Four Pa. Governors Pressing For Judicial Reform, Refuse To Heed Voter Rebellions In Other States

by Joe Shaheeli Supporters of merit selection for Pennsylvania Judges are at it again. Gov. Ed Rendell was joined by former Govs. Mark Schweiker, Tom Ridge, and Dick Thornburgh recently to kick-start the taking away of voters’ right to choose Judges.

Each decried judicial elections and the fundraising they require as unfair and corrupting. Each said the better system was to let the State’s chief executive, translated “Governor”, appoint the most qualified person for the job. Rendell

said the elective process “is an awful system. It has got to change.”

The four are ramping up an effort to get this legislative session to pass merit-selection legislation. The rules for any change to the constitution would make it necessary to approve the legislation this session and again approve the merit-selection legislation in both chambers the following session, before going to the voters on a referendum.

Though bills are in the hopper in both chambers, the push to approve the legislation this

session could be tricky. Lawmakers have a calendar loaded with contentious budget negotiations, finding money for dedicated transportation, and the need for many of them to start campaigning early before November. It may be hard for them to put judicial merit selection on the front burner.

In states where merit selection is in vogue, voters are beginning to rebel. Under an initiative headed for the November ballot, Missourians will decide if they want to heave out merit selection and replace it with the system now

enjoyed by Pennsylvanian: direct judicial elections by the voters.

In Missouri, vacancies are filled through a nonpartisan judicial nominating commission.

That commission selects a slate of Judges from which the Governor chooses a nominee.

This merit-selection plan effectively takes politics out of the courtroom, but places it in the hands of lawyers and bar associations, with little political accountability.

In Tennessee, Democrat Gov. Phil Bredesen rebuked the State judicial nominating

commission for trying to force its favorites on him. He’s pushed his State legislature to approve steps bringing greater transparency to the nominating commission.

Maybe that is why George Soros, according to the Wall Street Journal, funds Justice At Stake, one of the major meritselection lobbies. It’s easier to influence judicial selections when you only have a few Selection Commission members to lobby.

So Rendell and the other Governors can expect Soros to fund this campaign. Soros’ af-

filiated Missourians for Fair and Impartial Courts, according to the same Wall Street Journal editorial, hassled the ballot initiative’s signature gatherers, using bloggers to discourage voters from signing petitions. But the initiative has survived all court challenges.

As the Journal said, “We trust the voters more than we do a coterie of Soros-funded legal activists.”

We believe the four Governors should cease and desist trying to take away the right of voters to pick Judges. It is the birthright of voters.

Union Benevolent Association Seeks To Help Nonprofits Since its founding in 1831, the Union Benevolent Association has quietly sought to aid those most in need in Philadelphia. But now the group is raising its voice in a different way.

As routine funding sources for nonprofits continue to dry up or stall as a result of the recession, UBA has elected to offer more than small seed and booster grants in this cycle by opting to add a side of survival skills via a crash course in collaboration.

Earlier this month, UBA gathered some 60 grassrootsfocused service providers for a networking and training session on how to use existing, if not overlooked, assets to counter the impact of the lingering economic downturn.

Many social-service providers were caught short last year when the State budget impasse lingered for months past its Jun. 30 deadline. Several are bracing for another round of lengthy negotiations and even lengthier government disbursements, heightening the need for gatherings such as this one.

Attendees at the UBA event represented a variety of service providers that have won grants from the charity previously – ranging from those that focus on children, to those that offer instruction in the arts, to those that pro-

vide housing for seniors.

As the city’s oldest chartered charity in continuous existence and one of the oldest social-service supporters in the United States, UBA provides some $175,000 annually in small project grants to certified nonprofits across Philadelphia. Preference is given to groups and agencies with operating budgets under $2 million and UBA grants often serve as seed money for many well-meaning, but initially resource-poor entities.

Increasingly, those groups with established partnerships or plans to leverage dollars are drawing more attention as the economy cramps all budgets, said Lorene Cary, president of the UBA’s board of directors.

“Our charter calls for us to assist ‘the worthy poor,’ but that’s a definition and mission that has broadened in scope through the years,” Cary said.

“What we want our grantees to consider are new ways of working smarter. The mantra of ‘doing more with less’ is one many of us know too well. But we often fall short on offering people real tools to make that happen.

