Heard on the Hill / in City Hall Hughes Slams Republicans’ Tying Ed Funds To LCB Sen. Vincent Hughes (DW. Phila.) released the following statement in response to Pennsylvania House Speaker Mike Turzai’s recent comments on state budget negotiations: “I am disappointed by recent comments made by Turzai, who once again tried to link the issue of education funding to the privatization of our highly profitable state liquor-store system.

“Republicans refuse to seriously address education funding or property-tax relief, two of the most-important issues. We know test scores are dropping, critical educational programs are being cut, and over 20,000 public-school employees have been laid off across the state. It’s unacceptable to hold our schoolchildren hostage for an ideological agenda that is a bad deal for the people of Pennsylvania.

Republicans simply cannot run from the basic fact that education funding is the top priority for the people of Pennsylvania.

“It’s also a complete fantasy that there are Democratic votes in the Senate to override Gov. Wolf’s veto of the phony Republican budget. Senate Democrats stand united to fight for a state budget that fully funds the needs of Pennsylvania, including public education.

The Republican budget fails that test by only providing $8 million in additional funding for public schools.

“It’s time for Republicans to come back to the negotiating table and start talking compromise. Together, we can find a path to a state budget that addresses the many needs of Pennsylvania in a way that works for the entire Commonwealth. How-

ever, that agreement must include significant new dollars for public education to win any Democratic votes.”

Hughes is the Democratic Chairman of the Senate Appropriations Committee.

Sabatina Urges Senate To Preserve Veterans’ Bonus State Sen. John Sabatina (D-Northeast) joined Pennsylvania’s Dept. of Military & Veterans Affairs in calling for the Senate to reconvene in order to preserve a bonus program for veterans that will expire before the next scheduled session day.

“It is unthinkable that the door could close for thousands of veterans before they’ve applied for this benefit,” Sabatina said. “We have an obligation to taxpayers to complete the work before us and we have an obligation to veterans to do whatever we can to ensure they receive benefits they are due.”

The State House of Representatives voted to extend the Persian Gulf Veterans’ Bonus Program for three years before recessing in June but the Senate failed to vote on the bill and is not scheduled to be in session until Sep. 21.

Under current legislation, the program is scheduled to sunset on Aug. 31.

The bonus provides a onetime cash payment to eligible Pennsylvania veterans of the Persian Gulf War. Eligible Pennsylvania veterans served from Aug. 2, 1990 to Aug. 31, 1991 within the programdesignated Persian Gulf Conflict Theater of Operations.

More than 11,000 applications have been submitted to date, and 8,863 of those applicants have been awarded a bonus for a total of $3,652,513 awarded.”

Thomas Calls For Compromise State Rep. W. Curtis Thomas (D-N. Phila.), at a news conference gave an update to community members about the current state of the budget impasse, the funding issues health and human services providers soon will be facing, and his roadmap to a budget compromise.

Thomas explained federal services, including Medicare, won’t be affected during the impasse. Thomas also explained due to prudent financial maneuvers and better-than-anticipated revenue, the State should be able to continue funding human services providers until September.

“The situation we are in is a serious one, but at least it is good to know that childcare, health-care and humanservices providers in our state will, at least for the immediate future, be able to continue the vital work they do for the people of Pennsylvania. This is good news for those who depend on welfare, health care, drug and alcohol, or homelessness services in our state,” Thomas said. “However, any disruption in this lifeline that so many children, families and communities rely on would be tragic, which is why I am calling on my colleagues to get serious and begin negotiating with each other in good faith.”

Thomas continued that while the situation is serious, service providers would be in a much-worse situation if Gov. Tom Wolf had not vetoed the Republican-backed spending plan that was passed by the majority in the General Assembly last month.

Donatucci Praises Pittsburgh Council On Paid Sick Leave State Rep. Maria Do-

natucci (D-S. Phila.) has released the following statement in response to Pittsburgh City Council’s vote to require employers within the city to provide paid sick leave: “The affirmative vote by Pittsburgh City Council is certainly encouraging. Now that Pennsylvania’s two biggest cities are on their way to providing paid sick leave, we need to consider the hardworking Pennsylvanians in the rest of the commonwealth and extend paid sick leave statewide.

“Every day, Pennsylvanians are forced to decide whether to report to work sick, or risk losing their jobs by taking time off to care for themselves or an ill family member. It’s not fair to force people into making such a difficult decision, just as it’s not fair to have employees serving us food or doing business with us when they have strep throat or the flu.

“It’s time my colleagues seriously consider my HB 624, which would grant paid sick leave statewide. Businesses would see more loyal, productive employees, and our workforce would be healthier and better equipped to take care of their families in difficult times. Paid sick leave is a win for us all.

Controller Butkovitz Finds $110 Million Campaign Disclosure Law Water Bills Changed Without Authorization Includes Independent Groups City Controller Alan Butkovitz has found almost 130,000 water bills valued at $110 million were adjusted

by Water Revenue Bureau employees without authorization or dollar amount restrictions.

