Sheriff’s Office: More Than Another Real-Estate Biz

by Joe Shaheeli If a nonprofit, dependent on heavy contributors, believes it can remain independent of the influence of those benefactors, then its officers are living in la-la land.

They’d soon be out of business if they failed to consider the business needs of their chief supporters.

The Committee of 70 knows which side its bread is buttered on. Its heavy contributors are banks and law firms deeply involved in the commerce of real estate.

They’ve been rebuffed on more than one occasion of making a killing in Sheriff sales, however, because the Sheriff has rules.

These include opening Sheriff sales to everyone in this city, whether it be a newly arrived legal immigrant, a one-man contracting firm looking to rehabilitate a shell, or family looking for its first home.

Before Sheriff John Green

took over the office, Sheriff sales were attended mostly by lawyers who were representing banks foreclosing on properties. There were many buildings up for auction, but often fewer than two score bidders in attendance. Sheriff sales were a closed club. If you bid as an outsider, you learned quickly you couldn’t buy the property more cheaply than the mortgage it held. A bank lawyer would pop $200 above your last bid.

Under Green, Sheriff sales attract huge crowds. If you attend one, you will see a crosssection of every kind of citizen in this city. The Sheriff has successfully reached out to all Philadelphians to make opportunities for them.

So what does the Sheriff do, in addition to these sales, that makes the Committee of 70 believe its major crusade for “reform and good government” is to get rid of the Sheriff and his posse?

Butkovitz Finds Solar Trashcan’s Cotract Is Hard To Swallow City Controller Alan Butkovitz released a BigBelly Solar Compactors report that found questionable business practices with the City purchasing 768 high-tech trash cans, costing almost $3 million.

All compactors, costing $3,700 each, were purchased through a sole-source contract in which the Streets Dept. contacted only onedistributor, BigBelly Solar, and awarded the company an initial $2.1 million contract. Since the initial purchase of 500 compactors, the City purchased an additional 268 compactors for an added cost of $991,600.

“The single-source contract raises serious questions due to the $3,700 cost per unit, in comparison to the $100 wire baskets that were replaced,” said Butkovitz.

“The City also awarded the contract to BigBelly Solar in spite of their not having a required business-privilege license.”

One claim made by BigBelly Solar was a 70% weekly reduc-

tion and corresponding savings in cost would be realized.

During a two-month period, the Controller’s staff monitored BigBelly compactors and found there was an average of 10 compactor collections per week. This is more than double the amount predicted by BigBelly Solar, which were five collections.

“The City failed to consider numerous areas where savings may not materialize,” said Butkovitz. “It failed to consider the cost to replace a damaged unit, as well as the number of trained personnel and time it takes to maintain these highly complex units.”

“There is a complete lack of accountability for these expensive trash cans,” said Butkovitz. “There weren’t even property tags on the units that would identify and track damaged or deployed units.”

Before any additional BigBelly units are purchased and/or deployed, the Controller recommends the following: • Prepare a cost analysis

that courtroom decided to call it a day. With many judges, that means longer-thannormal hours.

Nevertheless, the Sheriff did take a look at his overtime and initiated a new overtimereduction plan, saving $150,000 so far. It is on pace to cut overtime cost by more than the 25% requested by the City administration.

He has done this by serving notice on judges to use any opportunity that arises to cut court time. The plan, now in place, reduces the number of deputies assigned to Family Court. Green has started a second shift for Traffic Court, which has evening hours, and staggered starting times for deputies to accompany varying courtroom schedules. The Sheriff will also rotate deputies on an as-needed basis to prisoner transportation, to allow for the expedited return of detainees to various prisons.

The earlier schedule had been put into effect two years ago by the Sheriff in response to overcrowding in Philadelphia prisons, enabling the Sheriff to transport large numbers of defendants to more courtrooms.

Managing other folks’ offices isn’t sexy, however, and tends not to grab headlines.

To ensure it gets the biggest propaganda response from its efforts to eliminate this essential branch of government, the Committee of 70 depends on others to spread its misinformation further in the press.

Misinformation Via Flunky Take, for example, an article by John Kromer, which appeared in the Inquirer’s opinion pages on Jun. 22.

Kromer has a pedigree of sorts. He is a former director of the Office of Housing & Community Development.

Currently, he is on the faculty of the University of Pennsylvania’s Fels Institute of Government. In his article, he claims he is not taking sides as to elimination of this office, but he incorrectly and wrongly blames the Sheriff for the delinquent properties that should have been pressed into the Sheriff sales.

Anxious to do the Committee of 70’s bidding, the Philadelphia Inquirer’s editorial department came up with a picture of a couple of dilapidated, boarded-up houses on Montrose Street, one of them supposedly 2130 Montrose Street in South Philadelphia.