“Those skills are especially needed now because the dollars just aren’t there,” she said. “Not from us, not from the City, not from the State, and increasingly not from the

larger foundations, either.

The challenge is continuing to provide quality service in spite of that reality, leveraging available resources. And we want to help our grantees and others be successful in those efforts.”

The recent gathering focused on helping people consider alternative ways to foot bills for programs, with speakers and attendees sharing real-world how-to’s when it comes to forging partnerships, rather than the default

mode of competing against neighbors for dwindling dollars. Featured speakers included Umi Howard of the United Way, Phyllis Martino of Impact Services Corp. and Heseung Ann Song of Generocity.

Can Mayor Michael Nutter be beaten?

If the scenario that has taken place since 1951, when the City Charter became the law of the local land, still holds true, he can’t be beaten by a Republican candidate, though on a couple occasions their mayoral candidates have come close.

That history doesn’t daunt the chairman of the 5th Ward Republican Committee, John Featherman. He’s already filed his political-committee registration, putting him first in line as an official candidate seeking the Republican nomination for the 2011 primary.

GOP Ward Leaders’’ List Still Changing The Democrat City Committee has its rule book closed and all of its ward leaders elected for another four years and a leadership voted in unanimously with Congressman Bob Brady as chairman.

Half of the above can be said of the Republican City Committee. It has its chairmanship and Republican Counsel positions and a bulk of ward leaders in the record book for the next four years.

But it won’t be until the end of next week that all the challenges have been lodged by both sides of the intra-party feud will have been heard.

Some have been adjudicated already, however.

Said one active member – in the middle between the State-sponsored opposition group and the regular Republican City Committee – “I believe we will be a united party by the time the Billy Meehan Clambake rolls around in August.”

Unhappy over a reschedul-

ing of a vote for his leadership in the 65th Ward is Phil Innamorato. His leadership vote had been contested. Phil knew the City Committee had ruled there would be a revote, since his leadership had been contested. He notified them he would be out of the country, as of now, for three weeks, a trip he had planned months earlier. He asked for the revote to wait until his return.

His committeepersons indicated they would wait. But Phil is out and the vote is tonight at Smokeaters Bar in Northeast Philadelphia. He must have one horrendous phone bill.

Shrader Takes On Collazzo Campaign Nathan Shrader, long-time campaigner and political analyst, has signed on the Marc Collazzo campaign for State Representative in 170th.

Look for Shrader to give the GOP nominee a robust campaign against a feisty, evercampaigning State Rep. Brendan Boyle.

‘No One Goes Home,’ Hopes Gov. Rendell Gov. Ed Rendell believes “the spirit of cooperation still prevails,” but acknowledges cuts alone will not solve Pennsylvania’s fiscal woes. “I have proposed an additional $600 million in cuts, but beyond that $600 million in cuts given what’s mandated here, it is going to be very difficult for there to be further cuts.”

Hunkering down for budget process, the Governor added, “I also informed leaders I am requesting that they all commit to staying in Harrisburg until we have a budget. No one should go home. The people of Pennsylvania expect that out of us and I think they have every reason to expect that out of us.”

They may not have to stay, since the Governor has picked up almost $400 million in tax and escheat notices.

Human Relations Commission Slapped

By Controller Audit It might be time for City Council to phase out the Commission On Human Relations.

Its housekeeping is a mess.

City Controller Alan Butkovitz has discovered the CHR can’t account for 60% of the Agency’s $513,000 equipment inventory.

The missing equipment from CHR’s June 2007 asset records consisted of computers, printers, and monitors that were valued between $500 and $23,000. “CHR could not tell us where the missing items were located or which items had been scrapped,” said Butkovitz.

“Not enough emphasis was placed on record keeping, which resulted in more than 60% of the equipment being unaccounted for.”

Along with the agency’s failure to locate some equipment, its inventory records did not include locations for any equipment. When auditors requested to see a random selection of three computers,

The successful bidder will pay all conveyance fees, all real estate and other taxes that are due on or after the delivery of the remainder of the payment and all other costs associated with the transfer of title. At the conclusion of the sale, the deposits of the unsuccessful bidders will be returned to them.