The bulk of the total value of adjusted accounts – $94 million – pertained to water accounts with balances over $1,000. These accounts represented almost 12,000 transactions.

More than half, 76,000, of the adjusted transactions were made to customers’ accounts with balances that were less than $100. These transactions represented $3.4 million of the total value.

“There were tens of thousands of water-customer accounts that had the potential to be inappropriately reduced,” said Butkovitz.

“With the average water bill at $75, these non-reviewed transactions add up to millions of dollars.”

Additionally, almost

12,000 of the total adjusted transactions pertained to water accounts with balances over $1,000. These transactions totaled $94 million and represented the bulk of the total value.

The non-reviewed adjustments were a result of the City’s water billing system, Basis2, lacking an electronic method for supervisors to authorize the adjustments. The WRB indicated that implementing this feature was not feasible, and instead created controls such as dollar limits for certain types of adjustments. However, not every adjustment is subject to these restrictions.

“There needs to be an efficient, technological system that provides the proper checks and balances,” said Butkovitz. “The City is leaving the door wide open for employees to make improper credit adjustments to customers’ accounts without detection.”

The WRB indicated it was

working diligently to identify and correct weaknesses in the water billing system after Controller Butkovitz raised this same finding in the FY2013 audit. However, the current audit disclosed there had been no improvement.

While the WRB had instituted a procedure requiring a review of quarterly credit adjustment reports to identify errors or improprieties, these reports were not always generated or reviewed in a timely fashion. The first two quarterly credit adjustment reports for FY2014 showed indications of supervisory review, but the third and fourth quarter reports contained no evidence of review.

According to Controller Butkovitz, the quarterly reviews need to pay particular attention to large dollar adjustments and instances of accountants performing multiple adjustments on the same customer account.

by Philadelphia Board of Ethics Executive Director Shane Creamer as they signed landmark campaign-disclosure legislation into law.

The legislation, Bill No. 150368, updates the Philadelphia Code to regulate campaign finance disclosures from non-candidate parties, such as nonprofit organizations, corporations, partnerships, and political-action committees.

The legislation, co-sponsored

by Council President Clarke and 9th Dist. Councilwoman Marian B. Tasco passed unanimously on Jun. 11, 2015, was drafted in cooperation with the Board of Ethics.

“Operating City government with the highest standards of ethics and integrity is one of the hallmarks of my Administration. Over the last seven years, we have accomplished a lot, but there is always more we can do,” said the Mayor. “This law will illuminate Philadelphia’s election process by expanding the reporting requirements for organizations that fundraise for the purpose of spending money on elections. Policymakers, the courts and the public have long recognized that the best way to check the potential influence of campaign dollars on the decisionmaking of elected officials is to require public disclosure. I applaud the Board of Ethics for addressing this ‘hidden’

aspect of our electoral process and thank City Council for passing this bill.”

Clarke said, “Public officeholders in Philadelphia are held to high transparency standards, and so should the people and organizations that help them win elections. When millions of dollars from anonymous wealthy individuals and powerful organizations comprise the majority of campaign expenditures, it’s no wonder so many Americans are skeptical of our political system.

The powerful and wealthy should abide by the same rules as everyone else who participates in elections. This law helps level the playing field in Philadelphia by requiring independent groups to disclose the source of their funding.”

Creamer said, “The Ethics Board commends Mayor Nutter and City Council, especially Council President Clarke, for passing and approving this important amendment to the City’s Campaign Finance Law. The new disclosure requirements will ensure that the public will be fully informed about who is spending money to influence City elections, as well as who is funding those efforts. This law puts Philadelphia in the vanguard of an effort to shed light on political spending by superPACs and nonprofits that have been spending millions of dollars nationwide to influence federal, state and local elections since the Supreme Court’s Citizens United deci-

Effective upon signing, the law requires non-candidate parties to file campaign finance reports every two weeks starting six weeks before an election. Disclosures regarding electioneering communications, such as TV ads paid for by non-candidate parties, also are required within 50 days of an election.

“The flood of undisclosed money since Citizens United has diminished the voices of individual voters and corroded our democracy. The City of Philadelphia today is placing another check on the wealthy and powerful who have become disproportionately influential in our politics,” Tasco said. “This law should be viewed as part of a larger strategy by individuals to reclaim our democracy, which includes reversing the methodical dilution of the Voting Rights Act by state legislatures, including Pennsylvania’s, over the past few decades.”

Though newly filled in a special election by former State Rep. John Sabatina, this senate seat comes up for a new term in the 2016 April primary.

56th Ward Leader John Sabatina, Sr. successfully used his powerful organization to help his son John, Jr. win the 174th Legislative Dist., and when that district found itself morphed into two districts, was able to keep his son in the seat while avoiding an all-out civil war. The other legislator, Ed Neilson, took on a vacant council-at-large seat and won it easily.

