metre. The next most expensive districts are Jomtien at 128,725 baht per sqm, and Pratumnak at 89,000 per sqm. Knight Frank’s Thailand research unit says that Jomtien has several advantages over neighboring Pattaya, namely less overcrowding, easier road connections and the advent of new attractions such as the biggest water park in Southeast Asia – Ramayana – and Cartoon Network Amazone, both of which are scheduled to open within a few months. There’s also the Grand Kingdom shopping mall and the Jomtien floating market, which are popular with Thai families and with Russian and Scandinavian buyers who are still active in the area. The new demand for Pattaya condominiums, especially in North Pattaya, will be driven by the many leisure facilities, shopping outlets and restaurants on offer there. Many observers believe that North Pattaya has a distinct identity compared with South Pattaya, as the former is more tranquil, possesses glorious sea views and beaches, and has more immediate road connections with Bangkok. A group of North Pattaya hotels, led by Cape Dara Resort, recently set up a marketing arm to publicize the attractions of North Pattaya as an entity. It’s obvious that the Eastern Seaboard property scene is changing fast. The shift is towards Thai domestic buyers, although top-selling condominiums still have many European, Russian and Chinese purchasers. It can be expected that these trends will continue and that the ASEAN Economic Community (AEC), the free-trade zone of 10 regional countries due formally to commence at the end of 2015, will enhance them still further. Colliers International reports a similar general trend in Hua Hin with many new condominium units being completed in 2013 in Cha-am and Pranburi as well as in Hua Hin itself. Most purchasers are Thais in both condominiums and housing estate projects, although many foreign retirees have bought units or houses for both residence and for capital appreciation. Prices have remained stable for the past two years.

PSC Golf from The Growling Swan by Peter Blackburn Hacky and Inspector Clouseau sparkle at Crystal Bay! Crystal Bay, C and A – Stableford They came out of the woodwork for this one as 36 golfers were signed up to play another of our favourite courses, Crystal Bay. We assembled at The Growling Swan and handed out warm welcomes to Adrian Zamell from Melbourne, Gavin Garfield from Sydney, the returning Frank Donnelly after a month in Vietnam, and Jason Schembri back from Melbourne for a couple of weeks. It was sadly time to say farewell to Brad “Bad” Todd who is returning to Perth after a month’s holiday here in Pattaya. Three mini vans plus were required to transport the group and we headed north on Sukhumvit. The golf course was not very busy, and we were allocated the C and A nines in that order. The weather was overcast but fine although very humid as our first of 9 four balls teed off 10 minutes ahead of schedule. With groups in front of us, we proceeded at a steady pace. The condition of the golf course was super and there was absolutely no excuse for good golf; as the results came in later, that was indeed the case. We did slow down somewhat due to the heat, taking a couple of drink breaks. The round was completed in four hours and 20 minutes. We had two grades: A Grade for handicaps 0 to 17 and B Grade for handicaps 18 and over, with seven places in each grade. There were also rewards for nearest-the-pins on the four par threes and longest first putts on the A9 and C9 greens.

A magnificent 43 points gave Paul “Hacky” Hack first place in A Grade, with Kevin “Wayco” Waycott second on 40 points, and Peter Bye third with 39 points. In fourth spot came Sal Brizzi on 38 points, and with three golfers on 37 points, a count-back resulted in Martin “Toddy” Todd (21 point back nine) finishing fifth from J J Harney (17 point back nine and 12 points on the last six holes) in sixth place with your writer, Peter “Blacky” Blackburn, (17 point back nine and 11 points on the last 6 holes) finishing seventh. Alain “Inspector Clouseau” Taddei took out the B Grade with a fine 41 points, 2 points ahead of Fred Dineley in second place. With two players on 37 points, a count-back was required which resulted in Tom MacMahon (19 point back nine) finishing third from Frank “Woody” Donnelly (18 point back nine) in fourth spot. Graham “Grunter” Buckingham was fifth with 36 points, Thientong Charoenrung finished sixth on 33 points, with Max “Corsets” Bracegirdle in seventh spot on 31 points. The Growling Swan NAGA Award (to the golfer who has the worst score on the day and discreetly their score is not made public) was well won by Growling Swan mine host Peter Grey, and he accepted and wore the award with pride. Max then kindly paraded Deefa the Dog and of course collected many donations for the needy in Pattaya from our generous Growling Swan golfers. Back at The Growling Swan afterwards there was a terrific crowd in attendance and many of us stayed for quite some time enjoying the company and the facilities whilst discussing the quality day we just had. International Bridge Tournament Challenge