The Secretary may grant an extension of time within which to deliver the remainder of the payment. All extensions will be for fifteen (15) days, and a fee will be charged in the amount of $150.00 for each fifteen (15) day extension requested. The extension fee shall be paid in the form of a certified or cashier’s check made payable to the Secretary of Housing and Urban Development. If the high bidder closes the sale prior to the expiration of any extension period, the unused portion of the extension fee shall be applied toward the amount due.

If the high bidder is unable to close the sale within the required period, or within any extensions of time granted by the Secretary, the high bidder’s deposit will be forfeited, and the Commissioner may, at the direction of the HUD Field Office Representative, offer the property to the second highest bidder for an amount equal to the highest price offered by that bidder.

Little did Patricia have any idea she was the marrying kind when she moved to South Philadelphia from New Jersey after her husband died. But Jim was hearing Frank Sinatra’s song “Love Is Better the Second Time Around” moments after he first engaged Patricia in conversation. Still, it took a while for the memory of the words to sink in.

But Eileen noted, “it was something to see as their relationship blossomed. We all knew it would be just a matter of time.”

Both said, “It was fitting to hold our wedding here at the center.”

On their special day, they were surrounded by over 100 of the senior members of the Adult Center. When Jim answered Judge Dembe's question, “Will you take her as

your beloved wife?,” he answered with a loud “You betcha!” to roaring applause.

Judge Dembe kept the senior audience laughing when she said, “We all know marriage is a give-and-take proposition. I can see it on most of your faces.”

They met in an unusual place: the 50-cent luncheon line set up for the over 1,000 members of the South Philadelphia Older Adult Center at Passyunk and Dickinson in South Philadelphia.

She was 66, a widow of three years and he was 70, a widower of 18 years.

Last Thursday, Common Pleas Judge Pam Dembe performed the wedding ceremony that bound Patricia Kuch to James Passarelli.

Credited with pushing this couple into marriage is the Center’s dietician Eileen Ashton, whom everyone at the center calls “Cupid”. She has always made it a point to know the needs of her lunch customers.

She lives near Passarelli, who has a home at 4th & Wolf, on Fitzgerald Street.

Ashton watched through the years as Jim lost his wife through a massive heart attack and, later, two children who died early. She said he was “absolutely lonely,” even though a remaining son is still alive and makes his home in New Jersey.

She talked him into coming to the center to get at least “one nutritious meal,” worried that he was “beginning to look rundown. Not taking care of himself.”

In reality, a lot of people who are not filing bankruptcy are in fact bankrupt right now. If they don’t get a raise, a large inheritance or a lottery win, they’ll spend a good part of the rest of their life with debt they can’t pay off and they’ll be at the mercy of their lenders every day. In reality, they work for their creditors but don’t get the health plan.

by Edith P. Frazier I have been retired for 28 years and have been among the fortunate 18.5 million American retirees receiving employer-provided health care coverage. We are split into two groups: 14.3 million are Medicare eligible, receiving employer-provided health care as supplemental insurance. According to the Congressional Budget Office this includes 9.5 million people receiving employer provided drug coverage, thus obviating the need for Medicare Part D, which in most instances would be more costly.

4.3 million are too young for Medicare and have employer-sponsored health care as primary coverage.

In 2004 when the Medicare Modernization Act (creating Medicare Part D) was first passed, there was a fear that employers who were providing retiree drug coverage would use the law as an excuse to drop their Medicare eligible re-

tirees, forcing the government to take over. So a very lucrative deal was offered to employers. For every $100 the company spends on retiree drug benefits, Medicare sends it a subsidy payment of $28. On top of that, the companies got a rare double tax break. The $28 subsidy is tax-free, and the company was allowed to deduct the entire $100 as a business expense.

The new 2010 version of health care reform law has left the 28% subsidy intact and continued to exempt it from taxation. But companies will no longer be allowed to also deduct the subsidy from their tax return, as if it were an expenditure of their own. This has caused major corporations to weigh the cost of their plans against the $2,000 per employee/retiree penalty which would be imposed by the new Federal health-care law should they drop the health plan coverage altogether.

Family Foundation study, the average costs for an employer-provided health plan approaches $5,000 for an individual and over $13,000 for a family. If you were an employer, could you imagine a better boost to your bottom line than to get out of the insurance business? If you were an employer, wouldn’t you gladly accept the penalty if it would save millions of dollars? Wouldn’t it be irresponsible to your stockholders to do otherwise? Wouldn’t Congress have the intelligence to anticipate this obvious result?

