With the UNIONS In what can be considered the largest rally for Hillary Clinton staged in Pennsylvania on the eve of the April 26th presidential primary took place this past weekend under the sponsorship of the United Brotherhood of Carpenters and Joiners of America. General President Douglas J. McCarron was joined by Mayor Jim Kenney, Congressman Bob Brady and other state officials and endorsed candidates under a massive tent on the huge Carpenters Apprentice Training Center grounds in the far Northeast. Packed on seats and standing were over 2,000 Union members and officers. It marked the first appearance of the newly reorganized union which covers most of the states in the Northeastern section of the country. President McCarron brought the crowd to standing

Councilman Oh To Host Drug Community Meetings Councilman at Large David Oh will take to the neighborhoods of Philadelphia for a series of seven community meetings regarding the heroin and opioid crisis. The community meetings come as a result of a resolution the Councilman passed through City Council which authorized the holding of public hearings pursuant to City Council’s declaration of 2016 as “The Year to Combat the Heroin Abuse Epidemic in Philadelphia.” The resolution also called for the development of a strategy to effectively address the heroin epidemic as an urgent local health priority. The first hearing is scheduled to take place Friday, May 20 in the Public Health &
Human Services Committee, chaired by 8th Dist. Councilwoman Cindy Bass. Before then, Oh will visit Northeast Philadelphia, the Manayunk/ Roxborough area, the River Wards, North Philadelphia, West Philadelphia, and South Philadelphia to gain a comprehensive perspective of the epidemic from local residents. Schools and recreation centers across Philadelphia have volunteered to open their doors for these important meetings. All community members are welcome to share their suggestions and experiences. The Councilman hopes the community meetings will help engage citizens and provide insights from everyday people who deal with drug abuse in preparation for the May 20 hearing. “This is an issue that needs community input if we’re going to take action to solve the epidemic in our neighborhoods,” the Councilman said. “Our experts and officials can provide leadership, but it’s the local residents who will ulti-

Donatucci Reports State Fire Assistance Grants State Rep. Maria Donatucci (D-S. Phila.) announced the State Dept. of Conservation & Natural Resources is accepting applications for its Volunteer Fire Assistance grant program, aimed at saving lives and protecting property in unprotected or inadequately protected rural areas. The VFA grant provides assistance to state foresters and other officials for their efforts to aid local forces in rural areas or communities with under 10,000 residents, to prevent and control fires threatening human life, livestock and their natural surroundings. “Our firefighters lay their lives on the line every day to keep us safe and protect our environment,” Donatucci said. “The least we can do is make sure they have the updated equipment they need to do their jobs.”