Kromer, blaming “the flawed tax-collection system,” claimed that house was purchased in 1986 by a development corporation that now “owes the City nearly $16,000 in taxes.” The blame for that should go directly to the City’s Revenue Dept., for not consigning that property to the Sheriff for sale. It is an upcoming neighborhood, with ready takers.

Unfortunately, or on purpose, the Inquirer picture in Kromer’s article was not that of the property he questioned.

The correct picture is shown in this article. Not only was the property wrong, but Kromer’s 2130 Montrose Street is under the control of the Office of Housing & Community Development – his alma mater.

Whoever is to blame, either the Inquirer or its photographer, Kromer should have called some of his former employees to get the facts straight. Kromer’s history of new housing starts, or of rehabbing houses to enable poor families to move into them, is weak . Much of his history in that office purportedly concentrated on working with developers.

How can he or the Committee of 70 blame the Sheriff for other departments’ vacant properties? The Sheriff does not have the power to confiscate them, only to sell at his monthly sales those properties handed over to him by the City, or by banks and mortgage companies.

Yet Kromer had the audacity to write to Sheriff Green on Jun. 21 to “request his support to organize a team to undertake this project to raise from non-municipal sources the funding needed to complete ... a detailed transition plan to close out the Sheriff’s office.”

Green Party Candidate Gets A Dem’s Backing

political experience and union connections. He has been working the District, which encompasses Roxborough and Manayunk along with parts of Lower Merion Township and Wynnefield, ever since the winter.

The 194th is a Democrat District. In 2008, Manderino beat a little-known Republican named Thomas Rolland there by about 75%-25%.

But the Dems are still split from their bruising primary, giving Giordano his opening.

Over the weekend, Giordano received the support and endorsement of former Democratic Primary candidate Bill Morris.

The two men came together at Gorgas Park in Roxborough with their supporters to make the endorsement official. Even though it was raining, the group was pumped.

“I sat back and thought hard about who is the best candidate to represent this District in Harrisburg,” said Morris. “At the end of the day, I feel Hugh is the best candidate.” Morris, a union carpenter, thinks Giordano, a union organizer, understands the issues of working people and the middle class and will stand by them against the corporate executives that control Harrisburg.

Morris specifically had DeLissio in mind. The Democrat candidate was formerly CEO of Kearsley Retirement Community in Wynnefield and has a long small-business résumé.

With that in mind, Giordano has fashioned a platform heavy on lunch-pail economic issues. “I will

stand up against corporate greed and lobbyists who control Harrisburg and fight to make sure that public schools are funded, good-paying jobs are created, single-payer health-care is initiated, workers’ rights are strengthened, and our environment is protected,” he said.

In addition to his own local, Giordano has gotten the backing of Teamster Local 77 and Ironworkers Local 405.

He is vigorously pursuing others. In largely bluecollar Roxborough, which dominates the District, union support can make a difference.

Giordano praised Morris on having the courage to stand up and do what’s right.

“Bill deserves a lot of credit and respect, because he is standing up for his community and District and is not controlled or intimidated by a party,” said Giordano. “He is a true champion of the people.”

On the failures and corruption of the Democratic and Republican Parties, Giordano said, “The Democrats

and Republicans have failed the people. They are controlled by CEOs, corporate consultants, and corporate attorneys.” Giordano thinks voters have given both major parties plenty of chances to represent them and are frustrated with what they’ve gotten in return.

Are they frustrated enough to vote for a thirdparty candidate? Giordano’s chances rest on some cagey math. No longer facing a popular incumbent, and buoyed by national voter backlash against Democrats, Republican Downey should push his vote share well over 30% in the fall. If Democrats stay split, and Giordano can work the splitters, he may pull from independents as well as disaffected Party faithful, only 30% of whom voted for DeLissio.

“If you vote for the twoparty system again, you are throwing your vote away.

You are wasting your vote” said Giordano. “It’s time to put your vote to good use.”

Corbett told Pennsylvania Public Radio last week, “People don’t want to come back to work while they still have unemployment. They’re literally telling – I’ll come back to work when the unemployment runs out. That’s becoming a problem. The jobs are there….”

Ever since, Corbett has been trying to unsay those words. But Onorato won’t let him. Across the state, 591,000 Pennsylvanians are out of work. The average person on unemployment receives $310 per week in benefits to put food on the table and keep a roof over their family’s heads.

“This is a fundamental difference between me and my opponent, and I don’t know what world Tom Corbett is living in,” Onorato said. “Our economy is struggling, families in Pennsylvania are hurting, and Harrisburg insiders like Tom Corbett aren’t doing anything to help them. Tom Corbett doesn’t even recognize there’s a problem, so it’s no surprise that he has no real plan to improve our economy or actually create the jobs that, in his mind already exist.”