Now, he’s back to battling in the Aug. 11 special election for his old legislative seat is Neilson, having lost his council-at-large seat in this past primary election. His ballot position was untenable in that race.In the special election for State Senate in that same primary, Sabatina, Jr. was nominated by the Democratic leaders in the district and won easily, replacing Lt. Gov. Mike Stack who had held that seat – which comes up for reelection in the coming April primary. Sabatina needs to begin running again to win the seat again in the next primary.

Pa. Dems Adopt 2016 Delegate Plan The Pennsylvania Democratic Party has adopted its Delegate Selection Plan for the presidential election in 2016.

“This year the adoption process was more democratic than it has been in past years,” said Diane Bowman, executive director for the PDP. “We invited all 369 members of our committee to review the Plan over a period of more than 10 days and received feedback from over 60 percent who overwhelmingly supported the plan,” Bowman stated.

The Delegate Selection Plan has been forwarded to the Rules & Bylaws Committee of the Democratic National Committee to await final approval.

Absent any objections from the DNC, Pennsylvania Democrats plan on engaging in a robust outreach effort led by Outreach Dir. Prescott Harris and Affirmative Action Chair Roger Lund to ensure participants in the endorsement process accurately reflect reg-

Moody Knows Extent OF Our Pension Burden It’s official!

Moody’s credit rating shows our city has the largest pension burden in the nation.

Although it shouldn’t come as much of a surprise that Philadelphia has a significant pension burden, it might surprise some readers the City of Brotherly Love has the biggest burden (as a percentage of it operating budget) of any other major city in the nation.

Moody states $660.6 million of the city’s $3.7 billion operating budget is devoted to its pension fund.

Quinnipiac Poll Finds Dems Trump Trump With 20% of Republican voters, Donald Trump is the clear leader in the crowded Republican presidential primary field, but he trails any of three leading Democratic contenders by wide margins in general-election matchups, according to the latest Quinnipiac University poll.

who arrests such an illegal alien is the one who is treated as a criminal for violating the LAPD’s rule against enforcing immigration law.

These incidents are only a handful of a long list of Americans who have been killed by illegal criminal aliens, who often hadbeen deported more than once and often resided in “sanctuary cities.” The recent tragedy in San Francisco has now led illegal-alien supporters like Sens. Danielle Cruz, an illegal alien who kidnapped a nineyear-old girl in San Jose, Cal. in June 2003. He had been stopped and arrested by local police for numerous offenses but because of San Jose’s sanctuary policy, ICE was never contacted.

The New York City tragedy in December 2002 when a woman was raped in Queens Park would have been easily averted had it not been for a sanctuary policy.

The policy prevented the New York Police Dept. from contacting Immigration when three of the four rapists were previously arrested but then released to the streets rather than being turned over to federal authorities.

Also, Mohamed Atta, leader of the 911 hijackers, was stopped and ticketed for driving without a license in Florida in early 2001 at a time when his visa had expired. One of his accomplices, Ziad Jarrah, a Lebanese citizen suspected of piloting United Airlines Flight 93 that crashed in Pennsylvania, was pulled over on Sep. 9, 2001 by Maryland State Troopers for speeding in a rental car. Both of these individuals were released due to sanctuary policies. Had they been detained by local law enforcement and turned over to ICE, perhaps thousands of Americans would still be alive today.

In Los Angeles, dozens of members of the MS 13 gang have re-entered the country after having been deported for such crimes as murder, assault and drug trafficking.

Police officers there know who they are and that their mere presence in the country is a felony. Yet an officer

In 2014, I specifically directed Northampton County law enforcement and the county prison to continue to cooperate with Immigration Customs Enforcement by honoring detainers placed on foreign, illegal criminal aliens identified by ICE. Now, yet another American is dead at the hands of an illegal criminal alien who had seven felony convictions, was deported five times and was let go because San Francisco is a sanctuary city. Unfortunately, this is not the first nor will it be the last such incident until we fully secure our borders and stop providing all kinds of incentives and sanctuary for those who enter into the United States illegally.

The murder of a young woman in San Francisco is only the latest of hundreds of similar incidents. As recently as Jul. 7, a 29-year-old illegal immigrant who had been deported six times nearly killed an Arizona family in a car accident. On Jun. 26, a popular Oklahoma sportscaster was killed by an illegal immigrant who tested positive for cocaine at the time of a motorvehicle accident and who also had been deported on three previous occasions.

Let us also not forget that John Lee Malvo, the 16-yearold apprentice sniper who terrified the Washington, D.C. area some time ago was also an illegal alien that had been stopped, but not detained, because Washington state had a sanctuary policy.

McClinton Brings Passion For Justice

by Tony West A career in the criminal-justice system has whetted Joanna McClinton’s desire to right wrongs.

Her passion for uplifting her West Philadelphia community began early with her church life and education; led her to a career in the Public Defenders Association; then took her away to Harrisburg to craft policy for State Sen. Anthony Williams.