A multi-nationality bridge event at Alto’s Restaurant attracted players from more than a dozen countries. The inaugural challenge between Pattaya Bridge Club and Dutch Bridge Club for the prestigious Kingdom of the Netherlands cup consisted of 12 players on each team. Top honours went to: Gerard Hardy and Derek Tyms from Australia, Mike and Viv Lloyd, a married couple from South Africa, Alan Purdy and Avon Wilsmore from England and Australia, Erik Saelensminde and Terje Lie from Norway, Duplessy Macha and Coutelet Christian from France. The event was supervised by Jeremy Watson, director of Pattaya Bridge Club.

Stuvik wins at Spa Francorchamps Thailand’s Sandy Kraokaew Stuvik, the European Formula 3 Open Championship leader, stormed into pole position in an exciting qualifying session at Belgium’s Spa Francorchamps. This marks the sixth of the eight rounds in one of the world’s largest Formula 3 grids. The young racer blitzed the field with a time of 2:16:777, a full 7 tenths of a second ahead of his RP Motorsport teammate Alexandre Cougnaud. Light rain made conditions tricky for the 30-car strong Formula 3 grid. As the lights came on the Thai driver had a good start and narrowly survived a high speed off at the famous Eau Rouge corner at the slippery first lap. He lost the lead to UAE’s Ed Jones in the process, but on the following

lap regained the first position after slipstreaming Jones along Kemmel straight. The lead would change again as the two championship contenders fought for position, but in the end the Thai driver managed to open a small lead on the Emirate driver and would eventually claim the win. Stuvik enjoyed the podium and the Thai National anthem played over the Belgian circuit, before again strategizing with the Italian racing squad RP Motorsport for Sunday’s second race. Slow Trickle Dear Andy, I have a very, very slow drain in my shower. I tried your suggestion to use baking soda and vinegar, and I tried a commercial liquid drain opener, but the water still pools up in the tub, only trickling out slowly. I also tried a plunger to no avail. It appears the clog (if that is indeed the problem) is relatively close to the drain opening as I can pour only a litre or so of water into the drain before it begins to back up into the tub. Water seems to drain just fine in the bathroom sink and toilet. Any ideas on what to do next? Jeremy It seems your shower drain will have to be snaked, Jeremy. If you’re handy, you might have success with a DIY snake since the clog is localized in the shower drain. lasting buds, the florist advises. She implies that some shops keep flowers around for days before selling or discarding them. Tell your husband to avoid selections that are discolored, drooping, etc., and have him pointedly ask the vender how fresh they are. If they die the next day, take them back and insist on replacing them with fresh. To help prolong the attractiveness of your blossoms, Supaporn recommends cutting the bottoms of the stems at an angle before placing them in a vase filled with fresh water. Subsequently, cut the stems a little each day and replace the water. This should help brighten your home until your romantic husband replaces them. Supaporn notes with a smile that “adding aspirin to the water will not help--unless the flowers have a blooming headache.” No Exit We have trouble opening our sliding patio doors, Andy. They usually stick and often we just can’t get out; when we do get them open, it’s hard get them closed. Is there anything we can do to solve the problem and avoid future problems? Bobby There are a couple things you can try. Begin by vacuuming out the top and bottom tracks of the patio doors. Then clean the tracks with detergent and a reasonably stiff bristle brush. If the door is dragging at the bottom, manipulate

the adjustment screw found near the bottom roller (on the door itself) so the door frame rises off the track. Finally, apply white lithium grease to both the top and bottom tracks. This grease is an excellent lubricant. Hot Shot What should you do if you eat a pepper that sets your tongue on fire (like I just did)? Sean Do not drink beer, water or similar liquids you might be inclined to reach for. Capsaicin, the chemical that makes a hot pepper hot, doesn’t dissolve in water, so even ice water won’t help remove the heat. Your best bet is a glass of milk. Because capsaicin is fat-soluble, a compound in milk can actually pull the capsaicin off your tongue and relieve some of the burn. Another option: eat bread or rice to absorb the heat. Cucumber can also have a cooling effect. If you feel brave (or masochistic), try eating another pepper. According to Robert Berkley, the author of Peppers: A Cookbook, you can build up a resistance to capsaicin by eating more chili peppers. Wood Eye Dear Andy, I plan to do some building in my yard and I’ve been eyeing pressure-treated wood. Do you think that would be suitable for outdoors? Actually, Dan, that’s a pretty good choice because it’s less expensive than standard wood and works particularly well if you