Union organizers and other Democrat campaign workers have been backing up this attack with rallies on that theme.

While the average voter may not be following the Senate race closely, business never takes a vacation. Small-business interests are busy assessing their political choices during the summer. A candidate who makes a strong impact as business-firendly can gain crucial financial support in time for the fall drive on ordinary voters.

“We’re talking four months before an election. To go with that type of an advertising onslaught is showing a sign of strength,” Borick said. “Voters have now heard a little about you, it’s starting to break into their consciousness.”

One ad starts with ominous music and pictures of Speaker of the House Nancy Pelosi and Senate Majority Leader Harry Reid. A voiceover says, “Want to stop the extreme spending from Washington’s one-party rule?” Then the music becomes more upbeat as video footage shows Toomey walking beside an elderly couple and Toomey sitting at a table with construction workers. A voiceover says, “Pat Toomey’s been called a ‘taxpayer hero’.”The other four focus on Sestak. They each end with: “That’s liberal. That’s Joe Sestak.”

The ads take on Sestak for saying he would have supported the $787 billion stimulus package even if it had cost $1 trillion, and for voting for a cap and trade plan Toomey believes will result in increased gas prices and cost Pennsylvania jobs.

The ad also criticizes Sestak for his vote on the health-care reform bill and says that he voted to “permit banning all private health insurance” during a committee markup of the bill.

Avoiding a tough primary challenge allowed US Senate candidate Pat Toomey to collect campaign donations all year and then sit back and patiently wait his turn.

Now that his turn has come, Toomey, a Republican from Zionsville, can spare large sums on a massive televisionad buy four months before the November General Election.

Like a warning shot to his Democratic opponent, Congressman Joe Sestak, Toomey began airing five new television commercials Wednesday in every television market for an “indefinite” amount of time.

The ads are quick hits, running less than 20 seconds. Four of them focus on Sestak’s votes, each taking on a different policies: the economic stimulus, health-care reform, cap and trade, and tax increases, and a fifth one taking on the Democrats in power.

A sixth biographic ad of Toomey, running a little more than 30 seconds, is also re-airing. It first aired in the days leading up to the May primary as a way for Toomey to introduce himself to voters when all the attention was focused on the Democratic battle between Sestak and Sen. Arlen Specter.

Toomey broke a new fundraising record for the second quarter of 2010 and outraised his opponent Sestak by over $1 million. Toomey raised $3.1 million and the campaign has $4.65 million cash on hand. Since Toomey’s announcement of his candidacy in April 2009, he has raised $10.3 million from over 54,000 contributors. He outraised his previous first-quarter fundraising record by $800,000.

While Toomey benefits from this huge war chest, Sestak’s name has been all over the national media.

Sestak, of Delaware Co, beat an iconic political figure and then became entangled in a White House brouhaha over whether he was offered a job in the Obama administration in exchange for bowing out of the Senate race.

2 Parkway Landmarks Win Federal Grants Congressman Chaka Fattah announced two of Philadelphia’s outstanding institutions on the Benjamin Franklin Parkway at Logan Circle have been awarded matching competitive Federal grants under the Museums for America program.

The Moore College of Art and Design will receive a $79,138 grant – and provide a match of $81,474 – so its galleries can introduce photographer Wendy Ewald’s nationally acclaimed “Literacy Through Photography” work to Philadelphia through exhibitions and public programs. The grant also will support Moore College’s partnership with the School District of Philadelphia in 2010-11 for the “Arts Rising” program to improve literacy and arts access for school-age children.

The Academy of Natural Sciences of Philadelphia has been granted $149,974 to create a digital index for its world-renowned collection of 4 million insect specimens dating to the early 1800s.

The program, which includes a $150,000 match from the Academy, will enable researchers everywhere to submit online queries to the Entomology Collection and determine the usefulness of their own specimens in on-going research projects.

“The Parkway is our gateway to culture, learning and enrichment for Philadelphians and visitors, and supporting these two fine institutions is an excellent use of our nation’s cultural resources,” said the Congressman. “I extend congratulations to the Academy of Natural Sciences and Moore College for these innovative proposals that have risen to the top in national competition. These will be dollars well spent.”

The competitive grants are provided by the Institute of Museum and Library Services through its Museums for America program.

The Institute has selected for funding about one-third of the 510 applications it received nationwide.

Everyone has a mom, and maybe by sharing our story and talking about what we do, we can somehow reach the young men,” said Speight, who walked with some 20 members.