Now, if voters approve in the Aug. 11 special election, it may seat her as their representative in the 191st Legislative Dist., where she has lived her entire life.

“My decision to run is an extension of service, the fighting and hard work I have done in courtroom, church and community,” said McClinton.

Work as a public defender exposed McClinton to the crises

Joanna McClinton … passion for her community of ordinary families. It also confirmed her commitment to good education.

“During that time I learned and saw the inequalities in justice in our system and the law, and how the school system has failed our children. Childhood is a pipeline to prison when the schools aren’t funded properly,” she asserted.

Expungement of criminal records is a cause McClinton has taken to heart. She has coordinated Williams’ successful

expungement fairs, which have drawn 100 people at a time.

If McClinton wins on Aug. 11, she will report for duty on Capitol Hill the next day, where the House of Representatives is at war over the budget. School funding is a large part of this dispute; and no school district has more riding on the outcome than Philadelphia’s.

McClinton worked on school funding for Williams, who has a reputation for wangling education dollars out of the cautious grip of Republicans who now dominate the General Assembly.

Workforce training is another mission McClinton has adopted. “I want my office to be a hub for everybody to seek training programs,” she said.

She has received a rack of endorsements from organized labor.

Adam Lang Wants To Rebuild

by Tony West Adam Lang is a candidate with a cause that strikes home.

His own home, in fact.

Like many of his neighbors, the 10-year resident of the Sharswood neighborhood in North Philadelphia has seen his house, in which he had invested much time and money, condemned by the City in order to expand the Bloomberg Philadelphia Housing Authority development.

Lang thinks that’s wrong and that’s crazy. Now he is campaigning for the open seat in the 195th Legislative Dist. so that he can help Harrisburg put brakes on Philadelphia’s mishandling of its unused real estate, which, he charges, keeps its residents poor and its government broke.

Adam Lang … property power to the people Public housing is just one example of bad land policy according to Lang. “PHA and the taxpayers are going to spend $500,000 per household to house 1,000 households,” he said. “If they simply gave $150,000 directly to each household, they could have housed 3,000 instead.”

Public housing also deprives poor people of equity, leaving

them unable to afford to move to areas where jobs are more plentiful, Lang noted. It traps them in job-starved communities instead.

Philadelphia doesn’t have a housing problem, it has an income problem,” Lang asserted.

It is better, he said, to “trust people to find their own resources” by giving them money to buy their own housing directly.

Bad land management goes far beyond PHA, as Lang sees it.

The City’s cumbersome bureaucracy has locked up 40,000 parcels of unused land. The solution? “Sell the properties, collect the property taxes – to fund the schools and other programs.”

In the House of Representatives, Lang will fight to impose fiscal discipline on the City by a state-level oversight board similar to PICA. Lang is a computer networking engineer. He and his wife Aldridk Gessa are active in Sharswood community life. He has sat on the board of Brewerytown-Sharswood Community Civic Association for seven years. Lang has served on the advisory councils of two neighborhood schools and ran a financial-literacy program at Roberts-Vaux HS.

“North Philadelphia, West Philadelphia and many other parts of the city have a blight problem from vacant land and boarded-up buildings,” says Adam Lang, candidate for the 195th Dist. “A lot of these blight problems are because City Hall refuses to let private individuals, residents, acquire land. Our elected officials let our neighborhoods run down as stockpile land for their own ends.”

Esler, a Tea Party activist who lost to Mullen in the Republican primary. Surfacing were pleas to Democrats to defect from Krueger-Braneky to Mullen – countered by pleas to Republicans to defect from Mullen to Esler.

In the end, Krueger-Braneky pulled through.

The other Aug. 4 special election matched up Republican Greg Rothman against Democrat Bob Charles for a seat vacated by GOP State Rep. Glen Grell (R-Cumberland). And there will be three more special elections a week later – on Tuesday, Aug. 11 – for Philadelphia’s 174th, 191st and 197th Legislative Dists. (all previously held by Democrats), two of which (the 191st and the 197th) were made vacant by house members who resigned following guilty pleas to publiccorruption charges.

Tuesday night, ADAM LANG, candidate for State Representative (195th Dist.) held a fundraiser at the home of WARD LEADERS MATT WOLFE and DENISE FUREY. The event was attended by Republicans and some Democrats from all over the city, including city council at-large candidate TERRY TRACY and Republican City Committee EXEC. DIR. JOE DeFELICE. 21ST WARD LEADER WALT VOGLER and 51ST WARD LEADER ANDREW GENTSCH along with a number of committee people and other Republican activists were there including MIKE DeNOIA (21st Ward) and ALDRIDK GESSA (29th Ward).

Lang, who has been very active in community affairs in his Sharswood neighborhood, is running on a platform primarily focused on addressing urban blight. He believes the Democrats who his neighbors have repeatedly put in office in Harrisburg and City Hall have ignored the neighborhood because they assume the area voters are a sure thing for any Democrat. Lang has repeatedly proven he will work for his neighbors. Hopefully, they will send him to Harrisburg.