Remarkably, the Congressional Budget Office has not included the cost of 9.5 million people having to migrate from private-employer coverage to Medicare, in its National Healthcare Reform projections.

However, should the 9.5 million get dumped, that cost would be an additional $5.4 billion over the original projections.

Whatever the motivation, Congress has kept the em-

ployer penalty low and private-sector employers are presented with an open invitation to drop health-care coverage for both active and retired employees.

Congress actually scheduled hearings to grill major employers who announced they were already dropping coverage, until legislators realized doing so was in reaction to loopholes in the law that fails to protect America’s retirees who accepted lower wages over a lifetime of employment in return for earned retirement health benefits.

Retirees need action from Capitol Hill before Washington takes its summer break for election primaries.

When Members of Congress hold town-hall meetings in the District as we get closer to November, we all need to ask why they allowed retirees to be thrown under the proverbial bus by providing such an employer inducement to drop coverage, and how they plan on fixing the mess they created for us.

With the deadline to pass a budget a few days away, those visiting the Capitol Building in Harrisburg can hear a lot of grunting, growling and bitching. It’s all to good purpose. Everyone vested with the responsibility of passing on the new budget is earnestly trying to do so with a minimum of gives and takes and, hopefully and wisely, not without any tax increases save those planned for some untaxed tobacco products.

Maybe Gov. Ed Rendell will find his lucky star flashing over his head again with the fact the State’s tax-amnesty campaign brought in over $261 million in new funds, with Pennsylvania Treasurer Rob McCord handing over $100 million in unclaimed funds to the Treasury.

The cry has become almost uniform from the grassroots lobbyists: “Don’t forget the needy, feed the nonprofits that were created to ease their burdens.” This hasn’t worked before, and doesn’t seem to be working now, as a propellant through the legislative process.

What does seem to be working, though, is the growing awareness this summer it is more critical than in past summers for legislators to spend campaign time in the only way that insures a return to the legislature ... locally, in the streets, knocking on doors and attending scores of community events. Unlike previous summers, more and more legislators are realizing, no matter how safe the seat, unless there is no competition in the General, the public sentiment to clean house may just do in any incumbent.

Messing up the normal routine this summer, for legislators, is the fact Bonusgate has cast a smell on all of the General Assembly membership. Coverage in the dailies is continuing to bring that odorous mess to the nostrils of voters. Add to that, though not up for reelection any time soon, is the snafu created by the truthful, or just dumb, defense raised by Supreme Court Justice Ronald D. Castille’s handling of the $200 million Family Court to be built in Philadelphia. Tax-weary Philadelphians will find it easy to add his woes to the reasons why they may give into the urge to throw the baby out with the bathwater this November.

PHA Fills In With Summer Food For Kids Senate Green Lights Southport The Philadelphia Housing Authority will help needy children through the summer vacation with good food. The 2010 Summer Food Program begins Monday, Jun. 21 at 19 PHA sites across the city.

PHA Executive Director Carl Greene says, “This is needed now more than previous years because of the depressed economy. Many parents are out of work and providing a good breakfast and lunch ensures that our children will not begin their day hungry.”

Under the Summer Food Program, all eligible children ages 18 and under are able to receive free breakfast and lunch from Monday, Jun. 21 through Friday, Aug. 20. The program will operate Monday through Friday from 8 a.m. to 2 p.m.

Carla Fleming, PHA Summer Food Program coordinator, anticipates increased participation in the program this year. The program provides young PHA residents and children from surrounding neighborhoods with the fundamentals, a good break-

fast and lunch.

The Summer Food Program changed dramatically several years ago with a switch to a nutritious hot lunch menu that proved very popular with the kids. No processed meats are used in lunches, which feature veggies and fruit.

No needy children will go hungry if they do not live at a PHA site offering the program. They can go to a neighboring site to receive a good meal or PHA will refer them to a City Dept. Of Recreation site that offers similar meals.

This way, parents and children don’t have to travel too far to take part in the program. Over 50,000 meals were provided to low-income children throughout the city last year.

The 19 sites for Summer 2010 are: Abbottsford, Arch, Bartram, Blumberg, Cambridge (JF Street), Champlost, Fairhill, Haddington, Harrison, Hillcreek, Johnson, Morton, Norris, Oxford, Queen Lane, Raymond Rosen, Spring Garden and West Park, Whitehall.