Both organizations represent hundreds of thousands of Pennsylvanians in every corner of the state. Two weeks ago, Shapiro released his plan to hold the fracking industry accountable. For Auditor General, neither Democrat Eugene DePasquale of York County nor Republican John Brown from Northampton County has opposition. For sure they will battle in November. A new clergy organization has been formed in Philadelphia, called the Greater Philadelphia Clergy Union, at Berachah Baptist Church,6327 Limekiln Pike in the West Oak Lane section of Philadelphia last Thursday. Its first president is Bishop R. Daniel Sutton, II, senior pastor at Zoe Bible Fellowship Baptist Church in North Philadelphia who announced the group’s founding. He stressed his group would concentrate on educa-
tion, and community empowerment, stating, “This organization has not been created to compete with the fine work of the Black Clergy of Philadelphia & Vicinity, the Philadelphia Council of Clergy, the Baptist Pastors & Ministers Conference of Philadelphia & Vicinity, or any other alreadyexisting clergy organization. A group of us pastors and ministers, from across the state of Pennsylvania, are members of some of the above listed organizations.” He added, “The GPCU is simply a group that will zero in on the poverty we see in Philadelphia. A group of Democratic and Republican State Senators have joined Lt. Gov. Mike Stack to express support for adopting a two-year State budget cycle to replace the current annual process. Just Vote NO! To Ballot Question 2 There is a movement to disenfranchise Philadelphia and its visitors. Sometimes it is weak and fails. This time it is strong and very doable. This one is on the ballot. And voters always in the majority vote “yes” regardless of the Question. Ballot Question two will disenfranchise again. It greatly aggravates us who cover the political and legislative world of this state and city. Ballot 2 abolishes Traffic Court, but only in Philadelphia. Every other county will have its traffic court in the form of District Judges. A yes vote would change the State of Pennsylvania Constitution. This change would take away the legal rights of Philadelphians as citizens to have a Community Court in Philadelphia. We cannot allow this vital process to be taken away from us! State Rep. W. Curtis Thomas reminds us the State of Pennsylvania’s Constitution allows for a Community Court in Philadelphia. This allows an individual, who has been or becomes versed in traffic laws, and is elected from the community and empowered to make a decision about your traffic situation, to hear your case in Traffic Court. If Ballot Question 2 is approved, everyone would have to go through Municipal Court and be represented by a member of the Pennsylvania Bar. Attorneys cost money. In Traffic Court, you could use your constitutional right to defend yourself. If more vote No than Yes, we would have the opportunity to repair a Philadelphia County issue. Rep. Thomas’ solution to resolve the issue is amending Title 42 (Judiciary and Judicial Procedure) of the Pennsylvania Consolidated Statues. ‘’Traffic Court’’ would function under the oversight of the President Judge of the Philadelphia Municipal Court. The title of that area will then be known as the ‘’Traffic Division’’. While the member of the Municipal Court in the General Division must be an attorney at law, a judge in the newly devised Traffic Division must either be an attorney or a person who has completed a course of training and instruction in the duties of the office and pass an examination. They will also have been selected as per the Pennsylvania Election Code. An annual reporting requirement with the General Assembly will include how funding was allotted; the number of cases that came before the Traffic Division; how the cases were resolved by the Traffic Division. This assures both residents and visitors of Philadelphia their due rights and protection under the Pennsylvania Constitution of a Community Court. It also establishes a greater accountability for an essential entity and part of the State’s Constitution and our civic rights in Philadelphia!

The way you can tell that something that someone has said is significant is by how long that something remains in the public consciousness. For example, if you say “I have a dream…” everyone knows you’re talking about the Rev. Dr. Martin Luther King, whether your 9 years old or 90. “’Tis better to be silent and be perceived a fool than to open your mouth and remove all doubt” is one of my favorite sayings from author Mark Twain. But the one saying that everyone who’s even peripherally involved in politics should be able to repeat comes from the late Speaker of the House, Massachusetts Democrat Tip O’Neil. That saying: “All politics is local.” While the eyes of the world will be on Pennsylvania because it’s the next stop in the circus known as the 2016 Presidential Elections, we have some local races that we need to keep our eyes on here in Philadelphia. And no, I’m not referring to the race for the Democratic 2nd Congressional Dist. between Chaka Fattah (the incumbent), State Rep. Dwight Evans, Brian Gordon and Dan Muroff, nor am I referring to the Democratic Senate primary that features Joe Sestak, Katie McGinty and John Fetterman. I’m also not talking the Attorney General’s office, despite the fact this race is actually pretty interesting. Former Allegheny County District Attorney Steven Zappala’s campaign was enough to get rivals – Mayor Jim Kenney and State Sen. Anthony H. Williams – to team up for a commercial. Former (Cont. An interesting aspect of the race for the United States Senate is the influence of outside money. Essentially all of the interest groups not from Pennsylvania back KATIE McGINTY. It will be interesting to see if JOE SESTAK or JOHN FETTERMAN make a big deal over the fact that they are homegrown and home-supported. Most Pennsylvanians are probably wary of outside influences in their own states political campaigns, but this is what happens today in America. The most recent polls have Sestak with a fairly substantial lead, but the McGinty money coming from the Washington Beltway will likely have an influence in the race. Fetterman, although clearly the most progressive, has not been able to garner the same contributor base that presidential candidate Bernie Sanders has. Sanders receives small contributions from progressives all over the country and has raised over $50 million so far. That is a relatively new trend which was expertly cultivated by PRESIDENT BARACK OBAMA’S fundraising machine. While lagging the other candidates in fundraising, Fetterman has stayed above the fray. He has done nothing to hurt his stature and his respectable run, regardless of the final tally, will only help him to become a progressive voice in Pennsylvania. The beautiful sunshine on the audience and stage gathered on the Ben Franklin Parkway for the annual Holocaust remembrance ceremony. The President of the Jewish Federation Board BUD NEWMAN, along with government-relations specialist ROBIN SCHATZ, assembled an outstanding program. There were a number of Holocaust survivors in attendance and their testimony provides hope for the future. Also in attendance was CHUCK FELDMAN, the architect of the Northeast Philadelphia Holocaust Awareness Museum. Chuck has been able to garner the support of several local politicians, including former Senator and now LT. GOV. MIKE STACK and STATE SEN. JOHN SABATINA. Feldman has expanded the educational programs into the thousands. On the podium were several notable elected officials, including DWIGHT EVANS, who is running for Congress, and his opponent the incumbent CHAKA FATTAH. The lone Jewish MEMBER OF CITY COUNCIL ALAN DOMB presented a citation. He was joined by his City Council colleague, the newly elected AL TAUBENBERGER, a Republican from the Northeast. (Cont. Page 37)