Lang is running in a special election next Tuesday, Aug. 11, for the seat vacated by MICHELLE BROWNLEE who pled guilty to crimes associated with a sting operation conducted by the Pennsylvania Attorney General’s office under INTERIM AG LINDA KELLY. This column has on many occasions discussed the sting operation that took down Brownlee and was probably the (Cont. Page 18)

Right now, I’m in the very, very quiet city of Minneapolis, Minn. for the National Association of Black Journalists convention. I went to dinner at a place called the Newsroom with some friends and went walking around the city. That’s how I discovered just how quiet it is. Really quiet. Pin-drop quiet.

NABJ is celebrating its 40th anniversary here in Minneapolis and it’s kind of ironic that the organization has chosen a city this quiet to celebrate its existence.

I say this because there’s nothing quiet going on in the news business, especially when you’re talking about the part that people of color are playing in mainstream newsrooms.

If you look at any set of statistics that talks about the state of modern journalism, one of the things that should strike you, and that definitely strikes me, is that the number of people of color that are doing the job of professional journalism has gone down...way down.

And when you consider the fact America is well on its way to being a majority/minority country, that reality becomes a little head-scratching and makes the mission of NABJ and other organizations like it just that much more important.

Which is why in a lot of ways I’m here in Minneapolis to ask the following question of NABJ’s leaders: Is this the beginning of the end, or the end of the beginning?

Like most organizations with the mission of trying to improve the lot of Black folks, NABJ has had some issues with what my friend Amy calls “mission drift.” Its mission includes making sure when people are looking for journalists (Cont. Page 18)

Yo! Here we go again and this story sent to me from a Rich, a reader who lives in Pittsburgh, Pa. It will make you love the attitude of this police officer.

A motorcycle police officer stops a driver for shooting through a red light. The driver is a real jerk, steps out of his car and comes striding toward the officer, demanding to know why he is being harassed by the Gestapo!

The officer calmly tells him of the red-light violation. The motorist instantly goes on a tirade, questioning the officer’s ancestry, sexual orientation, etc., in rather-explicit offensive terms.

The tirade goes on without the officer saying anything. He continues to write the traffic ticket.

When the officer finished writing the ticket, he puts an “AH” in the lower right corner of the narrative portion of the ticket and underlines it. He then hands it to the violator for his signature. The guy signs the ticket angrily, and when presented with his copy points to the “AH” and demands to know what it stands for. The officer says, “That’s so when we go to court, I’ll remember that you’re an asshole!”

Two months later they’re in court. The violator has a bad driving record with a high number of points and is in danger of losing his license, so he hires an expensive lawyer to represent him. On the stand the officer testifies to seeing the man run through the red light. Under cross examination the defense attorney asks, “Officer is this a reasonable facsimile of the ticket that you issued to my client?”

The officer responds, “Yes, sir, that is the defendant’s copy, his signature and mine, same number at the top.” The lawyer questions, “Officer, is there any particular marking or notation on this ticket you don’t normally make?”

“Yes, sir, in the lower right corner of the narrative there is an ‘AH’ underlined.”

“And what does the ‘AH’ stand for, officer?”

“Aggressive and hostile, sir.” “Aggressive and hostile?”

“Yes, sir.” “Officer, are you sure it doesn’t stand for asshole?”

“Well, sir, you know your client better than I do.”

How often can you get an attorney to convict his own client?

TWO GREAT FIRST LADIES OF POLITICS passed – both at 92. Enez BRADY, mom of Congressman Bob BRADY and committeewoman and mother-in-law of Judge MELCHIORRE. The loss of four score and 10+2 years of wisdom (each) is a jolt and a loss. It is reported St. Peter can’t get a word in edgewise with them.... Judge Diane ANHALT handled the case of an ex-narc cop with firmness and fairness.

All needed in charged cases. Bravo.

Judge Paul PANEPINTO is in the race for State Supreme Court – as an independent. This might be good for DEMS, since the western part of our state has more high-court judges, so it could bring BALANCE – with Kevin DOUGHERTY also running. It is time for that! It is a loss for the GOP, which failed to assimilate Panepinto into its ranks — although he is much loved by members of both parties.... I was never a friend of Judge Fortunato PERRI, but the editorial slamming him seem CRUEL and unneeded. The man is very ill! They cite a few cases; but judges hear hundreds of cases. They never heard a case so are unqualified to comment. And they probably could not get elected as Dogcatcher (Animal Control Officer). “Crimes dismantled Traffic Court.” Malarkey!

Hearing Officer jobs did.