Of Education and the United States Dept. Of Agriculture makes the program possible.

Village, will debut their sixth venture, Barbuzzo, a Mediterranean kitchen and bar, at 110 S. 13th St. in about two weeks.

With a wood-burning oven for pizzas and roasting, and decorative elements such as Italian marble and reclaimed woods, Barbuzzo will evoke the atmosphere of a Mediterranean farmhouse. For Turney and Safran, Barbuzzo will be the first of their restaurants to have a liquor license, and joins BYOBs Lolita and Bindi, as well as their gourmet prepared-food market, Grocery, and two boutiques, Open House and Verde.

City Council Wants RDA ‘Movement’ The 17-0 resolution followed two days of testimony before the Councilwoman’s Committee on Housing, Neighborhood Development and the Homeless in which local developers with ready-to-go projects testified the RDA is placing them in default and recalling property they had purchased.

Both the University City Science Center and Klein Properties are engaged in legal proceedings against the RDA that would enable them to move forward with projects that will bring hundreds of jobs to the City. Klein Properties has an

agreement with the Church of the Latter Day Saints (Mormons) to build a temple at 17th & Vine.

Many smaller projects, including those for affordable housing, have also been put on hiatus because of the RDA crackdown.

“That is the kind of cooperation that the Council wants,” said Blackwell. “The RDA should evaluate these projects on the basis of their contribution to the City – not send out blanket default letters without knowing what kind of projects are actually in motion.”

The Redevelopment Authority has been moving at a snail’s pass on needed new city developments according to Councilwoman Jannie Blackwell.

Under her sponsorship, City Council unanimously passed a resolution calling for the City’s Redevelopment Authority to honor its commitment to work with Council “in the spirit of transparency and cooperation” to end the current backlog.

We have projects both great and small that are ready to be built,” Councilwoman Blackwell said. “These are not ordinary times. The RDA has to understand that it can take time to put together a real estate project and get financing.

“Yet, here, we have one project that would build a beautiful church on our Parkway, and another project from a world-class urban-research park. Both would bring jobs and visitors to our City. I think the RDA needs to take a closer look and take a more pragmatic approach to managing these parcels of land.”

If you haven’t, please allow me to direct you to Rolling Stone magazine’s profile of Gen. Stanley McChrystal, the commander of our forces in Afghanistan.

In this article, the General lets it all hang out when it comes to his feelings on President Barack Obama, Vice President Joe Biden and the rest of the civilian structure that signs his checks, or as he calls them, the Wimps in the White House.

This article has some doozies in it. For example, here’s an exchange between the General and an aide regarding Vice President Biden: “Are you asking about Vice President Biden?” McChrystal says with a laugh. “Who’s that?” “Biden?” suggests a top adviser. “Did you say: Bite Me?” Reporter Michael Hastings gives us the whole skinny on McChrystal, who was kind of a hellraiser during his time at West Point and throughout his military career. We also find out through this article that McChrystal is the same guy who helped create the narrative that former NFL Safety Pat Tillman had died in a hail of enemy fire in Afghanistan instead of the “friendly fire” of his own fellow troops, a narrative the Bush Administration trotted out to whitewash the case.

And this is the guy that has the keys to the bus that is our policy in Afghanistan?

But my guess is it’s a job that no one else applied for. I mean, who would want to be the person in charge of the latest quagmire the United States has gotten itself into? It is that reality that probably made Gen. McChrystal feel empowered enough to refer to National Security Advisor Jim Jones as a “clown” and to say in front of a reporter he doesn’t “even want to open the email” he receives from Special Representative to Afghanistan Richard Holbrooke.

What I can’t understand is why McChrystal wasn’t being made to figure out the wheres and hows of civilian life by Monday morning.

I say this because I know for a fact that if a non-commissioned officer, meaning an officer who enlisted in the military without the kind of commission that comes with going to West Point, a stint in the Reserve Officers Training Corps, or some other post-high-school education, had said the things McChrystal said to Rolling Stone about the folks in the White House to any news organization, he or she would lose a stripe and would be peeling potatoes for six months before being forced out with a dishonorable discharge.

However, they are past masters of persuading people who do own boats to give them free rides on weekends.