Yo! Here we go again with these memories from the internet. Those born in the 1930s and early ’40s exist as a very special age. We are the “last ones.” We are the last, climbing out of the depression, who can remember the winds of war and the war itself, with fathers and uncles going off. We are the last to remember ration books for everything from sugar to shoes to stoves. We saved tinfoil and poured fat into tin cans. We saw cars up on blocks because tires weren’t available. We are the last to hear Roosevelt’s radio assurances and to see gold stars in the front windows of our grieving neighbors. We can also remember the parades on Aug. 15, 1945; VJ Day. We are the last who spent childhood without television; instead imagining what we heard on the radio. As we all like to brag, with no TV, we spent our childhood “playing outside until the street lights came on.” We did play outside and we did play on our own. The lack of television in our early years meant, for most of us, that we had little real understanding of what the world was like. Our Saturday afternoons, if at the movies, gave us newsreels of the war and the holocaust sandwiched in between westerns and cartoons. As we grew up, the country was exploding with growth. In the late ’40s and early ’50s the country seemed to lie in the embrace of brisk but quiet order as it gave birth to its new middle class. Our parents understandably became absorbed with their own new lives. They were free from the confines of the depression and the war. They threw themselves into exploring opportunities they had never imagined. Most of us had no life plan, but with the unexpected virtue of ignorance and an economic rising tide we simply stepped into the world and went to find out. We entered a world of overflowing plenty and opportunity; a world where we were welcomed. Based on our naïve belief that there was more where this came from, we shaped life as we went. We enjoyed a luxury: We felt secure in our future. Of course, just as today, not all Americans shared in this experience. Depression poverty was deep-rooted. Polio was still a crip(Cont. Page 39)

FACEBOOK had comments on states where it is illegal to collect rain water, which were met with posts that Philly just charges you for it each month... SO SAD that State Rep. Mark COHEN, at the apex of a long career, was not endorsed by the Democratic Caucus. Cohen worked long and hard to get the Medical Marijuana bill into law, and was a key player in the building of the Philly Veterans Home. Electing a younger person will not solve the many problems in a district overnight. WISDOM is more important than cash. State Rep. Vanessa BROWN has events for her constituents each week. Her free barbering and cosmetology course was a high success. Eastern Star members like Rep. BROWN work for the needy as often as they breathe. To include her in a sting is the ultimate in sleazebagism.... An article blasted that Chaka FATTAH’S lawyers attacked the evidence of the prosecutors. So what? That is what a defense lawyer does. It is ALLOWED in America. Then we read that Fattah spends taxpayer money (Cont. Page 39)