Waters described the walk as “peaceful and not confrontational,” stating, “Sometimes walks are reactionary.

Something bad happens and so you want to go out and march, protest or make demands. Why should we have to meet people only under those conditions?”

Williams noted the walk was a walk of solidarity with the people of the community.

He viewed the walk as having a two-fold purpose: one, to show the senior citizens that their elected officials are not afraid to walk the streets and that they should not be either and, two, to show youth living negative lifestyles that they do have more-positive options.

Answer: A recent bankruptcy court decision held that the entire balance of a reverse mortgage could be paid off over the five-year life of a Chapter 13 plan. In this case, the debtor and her daughter had lived in the home belonging to the debtor’s mother for 40 years. When the debtor’s mother died, leaving the home to the debtor, the home was subject to a reverse mortgage

upon which $29,524.44 was owed. The reverse mortgage provided the entire balance was due and payable immediately upon the mother’s death.

According to the court, section 1322(c)(2) of the bankruptcy code allowed the payment over five years of any mortgage upon which the last payment came due prior to the date of the last Chapter 13 plan payment. This section allowed the debtor to modify the terms of the reverse mortgage, extending it over five years.

Why Won’t ‘70’ Hand Complaints To Commission?

One must realize Stalberg and his ‘70’ acolytes have proven themselves to be well versed in subterfuge, and show a cynical and convenient lack of understanding of what is mandated by Federal and State election laws.

To make this point, at an open public meeting, one of Stalberg’s followers made a statement regarding their Election-Day complaint hotline. When the Commission asked for those complaints the Committee of 70 had said it had received, Stalberg, through his follower, would not release them to the Commission. The City Commissioners have repeatedly done so at numerous open public meetings. The City Commissioners have asked for them so they could be investigated

by the one arm of government that has the authority to do so.

The reasoning of the Committee of 70 was that it is a private organization which does not have to give anything to the Commission regarding Election Day complaints called into Stalberg’s 70 operation.

However, Stalberg’s Committee of 70 disciples stated on the record they were not finished with their “investigation” and “resolution” of the Election Day complaints. The Committee of 70 representative was challenged as to where in the Pennsylvania State Election Code do Stalberg and the Committee of 70 have any jurisdictional authority, investigative powers, or power to resolve or correct any election issue? That’s a question it has not yet answered.

It’s clear this “private organization” feels it is the Election Board, the District Attorney’s Office, and the Pennsylvania State Legislature, all wrapped up in one misguided, self-appointed authority.

We all know nongovernmental entities that throw as much crap on the wall as they

can, knowing how easy it is to confuse the populace. Continually bombarding and feeding the populace with falsehoods and misconceptions leads the populace to believe everything they hear. It is a shame the media in this city buy their charges without checking.

Stalberg and his Committee of 70 followers work well the technique, “Perception, not truth or fact, is the new reality”, and they play on the fact, “A lie will travel halfway around the world before the truth wakes up and puts its shoes on”. Just look at Shaheeli’s article in describing the Clerk of Quarter Sessions office’s downfall, and how Stalberg manipulated and used bits and pieces of the office’s problems in the press, to force its elimination.

If citizens would start to question the motives of organizations such as Stalberg’s Committee of 70, they would discover their agenda is all about taking choice away from the citizens, with promises of a better and leaner government. This template of elimination and consolidation causes more problems than solutions.

by Tim Dowling Joe Shaheeli’s article in the Public Record on Jul. 1 was an excellent exposé, uncovering Committee of 70 President Zachary Stalberg’s illusory rants as he seeks to do away with certain elective offices in Philadelphia. Finally people are starting to clearly see the agenda of Stalberg and his Committee of 70 society.

There is just one roadblock stopping him in his crusade, and that is a little thing called the “law”, a thing Stalberg and his acolytes try to ignore by using media thuggery and substituting, in place of the true facts, misrepresentations designed to benefit his crusade. As stated in the article, “Stalberg isn’t perturbed by his lack of understanding of the law.”

Summer political campaigns are like off-season sports.

Casual citizens aren’t watching; but players, teams and serious fans are carefully studying the shuffling and jockeying for position prior to Labor Day. In Pennsylvania’s gubernatorial race, both candidates – Democrat Dan Onorato and Republican Tom Corbett – have credible records of public service. Onorato is well-known in the Southwest, where he has led Allegheny Co., the state’s second-largest government, but he lacks statewide fame. Corbett has gained a measure of renown as Attorney General for prosecuting numerous legislators, but it’s the sort of fame that is tainted with suspicions of partisanship in the eyes of many voters.

Still, Corbett leads in early polls and he has a lot of money. With that in mind, his competitor is doing everything he can to boost the negatives in Corbett’s name recognition.