The Irish equivalent to the Holocaust was “An Gorta Mór”, which translates to “The Great Hunger”. This was a period in the 1800s which ran for five years, during which the potato crop failed and a famine followed. Over a million Irish were allowed to die because of the indifference and neglect of the British government which ruled Ireland at the time.

That occasion was observed at the Irish Hunger Memorial in New York under the sponsorship of the Counsel General of Ireland NIALL BURGESS. In attendance was Ireland’s PRESIDENT MARY McALEESE. To catch your favorite pol these days, take a stroll around Angelsea in North Wildwood. Many can be seen meeting and greeting at Keenan’s and at the Pointe, where the breezes waft in from the ocean. In fact, several major political events are planned in that seaside community this summer.

Yo! Here we go again with this fond memory of Mary Jane. I was traveling with my friend Jerry on a trip to Erie, Pa. and Jerry had brought a bag of them to snack on during the trip. Just the sight of the yellow and red wrapper brought back some great memories. I decided to get some facts on Mary Jane candy. So off to the trusty internet I went, to gather some facts for those who do not know about Mary Jane.

Mary Jane candy is 90 years old and still going strong. In 1914, Charles N. Miller named this bite-size peanut-butterand-molasses candy for his favorite aunt, Mary Jane. Over the years the company has tried out variations on the basic molasses and peanut-butter flavor, but none could compare to the original Mary Jane.

I remember when I was a very young there was a little corner candy store called Nick’s, but which was always referred to as Pabees. This little store was operated by a very friendly family who always catered to the kids in the neighborhood. They always had Mary Jane candy in the store and I think they cost two or three for a penny. After collecting an empty soda bottle or two, we took them to Nick’s and traded the deposit for some Mary Janes. It was always such a treat.

All it took was one Mary Jane and I knew I had found a new favorite. I ate them every time I could and that is how my mom got me to clean my room, brush my teeth, eat my dinner and all the other things that kids don’t like to do. I still love my Mary Janes and I would probably clean my room for a few Mary Janes to this day.

You know, that candy store right on the corner still reminds me of Mary Janes. I chuckle every time I think about (Cont. Page 18)

Legislative Roundup O’Brien, Boyle Pay Tribute To Firefighters State Reps. Dennis O’Brien and Brendan Boyle introduced two resolutions in the Pennsylvania House of Representatives in honor of firefighters who have lost their lives, and their survivors.

A resolution declaring a week in June for “Fallen Firefighters Survivors” in Pennsylvania was passed unanimously.

“Firefighters bravely put their lives at risk with each response to duty,” said O’Brien.

“We can honor those who made such a tremendous sacrifice by recognizing their courage and supporting those they have left behind.”

“These resolutions are meant to honor fallen first responders and their families,” Boyle said.

Also passing unanimously was a condolence resolution introduced by O’Brien to honor Capt. Lawrence J. McDonald.

McDonald was a retired captain of the Philadelphia Fire Dept. who tragically passed away in April.

Governor To Sign Tartaglione Bill A bill sponsored by Sen. Christine M. Tartaglione, intended to address a chronic shortage of nurses and other health providers, is now on its way to the Governor, having passed both chambers.

“We need to produce the next generation of health-care workers because we have a historically large next generation of seniors,” Tartaglione said. “Understaffing and overworking health care workers affects more than just their quality of life. It affects patient safety and outcomes as well.

Tartaglione’s legislation, SB 174, passed the Senate last month and was approved 165-

33in the House. The bill will create “The Pennsylvania Center for Health Careers” within the state’s Department of Labor and Industry.

The center will focus on increasing the capacity of nursing education, retaining health-care workers, increasing diversity and training new critical care workers.

Rep. Ron Waters Awards 3 Essayists State Rep. Ronald G. Waters, chairman of the Pennsylvania Legislative Black Caucus and a member of the House Judiciary Committee, acknowledged the winners of his “There Ought to be a Law” essay contest on the House floor.

Waters said the purpose of the contest is to allow students in Philadelphia schools to express their views on issues they feel lawmakers should consider addressing through legislation.

The winner, Jazmine Mitchell, and first runner-up Kian Pulliam are both from William C. Bryant School.

Mitchell advocated for the immediate removal and protection of children from the homes of foster-care parents who the children say have abused them. In Pulliam’s essay, he said it should be illegal for parents to leave children younger than 14 at home alone.