The Growling Swan & Pattaya Sports Club combine their efforts by William Macey It is 33 degrees with humidity in the mid-80s, not an unusual situation in Pattaya. There are 1800 children in School No. 9 and, when not in the classroom, they are running around expending energy like it went out of fashion. The one thing they need right now is a glass of cool, clean drinking water but, as you can see from the photograph, there is often a rush to have some refreshment. It does not help when the water filtration system is old and past its sell-by date, breaking down with monotonous regularity. Water is essential to maintain a healthy body. It has innumerable benefits, and it is said that we should drink two litres of water per day. It is essential that everyone has access to clean drinking water—particularly children just developing into adults, for it is far too easy to drink less than the recommended amount and suffer dehydration. Since opening in Soi Chaiyapoon, the Growling Swan has been raising money for the underprivileged with a system of fines for being late, putting a golf ball in the water, spilling beer (unheard of surely) and virtually any other blunder. Deefa the Dog is passed around for fines to be paid, but members do no object, for it all goes to a good cause. When the Growling Swan approached Pattaya Sports Club with funds that had been collected at the same time as School No. 9 wanted help with the filter system, the timing could not have been better. A quick inspection of the existing antiquated system confirmed the need for an immediate upgrade. A quotation for

replacement filters was obtained, the balance agreed upon by the PSC committee, and installation was achieved in only a week. It is now functioning perfectly, the old filter consigned to the museum and the children no longer have to hope that water is available.

Opportunities in Government by Derek Franklin The employment opportunities for people with disabilities have greatly improved over the past decade. Recent new laws introduced by the present and previous governments have given people with disabilities the chance to join the workforce as equals, free from discrimination and prejudice. Current employment law states that every company employing more than 100 workers must employ a person with a disability. Today people with a disability can be seen working in shops, hotels and factories and not just in companies employing more than 100 workers. Fear and misunderstanding of those seen as different was the main reason why companies in the past refused to employ anyone with a disability. This improvement in the opinions of the public and government is due in part to the continuous lobbying by the Pattaya-based Redemptorist Foundation for People with Disabilities. A recent two-day seminar prepared people with disabilities who wished to work for the government, where they are entitled to benefits including a high salary, pension and healthcare benefits for the worker and their family; these are not always found in the private sector.

Ussa Hongkanchana, director of the National Office of Empowerment of People with Disabilities, addressed seminar participants from throughout Chonburi and from as far as Chiang Rai in the north and the southern provinces; most represented their local support groups. As Thailand, and in particular potential employers, becomes more aware of the abilities of people with disabilities they will realize that having a disability does not always mean a person is disabled.

Youth Focus Why SATs are controversial and why independent international schools don’t have to do them by Justin Senior For a number of years I have worked as a teacher on the international school circuit and most recently as a school principal here in Thailand. One of the topics of conversation I have sometimes listened to among parents (and some teachers) is whether or not the various international schools should undertake SATs or equivalent exams. The assumption seems to be that if schools do not run these types of exam they are somehow failing. This shows a lack of awareness and misunderstanding about the history, culture and reason for these tests that are held in government state schools in the UK. What is often forgotten is that international schools are independent schools, not state schools. They do not have to follow the British National Curriculum (though most base their curriculum on it) and they don’t have to do SATs exams (and most do not). Let me enlighten you...but first some background information: The British National Curriculum was introduced into England, Wales and Northern Ireland as a nationwide curriculum for primary and secondary state schools following the Education Reform Act 1988. The purpose of the National Curriculum was to standardise the content taught across schools in order to enable assessment, which in

turn enabled the compilation of league tables detailing the assessment statistics for each school. These league tables were intended to encourage a ‘free market’ by allowing parents to choose schools based on their measured ability to teach the National Curriculum. The form of assessment used to compile the league tables are the SATs taken in British state schools at the end of KS1 and KS2. There has been huge controversy surrounding these exams, and in 2010 half of all state schools boycotted the exams. Two of the main points of concern are that these national exams place children under constant stress for their whole academic lives, and that the principal purpose of national curriculum testing is for school league tables. Thus, the nature of the tests leads to a phenomenon known as such as ‘teaching to the test’. Independent schools are not part of this system. Less than a fifth of independent schools in the UK now voluntarily stage exams in the three-Rs for 11-year-olds (Reading, wRiting and aRithmetic) – half the number of the late-90s. David Hanson, chief executive of the Independent Association of Schools in the UK, in a recent interview criticized the “obsession” with literacy and numeracy in