A gaffe last week, in which Corbett argued against extending unemployment compensation, charging the jobless are rejecting job offers from hungry employers because they’d rather live off a government check, gave Onorato just such an opening. Whether they’re at work or on vacation, even most Pennsylvanians who still have a job know better than that. Jobs are not that easy to find, and laziness has nothing to do with it. People didn’t suddenly turn lazier in September 2008; it was the economy, stupid.

Corbett has plenty of time and money to shrug off this issue. Look for Onorato to try his hardest not to let Corbett – and the public – forget it, though. It’s what he has to do.

Whoa! Trunk Man is still following up on last week’s column. I said the 2011 City Council race will be one for the ages; so far, we were right. Former Congressional candidate JOE McCOLGAN of the Northeast announced, in a letter to ward leaders, his intent to run for City Council at Large. His entrance in the race may be a rogue mission or a City Committee tactic. You see, McColgan is the son of CAMILLE McCOLGAN, aide to GOP City Commissioner JOE DUDA. The other bit of news comes to our call for more information on the rumors surrounding DENNY O’BRIEN. Trunk Man has it from a good source, from folks close to the long-time State Representative, that he is strongly considering the race. An O’Brien entrance into this likely open seat is sure to keep many out of the race, as his strong showing among Democrats and Republicans in his swing district would make him the front-runner.

Still no word from GEORGE KENNEY. Speaking of Kenney, announced candidate ELMER MONEY launched his campaign Facebook group. The group doubles as an antiGeorge Kenney page, with most of the posts attacking the former 170th District legislator. Does Money know something about Kenney’s intentions we don’t? Only time will tell.

Troubling news from the 40th Ward, whose Ward Leader for many a season, MIKE GALLAGHER, is ailing. What a character! Mike has more personality than any three Democrats put together. He started out in life as a motorcycle club member. Growing wise in the ways of the streets, he became an expert in Traffic Court affairs, steering many a citizen through its mazelike procedures. He ran for Traffic Court judge, and also for state rep against BOB DONATUCCI once. He owned a Republican Club in South(Cont. Page 16)

I never thought that I’d ever see myself write this, but I miss the Ride-A-Duck boats.

Prior to last week’s accident on the Delaware River, in which a City of Philadelphia garbage barge plowed into a disabled Ride-A-Duck boat, causing two people from a Hungarian exchange student program to drown and leading to the sidelining of Ride-A-Duck boats around the country by their Georgia-based parent company, I viewed the duck boats as a necessary annoyance needed to keep the tourists happy.

I still do if I’m honest with myself. There’s nothing quite so annoying as having to try and talk with someone at a South Street sidewalk café as a boatload of people armed with duck calls decide to blow them simultaneously.

But since tourism is a big part of how the city makes money, and we need lots and lots of money to close our evergrowing budget gap, we were grateful for the boats.

Still, there’s a lot about this incident I don’t quite understand.

For example, if you’re the Ride-A-Duck driver and you find yourself with an engine on fire, a boatload of rattled tourists, and a barge filled with trash coming your way, why are you going to call your office instead of 911? Are the folks from the office going to get there faster than the police? I don’t think so.

I also wondered how a barge and a tugboat could have missed seeing the Ride-A-Duck boat in the first place. Those things are hardly inconspicuous. If anyone should have seen it before mashing into it, it should have been the tugboat.

And help me out with how you can let a bunch of tourists (Cont. Page 16)

SNOOPER’S “SPECIAL MESSAGE”: This comes from two of my great friends. I told you last week about HON. RONALD MERRIWEATHER, Judge of Municipal Court, who passed away. This message comes from HON. JAMES DeLEON and HON. PETER ROGERS, both very close friends of the late Judge. The Judges want to THANK YOU personally for being so nice, by paying your respects to their friend. Both Judges told me some wonderful stories about their great friend, and what they told me really amazed me, especially how humane he was to fellow human beings. Thank God, I also got to meet this wonderful gentleman, and I must admit I was vey impressed with him. GOD BLESS HIM. SNOOPER’S PERSONAL COMMENTS: I must disagree with MAYOR NUTTER when he stated, “Philadelphia has THE BEST party and fireworks in The Country.” I don’t know how to tell you, Mr. Mayor, but two other cities had a better PARADE, a better PARTY and, without a doubt, the best FIREWORKS I have ever seen. I don’t know what this City paid for those fireworks, but I absolutely think WE are definitely entitled to some of that money back. They should have just set off the fireworks, without the music, because it had nothing to do with AMERICA. Yes Mr. Mayor, Philly did have quite a celebration, but please, it just wasn’t as great as you thought it was– no way. Roots and Goo-Goo Dolls – overhyped!

