hat an awesome convention! Thank you again to our many contributors and organizers. Are you still All In!? Here in southwest Ohio it’s been hot for a while and we’re already in full AC service/ replacement mode, but warm weather brings crazy storms too! As I type this, a thunderstorm is passing and my wife talks me into checking the grounds to make sure things are secure. If not, it could mean disaster and maybe a call to the insurance man. You know, few things are as interesting as insurance reviews... premiums, umbrellas, deductibles, etc. … exhilarating! This is one reason why I love our association and our many partners that unite and diversify us. Like a good business, you need people from all backgrounds and talents. Each person with different experiences and education brings unique strengths to make the team strong and I believe we are blessed to have that in ACCO. We have a great opportunity to discuss residential licensing with our state legislators on June 6. Join me and your fellow contractors and represent ACCO and PHCC in Columbus for Legislative Day. Info has been sent via Constant Contact, the

Congratulations to our 2016 Award Winners: BWA South, Manufacturer’s Rep of the Year; Dry Patrol, Service Contractor of the Year; Welker McKee, Supplier of the Year; and Rick Seifert of D&A Plumbing, Contractor of the Year. I hope you are able to attend the PHCC/ACCO Legislative Day June 6. We will meet with our elected legislators to discuss residential licensing. It’s an important issue that needs your attention. Stand up for your trade and stand up for your industry! The 2017 PHCC National Legislative Conference is June 1314. This is another perfect opportunity to leverage the power 6

of PHCC to influence important policy. This is a great event if you have never been to one. I suggest you try to attend if at all possible. It seems like the pace of construction projects is getting faster which leads to a shorter time of completion. It puts pressure on the companies and employees. Don’t get me wrong, I am all in agreement in completing a job at a good pace, but we must not forget the main concern should be of the employee’s safety and health. To overcome the fast pace of the construction market is to keep up with today’s technologies and provide team members with the latest tools and equipment. We must think outside the box and come together with a plan that surpasses the one in place, knowing how to come up with recruiting and training more young talent in our industry. DISCRIMINATION LAW REFORM COMING – LOSER PAYS?
W
ith the new administration in Washington and many statehouses now being occupied by Republicans, reform is being attempted in various states for what many employers believe is unfair or “uneven” treatment when it comes to defending discrimination claims. Most employers have felt the brunt of a baseless charge of discrimination filed against them by a disgruntled ex-employee – filed just to strike back and get even. After all, what does the ex-employee have to lose by filing? Of course, the employer loses much time and money in defending these spurious charges – to say nothing of the angst! But, now, at least one state – Ohio – is trying to level the playing field. On April 6, 2017, changes were made to the law governing the Ohio Civil Rights Commission’s procedures for investigating and resolving employment discrimination charges to permit a charged employer who prevails at a formal Commission hearing to be eligible to receive its attorneys’ fees and costs of defense. Attorneys’ fees have been available to a prevailing claimant for quite some time. But, a prevailing employer, was left with practically no way to recover its expenses. Unfortunately, under the new law, the case has to go to a formal hearing before the Civil Rights Commission may award the attorneys’ fees. So, what about all the time and expense incurred in addressing discrimination charges which are dismissed before an actual hearing but after a lengthy investigation and the exchange of company information? No relief is yet available.