state schools, claiming this was damaging pupils’ education, particularly among boys. Speaking before IAPS’s annual conference in Manchester last September, he said: “We are opposed to league tables – we think they are counterproductive and corrosive – and the vast majority of our schools don’t do SATs test. We think they’re unhelpful, they’re crude and there are far more useful assessment tools. It is now a minority sport for our schools.” Many fee-paying independent schools decided to ditch the exams because of concerns they narrow the curriculum and present a misleading picture of pupil standards. In the state sector, teaching unions continue to call for the exams to be scrapped altogether amid claims schools are forced to “drill” pupils to climb official government league tables. “We have a situation where teachers are forced to spend the entire morning obsessing

with literacy and numeracy to the detriment of the rest of the curriculum,” Mr. Hansen said. He added, “In our [independent] schools, we probably spend less time on literacy and numeracy then in a maintained primary school but much more time in arts, language development, sport and music, which creates a more joyful experience and has a positive impact on reading, writing and number work.” There is an argument for international schools to have an external examination to act as a benchmark against others, but with regard to SATs and their equivalents, it can be seen that such exams are highly criticized and one has to question the purpose if it is not for their initial reason – to create league tables of government schools in the UK. One can only assume that internationally they are used as a marketing ploy – from which comes misunderstanding about their importance. The important point for parents and teachers to remember is that international schools are independent schools, and independent schools do not come under the jurisdiction of a local UK based education authority. They are independent from the British National Curriculum (if they choose to be), thus, they do not have to undertake SATs exams or their equivalents unless they choose to do so voluntarily – and as we can see, most independent schools choose not to.

How to Remove the Skunk Smell from Dogs

Has your dog been sprayed by a skunk? Even if not, all dog owners should know how to handle it--just in case. You may have heard of skunk odor remedies like tomato juice or vinegar, but they really just cover up the odor. Products like Nature's Miracle Skunk Odor Remover have been known to work, but may be hard to find in a pinch. You can remove the odor from your dog using household items. It's all thanks to chemist Paul Krebaum, who developed the recipe in 1993. Skunk spray is very oily and contains sulfur (hence the stench). This recipe causes a chemical reaction that breaks up the oils and neutralizes the odor. Difficulty: Average Time Required: 30-60 minutes Here's How: 1. As soon as you realize your dog has been sprayed by a skunk, don some rubber or latex gloves and old clothes and look her over for bites or scratches. Also check her eyes for redness or discharge. If any injuries are found, you should contact your veterinarian before proceeding. 2. Time is of the essence here--the longer you wait to begin the process, the harder it will be to remove the stench. Get set up for bathing your dog outdoors or in an easy-to-clean area of your home (laundry room, bathroom, etc.) If indoors, open a window to save your nose! 3. Apply a small strip of eye lubricant (such as Puralube) or 1-2 drops of mineral oil to your dog's eyes. This will help protect her eyes in case any of the solution splashes or drips in. 4. In the plastic container, combine 1 quart hydrogen peroxide, 1/4 cup baking soda and 1 to 2 teaspoons of liquid soap. Add lukewarm water if needed (for larger dogs). Mix ingredients well. The solution will fizz, as a chemical reaction is occurring. Use immediately--do not store. 5. Do not soak your dog with water prior to bathing. Promptly begin cleansing the affected areas, thoroughly massaging the solution deep into your dog's coat. You may wish to use a sponge or washcloth. Avoid getting the solution in her eyes, ears or mouth. 6. Allow the solution to remain on your dog for at least five minutes (longer if strong odor persists). 7. Rinse your dog well with lukewarm water. Repeat steps 3-5 as necessary until odor is gone. 8. Dry your dog well and give her a treat! Tips: 1. NEVER place the solution in a closed container or spray bottle, as the pressure will build up and the container could burst. This could cause serious injury to you and your dog. 2. DO NOT use higher concentrations of hydrogen peroxide or substitute baking soda with "similar"

products. The altered chemical reaction could cause severe injury to you and your dog. 3. Be certain you use fresh hydrogen peroxide, as it becomes less concentrated over time. If you are unsure how old your hydrogen peroxide is (or if it is expired) get fresh bottles just in case.

In addition, keep your dog within eye shot and keep her from running into wooded areas unattended.