A neat little story on back pages stated that State Attorney General Kathleen KANE could find no evidence to charge the DA of Centre County. Not the front page like ANTI-KANE stories; and not the usual writer of Kane’s alleged wrongdoings (?). The same reporter should write pro- and con-Kane (Cont. Page 18)

Deepest condolences to CONGRESSMAN BOB BRADY on the loss of his mother ENEZ BRADY. The beautiful lady is survived by her three sons, six grandchildren, nine great grandchildren, and one great-great grandchild. Many elected officials traveled to Wynnewood, Pa. to attend Enez Brady’s viewing and funeral mass. The matriarch of the Brady family will be sorely missed, but will continue to influence the lives of her family through her great deeds and warm memories.

The passing of a parent is always difficult, but Brady will no doubt rally his family through this tough time just like he rallies the Philadelphia Democratic Party for big victories. Philadelphia Democrats are hoping for three big victories next Tuesday. Former STATE REP. and COUNCILMAN “SPECIAL” ED NEILSON is running in the special election for the 174th Legislative dist. He is trying to fill the Northeast Philadelphia house seat that was vacated by the election of JOHN SABATINA to the state senate.

The 191st and the 194th Legislative Dists. will also have a special election on Tuesday, Aug. 11. JOANNA McCLINTON, a former legal counsel to STATE SEN. ANTHONY WILLIAMS, is the endorsed Democrat for the 191st Legislative Dist., which includes portions of West and Southwest Philadelphia with Yeadon and Darby in Delaware County.

The third race is the 195th State House Race in Philadelphia. Democrat DONNA BULLOCK, ESQ. is on the ballot. The former aide to COUNCILMAN DARRELL CLARKE is expected to cruise to victory in this Democratic district in sections of North and West Philadelphia including Brewerytown, Strawberry Mansion and Fairmount.

Bullock, McClinton, and Neilson are expected to join LEANNE KRUEGER-BRANEKY in the State House on Aug. 25 for a swearing-in ceremony. Krueger Braneky with the help of GOVERNOR TOM WOLF beat two opponents to win the 161st Legislative District in Delaware County.

Another person hoping to join the soon-to-be State Reps with a significant electoral victory is GOV. TOM WOLF’S former CHIEF OF STAFF KATIE McGINTY. McGinty announced her candidacy this week with a video discussing her humble upbringing in Northeast (Cont. Page 18)

man’s investigation is pursuant to a grand-jury recommendation that she be indicted. The crimes are felonies and if convicted she will be disbarred.

These issues along with a number of other missteps and examples of bad judgment had not caused GOV. TOM WOLF to publicly question Kane’s ability to run the AG’s office. Last week, however, Wolf spokesman MARK NICASTRE said, “[We are] continuing to let the legal process play out. Obviously, we have watched the situation closely and staff has researched contingencies.”

The emails among a number of staffers, including Kane’s former chief of staff, reveal concerns that the AG’s office is an “unholy mess.” The internal correspondence also reveals the administration has considered replacements for Kane, including BRUCE BEEMER, the 1st Assistant AG. Kane recently took Beemer’s authority over personal affairs away from him and gave that power to AG CHIEF OF STAFF JONATHAN DUECKER. Kane promoted Duecker to chief of staff despite recommendations that she not only “not” promote him, but that she fire him. He has been accused of sexually harassing two female attorneys.

I am not sure what Wolf means by letting the “legal process play out.” Kane has refused to resign even if she is indicted. A conviction could take at least a year or more. Does he plan to sit by while the AG’s office is an “unholy mess”? He cannot fire her as she was elected, but he can publicly call for her resignation.

“At 10 p. m., Ben Donolow walked us into the District Attorney’s Office, present were Homicide Captain David Brown, no relation to the Commissioner, and Detective Raymond Kennedy. Also present were First Assistant District Attorney Richard Sprague, later a nationally known multi-millionaire tort lawyer; District Attorneys Robert Williams, later a judge; F. Emmett Fitzpatrick, later District Attorney of Philadelphia; and Richard Rosenbleeth, a newlyminted ADA, presently a Judge Pro Tempore.

“Ben Donolow had a flair for the dramatic and couldn’t resist a flowery statement. Seeing that my questioning had just about concluded, he jumped to his full five-feet-four and shouted, “And my client wants police protection!!”

“Sprague arched an eyebrow, “Why don’t you just take your client and get out of here?!”

“Ferguson owned a bar under a straw name at 13th and Filbert, around the corner from Philadelphia City Hall. All his men thought it was a good career move to drink in there so just on them alone it did business. I walked in one afternoon with my three-year-old daughter just so he would know it was a social call.

“His men were surprised to see me. The Hat looked uncomfortable. We went into a corner and I told him that I wanted him to talk to a friend of his and then get back to me. He agreed. No way I was going to say anything incriminating directly to him.”

“It’s no good coming in here, John,” he replied.

We arranged to meet two nights later in front of City Hall Annex, a block away.

“Meanwhile, I went down to 13th and Moyamensing Streets in South Philly to the home of Weasel Hogan. Weas was another old independent Irish bookmaker who had been around for years.