This new “fee-shifting” provision, however, may very well serve as a deterrent to claimants and the Commission processing a case to hearing that should be resolved otherwise. It places the claimant at risk. Fee-shifting provisions whereby a prevailing claimant gets his or her attorneys’ fees have been around for quite some time but irked employers who have not had the same opportunity to recoup their costs when prevailing – unless the claim is brought in bad faith. So, this is a start to “leveling the playing field” and it may cut down on the number of claims an employer must defend. Another Ohio bill (HB 2) has been introduced recently and would drastically reform Ohio’s civil rights laws by limiting the time in which a claimant can bring an action, eliminate individual liability of supervisors and managers, cap damages, bar the automatic award of attorneys’ fees in age discrimination cases and stop an employee from concurrently filing an administrative action and a civil court case. These reform measures could very well set a trend in the states surrounding Ohio in the months to come. Stay tuned! SUMMER 2017 – THE BOX SCORE Michael Bohinc, CPA
“H
ow’d the Tribe do yesterday?” a friend of mine asked me after I attended my first home opener in over a decade. (Opening Day and tax season usually don’t get along too well.) I responded “They won 2 – 1 in extra innings.” “How’d your guy do?” he followed up with. “He went 1 for 3 with a double, two walks and a strikeout. He knocked in the winning run in the 10th inning. It was a great way to return to the lineup and start the season!” (My guy is the Cleveland Indians’ Michael Brantley and he missed most of last season due to a shoulder injury.) (That’s great but where are you going with this? How does it relate to our industry?)
Here’s how. When you want to know how your team or favorite player performed in the game yesterday, you go to the “box score.” The box score tells you what happened in the game from a numbers perspective. It tells you if your team won or lost and how each team member performed in the game. You can take that same concept and create a box score for your company. Obviously the things that get measured are different and in most cases you’re establishing your own rules to determine a win or loss. In baseball, some of the things that are tracked (measured) are: win-loss record, batting average, hits, at-bats, types of hits, walks, strikeouts, runs scored, runs-batted-in and runners-left-on-base (to name just a few of probably hundreds of measurables). OK, what would be things that you can measure to review your team’s performance? • • • • • • • • • • • •
Number of service calls run (at-bats) Number of completed service calls where more than the service call fee, minimum fee or diagnostic fee is performed (hits) Conversion rate (batting average) Total Sales Average Sale Total number of tasks or services performed Tasks per service call Service agreements (SA) or Club memberships (CM) sold Conversion rate for service agreements or club memberships sold Hours worked Hours billed and many, many more Continued on Page 12 >>

A NEW ADMINISTRATION, A NEW CONGRESS… WHERE DO WE STAND?
T
hroughout history, public policy making – regardless of political party and whether it’s local, state, or national – is a tough business. To treat it like it’s a scorecard is ridiculous. Every American president and every Member of Congress has the pressure to work toward improving the quality of life for a nation for this generation and future generations. This is nothing new. Absolutely this nation has endured lawmakers who have gotten off track, but we need to maintain the purity of the system. One of the toughest parts of public policy is to oppose something someone else is expressing, and still try to keep in mind that they are doing (in their heart) the right thing. It’s a true challenge, but important. So, where do we stand in Washington, D.C.? SUPREME COURT - Neil Gorsuch is our newest Supreme Court Justice HEALTH CARE - As you now by now, the American Health Care Act passed the House and now the debate moves to the Senate. We can analyze the actions of the House and the details of the issues of what passed the House all day, but in truth, we now need to wait and understand what the Senate is thinking (this could take weeks or months and the Senate has vowed to significantly modify the House bill). Whether you agree or disagree with what the House did, we’re still in the first inning. TAX REFORM - This is one of the most positive actions in Washington, D.C., this year. A proposed tax reform plan (which has been talked about for the last three years) has been released and is now being worked on in the House and Senate. The proposed tax reform plan would:– • Cut the number of income tax brackets from seven to three, with a top rate of 35 percent and lower rates of 25 percent and 10 percent. It is not clear what income ranges will fall under those brackets. It would also double the standard deduction. • Decrease the corporate tax rate to 15 percent from 35 percent. • Tax income flow through entities at 15%. • Eliminate tax deductions, with only a few exceptions,
including the mortgage interest and charitable contribution deductions. • Establish “one-time tax” on the trillions of dollars held by corporations overseas though the rate for that tax has yet to be determined, including a repatriation rate. • Repeal the “death tax.” • Repeal the alternative minimum tax. REGULATORY REFORM - Much or what PHCC has pursued in terms of regulatory reform has been taken care of with Presidential Executive Orders. PHCC will continue to pursue legislative regulatory reform, but for now there is a hold on many of the rules and regulations we’ve fought. Regulatory reform is also conveyed in tax reform in the form of regulatory accountability (a process by which a regulatory agency must comply with its obligations in terms of conducting economic impact studies prior to finalizing a rule or regulation, so as to understand the harm – if any – of the new rule or regulation to small business). INFRASTRUCTURE SPENDING - A proposed $200 billion plan has been released. This is significant. It signals that lawmakers understand the true parallel between the health of the economy and the health of its transportation system. It also signals that there is a true commitment to apply needed funding to infrastructure underground as it pertains to clean water. None of these initiatives is unachievable and all are in play. The Plumbing-Heating-Cooling Contractors-National Association is the oldest construction trade association in the nation. PHCC may not set the agenda of what is considered in Washington, D.C., but PHCC certainly has a seat at the table when lawmakers need to make decisions on issues impacting the industry, and the best interest of the nation. On June 13-14, 2017, we will bring our collective voice to Capitol Hill. We need you to be involved and help the industry impact issues critical to the plumbing, heating, cooling industry. ACCO’s Supplier of the Year Award is given to a Supplier or Wholesaler, who has been supportive of the HVACR industry and provides outstanding assistance to ACCO members.
The ACCO Contractor of the Year Award recognizes an ACCO member who has a proven track record of hard work for the Association, our membership and the entire HVACR Industry.
According to the nominations, Stu Bennett “does a tremendous job helping his sales team develop a more personal approach to sales. They support our associations at the local and state, and they always support our state convention and give countless hours of training to our members.” Stu started his career working at a hardware store 28 years ago while in high school. He was also attending vocational school for building & remodeling. At a young age, he realized that physical labor wasn’t a strong point and he really enjoyed the personal interactions with customers. After high school, he continued in the distribution business working at a small family owned builder’s supply company. He covered every aspect of the business – counter, purchasing, warehouse, and delivery. He was also working part-time with a plumbing contractor doing rough-in and new construction. His next position was with a slightly larger family owned plumbing supply company where he started in the showroom, spending the majority as an outside sales associate. After 18 years, he left the company as Vice President of Sales. Staying with family owned businesses, Stu joined a 4th generation family owned business, Famous Supply in 2012 and currently holds the position of Northern District Sales Manager. Working for such a large company that still has the feel and culture of a family is exactly what he was looking for at this point in his career. At Famous, their purpose is “To build meaningful relationships for life” which he’s done throughout his entire career.
Ed Reid started in the business some 35 to 40 years ago. He always tells the story about how he got his start. At the time, he was doing foundation work - laying concrete - when someone walked up to him and asked if he wanted to be in the heating and air conditioning business. He looked around at what he was doing – down in a cement hole – and said, “sounds good.” He began working at Bartels Heating and Cooling in 1984 as a service tech and then worked his way up to sales and management. From there, he was offered the opportunity to take over the business – that was 20 years ago. Since that time, the company has grown to over 15 employees and has more than doubled in sales. Ed has served on the Greater Cincinnati Board, ACCO Board, and served as ACCO president in 2013-2014. He remains very active in both the local and state associations. He’s involved in his church, sings gospel music, and loves to fish. According to the nominations, “he is a go to guy and if help is ever needed on a project, you can count on him to assist anyway that he could. He is a great example of what an ACCO Member should be.” Another said, “He treats all the employees with respect and not a one person could tell you they don’t enjoy working with him.” Volume 2017, Issue 2 • OHIO PHC CONTRACTOR