Yo! Here we go again with this mind-boggling question: What’s a trillion dollars? A trillion dollars is $1,000,000,000,000. That’s 12 zeroes to the left of the decimal point. A trillion is a million million dollars.

The US government spends more than the entire Gross Domestic Product of Australia, China and Spain combined. If you laid one-dollar bills end to end, you could make a chain that stretches from earth to the moon and back again 200 times before you ran out of dollar bills!

One trillion dollars would stretch nearly from the earth to the sun. A military jet flying at the speed of sound, reeling out a roll of dollar bills behind it, would take 14 years before it reeled out one trillion dollar bills.

What does one-trillion dollar look like? We’ll start with a $100 dollar bill, currently the largest US denomination in general circulation. Most everyone has seen them; slightly fewer have owned them. They are guaranteed to make friends wherever they go.

A packet of one hundred $100 bills is less than ½” thick and contains $10,000. It fits in your pocket easily and $1 million dollars (100 packets of $10,000) could be stuffed into a grocery bag.

While a measly $1 million looked a little unimpressive, $100 million is a little more respectable. It fits neatly on a standard pallet. We’ll start with one layer, 7 packets wide by 16 packets deep, with each packet being $10,000. Increase that to 90 layers and you have a stack 38.7” tall (plus 4” for the pallet) that is worth a little over $100,000,000 (one hundred million dollars).

CONTROLLER ALAN BUTKOVITZ is preparing for a run for Mayor. That’s the word in many political circles.

He’s got a sizable war chest to get started, and doesn’t seem to have a problem raising money. The only question is, will it be next year or further down the road? He’s a hard worker and is highly visible in a position that is difficult and taxing ... pun intended. JONATHAN SAIDEL also did a good job in that position; Butkovitz is taking it to the next level.

Speaking of Philly powerhouses and money, we can´t understand why some people seem to be against the idea of CONGRESSMAN CHAKA FATTAH becoming appropriations chair. Who in their right mind would want to deny Philadelphians such a benefit? Seniority never has mattered in these matters; check the facts on that. We’re already about to lose SEN. ARLEN SPECTER, who brought home the goods. It’s time to rally behind all of our folks who can make this region what we want!

A very fine judge passed from this life on Jun. 24, 2010, RONALD MERRIWEATHER. He had been ill for a few years. He was one of the outstanding judges on the Municipal bench.

The judge had a fascinating career. before being elected to the bench, he served two years with an Airborne Ranger Platoon as a First Lieutenant.

He enlisted with the Secret Service and was responsible for providing security for, among others, VP HUBERT HUMPHREY and Supreme Court JUSTICE THURGOOD MARSHALL. While hearing criminal cases in the Municipal Court, he was remembered for a famous quote where he was placing a defendant on probation, “If you come before me again, bring your sneakers and toothbrush.”

Honorary pallbearers included JAMES JONES, DR. MELVIN JACKSON, ALFRED McNICHOL, JEFFREY PADULLA, his colleague from the Municipal bench JUDGE PETER F. ROGERS and ROBERT RIDLEY. Interment was as Mt. Lawn Cemetery in Sharon Hill.

All Lights Go ‘Green’ CONGRESSMAN Chaka Fattah joined other officials yesterday to celebrate installation of the first of 55,000 energy-efficient LED green and yellow traffic lights across the city. Workmen on ladders at rear are installing the light at 52nd & Chestnut Streets in the heart of the 2nd Congressional Dist. The new “green” light program is funded with a portion of the $14.1 million Energy Efficiency and Conservation Block Grant awarded to the city. It will ultimately save the City $1 million a year in electricity costs. Fattah is a leading advocate and major sponsor of the EECBG program, with $3.2 billion appropriated nationally through the American Recovery & Reinvestment Act.

New University City Hotel Gets State Money

State Sen. Vincent Hughes announced today that Philadelphia Industrial Development Corp. will receive a $2 million low-interest State loan to build a Hilton Homewood Suites extended-stay hotel.

Hughes added the project is expected to generate local jobs and boost revenue in the University City neighborhood of Philadelphia.

“The 40th & Walnut Street area has been the focus of redevelopment planning initiatives here in Philadelphia for nearly 15 years,” Hughes said. “I am pleased that the State funding for this extended-stay hotel will be a huge boost for redevelopment in this area.”

Butkovitz Finds Solar Compactor’s Contract Hard To Swallow

The 110,000-square-foot, 10-story, 136-suite hotel represents the largest private investment in the West Philadelphia neighborhood west of 40th Street in decades. The hotel will be located at 4109 Walnut Street.