She spoke as she always does in an inspired, articulate and persuasive manner. Judge Retirement Ballot Question Gets Lawsuit Three Democrats in the Senate have asked the courts to keep on the ballot the referendum about whether judges should be able to serve until they turn 75, extending the mandatory judicial retirement age by five years. The lawsuit, was filed last Thursday by State Sen. Daylin Leach, Senate Minority Leader Jay Costa (D-Allegheny) and State Sen. Christine Tartaglione (D-Kensington), who said she is among nearly 22,000 voters statewide who have already cast absentee ballots for primary.

Brian Gordon Finally Beats Petition Challenge The Pennsylvania Supreme Court affirmed the decision of the Commonwealth Court, ensuring Commissioner Brian Gordon will remain on the ballot for the Democratic Primary for the office of United States Congress in Pennsylvania’s 2nd Congressional Dist. This obviously poses a problem for beleaguered 2nd Dist. Congressman Chaka Fattah, since he formerly could count on strong support from the Montco end of his congressional district. Gordon’s assurance he stays on the ballot will no doubt take much of that cushion away from Chaka, making him
more vulnerable as he faces additional challenges from State Rep. Dwight Evans and Dan Muroff.
Philadelphia Republican Party Seeking Finance Director Republican Party Chairman Joe DeFelice is throwing out the dragnet to pull in a qualified political finance manager. He lists what is expected from an applicant: The finance manager works closely with chairman, executive board and donor relations. They oversee all aspects of the research, drafting and implementation of a citywide fundraising campaign plan. They will sit with clients, and conduct call time daily with candidates. They lead fundraising in identifying and soliciting funds for a significant fundraising campaign. They build broad, effective grassroots campaign including, but not limited to, coalition building. They oversee the development of all campaign fundraising. They will manage a finance committee
and coordinate with other committees and will work with comptroller to manage all aspects of campaign finance reporting requirements. Qualifications/Requirements: The finance director should have at least 2+ years of political organizing/campaign management experience, including experience with a city/statewide campaign in fundraising operations. Must have a proven track record of meeting goals. Must have demonstrated fundraising experience and knowledge of campaign funding sources. Must have demonstrated ability to work with diverse communities and serve as a team leader. It is my understanding Rafferty was unanimously supported by the 12-person Philadelphia State Committee delegation when the Pennsylvania Republican Party voted to endorse. Joe Peters was in attendance. The Pennsylvania race for AG is heating up especially on
the Democratic side. On the Republican side, Rafferty has the advantage of having the PAGOP endorsement. He has both prosecutorial and political experience, which will serve him well in the race and if he wins. Rafferty was a Deputy AG. His 13 years as a State Senator should give him the ability to navigate the politic issues faced by the AG. Peters has little political
support for his race and less name recognition than Rafferty. Peter’s biggest advantage is that he has top ballot position in the primary. His experience is almost exclu-
sively as a prosecutor or investigator. He worked in the AG’s office under Kane, but appears to have had the common sense to leave about a year after she took office. duce their encounters with potential criminals. Records show, he indicated, once inmates pass the age of 40, they begin to mature and understand why “crime does not pay. They are ready for rehabilitation, especially those who have landed in jail due to their drug addiction.” In the 21st century, law enforcement must develop new strategies that efficiently uses limited resources and establishes priorities. In addition, an agenda for action must be established and the leadership necessary to execute it must be provided. The agenda should have the following specific initiatives. He believes violent criminal offenders deserve to be sentenced for longer periods. “Violent crime in the United
States went down in the past in direct correlation with longer prison sentences for violent offenders,” he said. “Recently, violent crime is again on the rise. Violent offenders who bring physical harm to others should get long, stiff prison sentences their first time around. One miserable failure has been our parole system. Violent criminals out on parole are a significant percentage of repeat offenders. The time has come for parole to be abolished in Pennsylvania for any person convicted of a violent felony such as murder, rape, aggravated assault, kidnapping, armed robbery and sexual assault. These people should be given long flat sentences which should be served in their entirety.” Since Pennsylvania law
gives the Attorney General the power to adopt consumer-protection regulations, he notes, these regulations have the “force and effect of law. Under my watch, the AG of Pennsylvania will, via regulation, require the reporting of stolen/lost firearms to law enforcement within 48 hours. This would eliminate ‘cover’ for those who illegally sell guns to criminals and then claim that the gun was stolen when it shows up in a commission of a crime.” He laments, “Creeping federalism of local crimes has led to federal prisons being occupied by drug dealers and users rather than violent criminals and criminals dangerous to national security. Also, a lot of duplication of effort and expense goes on.”