The PHCC Contractor of the Year award is given to the individual contractor member who has demonstrated over and over his or her willingness to serve PHCC, the industry, and their community with their time and talent.
Welker McKee began serving the community in 1909 as a prominent plumbing and hydronic heating supplier in Northeastern Ohio. Proud to be a part of Hajoca, one of the largest privately owned companies in the industry with over 270 locations in the U.S., the company maintains its entrepreneurial business model and offers vast access to product resources. This defines the company’s ability to act as a principal supply entity to its customers.
Growing up in a family plumbing business, hearing stories about work at the dinner table, it seemed the plumbing business was the obvious career choice for Rick Seifert. After graduating from the University of Akron with a Mechanical Engineering degree, Rick started working for the family business in 1982.
Their destination Premier Kohler Showroom is a winner of The American Society of Interior Designers’ “Interior of the Year Award”, and displays 7,000 sq. ft. of the latest trends in decorative bath and kitchen fixtures and faucets. Two years later, our winner was approached by GPD & Associates, Consulting Engineers, to join their company. There he spent 14 years doing plumbing & heating design for commercial and industrial projects. Their client list included North Royalton and Copley-Fairlawn schools, The Church of Latter Day Saints, and Jo-Ann Fabrics to name a few. This career move also allowed him to obtain his State of Ohio Professional Engineers license. After his time away, Rick rejoined the family business with his father (Gene) and brother (Scott) in 1999. Today the company does a mix of residential, commercial, industrial, and design / build projects. The company office is located in Uniontown, Ohio, where they employ an office staff of approximately 40 people. Rick is a member of the Ohio Society of Professional Engineers, American Society of Heating, Refrigeration and Air-Conditioning Engineers, PHCC, and the East Central Ohio Mechanical Contractors Association. He is also past president of his local PHCC chapter and the local MCA chapter and has been serving as PHCC Ohio Director for the past 6 years. His favorite saying is, “The customer is always right, great customer service is the key to success.”