Second runner-up Jada Blanche DuBose, and third runner-up Yarnell Kamokai both attend South West Leadership Academy Charter School. DuBose said she believes Pennsylvania should make it easier for ex-convicts to obtain jobs upon their release from prison by requiring one month's supervision of that individual on his job. She

Stack Divestment Bill To Become Law State Rep. Babette Josephs and State Sen. Mike Stack applauded the unanimous House passage of Stack's legislation that would require the Commonwealth to pull its state pension investments out of companies that do business in the energy and military equipment sectors with the governments of Iran and Sudan.

The House passed SB 928 by a vote of 200-0. It now goes to the Governor for his signature.

“In Nazi Germany, it was the government doing the persecuting,” Josephs said. “The government perpetuated genocide and terrorism against its people. Now, thanks to the bipartisan support in the General Assembly, Pennsylvania is actively working to prevent these kinds of atrocities. Divesting from terror and genocide is a fiscally sound public policy and it is the right thing to do,” Josephs said.

“I am happy to be part of a government where all sides agree that genocide should never happen again,” Stack said. “I am glad I was able to forge an agreement in order to see this bill gain passage in

both chambers and reach the Governor’s desk.”

Specifically, the bill would require the withholding of Pennsylvania’s pension fund investments in the Public Employees’ Retirement System, State Employees’ Retirement System and Pennsylvania Municipal Retirement System from foreign companies in the energy and military equipment sectors that are helping the Sudanese government continue genocide and the Iranian government sponsor terrorism. The bill would also put the same restrictions on the State Treasurer’s Office.

Josephs said that this bill is similar to a bill she authored and the House passed in 2007.

At that time, the Senate failed to consider the legislation, but she has been working with Stack to get the legislation passed.

The bill received bipartisan support in the Senate and unanimous support in the House, including from the State Government Committee of which Josephs is chairwoman.

“While as public officials many of us do not have the expertise to understand all the technical details that make up a prudent investment policy, it is clear from the recent global financial-market collapse that policymakers must supply guidance to the technocrats. The citizens know this. They look to elected officials when things go wrong,” Josephs said. “We are accountable to the voters and taxpayers, and we must be the ones to set policy.”

Stack agreed, “Companies that choose to conduct business with nations that sponsor terrorism or murder their own people should not be sup-

ported by Pennsylvania tax dollars. This is a morally, fiscally, responsible and reasonable way for Pennsylvania to combat terrorism and genocide,” he said.

Currently, 28 states have either passed divestment laws or divested from Iran, Sudan or both through executive orders.

Getting Government Fingers Out Of Pie Good news for the sponsors everywhere of cake and pie sales. The Pie Bill is expected to become law in Pennsylvania. It’s a bill designed to keep government bureaucrats’ fingers out of the community pie and cake sales that bloom up this time of year.

State Sen. Elder Vogel’s legislation barring the State from citing community groups for selling home-made baked goods received final legislative approval in the Senate and Gov. Rendell is expected to sign the measure into law.

SB 828, known as the “Pie Bill”, will eliminate the ability of the Dept. of Agriculture to cite nonprofit community

groups such as volunteer fire companies, churches, and school booster clubs for selling non-hazardous homebaked food at fundraisers.

Vogel introduced the bill after the Dept. of Agriculture cited a local church for selling homemade baked goods prepared by ladies of the church at a Lenten fish fry.

It may be time for the City’s health inspectors to take heed as well.

Grand Jury Disses Caucus System A State grand jury investigating the “Bonusgate” scandal recommends the dismantling of the entrenched party caucus system that runs the Legislature. The 23-member grand jury calls for a wide range of reforms to the legislative branch, including reverting to the part-time body it was four decades ago and ending perdiem payments for lawmakers that don't require receipts.

But the anonymous members of the grand jury leveled their harshest criticism in a 34-page report against the legislative caucuses.

PGW Names Chief of Staff The Philadelphia Gas Works has named Charles J. Grant the company’s new Chief of Staff. Grant, a 30year resident, will focus on labor issues and external affairs. He will be reporting directly to Craig White, PGW’s executive VP and acting COO. “We’re excited to have Joey, as he likes to be called, join the PGW family,” said White. “His labor experience and knowledge of the city will be invaluable to us as we continue to improve the company’s