He is recognized as a leading and outspoken voice on behalf of crime victims and the law-enforcement community. DA Morganelli is also an experienced courtroom prosecutor who has personally and successfully tried to verdict over 20 1st-degree murder cases including a conviction in a case in which the body of the victim was never located. He has argued 1st-degree murder cases in both the State and federal appellate courts. DA Morganelli is often seen on national television. He has appeared on “60 Minutes”, “The Nancy Grace Show” and has been a guest on “The O’Reilly Factor”, “The Lou Dobbs Show”, “Connie Chung Tonite” and “Donahue”. Cases that he prosecuted have been the subject of documentaries aired on HBO, A&E Network, “America’s Most Wanted” and the Discovery Channel. Sterling House Publishing of Pittsburgh, Pa. released his first book, The D-Day Bank Massacre: The True Story Behind the Martin Appel Case. Just turned 60, Morganelli knows illegal guns must be taken off the streets. He says, “Much of the illegal trafficking of guns is by gangs with multiple state connections. We need a special state gang con-
trol division to go after them.” He feels the criminal-justice system is lopsided. There are too many suffering from mental illness who find themselves in jails for a variety of cases, many because of low-level crimes. They, along with other low-level, non-dangerous inmates need to be given a second chance. “Once out of jail and free of any criminal activity for a specific number of years, they should be able to easily get their records expunged. Most can’t find jobs. We have lost two generations of employable people because of those records.” As for police and other custodians of the law, he strongly believes they need to be supported. by Joe Shaheeli Every County in Pennsylvania has its own District Attorney. Yet only one is a record-setter, getting elected seven times by the critical voters of Northampton County. He was first elected District Attorney at the age of 35 in 1991. Since then he has been relected every four years. His county’s voters love him. Another former DA with a similar growing voter base was Philadelphia County’s “tough cookie”, Lynne Abraham, who probably would still be in that seat had she chosen to continue in that office. Besides sharing that reputation, John Morganelli proudly points to Lynnwe Abraham’s endorsement of his campaign to win the Democratic nomination for Pennsylvania Attorney General next Tuesday. District Attorney John Morganelli came to the Public Record offices recognizing he is an underdog with the Democratic Party and organizedlabor support already behind the candidacy of Stephen Zappala. He also knows Josh Shapiro, of neighboring Montgomery County, has the support of some of the city’s labor leaders. Yet, of the three seeking the Democratic nomination for Attorney General, he knows the city best. He earned his law degree at Villanova. His son is a graduate from Villanova and his daughter is a resident in Germantown, working in a Center City office. River-Deepening $$$ Congressman Bob Brady (D-Phila.) announced the final federal portion for the $364 million project to deepen the Delaware River main channel has been appropriated in the House’s Energy and Water Appropriations Bill for Fiscal Year 2017. Brady has fought for the project since he first came to Congress in 1998 in spite of multiple attempts to remove funding from spending bills. And, when the project was revived after over a 10-year delay he reached out to Vice President Biden to help ensure that the funding wasn’t redirected to New York. The deeper channel will allow larger ships to serve the Port of Philadelphia, making
the port more competitive and help create thousands of new jobs. According to the Maritime Exchange for the Delaware River & Bay, the economic impact of cargo activity on the Delaware River Port Complex equates to $53 billion contribution to the regional economy; $7.8 billion in wages and salaries; $781 million in state and local taxes; and, 135,000 direct, indirect and induced jobs. Congressman Brady said, “The Delaware River ports contribute mightily to the regional economy and the numbers will grow once the river deepening is completed in 2017. This is a great day for the port and our entire region.”