All compactors, costing $3,700 each, were purchased through a sole-source contract in which the Streets Department contacted only one BigBelly distributor, BigBelly Solar, and awarded the company an initial $2.1 million contract. Since the initial purchase of 500 compactors, the City purchased an additional 268 compactors for an added cost of $991,600.

The project is expected to create 34 permanent full-time jobs and roughly 350 temporary construction jobs.

The funding is from the Building PA funding program administered by the Commonwealth Financing Authority. The loan was approved during a CFA meeting last week.

Roebuck Confers On National Education Policy State Rep. Jim Roebuck, Chairman of the Pennsylvania House Education Committee, has been invited to join a select group of leading policymakers to attend the Council of State Governments’ Common Core State Standards and Policy Summit this afternoon and tomorrow in St. Petersburg, Florida.

The summit has been supported by the Bill & Melinda Gates Foundation. The goal of the summit is to inform and educate House and Senate Education Committee chairmen on the common standards, raise awareness on what implications the standards have for each state, and promote collaboration between state Boards of Education and departments of instruction as the initiative unfolds.

“The single-source contract raises serious questions due to the $3,700 cost per unit, in comparison to the $100 wire baskets that were replaced,” said Butkovitz. “The City also awarded the contract to BigBelly Solar in spite of their not having a required business-privilege license.”

During the Controller’s review, it was found BigBelly Solar provided false information to the City by stating it was the only source able to sell the product to the City.

According to Butkovitz, the City relied solely on the claims of BigBelly Solar without any other verification.

One of these claims included a report by BigBelly Solar and referenced by the City stating that a 70% weekly reduction and corresponding savings in cost would be realized.

During a two-month period, the Controller’s staff monitored BigBelly compactors and found there was an average of 10 compactor collections per week. This is more than double the amount predicted by BigBelly Solar, which were five collections.

“The City failed to consider numerous areas where savings may not materialize,” said Butkovitz. “It failed to consider the cost to replace a damaged unit, as well as the number of trained personnel and time it takes to maintain these highly complex units.”

Environmentalists See Ways To Tap Marcellus Shale Safely The Pennsylvania Environmental Council this released a report calling for swift action on new regulations and greater oversight of drilling and extraction of natural gas from the Marcellus Shale formation, a major gas field that lies deep beneath much of Pennsylvania.

Called “Developing the Marcellus Shale,” the report challenges State government and the natural-gas industry to adopt more-stringent standards for drilling and extraction to prevent the kind of environmental impacts that have occurred throughout Pennsylvania’s industrial past.

The report also includes a number of specific legislative and regulatory changes that PEC believes should be made to minimize the risk of accidents, environmental damage,and public health hazards stemming from drilling operations.

Among the recommendations called for in the PEC report include the creation of a Marcellus Shale Development Task Force, that would identify best practices in the industry and apply them to Marcellus Shale gas operations in Pennsylvania.

Additionally, PEC has called on the General Assembly to take the lead in requiring that any severance-tax revenues that are realized from the development of the Marcellus Shale be specifi-

cally directed to the management of this industry, its environmental impacts and its regulatory enforcement. The Rendell administration has estimated that a State severance tax on Marcellus Shale gas operations could generate more than $200 million per year for the Commonwealth.

“The Marcellus Shale is a once-in-a-generation energy and economic opportunity for Pennsylvania,” said PEC president Don Welsh. “We have a deep historical, political and fiduciary responsibility to get this right for the citizens of this Commonwealth, as well as future generations who will inherit the environment currently entrusted to us.”

The Marcellus Shale is a vast underground formation that contains an estimated 50year supply of natural gas beneath the surface of Pennsylvania. However, the nature of these gas reserves are such that unconventional extraction methods are needed, which have environmental risks affecting local groundwater supplies, land use, habitat, and a number of other adverse impacts. Current regulations on oil and gas drilling in Pennsylvania were put in place at a time when conventional extraction techniques were commonly used.

There are currently an estimated 1,500 Marcellus Shale gas wells in Pennsylvania and

industry officials predict an additional 35,000 to 50,000 more will be developed by 2030.

In the past year, Marcellus drilling operations have led to a number of accidents and reports of environmental contamination, including recent explosions at Marcellus drilling rigs in Penfield, Pa. and Moundsville, W. Va. This report takes aim at vulnerabilities in Pennsylvania’s gas-drilling and environmental protection laws that PEC says do not adequately address the extraordinary nature of the Marcellus Shale.

“The stakes in developing the Marcellus Shale – both economic and environmental – are far too great to take a ‘business-as-usual’ approach,” said John Walliser, PEC’s vice president of legal and governmental affairs. “There is broad consensus statewide that we have to do this right and the recommendations outlined in this report provide the starting point for doing just that.”