Monitored Legislation Throughout the year, ACCO tracked and monitored numerous items receiving attention by the legislature. These included SB 249 (Commercial Roofing Contractors License), HB 523 (Legalize Medical Marijuana), HB 394 (Changes to Unemployment Compensation) and SB 320 (Renewable Energy). Regulatory Residential Code ACCO attended the regular meetings, when held, of the Residential Construction Advisory Committee (RCAC) and provided input where needed.

ACCO and PHCC Members raise another $6,000! The Specialty Contractors Coalition would like to thank all PHCC and ACCO members who gave generously to the Ohio PAC in 2016. Monitored Legislation Throughout the year we monitored several bills from the legislature. These included SB 249 (Commercial Roofing Contractors License), HB 523 (Legalize Medical Marijuana) and HB 394 (Changes to Unemployment Compensation). Regulatory Residential Code of Ohio PHCC continued to provide input at the regular meetings of the Residential Construction Advisory Committee (RCAC). PHCC supported RCO, Section 108, Inspection Process (108.1 General). A petition was sent from numerous electrical contracting associations to the Board of Building Standards requesting their rule include licensed contractors before inspections will be performed. The change would have greatly reduced unlicensed activity throughout the state. The change was denied by the BBS Board. Ohio Plumbing Code/Section 312 The conversation started in 2015 that air-testing would no longer be allowed on DWV systems. PHCC was able to get vacuum testing (or other methods) as an acceptable testing method in the update. PHCC also suggested new language to the proposed rule change that would allow for air testing if the manufacturer allowed it. Recently, PHCC contractors have been successfully testing systems with vacuum devices. Board of Building Standards PHCC provided input at the regular meetings of the Ohio Board of Building Standards. Backflow Advisory Committee Along with Committee Member Rodger Sweitzer, Baumann Plumbing PHCC continued to work closely with the Advisory Committee and Plumbing Supervisor Jack Soma. OCILB PHCC continued working with OCILB and attended regular meetings, provided input and gathered information helpful to licensed contractors in Ohio. OCILB HVAC/R Section Board PHCC supported Mike Roush (Columbus, Mechanical Field Inspection Supervisor) to replace Cheryl Roahrig (Columbus, Mechanical Inspection Supervisor) on the board. MEMBERSHIP PHCC Membership Committee continues working each month to ensure our growth and retention of members. Thanks to members Brian Nieman, Dan Voight, Dave Wolfe, Larry Betlejewski, Nicole Hollenbeck, Mike Trickey and Ron Schmitt for serving on the committee. With the help of our members and chapters, PHCC had 11 new members in 2016. Benefit of the Month PHCC continued to promote member only benefits that included: Business Services, Workers Comp Program, Ohio Convention & Expo, Advocacy, Ohio PAC, PHCC Ohio Scholarships, Safety Lessons, Speedway, Legal Services Plan, License Bond Program, Education and Training, and the PHCC Contractor Locator. Do Business with a Member! Throughout the year PHCC encouraged our Plumbing contractors to team up with our Associate members to do business together! By being a member of PHCC you share common interests in the plumbingheating-cooling industry. You will find that PHCC members working together make a strong alliance. COMMUNICATION Ohio PHC Magazine The magazine was published 4-times, at no cost, with a distribution of just over 6,000. This year we started working with a new publisher…Look for a new look and new features in the future. PHCC Website The look, navigation and info is easy to access and find. Work continues on the site, so continue to visit as more content is added and updated. Social Media PHCC Ohio continues to increase its presence on social media. PHCC currently has over 360 “likes” on Facebook and 201 members on our Friends of PHCC LinkedIn Group. Social media continues to be a valuable resource to provide updates and information as well as have members interact with one another. Industry Partnership Program The Industry Partner Program gives a specific number of companies the opportunity to build name recognition and brand loyalty, reach new customers and sell their products, 30

with a year-long period of advertising and marketing to PHCC contractors. To date, Dry Patrol, Federated Insurance, Winsupply of Cleveland, Famous Supply, Keeping Score, Inc., Welker McKee, Champion Pump, NIBCO and Milwaukee Tool are PHCC Industry Partners. WORKFORCE DEVELOPMENT To help meet the PHC industry’s crucial challenge to attract, train, and retain qualified workers, PHCC is sharing resources from the PHCC national online Workforce Development Center. Visit the site at phccareers.com FINANCE PHCC monitored its programs, maintained membership numbers and worked to increase participants in our benefit programs. Expenses did increase this year and there were several opportunities to increase revenue (membership, member benefits, education and the industry partner program). Our budget was realistic and maintained services we needed to keep our industry affiliation strong. The Executive Committee reviewed operations throughout the year and made adjustments as necessary with Board approval.