One of the more-interesting races in this category is the 190th Dist., which has not one, not two, but six candidates vying for the Democratic nomination. Incumbent Vanessa Lowery Brown was among the folks swept up in the Tyron Ali sting and instead of taking a plea like the rest of the elected officials, she’s headed for trial. Morgan Cephas, Jestine Johnson, Steven Jones and Edwin Santana are taking on newly elected (and when I say ‘newly’, I mean last month) State Rep. Lynwood Savage. He won the seat in the special election that became necessary when State Rep. Louise Williams Bishop resigned as part of a plea agreement in the Tyron Ali case. There are also two ballot questions on next week’s ballot. One would abolish Philadelphia Traffic Court, which I thought had already been abolished, and the other would make the Mayor’s Commission on African American Males an independent commission. So don’t get stuck at the top of the ticket, although I can see where the “Hillary and Bernie and Donald and Ted and John Show” might be interesting. All politics is local. Remember that when you step into the voting booth on Tuesday.

Answer: Bankruptcy lawyers spend a lot of time working with and thinking about the Bankruptcy Code, which is the series of federal laws that govern what happens in any bankruptcy case. We even speak in “Code,” referring to things by their section numbers, like “341 meetings” or “362 motions.” And we tend to assume a level of knowledge about bankruptcy that others, including our clients, may not have. For example, when I have a new client that wants to file bankruptcy, I give them a packet of information about what she needs to do (like credit counseling, dealing with bank accounts), paperwork to fill out, and a list of documents to bring in (like paycheck stubs, bank statements and tax returns). All of that information has a role in preparing a bank-

The war was over and the cold war, terrorism, climate change, technological upheaval and perpetual economic insecurity had yet to haunt life with insistent unease. Only we can remember both a time of apocalyptic war and a time when our world was secure and full of bright promise and plenty. We grew up at the best possible time: a time when the world was getting better. We are the “last ones”.

You must file a list of property, debts, and a budget with the court, and you must provide certain documents, like paystubs and tax returns, to the trustee and the court. And as time goes by, you are shooting at a moving target: Credit-counseling certificates expire, paycheck records have to be updated, you get a new bank statement every month. So it’s important that you know what you need to provide, and when you need to provide it. A few years ago I had a particularly difficult case in which filing was delayed several times. If we had paycheck stubs up to date, we didn’t have bank statements; by the time the client brought in the bank statements, we needed more pay stubs. I finally sat down with the client to explain we needed everything up to the current date at one time. They said, “You never said that you needed it all at once,” and I realized she was right. Although it was implied, nothing in my paperwork said that I needed everything all at once. I had failed to clearly communicate
what I needed her to do. Needless to say, I remedied that particular deficiency, but I’m sure there is still room for improvement. When you start answering all the questions and putting together copies of all the documents your bankruptcy attorney is going to ask you for, you could be forgiven for thinking that your attorney is just pulling your leg, or torturing you. But there really is a reason for everything we ask for. Some of it is needed because your attorney will have to provide the documentation to the trustee in your case, or to the court. And some of it is to protect you, to make sure that there isn’t some potential problem lurking that will change the expected outcome of your case. We may not be great at explaining why we need all the information we ask for. And frankly, you may not want a detailed answer – my clients’ eyes tend to glaze over when I start talking about such things. But there is a reason, and we do need it all.