The Marcellus Shale is widely considered to be one of the largest unconventional onshore gas deposits in the world and holds great potential as an abundant fuel to help bridge the gap between today’s energy portfolio to a future supply that reflects a reduced dependence on foreign sources of energy.

Tens of thousands or more new jobs are expected to be created

over the next two decades, which will have a significant economic impact at both the local and state levels at a time when budget shortfalls are creating pressure to generate new sources of revenue.

“No one truly knows what the full extent of the local impacts from Marcellus Shale operations will be,” said PEC’s Walliser. “That’s why it’s critical to be mindful of the potential impacts and their associated costs now before drilling operations expand significantly. There’s no reason why everyone – the industry, the Commonwealth, communities, and land owners – can’t benefit from the development of this extraordinary resource, provided we take the proper steps at the beginning to ensure we don’t leave behind a legacy of environmental and economic destruction for future generations.”

Other recommendations in the PEC report include: • Adopting a set of best practices from other deepshale gas-producing states, such as Colorado, which require companies to submit more detailed information about their operations, but which also streamline the permitting process.

• More rigorous scrutiny in the permitting process, such as a two-tier drilling permit that would provide the Pennsylvania Dept. of

Environmental Protection with more-detailed information about a well site before drilling can begin.

Greater safeguards for private water supplies, which are the only available source of household drinking water for many rural families in Pennsylvania.

Providing greater authority to the DEP for the management of water withdrawal in large quantities, such as are needed for hydraulic fracturing in unconventional drilling.

Increase the frequency of inspections and monitoring of surface and ground water quality at and near gas well operations to detect any possible contamination.

Similarly, air-quality monitoring needs to be increased to assess the need for air emission-control systems as appropriate.

PEC recommends a stakeholders group be convened to create the structure of a trust-based alternative to the current bonding system to cover the cost of closing wells that have completed all production.

The Commonwealth should impose a temporary moratorium on the leasing of additional State Forest land (i.e. the moratorium should not affect existing, valid leases) until a com-

prehensive environmental and community-impact assessment can be completed.

• Pennsylvania State government should proactively work with the natural gas industry and mineral rights owners to address concerns relating to natural-gas extraction under State Park lands. Factoring in sitespecific considerations, the State and industry should design best management practices to avoid unnecessary or adverse impacts to the State Parks.

The PEC report is based on the proceedings of a twoday Marcellus Shale Policy Conference held in Pittsburgh in May. This conference convened experts, industry executives, community leaders and government officials to explore the specific challenges associated with this industry and how other states have responded.

PATCO Studying New Light Rail Light-rail service linking Center City Philadelphia with the Waterfront may be only a few years away.

The backdrop for Chef Levin’s food will be equal parts library and laboratory, designed to reflect the casualyet-refined esthetic of his

Consultant Kelly Becherer and designer Michele Nettles collaborated with Vivekananthan and outfitted the 46-seat space with a host of antiques, including beakers, microscopes, books and typewriters. (You might think you’d walked into an episode of the TV show “Antiques Roadshow” instead of a restaurant.)

Custom red oak woodworking anchors the underlit and backlit bar, while all tabletops are reclaimed dark gray soapstone from a highschool science lab. An eightfoot countertop near the bar offers drinking space overlooking Bainbridge Street and the restaurant’s 20 outdoor seats.

“Chef Levin is something of a mad scientist in the kitchen, and we wanted the look of our restaurant to reflect that spirit of discovery and creativity,” said Vivekananthan. “Instead of a formal dining room, Adsum feels more like a comfortable

Chef Levin went into the stratosphere for local “foodies” when he became one of the few chefs ever to receive a “Four Bells: Excellent” review from The Philadelphia Inquirer’s acerbic restaurant critic, Craig LaBan, during Levin’s tenure at Lacroix at the Rittenhouse.

Adsum (pronounced “ahdSOOM”; it’s Latin for “I am here”) will be Levin’s first time as a chef-owner. “I’ve dreamed for years about opening my own restaurant,” he said last week, “and I couldn’t be happier to debut Adsum here in my hometown of Philadelphia.”

On May 31, 2009, the life of Peter Lyde, Jr., 25, was senselessly taken as he worked security at a Ridge Avenue bar.

Two men began arguing over a bar seat that escalated into their each pulling guns. As they shot at each other, a stray bullet hit Lyde, who was standing in the doorway.

was not Evans, but the other man, who fired the bullet that killed Lyde. A $25,000 dollar reward has been offered for information leading to the arrest of this man, who remains unidentified and at large.

The Frazier-Lyde family lost their loved one over a barstool and we have to make sure this person is brought to justice.