“I told Weas that I wanted him to offer Fergie $30,000 to tank the case in Pottsville. Weas agreed.

I told him to expect to hear from The Hat in the very near future. It was early evening. I stood on the sidewalk in front of City Hall Annex. At the appointed time, a plain Plymouth sedan pulled up to the curb. In it was Fergie and his Schuylkill County mistress, Clara Grazl. From what I could see, she was dressed for a night on the town in an expensive outfit with a big fox collar. Fergie never made any effort to hide his relationship with Clara. In fact, it seemed that he was very proud to have a mistress at his age, notwithstanding his wife.

Fergie got out of the car, looked around, and approached me. We shook hands.

“Hello, John. That’s Clara in the car.” He turned toward the car and Clara waved. “John, I’m hearing a lot of things such as that you want me dead and all. I don’t put much stock in it. You know I could lock you up every day if I wanted to and I don’t. This is just a job to me, John. I’ve got nothing personal against you.”

“Nor I you, Captain.”

“Well, I’m glad to hear that.”

“Did you talk to our friend?”

“I sure did. And that thing could have been easily worked out if he’d contacted me in the beginning. But the case is too far gone now. There’s nothing I can do now. It’s beyond my control. If that whore had done the right thing in the first place, none of this ever would have happened. You know I sent word to her for a meeting before any

Philly’s Famous Criminals John C. Berkery has captured the essence of Philadelphia’s more-colorful personalities, both the famous and infamous, in his to books, K&A Kid, Books One and Two. They are available on Amazon.com. They are a goldmine of facts, not fiction. He only wrote about events in which he had an involvement.

Big on his list is the true story of the burglary of John B. Rich’s Pottsville, Pa., mansion in 1959, one which led him to serve time.

“John B. Rich, the one-time Giovanni Baptiste Recchione, a penniless immigrant urchin from Sicily, became the owner of the Gilberton Coal Company, one of the largest in the region. Rich was also a principal in the giant Reading Anthracite, and a millionaire many times over.”

He describes in detail how three men robbed the mansion – $3,500 in cash and $20,000 in jewelry.

Berkery tracks the thieves’ movements as they returned to Philadelphia including a stop for “three dogs and soft drinks.”

He chronicles his entering his Penthouse club on the 33rd floor of the Lewis Tower building and had the club photog take a pic of him behind Henry Fonda who was there dining, a pic he used as an alibi when accused of being one of those in that robbery. It was sent to legendary publicist Sam Bushman, who made sure it appeared in the Daily News.

One of Berkery’s K&A pals, Barney Blaney, and his brother Richie, confesses to the Pottsville burglary, blaming night-club doll Lillian Reiss, who supposedly got the info from her “sugar-daddy,” Schuylkill County coal operator Clyde “Bing” Miller.

Berkery laments in keeping Blaney around “and that I had made a bad mistake taking him on the strength of old times.” He spends the summer of 1959 keeping up his routine, opened a fuel oil business, and took his young family to Disney World in California.

He gives an insight into the world of Barney “the Moon” Blaney, chronicling some of Barney’s burglary mishaps. Arrested on Dec. 5, 1959, “four months after the robbery of the Rich residence in Pottsville, the same trio, the Blaney brothers and another smalltime thief named Robert Poulson, were caught red-handed after having robbed a house in Philadelphia of $3,000 in cash, $4,000 in jewelry and furs, and 15 silver dollars along with a couple of large, old out-of-circulation dollar bills, all of which was found inside the automobile of the three suspects. That and the Rich burglary were almost identical.

“The Moon didn’t make bail like the other two and was remanded to the Eastern State Penitentiary to begin processing to serve the balance of his earlier paroles and probations. He immediately sent for his rat-keeper, none other than my old friend, “The Hat”, Captain Clarence J. Ferguson. Ferguson let him sweat it out for a couple of weeks but in January, 1960, Ferguson paid him a visit. Blaney was a facile liar in the first place; now, with a couple of weeks to think up a story and his ass on the line with the numerous cons on the blocks who were just waiting for him to enter the general prison population, Blaney told Ferguson that Lillian Reis masterminded a huge burglary in Pottsville and that his two co-defendants in the earlier case, Barney, Blaney and Poulson, were involved in it, leaving

himself out. “Instead, he claimed that I was involved in it along with Lillian’s boyfriend, Ralph Staino.

“He must have gotten any personal details such as Lillian’s description from Barney, his brother, because as far as I know, the Moon had never even seen Lillian, nor for that matter, Staino, in his life.

The Moon always hated me because he knew that I knew him for what he was. He also knew I had guys looking for him for burglarizing Kay Hogan.

“Blaney told Ferguson he’d trade this information for complete immunity from all past misdeeds and that he was sure he could get his brother and Poulson to sign statements. Ferguson was dismissive, saying he’d let him know, while secretly coming in his pants. This might make him immortal, if he played it right! Immediately upon leaving the penitentiary, Ferguson was scheming. A case like this, if it would stand up, would mean a huge amount of publicity for him, and Ferguson loved publicity almost as much as money. Almost. He also knew territorial turf and that he had no authority up in Schuylkill County.

“Ferguson was no stranger to Schuylkill County, however. He had a long-time mistress, Clara Grazl, who ran a beauty parlor in Mahanoy City, just up the road from Pottsville. They had a secret love child who would one day become a doctor in Canada. Ferguson had all records of her birth pulled from the county records and destroyed. He knew his way around the county, all right”.

“By April, 1960, I wasn’t living at home but in a nearby apartment in Cherry Hill, N.J. Sure enough, on April 4, Ferguson made his big swoop, nabbing Barney, Poulson, Lillian, and Junior. Even “Bing” Miller was grabbed.

“The Hat also came with his goon squad, along with Pennsylvania State Police and Camden County detectives and raided my house only to find I wasn’t there. This caused the news media to question my new neighbors who we didn’t even know and now would never know. Me, I was in California”.

Berkery writes why he surrendered to Ferguson, following false arrest of members of his family. A hostage exchange.

In chapter four, which he titles “Ferguson Butts In; Truth Butts Out,” he reveals how Ferguson sweated out some, threatened others, and eventually successfully had him arrested and sentenced. During this period, he hires Sen. Ben Donolow to defend him, who served him well until the end. For a brief period, he is also accused by Ferguson of killing Barney Blaney by shooting and dumping his body in the Ocean off Atlantic City. He and Lillian Reiss were released from jail.

“Lillian walked into the Celebrity Room on the night of her release. Don Rickles was on stage. He spotted her.

“Hey. Lillian! Barney Blaney just called!” He said, “Glug, glug, glug, glug!”

The audience roared with laughter. Except, that is, for Ralph Staino, Sr. and Willie Weisberg, who called the maitre d’.

“Tell that asshole to get over here as soon as he gets off the stage,” he said.

Burk (Berkerey) was released on bail May 9, 1961. On Jul. 27, 1961, one of the witnesses against Berkerey, Richard Francis Blaney, gets blown up in his car. He was 27. Berkery, Staino and Reiss

arrests were made.”

“No. I didn’t know.”

That much was true; I didn’t know! Lillian’s Reiss trail produced a hung jury. He was sentenced finally from 5 to 12 years.

Jimmy King, who wound up as head of Philadelphia Traffic Court, played a part in the reduction of the time Berkery did serve.

If you want an insight into life in state prison, Berkery provides it within the walls of Eastern State Penitentiary, and then again at Graterford, still the “college” for many Philadelphia criminals. During that period his buddy, Billy Sears, is killed by a man he had hustled. Berkery tells about some of the antics of his friends who had not yet been caught. It makes for hilarious reading. Life in Graterford had its funny moments as well. After serving more than four years, a day after his 34th birthday, he learns one of his appeal attempts had worked. The PA Supreme Court threw out his case.

“It reaffirmed the constitutional right to silence and a presumption of innocence. “Tacit admission” was history in Pennsylvania and anywhere else who still used it. The Pennsylvania Supreme Court was bound to follow Bruton.

“Since I lived in New Jersey, I never again came in contact with Ferguson between 1968, the year I came home, and 1975, the year he died in a nursing home, demented and friendless.

Maybe a year later, I walked in a place called the Cherry Hill Lodge, a hotel with a nice bar. The bartender was one of our Irish guys. As I walked past some corner tables, a familiar voice called out, ‘John.’ It was dark but I could make out the corpulent shape of Jimmy King. There was another man with him, older and a bit heavy, too. ‘John, come over here.’

I walked over and remained standing, shaking hands with Jimmy. ‘John, this is Judge Eagen.’ I looked down at Judge Eagen’s outstretched hand and shook it. Judge Michael J. Eagen of the Pennsylvania Supreme Court. Kingie wasn’t so full of shit after all. The judge looked up, an Irish twinkle in his blue eyes, ‘How did you like that opinion we wrote for you, John?’

I looked down. ‘I liked it just fine, Judge. Just fine.’

“That’s good. You deserved it. You’re a good Irishman. You were in there too long.’

“Upon my release, and ultimate vindication in 1968, it wasn’t long before Angelo Bruno sent for me. I guess he liked the way I had handled myself during the case in Pottsville. We met in the President Hotel in Atlantic City, near his summer house, and he was really glad to see me. He told me to be careful and anything I wanted to do he would help me all he could. “‘John, you’ve been around us for a dozen years. Did you ever get into any trouble around our fellows?’ Ange asked. ‘Never,’ I said. ‘And you never will,’ Ange replied. ‘That should tell you where you belong. We think a lot of you downtown.’ ‘I am with you, Ange. All the way.’ My future relationship with Angelo Bruno is detailed in Book Two.” He ends Book one with the death of Lillian Reiss at the age of 79 in December 2009.
